TMDL Activities Update Lance informed the group that Susan has taken another position within IDEQ and her position is open. He is evaluating what she was working on and what the WAG wants to accomplish over the next 2-5 years. He indicated that he had no technical information update at this point. Lauri said that the bacteria and sediment TMDL's for 5, 10 & 15 mile Creeks were at the same place as last time. Consent Agenda Approval of Minutes from Previous Meeting The minutes from the regular meeting on November 10, 2011 were approved.

Discussion Agenda Introduction of New Executive Director Dan Steenson introduced the new Executive Director, Melanie Miller. Dan summarized the selection process. Minutes from the Executive Session, held on December 1, 2011 where Melanie's selection was agreed upon were presented and approved. A one-year agreement with Ms. Miller was signed and enacted on January 10, 2012.

Melanie gave a brief background of her experiences and expressed her delight at being selected as the new Executive Director.

TMDL Activities Update Lance informed the group that Susan has taken another position within IDEQ and her position is open. He is evaluating what she was working on and what the WAG wants to accomplish over the next 2-5 years. He indicated that he had no technical information update at this point.

Lauri said that the bacteria and sediment TMDL's for 5, 10 & 15 mile Creeks were at the same place as last time. DEQ is looking at steps taken in the past, looking at what EPA said was lacking and moving forward.

First TAC meeting for Sand Hollow Watershed was held in December. They are trying to involve more local people in implementation and many local people were at the meeting. Next meeting will be in February or March.

Lauri said the sediment TAC meeting focused on developing a sediment target following recommendation from EPA, which reflects a TMDL they would approve. sediment TMDL load allocation to be met. Need to have a follow-up TAC meeting to discuss affect levels and how targets were developed. Timeline could be some time this calendar year once they have targets. A work group is also focusing on the Indian Creek temperature TMDL. There will be a Follow-up meeting scheduled some time in the future to decide next steps. Who is scheduling this meeting?

Multiple questions for DEQ: (1) Is there momentum on any projects that should have priority? (2) Who is going to schedule a meeting with DEQ? (3) Complete tributaries and then look at Lower Boise in terms of their allocations? (4) Is it worth it to create a separate TAC for Lower Boise TP and the tribs? (5) What are DEQ's capacities?

Melanie and new chair will facilitate meetings - first meeting should be to set LBWC TMDL priorities, then set meetings to look at 2012 Lower Boise TMDL's and phosphorus.

Lance and Lauri indicated that everything DEQ is doing is high priority because they are part of the Settlement Agreement.

Idaho Integrated Report Discussion

Robbin Finch presented background on the Integrated Report Discussion. (See attached handout)

The Clean Water Act requires states to report water quality status to EPA every two years. The five report summarizing surface water quality status in the state, identifies waters fully supporting, partially supporting, and not supporting standards. Category Five of the report, not meeting standards, TMDL required, includes the listing and priority for waters needing a TMDL.

Canyon County Comprehensive Plan

Kevin LoPiccolo presented the Canyon County Comprehensive Plan, which has 15 components, from property rights to populations, natural resources, hazardous areas, transportation, communications, design, agriculture, electrical and more. The Plan anticipates 80% of Canyon County land area will remain in agriculture. Commercial and industrial is less than 1% and residentia119%. The plan shows land uses the County observes and anticipates will be developed and how to minimize conflicting land uses (e.g. agriculture can co-exist with commercial and light industrial but less well with residential uses). The County anticipates guiding future growth based on the development and building permit processes. The Middleton/Star area is where the County observes recent and anticipated future residential growth and development. The County has worked with multiple entities to develop a smart growth concept. The Plan is reviewed and updated every five years and looks forward 10 years. The Plan includes growth projections for each sector on a countywide basis. Specific land uses are not broken down into areas where growth is anticipated to occur. Protection and respect for all zoning districts is a key component of the Plan.

Council Business 2011 319 Grant: Agriculture TAC Recommendations (monitoring, outreach) There will be another workgroup meeting next week on the outreach plan, and Clint is working on a monitoring approach, but these items are still a work in progress and thus no vote of approval was made at this meeting.

Tanya announced that she is transferring to Kansas. Henry noted that the LBWC was very appreciative for all the great work Tanya has done on the 319 grants and she will be missed by all.

Education outreach is still draft - having another meeting next week - key is to get educational material finalized and come back to council next month. Pamphlet finished for 319 grant outreach. How do we get distribution list for pamphlet? Subgrant development forms must be signed and given to DEQ.

