4.1.1. General Guidelines
The Board has issued office order vide No.GPC/NIP/F-10/2010/4 dated
17/2/2010 for the Policy guidelines regardidng categorization of industries & procedure
for Consent Management mechanism and validity period for various categories of
industries. The Punjab Pollution Control Board vide its No. EE(Mega)/2013/19650-761
dated 30.4.2013 has further revised the Policy of Consent Management, which is

Notice/directions u/s 33-A of the Water (Prevention & Control of Pollution) Act,
1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 to large
and medium scale red category industries will be issued with the approval of
Chairman of the Board.
Notice / directions u/s 33-A of the Water (Prevention & Control of Pollution)
Act, 1974 and u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 to
all categories of small scale units and large/medium orange and green category
of industries, will be issued with the approval the Member Secretary of the
Board but personal hearing in these cases will be held at the level of Chief
Environmental Engineer.
Notice u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974 and
u/s 31-A of Air (Prevention & Control of Pollution) Act, 1981 shall be signed by
the concerned Environmental Engineer of the Zonal Office on behalf of the
approving authority.

The directions for closure / restoration of the industrial units/projects u/s 33-A
of the Water (Prevention & Control of Pollution) Act, 1974 and u/s 31-A of the
Air (Prevention & Control of Pollution) Act, 1981 will be signed by the
concerned Senior Environmental Engineer, irrespective of its scale.
The MoEF vide notification No. S.O 23(E) dated 08.01.1997 has delegated the
powers vested in the Central Govt. u/s 5 of the Environment (Protection) Act,
1986 to the Chairman of the State Pollution Control Boards to issue directions
to any industry or any local or other authority for the violations of the
standards and rules relating to hazardous wastes notified under the
Environment (Protection) Act, 1986. Furthermore, the MoEF vide notification
No. S.O 327(E) dated 10.04.2001 has delegated the powers vested in the
Central Govt. u/s 5 of the Environment (Protection) Act, 1986 to the Chairman
of the State Pollution Control Boards to issue directions to any industry or any
local or other authority for the violations of the standards and rules relating to
Bio-Medical Waste, Hazardous Chemicals, Industrial Solid Waste and Municipal
Solid Waste including Plastic Wastes notified under the Environment
(Protection) Act, 1986.
Notice/Directions u/s 5 of the Environment (Protection) Act, 1986 to all
categories of industries will be issued with the approval of the Chairman of the
Board and the said directions will be signed by the concerned Senior
Environmental Engineer/ Additional Secretary. However, the notice to issue
directions u/s 5 of the Environment (Protection) Act, 1986 can be signed by the

land for irrigation.
11. Land documents such as Registration deed/Rent deed/Lease deed mentioning details of the

12. Undertaking to the effect that the proposed site of the project/industry is located in the designated Industrial zone/area of the notified/draft Master Plan in which the establishment of
such industry/project is permissible. The undertaking shall clearly indicate the revenue entries i.e. Hadbast Number, Khewat/Khatauni number and Khasra numbers.
13. Certificate of Revenue Authorities (DC/ADC/SDM) indicating the distance of proposed site of
industry from the MC limits/Phirni/Lal lakir of the nearest village, in case, the industry is to be established at a site other than the site in the industrial area/industrial estate/industrial zone of
the draft master plan/industrial zone of the notified master plan.
14. Allotment letter of the Allotting Authority, if the site of the project is located in the designated
Industrial Area/Industrial Estate/Focal Point.
15. For industry specific guidelines, certificates/documents as mentioned in the said guidelines.
Note : Each & every document should be duly authenticated by the industry.

OFFICE ORDER
The sub section 2 of section 25 of the Water (Prevention & Control of Pollution) Act,
1974 states that every industry covered under the said Act, is required to file an application for
'Consent to Establish/Operate' as required under sub section 1 of section 25 of the said Act alongwith
such fee prescribed by the Board. There is similar provision for obtaining 'Consent to Establish/Operate'
under sub section 2 section 21 of the Air (Prevention & Control of Pollution) Act, 1981, also Punjab
Pollution Control Board is charging the application fee for processing the consent applications filed by
the industries and other establishments for 'Consent to Establish' and 'Consent to Operate' which was
prescribed by the Board since its inception in 1975.
Keeping in view the changing financial scenario, increase in the expenditure of the
Board and the Board is in the process of introducing a new category namely orange category, it has
been felt necessary to go in for a revision of the 'Consent to Establish' and 'Consent to Operate' fees for
the processing of the application etc. Accordingly, the matter for 'Consent to Establish/Operate' fee was
placed before the Board in its 144th meeting held on 20.08.2009 and accorded its sanction.
In pursuance of the decision taken by the Board in its 144th meeting held on
20.08.2009, the 'Consent to Establish' and 'Consent to Operate' fees for the processing of application
under the Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of
Pollution) Act, 1981 etc. will now be charged as under :

ORDER
Whereas it is necessary and expedient to take immediate steps under section 5 & 7 of Environment
(Protection) Act, 1986 and rules framed there under to maintain ecological balancein the State, to prevent
environmental degradation and to avoid traffic and human health hazard.
And whereas Rice Shellers and Saila Plants in the State of Punjab have been causing grave air
pollution and causing hazard to traffic and human health, and Appellate Authority constituted bythe State
Government under the provisions of the Water (Prevention & Control of Pollution) Act,1974 and Air (Prevention &
Control of Pollution) Act, 1981 while considering the appeals of five rice mills established in violation to the siting
guidelines, issued an order directing the Board to review the siting criteria
And whereas to abate an pollution created by the Rice Sheller and Saila Plant units, Punjab
Pollution Control Board has recommended siting guidelines, emission standards and code of practices to be
followed in respect of these units in the State of Punjab.
Now, therefore, in supersession of orders issued vide endst. No. 10/48/2004/S TE4/1692 -
1708,dated 2.6.2005 and No. 10/ 48/2005/S TE4/ 2504-20, dated 23.6.2006 and in exercise of powers conferred
under section 5 of the Environment (Protection) Act, 1986 read with Government of India, Ministry of Environment
and Forest, Department of Environment, Forests, and wild life Notification No. S.O. 289 (E) dated the 14thApril,
1988 and in pursuance of the provisions of section 7 of the said Act and Rule 4 of t he Environment (Protection)
Rules, 1986 the Governor of Punjab, is pleased to issue following revised siting guidelines for the New Rice shallers
and Saila Plants in the State as under:-
A) New Rice Shellers and saila plants in the State of Punjab should be located at: -
i. In Focal Point and in designated Industrial Land use Zones,
ii. In rural zone of Master Plan (Statutory/Non-Statutory), rural zone of Local Planning Area and in the agriculture land outside the rural zone of Master Plan and Local Planning Area but shall be at the distance of 500 meters from urbanisable limits of Master Plan and 2 Kms from Local Body limits where the master plan are yet to be prepared.
iii. 500 meters away from the bye-pass, National Highway, State Highway and Scheduled Road
[Point No. (i) to (iii) to be certified by D. T.P.]
iv. 500 meters away from the village Lal Dora/Phirni, Wild Life Sanctuary, Zoo, residential area*, educational institution, historical, religious places and protected monuments.
*The residential areas means the area under a scheme notified by Punjab Urban & Development Authority (PUDA), Municipal Corporation, Municipal Council, Improvement Trust or any other authority/agency in the State. [Point No. (iv) to be certified by Revenue Authority
v. Punjab Pollution Control Board will ask for certificate from the District Town Planner/Revenue authorities within 15 days failing which Board will be at liberty to issue NOC and the rice millers will not have to approach the concerned authorities for obtaining the requisite certificate. The requisite fee to be charged by the Town & Country Planning Department will be deposited by the industry as a separate Bank Draft alongwith NOC fee of PPCB with the Board and PPCB will forward the fee of Town & Country Planning Department to the DTP with the request to

report/comment regarding issues contained in A (I to III) as mentioned above within 15 days failing which Board will be at liberty to issue NOC.
vi. All the Rice Mills located outside the Municipal limits of town and cities and in the designated
areas within the cities established with NOC of Punjab Pollution Control Board will be allowed to expand (only dry process i.e., no generation of trade effluent)/ modernize within their existing premises, if pollution load of existing unit has been effectively taken care of by the industry and no
specific approval of District Town Planner will be required.
NOTE :
(I) No new Sheller shall be allowed between intersection of the municipal committees having distance less than 2 kilometers.
(II) Right of the way will be accepted as per revenue records and minimum width of 15 ft. to 16 ft of passage may be provided for easy transportation instead of 22 ft.
(III) The parking will be provided within the site. (IV) All distances shall be measured from right of the way upto pollution control device chimney. (V) All these siting criteria specified above will be applicable in toto and not in piece meal.
B) Emission Standards Emission Standards for Rice Shellers&saila Plants in the State of Punjab will be applicable as under:-
1. Emission Standards 750* SPM (mg/Nm3)
2. Inside the Building TLV of air ** SPM (mg/Nm3)
NOTE : * The existing units not meeting with the prescribed siting guidelines will meetstack emission standards of
SPM 500 mg/ Nm3
* To be controlled by Director of Factories
C) Code of Practices
I. All the processing sheds be covered and have minimum ventilation as per the recommendations of Director of Factories

III. The industry should provide proper rice husk/husk ash storage facilities inside the factory premises and the height of wall around the husk discharge point/ashstorage area should be 10 ft high.
IV. The industry should plant thick plantation of spreading crown varieties of evergreen trees all along the boundary wall of the Shellers/Saila plants.
V. All dust emitting points should be properly hooded and dust extracted to a common point. At this exhaust point, dust coming here will be passed through adust control system and air will be emitted through a stack of height 3 meters above the roof of the building.
VI. The industry shall not be located in High Tension Transmission Zone of Punjab State Electricity Board.

time of establishment and with the consent to establish /operate of the Board have taken
effective care of existing pollution load and the proposed expansion is within their exiting
premises.

