STATES WITH LEGAL CANNABIDIOL (CBD)

While 33 stated have legalized medical marijuana, the remaining 17 states have all passed laws allowing the use
of cannabidiol (CBD) extract, usually in oil form, with minimal tetrahydrocannabinol (THC), and often for the
treatment of epilepsy or seizures in seriously ill children. CBD, one of the 400+ ingredients found in marijuana,
is not psychoactive.
ProCon.org does not consider passing a CBD-specific law to be the equivalent of making medical marijuana
legal because these laws do not legalize use of the marijuana plant for medical purposes. See our resource on
the legal medical marijuana states for more information.
1. Alabama
On Apr. 1, 2014, Alabama Governor Robert Bentley signed SB 174 , known as “Carly’s Law,” which allows
an affirmative defense against prosecution for CBD possession by people suffering from a debilitating epileptic
condition. The law states that “a prescription for the possession or use of cannabidiol (CBD) as authorized by
this act shall be provided exclusively by the UAB [University of Alabama at Birmingham] Department for a
debilitating epileptic condition.” Since marijuana is illegal under federal laws, doctors are not allowed to write
“prescriptions” for it. The states that have legal medical marijuana allow doctors to “recommend” it.
On May 4, 2016, Gov. Bentley signed HB 61 into law. Known as Leni’s Law, the bill provides an affirmative
defense for possession of CBD oil “for specified debilitating conditions that produce seizures.”
2. Georgia
On Apr. 16, 2015 Georgia Governor Nathan Deal signed HB 1 (Haleigh’s Hope Act) into law, allowing the
use of cannabis oil that is contains no more than 5% THC. According to the Georgia Department of Public
Health, the law did “not address how low THC oil is made, purchased or shipped. The law only creates a
procedure to ensure qualified persons will be protected from prosecution for having it in their possession.” On
Apr. 17, 2019, Gov. Brian Kemp signed a bill that permits in-state production/sale of marijuana oil and allows
growing licenses for up to six private companies, effective July 1, 2019.
The Georgia Department of Public Health issues Low THC Oil Registry Cards ($25 fee) to qualifying patients
with one of 16 conditions: cancer, ALS, seizure disorders, multiple sclerosis, Crohn’s disease, mitochondrial
disease, Parkinson’s disease, sickle cell disease, Tourette’s syndrome, autism spectrum disorder, when (a)
patient is 18 years of age or more, epidermolysis bullosa, Alzheimer’s disease, AIDS, peripheral neuropathy,
hospice program patients, intractable pain, and PTSD.
3. Indiana
On Apr. 27, 2017, Gov. Eric Holcomb signed HB 1148 into law, allowing the use of cannabidiol that is at
least 5% CBD and contains no more than 0.3% THC for treatment-resistant epilepsy.
On Mar. 21, 2018, Gov. Holcomb signed SB 52 into law, which allows distribution and retail sail of “low-
THC hemp extract,” defined as a product “(1) derived from Cannabis sativa L. that meets the definition of

industrial hemp; (2) that contains not more than 0.3% delta-9-THC (including precursors); and (3) that contains
no other controlled substances.”
4. Iowa
On May 30, 2014, Iowa Governor Terry Branstad signed SF 2360 into law, saying “This bill received
tremendous support and truly shows the power of people talking to their legislators and to their governor about
important issues to them, to their families and to their children.”
On May 12, 2017, Governor Branstad signed HF 524 into law. According to the Iowa Department of Health
Office of Medical Cannabidiol Website (accessed Mar. 15, 2018), “a person may recommend, possess, use,
dispense, deliver, transport, or administer cannabidiol if the recommendation, possession, use, dispensing,
delivery, transporting, or administering is in accordance with new chapter 124E of the Iowa Code.”
The Office of Medical Cannabidiol issues registration cards and the law “requires medical cannabidiol
dispensaries to begin dispensing to patients in Iowa by December 1, 2018.”
5. Kansas
On May 14, 2018, Governor Jeff Colyer signed SB 282 into law, which allows the use and sale of CBD that
contains no THC.
On May 20, 2019, Governor Laura Kelly signed HB 2244 (“Claire and Lola’s Law”) into law, allowing the
use of CBD containing no more than 5% THC to treat debilitating medical conditions “for which the patient is
under treatment by a licensed physician.”
6. Kentucky
On Apr. 10, 2014, Kentucky Governor Steve Beshear signed SB 124. The law excludes from the definition of
marijuana the “substance cannabidiol, when transferred, dispensed, or administered pursuant to the written
order of a physician practicing at a hospital or associated clinic affiliated with a Kentucky public university
having a college or school of medicine.” The law does not address how patients may obtain the CBD.
7. Mississippi
On Apr. 17, 2014, Mississippi Governor Phil Bryant signed HB 1231 , “Harper Grace’s Law,” which allows
for cannabis extract, oil, or resin that contains more than 15% CBD and less than 0.5% THC. “The CBD oil
must be obtained from or tested by the National Center for Natural Products Research at the University of
Mississippi and dispensed by the Department of Pharmacy Services at the University of Mississippi Medical
Center.” The law also provides an affirmative defense for defendants suffering from a debilitating epileptic
condition who accessed the CBD oil in accordance with the requirements set forth in the bill and is effective
July 1, 2014.
Governor Bryant released the following statement to the media on Apr. 17, 2014:
“The bill I signed into law today will help children who suffer from severe seizure disorders. Throughout the
legislative process I insisted on the tightest controls and regulations for this measure, and I have been assured
by the Mississippi Bureau of Narcotics that CBD oil is not an intoxicant. The outcome is a bill that allows this
substance to be used therapeutically as is the case for other controlled prescription medications. I remain
opposed to any effort that would attempt to legalize marijuana or its derivatives outside of the confines of this
bill.”

