    REPORT SUMMARY

    Louisiana Revised Statute (R.S.) 24:513.2(E) requires the legislative auditor to submit annuallyto the legislature a report including summary financial and personnel information on all boards,commissions, and like entities created by law or executive order and to report findings andrecommendations resulting from any analysis of the information. Based on our analysis, wesubmit the following information and recommendations:

    As of June 30, 2013, we identified 485 boards, commissions, and like entitiescreated by law or executive order.

    Since our last report, 12 entities were created and 19 were repealed, terminated, orotherwise removed.

    Of the 448 active entities that responded to our request, 257 pay per diem,salaries, and/or travel of the board members. The 2013 and 2012 actual amountstotaled $1,163,133 and $1,199,247 for per diem payments; $3,316,107 and$2,008,844 for board member salaries; and $2,489,761 and $2,204,437 for boardmember travel, respectively.

    Twenty-seven boards, commissions, and like entities that were created during2011 or earlier have never been fully organized, have disbanded, or are currentlyinactive. The legislature and/or governor should consider abolishing theseentities.

    Ten boards, commissions, and like entities did not provide the requestedinformation. Louisiana law requires these entities to provide requestedinformation. Act 184 of 2013, effective August 1, 2013, now requires thecommissioner of administration to notify the Senate Committee on Senate andGovernmental Affairs, the House Committee on House and GovernmentalAffairs, and the oversight committees for boards, commissions, or like entities oftheir failure to comply with the request for information.

    REPORT TO THE LEGISLATURE

    Legislative Mandate

    R.S. 24:513.2(E) requires the legislative auditor to submit annually to the legislature a reportcontaining summary financial information and personnel data on (1) boards, commissions, andlike entities created by law or executive order that are made part of, or are placed in, theexecutive branch of state government and (2) local boards, commissions, and like entities that arespecifically created by law. The statute provides for the legislative auditor to report findings andrecommendations resulting from any analysis performed of the information.

    R.S. 49:1301 requires the commissioner of administration to establish and maintain a websitecontaining information on boards, commissions, and like entities. Act 184 of 2013, effectiveAugust 1, 2013, now requires the commissioner of administration to send boards, commissions,and like entities that fail to submit the required information a notice of noncompliance bycertified mail; to send a notice detailing the failure to comply by certified mail to the chiefadministrative officer of the department of which the board, commission, or like entity is a part,if applicable; and to send a notice detailing the failure to comply to the Senate Committee onSenate and Governmental Affairs, the House Committee on House and Governmental Affairs,and the oversight committees for the board, commission, or like entity. R.S. 49:1307 alsorequires the legislative auditor to work with the commissioner of administration to ensure thateach board, commission, or like entity complies with submitting information to the website.

    Website

    Through a cooperative endeavor agreement, the legislative auditor and the commissioner ofadministration established a website at wwwprd.doa.louisiana.gov/boardsandcommissions/home.cfm . The information provided in this report was collected from the website as of June 30,2013. Information for a specific board, commission, or like entity can be viewed by visiting thewebsite and searching for the specific board, commission, or like entity of interest. A list of the485 boards, commissions, and like entities identified at the time of this report begins on page 12.

    Trend

    This report identifies 485 boards, commissions, and like entities, as of June 30, 2013. Ourcurrent and previous reports include the following number of entities:

    Since 1992, these comparisons reflect an increase in the growth of boards, commissions, and likeentities. The 1997 and 2005 decreases in the number of such entities are primarily attributable tothe termination, in accordance with R.S. 49:215(C), of entities that were created by executiveorder. Since our last report, 12 entities were created and 19 entities were either repealed by law,terminated in accordance with law or executive order, or otherwise removed.

    The recommendations included in this report are intended to control the growth of boards,commissions, and like entities.

    Information Requested

    R.S. 24:513.2(F) directs all agencies, boards, commissions, and departments of the state and its political subdivisions to furnish information and reports as requested by the legislative auditor tofulfill his responsibilities. All boards, commissions, and like entities were requested to providecontact information, membership information, and statutory or legal authority relative to theentity.

    R.S. 39:1335 and 1336 require licensing agencies to provide summary and detailed information pertaining to actual and budgeted revenues by source, expenditures by category, and fund balances; the number of classified and unclassified personnel; performance indicators; andcertain general information pertaining to the board and its authority and functions.

