for Comprehensive Planning, Architectural Services,
Geotechnical
Investigation, Clearances, Permissions, NOCs, Detail Design,
Construction
Supervision, Quality Control and Quality Assurance for
Marine/Building
infrastructure project (hereinafter referred to as Agreement) is
made at

Office at 2nd
floor, Indian Mercantile Chambers, Ballard Estate, Mumbai - 400

hereinafter referred to as the Client (which express shall

its successors and permitted assigns) of the One Part.

Time limit for completion of work shall be ____months from the

The tenderer shall submit their offer for projectwork as per the

The said project work shall be carried out as per the tender

document, prevailing specifications and instructions on site

execution
along with obtaining necessary permissions.

2.1 INSTRUCTION TO TENDERERS
The bid document can be downloaded from the aforesaid e-
tendering portal by the prospective Bidders by paying Rs.
5,000/-
as the Tender form fee and Rs. 50,000/- as an Earnest Money
Deposit through the payment gateway of Maharashtra Maritime
Board Mumbai, Payment in any other mode, including but not
limited to cash/demand draft/term deposits/pay order will not
be
accepted.
MMB will not be responsible for any delay in submission of
bids,
including conditional bids and reserves the right to accept or
reject
any or all bids without assigning any reason thereof and
incurring
any liability thereof.

Maharashtra Maritime Board, however reserves the right to
reject
any or all the tenders without assigning any reasons what so
ever.
Canvassing or lobbying in connection with tender in any form
renders the tender liable for rejection.
All the bids shall be based on the drawings and design
attached
to the Tender.
The tenderer firm or company shall in their forwarding
letter,
mention the name of all the partners/directors of the firms or
the
company (as the case may be) consortium details and the name
of the partner / director who holds the power of attorney
with

attested copy of registered power of attorney, authorizing him
to
conduct transaction on behalf of the firms or company.
The tenderer whose tender is accepted will have to give an
undertaking in writing to the effect that they will pay the
Labours
engaged on the work, the wages as per Minimum Wages Act,
1936 and amended up to date applied to the zone in which the
work lies and act accordingly.
The successful Tenderer shall comply with the provisions of
the
payment of Wages Act, 1936, Minimum Wages Act, 1936,
Employees Liability Act, 1938, Workmens Compensation Act,
1923, Industrial Disputes Act, 1947 and the Maternity Benefit
Act,
1961, the Contract Labour (Regulation and Abolition) Act,
1979
and any modification there of or any law relating thereto, and
rules
made there under from time to time.
The Tenderer whose tender is accepted should note that the
Corporation will release no foreign exchange.
The tender notice along with all the tender documents
including
minutes of pre-bid meeting shall form a part of the contract
agreement.
The tenderer will have to sign the original copy of the
tender
papers and the drawings according to which the work is to be
carried out. The Tenderer shall also have to give a declaration
on
stamp paper of Rs. 100/-, that he is conversant with local
conditions / laws and availability of labours and materials and
he
has quoted his rates with the consideration to all these
factors
The Client reserves right to revise or amend the contract
documents fully or part thereof, prior to the date notified
or
amended for the receipt to tender. Such deviations/amendments
if
any shall be communicated in the form of corrigendum or by a
letter as may be considered suitable.

The Client reserves the right to relocate the buildings /
Marine
Structure shown in the tender documents (Layout) within the
same site. PMC shall have no objection for this and he will
execute the work and no additional payment will be made for
this.
The acceptance of tender may be communicated to the tenderer
by E-mail / Speed Post / Courier /Personally or otherwise
either
by the tender Opening Authority or any Authority in the
Maharashtra Maritime Board, Mumbai.
The successful tenderer will be required to produce within
one-
month (i.e. 30 days) to the satisfaction of the specified
concerned
authority, a valid and concurrent license issued in his favour
under
provisions of the Contract Labour (Regulations and Abolition)
Act
1979, before starting the work. On failure to do so, the
acceptance
of the tender is liable to be withdrawn and earnest money will
be
forfeited and submitted Bank guarantee will be encashed.
All Tenderers are cautioned that the tenders containing any
deviation from the contractual terms and conditions,
specifications
or other requirements and/or conditional tenders shall be
rejected.
2.2 CONDITIONS OF OFFER:
2.2.1 The bidders are required to upload coloured scanned copy
of
original documents as below-
Eligible PMC as per eligible criteria mentioned in the
tender
document and who have completed Three (03) similar works
(Building, Bridge, Marine Structure, Paving, Pavement, etc.)
as
described in this tender document with minimum proven
experience in Project Management.
Experience certificate (Work Done Certificate) of having
started
and completed at least 3 (Three) similar work of construction
of
building /marine structure during the last 3 (Three) years.

The average annual turnover of the PMC for last three
financial
years shall not be less than the 50.00 lakhs. As regards
three
similar works, the work done certificates clearly stating the
scope
of the work, the date of the work order, stipulated and actual
date
of completion, levy of penalty, if any, etc, shall invariably
be
submitted. In case of the private works, the work done
certificate
under the hand and seal of the owner, PMC and structural
design
engineer should be submitted.
The tenderer should give Original copy of Valid GST
registration
certificate from Goods and Service Tax Act.
The tenderer should give all details of Technical person
available
with the PMC since last five year and their CV.
The tenderer should give all details of Manning schedule.
The tenderer should give all details of the works carried out in
last
three financial years.
The tenderer should give all details of work in hand.
The tenderer should give all details of works.
The tenderer should give all details of the similar work
completed
by him or her. These works / Projects shall be open for
inspection
and verification by representative of the Client.
The tenderer should give all details of Bar chart showing
progressive details of Project work for stage 1, 2, 3.
2.2.2 In case any parent company / proprietor / directors /
partners of company
are black listed by any government organization, please mention
the
name of the organization who `have blacklisted and the
operative
period of blacklisting. If above information is found incorrect,
the
tender will be rejected at any stage even during consultancy
period.

2.2.3 The past experience / track records / performance of PMC,
view of quality,
workmanship, punctuality and directly/ indirectly subletting of
works will be
viewed during scrutiny of tender / awarding works, even if the
PMC is
lowest among the bidders.