Whereas, the Govt. of Punjab, Department of Science, Technology,
Environment and Non-Conventional Energy, Chandigarh in pursuance of the provisions
of section 7 of the Environment (Protection) Act, 1986 and Rule 4 of the Environment
(Protection) Rules, 1986 vide order no. 10/48/2004-STE-4/4061-77 dated 13/9/2006
had laid down siting guidelines including code of practice for setting up of new rice
shellers and saila plants in the State of Punjab.
And whereas, the Govt. of Punjab, Department of Science, Technology,
Environment, vide Order No. 10/48/2003-STE(4)/3547 dated 19.12.2011 has made
certain amendments in Order No. 10/48/2004-STE-4/4061-77 dated 13/9/2006 and
one of the amendments in respect of siting guidelines for dry shelling units with
sundrying process is that the said units can be established at a distance of 300 m
from Wildlife Sanctuary/Zoo.
And whereas, LPA 197 of 2009, titled as Prem Goyal Vs State of Punjab
came up for hearing before the Hon'ble Punjab & Haryana High Court on 09.09.2009
and the operative part of the Interim Order passed by the Hon' ble Court is
reproduced as under:-
" We deem it appropriate to direct the Chief Secretary to constitute a
Committee of Officer not below the rank of Secretary/Head of the
Department representing various authorities concerned to find a just and
fair solution so as to maintain wildlife Sanctuary as well as protect the
interest of the petitioner-appellant and other Industrial Units. The
Committee be constituted within one week from today. It shall prepare
a report and place before this Court within a period of eight weeks
thereafter".
And whereas in compliance to above Orders of the Hon'ble Punjab &
Haryana High Court, the Hon'ble Chief Secretary to Govt. of Punjab has constituted a

Committee comprising of six members and the said Committee in its report submitted
to the Hon'ble Punjab & Haryana High Court has recommended that no new
industrial unit shall be allowed to be established within 500 m radius of Wildlife
Sanctuary/Zoo w.e.f. 1.1.2010 unless and until a Committee comprising of Department of
Forests & Wildlife Preservation, Department of Industries & Deptt. of Science & Technology
specially recommends its establishments.
And whereas, LPA 197 of 2009 titled as Prem Goyal Vs State of Punjab has
been disposed of by the Hon' ble Punjab & Haryana High Court on 23.12.2011 and the
operative part of the order is reproduced as under:
"We would like to place on record our appreciation for excellent report submitted on 17.12.2009 by the Committee constituted by the Chief Secretary, Punjab. The respondent State shall in compliance with directive principle of State Policy given in Article 48-A of the constitution frame a policy guidelines keeping in view the recommendations made by the committee, which have been placed on record on 17.12.2009. The same be notified to all concerned within a period of two months from the date of receipt of a copy of this order."
In view of above and in exercise of powers conferred u/s 5 of the Environment
(Protection) Act,1986 read with Government of India, Ministry of Environment & Forests,
Department of Environment, Forests and wildlife Notification No. S.O. 289 (E) dated 14th

Important points for Prevention of Pollution by Hot Mix Plant
1. A suitable dust control system for the dryer and mixer to contain/recycle permissible lines in the
mix should be provided. It should be capable of preventing the exhaust of line dust into
atmosphere from both ends of the dryer drum by creating adequate negative pressure.
2. The plant should have centralized control panel/cabin capable of presetting controlling/synchronizing all operations, starting from feeding of cold aggregates to the
discharges of the hot mix to ensure proper mixing. It should have adequate water scrubbing
mechanism to completely remove/control the dust coming out the drier with proper provision of re-circulation system for the scrubber water.
3. Bitumen must be mixed with aggregate as soon as it is heated and second time lifting of the
dried aggregate for proper batching should be avoided.

4. All roads/vehicular movement areas at the site of Hot Mix Plant should be pucca/stabilized with
stone aggregates and regular sprinkling of the water be ensured so that no dust is generated with vehicular movement.
5. Hot Mix Plant must have proper stack heights for its scrubbed fire gases and bitumen heating
system with proper platform and port holes as per the Punjab Pollution Control Board norms.
6. Fine dust arrested by water scrubber and collected in the re-circulation water tank should be
collected and filled in a pit to be covered with fresh earth. This exercise should be repeated as and when dust is removed from re-circulation tank.

Notification
The 17th March, 1998
No. 3/7/96-STE(5)562 Whereas, it is necessary and expedient to take immediate
steps under section 5 & 7 of the Environment (Protection) Act, 1986 and rules framed
thereunder to maintain ecological balance in the State, to prevent environmental
degradation and avoid traffic and human health hazards;
And whereas stone crusher units in the State of Punjab have been causing grave air
pollution and causing hazards to traffic and human health;
And whereas to abate air pollution created by the stone crusher units, the Punjab
Government notified a policy on the siting of stone crushers vide Notification dated
3/7/96-STE(4)/1120 dated 15th May, 1996;
And whereas various stone crusher owners have filed civil writ petition bearing Nos.
16520 of 1996, 16832 of 1996, 16853 of 1996, 17101 of 1996, 17647 of 1996, 17654
of 1996, 18106 of 1996 challenging the said notification dated 15th May, 1996 in the
Hon'ble High Court of Punjab & Haryana;
Now, therefore, in supersession of the said notification No. 3-7-96-STE(4)/1120 dated
15th May, 1996 and in exercise of powers conferred by Section 5 of the Environment
(Protection) Act, 1986 read with Government of India, Ministry of Environment and
Forests, Department of Environment, Forests and Wild Life Notification No.
S.O.389(E), dated the 14th April, 1988 and in pursuance of the provisions of Section 7
of the said Act and Rule 4 of the Environment (Protection) Rules, 1986, the Governor
of Punjab, hereby directs as under:-
1. FOR NEW STONE CRUSHER :-
No new stone crushing unit shall be allowed to be installed

and operated within the limits of :-
A. (i) 500 meters on National Highway/ State Highway / Scheduled Roads in
plain areas and 250 meters in sub-mountainous areas.
(ii) 5 km. of the city limit of metropolitan cities / Municipal Corporations.
(iii) 2 km. of the city limits of A-Class Towns,
(iv) 1.5 km. of the city limits of B-Class Towns.
(v) 1.0 km. of other Cities/Towns.
(vi) 500 meters of village phirni / LalLakir/ Approved Residential Colony.
Parks / Wild Life Sanctuaries/ Protected Monuments.
(viii) 100 meters of Link Roads and other district roads.
(ix) 300 meters of all major district roads in plain areas and 150 meters in
sub-mountainous area.
B. Stone crushers shall be located in a minimum area of 0.4 hectare which
should be owned by the stone crushing unit or by taking land on lease either by the
panchayats or in the private sector.
2. FOR EXISTING STONE CRUSHER :-
The existing stone crushers meeting the guidelines given below
alongwith standards notified under Environment (Protection) Act, 1986 and the code
of practice for pollution prevention as specified hereinafter should be allowed to
operate:-
(i) No dust emitting point within 100 meters from right of way of scheduled roads within the Chandigarh Capital Periphery Control Area /Communication Zone.
(ii) No dust emitting point within 30 meters from right of way of Highways/ Scheduled Roads in the other parts of the State.
(iii) 250 meters from Municipal/Notified Area Committee Limit/Village LalLakir/Approved Residential Colonies/Historical Places/Zoological Parks/ Wild Life Sanctuaries/ Protected Monuments.
NOTE :-
(i) Those limits which are not conforming to the

above guidelines should be shifted from the present sites.
(ii) The Environment Impact of existing stone crushers may be studied and
their further continuation reviewed after a period of five years.
3. FOR NEW CLUSTERS OF STONE CRUSHERS :-
In addition to the guidelines for new stone crushers recommended
above, the following criteria shall be adopted where stone crushers are set up in
clusters :-
(i) A green belt of width as specified by the Punjab Pollution Control Board will be provided all around the clusters.
(ii) Only one approach from National Highway/ Scheduled Road will be provided to the cluster.
(iii) The approach road leading to a cluster of five or more stone crushers shall not pass through any village.
(iv) All new clusters of stone crushers shall get the layout plan approved
from Town and Country Planning Department, Punjab.
4. FOR EXISTING CLUSTERS OF STONE CRUSHERS:-
The approach road leading to a cluster of five or more stone crushers
shall not pass through any village.
5. CODE OF PRACTICE FOR POLLUTION PREVENTION:-
All the stone crushers shall take the following pollution control
measures:-
(i) All the dust emitting points like Jaw/ Roller crushers, screens/ classifiers
should be properly enclosed/ covered.
(ii) Conveyor belts should be of proper quality material instead of used
tyres.
(iii) The ends of conveyor belts should be covered with telescopic chute.
(iv) Regular water spray should be carried out at all dust emitting points and
transfer points.
(v) Water spray should be done on the boundary as per requirement.

(vi) Regular cleaning of approach roads should be carried out.
(vii) All the approach roads and ramps should be metalled.
(viii) A green belt consisting of three rows of tress (out of which one
row of tall leaved trees and two rows of medium leaved dense
trees) should be provided along the periphery.
(ix) Annual health survey of the workers should be conducted.
(x) The openings of the housing for the movement of mechanical
drives, conveyor belts etc. should be properly sealed with flexible
rubber flaps.
(xi) The process waste i.e. file material should be dumped along the
road side and should be used for filing up of low lying areas.
(xii) The water spray system should be interlocked with the main
crushing operation.
(xiii) The stone crushers should conform to the emission standards load
down by the Punjab Pollution Control Board.
6. The existing stone crushers meeting the guidelines for existing
stone crushers, but not conforming to the guidelines for new stone crushers
shall, in addition to the above pollution control measures; provide a 10ft. brick
wall as boundary/ wind breaking wall facing the road as well as towards
residential area with a well defined single entry from the road.
7. Each stone crusher shall install suitable pollution control measures
to the satisfaction of the Punjab Pollution Control Board and shall
obtain 'No Objection Certificate' from Punjab Pollution Control
Board and shall obtain 'No Objection Certificate' from the Town
and Country Planning Department, Punjab and also conform to the
other statutory regulations, in any.

8. The stone crusher unit henceforth should be
permitted anywhere subject to the restriction of the Department
of Town and Country Planning, Punjab and the Punjab Pollution Control
Board.
9. Existing stone crusher units which are not conforming to the parameters, as
detailed above, shall shift to sites conforming to the above parameters within the time frame given by the Punjab Pollution Control Board to them but not later than three months from the date of issue of this notification.

In partial modification of Notification No. 3/7/96-STE (5)/562 dated 17/3/1998
and in exercise of powers conferred under section 5 of the Environment (Protection)
Act, 1986 read with Government of India, Ministry of Environment and Forests,
Department of Environment, Forests and Wild Life notification no. S.O 289 (E) dated
the 14/4/1998 and in pursuance of the provisions of section 7 of the said Act and Rule
4 of the Environment (Protection) Rules, 1986, the Governor of Punjab is pleased to
insert provision No.5 (A) as Code of Practice for Pollution Prevention" for stone
crushing units using wet raw material and having washing facilities at
screener/classifier as under:-
"5, A) WET PROCESS:-
i) The dust emitting namely jaw/roller crushers should be properly
enclosed/covered.
ii) Conveyor belts should be of good quality preferably thick sheet of rubber
material to avoid any kind of spillage of material carried by these belts and
consequently reducing air pollution.
iii) End of conveyor belts should be provided with conventional type Chute made
of rubber sheet/flapper of minimum 5 ft. height supported by Mild Steel
angles in place of telescopic chute at the end of the conveyor belt.
iv) Regular water spray should be carried out at jaw crushers and roller crushers.
v) Water spray should be done on the boundary wall at main entrance. Stone
Crushers should also provide proper water sprinkling system on the berms
of ramp and approach road to ensure that these are in wet condition during
the operation hours.

vi) All the approach roads and ramps should be 30 cm. thick with washed river bed
material of size 10-53 mm. duly compacted with any mechanical means
such as road roller in conformance to IS: 6579-1981.
vii) A green belt consisting of three rows of trees (out of which one row of tall
leaved trees and two rows of medium leaved dense trees) should be
provided along the periphery. In case of cluster of stone crushing units, a
common green belt may be provided along the periphery of cluster.
viii) The stone crushing units should make the following provisions for the
management of wastewater:-
a) The stone crushing units shall provide settling tank(s) for wastewater of
adequate capacity, designed by taking surface loading rate of 25 m3/day/m2
and length to width ratio of 3:1 and clear water depth as 3 m excluding 0.3
m free board and 0.5 m depth for accumulation/storage of solids. The
treated effluent shall be discharged into inland surface water/onto land for
irrigation as per the mode of disposal allowed by Punjab Pollution Control
Board.
b) The units shall ensure that the settling tank(s) is/are cleaned regularly to
maintain minimum clear water depth of 3m.
c) For measuring the discharge of wastewater, the stone-crushing units shall
provide 90o V-notch at the outlet of settling tank(s) and maintain the record
of discharge in register on daily basis.
d) The process waste i.e. fine material and silt so produced from the settling
tank(s) will be disposed of in an environmentally sound manner such as
filling in low lying area with half meter height of silt layer followed by cover
of good earth of 15 cms. and so on with the prior approval of concerned
Environmental Engineer of Punjab Pollution Control Board.
All other provisions of the parent notification shall apply.