On Mar. 20, 2017, Gov. Bryant approved SB 2610 , which amended the state’s CBD law to “clarify use in
research of seizures and other medical conditions.” The bill allows other pharmacies to dispense CBD in
addition to the University of Mississippi Medical Center, with federal and state regulatory approval.
8. North Carolina
On July 3, 2014, North Carolina Governor Pat McCrory signed HB 1220 into law. The bill allowed
universities to conduct clinical trials using CBD oil that was less than 0.3% THC and at least 10% CBD only for
the treatment of intractable epilepsy.
On July 16, 2015, Gov. McCrory signed HB 766 , which amended the CBD law.
According to the North Carolina Department of Health and Human Services (DHHS), “hemp extract must be
composed of less than nine-tenths of one percent (0.9%) tetrahydrocannabinol (THC) by weight, at least five
percent (5%) cannabidiol (CBD) by weight and may contain no other psychoactive substances.” By law,
patients are allowed to use and possess CBD but it remains illegal to cultivate or produce hemp extract in the
state. People in possession of the DHHS Caregiver Registration letter are allowed to carry hemp extract outside
their homes.
9. Oklahoma
On Apr. 30, 2015, Oklahoma Governor Mary Fallin signed HB 2154 , known as Katie’s Law, which allows
the use of cannabis oil that is no more than 0.3% THC for the treatment of severe forms of epilepsy. Fallin
stated at the signing:
“This bill will help get sick children potentially life-changing medicine. By crafting the legislation in a way that
allows for tightly controlled medical studies, we can ensure we are researching possible treatments in a
responsible and scientific way. The CBD oil we are studying is a non-intoxicating derivative of marijuana. It is
not marijuana, and it is not anything that can make you ‘high.’ This law has been narrowly crafted to support
highly supervised medical trials for children with debilitating seizures. It is not a first step towards legalizing
marijuana, and I will never support the legalization of marijuana in Oklahoma.”
On May 13, 2016, Gov. Fallin signed HB 2835 into law. As of Nov. 1, 2016, the law includes adults and adds
“spasticity due to multiple sclerosis or due to paraplegia, intractable nausea and vomiting, and appetite
stimulation with chronic wasting diseases” to the list of approved conditions.
On Apr. 17, 2017, Gov. Fallin signed HB 1559 , amending the law (effective Nov. 1, 2017), to exclude from
the definition of marijuana “any federal Food and Drug Administration-approved cannabidiol drug or
substance.”
10. South Carolina
On June 2, 2014, South Carolina Governor Nikki Haley signed S 1035 into law. “Julian’s Law” pertains to
people who obtain a written certification signed by a physician “stating that the patient has been diagnosed with
Lennox-Gastaut Syndrome, Dravet Syndrome, also known as ‘severe myoclonic epilepsy of infancy’, or any
other severe form of epilepsy that is not adequately treated by traditional medical therapies and the physician’s
conclusion that the patient might benefit from the medical use of cannabidiol.” Those patients may use CBD oil
that is less than 0.9% THC and more than 15% cannabidiol, which is to be provided by the Medical University
of South Carolina in a study to determine the effects of CBD on controlling seizures.