319 Grant Amendement - LBWC Board Member In -Kind Estimate

The 319 grant in-kind hourly rate recommendation is $30/hr for board members, $25/hr for state employees for calculation of the in-kind match. The recommended In-kind rates were approved, with one dissenting vote, Flood District #10.

BAG Meeting Update and 319 Grant Applications

The BAG met in November to review six projects that were submitted from SW Idaho. BAG ranked and submitted the projects to the superbag. No projects were proposed within the Lower Boise Watershed. The superbag met in December. Three of them will be submitted to EPA. EPA estimates 30% hit in funding, so not sure how many projects will get funded this year. It was suggested that a white paper and/or letter be sent to Senators to keep funding for the 319 program.

Over last five years, 319 funding has been distributed throughout the regions to non-point source projects in the following amounts, Panhandle has received $1.5 million 14.8%, Clearwater $3.4 million 33% Southwest Basin $2.5 million 24%, Mid/Upper Snake $2 million 20%, and Bear Basin $0.6 million 6.25%.

The Lower Boise 2011 grant for 319 will be fully funded. Money is in an account and available to fund projects. The 2009 319 grant has been fully spent. The 2011-14 grant amount is $250,000. We will identify and implement five to seven projects over the next couple of years.

Other sources for non-point source funds include State and Farm Bill (NRCS) monies. There will be new NRCS staff due to turnover so identifying new state or federal staff will be important for us to be able to implement high quality 319 projects.

2012 Executive Officers Election

Executive Officers - Chair, Vice-Chair, and Secretary/Treasurer were nominated. Lee Van De Bogart was nominated as Chairman, Liz Paul as Vice-Chair and Henry Hamanishi as

Secretary/ Treasurer. It was moved and seconded to accept the slate of officers and unanimously approved.

At this point, Lee took the lead as chairman, thanking the retiring officers for their service.

Approval of Invoices

Invoices from CH2M Hill and Executive Director were approved as presented.

Board Liability Insurance

The board annual liability insurance policy was approved for another year and the invoice approved.

Discussion Agenda TMDL Activities Update The DEQ staff had lunch with Melanie. Lance reported that since the last meeting, the position to replace Susan has closed with 36 applicants. Those will be narrowed down to 12 who will be interviewed in the next weeks.

Lance provided a handout on what is being done on various tributaries and who the responsible party is for each.

1. Indian Creek - two assessment units covering sediment, temperature and fecal coliform.

TMDL status:

Temperature - processing thermograph data

Sediment - TAC meeting held in December. Agreement that an analysis of concentration and duration using the Newcombe and Jensen 1996 study at an SEV (Severity Score) 8 is appropriate goal for sediment. Awaiting USGS data on Mason Creek to see relevance to IC. TAC will contact DEQ once they have decided on final sediment target to be used.

Working group meeting needed for Indian Creek.

2. 5/10/15 Mile

New report on monitoring assessment for 5/10/15 Mile will be up on website this week.

3. Mason Creek

No action on Mason Creek at this time. Waiting on report from USGS.

4. Lower Boise

Staff is working on proposal and a timeline is being prepared.

5. Lake Lowell

Ag implementation plan is being worked on. Targeted completion date of April.

6. Willow Creek

Being delisted for temperature. Once Indian Creek is complete, information can be applied to Willow Creek and others.

DEQ is initiating 319 grants on the Watershed. Robbin will be a representative on the SW BAG. DEQ would like to invite Wayne Newbill to the next meeting. He works on Idaho One Plan.

Boise Basin Watershed Solutions Presentation, David Tuthill

This program is an opportunity for trading as an impactor for reducing phosphorus. Nutrient, sediment and temperature need to be reduced. Watershed approach is attractive but not necessarily practical. Successful watershed projects were highlighted - Willamette Partnership and Freshwater Trust. These are two models that are working. Freshwater Trust is considering expansion into others areas, including the Boise Basin. The major deal with these two projects is on temperature reduction. Deals have not been made with irrigators yet. The Boise basin has a much broader approach and appeal. Riparian activities have some possibilities - temperature as well as wetlands. Possibility of automation of wetlands and reuse of agricultural and municipality waters. Lower Boise Watershed Council is a standard bearer for a program similar to Willamette. Idaho Watershed Solutions, Inc. is in the role similar to Freshwater Trust. Idaho Water Resources Research Institute could help with funding. To become part of the team - agencies, NGOs, INL, additional stakeholders - irrigation organizations, equipment vendors, NPDES holders -$50K/year for 4 years. Benefits - leverage funds, help frame activities to benefit stakeholder interests, identify

additional options.

