Susan M. Dooha We are now celebrating the 25th Anniversary of the Americans with Disabilities
Act. Regrettably, the timing of revisions seemingly did not permit consideration
of new detailed guidance from the U.S. District Court applying the Americans
with Disabilities Act to Emergency Preparedness planning and disaster response.
The Court’s interpretation of the law now has bearing on this document. See
Case 1:11-cv-06690-JMF Document 159 Filed 11/07/13 Page 1 of 119.
Subsequent guidance in the form of settlement agreements was also approved
by the Court, to offer assistance to planners. It is my hope that this document will
be reopened to apply the Court’s guidance so that jurisdictions that struggle to
comply with the law will have the most current statement of the law’s
requirements.

Lawrence J. Shudak I am not sure what the committee's response means["The TC recognizes the
revisions as suggested through the various PI submitted to clarify the intent of
this section of the document."] but the issues sited in the PI (#202)for clause
5.9.2 were not resolved. The term "when feasible" does not meet the manual of
style for language in the body of a standard because it is not enforceable and is a
recommendation. Directing that a risk analysis is to be completed to determine
whether redundancy is to be implemented is in line with the manual of style. The
PI (#202) for 5.9.2 also recommends other critical factors which need to be
considered in addition to reliability and interoperability. Referencing NFPA 72
resolves this issue.

Jim Reidy Singling out one affected group such as "those who identify as transgender in
various stages of transition" that is already covered by anti discrimination laws is
not necessary. The evacuation shelter plan can address all types potential
evacuees covered by anti discrimination laws. otherwise the plan would have to
identify every single type of potential special category of potential evacuee.
See

be reopened to apply the Court’s guidance so that jurisdictions that struggle to
comply with the law will have the most current statement of the law’s

Kevin R. Klein I am uncomfortable with J.5 down. States change and not sure I want to refer an
example as a specific state.
