Subject; Payment of Dearness Allowance to Central Governmentemployees· Revised Rates effective from 1.1.2008.
The undersigned Is directed to ~fer to this Ministry's OfficeMemorandum No. 1 (8)/2007-E-n (6)/212 dated 11th september, 2007 onthe subject mentioned above and to state that the President Is pleased todecide that the Dearness Allowance payable to Central Governmentemployees shall be enhanced from the existing rate of 41% to 47% witheffect from 1st January, 2008.
2 The provisions contained In paras 3, 4 and 5 of this Ministry's a.M.No.1 (13)/97-E-II (B) daled 3.10.1997 shall continue to be applicable whileregulatIng Dearness Allowance under these orders. However, with effectfrom 01.04.2004, Dearness Allowance is computed on the basis Of BasicPay, Dearness pay, Stagnation Increment and NPA. Provisions contained inpara 3 of this Ministry's OM No.1 (13)/97·e.II.(B) ;j!dated 3.10.1997,therefore, stand amended to this extent.
3 The additional Installment of DearnessAllowance payable under theseorders shall be paid In cash to all Central Government employees.
4 The payment of arrears of Dearness Allowance for the months ofJanuary and February,2008 shall not be made before the date ofdisbursement of salary of March, 2008.
5 These orders shall also apply to the civilian employees paid from theDefence Services Estimates and the expenditure will be chargeable to therelevant head of the Defence Services Estimates. In regard to Armed Forcespersonnel and Railway employees separate orders will be Issued hy theMinistry of Defence and Ministry of Railways, respectively.
6 In so far as the persons servIng in the Indian Audit and AccountsDepartment are concerned, these orders issue after consultation With theComptroller and Auditor General of India. A

Subject: Provisional revision of scales of pay and other allowances in respect of officerslstaff ofLok Sabha Secretariat.
In exercise of powers conferred by Rule 8 and 9 of the Lok Sabha Secretariat (Recruitment andConditions of Service) Rules 1955, the Speaker is pleased to direct that the orders contained in the Ministry ofFinance and Personnel, Public Grievances & Pensions, Government of India, Notifications and OfficeMemoranda detailed in Appendix, as reproduced in Annexure - I to X to this order, read in conjunction with theGeneral Adaptation Order No. 185, dated the 19th December 1957, shall apply proVisionally to the officerslstaffof Lok Sabha Secretariat as an interim measure, subject to the following modifications:-
(1) In Rule 3 of Annexure -I, the word "Schedule" shall mean "Schedule" annexed to this order (asadopted for application to Lok Sabha Secretariat) or such subsequent orders as may be issuedin continuation to this order.
(2) In Rule 4 of Annexure -I, the words "First Schedule" shall mean the "First Schedule" appendedto this order or such subsequent orders as may be issued in continuation of this order.
(3) In the Annexures to this order, the words "The Presiden(" and "Central Government", whereverthey occur shall stand substituted by the words "The Speaker" and "Lok Sabha Secretariat".
(4) In the Annexures to this order, after the words "Fundamental Rules" wherever they occur, thewords "as adopted for application to the officers/staff of Lok Sabha Secretariat" shall be added.
. .(5) The period of three months allowed to exercise option under Rule 6 of Annexure - I will be
reckoned from the date of issue of this R&CS Order.
2. This order shall provisionally allow the officerslstaff belonging to Lok Sabha Secretariat to draw, pay inthe revised pay structure corresponding to the scales shown in the First Schedule annexed to this order witheffect from 1st January 2006, Dearness Allowance at the rates effective from the date as per GovernmentOrders issued from time to time and revised allowances other than Dearness Allowance with effect from1st September 2008 in accordance with the orders in this regard. These shall be subject to the adjustments tobe made, as may be necessary.

(2) "existing scale" in relation to it Government servant means the presentscale applicable to the post held by the Government servant (Of, [IS Ihecase may be, personal scale applicable to him) as on the 1st <jay of January,2006 whether in a substantive or officiating capacity.
Explanation- In the case of a Government servant, who was on the ]'1
day of January, 2006 on deputation out of India 01' on leaveor on foreign service, or who would have on that daleofficiated in one or more lower posts but for his officiatingin a higher post, "existing scale" includes the scaleapplicable to the post which he would have held but for hisbeing on deputation out of India or on leave or on foreignservice or, as the case may be, but for his officiating in ahigher post;
(3) "existing emoluments" mean the sum of (i) existing basic pay, (ii)dearness pay appropriate to the basic pay and (iii) dearness allowanceappropriate to, the basic pay .+ dearness pay at index average 536(1982=100).
(4) "present scale" in relation to any post/ grade specified in column 2 of theFirst Schedule means the scale of pay specified against that post incolumn 3 thereof;
(5) "pay in the pay band" means pay drawn in the running pay bandsspecified in Column 5 of the First Schedule.
(6) "grade pay" is the fixed amount corresponding to the pre-revised payscales/ posts.
('7) "revised pay structure" in relation to any post specified in column 2 ofthe First Schedule means the pay band and grade pay specified againstthat post or the pay scale specified in column 5 & 6 thereof, unless adifferent revised pay' band and grade pay or pay scale is notifiedseparately for that post.
(8) "basic pay" in the revised pay structure means the pay drawn in theprescribed pay band plus the applicable grade pay but does not includeany other type of pay like special pay, etc.
In the case of Covernrnentservants in the pay scales of HAG+, apex scaleand the Cabinet Secretary's scale, basic pay means the pay in theprescribed scale.