Whereas, the Govt. of Punjab, Department of Science,
Technology, Environment and Non-conventional Energy, Chandigarh in
pursuance of the provisions of section 5 of the Environment (Protection) Act,
1986 and read with Government of India, Ministry of Environment & Forests,
Notification No. S.O 389 (E) dated 14.4.1988 and in pursuance of the
provisions of section 7 of the said Act and Rule 4 of the Environment
(Protection) Rules, 1986 vide order no. 3/7/96-STE(5)/562 dated 17/3/1998
had laid down siting guidelines including code of practice for setting up of new
stone crushers in the State of Punjab.
And whereas, LPA 197 of 2009, titled as Prem Goyal Vs State of
Punjab came up for hearing before the Hon'ble Punjab & Haryana High Court
on 9.9.2009 and the operative part of the interim Order passed by the Hon'ble
Court is reproduced as under:
"We deem it appropriate to direct the Chief Secretary to constitute a
Committee of Officers not below the rank of Secretary/Head of the
Department representing various authorities concerned to find a just and
fair solution so as to maintain Wildlife Sanctuary as well as protect the
interest of the petitioner-appellant and other industrial units. The
Committee be constituted within the week from today. It shall prepare a
report and place before this Court within a period of eight weeks
thereafter."
And whereas in compliance to above orders of the Hon'ble Punjab
& Haryana High Court, the Hon'ble Chief Secretary to Government of Punjab
has constituted a Committee comprising of six members and the said
Committee in its report submitted to the Hon'ble Punjab & Haryana High Court
has recommended that no new industrial unit shall be allowed to be established
within 500 m radius of Wildlife Sanctuary / Zoo w.e.f. 1.1.2010 unless a

Committee comprising of Department of Forests & Wildlife Preservation,
Department of Industries & Deptt. of Science & Technology specially
recommends its establishments.
And whereas, LPA 197 of 2009 titled as Prem Goyal Vs State of
Punjab has been disposed of by the Hon'ble Punjab & Haryana High Court on
23.12.2011 and the operative part of the order is reproduced as under:
"We would like to place on record our appreciation for excellent report submitted on 17.12.2009 by the Committee constituted by the Chief Secretary, Punjab. The responded State shall in compliance with directive principle of State Policy given in Article 48-A of the Constitution frame a policy guidelines keeping in view the recommendations made by the Committee, which have been placed on record on 17.12.2009. The same be notified to all concerned within a period of two months from the date of receipt of a copy of this order."
In view of above and in exercise of powers conferred u/s 5 of the
Environment (Protection) Act, 1986 read with Government of India, Ministry of
Environment & Forests, Department of Environment, Forests and Wildlife
Notification No. S.O. 289 (E) dated 14th April, 1988 and in pursuance of the

PREAMBLE
1.1 India is unique in terms of biological diversity due to its unique biogeographical
location, diversified climatic condition and enormous ecodiversity and
geodiversity. India contributes 10% to the world's Biological Diversity. Punjab,
the 'land of five rivers' is a relatively small state of India occupying an area of
50,362 Sq. Km. Situated between river Ravi in the North-West and Ghaggar in
the east, Punjab shares its boundaries with Jammu & Kashmir in the North,
Himachal Pradesh in the North-East and Haryana and Rajasthan to its South.
the state also shares a 300 km. long international border with Pakistan on the
western side.
1.2 Punjab has rich biodiversity which, however, is severely threatened and needs
to be conserved. The state has so far notified 16 Protected Areas out of which
there are 13 Wildlife Sanctuaries, 2 Community Reserves and one Conservation
Reserve. There is no National Park in the State. Most of the protected areas are
of small size and are hence extremely vulnerable to industrial and other
pollution sources in their immediate vicinity. These guidelines frame the policy
in respect of existing and future industry in the eco-sensitive areas around the
Protected Areas.
2. MISSION
The State shall endeavour to protect, conserve and maintain wildlife
sanctuaries and strive to safeguard the representative ecosystems, habitats and
species in them and shall discharge its responsibilities by providing pollution
free environment in the vicinity of wildlife sanctuaries/zoos and seeking strong
commitment from industrial units to fulfill their obligations for the careful
stewardship of wildlife sanctuaries whilst recognizing the need to integrate the
interests of people and nature.

3. OBJECTIVES
To achieve the above mission, the policy seeks to pursue the following
objectives :
a) Identification of Industrial units/activities located within 500 meters
distance of wildlife sanctuaries/zoos of the State.
b) Categorisation of industrial units/activities as per "Siting Guidelines" of
Punjab Pollution Control Board issued from time to time.
c) Assessing the impact of existing industrial units/activities on the health
of ecosystem and fauna in the wildlife sanctuaries/zoos.
d) Establishing guidelines for the shifting of industrial units/activity or
monitoring the activities of existing units
or
Setting up of new industrial units within 500 meters distance of wildlife
sanctuaries/zoos.
e) Enforcement of standards and norms in the delineated 500 meter radius
zone around wildlife sanctuaries/zoos as per guidelines.
f) Enunciate mechanism/processes to declare the areas located within 500
meters of sanctuaries/zoos as an eco-sensitive zone and bringing it
under legal enactment for strict enforcement and compliance of the
directives.
4. STRATEGIES
The stated objectives would be achieved through following strategies.
4.1. DESIGNATED COMMITTEE
State Government will appoint a high powered Committee (hereinafter referred
to as this Designated Committee) comprising Senior Officers of the Forest &
Wildlife Preservation Department, Department of Industries, Department of
Science and Technology and the PPCB for framing rules, regulations and giving
effect of to these Guidelines.

4.2 FOR EXISTING INDUSTRIAL ENTREPRENEURS UNITS
The following guidelines formulated in compliance of Hon'ble Punjab and
Haryana High Court order dated 23.12.2011 in LPA 197 of 2009 - Prem Sagar
versus Punjab State shall be followed by all the existing industrial
entrepreneurs units.
4.2.1 IDENTIFICATION OF INDUSTRIAL UNITS/ACTIVITIES WITHIN 500
METER RADIUS OF ALL WILDLIFE SANCTUARIES/ZOOS IN THE
STATE.
4.2.1.1 List of exiting industries within 500 meters from outer boundaries of
sanctuaries identified by High Powered Committee constituted by Chief
Secretary, Punjab in compliance of Hon'ble Punjab and Haryana High
Court order dated 09.09.2009 shall be conveyed to the executive
functionaries of allied departments such as Department of Industries and
Punjab Pollution Control Board, Department of Science, Technology and
Environment and Department of Revenue, Government of Punjab.
4.2.1.2 None of the industrial units within 500 m of the periphery of the
sanctuaries identified by the committee within 500 meters of wildlife
sanctuaries/zoos shall be allowed to continue but shall be monitored by
a Joint Committee of Department of Forests and Wildlife Preservation,
Department of Industry and Punjab Pollution Control Board after every
three months.
4.2.1.4 The existing Entertainment Park within 500 meters of wildlife
sanctuaries/zoos though belong to exempt category shall be brought
within the eco-tourism policy of the State Government duly approved by
the Department of Tourism. The park shall be given a time frame of six
months to follow the guidelines of Department of Tourism as laid out in
the ecotourism policy. The Department of Forests and Wildlife
Preservation along with representative of Department of Tourism shall
monitor the park after every six months to see that the guidelines of
Department of Tourism are followed strictly. The department of Tourism

shall initiate due procedure to bring the park under Ecotourism Policy of
the State.
4.2.2 FOR EXISTING INDUSTRIAL UNITS/ACTIVITIES (GREEN
CATEGORY)
4.2.2.1 All the green category industrial units/activities identified by the
committee within 500 meters of wildlife sanctuaries/zoos except industry
located within 30 meters of sanctuaries shall allow to continue. However,
a committee (Department of Forests and Wildlife, Department of
Industries and Punjab Pollution Control Board) shall monitor these units
after every six months.
4.2.2.2 The department of industries shall initiate due procedure for the shifting
the green category industrial unit that fall within 30 meters of wildlife
sanctuaries/zoos. A Joint committee (Department of Forests and Wildlife,
Department of Industries and Punjab Pollution Control Board) shall
monitor its after every six months.
4.2.2.3 A Joint committee of Department of Forests and Wildlife, Department of
Industries and Punjab Pollution Control Board shall carryout stringent
monitoring after every six months in respect of sensitive green industries
such as Rubber/Plastic/Chilling Plant/Ice Plant.
4.2.2.4 Principal Chief Conservator of Forests, Punjab shall initiate action against
(small scale wood based industry) already identified by a Committee
within 500 mt. of wildlife sanctuaries/zoos as per Punjab Regulation of
Saw Mills, Veneer and Plywood Industries Rules, 2006.
4.2.3 FOR EXISTING INDUSTRIAL UNITS/ACTIVITIES (RED
CATEGORY)
4.2.3.1 RICE SHELLERS
(a) All the existing rice shellers within 500 meters of wildlife
sanctuaries/ zoos but not within 30 meters from boundary of
wildlife sanctuary shall be allowed to operate.

(b) Those rice shellers which were in operation prior to siting
guidelines/ parameter of Punjab Pollution Control Board within
500 meters of wildlife sanctuaries/zoos be bound to follow the
norms of Punjab Pollution Control Board. For these rice shellers,
Punjab Pollution Control Board shall frame stringent norms and
shall notify the same. A Joint Committee comprising
representatives of Department of Forests and Wildlife,
Department of Industries and Punjab Pollution Control Board shall
monitor such rice shellers after every six months.
(c) Department of industries shall initiate due procedure for shifting
of all rice shellers that fall within 30 meters of Wildlife
Sanctuaries/zoos. The shifting of such units shall be monitored by
a Joint Committee comprising representatives of Department of
Forests and Wildlife, Department of Industries and Punjab
Pollution Control Board.
4.2.3.2 BRICK KILNS
(a) All the existing Brick kilns within 500 meters of wildlife
sanctuaries/ zoos but not within 30 meters from boundary of
wildlife sanctuary shall be allowed to operate.
(b) Those brick kilns which were in operation prior to siting
guidelines/ parameter of Punjab Pollution Control Board within
500 meters of wildlife sanctuaries/zoo be bound to follow the
norms of Punjab Pollution Control Board. For these brick kilns,
Punjab Pollution Control Board shall frame stringent norms and
shall notify the same. A Joint Committee comprising
representatives of Department of Forests and Wildlife,
Department of Industries and Punjab Pollution Control Board shall
monitor such brick kilns after every six months.