Schedule for 2012 includes review and formulation of a trading framework, writing and filing

for federal and state grants and participate in regulatory discussions.

Mason creek will be the first focus for trading nutrients, sediment and temperature.

If the canal systems can be automated, it saves some water throughout the season.

These are the preliminary findings from the monitoring on Mason Creek. There were five sample sites including gages and turbidity probes. Development has occurred over 10 years. The watershed is 71 miles squared. Population has grown 65% in Nampa and Caldwell that are impacting Mason Creek. 12 water quality samples were collected. Results:

1. Nitrate was highest during irrigation season 2. Total phosphorus - turbidity and flow explain 91% in sample data 3. Ecoli - 92% 4. Phosphorus highest during irrigation season 5. 3 age classes of fish found 6. Mason Creek can support cold water fisheries

Challenges to collecting data included backwater, wading, non-telemetered data, sampling over range of conditions, storms. To continue would cost $30K annually - matching funds unknown. The plan is to rotate this to other tributaries - Eagle Drain and Dry Creek are next in the rotation. Similar rotation set for next year.

Council Business 2011-12 319 Grants

First $250,000 is almost spent. We need to begin spending the second $250,000.

The 319 TAC is working with NRCS to find participants. A new brochure to get the message out to find more participants has been finalized. These will be handed out at farm shows, Simplot and Amalgamated field staff will distribute. Need to find other venues to help with distribution. Suggested that is be sent to Sorrento, Darigold, flood control managers, university programs.

A summary report on the first 319 grant projects should be written.

Discussion Agenda 319 Project

James Eller presented a 319 project for approval. This project is a conversion from surface to drip irrigation system on 37.4 acres of mint. Cost is $30,404. 319 share is 60% or $18,242.40. Steve Sweet moved to approve the project, Bob Braun seconded. Motion carried.

Following the approval of the project, the group discussed how to monitor 319 projects including how much gain we have from sediment, phosphorus, nutrients, etc. going into the river. One of the primary tasks of the TAC is figuring out how to monitor effects of 319 projects.

It was suggested that we work with NCRS to develop priority criteria for projects going forward - create a "minimum criteria" they need to meet to obtain funding. Group asked how we go about getting projects in as groups rather than one at a time.

DEQ Update

Indian Creek - working on thermograph for temperature. Analysis is not quite complete. Working group for end of March.

TAC meeting has been set for March on sediment in Indian Creek.

Lower Boise River - phosphorus planning meetings on TMDL's scheduled for March 16 -additional meetings will cover details of TMDL's including target dates. June 30, 2013 USGS analysis will be done. Contract with USGS runs through June 2013. Data mined will be on phosphorus for the river and its tributaries. Monitoring will be 3 time periods on 40 sights including irrigation, off irrigation and winter seasons to see what all of the seasons provide. From this a model will be created for moving forward.

USGS has ore matching funds from cancelled projects - will be able to match at 50% for some projects - nest year will be at 43%.

DEQ will have a new hire in the next couple of weeks.

DEQ is trying to meet with Pioneer Irrigation in April and Soil Conservation Districts.

New 319 application cycle opens April 9.

Idaho One Plan - Wayne Newbill (Association of Soil Conservation Districts) Idaho One Plan is confidential based on Idaho Code. It provides farmers with an online conservation planner (www.oneplan.org/cp) . All farmers should have a conservation plan to: 1. Deliniate your farm and 2. Establish resource concerns The conservation plan is based on 15 questions about your farm - common resource area, land use, ground water management area, etc. The program comes up with different options to follow with different management practices. A finished application gives you a conservation plan based on NRCS criteria. Plan detail for each field and farmstead action items are the end product. OnePlan is a pesticide record keeping program from University of Idaho Extension Service (www.oneplan.org/par) . It is a soil fumigant application management project funded by EPA region 10 and is now required for all applications. All fumigants are restricted use. Following good agricultural practices is mandatory for this project. Buffers and/or mitigating practices will be mandatory next year. Nutrient management is a program being done mostly by consultants for dairymen. Download map, describe your livestock, describe bio-nutrients from livestock (auto calculations) and the program calculates nutrient application and calculates how much you need to buy - then calculates nutrient risk management. Conservation funding program are listed on the OnePlan website. Carbon sequestration is also on the website - when carbon credit becomes important. New mapping module - can zoom in (based on google mapping) - now has 2011 imagery. What else is coming? Carbon credit trading, TMDL/run off reduction credit trading When a conservation plan is done thru OnePlan, it is automatically emailed to local conservation district offices.