2.3.1 Tenders should have valid Class 2 Digital Signature
Certificate (DSC)
obtained from any Certifying Authorities. In case of requirement
of
DSC, interested Bidders should go to https://mahatenders.gov.in

Instructions to the PMCs/Bidders for the e-submission of the
bids online

After downloading / getting the tender schedules, the Bidder
should go
through them carefully and then submit the documents as
asked,
otherwise, the bid will be rejected.
If there are any clarifications, this may be obtained online
through the
tender site, or through the contact details. Bidder should take
into account
of the corrigendum published before submitting the bids
online.
Bidder, in advance, should get ready the bid documents to be
submitted
as indicated in the tender schedule and they should be in
PDF/xls/rar/dwf
formats. If there is more than one document, they can be
clubbed
together.
Bidder should get ready the EMD as specified in the tender.
The bidder reads the terms and conditions and accepts the same
to
proceed further to submit the bids.
Bidder should read the Announcements and Downloads section
of
https://mahatenders.gov.in before proceedings.
The bidder has to submit the tender document online well in
advance
before the prescribed time to avoid any delay or problem during
the
submission process.
After the bid submission, the acknowledgement number, given by
the e-
tendering system should be printed by the bidder and kept as a
record of
evidence for online submission of bid for the particular
tender.
Bidder has to pay EMD online using online pay mode i.e. in this
stage all
the PMC will have to pay EMD online by using Net Banking, Bidder
will
have to validate the EMD payment as a last stage of bid
preparation. If the
payment is not realized with bank, in that case system will not
be able to
validate the payment and will not allow the bidder to complete
his Bid
Preparation stage resulting in non-participation in the
aforesaid e-Tender.
The Tender Inviting Authority (TIA) will not be held responsible
for any
sort of delay or the difficulties faced during the submission of
bids online
by the bidders.
The bidder may submit the bid documents either by online mode
through
the site (https://mahatenders.gov.in) as indicated in the
tender.
The tendering system will give a successful bid updating message
after
uploading all the bid documents submitted and then a bid summary
will be

shown with the bid no, date and time of submission of the bid
with all
other relevant details. The documents submitted by the bidders
will be
digitally signed using the e-token of the bidder and then
submitted.
The bid summary has to be printed and kept as an acknowledgement
as a
token of the submission of the bid. The bid summary will act as
a proof of
bid submission for a tender floated and will also act as an
entry point to
participate in the bid opening date.
Bidder should log into the site well in advance for bid
submission so that
he submits the bid in time i.e. on or before the bid submission
end time. If
there is any delay, due to other issues, bidder only is
responsible.
The bidder should see that the bid documents submitted should be
free
from virus and if the documents could not be opened, due to
virus, during
tender opening, the bid is liable to be rejected.
The time settings fixed in the server side and displayed at the
top of the
tender site, will be valid for all actions of requesting, bid
submission, bid
opening etc., in the e-tender system. The bidders should follow
this time
during bid submission.
The bidder should logout of the tendering system using the
normal logout
option available at the top right-hand corner and not by
selecting the (X)
option in the browser.
The bidder should upload the Technical document in .rar format

to upload in Technical cover and then BOQ in .xls format single
file to
upload in Finance cover.

2 The said tender fee and EMD shall not carry any interest.
3 E.M.D. exemption certificate issued by P.W.D. or any other
department will not be accepted.
4 The amount of earnest money will be refunded to the
unsuccessful
Tenderers except Lowest two tenderers, within a month from date
of
opening of financial envelope. The tenderer shall have submitted
the
bank details for refund of EMD. If details of bank are not
correct and
the amount refunded is transferred to any other account, the
MMB
shall not be held responsible.
5 In case of the successful tenderer, Earnest Money Deposit will
be
refunded on his/her paying the initial security deposit and
completing
the agreement formalities mentioned in the tender document or
will
be transferred towards a part of security deposit to be paid
after
awarding of the work.
6 Earnest Money Deposit of second lowest tenderer will be
refunded
on payment of initial security deposit and completing the
agreement
formalities mentioned in the tender document by the
successful
lowest one tenderer.
7 If successful tenderer does not pay the security deposit in
the
prescribed form, within time limit and does not complete the
agreement formalities and / or does not execute the contract
within
prescribed time limit then his/their earnest money deposit will
be
forfeited by Maharashtra Maritime Board, Mumbai.

i) TENDERING PROCEDURE
a. Blank Tender Forms:
Blank tender forms can be downloaded online from the
e-Tendering
portal of MMB i.e. https://mahatenders.gov..in as per the
schedule
defined in the tendernotice.
b. Pre-Tender Conference:
a) A Pre-Tender Conference open to all prospective tenderers
will be
held at Mumbai on 04.06.2018 at 15.00 PM in the Office of
the
Chief Executive Officer Maharashtra Maritime Board in Presence
of
the Chief Engineer, Superintending Engineer, the Financial
Adviser
and Chief Accounts Officer and the Executive Engineer, MMB.
Mumbai, wherein the prospective tenderers will have an
opportunity
to obtain clarifications regarding the work and the tender
conditions. Response to queries raised at the time of
pre-bid
meeting will be uploaded on the e-Tendering portal of the MMB.
i.e.
mahatenders.gov.in under the section Press Notices /
Corrigendum
b) The prospective tenderers are free to ask for any
additional
information or clarification either in writing or orally and the
reply to
the same will be given by the Client, in writing. This
clarification
referred to as Common set of deviations shall form part of
tender
documents and which will also be common and applicable to
all
tenderers.
c) The tender submitted by tenderer shall be based on the
clarification, additional facility issued (if any) by the MMB
and this
tender shall be unconditional. Conditional tenders will be
summarily
rejected.
ii) In case, there is any doubt/omissions regarding the wording
in general
conditions or special conditions or the scope of work or the
specifications and drawing or any other matter concerning the
contract,

the same shall in good time be submitted to the Chief Engineer,
MMB
Mumbai, to reach him before scheduled pre-bid meeting date and
time,
in writing in order that such doubts may be clarified authority
before
tendering.
iii) Manner of submission of tender and its accompaniments:
e -Tender process shall be carried out in two stages as
below
Technical Envelope
Technical Envelope shall contain the following documents.