(c) Department of industries shall initiate due procedure for shifting
of all brick kilns that fall within 30 meters of Wildlife
Sanctuaries/zoos. The shifting of such units shall be monitored by
a Joint Committee comprising representatives of Department of
Forests and Wildlife, Department of Industries and Punjab
Pollution Control Board.
(d) The brick kilns already in operation in the Abohar Wildlife
Sanctuary shall also be allowed to operate as the area of Abohar
Wildlife Sanctuary is privately owned and the rights of people
cannot be ignored. However, Punjab Pollution Control Board shall
frame stringent norms for them and strict monitoring of these
units shall be carried out by a Joint Committee comprising
representatives of Department of Forests and Wildlife,
Department of Industries and Punjab Pollution Control Board.
4.2.3.3 HOT MIX PLANTS
No Hot Mix Plant within 500 meter of wildlife sanctuaries/zoos shall be
allowed to operate. Any existing hot mix plant within 500 meters of
wildlife sanctuaries/zoos shall be closed down. Punjab Pollution Control
Board and Department of Industries shall initiate due procedure for its
closure and a close monitoring shall carried out by a Joint committee
comprising representatives of Department of Forests and Wildlife,
Department of Industries and Punjab Pollution Control Board.
4.2.3.4 STONE CRUSHERS
(a) All the existing stone crushers (boundaries or machinery) within
500 meters of wildlife sanctuaries/zoos but not within 30 meters
from boundary of wildlife sanctuary shall be allowed to operate.
(b) Those stone crushers which were in operation prior to siting
guidelines/parameter of Punjab Pollution Control Board within 500
meters of wildlife sanctuaries/zoos be bound to follow the norms
of Punjab Pollution Control Board. For these stone crushers,

Punjab Pollution Control Board shall frame stringent norms and
shall notify the same. A Joint Committee comprising
representatives of Department of Forests and Wildlife
Preservation, Department of Industries and Punjab Pollution
Control Board shall monitor such stone crushers after every six
months.
(c) Department of industries shall initiate due procedure for shifting
of all stone crushers that fall within 30 meters of Wildlife
Sanctuaries/zoos. The shifting of such units shall be monitored by
a Joint Committee comprising representatives of Department of
Forests and Wildlife Preservation, Department of Industries and
Punjab Pollution Control Board.
4.2.3.5 MEDIA PAPER, CARDBOARD, SERVICE STATION/EFFLUENTS
TREATMENT PLANT
The existing media paper/card board unit, service station and Effluent
Treatment Plant shall be required to follow the norms of Punjab
Pollution Control Board and a Joint Committee comprising
representatives of Department of Forests and Wildlife, Department of
Industries and Punjab Pollution Control Board shall monitor on six
months basis.
4.2.3.6 IOC DEPOT
The existing IOC Depot within 500 meter of wildlife sanctuary shall be
shifted. IOC Depot shall submit its plan of shifting operation to
industries Department within 6 months. A Joint Committee comprising
representatives of Department of Forests and Wildlife Preservation,
Department of Industries and Punjab Pollution Control Board shall
review the action taken by unit for its shifting.

4.3 GUIDELINES FOR NEW INDUSTRIAL UNITS/ACTIVITIES
WITHIN 500 METER OF WILDLIFE SANCTUARIES/ZOOS.
4.3.1 No new industrial unit shall be allowed to be established within 500
Meter periphery of any Wildlife Sanctuary/Zoo unless the Designated
Committee Specifically recommends its establishment. Till then the PPCB
shall not process any NOC/Consent/Clearance to those applicants who
have already applied for the establishment of units within 500 Meter
periphery of any Wildlife Sanctuary/Zoo.
4.3.2 None of the industrial units already in existence within 500 Meter of the
periphery of the sanctuaries shall henceforth be allowed to expand
without the approval of the Designated Committee.
4.3.3 Establishment of entertainment park/Eco-tourism activity within 500
meters periphery of any wildlife sanctuary shall be considered by the
Designated Committee only after obtaining NOC's from the Department
of Forests and Wildlife Preservation and Department of Tourism.
4.3.4 All pending applications with Punjab Pollution Control Board w.e.f.
01.01.2010 for setting up of new industrial units/activities within 500
meters of wildlife sanctuaries/zoos shall be placed before the Designated
Committee for its consideration. The Punjab Pollution Control Board shall
grant NOC/Consent/Clearance to only those applicants whose cases are
recommended by the Designated Committee. Applications which are not
recommended by the Designated Committee shall be rejected forthwith
by Punjab Pollution Control Board.
4.3.5 SEWAGE DRAINS/SOLID WASTE
(a) Municipal Corporations shall ensure that no untreated sewage is
discharged inside or within 500 Meter periphery of any Wildlife
Sanctuary/Zoos. In case Municipal Corporations have not installed
STPs for the treatment of sewage so far, same shall be done
within six months. The Designated Committee shall monitor the
same.

(b) Municipal Corporations shall ensure that no municipal solid waste
is dumped within 500 meters of any wildlife sanctuary/zoos.
Municipal Corporations shall make alternative arrangements for
the disposal of municipal solid waste if any within a period of 6
months. The Designated Committee shall monitor the same on six
months basis.
4.4 ENUNCIATE MECHANISM/PROCESSES TO DECLARE 500
METERS PERIPHERY AREA AS "ECO-SENSITIVE ZONE" AND
BRINGING IT UNDER LEGAL ENACTMENT FOR STRICT
ENFORECEMENT AND COMPLIANCE OF DIRECTIVES.
The Department of Forests and Wildlife Preservation, Punjab in tune with
the policy of Government of India, Ministry of Environment and Forests
shall initiate process for the declaration of 500 meters area around
Wildlife sanctuaries/zoos of the State as Eco-sensitive Zone so as to
further enforce the standards and norms for safeguarding this zone.
4.5 Any matter/issue not explicitly covered in these guidelines shall be
decided by the competent authority after obtaining and considering the
recommendations of the "Designated Committee".

Annexure-14
Government of Punjab Department of Science, Technology, Environment
Whereas, it is necessary and expedient to take steps under section 5 and
section 7 of Environment (Protection) Act, 1986 and the Rules framed their
under, to maintain ecological balance, to prevent environmental degradation
and to avoid human health hazard in the State.
2. And whereas, in order to resolve the complex issue regarding siting of
residential project in the vicinity of industrial units/industrial areas and to
frame consolidated guidelines after considering all other guidelines/
instructions/notifications issued by Govt. of India/State Government and
various Pollution Control Boards, the Govt. of Punjab constituted a
committee headed by the Chief Secretary , Punjab which in its meeting
held on 8.6.2007, observed that in case of knowledge based industry like
electronic/I.T. Parks etc. where there is no discharge of any type, there
may not be any necessity of any buffer distance between the industry
and the residents. In fact, the concept of walk to work is being
encouraged, world wide, in green industries. The SEZ policy of Govt. of
India also permits development and co-existence of non-polluting and
non-hazardous industries. Similarly, the Punjab State Industries and
export corporation policy/industrial policy of the State Govt. have
provision for co-existence of residential and industrial establishment in
industrial parks./focal points. The committee also observed that new
sophisticated technological development today enable us to curb the
levels of pollutants from various categories of industries eliminating or
substantially minimizing the ill effects of industrial emission/discharge.

The pressure of ever increasing population, fast urbanization and nearly
double digit economic growth make it imperative that natural resources
including land, are optimally utilized. This calls for co-existence of
residential projects and industry of course, with proper safe guard
measures.
3. And whereas, it was noticed that no such minimum distance in locating
residential colony/ commercial complexes from existing industrial
complex has been fixed either by the Ministry of Housing and Urban
Development, the Ministry of Environment & Forest, Govt. of India, or
other State Pollution Control Boards from where information could be
obtained. Noticing further that in case of air and water pollution,
prescription of any such distance say 500 metres or even 100 metres,
may become more or less fruitless because pollution if created shall
spread beyond the prescribed distance. The Bhopal gas tragedy is too
recent to be forgotten. Therefore, the focus has to be on strict and rigid
pollution and risk control measures. Fortunately, the Pollution Control
Acts, provides a comprehensive system and mechanism, laying standard
and norms which the committee recommended, should be rigorously
enforced. Primarily, the committee observed that the need was to ensure
public safety for which the distance from source of hazard was relevant
for locating residential colony/commercial Complex.
4. And whereas, the committee also held a public hearing on the issue of
evolving the siting guidelines on 2.6.2007, which was attended by the
representatives of the industries as well as representatives of on going
residential complexes in the State. It was pointed out at the time of
public hearing that some of the existing and on going residential projects
are located as per the draft master plan in residential zones/Municipal
area etc. and some of these cases have got a detailed EIA study done
and obtained approval after proper public hearing. It was further

represented that the committee should take into account the huge
investments made by the project promoters as well as the individual
buyers of these properties.
5. And whereas, it was resolved that to solve the issue of siting in a logical
manner and on permanent basis, there is an urgent need to immediately
prepare the Master Plans for the entire State, designating industrial and
residential zones. Once these plans are in position, the respective activity
should be allowed only in the designated zone, thus eliminating conflict
between industrial and residential usage of land.
6. Accordingly, in supersession of earlier guidelines framed by the Punjab
Pollution Control Board vide letter no. GPC/Gen/4/419/2006/876-96
dt.17.1.2006 and any other guidelines/notification issued by the Board
from time to time, the State Govt. vide its notification no. 3/6/07/STE
(4)/2851 dt.7.8.2007 laid down the siting policy/guidelines for
establishment of residential colonies, commercial establishment like
shopping malls, multiplexes in the State of Punjab, wherein, a minimum
distance of 100 metres from the source of pollution hazard of the
Maximum Accident Hazard (MAH) industries notified by Director General
Factory Service Labour Institute to the building line of residential
colonies/commercial complex was prescribed.
The above said notification was further reviewed by the committee under the
Chairmanship of Chief Secretary, Punjab as per the observations of Hon‟ble
High Court in CWP no.18632 of 2005. This committee further decided to
increase the distance of building line of the coming up residential settlement
from the Maximum Accident Hazardous source from 100 mts to 250 mts. in the
above said notification. It was also decided by this committee that minimum
buffer of 15 metres green belt of broadleaf trees should be provided by the
colonizer towards the air polluting industries, boundary of which are located
within 100 metres from the boundary of such air polluting industries.

Now, therefore, in supersession of earlier notification no. 3/6/07/STE(4)/2851
dt. 7.8.2007 issued by the State Govt. and any other guidelines/notification
issued by the State Govt./Punjab Pollution Control Board from the existing
industries and in exercise of the powers conferred under section 5 of the
Environment (Protection) Act, 1986 read with Rules 5 (I) (vi) of the
Environment (Protection) Act, 1986, the Governor of Punjab is pleased to notify
the siting policy/guidelines for establishment of residential colonies, commercial
establishment like shopping malls, multiplexes in the State of Punjab as under;
1. The Master Plan is the final legal solution to planned development and
hence the master plans be prepared in a time bound manner on priority.
2. All residential colonies, commercial establishments like shopping malls
multiplexes etc. shall maintain a minimum distance of 250 metres from the
hazardous (Maximum Accident Hazard) industries notified by Director
General Factory Advise Service Labour Institute. The distance should be
measured from the source of pollution/hazard (e.g. storage tank, gas
chamber etc.) in the industrial premises to the building lines as per Zoning
Plan, of residential colonies/commercial complex. This notification would not
have an overriding affect on any Act/Rules/Orders of the Govt. of India/
State Govt. which prescribe a distance of more than 250 metres from such
source of hazard and the said prescribed distance shall be maintained. The
notification/ orders issued by the State Govt./ Punjab Pollution Control
Board relating to siting of industries namely stone crushers, rice shellers,
saila plants, brick Kilns, cement plants, grinding units, hot mix plants and
other industries shall remain operative and unaffected by this
policy/notification. In order to resolve any dispute regarding measurement
or other related issues, an inspection committee comprising of Chairman,
Punjab Pollution Control Board or his nominee, Chief Inspector of Factories,
Punjab or his nominee, Chief Town Planner, Punjab or his nominee and a
nominee of the Department of Industries is hereby constituted. This

inspection committee will be headed by the Chairman, Punjab Pollution
Control Board who will also act as convener of the said committee.
3. Minimum buffer of 15 metres green belt of broadleaf trees should be
provided by the colonizer towards the air polluting industries, boundary of
which are located within 100 metres from the boundary of such air polluting
industries. This would be included as a clause both by licencing authorities
of Housing Department as well by Punjab Pollution Control Board. The
species/varieties of trees shall be decided in consultation with Forest
Department.
4. In view of the fact that these guidelines may affect few existing housing
complexes and also that some projects in the pipeline may not be
conforming to the policy and also the fact that huge investments made by
the project proponents and the prospective buyers in the these project, it is
decided that all such project which are not covered under the policy, shall
be studied on unit to unit basis by the above said inspection committee as
per the guidelines prescribed above with Public safety being the prime
concern.

units/ hot mix plants) for establishments of residential colonies/ commercial
establishments, was discussed in a meeting held under the chairmanship of Chief
Secretary, Punjab on 13/1/2009 and it was decided as under :
1. The distance of 500 metres and 300 metres as prescribed in the above
mentioned notification for establishment of rice shellers/saila plants/stone
crushers and brick kilns/ cement plants/ cement grinding units/ hot mix plants,
respectively, would be maintained by the new residential colonies to be
established outside the local planning area (LPA) i.e. these notifications would
be deemed to be operative vice-versa also.
2. The residential/commercial establishments shall be allowed within the Local
Planning area as per the land use prescribed in the master plan / draft master
plan of the area irrespective of their distance from the rice shellers/ saila plants
/ stone crushers /brick kilns/ cement plants / cement grinding units/ hot mix
plants. However, minimum buffer of 15 metres green belt of broadleaf trees
should be provided by the colonizer towards the air polluting industries,

boundary of which are located within 100 metres from the boundary of such
projects.
It is, therefore, requested that the above said clarification may be kept
in view while processing the cases of residential colonies / commercial establishments.