11. South Dakota
On Mar. 17, 2017, South Dakota Governor Dennis Daugaard signed SB 95 into law. The law added
cannabidiol to the list of Schedule IV controlled substances and excluded it from the definition of marijuana,
but specified that the CBD must be a product approved by the United States Food and Drug Administration
(FDA).
12. Tennessee
On May 16, 2014, Tennessee Governor Bill Haslam signed SB 2531 into law. The bill allows the use of
cannabis oil containing cannabidiol (CBD) that has less than 0.9% THC “as part of a clinical research study on
the treatment of intractable seizures when supervised by a physician practicing at… a university having a
college or school of medicine.” The study is authorized for four years.
On May 5, 2015, Governor Haslam signed SB 280 into law. The bill allows the use of CBD oil that is less
than 0.9% THC and that is “obtained legally in the United States and outside of” Tennessee. The bill went into
effect immediately.
13. Texas
On June 1, 2015, Texas Governor Greg Abbott signed SB 339 , which allows the use of cannabis oil that is no
more than 0.5% THC and at least 10% CBD for the treatment of intractable epilepsy. The bill requires patients
to get approval from two certified specialists.
Governor Abbot stated: “There is currently no cure for intractable epilepsy and many patients have had little to
no success with currently approved drugs. However, we have seen promising results from CBD oil testing and
with the passage of this legislation, there is now hope for thousands of families who deal with the effects of
intractable epilepsy every day.”
Gov. Abbott signed HB 3703 on June 14, 2019, expanding the approved conditions to include medical seizure
disorders, multiple sclerosis, spasticity, terminal cancer, Alzheimer’s, Parkinson’s, Huntington’s, autism, and
ALS.
The law as written requires physicians to “prescribe” CBD, which would break federal law. States with legal
programs allow doctors to “recommend” as opposed to prescribe. However, the Texas Compassionate Use
Program says that “prescription” is defined as “an entry in the compassionate-use registry” and three dispensing
organizations were licensed by Dec. 15, 2017. “On June 10, 2019, Governor Greg Abbott signed House Bill
1325 into law, to allow for the production, manufacture, retail sale, and inspection of industrial hemp crops and
products in Texas. This includes products for human consumption that may contain cannabidiol, also known as
CBD, as well as certain other parts of the hemp plant… These products may not contain more than 0.3 percent
concentration of tetrahydrocannabinol (THC).”

14. Utah
On Mar. 21, 2014, Utah Governor Gary Herbert signed HB 105 , known as “Charlee’s Law,” which allows the
use and possession of marijuana extract, under certain conditions, by people with intractable epilepsy who have
a statement signed by a neurologist. The extract must be composed of less than 0.3% tetrahydrocannabinol
(THC) and at least 15% cannabidiol (CBD) by weight, and may not contain any other psychoactive substance.
The law goes into effect on July 1, 2014. The extract must be obtained in a sealed container from a laboratory

that is licensed in the state where it was produced, with a label stating the extract’s ingredients and origin, and
transmitted by the laboratory to the Utah Department of Health. The Utah Department of Health is required to
determine the details of the registration program.Kristen Stewart of the Salt Lake Tribune wrote in her article
“Utah Families Celebrate Passage of Cannabis ‘Charlee’s Law,'” dated Mar. 25, 2014:
“HB105 gives Utahns with epilepsy trial access to a non-intoxicating, seizure-stopping cannabis oil. But it
doesn’t take effect until July 1, 2014, and until then, Utahns can’t legally possess cannabis oil.
And obtaining it after that date will still risk violating federal law — and require jumping through a set of still-
vaguely defined hoops.
Currently, patients will need to travel to states where medical marijuana is legal and import cannabis oil
themselves. Doing so remains technically a violation of federal law.”
According to the Utah Department of Health Hemp Registry, “To legally possess hemp extract under Utah law,
an individual must apply for and obtain a hemp extract registration card from the Utah Department of Health,
Office of Vital Records and Statistics (OVRS).”
15. Virginia
On Feb. 26, 2015, Virginia Governor Terry McAuliffe signed HB 1445 into law. The bill stated: “In any
prosecution… involving marijuana in the form of cannabidiol oil… it shall be an affirmative defense that the
individual possessed such oil pursuant to a valid written certification… for treatment or to alleviate the
symptoms of… intractable epilepsy.” The oil must contain at least 15% CBD and no more than 5% THC.
A Feb. 26, 2015 quote on Gov. McAuliffe’s Facebook page stated: “The whole reason I got into politics was to
bring about a positive impact in the lives of families across the Commonwealth. This piece of legislation is a
tremendous step forward.”
On Mar. 9, 2018, Gov. Ralph Northam signed HB 1251 , expanding the list of conditions to “any diagnosed
condition or disease determined by the practitioner to benefit from such use.”
The Virginia Board of Pharmacy conditionally approved five pharmaceutical processor permits for CBD and
THC-A oil with the expectation that sales to patients begin in summer 2020.
On Apr. 6, 2020, Virginia Governor Ralph Northam signed SB 1015 into law. The law goes into effect on July
1, 2020 and will legalize CBD and THC-A medical cannabis products, protecting patients from arrest and
prosecution for possession.
16. Wisconsin
On Apr. 16, 2014, Wisconsin Governor Scott Walker signed AB 726 , known as Lydia’s Law, which states
that “any physician may provide an individual with a hard copy of a letter or other official documentation
stating that the individual possesses cannabidiol to treat a seizure disorder if the cannabidiol is in a form without
a psychoactive effect.” A release from the Governor’s office characterizes the law as “clearing the way for a
new treatment for children suffering from seizure disorders, pending FDA approval.”
On Apr. 17, 2017, Gov. Walker signed SB 10 into law, which replaced “seizure disorder” with “medical
condition,” broadening the original bill.