/-
as the Tender form fee and Rs. 50,000/- as an Earnest Money
Deposit through the payment gateway of Maharashtra Maritime
Board Mumbai, Payment in any other mode, including but not
limited to cash/demand draft/term deposits/pay order will not
be
accepted.
Project Management Consultancy as per eligible criteria
mentioned
in the tender document and who have completed five similar
work
as described in this tender document with minimum proven
experience in consultancy.
Details of the works tendered for and in hand with the value of
work
unfinished on the last date of submission of tender. The
certificates
from the Head of the offices under whom the works are in
progress
should be enclosed. The Tenderer should give all details of work
in
hand. An Undertaking declaring the truthfulness of the value
of
such works in hand to be considered for calculation of the
bid
capacity be submitted.
Note: - Any wrong information / misinformation in this regard
would
invite disqualification. Works in hand shall be supported by
certificate issued by agency / authority. It also includes
private work
if any.

List of Machinery and Plants owned or hired immediately
available
with the tenderer for use on this work.
Details of works of similar type and magnitude carried out by
the
Tenderer.
Details of Technical Personnel, consortiums with name,
qualifications and experience in similar works, and a period of
his
working with organization, who will be working on this project
as
technical key persons for supervision, to receive technical
instructions issued by the authorities from time to time.
(Details of
Technical person available with PMC since last five years and
their
CV).
Details of payment received in all Project Management

required
to select the relevant document / compressed file (containing
multiple
documents) already uploaded in the briefcase.
Notes:
The PMCs should upload a single document or a compressed
file
containing multiple documents against each unloadable
option.
The Hashes are the thumbprint of electronic data and are
based
on one way algorithm.
The Hashes establish the unique identity of Bid Data.
The bid hash values are digitally signed using valid Class I
or
Class 2 Digital Certificate issued any Certifying Authority.
The
PMCs are required to obtain Digital Certificate in advance.
After the hash value of bid data is generated, the PMCs
cannot
make any change / addition in its bid data. The bidder may
modify

9. Technical Envelope - DELETED
Technical Envelope of the tender will be opened online to verify
its
contents as per requirements on stipulated in table below. If
the various
documents contained in this envelope do not satisfy the
requirements
of the MMB, a note will be recorded accordingly by the tender
opening
authority and the said tenderers. Financial Envelopes will not
be
considered for further action but the same will be rejected and
recorded
by tender opening committee.
Technical proposal evaluation criteria
A successful firm shall secure minimum Marks of the total points
as
mentioned in Table below.

1) Techno-commercial evaluation criteria - DELETED
This will be a techno commercial evaluation and accordingly
the
Technical evaluation will have 60% weightage and Commercial
evaluation shall have 40% weightage. These weightages shall
be
taken into consideration for arriving at the Successful Firm.
The
evaluation methodologies vis-a-vis the weightages are as
under:
Score will be calculated for all technically qualified Firms
using the
following formula: S = (T/T High x 60) + (C Low/C x 40)
Where:
S = Score of the Firm
T High = Highest Technical score among the Firms
C = Quote as provided by the Firm
C Low = Lowest Quote of C among the Firms
The Firm securing the highest score becomes the successful
Firm
For example There are three Bidders A, B and C.
Technical score will be arrived at treating the marks of the
Bidder
scoring the highest marks (A) in Technical evaluation as
100.
Technical score for other Bidders (B, C, etc.) will be
computed
using the formula Marks of B / Marks of highest scorer
A*100.
Similarly, Commercial Score of all technically cleared Bidders
will
be arrived at taking the cost quoted by L1 Bidder i.e., the
lowest
quote from all technically qualified Bidder (say C) as 100.
Marks
for other Bidders will be calculated using the formula
Commercial
Score = Cost of L1 Bidder / Cost quoted by Bidder * 100.
A Combined score will be arrived at, taking into account
both
marks scored through Technical Proposal evaluation and the
nominal commercial quotes with a weightage of 60% for the
Technical Proposal and 40% for the Financial Proposal as
described below.
The combined score is arrived at by adding Technical Score
and
Commercial Score. The successful Bidder will be the one who
has
highest Combined Score.

2) Eligibility cum Technical Proposal - DELETED
Eligibility criteria for the Bidder to qualify this stage are
clearly
mentioned in Eligibility Criteria Compliance to this document.
The
Bidder would need to provide supporting documents as part of
the
eligibility proof. The Technical Proposal will also be evaluated
for
technical suitability.
During evaluation of the Tenders, the MMB, at its discretion,
may
ask the Bidder for clarification in respect of its tender. The
request
for clarification and the response shall be in writing, and
no
change in the substance of the tender shall be sought, offered,
or
permitted.
The MMB reserves the right to accept or reject any tender in
whole or in parts without assigning any reason thereof. The
decision of the MMB shall be final and binding on all the
Bidders
to this document and the MMB will not entertain any
correspondence in this regard.
1 Financial Envelope - DELETED
This envelope shall be opened as per schedule, only if
contents
of Technical Envelope are found to be acceptable to the MMB.
The lump sum amount quoted shall then be read out.

The MMB reserves the absolute right to accept any offer not
necessarily the lowest.
Tenderers are hereby cautioned that opening of financial
envelope shall not be treated as acceptance of his technical
qualification, financial offer and acceptance of bid of
tenderer.
Validity period: Normally, the offer of the Tenderer shall
remain
valid for 30days (Thirty Days Only) from the date of opening
of
Tender. However, in exceptional cases, with intimation to
the
eligible bidder, the MMB, reserves the right to extend such
validity maximum up to 30 more days unilaterally and the
same
will be binding on the bidder
2 SECURITY DEPOSIT - DELETED
I. Total Security Deposit 5 % (Five Percent) of tender cost
offered by
Tenderer and Accepted by the MMB.