4. Scale a/pll!! OJ',JOsls - The pay hand and grade payor the pay scale, asapplicable, of every post/ grade specified in column 2 of the First Schedule s!1all be asspecified against it in column 5 &t 6 thereof.
5. Dratoal of PIIY in the revised pay structure - Save as otherwise provided in theserules, a Government servant shall draw pay in the revised pay structureapplicable to thepost to which he is appointed;
Provided that a Government servant may elect to continue to draw pay in theexisting scale until the date on which he earns his next or any subsequent increment inthe existing scale or until he vaca les his post or ceases to draw pay in that scale.
Provided further that in cases where a Government servant has been placed in ahigher pay scale between 1.1.2006 and the date of notification of these Rules on accountof promotion, upgradalion of pay scale etc., the Government servant may elect to switchover to the revised pay structure from the date of such promotion, upgradation, etc.
Expl anation 1 - The option to retain the existing scale under the provisos to this ruleshall be admissible only in respect of one existing scale.
Explnnaiion Z - The aforesaid option shall not be admissible to any person appointed toa post on or after the 1sl day of January, 2006, whether for the first timein Government service or by transfer from another post and he shall beallowed pay only in the revised pay structure,
Txplonation 3 - Where a Government servant exercises the option under the provisos10 this.rule to retain the existing scale in respect of a post held by himin an officiating capacity on a regular basis for the 'purpose ofregulation of pay in that scale under I'undarnentalRule 22, or any otherrule or order applicable to that post, his substantive pay shall besubstantive pay which he would have drawn had he retained theexisting scale in respect of the permanent post on which he holds a lienor would have held a lien had his lien not been suspended or the pay ofthe officiating post which has acquired the character of substantive payin accordance with any order for the lime being in force, whichever ishigher.
h. Exercise of Option -

Provided that _.
(i) ill the case of i'\ Government servant who i", on the elate (If SlIeI,publication OT, as the case may be, elate of such order, out of Indiaon leave or depulation or foreign service or active service, thesaid option shall be exercised in wriling so as to reach the saidauthority within three months of the date of his taking charge ofhis post in India; and
(ii) where a Government servant is under suspension on the 151 day ofJanuary, 2006 ; the option may be exercised within three months ofthe dale of his return 10 his duty if that date is later than the daleprescribed in this sub-rule.
(2) The option shall he intimated by the Government servant to the Head ofhis Office.
(3) If the intimation regarding option is not received within the timementioned in sub-rule (1), the Government servant shall be deemed 10
have elected to be governed by-the revised pay structure with effecl onand Irom the ]<t day of [anuary, 2006.
(4) The option once exercised shall be final.
Note J - Persons whose services were terminated on or after the 1st January, 2006 andwho could not exercise the option within the prescribed time limit, onaccount of discharge on the expiry of the sanctioned posts, resignation,dismissal or discharge or disciplinary grOlmc!s, areentitled to the benefits ofthis rule.
Note 2 - Persons who have died on or after the 1.t day of January, 2006 and could notexercise the option within the prescribed time limit are deemed to haveopted for the revised pay structure on and from the -ist day of January, 2006or such later date as is most beneficia! to their dependents, if the revised paystructure is more favourable and in such cases, necessary action for paymentof arrears should be taken by (he Head of Office.
Note B - Persons who were on earned leave or any other leave onT :1.2006 whichentitled them to leave salary will be allowed Olebenefits of this rule.

(ii) if the minimum of the revised pay bancl/ pay scale is more thanthe amount arrived at as per (i) above, the pay shall he fixed at theminimum of the revised pay band/ pay scale;
Provided further that.-
Where, in the fixation of pay, the pay of Government servantsdrawing pay at two or more consecutive stages in an existing scalegets bunched, that is to say, gets fixed in the revised pay structureat the same stage in the pay band .. then, for every two stages sobunched, benefit of one increment shall be given so as to avoidbunching of more than two stages in the revised running paybands. POI' this purpose, the increment will be calculated on thepay in the pay band. Grade pay would not be taken ipto accountfor the purpose of granting increments to alleviate bunching.
In the case of pay scales in higher administrative grade (I-TAG) inthe pay hand PB-4, benefit of increments due 10 bunching shall begiven taking into account all the stages in different pay scales inthis grade. In the case of HAG+ scale, benefit of one increment forevery two stages in the pre-revised scale will be gnHlled in therevised pay scale.
If by stepping up of the pay as above, the pay of a Governmentservant gets fixed at a stage in the revised pay band/ pay scale(where applicable) which is higher than the slage in the revisedpay band at which the pay of a Government servant who wasdrawing pay at the next higher stage or stages in thesame existingscale is fixed, the pay of the latter shall also be stepped up only tothe extent by which it falls short of that of the former.

(iii) The pay in the pay hand will be determined in the above manner.In addition to the pay in the pay hand, grade pay corresponding tothe existing scale will be payable.

(B) In the case of employees who are in receipt of special pay/allowance illaddition to pay in the existing scale which has been rr-rommeudcd forreplacement by a pay band and grade pay without any sper-ialpay / allowance, pay shall he fixed in the revised pay structure inaccord ance with the provisions of clause (1\) above.

(0) 1n the case of medical officers who are in receipt or non-practisingallowance, the pay in the revised pay structure shall be fixed inaccordance with the provisions of clause (A) above except that, in suchcases, the pre-revised dearness allowance appropriate 10 the 11011-