“The Master Plan is the final legal solution to planned development
and hence the master plans be prepared in a time bound manner on priority.
Where statutory master plan has been notified under the Punjab Regional and
Town Planning and Development Act, 1995 (Amended) 2006, mixed land use
or any other development/construction which come up as per the earmarked
zone, in case of new residential, commercial, there is no need to keep any
additional distance from the existing industry from the environment point of
view because these factors have already been considered while earmarking the
use of land for different categories in the master plan, as per Notification No.
6312 dated 11th August, 2009 issued by Department of Housing & Urban
Development.

The Board in its 92nd meeting held on 10.10.1995 has decided that the
consent to establish be issued only to such industries which are located in the
following designated areas:
1. Industrial area or FEZ areas as demarcated by Town & Country Deptt. of
Punjab/Govt. of Punjab.
2. Out side “Lal Lakir‟ as notified in each village and in case the industry propos to
uses solid fuel it should be located beyond 100 meters from „Lal Lakir‟.
These guide lines are also applicable to all those industries which are
exempted by Punjab Pollution Control Board for obtaining consent to establish vide

Notice/directions u/s 33-A of the Water (Prevention & Control of Pollution)
Act, 1974 and 31-A of Air (Prevention & Control of Pollution) Act, 1981 will be
issued with the approval of Chairman of the Board.
Directions u/s 33-A of the Water (Prevention & Control of Pollution) Act, 1974
and 31-A of Air (Prevention & Control of Pollution) Act, 1981 of all large and
medium Red category of industries will be signed by the Member Secretary of
the Board.
Notice/directions u/s 33-A of the Water (Prevention & Control of Pollution)
Act, 1974 and 31-A of Air (Prevention & Control of Pollution) Act, 1981 of all
categories except directions under the said acts to large and medium Red
category industries will be signed by the Senior Environmental Engineers.
B. Siting criteria:
All Red/Orange/Green category of industries will only be allowed to set up in
the designated industries zones in the cities/towns where statutory/non-
statutory Master Plan/Local Planning area have been prepared/notified by the
Town & Country Planning Department, Punjab and designated industrial areas
/FEZ declared by the Govt. of Punjab, Department of
Industries/PSIEC/PSIDC/any other Govt. Authority.
All Red/Orange/Green categories of industries will only be allowed to set within
the Local Planning area, where the statutory/non-statutory Master Plan of the
said area is yet to be prepared/notified, after getting change of land use/NOC
from the Town & Country Planning Department, Punjab/Competent Authority of
the State. Furthermore, in case, any existing industry of red/orange/green
category within the municipal limits/local planning area intends to carryout
expansion/ modification, where the statutory/non-statutory master plans have
not been prepared/notified by the Town and Country Planning Department,
Punjab, after getting change of land use/NOC from the Town and Country
Planning Department, Punjab/Competent Authority of the State.
All Red/Orange/Green category of industries, where statutory/non-statutory
Master Plans/Local Planning area have not been prepared/ notified by the Town
& Country Planning Department, Punjab, will be allowed to set up at a distance
of 100m outside the Municipal Council limits/ phirni of village/ designated
residential area approved by the Competent Authority of the State.

Office Order No. GPC/1999-2000/Gen-434/F-1 dated 16/08/2000 as amended
from time to time will remain operative copy of which is annexed herewith as
Annexure-3.
Orange category of industries will be treated at par with Red category of
industries as far as siting criteria/shifting of industries from non-designated
area to designated industrial area is concerned. As such, all circulars/office
orders/notifications/ clarifications issued by the Board for siting criteria for
Red category of industries, will be applicable to Orange category of industries.
The siting guidelines issued for rice shelling units/parboiling plants/cement
plants including cement grinding units/hot mix plant/brick kilns/stone
crushers will remain operative and implemented independently from the
aforesaid siting criteria.
C. Consent Fee:
a) Consent to Establish/Operate fee to be charged w.e.f. 22/10/2009. Consent to establish/operate fee from large/medium/small scale Red/Orange/
Green category of industries will be charged as specified by the Board vide
office order No. Admn./SA-2/F.No.563/2009/6 dated 22/10/2009 (Annexure-
4).
b)Criteria for calculating the consent to operate fee prior 22/10/2009.
The credit of consent fee already deposited prior to 1/10/2004 under the Water
(Prevention & Control of Pollution) Act, 1974 & the Air (Prevention & Control of
Pollution) Act, 1981 for 15 years will be calculated by using the following
formula:
A– A(1XT/15) Where T is time period from the date of deposit of consent fee for 15 years upto 30/9/2004.
A is the Amount of Consent fee deposited for 15 years prior to
30/9/2004.
In case any industry had not deposited consent fee for 15 years prior to
30/9/2004, then for calculating the consent fee of such industry, yearly consent
fee applicable to the industry as per slab will be taken into account. Similarly,
consent to operate fee will be charged on yearly basis for the period 1/10/2004
to 22/10/2009.

In case consent to any industry is refused/revoked/cancelled due to violation of
the provisions of the Water (Prevention & Control of Pollution) Act, 1974 & the
Air (Prevention & Control of Pollution) Act, 1981, the consent fee will be
deducted from already deposited amount or the industry will deposit the fee
equal to the amount applicable to the industry for one year, if the industry
applies for the same afresh within one year. In case, the industry applies for
obtaining the said consent after the elapse of one year but before the elapse of
two years, then such amount will be equal to the double the yearly fee
applicable to the industry and so on.
The consent fee for the period 1/4/1992 to 9/10/1994 will be calculated as per
fee criteria given in Annexure-5. The consent fee for the period 10/10/1994
to 30/9/2004 will be calculated as per fee criteria given in Annexure-6 and
consent fee for the period 1/10/2004 to 21/10/2009 will be calculated as per
fee criteria given in Annexure-7.
D. Application form for consent to establish/operate & the procedure for processing the cases:
The application form presently prescribed for Red category of industries for
consent to establish/operate will be applicable for Red and Orange category of
industries. All Green category of industries, irrespective of their scale, will apply
for consent to establish/operate on the proforma presently prescribed for small
scale Green category of industries.
The application for consent to establish/operate/clearance certificate under the
Water (Prevention & Control of Pollution) Act, 1974 & the Air (Prevention &
Control of Pollution) Act, 1981 shall be attached with documents as mentioned
in Board's letter no. 4441-51 dated 3/5/2002 (Annexure-8). The case will be
processed by all the Regional Offices/Nodal Office as per circular no. 14442-52
dated 26/11/1999 (Annexure-9).
Restoration cases of supply of electricity will be processed as per Board's
circular no. 975-96 dated 9/3/2000 as amended on 3/5/2001. A copy of these
circulars is annexed herewith as Annexure -10&11.
Circular no. CSA/03/21st meet/10149-63 dated 8/3/2005 (Annexure-12) for
grant of NOC from pollution angle to the industries, which are covered under
the Factories Act, 1948, will remain operative.

E. Validity period of consent tooperate:
The validity period of consent to operate under the Water (Prevention
&Control of Pollution) Act, 1974 and the Air (Prevention & Control of Pollution) Act,
1981 for various categories of industries is as under:

The consent to operate alongwith clearance certificate irrespective of category
of industries shall be initially granted for 6 months and shall be extended after
commissioning/expansion/modernization of the industrial unit under the Water
(Prevention & Control of Pollution) Act, 1974&the Air (Prevention & Control of
Pollution) Act, 1981 for the period as mentioned above, only after assessing the
adequacy of the pollution control devices within the validity period of 6 months.
F. Frequency of visit/sampling:
Frequency of visit/sampling of the units shall be as under:

The Board's order no. EE-I/Gen-214/F-2 dated 31/8/2000 as partially
amended vide office order no. 2 dated 16/9/2002 will remain operative as far as
exemption of 95 category of tiny/ small industries are concerned. The list of which is
annexed herewith as Annexure 13& 14.

H. Procedure for power load to the existing industries:
The existing industries may be permitted an extension in power load upto 25%
of the sanctioned load for the purpose of modernization/expansion as per
procedure laid down in circular no. Gen./F. No. GEN-192/2001/3001-3100
dated 10/8/2001 & no. 5558-68 dated 24/7/2002. A copy of the said circulars is
enclosed herewith as Annexure-15 & 16.
The circular no. GPC/Gen/F. No. 434/2005/173 dated 7/3/2005 for power load
to green category of industries located in non-designated areas, will remain
operative. A copy of the said circular is enclosed herewith as Annexure-17.
For increase in the power load for running of effluent treatment plants/ air
pollution control devices, each industry shall apply for consent to establish
(NOC)/ clearance certificate at Regional Office of the Board containing
information in respect of following points:
i) Detail of the existing power load with each component of the effluent treatment plant/ air pollution control device.
ii) Additional components of the effluent treatment plant/ air pollution control device installed and detail of power load for each component.
iii) Completion certificate of the consultant regarding upgradation/ installation of the effluent treatment plant/ air pollution control device.
iv) An undertaking to the effect that the industry will not utilize this electric load for any other purposes except for running of effluent treatment plant/air pollution control devices and its standby motors meant for this purpose only.
The Regional Office will examine the case thoroughly and the
case will be decided by the respective Competent Authority of the Board as
per delegation of powers given in Para-A above.
I. Period prescribed for grant of consent to establish/ operate
The Govt. of Punjab has prescribed the following time period for
deciding the application for consent to establish/ operate under the Water (Prevention
& Control of Pollution) Act, 1974 & the Air (Prevention & Control of Pollution) Act,
1981 under the Punjab Industrial Facilitation Act, 2005:

How to calculate the fee to be deposited by the industry on a/c of increase in the value of fixed capital investment
The industries, which are applying first time, the calculation of consent
fee shall be @ as applicable at that time and subsequently increased rates in the
following years. The investment for calculating the fee will be as per the C.A certificate
w.r.t gross fixed assets (GFA) at that time. The industry will submit the year wise C.A
certificate for all the previous years for which consent fee is to be calculated. In case
of non-availability of records of the gross fixed assets of the previous years, the last
available value of the gross fixed assets as certified by the C.A. will be taken as the
base of calculating the consent fee for the previous years. In addition to the consent
to operate fee, the industry will also deposit the consent to establish fee for the
increased component of the gross fixed assets wherever there is an increase in the
gross fixed assets.
An illustrative example for calculating the fee in the above mentioned is
as under:
Suppose, the industry was commissioned in October, 1996 and the gross
fixed assets at the time of commissioning were Rs. 'A' and its gross fixed assets
increased to Rs. 'B' in the year 1999 and then to Rs. 'C' in the financial year 2005-06.