Initial Security Deposit
The successful tenderer shall have to pay 50%
Security Deposit in cash (i.e. in the form of
demand draft) or in form of Term Deposit
Receipt from Nationalized Bank / Scheduled
Bank in the name of. The Maharashtra Maritime
Board, Mumbai or Bank Guarantees from a
Nationalized Bank/ Scheduled Bank for the
project period in the enclosed form and complete
the contract documents failing which his earnest
money will be forfeited to the Corporation.
2I. Remaining Security
Deposit
The balance 50% Security Deposit will be
recovered from the next 3 R.A. Bills.
The Bank Guarantee / Term Deposit Receipt shall be kept
valid
for the project period. Before expiry of the Bank Guarantee /
Term
Deposit Receipt, the PMC shall renew it or submit new Bank
Guarantee / Term Deposit Receipt of required period well
before

the expiry date, if necessary, or otherwise the Guarantee /
Term
Deposit Receipt will be encashed accordingly.
In case of non-renewal of Bank guarantee / Term Deposit
Receipt
or non- submission of Bank guarantee / Term Deposit Receipt
well in time, a penalty of Rs. 5,000/- (Rupees Five thousand
only)
per day (after the expiry of the date) will be imposed till
submission of renewed Bank Guarantee / Term Deposit Receipt
or new Bank guarantee.
All compensation or other sums payable by the PMC under the
terms of this contract or any other contract or an any account
may
be deducted from his Security Deposit or from any other bill of
the
organization.
sums which may be due to him or may become due to him by
Client on any account and in the event of the Security
deposit
being reduced by reason of any such above noted deductions
the
PMC shall within ten days of receipt of notice of demand from
the
Client make good the deficit and reinstate the security
deposits.
There shall be no liability on the Client to pay any interest on
the
Security Deposit paid by or recovered from the PMC.
3 REFUND OF SECURITY DEPOSIT - DELETED
The 50% security deposit amount will be refunded after the
successful
completion of Geotechnical Investigation along with all reports
of this
project on submission of completion certificate of PMC and
Authority
from Executive Engineer of MMB and balance 50 % security
deposit
will be refunded after 12 months period or completion of
foundation
whichever occurs earlier.

Now this Agreement witnessed, and it is hereby agreed by and
between the parties hereto as follows: -
1. DEFINITIONS: For the purpose of this Agreement the following
words are
defined as under:
1.1 The term Architect as used herein shall mean an Architect
should
belicensed to practicethe profession of Architects under the
IndianArchitects
Act, 1972, andregistered with the Council of Architecture
inIndia.
1.2 The term Block Estimate as used herein shall mean the cost
of work
given by PMC based on approximate estimate.
1.3 The term Breakwaters are the protective barrier constructed
of R.C.C or
course rubble masonry to enclose harbours and to keep the
harbour waters
undisturbed by the effect of heavy and strong sea waves.
1.4 The term Budget as used herein shall mean the sum the Client
proposes
to spend on the Project inclusive of professional fees and
expenses and
statutory charges.
1.5 The term Contractor as used shall mean the contractor
appointed
forconstruction of the project.
1.6 The term Detailed Estimate as used herein shall mean the
cost of
workbased on detailed drawing, design and detailed measurements
and rate
analysis for individual items of work.
1.7 The term Dolphins are man-made marine structure, located at
the
entrance of the locked or alongside a pier or a wharf that
extends above the
water level and is not connected to shore.
1.8 The term Draft or draught of ships hull is the vertical
distance between
water line and bottom line of the hull,with the thickness of the
hull included.
1.9 The term Fees as used herein shall mean the amount to be
paid to the
PMCor the services rendered to Client.
1.10 The term Jetty are the structures in the form of piled
projections and they
are built out from the shore to deep water and they may be
constructed
either for a navigable river or in the sea.
1.11 The term Link span is a type of drawbridge used mainly in
the operation
of moving vehicles on and off a RO-RO vessel or ferry,
particularly to allow
for tidal changes in water level.

1.12 The term Model as used herein shall mean digital model
prepared using
2D, 3D software to visualize the building / project.
1.13 The term Ro-Ro is Roll on/ roll off ferries are large,
conventional ferries
named for the ease by which vehicles can board and leave.
1.14 The term Structural Consultant is a structural engineer who
analyze,
design, plan and research structural components and structural
systems to
achieve design goals and ensure the safety and comfort of users
or
occupants.
1.15 The term Services as used herein shall meanthe services to
be provided
by the PMC as specified in the Agreement herein below.
1.16 The term Site as used herein shall mean the place where
those works are
to be carried out.
1.17 The term Site Staff as used herein shall mean theStaff
appointed by the
PMC / Client to inspect the works.
1.18 The term Specialist / Expert /Sub Consultant as used herein
shall
meana person or firm, other than the consultant, appointed by
the PMC to
provide expertise, skill and care, involving design, in the
supply or
manufacture of goods, materials or components or in the
construction of
parts of the Project.
1.19 The term Tender cost as used herein shall meanthe offer
submitted by
the Contractor and accepted by Client.
1.20 The termTimetable as used herein shall mean the timetable
for the
completion of the services by the PMC under this Agreement.
Stages into
which the process of designing building projects
andadministering building
contracts is divided in accordance with this Agreement. The same
has been
mentioned in Para - 8 and Para - 10 of this Agreement.
1.21 The term Works as used herein shall mean the works to be
carried out by
the Construction Contractor as described in theContract Document
executed
between the Client and Construction Contractor.

TERMS and CONDITIONS OF AGREEMENT:
2. GENERAL SCOPE OF SERVICES: Subject to the provision of
this
agreement, PMC shall be responsible for discharging the scope of
services
set out hereunder:
2.1 The PMC shall perform services and carry out its obligations
hereunder with
all due diligence, efficiency and economy, in accordance with
generally
accepted professional techniques and practices, and shall always
observe
sound management practices. It shall cause to be employed
appropriate
advanced technology and safe and effective equipment,
machinery,
materials and methodsin connection with the Project at all
stages of the
Project. The PMC further covenants with Employer to furnish its
best skill,
care, diligence, and judgment in the rendition of all services
under this
agreement which shall be no less than that exercised by a PMC of
good
reputation performing work for projects of a size, scope and
complexity
similar to the Project and to further the interest of Client at
all times through
efficient business administration, management and
construction
management services.
2.2 Standard of care :
PMC acknowledges the relationship of trust and confidence
established
between the PMC and Client by this Agreement. Accordingly, the
PMC acts
shall be consistent with this relationship. The PMC shall always
act, in
respected any matter relating to this Agreement, as an honest
and faithful
adviser to Client. The PMC shall at all times support and
safeguard Clients
legitimate interests in any dealings with the Contractor or
other third parties.
2.3 Adherence to law :
The PMC shall perform works / services under this Agreement in
accordance
with the applicable laws, bye- laws, rules, regulations, etc.
and shall also

ensure that his personals comply with the applicable laws,
bye-laws, rules,
regulations, etc.
2.4 PMC Not to Benefit from Commissions Discounts, Etc.:
The remuneration of the PMC pursuant to Para - 9 of this
Agreement shall
constitute the PMC sole remuneration in connection with this
Agreement and
the Project. The PMC shall not accept for it sown benefit any
trade
commission, discount or similar payment in the discharge of its
obligations
here and the PMC shall ensure that its personnel, agents, sub-
agencies,
etc. similarly shall not receive any such additional
remuneration. The PMC
shall at all times perform its responsibilities here under in
the best interest of
Client. Any discounts or commissions obtained by the PMC in
exercise of its
responsibilities here under, whether fromContractor or any third
parties shall
be to the account of Client.
3. SCOPE OF PMC SERVICES: 3.1 The Clienthas proposed to