lion-practising allowance at the new rates shall be drawn with effect [rom

Notel - (a) In the case of Group D employees, the pay in the revised pay slructurcwill be fixed initially in the -IS pay band as per Clause (A) above with theappropriate grade pay and arrears paid accordingly. Thereafter, pay of suchor those Group D employees who already possess the revised minimumqualifications recommended by the Commission prescribed for entry inlo1"13-1would be fixed with effect from '1.1.2006 in PB-l with grade pay ofRs.1800.
(b) Such of those existing Group D employees who .do not possess therevised minimum qualifications fOJ''entry into 1'13-1would be retrained bythe concerned Department preferably within a period of six months so thatpayment of arrears on account of upgradation are not delayed. After re-training, these Group D staff will also be placed in U1ePay Band P13-'J withthe grads pay of Rs.1800 with effect from 1.1.2006 and arrears drawnaccordingly. Once placed in the PB-l Pay Banet this category of Group Dstaff will regain their seniority vis-a-vis the other category of Group D staffthat already possessed the minimum qualifications and were, therefore,placed in the P13·] Pay Band as on 1.1.2006. Inter-se seniori!y of all theemployees in erstwhile Group D will be fully maintained with Group Demployee in a higher pre-revised pay, scale being placed hi!~her vis-a-vis anemployee in a lower pay scale. vVilhin the same pre-revised pay scale,seniority which existed prior to revision would continue.
(c) Arrears shall be payable with effect from 1:1.2006 in both the cases i.e, tothose Group D employees who possess the qualifications and are placed inPB-I straight away and those Group D employees who do not possess thequalifications and are placed after re-training . Nole.1 - A Government servant who is on leave on the 1.1 day of January, 2006 and isentitled to leave salary shall become entitled to pay in the revised paystructure hom "1.1.2006 or the date of option for the revised pay structure.Similarly, where a government servant is on study leave on the first clay ofJanuary, 2000 he will be entil:1ed to the benefits under these Rules from1.1.2006 or the date of option.
Note A - A Government servant under suspension, shall continue to draw subsistenceallowance based on existing scale of pay and his pay in the revised paystructure wiJI be subject to the final order on the pending disciplinaryproceedings.
Noll' 5 - Where a Covernmenl servant is holding a permanent post and is officiatingin a higher post on a regular basis and the scales applicable 10 these twoposts are merged into one scale, the pay shall be fixed under this sub-rulewith reference to the officiating post only, and the pay so fixed shall hetreated as substantive pay.
The provisions of this Note shall apply mutatis mutandis, to Governmentservants holding in an officiating capacity, posts on different existing scaleswhich have been replaced by the revised pay structure.

Note 1)- In the case of employees who are in receipt of personal pay for passing HindiPragya, Hindi Typewriting, Hindi Shorthand and such other examinationsunder the "Hindi Teaching Scheme", or on successfully undergoing trainingin cash and accounts mailers prior to the 151 day of January; 2000, while thepersonal pay shall not he taken into account for purposes of fixation of initialpay in the revised pay structure, they would continue to draw personal payafter fix-ation of their pay in the revised pay structureon and from the '1';'Ibyof January, 2006 or subsequently for the period for which they would havedrawn it but for the fixation of their pay in the revised pay structure. Thequantum of such personal pay would be paid at the appropriate rate ofincrement in the revised pay structure from the date of fixation of pay for Iheperiod for which the employee would have continued 10 draw it.
Explanat.ion - For the purpose of this Note, "appropriate rate of incrementin the revised pay structure" means 3% of the sum of thepay in the pay band and the grade pay at the stage at whichthe pay of the employee is fixed in the revised paystructure .
.Note Itt - lJ1 cases where a senior Government servant promoted to a higher post
before the JSI day of January, 2006 draws less pay in the revised pay structurethan his junior who is promoted to the higher post: on or after the 1st day ofJanuary, 2006, the pay in the pay band. of the senior Government servantshould be stepped up to an amount equal to the pay in the-pay band as fixedfor his junior in that higher post. The stepping up should be done with etlr-ctfrom the date of promotion of the junior Government servant subject to thefulfillment: of the following conditions, namely: -
(a) both the junior and the senior Government servants should belong tothe same cadre and the posts in which they have been promo ledshould be identical in the same cadre.
(b) the pre-revised scale -of pay and the revised grade pay of the lowerand higher posts in which they are entitled to draw pay should beidentical.
(c) the senior Government servants at the time of promotion should havebeen drawing equal or more pay than the junior.
(d) the anomaly should be directly as a result of the application of theprovisions of Fundamental Rule 22 or any other rule or orderregulating pay fixation on such promotion in the revised paystructure. If even in the lower post, the junior officer was drawingmore pay in the pre-revised scale than the senior by virtue 6f all)'

B. Fixation of pay in the reoised pay structure of employees appointed as freshrecruits Oil or after ,1.1.2006 - Section Il of Part A of the First Schedule of these Rulesindicates the entry level pay in the pay band at which the pay of direct recruits to II
particular post carrying a specific grade pay will be fixed on or after J.J .2006.
This will also be applied in the case of those recruited between 1.1.2006 and thedate of issue of this Notification. In such cases, where Ole emoluments in the pre-revisedpay scalets) [i.e., basic pay in the pre-revised pay scale(s) plus Dearness Pay plusDearness Allowance applicable on the date of joining) exceeds the sum of the pay fixedin the revised pay structure and the applicable dearness allowance Thereon, thedifference shall be allowed as personal pay to be absorbed in future increments in pay.
9. Rate of increment ill the revised I,ay structure -The rate of increment in therevised pay structure will be 3% of the sum ofthe pay in the pay band and grade payapplicable. which will be rounded off to the next multiple of 10. The amount ofincrement will be added to the existing pay in the pay bam!' Illustration 5 in thisregarel is in the Explanatory Memorandum to these Rules. In the case of PB-3, variablerates of increment at 3°,.{, and 4% have been provided. The higher rate of increment willbe granted to not more them 20'Yo of the strength of officers in PB-3.
10. Date of next incremen t ;11 the revised pay structure - There will be a uniform elateof annual increment, viz. 1st July of every year. Employees completing 6 months andabove in the revised pay structure as on. 1st of July will be eligible to be granted theincrement. The first increment after fixation of pay on 1.1.2006 in the revised paystructure will be granled' on 1.7.2006 for those employees for whom the date of nextincrement was between 1st July, 2006 to 151 January, 2007.
Provided that in the case of persons who had been drawing maximum of Uteexistingscale for more than a year as on the "[st day of January, 2006, the next incrementin the revised pay structure-shall be allowed on the 151 day of January, 2006. Thereafter,the provision of Rulel Owould apply.
Provided that in cases where an employee reaches the maximum of Ids pay band,shall be placed in the next higher pay band after one year of reaching such a maximum.At the lime of placement in the higher pay band, benefit of one increment will beprovided. Thereafter, he will continue to move in the higher pay band till his pay in till'pay hartd reaches the maximum of PB-t!, after which no further increments will begranred.