RID Water Quality 2012 - Jack Harrison

Water comes into Riverside Canal from different sources, goes to farmland, and discharges in different areas to Boise. Nonpoint Trading - nutrient management - 10,000 acres make up Riverside Irrigation District. What happens to phosphorus - 20 lbs/acre average - balance what comes in, what is applied and what goes out with plants - typical field inflow .07, 50-70% management water vs. 30% water quality, .20 mg/L concentration for outflow = 146 lb/day of phosphorus coming off field. Riverside actual number - .50 inflow, 50-70% management water vs. 30% water quality, .30 concentration = 219 lb/day coming off field. 10,000 acres potential = 1,000 lb/day loss of nutrients. Need to get allocation load to 532. Monitoring Program - starts in Caldwell - data collected - water comes in from Indian Creek, west end drain and some gulches - source waters. 1000 lb/day coming in from secondary sources. Average load spilling out is 643 lb./day. Water Quality Improvements - improved water management can reduce spills - new gates on Indian creek and monitor to reduce Boise river diversion and reduce Indian Creek spill while maximizing agricultural reuse.

Council Business Executive Director Report Meeting with board to review strategic plan for increase membership and funding. Mailed out invoices. Continuing to research possible funding opportunities.

2011 319 Grant Update

Pamphlet finished for 319 grant outreach. 319 TAC asked about Melanie overseeing new outreach employee to be hired by Soil Conservation Service. Board was not in favor of time it might take to oversee this position. Needed more information before a decision could be made.

Peter met with Pioneer Irrigation board and plans to do other similar meetings with boards and irrigation companies to discuss grants available, 319 opportunities and other funding available.

Work has started on Indian Creek temperature and sediment. Work is being done by Hawke.

A new permit for Boise NPDS has been approved. Idaho Rivers Unlimited is appealing two permits granted in March because they don't meet clean water act limits for phosphorus discharge. One point has been appealed - asking EPA to revise permits to set phosphorus limits during the months of May through September. Request was not made for specific limits during the October through April time period. Permits are effective May 1. Comments can be made at the EPA site - page 27.

Flood Control District #10 Update — Steve Sweet

Steve is responsible for District 10 and 11 flood control in Canyon County. These districts cover 60,000 acres of irrigated lands. The districts try to hold the river at 6500 cfs to avoid flood stages at Glenwood. Flood district 10 includes about 22 miles of the Boise River, while district 11 covers 5-10 miles of the river.

Flood district 10 goes from Boise to Caldwell. Flood district 11 goes from Caldwell to Parma.

About 40-45,000 people reside inside these flood districts.

These flood districts has numerous powers and duties, including taxation, corp of engineers, can sue and be sued, authority to maintain structures, acquire property, power of eminent domain, convey rights of way, use natural streams and improve them for flood control among others.

Annual revenues for district 10 are about $250,000. This covers 1 full-time employee and Steve on a part-time basis (covers Eagle and Parma). District 11 revenues are about $25,000.

Daily discharge data for the Boise River — Max 7000cfs — Minimum 109cfs — daily average is about 3000cfs.

Because of the excess snow fall and rain last year, there were 61+ days over 6000cfs.

High water impact includes loss of trees and bank erosion. 120 trees were knocked down — these affect irrigation and cause erosion, but are great for fishing, creating habitat for fish.

This year could see the same flood scenario as last year — there is more junk in the river this year.

NRCS Report — James Eller

NRCS has received 41 applications for agricultural improvements — 5 in Ada County, 36 in Canyon County.

12 of the applications have been obligated and work is underway.

James has an email newsletter outlining opportunities and projects that are under way or have been completed. Sign-up form was available for this email blast.

James discussed a new initiative program.

At the last meeting, board members ask about a possible way to rank and weigh applications for our 319 grant money. James presented a recommended ranking criteria for these applications. One criteria discussed at length were tiers 1-3+. Initially priority was placed on tiers 1 & 2 because they were directly adjacent to the main stream, however, since tributaries have been added to the impact, tier 3 projects may be more relevant now. Tier one projects are in direct proximity to the Lower Boise River. Tier 2 projects are located on tributaries with direct proximity to the river, while tier 3 projects are up stream on tributaries without having direct proximity to the river. With the inclusion of tributaries to the LB watershed, these projects can affect the main stem but with less impact.