In order to smooth the system of grant of consents to the industry under
the provisions of the said Acts, the first time consent shall be granted by getting
deposit the fee valid upto end of the particular month as mentioned above. For
example, if a particular small scale red category industry has applied for consent for
four years and the consent to the industry is approved for grant by the Competent
Authority on 22/1/2013 and as per the present practice followed by the Board, the
expiry period of the consent becomes 21/1/2017, but as per the proposal the industry
needs to grant consent upto 30/6/2017. Thus, in case the industry has capital
investment of 8 crore and it has deposited Rs. 60,000/- (Rs. 15,000/- per year) as
consent fee for four years i.e. upto 21/1/2017 but in order to grant consent to this
industry upto 30/6/2017, the industry has deposit the additional consent fee as

For the effective implementation of the provisions of the Water (Prevention & Control
of Pollution) Act, 1974, Air Act, 1981 and Environment Protection Act (EPA), 1986 and
Rules framed there under, it is imperative that the monitoring of effluent treatment
plants, air pollution control systems, ground water quality are required to be carried
out by the Board.
In some of the cases, the Board gets Bank Guarantee from the industries/project
proponents as an assurance to achieve the standards prescribed by the Board/comply
with the various conditions imposed by the Board.
Also, in some of the cases, the Board issues necessary directions u/s 33-A of the
Water (Prevention & Control of Pollution) Act, 1974, 31-A of the Air Act, 1981 and
section-5 of the EPA to the industries which violate the provisions of the said Acts for
closure of the industries and refusal/revocation of consents.
However, it has been observed that after making necessary compliance of the
provisions of the said Acts, the concerned industry submits its report with the request
to restore the power connection of the industry and/or release of Bank Guarantee
submitted by the industry/project proponent. Accordingly, the concerned Regional
Office/Zonal Office recommends the case of the industry for permanent restoration of
electric connection of the industry and/or release of Bank Guarantee submitted by the
industry as an assurance to comply with the provisions of the relevant Act on the
basis of analysis results of single sample of effluent/emission sample, which is not
sufficient to adjudge the adequacy/efficacy of the treatment system. Thus, on the
basis of analysis results of single sample of effluent/air emission, it is not appropriate

to restore the power connection of the industry permanently and/or release the Bank
Guarantee of the industry.
In view of the above, the competent authority of the Board had decided that as and
when the request of the industry/project regarding permanent restoration of electric
connection of the industry/project and/or release of Bank Guarantee is received by
the Board, the concerned Regional Office/Zonal Office shall make recommendations
for the restoration of permanent electric connection and/or release of Bank
Guarantee only after adjudging the adequacy/efficacy of the treatment system on the
basis of three effluent/emission samples collected on different dates and these
samples must comply with the effluent/emission samples.
These orders shall come into force with immediate effect.

respective industry satisfying the following conditions:
1. That the industry is established/ being established in the State demarcated Industrial Estates/Zones classified by the State authorities viz PSIEC, Department of Industries, PUDA, Chief Town Planner under draft master plan or any other authority appointed under the statute of the State for the development of industrial experts and shall not be applicable to the category of industries established/ being establishedin predominantly residential are as and approved residential areas.
2. That the investment of theindustry is not more than Rs.25 lacs on plantand
machinery.
3. That there will not be any discharge of trade effluent from the industry into stream or well or sewer or onto land or/and that the industry will not discharge any air pollution including noise into the atmosphere.

and the Hazardous Waste (Management, Handling & Transboundary Movement)
Rules, 1989, if the unit satisfies some conditions as mentioned in the said
notification dated 31/8/2000.
Now, the Punjab Pollution Control Board in its 145th meeting held on
30/11/2009 vide item no. 145.08 has decided to raise the investment limit in
machinery from the existing Rs. 25 lacs to Rs. 1 crores for units relating to Hosiery
manufacturing as mentioned at Sr. No. 64, 65, 66 & 67 in the list of 95 types of
industries already exempted vide Board's notification no. EE-1/Gen-1/F.No. Gen

Subject: Exemption from Consent Management of the Board for Information Technology industry in the State of Punjab.
The Punjab Pollution Control Board in its 109th meeting held on
25/1/2001 vide item no. 109.32, has decided to exempt IT industry (which is not
covered under the Board's notification no. EE-1/Gen-1/F.No. Gen 214/F-2 dated
31/8/2000) from the consent management of the Board under the provisions of the
Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention &
Control of Pollution) Act, 1981 and the Hazardous Waste (Management, Handling &
Transboundary Movement) Rules, 1989, subject to certain conditions for 2 years.
Thereafter, the Board kept on extending this period from time to time and lastly
vide Board's notification no. GPC/Gen/460/2008-09/14 dated 22/1/2009 issued in
compliance of Board's decision taken in 140th meeting held on 18/12/2008, the
time period was extended for another 2 years i.e. upto 18/11/2010.
Now, the Punjab Pollution Control Board in its 146th meeting held on
12/1/2010 vide item no. 146.07 has decided to exempt IT industry / knowledge
industries as per Annexure-I of Chapter 11 of the Punjab Industrial Policy, 20098
for 5 years for obtaining the consent of the Board under the provisions of the
Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention &
Control of Pollution) Act, 1981 subject to the following conditions:
1. That the IT/ Knowledge industry shall mean:
i) Companies in the IT hardware, IT software and other knowledge industry unit such as bio-technology, Nanotechnology and Telecommunications etc. IT software industry includes IT software, IT
services and IT enabled services.
ii) A biotech company refers to Research and Development and / or non polluting manufacturing of products or processes, which use or are derived by using specific living systems (plants, animals and microbes or parts thereof) and or enzymes /biocatalysts-derived there from. The company also includes activities such as Genetic engineering or cell culture or microbiology or biochemistry and bio-informatics.

iii) Telecommunications companies include Basic Telecom Service Providers (fixed) VSAT, Cellular (Mobile) companies, Telecom Infrastructure companies, ISPs and any other value added services
licensed by Ministry of Communications & IT, Government of India.
iv) Knowledge industries refer to those industries which are relatively intensive in their inputs of technology and / or human capital. These include IT/ITES, Nanotechnology, Consulting, Biotechnology, Electronics and Telecommunications. This will also include Research
and Development services and other specialized institutions.
v) Institutions offering specialized education and training for IT and knowledge industries such as finishing schools, Entrepneurship Development Cells, Incubation Centres, Institutes of higher learning and other knowledge industries, which are part of an IT park / Knowledge Park would be eligible for the benefits under this policy at
par with IT units.
vi) IT projects refers to investment from infrastructure developers and the IT units / companies as describes in Annexure.
vii) Infrastructure developers or builders refer to real estate infrastructure companies constructing built up space for sale / lease / or sale-cum-
lease to the IT / Knowledge industries.
viii) SMEs: Small & Medium Enterprises are IT units with a fixed capital investment of upto Rs. 10 crores.
ix) Mega IT projects for developers refers to projects with fixed capital investment of Rsa. 50 crores and with a minimum area requirement
of 10 acres.
x) Mega IT projects for units refers to projects with fixed capital
investment of Rs. 25 crores.
xi) IT parks are defines as follows:
a) IT parks providing built up space to IT / knowledge industry. b) Integrated IT parks providing built up space and plotted
infrastructure for it units / companies as well as necessary support infrastructure in terms of residential, commercial, recreational and other facilities.
2. That the industry is proposed to be established in industrial zone / industrial estate / industrial area / industrial focal point / industrial parks / IT parks as declared by Competent
Authority or at any other site for which permission has been granted / deemed by Competent Authority.
3. Where no. of workers in a industry exceeds 500 and there exits no sewage treatment
facility exemption shall not be available. However, if the industry has been permitted to connect its domestic discharge to sewerage line of local authority and local authority has
sewerage treatment facility exemption shall be available.
4. Exemption shall not be available to an industry, if it uses DG set beyond 200 KVA or if its DG set does not conform to the criteria standards as laid down by the MOEF vide
notification no. GSR 371 (E) dated 17/5/2002 as amended from time to time.
5 i) IT / Knowledge industries as in para 1 above shall however required to obtain
authorization under Rule 5 of Hazardous Waste (Management, Handling & Transboundary Movement) Rules, 2008, if applicable. Normally, it shall be granted
for 5 years at a time.

ii) However, it shall exempted from obtaining authorization under category 5.1 of the
said rules, if it installs DG set of not more than 10 KVA capacity maintain record and disposes off / recycles used oil as per the provisions of the said rules.
6. That the industry will not discharge any toxic / hazardous waste and will not handle any
toxic / hazardous chemical.

To redress the problems faced by various industrial units, it has been
decided by the Board as under:
In case any industry wants "No Objection Certificate / Clearance
Certificate for extension in electric load, only for running of its Effluent treatment
plants and Air pollution control devices and its standby motors, the Regional Offices
/ Senior Environmental Engineer Office should immediately grant No Objection
Certificate / Clearance Certificate on priority basis subject to the following
condition:
1. That the Regional Office will examine the case thoroughly and record in
writing that the extension in load is meant only for operating of the Effluent
treatment plant / Air pollution control devices and its standby motors.
2. That the industry shall submit an undertaking to the fact that the industry
will not utilize this electric load for any other purposes except for running of
effluent treatment plant / air pollution control devices and its standby

Ludhiana is an industrial hub of State of Punjab and there are
approximately more than 20,000 nos. of industries operating in the city of
Ludhiana. Out of which 200 nos. are large and medium scale industries, 2500 nos.
are small scale industries of red category and approximately more than 17,500 nos.
of industries are of green category. So more than 80% of total industries operating
in Ludhiana are small scale tiny units of green category mainly engaged in
manufacturing Hosiery garments, machining of sewing machine parts, cycle parts,
auto parts, hand tools etc.
Punjab Pollution Control Board has mainly laid stress in pollution
control in red category of industries. The Board has laid down the policy for red
category of industries operating in non-designated area and as per the policy, the
industries are required to be shifted to designated area. The time period has been
extended in the past few years and recently the time period has been extended by
the Board upto 30/6/2005. The main motive behind the policy of the Board is not
to allow the establishment of any designated area of five highly polluting towns of
the State of Punjab. Ludhiana city, is one of them. The main stress of the Board
was on red category of industries but the policy was implemented in totality in all
type of industries, which included green category of industries also.
The Board has been receiving large number of representations from
various Industrial Associations of Ludhiana and also from the office of Chairman,