3.2 The broad scope of services under this contract shall be the
preparation of
conceptual plans for selection of options by the Client,
detailed architectural
drawings including plans, elevations and sections, etc. all
Structural Designs
and drawings, Electrical, HVAC, indoor and outdoor lighting,
plumbing,
Sanitary, Fire detection and safety system, Communication
system, LAN,
Access control, Surveillance Security system, power backup and
Green
features, Landscape, Certification from respective competent
authorityetc.,
includes providing detailed designs and specifications with Bill
of Quantities,
preparation of tender document, tender drawings for all works
involved in the
construction of the
----------------------------------------------------------------------------
----------------------------------------------------------marine,building,etc.infrastructure
as per requirement of Client.
3.3 Obtaining necessary approvals from local bodies / statutory
authorities, State
Govt. and Central Govt. if any, etc. as per requirement to start
and complete
the project without any hindrance.
3.4 Preparation of construction drawings, Modification to the
drawings during
execution if required and also assist Client during the
execution.
3.5 Preparation of project schedules, broadly monitoring of
project, liaisoning
with the Client, engineersand the contractors for the execution
of the project
as per the approved designs and drawings, etc. Preparation and
submission
of completion drawings /diagrams / reports and obtaining
completion /
occupancy certificate from the local authorities /statutory
authorities / bodies,
etc.
3.6 The scope of work shall not include appointment of the
contractor and any
direct contractual dealing with the contractor during pre-tender
stage and
duringthe execution of the work. However, during execution it
should be as
per scope of stipulated tender conditions of works contract and
the scope of
work shall include any other servicesnormally required by the
PMC such as
site inspections at various stages of work to ensure successful
completion of
the project as per approved designs and drawings.

3.7 Through all the project phases Client expect the PMC to
illustrate the interest
and commitment to utilize the latest National and International
techniques in
order to promote fast, efficient, economical and sound technics
for
completion of the project.
4. THE DETAILS OF SERVICES TO BE PROVIDED BY THE PMC :
4.1 ARCHITECTURAL SERVICES:
4.1.1 Site evaluation, analysis and impact of existing and /or
proposed
development on its immediate environs.
4.1.2 Preparation of design, site development, Masterlayout plan
of entire plot,
Architectural detail drawings, Elevations, Sections,etc., with
details of area
analysis, Building geometry, marine works,etc.
4.1.3 Preparation of all good for construction drawing for
structural designs,
HVAC, electronic, elevators, internal and external works i.e.,
electrical,
water supply, Sanitary works, drinking water, sewerage
design,
Telecommunications, Networking, Graphic signage,
firefighting
arrangements, security systems and other mechanical systems,
parking
etc., and all related civil works including technical
specifications of works as
per requirement of Client.
4.1.4 Preparation of preliminary drawings using Auto CAD or
equivalent for
various floors, toilets, staircases, elevators, etc. explaining
the general
planning with schedule of internal and external materials and
finishes and
dimensions. Plumbing / Electrical layout indicating internal and
external
lines, transformer, fire safety detection and firefighting
system, UPS and
location of channels for electric cables, telephone, LAN, AC
ducts and other
conduits for services, complete in accordance with the relevant
NBC /local
Bye laws including 2D drawings and 3D views, walkthrough
presentation
using 3Dmax or equivalentat no extra cost and obtaining approval
of
Client/any other user suggested by Client.

4.1.5 Preparation of detailed architectural drawings sufficient
to prepare tender
documents consisting of floor plan to each level, reflected
ceiling plans at
each level including coordinated lighting and service features,
external
(faade) elevations, internal elevations, cross sections and
longitudinal
sections, terrace plans, electrical/lighting fixtures /
switching plan including
MCCB, MCB, ELCB, capacitors and earthing, plumbing and
schematics,
interiors, etc.Storm water drainage detailed plans of ground and
terrace
plan for effective disposal to ensure no leakages, dampness
inside the
building. Proper slopes at roof level, ground level for
effective drainage
without ponding and stagnation of water should be provided as
a
precautionary measures.Effectiveprotection from rain and heat
shall be
provided in Architectural plan with due study of rain, wind and
sun
directions. Proper protective measure should be incorporated in
the
Architectural plan so that building shall give comfort of living
/ working
atmosphere in all the seasons during rain, winter and summer.
Protective
measures like fins, chajjas, boxes or any other types of
architectural
features shall be included as built and no extra works after
construction
shall be provided. If Architectural plan is not designed
considering proper
climatic conditions and not in consistencywith structural
requirements then it
shall be rejectedout rightly at stage - 1. PMC shall submit
alternative plan
within 10 days to the satisfaction level of Client.
4.1.6 For important building projects/marine works as per
requirement of Client,
block model shall be prepared. After finalization of the working
drawings,
the PMC shall be required to prepare a block model to a
convenient scale,
showing the complete details of the building and entire plot, in
addition, the
PMC is also required to prepare a model to a convenient scale
showing the
site along with its proposed landscape etc. locating the
proposed building in
it.
4.1.7 Key plan shall be showing details from the main highway
and access to the
subjected plot for building infrastructure with proper distances
boundaries
and North direction.

