Seksyon 25 ng Wildlife Act (RA 9147)
PAGTATATAG NG CRITICAL HABITAT“....ang Kalihim ng DENR ay magtatalaga ng mga criticalhabitats sa labas ng Pinapangalagaang Pook na sakop ng RA7586 (NIPAS Act), kung saan matatagpuan ang mga uri ngbuhay-ilang na may banta. Ang pagtatatag nito ay gagawinbatay sa siyentipikong impormasyon/datos na maykonsiderasyon sa species endemicity and/or richness,presensya ng man-made pressures/threats to the survival ofwildlife living in the area, at iba pa.

PAGTATATAG NG CRITICAL HABITATSLahat ng itinalagang critical habitats ay poprotektahan,sa pakikipagtulungan at koordinasyon ng mga LGUs atiba pang nagmamalasakit na grupo, sa anumang pormang ekploytasyon o pagkasira na maaaring maging bantasa kaligtasan o survival ng mga buhay-ilang nanakadepende dito.
Ang mga sumusunod ang pangkalahatangkonsiderasyon sa pagtatatag ng Critical Habitats:
1. Mga uri ng buhay ilang na may banta na nakatala sa DAODAO 2004-15 (Establishing the List of Terrestrial ThreatenedSpecies and their Categories, and List of Other WildlifeSpecies pursuant to RA 9147);2. Lugar na ginagamit na breeding, nesting (pamugaran),roosting(pahingahan), wintering, foraging at iba pangaktibidad ng mga natural na uri ng buhay ilang na naitala odi pa naitatala subalit nakaambang mawala;
3. Presensya ng man-made pressures o mga bantakagagaya ng logging, quarrying, mining,squatting/informal settling, at mineral exploration4. Mga prayoridad na lugar para sa konserbasyon nanatukoy ng Philippine Biodiversity Conservation PrioritySetting Program at iba pang key biodiversity areas (KBA);5. Presensya ng iba pang likas-yaman na may pang-ekonomiya at pang-sosyal na impact sa lugar. (watershed)

5.1 Ang lahat ng naitalagang critical habitats ay magkatuwang ngpangangasiwaan ng LGU at iba pang kinauukulang grupo. Ang DENRsa pamamagitan ng Regional Executive Director ay maaaringpumasok sa isang Memorandum of Agreement (M0A)/PartnershipAgreement sa LGU, People's Organization (PO), Non-GovernmentOrganization (NGO), Indigenous People/lndigenous CulturalCommunity (IP/ICC), private sector o iba pang kinauukulang grupopara sa pamamahala ng critical habitats;
Section 6.Paghahanda/Paggawa ng Critical Habitat Management Plan6.1 Ang Critical Habitat Management Plan (CHMP) ay magkatuwangna bubuuin ng kinauukulang DENR Regional Office, LGU at iba panggrupo. Ang CHMP ay magsisilbing giya o gabay sa pamamahala ngcritical habitats;6.2 Ang CHMP ay naglalaman, subalit hindi limitado sa, mgasumusunod:(1) Layunin;(2) Mga matitingkad ng isyu sa pamamahala;(3) Mga estratihiya sa pamamahala ng lugar at mga aktibidad
kagaya ng: monitoring and evaluation, community organizing,habitat rehabilitation, etc; at,
(4) Administrasyon o Pamamahala, na binibigyangkonsiderasyon ang resulta ng mga proseso isinagawa nanakasaad sa Seksyon 4 ng Memorandum Circular na ito.