J3. Fixation ofpl1Y em promotion OJI or after 1.1.2006 - In the case Cifpromotion fromone grade pay ttl another in the revised pay structure, the fixation will be done asfollows:-
(i) One increment equal to 3% of the sum of the pay in the P~\Yhand and theexisting grade pay will be computed and rounded off to the next multiple of10. This will be added to the existing pay in the pay band. '[he grade paycorresponding to the promotion post will thereafter be granted in addition Inthis pay in the pay band. In cases where promotion involves change in thepay band also, the same methodology wiIl be followed. However, if the payin the pay band after, adding the Increment is less than the minimum of thehigher pay band to which promotion is taking place, pay in the pay band willbe stepped to such minimum.
(ii) In the case of promotion from PB-4 to HAG+, after adding one increment inthe manner prescribed in Rule 9, the pay in the pay band and existing gmdepay will he added and the resultant figure will become the basic pay inHAG+. This shall not exceed Rs, 80,000, the maximum of the scale. ForGovernment servants in receipt: of NPA, pay plus NPA will not exceed Rs.83,000.
H. Mode of ptnnneu! of arrears of lJay - The arrears shan be paid in cash in twoinstalments. The first instalment should bc restricted to 40% of the total arrears. Theremaining 60% of arrears should be paid during the next financial year.

15, Ouerriding effect of Rules - The provisions of theFundamental rules, the CentralCivil Services (Revision of Pay) Rules, 1947, the Central Civil Services (Revised Pay)Rules., J960, the Central Civil Services (Revised Pay) Rules, 1973, Central Civil Se rvices(Revised Pay) Rules, 1986 and CCS'(l~evjsed Pay) Rules, 1997 shall not, save as otherwiseprovided in these rules, apply to cases where pay is regulated under these rules, to theextent they are inconsistent with these rules.
[6. Power to relax - Where the President is satisfied that the operation of all or anyof the provisions of these rules causes undue hardship in any particular case, he may, byorder, dispense with or relax the requirements of DUll: rule to such extent and subject tosuch conditions as he may consider necessary for dealing with the case in a just andequitable manner.
'17. Interpretation - If any question arises relating to the interpretation of any of theprovisions of these rules, it shall be referred to the Central Government (or decision .•

Rule 1 ..This rule is self-explanatory.
Rule 2 - This rule lays down the categories of employees to whom the rules apply.Except for the categories excluded under clause (2), the rules are applicable to all personsunder the rule making control of the President serving in Departments paid from CivilEstimates. They do not apply to the employees under the Ministry of Railways andcivilian personnel paid from Defence Services Estimates, for whom separate rules will heissued by the Ministries concerned. The rules do not also apply to Gramin Oak Sevaksin the Department of Posts. The rules, however, apply to work charged establishments.
Rule 3 & 4 - These rules are self-explanatory.
Rule 5 - The intention is that all Government servants should be brought over to therevised pay structure except those who elect to draw pay in the existing scales. Thosewho exercise the option to continue on the existing scales of pay wi1l continue to drawthe dearness allowance at the rates in force on the 1st January, 2006 and the dearnessallowancewill counL towards the emoluments for pension, etc. to the extent it so countedon the said date. If a Government servant is holding a permanent post in a substantivecapacity and officiating in a higher post, or would have officiated in one or more postsbut for his being on deputation etc., he has the option to retain the existing scale only inrespect of one scale. Such a Government servant may retain the existing scale applicableto a permanent post or anyone of the officiating posts. In respect of the remaining postshe will necessarily have to be brought over to the revised pay structure.
Rule 6 - T.hisrule prescribes the manner in which option has to be exercised and also theauthority who should be apprised of such option. The option has to be exercised in theappropriate form appended to the rules. It should be noted that it is not sufficient for aGovernment servant to exercise the option within the specified time limit but also toensure that it reaches the prescribed authority within the time limit. In the case ofpersons who are outside India at the time these rules are promulgated, the period withinwhich the option has to be exercised is three months from the date they take over chargeof the post in India. In the case of Government servants the revised pay structure ofwhose posts are announced subsequent to the date of issue of these rules, the period ofthree months will run from the date of such announcement.
Persons who have retired between lsI January 2006 and the date of issue of these rulesare also eligible to exercise option.
Rule 7(1) -' This rule deals with the actual fixation of pay in the existing scales on 1s'
January, 2006. A few illustrations indicating the manner in which pay of Governmentservants should be fixed under this sub-rule subject to stepping up of pay under Notesbelow rule 7(1) are given in the attached Annexure.

Rule 7(2) - The benefit of this TIlleis not admissible in cases where a Government servanthas elected the revised pay structure in respect of his substantive post, hut has retainedthe existing scale in respect of an officiating post.

Rule 9 & 10 These rules prescribe the manner in wluch the next Increment in the newscale should be regulated. The provisos to this rule are intended to eliminate thpanomalies of junior Government servants drawing more pay than their senior by theoperation of substantive part of this rule and also taking care of the Governmentservants who have been drawing pay at the maximum of the existing scale for more thanone year as on 1.1.2006 and also those Government servants who have bsen stagnating atthe ma>-:imumof the existing scale and are actually in receipt of stagnation increment onad hoc basis.