4.1.8 Preparation and submission of detailed designs, drawings
and documents
for all internal utility services like plumbing,
electrification, firefighting, fire
detection and lifts, telephones, PABX, LAN, Networking, public
address
system and other specialized services etc. as per the
requirements of the
Project, suitable for construction and development to site.
4.1.9 Preparation and submission of detailed designs, drawings
and documents
for all external utility services like water supply, sewerage,
storm water
drainage, fire hydrants schemes, treatment plants for sewage,
rain water
harvesting, water supply intakes arrangements, roads, street
lighting,
telephone system, electrical transformer, electrical substation,
lightning
arrestor and other related schemes, boundary walls and any
other
specialized services as per Project requirement suitable for
construction
andissue to site of work including getting necessary approvals
from Client
and other departments.
4.1.10 Preparation of landscape architecture, interior
architecture, architectural
conservation, graphic design and signage, etc.
4.1.11 Preparation of detailed specifications, bill of
quantities, rate analysis.
4.1.12 Preparation of Tender drawings, Technical specifications,
vendors /
manufacturer for materials and equipments and tender documents
for
Bidders. Assistance to Client in providing clarifications to
Bidders, Pre bid
meeting and specifying the construction contract.
4.1.13 The approvals of the Clientare required on all drawings,
specifications,
documents,etc. and PMC shall be responsible for
modifications,
incorporation of suggestions, etc. suggested by Client.
4.1.14 Obtaining of approvals from local bodies / statutory
authorities, State Govt.
and Central Govt. if any, etc.
4.1.15 The PMC shall prepare the drawings, technical
specifications and liaison
with all departments for statutory approvals, clearances of
various

authorities in execution of the project and ensure compliance
with codes,
legislation as applicable, etc.
4.1.16 Ensure engaging the required key professionals for
services such as
architectural, structural, electrical and mechanical systems
(MEP), HAVC,
Networking and LAN, Sanitary and Public Health system for the
project
designing and execution, etc.
4.1.17 The PMC shall also attend the reviews, meetings,
presentations,
conferences pertaining to the project and also liaison with the
statutory
Client for obtaining the necessary certificates, permissions,
ocs, occupancy
certificate, etc.
4.1.18 Assist Clientin the concerned litigations, court of law
in all cases pertaining
to this project as they may arise up during the period of their
assignment
including DLP, as per the directives of Client.
4.1.19 Attend all meetings about this project at various places
and prepare minutes
and compliances as per directives of Client.
4.1.20 Prepare and arrange Power Point Presentation, walk
through or similar
Presentation on this project at various forums / locations as
per the
directives of Client.
4.2 STRUCTURAL ENGINEERING SERVICES:
4.2.1 The PMC should specify well in advance the details of
Geotechnical
surveys, soil investigations and required tests for the
purpose
ofreimbursement if such soil investigation and testsare required
to be
carried out by Client. The foundation system shall be finalized
referring the
Soil Investigation reports and in consultation with Client.
4.2.2 Geotechnical, soil investigation and required test shall
be the responsibility
of PMC for design of foundations. Detail investigation as per IS
code / BIS
code is essential.
4.2.3 The building/marine works shall be designed to withstand
static/dynamic
loading (wind/seismic) and the design shall be strictly in
accordance with

the latest Indian Standard Code of Practices / National Building
Code. The
structural analysis and design shall be done by using latest
version of
software packages such as STAADPRO or equivalent. The provisions
in
various BIS Codes shall override the packages output.
4.2.4 The PMC shall supply all design calculations/computer
input and output
giving specific reference to BIS/NBC, along with soft copies.
The structural
drawing showing the reinforcement details / bar bending schedule
shall be
prepared as per latest edition of SP: 34 (SandT). All overriding
conditions
prescribed by IS: 13920 as applicable or any other applicable
BIS code
shall be taken into account while preparing the structural
drawings
4.2.5 For all structural designs and drawings the PMC get the
proof check done
by specialize structural designer, structural designer firms,
institution, etc.
orproof checking consultant / consultants approved by Client as
per
requirement and decided by the Client. Structural Design shall
be based on
minimum standards specified in codes,standard specifications and
design
criteria, etc.Design criteria is annexed asAppendix - I.
Presentation of
structural drawings and design alongwith specified consideration
and
assumption is mandatory by structural consultant of PMC.
4.3 SERVICE DESIGNS:
ThePMC shall be responsible for the design of the following
systems and
after his suggestion the contractor shall provide the same -
4.3.1 The design, details, drawing, plans, etc. for the
following minimum services
shall be carried out as per the provisions of the design brief
for respective
services and shall be approved by Client. PMC shall provide
detailed walk
through presentation of the services and ensure that there is no
conflict
amongst them.
i. HVAC - It shall be provided with latest features having
energy
efficiency standards. The approval for the same as per
requirements of Competent Client for access control
system/security system shall be responsibility of PMC till
DLP.

ii. FIRE DETECTION and FIRE FIGHTING SYSTEM - Highest fire
safety norms in accordance with local fire byelaws/ codes
are
to be followed and state of the art microprocessor based
addressable fire alarm systems shall be considered. And
approval for the same as per requirements of Competent
Authority for firefighting system shall be the responsibility
of
PMC till DLP(Defect Liability Period).
iii. ACCESS CONTROL SYSTEM/SECURITY SYSTEM - Access
Control System/ Security system shall be designed and
supervise to maximize the performance of fire/intrusion
alarms
and security systems. Approval for the same as per
requirements of Competent Authority for access control
system/security system shall be the responsibility of PMC
till
DLP.
iv. ELEVATORS - The elevators shall be as per international
standard with latest features. The approval for the same as
per
requirements of Competent Authority for elevators shall be
the
responsibility of PMC till DLP.
v. POWER MANAGEMENT SYSTEM -As directed by Competent
Authority shall be considered.
vi. Transformers and HV/ LV panels - As directed by
Competent
Authority shall be considered.
vii. DG SETS - As directed by Competent Authority shall be
considered.
viii. UPS -As directed by Competent Authority shall be
considered
for computers, communication system, etc.
ix. SOLAR ENERGY SYSTEM (SES) -As directed by Competent
Authority. The solar energy system shall beconsidered for
common grid as per requirement of MMB. Supervision of SES

shall be the responsibility of PMC till DLP.Solar energy
system
shall be designed for different purpose like hot water,
lighting,
pumping water, etc. as specified by Client.
x. WATER PURIFIER AND WATER COOLERS - On approval,
appropriate capacity have to be considered in the
design.Supervision of water purifier and water coolers shall
be
the responsibility of PMC till DLP.
xi. WASTE WATER MANAGEMENT AND SOLID WASTE
MANAGEMENT SYSTEM - A sewage treatment plant shall be
designed to provide soft water for horticultural and other
uses.
Supervision of waste water management and solid waste
management shall be the responsibility of PMC till
DLP.Proper
disposal location for waste water and solid waste shall be
identified and marked on drawing by the PMC.
xii. ENVIRONMENTAL PROTECTION - Cautious effort shall be
made to ensure the project provides positive contribution to
the
Environment and confirm to local pollution control norms.
Suitable environmental impact assessment study and
mitigation
measures if applicable by law shall be suggested by PMC. The
approval from the Competent Authority shall be the
responsibility of the PMC, if applicable for the project.
xiii. INTERIOR DESIGN - The interiors of the building shall
be
designed to ensure pleasant environment that encourages
excellence and working comfort. The design of the furniture
and
interior design shall be the responsibility of PMC. The
Interior
Design shall be carried out by qualified interior designer and
the
design shall be approved by Client in consultation with user
of
building.
xiv. LANDSCAPING AND HORTICULTURE - Appropriate hard and
soft landscaping shall be designed to be in harmony with the
surrounding Environment and neighborhood. The objective is
to