PSEB to allow extension in electric connection to existing green category of
industries in Ludhiana.
The process involved in existing Hosiery units are knitting on flat knit
machine and stitching of garments. The trade in the International market has been
opened to all. The hosiery units in particular when go in for modernization /
expansion, has to purchase computerized knitting machinery which cost them 1
crore to 5 crores investment in plant and machinery and also requires
enhancement of electric connection to operate these machinery so that they can
complete the product manufactured at international level. Further, due to the
addition of such type of computerized knitting machine, there is neither any
increase in pollution load of water or air.
A letter has been received from PSEB vide which it has been
intimated that a large number of green category industries are operating
particularly in Ludhiana in non designated area but predominantly resident area,
the industries are operating overload thus causing revenue loss to PSEB. The PSEB
has requested to release one time 100% load to such industries with certain
conditions, which will not cause any increase in pollution load.
The Board vide its notification no. 178/98/1 dated 20/1/1998 decided
that marginally polluting industries as per Schedule-I which cater to the daily need
of the community shall be permitted to be set up within commercial and other than
residential area of the town after obtaining consent to establish from the Punjab
Pollution Control Board under green category and in municipal areas other than
residential and commercial, consent to establish will be granted on merit after
assessing the suitability in each individual case. Though the Board is pressurizing to
shift the industries from the residential areas, however, till date there is no such
concrete policy to shift the existing industries from the non-designated areas to

designated areas. The main green category industry in Ludhiana is relating to
hosiery goods manufacturing. Due to modernization to improve the quality of the
product the latest machinery is being installed and for which additional electric load
is required. With this modernization or increase in production there be no increase
in pollution load.
In view of the above, it has now been decided that the existing green
category of industries located in non-designated areas may be permitted an
extension in power load upto 100% of their existing sanctioned load for the
purpose or modernization / expansion / regularization of over load subject to the
following conditions:
1. The industry will submit an affidavit that there will be no addition of plant and machinery generating pollution load consequent upon the increase in power load upto 100% of the existing sanctioned load at the same location and there will be no increase or addition in pollution load either on modernization or by expansion.
2. That the industry must have either valid consent to operate of the Board or should have applied for the consent to operate of the Board for the existing unit.
3. That the industry shall apply for the „consent to establish‟ on simplified green category prescribed proforma and shall deposit the requisite consent to establish fee as applicable for the expansion / modernization of the project irrespective of cost. The industry shall submit details of the plant and machinery to be installed with tentative extension in electric load.
4. That this facility will be extended to the existing green category of industries operating in non designated area.
5. That this relaxation is applicable only for modernization / expansion of the industry restricted as one time benefit only.
6. That this facility will not be extended for the establishment of new green category of industries in non-designated area.
7. This benefit of power load extension would be extended to small scale units only and subject to the notification of Govt. of India no. 477(E) dated 25/7/1991.
8. The industry shall shift its premises to designated area as and when the Govt. formulates the policy of shifting of industries in future.
9. The NOC shall not be any ground for not shifting the industry to the designated areas as and when Govt. frames the policy for shifting of industries.

The Punjab Government has prescribed the following time period for
deciding the „consent to establish‟ applications of various industries.
Red Category Within one month after submission of complete application.
Green category
i) Moderately Polluting Within one month after submission of complete application
ii) Marginally Polluting Within 15 days after submission of complete application.
However, it has been observed that a no. of consent applications are
not disposed off by the Board within the above said prescribed period. Sometimes,
the show cause notice is issued to the industry on the last date of the expiry of
prescribed time period. In view of the above, it has been decided that henceforth
the following procedure shall be adopted for dealing „consent to establish‟
applications of various industries.
1. Regional Offices should convey the observations, if any, on the application
of the industry within 2 days from the date of receipt of application. No
observations at the later stage be raised after the first set of queries are
raised.
2. Cases of the green category of industries which fall in the competency of
Regional Offices should be decided within the prescribed time period failing
which Environmental Engineers of the Regional Offices will be held
personally responsible for the delay.
3. Where the „Consent to establish‟ application falls in the competency of Head
Office, such applications maybe sent to Head Office within a period of 15

days from the date of receipt of applications after completing all the
formalities.
4. As soon as „consent to establish‟ application is received in the Head Office,
the same may be sent to the concerned Environmental Engineer by the
Administrative Officer and photocopy of the forwarding letter may be sent in
the dak for the information of the Chairman / Member Secretary.
5. Environmental Engineers, Consent Management Cell should get all „consent
to establish‟ applications cleared from the Competent Authority at personal
level and ensure that time does not over-shoot in any case.

capital investment for the purpose of calculating consent fee and approved the
proposal for change in definition of 'Capital Investment' prescribed under the
Punjab State Board for the Prevention & Control of Water Pollution Rules, 1977 and
any other rules as may be notified or modified by the Government. The definition
of 'Fixed Capital Investment' shall be as notified by Director of Industries &
Commerce, Punjab Vide notification No. Inc.11/15/43/96-5/IB/4176 dated 1st June,
1996 in its industrial policy or in consequent amendment or notification carried out
or to be carried out from time to time for the purpose of defining fixed capital
investment definition.
The consent fee shall be charged by the Board on the basis of "Fixed Capital
Investment" certificate issued by the General Manager, Distt. Industries Centre or
by the certifying Chartered Accountant regarding Fixed Capital Investment.

The Board in its 115th meeting held on 2.8.2002, decided to amend
the condition No. 1 approved by the Board in its 107th meeting held on 7.7.2000 for
exemption of 95 types of industries under tiny/small scale sector from obtaining
consent of the Board under the provisions of Water (Prevention & Control of
Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 and
Hazardous Waste(Management & Handling) Rules, 1989. Accordingly, in
superceding the condition No. 1 of the Board's office order No. EE-I/Gen-
1/F.No.Gen-214/F2 dated 31.8.2000 which will, now be read as:
"That the industry is established/being established in the demarcated industrial Estates/Zones classified by the State authorities vizPSIEC, Department of Industries, PUDA, CTP under draft Master Plan or in mixed category area or predominantly industrial areas within Municipal Limit of a Town/City after classification of the area by CTP/STP/DTP".
All other conditions remains the same.

The Board in its 115th meeting held on 2-8-2002 to encourage the

the consent to establish (NOC) to the green category units proposed to be located
in the designated /demarcated industrial areas classified by the State Authorities
like PSIEC/DOI etc. shall be granted within 48 hours on the basis of their self
certification. However, if at the latest stage, it is found that the industry has given
wrong information, then the industry will be responsible for misguiding the Board
and action will be taken for revoking of consent to establish (NOC) and closure of
the industry. However, for the Red Category units and Green Category in other
areas, the procedure shall remain the same as already in practice.

the consent to establish (NOC)/consent to operate to green category
units in small scale sector under Water (Prevention & Control of
Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act,
1981 and shall continue to exercise these powers.
However, the above powers shall be subject to :
a) Guidelines to be prescribed by the Board from time to time to
grant /refuse consent/NOC, prosecute or order closure of the
industry.
b) The Chairman may suo moto or on request by any person
concerned take action in any case which is pending before any
officer of the Board.

Whereas 32 categories of projects are covered under the Environment
Impact Assessment Notification 1994 which are required to obtain environmental
clearance from GOI, MoEF, Public hearing is required to be conducted by the State
Pollution Control Board covered under this notification. The whole process of public
hearing takes about 3-4 months time.
And whereas, many of these 32 categories are also required to obtain
environmental clearance by the State Competent Authority as required under Press
Note 17 (1984 series) of GOI, Ministry of Environment & Forests.
And whereas, as per the present procedure, the State Competent Authority
considers the grant of environmental clearance only after the public hearing which
take another 40-45 days. As such, the total time taken for the grant of
environmental clearance by the State Competent Authority comes out to be about
5 months i.e. (150 days).
And whereas, to cut short this time, following suggestions were placed
before the Board in its 123th meeting, vide item no. 123.15 held on 6/9/2004 and
decided as under:-
That CSA-cum-SAC should consider the environmental clearance in its meeting without waiting for the public hearing. This clearance can be granted subject to the clearance in the public hearing.
That all the Deputy Commissioners of the Districts in the State may be requested to prepare a Standing Panel of members for conducting personel hearings. They should provide this panel to the Board within 15 days. The panel should also include the Commissioners of Municipal Corporations.
In view of the above decisions of the Board, comments of the Board, in
cases should be sent to CSA-cum-SAC without waiting for the public hearing.

The Board has recognized laboratories u/s 17 (2) of the Water Act,
1974 and u/s 17(2) of the Air Act, 1981 for the analysis of Physical,
Chemical, Metals, Organic & Micro-biological parameters in the effluent,
stack and ambient air samples. As per the terms and conditions of the
Recognition Certificates, the laboratories are required to intimate their
programme normally two days in advance to the concerned Regional Offices
to monitor an industry. In case, the pre-decided programme is changed
during the day, the Regional Office will be informed on telephone/Fax
immediately before or after monitoring. Regional Offices will send a
consolidated report of each laboratory by 10th of next month.
Now, it has been decided by the Board that whenever any recognized
laboratory u/s 17 (2) of the Water Act, 1974 and u/s 17(2) of the Air Act,
1981 intend to collect effluent and / or air emission samples on the request
made by the industry / Board, the said laboratories will inform to the
concerned Regional Offices of the Board well in advance and the
Environmental Engineer of the said office will depute his officer on the day
of sample collection of the industry and it will be ensured that the industry is
operating its all processes at optimum capacities.
The analysis results of the samples collected in violation of the
said instructions will not be accepted by the Board.
These orders will come into the force with immediate
effect.

(as primary treatment plant) before discharging effluent into local body‟s
sewer leading to STP of town/city, individually.
The member units which are outside municipal limit/not connected to the
sewerage system leading to STP/where adequate surplus capacity in existing
STP is not available, shall provide its own sewage treatment plant.

All the member units shall submit NOC/Acceptance Certificate of local body
regarding discharge of effluent into sewer leading to STP and adequacy of
STP to take pollution load of the unit.
All the member units shall be responsible for working of sewer lines within
his area and shall be specifically banned to dispose of solid waste through
sewer and shall dispose of solid wastage in environment friendly manner.
All the member units shall get „consent to operate‟ of the Board under the
Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention
& Control of Pollution) Act, 1981 and will comply with all the provisions of
the said acts.

The Central Pollution Control Board vide its letter No.B-
31011(BMW)/30/93/HWMD/3712 dated 4.8.2009 clarified that consent to establish
& operate under Water (Prevention & Control of Pollution) Act, 1974 and the Air

meeting held on 12.01.2010 regarding coverage of Health Care
Establishments/Testing Labs/Blood Banks/Vet. Clinics & CBWTFs under the ambit of
Water (Prevention & Control of Pollution) Act, 1974 and the Air (Prevention &
Control of Pollution) Act, 1981. The Board decided that the Health Care
Establishments/Testing Labs/Blood Banks/Vet. Clinics & CBWTFs should be covered
under the ambit of Water (Prevention & Control of Pollution) Act, 1974 and the Air
(Prevention & Control of Pollution) Act, 1981. Provided these establishments shall
not be covered under the provisions of the said Acts, in case:
i) The Health Care Establishments/Testing Labs/Blood Banks/Vet. Clinics,
which are established/being established in towns other than having
Municipal Corporation/councils and have capital investment (including
land/building and machinery) below Rs.50 Lacs shall be exempted from
the ambit of Water (Prevention & Control of Pollution) Act, 1974 and the
Air (Prevention & Control of Pollution) Act, 1981 for 5 years.
ii) The Health Care Establishments/Testing Labs/Blood Banks/Vet.
ClinicsCBWFTs, which are established/being established in towns other
than having Municipal Corporation/councils and have capital investment

As you are aware of the facts that the Board issued directions 33-A
of Water (Prevention & Control of Pollution) Act, 1974 and/or u/s 31-A of Air
(Prevention & Control of Pollution) Act, 1981 or u/s 5 of the Environment
(Protection) Act, 1986 to the industries/development projects generating hazardous
waste for violations of provisions of the said Acts and Rules. But it has been
observed that the compliance of the directions are not monitored in true spirit and
meticulously by concerned Regional Officers/Zonal Officers. Many times it has been
found that the temporary electric connection/restoration permitted to the industrial
units for short period are not brought to the notice of the competent authority after
the expiry of the stipulated period, resulting in operation of the industries/units
without any permission in violation of the compliance of the directions issued by
the Board. Moreover, the effluent/air samples of these industries are not collected
within the stipulated period which also results in delay for taking further action on
these directions.
Thus, the timely monitoring of compliance of the directions issued by
the Board is quite indispensable i.e. monitoring report alongwith recommendations
should be made available to the Board atleast 15 days before the expiry of the
temporary power connection.
Therefore, it has been decided by the competent authority that timely
report on monitoring of compliance of directions including the sample collection
and analysis data alongwith recommendations should be sent to the competent
authority

Any deviation from the above shall be viewed seriously and shall
attract disciplinary action against erring officers.