Question was asked about whether removal of trash and tributary clean up would fit into 319 projects. Does it reduce phosphorus, does it meet water quality issues? It was suggested that a water quality ranking should also be established. Because there is already a sediment TMDL in place there is an incentive to reduce sediment through clean-up.

James also discussed the National Water Quality Initiative. It covers three areas, with a total of $608,000 for the projects. Money must be obligated by July 2. There is a very short sign-up period of 3-4 weeks. It provides a 75% cost share compared to the normal Equip project funding which is only 50%. Projects are capped at $300,000.

Kuna Water Treatment Plant Update — Royce Davis

Kuna has a new plant and lagoons south of town. Total phosphorus load is .8. This is reached using 2mm fine screens, water goes through a bioreactor membrane with a pore size of .04microns. Water also goes

Discussion Agenda DEQ Update TMDL Update - Lance is preparing a strategic plan for the phosphorus TMDL which he hopes to have ready for the next board meeting. Components of the plan will include a timeline, integrated reports over time, target development, model to be used and compared to and 2010 integrated report. The TMDL will be written for two river segments - Middleton to Indian Creek and Indian Creek to the mouth. DEQ is considering making it a nutrient TMDL instead of only concentrating on phosphorus. Tributaries would be required to either meet the Lower Boise River concentration at the mouth or would be given a waste load allocation. [Indian Creek is not listed as impaired.] DEQ will be meeting with USGS on the monitoring program next week. Still on track for completion by 2014. Lauri is working on the tributary TMDL's. She is writing a strategic paper to roll all of the tributaries together as an addendum to the Lower Boise River sediment TMDL. Sediment allocations must be consistent with Lower Boise TMDL. Rather than doing individual TMDL's for each tributary, considering including them into the Lower Boise TMDL. DEQ will request TAC meetings to cover all of these issues as they move forward.

NPDES Update - Greenleaf draft permit has been completed and has been sent to EPA. EPA should issue the permit shortly. Expected limits should be consistent with the TMDL's. City of Boise's NPDES permits were to be effective May 1, but have been delayed due to legal challenges.

Other Items - Troy reported on short term activity exemptions - projects that are less than an acre in size and less than a year in length and construction general permits covering sites larger than one acre with longer than one year duration. These projects are visited by DEQ since DEQ certifies that they work will be done under certain conditions. They have no enforcement ability but can report to EPA which does have enforcement action.

Southeast Boise River Watershed Project - Dick Jordan, Timberline High School Dick Jordan, AP Environmental Science Teacher at Timberline High School presented his "Our Shed" project to the board. The project is designed to connect students with their community and environment. The program brings watersheds, airsheds and landsheds together in a compelling project for kids. He is interested in bringing businesses and organizations together with his students to educate them about opportunities in different fields of environment through field trips, job shadowing, research, restoration, recreation, college and careers. Several ideas he presented included an environmental workshops in the fall for teachers and town hall meetings.

University of Idaho Conservation Innovation Grant Project - Ronda Hirnyck

Ronda presented a three year integrated pesticide management (IPM) program that is trying to minimize the use of pesticides and the resulting pesticides in the receiving streams. It utilizes the OnePlan with voluntary producer participants with mapping platform, GPS and recordkeeping capabilities that enable producers and NRCS staff to plan, research pest management reference materials and document IPM plans and practices. The university is utilizing interns to work directly with the producers on the project. Monitoring will not be part of the program, but will be utilizing USDA data to get some monitoring data to see if there is any seasonal trending.

Letter to DEQ requesting EPA modeling - Tom Dupuis

Tom Dupuis presented a draft letter to DEQ requesting an EPA modeler be involved in the phosphorus TMDL from the beginning. Comments that were made by board members were also discussed. The letter was approved as edited and will be sent to DEQ.

prepared handouts and set up table display for water reuse conference and prepared mid-year financial report and fundraising report for May board meeting.

Financial and Fundraising Update

As of April 30, 2012, the Council has received $93,429.00 in member contributions, combined with interest income and a carry-over balance, leaving $148,730.39 income balance. Expenses to date have totaled $81,788.03, leaving a $68,442.36 account balance.

Except for interest income, there has been no activity to date in the 319 account, which has a balance of $47,981.97.

Approximately 90% of contributions have been received based on FY 2011 income. Approximately $9739.00 is still outstanding, with approximately $5700 of that verbally committed.