Subject: Implementation of Sixth Central Pay Commissionrecommendations - fixation of pay and payment ofarrears - instructions regarding.
The undersigned is directed to refer to the Central Civil Services (RevisedPay) Rules, 2008, notified vide G.S.R. No.622.(E)dated 291h August,"2008 and tostate that in terms of Rule 6 of these Rules, government servants are required toexercise their option for drawal of their pay in the revised pay structure in theformat prescribed in t-heSecond Schedule to the Rules.
2. The sequence of action to be taken on receipt of the option will be asfollows: -
(i) The manner of initial fixation of pay in the revised pay structurehas been indicated in Rule 7 of the CCS (RP) Rules, 2008. On thebasis of this Rule, detailed Fixation Tables for each stage in each ofthe pre-revised scales have been worked out in the mannerrecommended by the Sixth Pay Commission and are enclosed asAnnex-I of this a.M. These may be used for the purpose of fixationin the revised pay structure as on 1.1.2006.
(ii) The tables in Annex-I will be applicable in cases where normalreplacement pay scales have been approved by the Government. Incases of upgradation of posts and merger of pre-revised pay scales,fixation of pay will be done as prescribed in Note 2A and 2.UbelowRule 7(1) and in the manner indicated in Illustration 4A & 4Brespectively of the Explanatory Memorandum to the CCS (RP)Rules, 2008.
(iii) In terms of the CCS (RP) Rilles, 2008, there shall be a uniform dateof increment i.e. 1st July of the year after implementation of therevised pay structure. Consequently, in the case of employeeswhose date of next increment falls on 1.1.2006, the increment will bedrawn in the pre-revised scale and pay fixed in accordance with thetables after including this increment. The next increment in therevised pay structure in such cases will be drawn orrI>' July, 2006.

Insofar as the employees who have joined on or after 1.1.2001are concerned, the enhanced deductions under the New PensionScheme will be calculated with reference to the revised basic payand DA thereon,
"Basic pay" in the revised pay structure means the pay drawn in theprescribed pay band plus the applicable grade pay but does notinclude any other type of pay like special pay, etc. ln the case ofGovernment servants in the pay scales of HAG+ and above, basicpay means the pay in the prescribed scale.
(\1) Bills may be drawn separately in respect of the arreass of pay andallowances for the period from January I, 2006 to August 31,2008.The aggregate arrears, computed after deduction of subscription atenhanced rates of GPF and NPS with reference to the revised pay,may be paid in two instalments, the first instalment being restrictedto ·10% of the aggregate arrears. DDOs/PAOs will ensure thataction is taken simultancously . in regard to Government'scontribution towards enhanced subscription. Orders in regard tothe payment of the second instalment of arrears will be issuedseparately.
(vi) Similar sequential action as indicated above may be taken for theauthorization of the revised pay and allowances of those employeeswhose options might be received later.
3, The revised rates of all allowances, such as House Rent Allowance,Transport Allowance, Children Education Allowance, Special CompensatoryAllowance, Special Duty Allowance, Island Special Duty Allowance, Hard DutyAllowance, etc., will be paid prospectively w.e.I. 1.9.08. Accordingly, no arrearswill be paid in respect of these allowances. However, Dearness Allowance andNon-Practising Allowance for medical doctors at rates notified separately, will bepayable w.e.f. 1.1.2006 or the date of option.
4. With a view to expediting the authorization and disbursement of arrears,it has been decided that the arrear claims may be paid without pre-check of thefixation of pay in the revised scales of pay. The facility to disburse' arrearswithout pre-check of fixation of pay will not, however, be available in respect oft hose Government servants who have relinquished service on account ofdismissal, resignation, discharge, retirement etc. after the date of implementation

J. In order 10 ensure correr t and systematic fikation of pay in l lu- revised payslructure, a proforma for the purpose (Statement of Fixation of Pay) is enclosed(Annex-H). The statement should be prepared in triplicate and one copy thereofshould be passed in the Service Book of the Government servant concerned andanother copy made available to the concerned accounting authorities [ChiefController of Accounts/ Controller of Accounts/ Accounts Officer] for post-check.Attention is also invited in this connection to the Government decision containedat 51. No.2 (iii) of the Part I AI of the Resolution No.l/l/200R-lC dated August29,2008 regarding the adjustment of the instalments of Dearness Allowance paidpaid between July 112006 and June 30/2008.
6 The requirement of pre-check of pay fixation having been dispensed with,it is not unlikely that the arrears due in some cases may be computed incorrectlyleading to overpayments that might have to be recovered subsequently. TheDrawing & Disbursing Officers should, therefore, make it clear to the employeesunder their administrative control, while disbursing the arrears, that thepayments are being made subject to adjustmentfrom amounts that may be due tothem subsequently should any discrepancies be noticed later. For this purpose,an undertaking may also be obtained in writing from every employee at the timeof disbursement of the arrears/ pay and allowances for September, 2008 to theeffect that any excess payment that may be found to have been made as a resultof incorrect fixation of pay in the revised scales will be refunded by him toGovernment either by adjustment against future payments or otherwise. Aspecimen form of the undertaking is also enclosed (Annex-III).
7. In authorizing the arrears, Income Tax as due may also be deducted andcredited to Government in accordance with the instructions on the subject. Incase a Government servant wishes to deposit 'his arrears in his General ProvidentPund account, this may be permitted. •
S. On receipt of the necessary options, action for drawaland disbursement ofarrears should be completed immediately.

No. 9(20)/2000-EII(B) dated 28.J2.2004, the Sweepers and Farashes working in CentralSecretariat and allied offices performing split duties, where the break-in between the shill is at least 2 hours and theyhave not been provided residential accommodation within I km. of the office premises shall be entitled to Split DutyA llownnce at the rare ofRs.200 per month. The other conditions ofO.M. No. 9(20)/2000-EII(ij) dated 28.12.2004will remain unchanged.