provide a harmonious and friendly environment with green
area
and landscape features.
xv. GREEN BUILDING CONCEPT While designing the building,
the green building concept shall be used by the PMC as per
the
direction of Client for special type of buildings and
certification
from Green Rating for Integrated Habitat Assessment (GRIHA)
or LEED shall be obtained by PMC.
xvi. ELECTRIC / WATER SUPPLY CONNECTION The PMC shall
responsible for completing all formalities regarding electric
/
water supply connection.
xvii. STORM WATER DISPOSAL Storm water disposal shall be
designed and accordingly plans shall be prepared. No
stagnation, ponding of water on terrace and on ground shall
be
allowed. Ensure effective disposal of storm water at the
lowest
level of land. Water bodies shall be designed and planned
and
developed according toexisting site topography. Proper
disposal
location for storm water shall be identified and marked on
drawing by the PMC.
xviii. DUCTS Suitable and sufficient ducts shall be provided
required for utilities and services considering maintenance
facilities
xix. ELECTRICAL CABLES AND APPLIANCES Services, safety,
etc. shall be ensured while designing and planning.
xx. PLINTH LEVEL AND GROUND LEVEL Plinth and ground
level of the building shall be designed and planned so that
no
rain water should be stagnated or entered into any part of
building infrastructure.
xxi. TREE PLANTATION Existing trees shall be preserved.If
tree
removal is unavoidable then first priority to transplantation
shall

be ensured before cutting. Permission for the same is the
responsibility of PMC after approval for the same. Arboriculture
/
tree plantation shall be considered while planning and
designing
of infrastructure around the building and on available land
as
requirement of users and tree authority. Tree plantation shall
be
as perAppendix - II.
xxii. EXISTING STRUCTURE Existing structure shall not be
demolished without prior permission of Client. If existing
structure needs to be demolished then proper valuation and
value for credit shall be considered in the estimate. For
such
structure separate cost valuation shall be prepared by PMC
and
approval from Client is mandatory.No objection certificate
shall
be obtained from competent authority before demolition. It is
the
responsibility of PMC.
xxiii. SOURCE OF ELECTRICITY, WATER, TELEPHONE Source
of electricity, water, telephone, other services, etc. shall
be
marked on plan and frame the estimate accordingly.
Permission
for the same shall be the responsibility of PMC.
xxiv. OCCUPANCY CERTIFICATE - The PMC shall be responsible
for completing the all formalities regarding occupancy
certificate.
xxv. OTHER SERVICES - Any other services connected with the
work shall be designed as per standard practice. Preparation
of
the lighting scheme including HVAC, Sanitary and plumbing,
drainage system, landscaping, signages, information board
and
all other appurtenances, etc.
xxvi. ZONES While planning and designing of the building
structure, due consideration to the climatic conditions,
locations,
situations, surroundings, rainfall, temperature, local
heritage,
surrounding habitants, natural resources, etc. shall give
preference.

4.3.2 The PMC shall ensure the durability, serviceability,
structural adequacy,
conformation to the design standards aesthetics, structural
component of the
project before recommending the same for approval. After
scrutiny by Client,
the corrected design and drawings shall be prepared for approval
and issue
the drawings good for construction and the process. Any
component which
requires redesigning on account of exigencies of the site like
redesigning the
foundations, utilities etc., during the execution shall be
approved as
expeditiously as possible.
4.4 ENGINEERING DOCUMENTS / DETAILED ESTIMATES:
4.4.1 Preparation of Detailed estimate along with general
description and abstract
as per P.W.D. Standard Specifications, works manual, eDSR (PWD)
and
SSRs of PWD and MJP, Parks and gardens, FMR (Fair Market rate)
of
MCGM, MSEB, BEST, etc.for engineering works. For items not
covered in
these then NBC/ CPWD/ CBRI Standard and specifications or any
other
standard specifications and rates as applicable with complete
working
details, rate analysis, schedules such as internal and external
finishes,
hardware sanitary fitting and tap ware, building specifications
including
specification for all trades and services, and bill of
quantities including those
of various services all based on schedule of rates conforming
to
specifications and procedures approved and prescribed by the
Clientto
describe the whole project adequately. Submitting details of
calculations of
such Schedule of quantities to enable the Client to check them
before
preparation of draft tender documents.
4.4.2 Where prescribed specifications and/or schedule of rates
do not provide for
certain items/services specification and rates based on proper
market rate
analysis supported by competitive quotations from
reputed/specialized /
authorized agencies shall be adopted for these items with the
approval of the
Client.
4.5 PREPARATION OF TENDER DOCUMENT:
4.5.1 The PMC may indicate any special requirements to suit
his
Architectural/Structural concepts as well as timely completion
of the Project.