    All other boards, commissions, and like entities were requested to provide similar information,except that the financial and budget information was requested in summary form only andinformation pertaining to performance indicators was not requested.

    No Response Received

    Some boards, commissions, and like entities did not respond to our request for information. Alist of those boards, commissions, and like entities that did not respond to our request can befound on page 7.

    Information Unaudited

    Information included in this report and on the website was provided by the boards, commissions,and like entities; it has not been audited by the legislative auditor, and, accordingly, we expressno opinion on the information.

    Inactive Entities

    The following 27 boards, commissions, and like entities were never fully organized; weredisbanded with no plans to reorganize; were inactive; or had no funding prospects to undertake

    the functions for which they were established, even though the board members may continue tomeet.

    Because these entities are not fulfilling their established functions, the legislature or governor asdeemed appropriate should consider their abolishment.

    As of June 30, 2013, we identified 10 boards, commissions, and like entities that have notresponded to our requests for personnel data and financial information.

    A joint letter from the legislative auditor and the commissioner of administration requestinginformation was mailed to all 485 boards, commissions, and like entities identified in our report.

    Numerous attempts via telephone and email to contact those boards, commissions, and likeentities that did not submit the requested information were made by the legislative auditors staffwith no response from these entities.

    Comparison to Other Southeastern States

    We collected data on the number of boards, commissions, and like entities in 14 otherSoutheastern states to compare to the number in Louisiana. As of June 30, 2013, Louisiana hadthe highest number of boards, commissions, and like entities at 485. Oklahoma had the nexthighest number of boards, commissions, and like entities at 448, and Florida had the lowestnumber at 106. The graph on the following page illustrates those Southeastern states that wecollected data on and how they compare to Louisiana.

    Boards and Commissions Per Diem Freeze

    During fiscal year 2012, Executive Orders BJ 12-09 and 12-20 were issued. These executiveorders directed that all expenditures for per diem to members of all boards, commissions,authorities, task forces, and committees in the executive branch of government be terminated.However, the following were exempted from the provisions of the executive order: (1) electedmembers of boards, commissions, authorities, task forces, and committees who are authorized bylaw to receive a per diem; (2) members of boards, commissions, authorities, task forces, andcommittees who are statutorily authorized and entitled to the payment of per diem on their ownwarrant; and (3) exemptions granted by the commissioner of administration as may be necessarydue to extreme economic hardships which would otherwise result to a member of a board,

    commission, authority, task force, or committee. Because of the exemptions, the executiveorders had little or no fiscal impact on the boards, commissions, and like entities listed in thisreport. Executive Orders BJ 12-09 and BJ 12-20 are attached in Appendix B.

    WHEREAS, some boards, commissions, authorities, task forces and committees have beenestablished by law or executive order with the provision for the payment of per diem to themembers thereof; andWHEREAS, continuing to pay per diem causes a drain on the state general fund; andWHEREAS, the termination of per diem expenditures is necessary to decrease the drain on thestate general funds; andWHEREAS, the purpose of this order is to withhold appropriations and limit expenditures for per diem for members of boards and commissions in the executive branch;NOW, THEREFORE I, BOBBY JINDAL, Governor of the State of Louisiana, by virtue of the

    authority vested by the Constitution and laws of the State of Louisiana, do hereby order and directas follows:SECTION 1: That all expenditures for per diem to members of all boards, commissions,authorities, task forces or committees in the executive branch of government which are made by theGeneral Appropriation Act be, and the same are hereby, terminated.SECTION 2: The commissioner of administration is hereby empowered to withhold allappropriations for the per diem expenditures subject to this order and is directed to develop

    procedures to terminate all such payments.SECTION 3: The following categories of members of boards, commissions, authorities, task forces and committees are herby exempted from the provisions of this executive order:

    1. Elected members of boards, commissions, authorities, task forces andcommittees who are authorized by law to receive a per diem.2. Members of boards, commissions, authorities, task forces and committeeswho are statutorily authorized and entitled to the payment of per diem on their ownwarrant.3. The commissioner of administration is hereby authorized to grant such further exemptions as may be necessary due to extreme economic hardships which wouldotherwise result to a member of a board, commission, authority, task force or

    committee under Section 1 and 2 of this executive order.