Subject :- Recommendations of the Sixth Central Pay Commission-implementation of decisions relating to the grant of Children EducationAssistance and Reimbursement of Tuition Fee.
Consequent npon the decisions taken by the Government on therecommendations made by the Sixth Central Pay Commission and in supersessionof all earlier orders on the subject of Children Education Allowance andReimbursement of Tuition Fee, the President is pleased to issue the followinginstructi ons:-
(a) Children Education Allowance and Reimbursement of Tuition Feewhich were hitherto payable separately will be merged and willhenceforth be known as 'Children Education Allowance Scheme'.
(b) Under the Scheme of Children Education Allowance reimbursement canbe availed by Government Servants upto to a maximum of 2 children.
(c) Reimbursement as indicated above will be applicable for expenditure onthe education of school going children only i.e., for children from classesnursery to twelfth, including classes eleventh and twelfth held by juniorcolleges or schools affiliated to Universities or Boards of Education.
(d) Henceforth, the reimbursement of Children Education Allowance shallhave no nexus with the performance of the child in his class. In otherwords, even if a child fails in a particular class, the reimbursement ofChildren Education Allowance shall not he stopped.
(e) Reimbursement for the following items can be claimed under this Scheme:
Tuition Fee, admission fee, laboratory fee, special fee chargedfor agriculture, electronics, music or any other subject, Feecharged for practical work under the programme of workexperience, fee paid for the use of any aid or appliance by the
child, library fee, games/sports fee i'lIld fee [,:1I extra-curricularactivities. This also includes reimbursement for purchase of one$d of text 'houks and notebooks, two sets uf uniforms awl one setof school shoes which can he claimed for a child, in a year.
(f) The annual ceiling fixed for reimbursement of Children Educationallowance is RS.12000.
(g) Under this scheme, reimbursement can be claimed once every quarter.The amount that can be claimed in a quarter could be more thanRs.3000, and in another q11311er less than Rs.3000, subject to the annualceiling ofRs.12000 per child being maintained.
(h) In case both the spouses are Government servants, only one of themcan avail reimbursement under Children Education Allowance.
(i) Hostel subsidy will be reimbursed upto the maximum limit of RS.3000per month per child subject to a maximum of 2 children. However, bothhostel subsidy and Children Education Allowance cannot be availedconcurrently.
(j) The above limits would be automatically raised by'25% every time the.. Dearness Allowance on the revised pay structure goes up by50%.
2. In order to ensure that Government servants have no difficulty in claimingreimbursement, the procedure tinder this Scheme is being kept simple.Reimbursement should henceforth he made all the submission of original receipts onthe basis of self-certification by the Government servant.
3. These orders shall be effective from 1st September, 2008.
4 _ Insofar as persons serving in the Indian Audit and Accounts Department areconcerned, these orders issue in consultation. with the Comptroller arid auditorGeneral of India.

The undersigned is directed to say that in pursuance of Government's decision on therecommendations of Sixth Central Pay Commission, sanction of the Prf!sident is herebyaccorded to the regulatIon, with effect from 1.1.2006, of pension/ family pension of all thepre-2006 pensioners/ family pensioners in the manner indicated In the succeeding paragraphs.Separate orders will be issued in respect of employees who retired/died on or after 1.1.2006.
2.1 These orders apply to all pensioners/family pensioners who were drawingpension/family pension on 1.1.2006 under the Central Civil'Services (Pension) Rules, 1972,CCS (Extraordinary Pension) Rules and the corresponding rules applicable to Railwaypensioners and pensioners of All India Services, including officers of the Indian Civil Serviceretired from service on or after 1.1.1973.
2.2 Separate orders will be issued by the Ministry of Defence in regard to Armed Forcespensioners/family pensioners.
2.3 These orders do not also apply to retired High Court and Supreme Court Judges andother Constitutional/Statutory Authorities whose pension etc. is governed by separaterules/orders.
3.1 In these orders:
a. EXisting pensioner or Existing Family pensioner means a pensioner who wasdrawinq/entitled to pension/family pension on 31.12,2005.
b. Existing pension means the basic pension inclusive of commuted portion, if any, dueon 31.12.2005. It covers all classes of pension under the CCS (Perjslon) Rules, 1972as, also Disability Pension under the CCS (Extraordinary Pension) Rules and thecorresponding rules applicable to Railway employees and Members of All IndiaServices.
c. Existing family pension means the basic family pension drawn on 31.12.2005 underthe CCS (Pension) Rules and the corresponding rules applicable to Railway employeesand Members of All India Services. •
4.1 The pension/family pension of existing pre-2006 pensioners/family pensioners will beconsolidated with effect from 1.1.2006 by adding together:-
i. The existing pension/family pension.
ii. Dearness Pension, where applicable
iii. Dearness Relief upto AICPI (IW) average index 536 (Base year 1982 = 100) l.e , @24% of Basic Pension/Basic family pension plus clearness pension as admissible videthis Department's a.M. No. 42/2/2006-P&PW(G) dated 5.4.2006
iv. Fitment weightage @ 40% of the existing pension/family pension.