The Punjab Pollution Control Board in its 148th meeting held on
23.6.2010 vide item No.148.15 permitted the use of pet coke as fuel in the
boilers/furnaces subject to the following conditions:
1. The boilers/furnace emissions shall conform to SO2 standards of 400
mg/Nm3 as laid down by Ministry of Environment & Forests for the small
boilers.
2. The industry shall p;rovide well designed two stages desulphurization i.e. at
combustion stage and of flue gas emissions.
3. The industry shall install dry type air pollution control device, such as,
cyclone/multicyclone followed by spray type alkali scrubber and packed bed
alkali scrubber. The packed bed scrubber to be installed should conform to
the guide parameters as mentioned below and the industry shall use only
caustic soda as scrubbing media:-
i) Velocity of gas through the lower is commended to be 1.5-2.5
m/s.
ii) Liquid gas ratio is recommended to be 3.5-4.0 liter/m3 of gas
flow or 80-325 lpm/m3 of lower cross sectional area.
iii) Pressure drop is recommended to 15-150 mm W.G./m of
packed bed height.
iv) Maximum inlet concentration – 5000 ppm by volume.
4. The industry shall install on line monitor for SO2 with the stack of the boiler.
5. The industry shall provide interlocking of online SO2 monitor with the feeding
system of the boiler, so as to ensure that the feeding system of fuel in the
boiler furnace should become in shut down condition, in case, the conc. of
SO2 increases beyond the prescribed standard of 400 mg/Nm3 at any time.

6. The industry shall provide online pH meter on the recirculation tank of
scrubbing liquor, from where the said liquor is fed to the air pollution control
device and ensure that the pH of the feed scrubbing liquor should remain
within the range of 10-12.
7. The industry shall provide flow meter and pressure gauge at the outlet of
the pump used to supply the scrubbing liquor to the alkali scrubber, so as to
ensure that the scrubbing liquor is fed to the air pollution control device at
the desired rate and pressure.
8. The industry shall provide a stack of height calculated by using the formula
H=14 Q0.3 and the emission rate of SO2 (value of Q in kg/hr.) should be
calculated by using the volume of flue gas emissions and the standards for
SO2 (400 mg/Nm3) or 30 m, whichever is higher.
9. The sludge produced in the recirculation tank of the scrubbing liquor shall be
disposed off in an environmentally sound manner.
These order shall come into force with immediate effect.

The Central Ground Water Authority (CGWA) has been constituted in the
year 1997 by the Government of India, Ministry of Environment and Forests under
the Environment (Protection) Act, 1986 in pursuance of directions from the Hon‟ble
Supreme Court of India for the purpose of regulation and Control of Ground Water
Development and Management in the country.
CGWA has identified Ludhiana City and 5 blocks i.e. Moga-I and II in Moga
District, Sangrur and Malerkotla-II (Ahmedgarh) in Sangrur District and Mehal
Kalan in Barnala District in the State of Punjab as Critical Area(s) in view of the
overexploitation of Ground Water Resources in the region and has declared these
as Notified Area(s). CGWA in exercise of its powers and functions under Section 5
of Environment (Protection) Act, 1986 had issued directions to regulate the Ground
Water Development and Management in these Notified Area(s) in order to improve
Ground Water regime.
In compliance to Central Ground Water Authority and Punjab State Water
Resources Committee (WRC) directions, the District Advisory Committees have
been constituted in the above mentioned Districts to regulate Ground Water
Develoment and Management in the Notified Areas by completely banning the
process of drilling, construction, installation of any Ground Water abstraction
structure for Commercial/Industrial use or by farmers having holdings above 4
Hectare of Land and to issue prior specific approval for construction of any new
structure and scheme/project of Ground Water Development as per the guidelines
of CGWA and to perform some other functions.
As the Industrial/Commercial units are required to obtain the consent to
establish (NOC) of the Punjab Pollution Control Board at the time of establishment,
under the relevant provisions of the Water (Prevention & Control of Pollution) Act,
1974 and Air (Prevention & Control of Pollution) Act, 1981, it has been decided that
at the time of grant of consent to establish (NOC) to the Commercial/Industrial

establishments in the above mentioned Notified Area(s), the Board shall impose a
special condition as under:
“That the Commercial/Industrial establishment shall seek and obtain the
prior specific approval of the District Advisory Committee for the purpose of
drilling, construction, installation of any ground water abstraction structure
for Commercial/Industrial use and submit the same to the office of the
Board at the time of obtaining clearance certificate for release of Power and
consent to operate.”
Clearance certificate for release of Power and consent to operate will be
granted to the Commercial/Industrial establishments only on the furnishing of
specific approval of the District Advisory Committee of the respective notified
area(s).

1. If, the effluent is discharged into a municipal sewer leading to a sewage treatment plant, the hotel or restaurant or banquet hall, as the case may be, shall provide a proper oil & grease trap for effluent arising from its kitchen and laundry and shall have to comply with the General Standards for discharge of Environmental Pollutants Part-A Effluents notified under Schedule-VI appended to the Environment (Protection) Rules, 1986 vide notification no.GSR-322(E) dated 19.05.1993.
2. The project proponent shall provide an acoustic enclosure (Canopy) with the
DG set, so as to contain the sound pressure level within the standards
prescribed by the MoEF vide Notification No.371(E) dated 17.5.2002 as
amended from time to time.
3. In case, the Hotel/Motel/Restaurant/Lodge/Inn/Guest House/Banquet
Hall/Marriage Palace is located within M.C. limits, the project proponent shall
obtain permission from the concerned Municipal Corporation/Municipal

handling of solid waste.
4. In case, the Hotel/Motel/Restaurant/Lodge/Inn/Guest House/Banquet
Hall/Marriage Palace is located outside M.C. limits, the project proponent

in an environmentally sound manner within/adjoining the premises of the
establishment.
NOTE: In case of any above provision, which is/will be rendered
contrary to any Notification, Law/Rules/Guidelines as issued
by the MoEF, Govt. of India, the later shall prevail.

Subject: Regularization of consents for operation of additional Machinery/ Modification/Increase in production capacity by industries/project proponent under the various provisions of Water (Prevention & Control of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981.
It has been observed that there are some industries, which had been
established and commissioned without obtaining the consent to establish/operate
of the Board required under the provisions of the Water (Prevention & Control of
Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981. Some of
the industries had carried out expansion of their existing industrial plants without
the prior approval of the Board. Some of such units are also covered under the
First Schedule of The Factories Act, 1948 and/or Press Note 17 (1984 series) but
they have not obtained site clearance/environmental clearance from SCA-cum-SAC
as required under the Law. Later on, such units have voluntarily approached the
Board for obtaining the consent to operate and/or SCA-cum-SAC for obtaining the
site clearance / environmental clearance for regularization of their establishment.
Furthermore, many other such units are still operating without approaching the
Board and/or SCA-cum-SAC. The matter was considered by the Board in its 153rd
meeting held on 9.9.2011 and it has been decided as under:
i) Units covered under the First Schedule of Factories Act, 1948 and/or Press Note 17 (1984 series) as well as EIA Notification dated 14.9.2006.
In case, such units are established and commissioned without
obtaining the consent to establish/operate of the Board / have carried out
expansion of their existing industrial plants without the prior approval of the Board
/ have made alterations or variations without the consent to establish of the Board,
then such units should be granted consent to operate by the Board only after they

obtain site clearance/ environmental clearance from SCA-cum-SAC as well as
environmental clearance under the provisions of EIA Notification dated 14.9.2006,
if required. However, the consent fee for the period prior to submission of consent
application to the Board should be charged at higher rate i.e. 2 times of the normal
fee presently being charged by the Board for each financial year. The fraction of
year shall be counted as a full financial year.
ii) Units covered under the First Schedule of Factories Act, 1948 and/or Press Note 17 (1984 series) but not under EIA Notification dated 14.9.2006.
In case, such units are established and commissioned without
obtaining the consent to establish/operate of the Board / have carried out

In case, such units are established and commissioned without
obtaining the consent to establish/operate of the Board / have carried out
expansion of their existing industrial plants without the prior approval of the Board
/ have made alterations or variations without the consent to establish of the Board,
then such units should be granted consent to operate by the Board only after they
obtain environmental clearance under the provisions of EIA Notification dated
14.9.2006. However, the consent fee for the period prior to submission of consent
application to the Board should be charged at higher rate i.e. 2 times of the normal
fee presently being charged by the Board for each financial year. The fraction of
year shall be counted as a full financial year.
iv) Units neither covered under the First Schedule of Factories Act, 1948 and/or Press Note 17 (1984 series) nor the EIA Notification dated 14.9.2006.

Board/have failed to get the consent renewed in time, then such units should be
granted consent to operate by the Board only in case such industrial units are
meeting with the prescribed siting criteria prescribed by the Board and they have
taken adequate and appropriate pollution control measures. However, the consent
fee for the period prior to submission of consent application to the Board should be
charged at higher rate i.e. one and half times of the normal fee presently being
charged by the Board for each financial year. The fraction of year shall be counted
as a full financial year.
In case, such units are not meeting with the prescribed siting criteria
of the Board, then such units should be issued directions for closure of their units
or revert back to the sanctioned capacity, as the case may be.
These orders shall come into force with immediate effect.

Subject: Permissions for the disposal of material confiscated under NDPS Act, by the police authorities and other agencies.
The Board is receiving regular requests from the police authorities
seeking permission for the disposal of drugs and other materials confiscated under
the NDPS Act. These authorities sought such permission at a very short notice. As
per present practice, such requests are routed through various channels causing lot
of time for final issuance of such permissions.
To overcome this problem, the competent authority has decided that,
in future, such permissions will be granted by the concerned Regional Officer in
whose jurisdiction the Bio-Medical Waste Treatment Facility or the industry having
incinerator falls, where these material has to be disposed off. The concerned
Regional Officer may issue such permissions after checking the surplus capacity of
the incinerators provided by such facility/industry and send the copy of the
permission to the Additional Secretary, BMW Cell, SAS Nagar for his information
and record.
This issues with the approval of the Chairman of the Board.

The Board in it 149th meeting held on 20.10.2010 vide item No.149.03 has
decided to exempt the Solar Photovoltaic Plants less than 5 MW for obtaining the
consent to establish/operate from the Board under the Water (Prevention & Control
of Pollution) Act, 1974 and Air (Prevention & Control of Pollution) Act, 1981 for a
period of five years subject to the following conditions:
1. That there will not be any discharge of trade effluent from the industry into the stream or well or sewer or onto land for irrigation and it will not cause any air pollution including noise.
2. That the industry will not discharge any toxic/hazardous waste and will not handle any toxic/hazardous chemicals.
3. This exemption shall be valid for Solar P.V. Plants having capacity less than 5 MW and having maximum manpower employed upto 25 only.
4. Domestic effluent after treatment in septic tanks shall be used for gardening/plantation purpose inside their premises.