Five foundations have been identified for possible application. Two are locally based. All have focuses on water stewardship or agriculture.

319 Update

A proposal for a drip system on mint from Robert McKellip was presented. This would be a second project for Mr. McKellip. It would cover 56.4 acres at a shared cost of $45,912.98. The board will review and vote at the next meeting.

Discussion Agenda DEQ Update

Peter met with Pioneer Irrigation board and plans to do other similar meetings with boards and irrigation companies to discuss grants available, 319 opportunities and other funding available.

Work has started on Indian Creek temperature and sediment. Work is being done by Hawke.

A new NPDS permit for Boise's two waste water treatment plans has been approved. Idaho Rivers Unlimited is appealing these two permits granted in March because they don't meet clean water act limits for phosphorus discharge. IRU is asking that the permits be revised to cover the whole year for phosphorus discharge. Permits are effective May 1. Comments can be read at the EPA website.

Flood Control District #10 Update - Steve Sweet

Steve is responsible for District 10 and 11 flood control in Canyon County. These districts cover 60,000 acres of irrigated lands. The districts try to hold the river at 6500 cfs to avoid flood stages at Glenwood. Flood district 10 includes about 22 miles of the Boise River, while district 11 covers 5-10 miles of the river.

Flood district 10 goes from Boise to Caldwell. Flood district 11 goes from Caldwell to Parma.

About 40-45,000 people reside inside these flood districts.

These flood districts has numerous powers and duties, including taxation, corp of engineers, can sue and be sued, authority to maintain structures, acquire property, power of eminent domain, convey rights of way, use natural streams and improve them for flood control among others.

Annual revenues for district 10 are about $250,000. This covers 1 full-time employee and Steve on a part-time basis (covers Eagle and Parma). District 11 revenues are about $25,000.

Daily discharge data for the Boise River — Max 7000cfs — Minimum 109cfs — daily average is about 3000cfs.

Because of the excess snow fall and rain last year, there were 61+ days over 6000cfs.

High water impact includes loss of trees and bank erosion. 120 trees were knocked down — these affect irrigation and cause erosion, but are great for fishing, creating habitat for fish.

This year could see the same flood scenario as last year — there is more junk in the river this year.

NRCS Report — James Eller

NRCS has received 41 applications for agricultural improvements — 5 in Ada County, 36 in Canyon County.

12 of the applications have been obligated and work is underway.

James has an email newsletter outlining opportunities and projects that are under way or have been completed. Sign-up form was available for this email blast.

James discussed a new initiative program.

At the last meeting, board members ask about a possible way to rank and weigh applications for our 319 grant money. James presented a recommended ranking criteria for these applications. One criteria discussed at length were tiers 1-3+. Initially priority was placed on tiers 1 & 2 because they were directly adjacent to the main stream, however, since tributaries have been added to the impact, tier 3 projects may be more relevant now. Tier one projects are in direct proximity to the Lower Boise River, Tier 2 projects are located on tributaries with direct proximity to the river, while tier 3 projects are up stream on tributaries without having direct proximity to the river. With the inclusion of tributaries to the LB watershed, these projects can affect the main stem but with less impact.

Question was asked about whether removal of trash and tributary clean up would fit into 319 projects. Does it reduce phosphorus, does it meet water quality issues? It was suggested that a water quality ranking should also be established. Because there is already a sediment TMDL in place there is an incentive to reduce sediment through clean-up.

James also discussed the National Water Quality Initiative. It covers three areas, with a total of $608,000 for the projects. Money must be obligated by July 2. There is a very short sign-up period of 3-4 weeks. It provides a 75% cost share compared to the normal EQIP project funding which is only 50%. Projects are capped at $300,000.

Kuna Water Treatment Plant Update — Royce Davis

Kuna has a new plant and lagoons south of town. Total phosphorus load is .8. This is reached using 2mm fine screens, water goes through a bioreactor membrane with a pore size of .04microns. Water also goes

through ultraviolet disinfection. Discharge from Kuna goes down 10 mile and down Lake Hazel and then south into Indian Creek. BOD is 30mg/I/month — test is less than 3 for e.coli - phosphorus is .07 May-Sept with no limit from Oct-Apr. 4.1 is phosphorus for off months — last year's average was 3.5-4.5 effluent for off months (Oct-Apr). Alum is used to remove phosphorus. They start with a low dose about a month ahead and increase to reach .07 limit (approx. 4.3 gallons). 40 gallons of Alum got the limits down to .07 — goal was .05 Have monthly and weekly averages. 5 loads of alum - $5,760 per load — about $30,000 — approximately $7 to remove a pound of phosphorus - $200/day.