17. Wyoming
On July 1, 2015, HB 32 became law after Gov. Matt Mead neither signed the bill nor vetoed it, allowing the
use of hemp extract that contains at least 15% CBD and no more than 0.3% THC for the treatment of intractable
epilepsy.
The Wyoming Department of Agriculture (WDA) stated, “We do not anticipate a licensing program prior to the
start of 2019… The main hurdle the program faces is funding… This legislation had no appropriation attached
and in order to start the new program, the WDA needs funding to start and implement the program.”

and chemical synthesis, that contains any
quantity of the following substances, or that
contains any of their salts, isomers, and salts
of isomers when the existence of the salts,
isomers, and salts of isomers is possible
within the specific chemical designation, is
included in Schedule VI:
(1) Marijuana;
(2) Tetrahydrocannabinols;
(3) A synthetic equivalent of:
(A) The substance contained in the Cannabis
plant; or
(B) The substance contained in the resinous
extractives of the genus Cannabis;
(4) Salvia divinorum or Salvinorin A, which
includes all parts of the plant presently
classified botanically as Salvia divinorum,
whether growing or not, the seeds of the

described in this subdivision (a)(5),
regardless of numerical designation of atomic
positions, are included in this subdivision
(a)(5). The synthetic substances, derivatives,
or their isomers included in this subdivision
(a)(5) are:
(A) (i) Tetrahydrocannabinols, including
without limitation the following:
(a) Delta-1 cis or trans tetrahydrocannabinol,
and its optical isomers;
(b) Delta-6 cis or trans tetrahydrocannabinol,
and its optical isomers; and
(c) Delta-3.4 cis or trans
tetrahydrocannabinol, and its optical isomers.
(ii) Dronabinol in sesame oil and
encapsulated in a soft gelatin capsule in a
drug product approved by the United States
Food and Drug Administration is not a
tetrahydrocannabinol under this subdivision
(a)(5)(A);

the possession for sale or sale of up to
four pounds, of marijuana.
(d) “Level 2 offense” means the
possession for sale of four ounces or more
but less than eight ounces of, or the sale or
furnishing of one ounce or more but less
than two ounces of, a specified illegal
controlled substance, or the cultivation of
at least 50 but less than 75 plants, the
possession for sale of four pounds or more
but less than eight pounds, or the sale or
furnishing of more than one pound but
less than five pounds, of marijuana.
(e) “Level 3 offense” means the
possession for sale of eight ounces or
more but less than 16 ounces of, or the

pounds or more but less than 16 pounds,

(f) “Level 4 offense” means the
possession for sale of 16 ounces or more
of, or the sale or furnishing of four ounces
or more of, a specified illegal controlled
substance, or the cultivation of 100 plants
or more of, the possession for sale of 16
pounds of, or the sale or furnishing of
more than 10 pounds of, marijuana.

(a) Notwithstanding any other law, if
cannabidiol is excluded from Schedule I
of the federal Controlled Substances Act
and placed on a schedule of the act other
than Schedule I, or if a product composed
of cannabidiol is approved by the federal
Food and Drug Administration and either
placed on a schedule of the act other than
Schedule I, or exempted from one or
more provisions of the act, so as to permit
a physician, pharmacist, or other
authorized healing arts licensee acting
within his or her scope of practice, to
prescribe, furnish, or dispense that
product, the physician, pharmacist, or
other authorized healing arts licensee who
prescribes, furnishes, or dispenses that
product in accordance with federal law
shall be deemed to be in compliance with
state law governing those acts.
(b) For purposes of this chapter, upon the
effective date of one of the changes in
federal law described in subdivision (a),
notwithstanding any other state law, a
product composed of cannabidiol may be
prescribed, furnished, dispensed,

incapable of germination if these items exist
apart from any other item defined as
"marijuana" in this subsection (18).
"Marijuana" does not include marijuana
concentrate as defined in subsection (19) of
this section or prescription drug products
approved by the federal food and drug
administration and dispensed by a pharmacy
or prescription drug outlet registered by the
state of Colorado.
(b) Nothing in this subsection (18) or any
other provision of law shall restrict or
otherwise affect regulation of or access to:
(I) Marijuana that is authorized under
sections 14 and 16 of article XVIII of the
Colorado constitution and articles 11 and 12
of title 44; or
(II) Industrial hemp and derivatives
therefrom, as authorized by section 16 of
article XVIII of the Colorado constitution and
article 61 of title 35.
(c) House Bill 18-1295, enacted in 2018,
does not allow an entity with federal drug
administration approval or its agent to initiate
criminal, civil, or administrative proceedings
to prevent the nonpharmaceutical production,
sale, or distribution of naturally occurring
cannabinoid or cannabinoid extracts or restrict
the nonpharmaceutical production, sale, or
distribution of naturally occurring
cannabinoid or cannabinoid extracts.
(19) "Marijuana concentrate" means hashish,
tetrahydrocannabinols, or any alkaloid, salt,
derivative, preparation, compound, or
mixture, whether natural or synthesized, of
tetrahydrocannabinols.