4.2 The fixation of pension will be subject to the provision that the revised pension, in nocase, shall be lower than fifty percent of the minimum of the ~ay in lIle pay band plus the~,radepay correspondlnq to the pre-revised pay scale from which the pensioner had retired. Inthe case of HAG+ and above scales, this will be fifty percent of the minimum of the revisedpay scale.
4.3 Since the consolidated pension will be inclusive of commuted portion of pension, ifany, the commuted portion will be deducted from the said amount while making monthlydisbursements.
4.4 The upper ceiling on pension/family pension laid down in the' Department of Pensionand Pensioner's Welfare Office Memorandum No 45/86/97-P&PW(A)(Part-1) dated 27.10.1997has been increased from Rs. 15000/- and Rs. 9000/- to 50% and 30% respectively of thehighest payJn the Government (The highest pay In the Government is Rs. 90,000 since1.1.2006). .
4.5 The quantum of pension/family pension available to the old pensioners/ familypensioners shall be increased as follows:-

The amount of additional pension will be shown distinctly in the pension payment order. Forexample, in case where a pensioner Is more than 80 years of age and his/her consolidatedpension in terms para 4.1 and 4.2 above is Rs.1Q,OOOprn, the pension will be shown as(i).Basic pension=Rs.lO,OOO and (ii) Additional pension =: Rs.2,OOO pm. The pension onhis/her attaining the age of 85 years will be shown as (l). Basic Pension = Rs.I0,OOO and (ii)additional pension =: Rs.3,OOOpm.
4.6 Some of the existing pensioners who retired between 31.3.t985 and 31.12.1985 arein receipt otpersonet pension. The said personal pension will continue to be granted as aseparate element and will not be merged into the pension as consolidated above.
4.7 Since the consolidated pension/family pension arrived at as per paragraph 4.1.includes dearness relief upto average Index level 536(Base year 1982=100), dearness reliefwill be admissible thereon only beyond index average 536 (Base year 1982= 100) inaccordance with the revised scheme of dearness relief for which orders are being issuedseparately. The four instalments of clearness relief sanctioned earlier from 1.7.2006, 1.1.2007,1.7.2007 and 1.1.2008 In this Department's Office Memorandum No. 42J2/2906-P&PW(G)dated the 15.9.2006, Office Memorandum No. 42/2/2006-P&PW(G) dated the 23,3.2007,Office Memorandum No. 42j2/2006-P&PW(G) dated the 18.9.2007 and Office MemorandumNo. 42/2/2006-P&PW(G) dated the 19.3.2008 respectively shall be adjusted against revisedDearness Relief becoming due on the consolidated pension/family pension.

6. The employed/re-employed pensioners/family pensioners are not getting dearnessrelief on pension at present under the extant orders. In their case the notional dearness reliefwhich would have been admissible to them but for their employment/re··employment will betaken into account for consolidation of their pension in terms of paragraph 4.1. above as ifthey were drawlnq the dearness relief. Their pay will be re-fixed w.e.f. i.1.2006 with referenceto consolidated pension becoming admissible to them. Dearness relief beyond 1.1.2006 Will,however, not be admissible to them during the period of employment/re-employment.
7. The cases of Central Government employees who have been permanently absorbed inpublic sector undertakings/autonomous bodies will be regulated as follows:-
(a) PENSION
Where the Government servants on permanent absorption in' public sectorundertakings/autonomous bodies continue to draw pension separately from the Government,the pension of such abosrbees will be updated in terms of these orders. In cases where theGovernment servants have drawn one time lump sum terminal benefits equal to 100% of theirpensions and have become entitled to the restoration of one-third commuted portion ofpension as per Supreme Court judgement dated 15.12.1995, their cases will not be coveredby these orders. .
(b) FAMILY PENSION
In cases where, on permanent absorption in public sector undertakings/autonomous bodies,the terms of absorption permit grant of family pension under the CCS (Pension) Rules, 1972 orthe corresponding rules applicable to Railway employees/members of All India Services, thefamily pension being drawn by family pensioners will be updated in accordance with theseorders.
8. All Pension Disbursing Authorities including Public Sector Banks handlingdisbursement of pension to the Central Government pensioners are hereby authorised to paypension/family pension to existing pensioners/family pensioners at the consolidated rates interms of para 4.1 above without any further authorisation from the concerned AccountsOfficers/Head of Office etc. A table indicating the existing basic pension/family pension withoutDearness Pension, the basic pension/family pension with dearness pension and the revisedconsolidated pension/family pension is enclosed for ready reference .. (Annexure 1). This tablemay be used where the pensioner is in receipt of a single pension only. Where a pensioner isin receipt of more than one pension, consolidation may be done separately in terms ofparagraph 4.1 and as indicated in paragraph 5 floor ceiling of Rs. 3500/- may be applied tototal pension from all sources taken together. Wherever the age of pensioner/ familypensioner is available on the pension payment order, the additional pension/ family pension interms of para 4.5. above may also be paid by the pension disbursing authorities immediatelywithout any further authorisation from the concerned Account Officer/ Heael of Office, etc. Asuitable entry regarding the revised consolidated pension shall be recorded by the pensionDisbursing Authorities in both halves of the Pension Payment Order. An intirnation regarding