However, the final decision for stipulating the special
conditions for Pre-
Qualification / Post- Qualification of the contractor shall be
determined by the
Client. The PMC shall prepare a DRAFT TENDER DOCUMENT based
on
the standard contract document approved by the Client
incorporating
construction methodology and special conditions as felt
necessary by him in
consultation with the Client.
4.5.2 On approval of the draft tender document, the PMC shall
prepare sufficient
number of tender documents.
4.5.3 The Team leader of PMC shall attend pre-bid meetings with
the bidders and
offer clarifications, if any, sought by the intending bidders.
The PMC shall
prepare minutes of such meetings and also prepare Common Sets
of
Deviations duly considering technical, financial and legal
aspects and in
consultation with Client for issuing to the bidders within two
days.
4.5.4 The PMC shall attend opening of tenders/offers. He should
prepare
evaluation report to evaluate the bids received for work
contract. The PMC in
consultation with Client shall scrutinize the bids received,
prepare
comparative statements, carry out assessment of bids and give
his
recommendations including advice on acceptability or otherwise
of the bids
received and attend meetings as and when called by the
Client.
4.6 EXECUTION STAGE:
4.6.1 Prepare and issue of working drawings with all details for
proper execution of
the work. This shall include preparation of fabrication / shop
drawings for
select items as well as scrutiny / approval of shop drawings
submitted by
contractors for various services.
4.6.2 Revision of drawing details and specifications as required
by construction
process.
4.6.3 Prepare critical path method chart (CPM) / PERT chart for
material,
manpower, machineries, etc. for implementation and completion of
project
within prescribed time period as per works contract,
consultation with
contractor and submitted duly signed by PMC, contractor to
Client for

approval.The PMC shall also prepare SOPs (Standard Operating
Practices)
and got approved from Client prior to start of work.
4.6.4 Preparation of Project planning on MIS(Management
Information
System)/Primavera along with sequence of construction. The PMC
shall
prepare and plan all design details, deliverables and plan the
construction
program to complete the project.
4.6.5 The PMC shall attend all the review meetings conducted by
Client from time
to time without any extra cost and shall also be available for
any
clarifications and bring out any issues related to construction
which may lead
to difficulties, litigation, delays etc.
4.6.6 Preparation of the As-Built drawings within a month of the
occupation for
release of final bills to the Contractor.
4.6.7 Preparation of Bill shall be done in time by PMC on actual
measurments at site of work.
4.6.8 PMC shall provide material sample for approval from
Client.
4.6.9 Testing of material , quality checking, quality assurance,
etc. shall be done
by Contractor in time and 25% of the testing shall be witnessed
by PMC.
4.7 ROLE OF PMC KEY TECHNICAL PERSONNELS DURING ENTIRE
EXECUTION:
4.7.1 The PMC shall assist in pre-commencement/ Construction /
post completion
activities / defect liability period with respect to the
project, for ensuring that
the work is carried out as per approved drawings, designs and
specifications
through a team of qualified and experienced technical personnels
to be
provided at site of work, including Architects, Engineers etc.,
and to bring out
deviations, if any, to the notice of the Client for its
rectifications in advance to
keep the specified progress of work as per conditions of works
contract.
4.7.2 In the event of differences relating to the
interpretations of drawings
/designs/specifications/ any other part of the Consultancy
between the PMC
and the contractors, the interpretation and the decision of the
Clientshall be

final and binding. Assisting and preparing the compliances in
arbitration and
litigation cases that may arise out of the contracts entered
into in respect of
any of the works.
4.7.3 Exercising cost control and economy measures to ensure
that the approved
Estimates are not exceeded.
4.7.4 The PMCshall obtain the approval of the Client for any of
the material
deviation in the design or specification that may be required
and felt
necessary during execution due to technical or administrative
reasons.
4.7.5 The PMC should analyze any deviations provide detailed
specifications and
rates of supplemental items, additional items and remains for
deletions if any
arises during the construction stage.
4.8 POST COMPLETION:
4.8.1 The PMC shall submit required number of sets of completion
drawings and
other details to local authorities and obtain completion
certificates. The PMC
shall be responsible for obtaining final completion certificates
from different
authorities in respect of various building and services and
securing
permission of Municipal Corporation and such other authorities
for
occupation of the building and assist Client in obtaining refund
of deposit if
any, made by the Client to the corporation or any such other
Client. ThePMC
shall prepare and submit maintenance manual and housekeeping
schedule
for the completed building, infrastructure, all utilities, all
services, etc.
4.8.2 The PMC shall be responsible for scrutinizing the AS
BUILT
DRAWINGSof the building/marine works prepared by Contractor
and
submit it to the Client.PMC is also responsible for all services
for reference
and records to Client both in hard cloth mounted drawings and
digital mode.
4.8.3 The PMC shall submit record of all warranties and
guaranties of electro
mechanical systems and contact numbers and details for
service.

4.9 CONSTRUCTION MANAGEMENT
The PMC shall;
4.9.1 Act as Clients representative at project site and depute
required engineers
for supervision, monitoring for construction activities.
4.9.2 Organize construction planning and management services at
site to enable
monitoring of work in accordance with construction schedule as
per
construction manual prepared by PMC and approved by Client.
4.9.3 Provide quality control checks at site based on standard
specifications and
certify quality of work performed by contractor as per PWD norms
on site
and in laboratory also.
4.9.4 Scrutinize, certify and approve invoices, bills and other
documents submitted
by contractor against for releasing advance/stage/ final
payments.
4.9.5 Work carried out would be measured and certified by an
independent
Quantity Surveyor of the PMC.
4.9.6 Co-ordinate with the various concerned agencies on behalf
of the Client and
obtain all necessary approvals wherever required.
4.9.7 Take measurement and certify the work, recommend for
payment of the
work which shall be fully consistent with quality and
specifications prescribed
in the agreement entered into. While submitting such bills of
contractor the
PMC shall follow the rules and instructions issued by the Client
from time to
time. The PMC shall be deemed to guarantee the correctness,
scrutiny,
checking or approval by them, as to quality of the work
concerned. The
Client or its authorized representative(s) may also check a
certain
percentage of the measurements and bills as felt necessary.
4.9.8 Supervise the work and also check measurements of hidden
items to be
done jointly by the PMC staff in the presence of the contractor
or his
authorized representative. The PMC shall affix their signature
as a token of
their check.
4.9.9 Furnish monthly reports on monitoring of Quality Control
to the Client
covering the above-mentioned aspects and any other important
point
relevant to the quality of work and the extent of his
inputs.

4.9.10 Submit monthly progress reports to the covering physical
progress against
targets, financial progress against targets, all quality control
results and
suggestions for corrective actions, quality aspects compliance
with tender
specifications / provisions and suggestions for wiping out
back-log if any.
The progress reports shall also include the PMC inputs on the
job for the
period of reporting and any other observations.
4.9.11 PMC shall also submit progress details of work with
respect to scheduled
program and shall submit causes for delay if any and suggestions
if any to
maintain progress work as per schedule.
4.10 PROCESSING OF BILLS
4.10.1 Interim monthly bill, payments shall be based on the
actual work done at
site of work and certificates which includes detailed
measurements and
abstract, photos, etc. processed by the PMC on the