(34.5) (a) "Synthetic cannabinoid"
means any chemical compound that is
chemically synthesized and either:
(I) Has been demonstrated to have
binding activity at one or more
cannabinoid receptors; or

(10) "Designer drug'' means a substance that
has a chemical structure substantially similar to
that of a controlled substance or that was
specifically designed to or may produce an
effect substantially similar to that of a
controlled substance. Examples of chemical
classes in which "designer drugs'' are found
include, but are not limited to, the following:
Phenethylamines, N-substituted piperidines,
morphinans, ecgonines, quinazolinones,
substituted indoles, arylcycloalkylamines,
cannabinoids, cathinones, and any synthetic
analogue of a controlled substance. "Designer
drug'' does not include any substance that was
manufactured, delivered or dispensed in
conformance with an approved new drug
application, or an exemption for investigating
use within the meaning of § 505 of the Federal
Food, Drug and Cosmetic Act (21 U.S.C. §
355), or that was manufactured, delivered or
dispensed in conformance with a registration
issued by the Attorney General of the United
States within the meaning of §§ 301-304 of the
Federal Controlled Substances Act (21 U.S.C.
§§ 821-824).
§ 4902A Definitions.
(10) "Medical marijuana oil'' means:
a. "Cannabidiol oil'' which is a processed
Cannabis plant extract that contains at least 15
percent cannabidiol but no more than 7 percent
tetrahydrocannabinol, or a dilution of the resin

milligrams of cannabidiol per milliliter but not

893.02 Definitions.— The following
words and phrases as used in this chapter
shall have the following meanings, unless
the context otherwise requires:
(2) “Cannabinoid receptor agonist”
means a chemical compound or substance
that, according to scientific or medical
research, study, testing, or analysis
demonstrates the presence of binding
activity at one or more of the CB1 or CB2
cell membrane receptors located within the
human body.
1(3) “Cannabis” means all parts of any
plant of the genus Cannabis, whether
growing or not; the seeds thereof; the resin
extracted from any part of the plant; and
every compound, manufacture, salt,
derivative, mixture, or preparation of the

dispensed, in conformance with s.
381.986. The term does not include hemp
as defined in s. 581.217 or industrial hemp
as defined in s. 1004.4473. The term does
not include a drug product described in s.
893.03(5)(d).
(4) “Controlled substance” means any
substance named or described in Schedules

substances are drug abuse laws.
(5) “Cultivating” means the preparation
of any soil or hydroponic medium for the
planting of a controlled substance or the
tending and care or harvesting of a
controlled substance. 1Note.—Section 1, ch. 2017-232,
provides that “[i]t is the intent of
the Legislature to implement s. 29,
Article X of the State Constitution by
creating a unified regulatory
structure. If s. 29, Article X of the
State Constitution is amended or a
constitutional amendment related to
cannabis or marijuana is adopted,
this act shall expire 6 months after
the effective date of such
amendment.” If such amendment or
adoption takes place, subsection
(3), as amended by s. 1, ch. 2017-
232, will read:
(3) “Cannabis” means all parts of

As used in this article, the term "low THC oil"
means an oil that contains an amount of
cannabidiol and not more than 5 percent by
weight of tetrahydrocannabinol, tetrahy-
drocannabinolic acid, or a combination of
tetrahydrocannabinol and tetrahydro-
cannabinolic acid which does not contain plant
material exhibiting the external morphological
features of the plant of the genus Cannabis.

(a) (1) Notwithstanding any provision of
Chapter 13 of this title, it shall be lawful for
any person to possess, purchase, or have under

THC oil if such substance is in a
pharmaceutical container labeled by the
manufacturer indicating the percentage of
tetrahydrocannabinol therein and:
(A) Such person is registered with the
Department of Public Health as set forth in
Code Section 31-2A-18 and has in his or her
possession a registration card issued by the
Department of Public Health; or
(B) Such person has in his or her possession a
registration card issued by another state that
allows the same possession of low THC oil as
provided by this state's law; provided,

however, that such registration card shall not
be lawful authority when such person has been
present in this state for 45 days or more.
(2) Notwithstanding any provision of Chapter
13 of this title, any person who possesses,
purchases, or has under his or her control 20
fluid ounces or less of low THC oil without
complying with paragraph (1) of this
subsection shall be punished as for a
misdemeanor.
(b) (1) Notwithstanding any provision of
Chapter 13 of this title, it shall be lawful for
any person to possess, purchase, or have under
his or her control 20 fluid ounces or less of low
THC oil if:
(A) Such person is involved in a clinical
research program being conducted by the
Board of Regents of the University System of
Georgia or any authorized clinical trial or
research study in this state or their authorized
agent pursuant to Chapter 51 of Title 31 as:
(i) A program participant;
(ii) A parent, guardian, or legal custodian of a
program participant;
(iii) An employee of the board of regents
designated to participate in the research
program;
(iv) A program agent;
(v) A program collaborator and their
designated employees;
(vi) A program supplier and their designated
employees;
(vii) A program physician;
(viii) A program clinical researcher;
(ix) Program pharmacy personnel; or
(x) Other program medical personnel;
(B) Such person has in his or her possession a
permit issued as provided in Code Section 31-
51-7; and
(C) Such substance is in a pharmaceutical
container labeled by the manufacturer