Phosphorus TMDL Informational Meetings Update

Liz reported on two informational meeting that were held on the phosphorus TMDL process. DEQ did a great job giving information and outlined an aggressive timeline to get something done by July 2014.

Letter to EPA re: phosphorus TMDL model selection

Liz lead the discussion on the importance of a TMDL model being one that is agreed upon by all. EPA is the ultimate approval source, so they should be involved early on in the program planning efforts. There is a history — in past models have been developed than EPA disapproved. The idea is to get EPA involved early on model development rather than waiting — have modeler involved from the beginning so when they do review, there aren't a lot of questions. By involving EPA early, it helps streamline the process and creates a mass-balance model to compare to Aquatox.

Will have to have resources to have someone attend meetings and to what extent that person will be involved. Board approved having Tom DuPruis draft the first letter for the next meeting and send out in the next few weeks.

Discussion Agenda DEQ Update Troy Smith - Tributary TMDL's DEQ hoping to combine tributaries into one TMDL process for sediment and bacteria (e. coli) -Indian Creek, 5, 10 & 15 Mile, willow creek, mason creek, sand hollow. Reason why - efficiency of resources, combining them into one will streamline the process, consistent with TMDL process statewide, equitable appropriate load allocations within the watershed, data driven -load allocations determined based on best available information. EPA is supportive of this approach.

Lance Holloway - Phosphorus TMDL Strategy Paper Lance distributed the draft strategy paper and asked for comments back to him in two weeks. First TAC meeting is scheduled for July 26 at 9am at the Meridian City Hall.

Lauri Monnot - Greenleaf NPDES Greenleaf NPDES is now out for public comment.

Future Years Monitoring

Alex provided four options for monitoring for the coming year (October 2012-September 2013).

Emerging contaminants are an extra expense on all options but option 1. 9 samples/ year on Willow Creek is an extra on option 4.

All options include sampling on 3 sites - Diversion Dam, Middleton and parma. A 4th could be Notus, Glenwood, Caldwell or a site of our choosing. Could possibly sample Diversion only 3-4 times and include another site for the rest of the year.

Asked for a TAC meeting for further discussion of monitoring and budget. Need to have a final decision by the end of August. Budget will be between $67-76,000.

Finalizing 319 and Weyerhaeuser grant applications, 319 invoicing and reporting.

319 Update

Summer tour is scheduled for August 8th 9-2pm. The tour will include a drip system, pivot system and wetlands. Four 319 applications were presented for consideration.

1. Conversion from surface to sprinkler on alfalfa

2. Concrete ditch, screens and gated pipe, sediment basins (improved flood system) for alfalfa

3. Flood control district 11 project - 500 feet of eroded stream bank restoration. Crop land is alfalfa. Soil loss estimate is 3-4,000 cubic yards/year - current damage is about 75-80%. Proposal is to install riprap, fill 5-700 feed of erosion area, reestablish road. Estimated cost $125,000.

4. IWS proposal for pilot wetland drainage project. Approximate cost $60,000.

It was moved, seconded and approved that discussion on the stream bank project and wetland project be tabled until further information is obtained.

The sprinkler conversion and concrete ditch projects were recommended by the 319 TAC and were approved for funding.

Invoices were presented for two completed projects. Payment was approved as presented.

Discussion Agenda Stormwater Update

Erica - Ada County

ACHD has two permits - phase 1 for Boise; phase 2 for Meridian and Eagle Phase 1 was issues in 2000. It has co-permittees who work together to implement permit requirements - cost share as well as other issues. Phase 2 was issued in 2009. It has no co-permittees. Permits allow for discharge to waters in the US. Certain activities are required to discharge. New permit is anticipated in the fall to replace the phase 1 permit which will require implementing 3 low impact development projects. Two watershed plans require public involvement. ACHD is required to inspect and clean catch basins every two years - 15000 of them in county. Pollutants of concern - sediment, bacteria and phosphorus - set up best practices to control those. Lee - Canyon County/Caldwell - 2009 All cities in Canyon County have individual permits, but work to partner on different projects. Monitor pollutants, bacteria, phos - what is coming out of storm drains. Expect to have limits placed on what is coming out for future permits. Three weather stations around town to check for storms coming in to monitor and measuring within 2 hours of storm starting. 2780 catch basins to clean, 2400 discharge points to check. In 2 years will be working on next permit.