    Moratorium on Boards and Commissions Authority to Pay per Diems and Elimination of CertainBoard

    WHEREAS, Executive Order BJ 2012-9 froze payment of a per diem to membersof boards, commissions, and like entities funded by the General Appropriation Act.However, over the years, many boards, commissions and like entities that have beenstatutorily created in the executive branch of state government with budget authoritydo not receive annual appropriation approval via the General Appropriation Act;WHEREAS, more than 80 boards, commissions, authorities, task forces, advisorycouncils, committees, and like entities have been established with a statutory mandaterequiring payment of a per diem;

    WHEREAS, approximately 300 additional boards, commissions, authorities, task forces, advisory councils, committees or like entities have been established that permitdiscretionary payment of per diems, are silent as to such payments but may grantimplied budgetary authority to authorize such payments, or provide that nocompensation shall be paid to members of such entities;WHEREAS, continuing to pay a per diem is a drain on state funds and places afiscal burden upon individuals, businesses, or other entities that fund the operations of

    boards, commissions, or like entities;WHEREAS, a moratorium on the payment of a per diem is necessary to decreasethis fiscal burden and is proper to ensure boards, commissions, authorities, task forces, advisory councils, committees, and like entities are functioning in a fiscally

    prudent manner consistent with those that are included in the General AppropriationsAct; andWHEREAS, the purpose of this Order is to freeze per diem payments, withholdappropriations for per diem payments, and limit expenditures for a per diem in theexecutive branch of state government, which will result in approximately $275,000savings this fiscal year;NOW THEREFORE I, BOBBY JINDAL, Governor of the State of Louisiana, byvirtue of the authority vested by the Constitution and laws of the State of Louisiana,

    do hereby order and direct as follows:SECTION 1: Expenditures for per diem payments by members of all boards,commissions, authorities, task forces, advisory councils, or committees in theexecutive branch of state government are hereby suspended, including any that mayhold funds in accounts other than the State Treasury, except as otherwise provided inthis Order.SECTION 2: The Commissioner of Administration and any executive or fiscalofficer for any board, commission, authority, task force or committee in the executive

    per diem.SECTION 3: The Treasurer shall not honor warrants drawn upon the StateTreasury that are inconsistent with this Order, and no executive or fiscal officer of any

    board, commission, authority, task force, or committee in the executive branch of state government shall approve any request for an expenditure that is inconsistent withthis Order.SECTION 4: Per diem payments that are expressly and directly statutorily

    mandated are exempt from this Order. The Commissioner of Administration is herebyauthorized to grant further exemptions as may be necessary due to extreme economichardships which would otherwise result to a member of a board, commission,authority, task force, advisory council, committee or like entity.SECTION 5: All boards, commissions, authorities, task forces, advisory councils,committees, and like entities in the executive branch of state government, including anythat may hold funds in accounts other than the State Treasury, must comply with thefollowing directives:A. By August 1 of each year, all boards, commissions, authorities, task forces,advisory councils, committees, and like entities shall report to the Commissioner of Administration the total amount of funds collected and expended by the entity duringthe prior fiscal year.B. By the end of each month, any entity expressly and directly mandated to pay a per diem or granted a hardship exemption for any member by the Commissioner pursuantto Section 4 shall report to the Commissioner of Administration the total amount of funds expended by the entity on per diem during the prior month and by August 1 of each year, report to the Commissioner of Administration the total amount of fundsexpended by the entity on per diem during the prior fiscal year.SECTION 6 : The following entities are hereby terminated:

    A. The E-Rate Oversight Committee as re-established by BJ 2008 52;B. The Maritime Advisory Task Force as re-established by BJ 2008 42;C. The Interstate 49 North Extension Feasibility and Funding Task Force as re-established byBJ 2008 44; andD. The Governors Military Advisory Board as re-established by BJ 2010 17.SECTION 7 : This Order shall supersede all prior Executive Orders not consistentherewith.SECTION 8 : This Order is effective upon signature of the Governor and shall remainin effect until amended, modified, terminated or rescinded by the Governor, or terminated by operation of law