indicating the percentage of
tetrahydrocannabinol therein.
(2) Notwithstanding any provision of Chapter
13 of this title, any person who possesses,
purchases, or has under his or her control 20
fluid ounces or less of low THC oil without
complying with subparagraphs (A), (B), and
(C) of paragraph (1) of this subsection shall be
punished as for a misdemeanor.
(c) Notwithstanding any provision of Chapter
13 of this title, any person having possession
of, purchasing, or having under his or her
control more than 20 fluid ounces of low THC
oil but less than 160 fluid ounces of low THC
oil or who manufactures, distributes,
dispenses, sells, purchases, or possesses with
the intent to distribute low THC oil shall be
guilty of a felony and, upon conviction thereof,
shall be punished by imprisonment for not less
than one year nor more than ten years, a fine
not to exceed $50,000.00, or both.
(d) Notwithstanding any provision of Chapter
13 of this title, any person who sells,
manufactures, delivers, brings into this state,
purchases, or has possession of 160 or more
fluid ounces of low THC oil shall be guilty of
the felony offense of trafficking in low THC
oil and, upon conviction thereof, shall be
punished as follows:
(1) If the quantity of low THC oil is at least
160 fluid ounces but less than 31,000 fluid
ounces, by imprisonment for not less than five
years nor more than ten years and a fine not to
exceed $100,000.00;
(2) If the quantity of low THC oil is at least
31,000 fluid ounces but less than 154,000 fluid
ounces, by imprisonment for not less than
seven years nor more than 15 years and a fine
not to exceed $250,000.00; and
(3) If the quantity of low THC oil is 154,000
or more fluid ounces, by imprisonment for not

less than ten years nor more than 20 years and
a fine not to exceed $1 million.
(e) Subsections (c) and (d) of this Code section
shall not apply to a person involved in a
research program being conducted by the
Board of Regents of the University System of
Georgia or its authorized agent pursuant to
Chapter 51 of Title 31 as an employee of the
board of regents designated to participate in
such program, a program agent, a program
collaborator and their designated employees, a
program supplier and their designated
employees, a physician, clinical researcher,
pharmacy personnel, or other medical
personnel, provided that such person has in his
or her possession a permit issued as provided
in Code Section 31-51-7 and such possession,
purchase, sale, manufacturing, distribution, or
dispensing is solely for the purposes set forth
in Chapter 51 of Title 31.
(f) Subsections (c) and (d) of this Code section
shall not apply to a designated university,
pharmacy, or licensee under Article 9 of
Chapter 12 of Title 16, provided that such
possession, purchase, control, sale,
manufacturing, distribution, or dispensing is
solely conducted in accordance with the
provisions of Article 9 of Chapter 12 of Title
16.
(g) Nothing in this article shall require an
employer to permit or accommodate the use,
consumption, possession, transfer, display,
transportation, purchase, sale, or growing of
marijuana in any form, or to affect the ability
of an employer to have a written zero tolerance
policy prohibiting the on-duty, and off-duty,
use of marijuana, or prohibiting any employee
from having a detectable amount of marijuana
in such employee's system while at work.

PERSONAL USE OF CANNABIS
Section 10-5. Personal use of cannabis;
restrictions on cultivation; penalties.
(a) Beginning January 1, 2020,
notwithstanding any other provision of law,
and except as otherwise provided in this Act,
the following acts are not a violation of this
Act and shall not be a criminal or civil offense
under State law or the ordinances of any unit
of local government of this State or be a basis
for seizure or forfeiture of assets under State
law for persons other than natural individuals
under 21 years of age:
(1) possession, consumption, use,
purchase, obtaining, or transporting an amount
of cannabis for personal use that does not
exceed the possession limit under Section 10-

(a) Industrial hemp that is in the possession,
custody, or control of a person who holds a
license issued by the Department of
Agriculture permitting that person to cultivate,
handle, or process industrial hemp;
(b) Industrial hemp products that do not
include any living plants, viable seeds, leaf
materials, or floral materials;
(c) The substance cannabidiol, when
transferred, dispensed, or administered
pursuant to the written order of a physician
practicing at a hospital or associated clinic
affiliated with a Kentucky public university
having a college or school of medicine;
(d) For persons participating in a clinical trial
or in an expanded access program, a drug or
substance approved for the use of those
participants by the United States Food and
Drug Administration;
(e) A cannabidiol product derived from
industrial hemp, as defined in KRS 260.850; or
(f) A cannabidiol product approved as a
prescription medication by the United States
Food and Drug Administration;
(51) "Synthetic cannabinoids or piperazines"
means any chemical compound which is
not approved by the United States Food and
Drug Administration or, if approved, which
is not dispensed or possessed in accordance
with state and federal law, that contains