Stormwater General Construction Permits Bill Stewart - EPA Effects of construction site on water In 2004 there were 3,533,205 miles of streams. 84% were not assessed. Of the 16% assessed, 53% was good, 44% was impaired. Impairment included - pathogens, habitat alteration, organic enrichments, nutrients, metals, sediment, mercury, flow alteration, turbidity. EPA regulated 3 types of activities - industrial, construction, municipal. An EPA permit is needed if:

• 1+ acres • Erosion and sediment controls, secondary containment, minimize exposure, protect

critical habitat

C&D Effluent Guideline - Effective Dec 1, 2009 • Erosion and sediment control • Dewatering • Pollution prevention • Prohibited discharges • Surface outlets • Numeric turbidity limits (indefinitely stayed)

If you have a discharge, must monitor it 2 times a day - especially if there is turbidity New elements in permitting process

• Notice Of Intent (NOI) waiting period - now 14 days • Eligibility for treatment chemical (flocculants) no cationic treatment chemicals allowed

in region 8 • Effluent guidelines for erosion and sediment control • Buffer zone requirements • Water quality based effluent limits • Qualifying storm - now 0.25" (used to be .50") • Corrective action schedules

New permits say leave a 50 foot buffer on any flowing stream Alternative buffers - estimate sediment reduction from 50 foot buffer, design controls that match sediment removal Set up perimeter controls before you get started - if silt reaches 1/2 way on silt fences, must clean them out Remove track-out sediment the same work day Don't put stock piles in natural buffer areas, protect from run-on, wind, cover where practicable Erosion and sediment controls

DEQ Update Hawk Stone - Indian Creek Temperature assessment in Indian Creek - either meets or is cooler than its natural background temperature. Plan to remove it from the 303D list and say it is not impaired any more. Natural condition of Indian Creek was a desert stream - dry on many occasions. No claims of water rights. 20% of the time the natural flow is 2CFS in August. Where did flow naturally begin - Robinson Springs, just above Robinson Road. Yellow willow and grasses as dominant shade vegetation. Impass between DEQ and EPA whether it should be delisted. Probably not going to be able to use it as a model for temperature for other tributaries.

Lauri Monnot - sediment and bacteria TMDL's Proposing to combine all lower Boise tributary sediment and bacteria TMDL's into one document rather than individual TMDL's for each trib. Would be consistent with what is done across the state. Will look at each trib individually, but only write one document rather than individual document for each trib. Email questions to Lauri and have further discussion and vote on proposal at next meeting.

Lauri Monnot - Greenleaf NPDS 2 weeks before putting out for public comments. Asking for clarification on sediment. Lake Lowell TMDL completed in 2010 - working on implementation plan for agriculture to be implemented.

Lance presented a draft strategic paper. Over the next year, there will be 40 monitoring sites, checked 3 times during the year - spring, summer and fall, which will give very robust data for phosphorus, sediment, bacteria, etc. Lance proposed establishing a series of TAC meeting(s) to include Indian Creek, TMDL and tribs.

Council Business Executive Director Report Continuous: preparing for and facilitating monthly board meetings, attending monthly 319 meetings, research and application prep for grants and other financial opportunities.

Worked on 319 and Weyerhaeuser grant applications; attended/participated in the following meetings - United Rivers Workshop, USGS TAC meeting, DEQ BAG meeting, 319 tour preparation meeting; prepared for and facilitated board retreat; river tour with DEQ; meeting with Julia Achabal and Jerry West, DEQ, re: 319 forms and final report for grant ending this year; facilitate/set up interviews for TV reporter doing story on 319's and accompanied her and film crew on interviews and farm tour.

Financial Update

As of May 31, 2012, the Council has received $97,699.00 in member contributions, combined with interest income and a carry-over balance.

Approximately 97% of contributions have been received based on FY 2011 income.

319 Update

Summer tour is scheduled for August 8 th 9-2pm. The tour will include a drip system, pivot system and wetlands. Newest 319 grant was extended to 2014. Data that was requested at the last meeting regarding the mint drip system: Using drip, will increase yield 10-15% for a year. Fields will use 50% less nitrogen and pesticides. 319 project for 2nd mint drip system was voted on and approved. Liz and Erica abstained. It was recommended that the remainder of the 319 projects be put into a spreadsheet for comparison based on criteria developed by James, with ranking and recommendations.