Chapter 94G: Section 1. Definitions
"Cannabinoid profile'', amounts, expressed as
the dry-weight percentages, of delta-nine-
tetrahydrocannabinol, cannabidiol,
tetrehydrocannabinolic acid and cannabidiolic
acid in a marijuana product. Amounts of other
cannabinoids may be required by the
commission.
"Hemp'', the plant of the genus Cannabis or any
part of the plant, whether growing or not, with
a delta-9-tetrahydrocannabinol concentration
that does not exceed 0.3 per cent on a dry
weight basis of any part of the plant of the
genus Cannabis, or per volume or weight of
marijuana product, or the combined per cent of
delta-9-tetrahydrocannabinol and
tetrahydrocannabinolic acid in any part of the
plant of the genus Cannabis regardless of
moisture content.
"Marijuana'' or "Marihuana'', all parts of any
plant of the genus Cannabis, not excepted
below and whether growing or not; the seeds
thereof; and resin extracted from any part of
the plant; and every compound, manufacture,
salt, derivative, mixture or preparation of the
plant, its seeds or resin including
tetrahydrocannabinol as defined in section 1 of
chapter 94C; provided, however, that

Subd. 16.Small amount.
"Small amount" as applied to marijuana
means 42.5 grams or less. This provision
shall not apply to the resinous form of
marijuana. The weight of fluid used in a
water pipe may not be considered in
determining a small amount except in cases
where the marijuana is mixed with four or
more fluid ounces of fluid.

(1) For purposes of sections 28-463 to 28-468:
(a) Cannabidiol means processed cannabis
plant extract, oil, or resin that contains more
than ten percent cannabidiol by weight, but
not more than three-tenths of one percent
tetrahydrocannabinols by weight, and
delivered in the form of a liquid or solid
dosage form; and
(b) Intractable seizures means intractable,
catastrophic genetic, or metabolic epilepsies;
Lennox-Gastaut Syndrome; epilepsies
consisting of drop seizures at risk for
significant bodily injury; or cluster seizures
that result in significant life-threatening apnea
after the trial and failure of at least three
antiepileptic therapies that directly address the
epilepsy in question.

§ 90-94.1. Exemption for use or possession
of hemp extract.
(a) As used in this section, "hemp extract"
means an extract from a cannabis plant, or a
mixture or preparation containing cannabis
plant material, that has all of the following
characteristics:
(1) Is composed of less than nine-tenths of
one percent (0.9%) tetrahydrocannabinol by
weight.
(2) Is composed of at least five percent (5%)
cannabidiol by weight.
(3) Contains no other psychoactive
substance.
(b) Notwithstanding any other provision of
this Chapter, an individual may possess or use
hemp extract, and is not subject to the
penalties described in this Chapter, if the
individual satisfies all of the following
criteria:
(1) Possesses or uses the hemp extract only
to treat intractable epilepsy, as defined in G.S.
90-113.101.
(2) Possesses, in close proximity to the
hemp extract, a certificate of analysis that
indicates the hemp extract's ingredients,
including its percentages of
tetrahydrocannabinol and cannabidiol by
weight.
(3) Is a caregiver, as defined in G.S. 90-
113.101.
(c) Notwithstanding any other provision of
this Chapter, an individual who possesses
hemp extract lawfully under this section may
administer hemp extract to another person
under the individual's care and is not subject
to the penalties described in this Chapter for
administering the hemp extract to the person

in a clinical trial or in an expanded
access program related to
administering cannabidiol for the
treatment of severe forms of epilepsy
pursuant to Article 18, Chapter 53,
Title 44, a drug or substance approved
for the use of those participants by the
federal Food and Drug Administration;
or
(vi) for persons, or the
persons’ parents, legal guardians, or
other caretakers, who have received a
written certification from a physician
licensed in this State that the person
has been diagnosed by a physician as
having Lennox-Gastaut Syndrome,
Dravet Syndrome, also known as
‘severe myoclonic epilepsy of
infancy’, or any other severe form of
epilepsy that is not adequately treated
by traditional medical therapies, the
substance cannabidiol, a
nonpsychoactive cannabinoid, or any
compound, manufacture, salt,
derivative, mixture, or preparation of
any plant of the genus cannabis that
contains nine-tenths of one percent or
less of tetrahydrocannabinol and more
than fifteen percent of cannabidiol.
(c) For purposes of this item,
written certification means a document
dated and signed by a physician stating
that the patient has been diagnosed

cannabidiol to a patient in accordance
with this section.

(x) "Marijuana" or "marihuana" means all
parts of the plant Cannabis, whether growing
or not, with a THC concentration greater than
0.3 percent on a dry weight basis; the seeds
thereof; the resin extracted from any part of
the plant; and every compound, manufacture,
salt, derivative, mixture, or preparation of the
plant, its seeds or resin. The term does not
include:
(1) The mature stalks of the plant, fiber
produced from the stalks, oil or cake made
from the seeds of the plant, any other
compound, manufacture, salt, derivative,
mixture, or preparation of the mature stalks
(except the resin extracted therefrom), fiber,
oil, or cake, or the sterilized seed of the plant
which is incapable of germination; or
(2) Industrial hemp as defined in RCW
15.120.010.

94.55 Industrial hemp.
(1) Definition. In this section, “ hemp”
means the plant Cannabis sativa L. and any
part of that plant, including the seeds thereof
and all derivatives, extracts, cannabinoids,
isomers, acids, salts, and salts of isomers,
whether growing or not, with a delta-9-
tetrahydrocannabinol concentration of not
more than 0.3 percent on a dry weight basis or
the maximum concentration allowed under
federal law up to 1 percent, whichever is
greater, as tested using post-decarboxylation
or other similarly reliable methods. “Hemp”
does not include a prescription drug product
that has been approved by the U.S. food and
drug administration.

(14“Marijuana" means all parts of the plants
of the genus Cannabis, whether growing or
not; the seeds thereof; the resin extracted from

(t) (t) Tetrahydrocannabinols, commonly
known as “THC", in any form including
tetrahydrocannabinols contained in marijuana,

tetrahydrocannabinols do not include any of
the following:
1. Tetrahydrocannabinols contained in a

961.32 Possession authorization.
(a) In this subsection, “certification" means a
letter or other official document issued by a
physician licensed under s. 448.04 (1) (a) that
contains all of the following:
1. The name, address, and telephone number
of the physician.
2. The name and address of the patient who is
issued the letter or document.
3. The date on which the letter or document is
issued.
(b) An individual may possess a cannabidiol
product if the individual has certification
stating that the individual possesses a
cannabidiol product to treat a medical
condition, if the certification has an issue date
that is no more than one year prior to the
possession, and if any expiration date

provided by the physician in the certification
has not passed. A certification is not required
to possess hemp, as defined in s. 94.55 (1), or
a prescription drug product that has been
approved by the U.S. food and drug
administration.
(3)
(a) In this subsection:
1. “Cannabis” means the plant Cannabis
sativa L. and any part of that plant, including
the seeds thereof and all derivatives, extracts,
cannabinoids, isomers, acids, salts, and salts
of isomers, whether growing or not.
2. “Hemp” has the meaning given in s. 94.55
(1).
(b) A person who is not otherwise violating s.
94.55 or rules promulgated by the department
of agriculture, trade and consumer protection
under s. 94.55 may not be prosecuted for a
criminal offense under this chapter, or under
an ordinance enacted under s. 59.54 (25) or
66.0107 (1) (bm), for any of the following:
1. Planting, growing, cultivating, harvesting,
producing, processing, or transporting
cannabis that contains a delta-9-
tetrahydrocannabinol concentration of the
crop of not more than 0.7 percent above the
permissible limit for hemp on a dry weight
basis or that is grown from hemp seed
certified under s. 94.55 (2) (c) or approved for
growing by the department of agriculture,
trade and consumer protection under s. 94.55
(2) (f).
3. Selling, transferring, importing, exporting,
processing, transporting, harvesting, or taking
possession of cannabis that has been tested
and certified, by the department of
agriculture, trade and consumer protection or
a person approved by the department of
agriculture, trade and consumer protection
under s. 94.55 (2) (b) 4g., as meeting the

permissible delta-9-tetrahydrocannabinol
concentration limit for hemp if the person has
no reason to believe that the test certification
is incorrect.
4. Possessing cannabis that contains a delta-9-
tetrahydrocannabinol concentration of not
more than 0.7 percent above the permissible
limit for hemp on a dry weight basis if the
possessor reconditions or processes the
cannabis to a delta-9-tetrahydrocannabinol
concentration at or below the permissible
limit for hemp with the approval of the
department of agriculture, trade and consumer
protection of those actions.
4m. Temporarily possessing cannabis during
the normal course of processing hemp if the
possessor reconditions or processes the
cannabis to a delta-9-tetrahydrocannabinol
concentration at or below the permissible
limit for hemp within a reasonable amount of
time.
4r. Possessing cannabis purchased or obtained
at retail that contains a delta-9-
tetrahydrocannabinol concentration of not
more than 0.7 percent above the permissible
limit for hemp if the possessor has no reason
to believe that the cannabis contains a delta-9-
tetrahydrocannabinol concentration above the
permissible limit for hemp.
5. Taking samples of cannabis, transporting
samples to a testing facility, or testing
samples for their delta-9-tetrahydrocannabinol
concentration or for the presence of other
substances.
(c) A person who violates s. 94.55 or a rule
promulgated under s. 94.55 may not be
prosecuted under s. 94.55 or this chapter
unless the person is referred to the district
attorney for the county in which the violation
occurred or to the department of justice by the
department of agriculture, trade and consumer

protection, and may not be prosecuted under
an ordinance enacted under s. 59.54 (25) or
66.0107 (1) (bm), unless the person is referred
to the local prosecuting authority by the
department of agriculture, trade and consumer
protection.
(cm) A hemp producer that negligently
violates s. 94.55 or a rule promulgated under
s. 94.55, as described under s. 94.55 (2g) (a),
may not be prosecuted under s. 94.55 or this
chapter or an ordinance enacted under s.
59.54 (25) or 66.0107 (1) (bm).

(1g) In this section, “medical treatment"
includes dispensing or administering a
narcotic drug for pain, including intractable

(b) DEFINITIONS (2) INDUSTRIAL HEMP.—The term ‘‘industrial hemp’’ means the plant Cannabis sativa L. and