,.)f',u.1disbursement of revised pension may bE sent 'by the pension disl>Lwsing authorities co theOffice of CPAO and Accounts Officer which had issued the PPO in the form given at Annexure-II so that the latter can update the Pension payment Order Register maintained by him. Anacknowledgement shall be obtained by U1C Pension Disbursing Authorities from Office of CPADand the respective Accounts Officers in this behalf.
9 The consolidated pension/f<lmily pension as wellk•..rl !lilt. in accordance with provlslou-,of Para 4.1. above shall be treated dS finnl 'Basic Pension' with effect from 1.1.2006 and ~;haltqualify for grant of Dearness Relief sanctioned thereafter.
,1I) 40% of the arrears ot pension will be paid in the year 2008··09 and the remaining 60%in the year 2009-10.
11. It shall be the responsibility of the Head of the Departrnent of the Ministry,Department, Office, etc. from which the government servant hacl retired ~r where he wasworking prior to his demise to revise the pension/family pension of all pensioners/ familypensioners with effect from 1st January 2006 in accordance with the provisions mentioned inpara 4.1 and 4.2 above and to Issue revised Pension Payment Order (PPOs). Action to revisepension/ family pension in terms of these provisions shall be initiated suo moto by theconcerned Heads of Departments. In the case of the Defence Civilian Employees, however, theprocedure prescribed in this regard by the Ministry of Defence. shall be followed. It isemphasised that the Pension Sanctioning Authority, in no case, will ask the pensioner/ familypensioner to surrender his/ her original Pension Payment Order (PPO) for issuing revisedauthority. In case, however, the age of pensioner/family pensioner is not available on thePPO/office records, the same shall be -obtained from the pensioner/family pensioner andindicated in the revised PPO. The authenticity of the age declared by the pensioner/familypensioner shall be verified by the pension sanctioning authority. It may also be ensured that acopy of the revised PPO should be invariably endorsed to the pensioner/ family pensioner.
12. It is considered desirable that the benefit of these orders should reach the pensionersas expeditiously as possible. To achieve this objective it is desired that all Pension DisbursingAuthorities should ensure that the revised pension and the first instalment of arrears due tothe pensioners in terms of para 4.1. and para 4.5 above Is paid to the pensioners or creditedto their account by 30th September, 2008 or before positively. Instructions regar(1il)g releaseof second instalment of arrears will be issued later. Concerted efforts should be made 'by allthe authorities concerned to ensure that the revised PPO's are issued, wherever necessary,with the utmost expedition in terms of para 4,1, 4.2. and 4.5 above and arrears are paid interms of para 10 above within two months from the date of issue of this O.M.
13. In their application to the persons belonging to Indian Audit and Accounts Departmentthese orders issue In consultation with the Comptroller and Auditor General of India.

1. The undersigned is directed to state that in pursuance of Government's decision on tilerecommendation of the Sixth Central Pay Commission, the President is pleased tointroduce the following modifications in the rules regulating pension,Retirement/Death/Service Gratuity/Family Pension/disability pension and ex-qrarialump-sum compensation under the CCS (Pension) Rules, 1972 (hereafter referred toas Pension Rules) and Cornrnutation of Pension under CCS (Commutation of Pension)Rules, 1981, CCS (Extraordinary Pension) Rules, 1939, etc.
2 These orders apply to Central Government Employees governecl by tile CCS (Pension)Rules, 1972. Separate orders will be issued bv the Ministry of Defence, Ministry ofRailways and the AIS Division of the DOPT in respect of Armed P'orces personnel,Railway employees and the officers of All India services respectively on the basis otthese orders.
DATE OF EFFECT
3.1 Save as otherwise mentioned in these orders, the revised provisions as per theseorders shall apply to Government servants who retire/die in narness on or after1.1.2006. Separate orders have been issued in respect of employees who retired/diedbefore 1.1.2006.
3.2 Where pension/family pension/Gratuity/Commutation of pension, etc has already beensanctioned in cases occurring on or after 1.1.2006, the same shall be revised in termsof these orders. In cases where pension has been finally sanctioned on the pre-revise-dorders and if it happens to be more beneficial than the pension becoming due underthese orders, the pension already sanctioned shall not be revised to the disadvant aqeof the pensioner in view of Rule 70 of the CCS (Pension) Rules, 1972.
EMOLUMENTS
4.1 The term 'Emoluments' for purposes of calculating various pensionary benefits otherthan various kinds of Gratuity shall have the same meaning as in Rule 33 of theCentral Civil Services (Pension) Rules, 1972.
4.2 BaSICpay in the revised pay structure means the pay drawn in the prescribed f),lyband plus the applicable grade pay but cloes not include any other 'tvpe of pav likespecial pay, etc.
4.3 In the case of all kinds of Gratuity, DA adrnlsslble on the date of retirement/death sha!lcontinue to be treated as emoluments alonq wilh tile emoluments as defined 111

1·,.3 In cases where Government servant becomes entitled to pension on completion of 10years of qualifying service in accordance with nule 49(2) of the CCS (Pension) Rules,1972, pension in those cases shall also be paid at 50% of the emoluments or averaqeemoluments, whichever is more beneficial to the Government servan~.
5.4 The revised provisions for calculation of pension in para 5.2 and para 5.3 above shallcome into force with effect from the elate of issue of this O.M. and shall be applicableto Government servants retiring on or after 1I1atdate. The government servants whohave retired on or after 1.1.2006 but before the date of issue of this O.M. will continueto be governed by the Rules/ orders which were in force immediately before cominginto effect of these orders. •
~'.5 Tile amount of pension shall be subject to a minimum of Rs.3500/- and maximumupto.50% of highest pay in the Government (The higllest pay in the Govt , rs Rs,90,000 since 1.1.2006).
5.6 The provisions of clauses (a) to (c) of sub-rule (2) of Rule 49 of the Pension Rulesshall stand modified to the extent mentioned in para 5.1 to para 5.5 above. The otherprovisions contained in Rule 49 shall continue to apply.
5.7 Tile quantum of pension available to the old pensioners shall be increased as follows:-

8,1 'Family pension shall he calculated at a uniform rate of 30% of basic pay in all casesand shall be subject to a minimum of Rs.3500/-p.m. and maximum of 30% of thehighest pay in the Government. (The highest pay in the Govt. is f~s.90,000 since1.1.2006). Rule 54(2) relating to Family Pension, 1964 under Pension Rules shallstand modified to this extent.
82 The enhanced family pension under Rule 54(3)(a)(i) shall be payable to the family of aGovernment servant who dies in service from the date of death of the Governmentservant for a period of ten years, without any upper age limit, Rule 54(3)(a)(i) shallstand modified to this extent. There will be no change in the period for payment ofenhanced family pension to the family in the case of death of a pensioner.

8.5 The depenclency criteria for the purpose of family pension shall be the minimum familypension 010119 with dearness relief thereon.
8.6 The childless widow of a deceased Government employee shall continue to IJe paidfamily pension even after her remarriage subject to the condtnori that the familypension shall cease once her independent income from all other sources becomesequal to or higher than the minimum prescribed family pension in the CentralGovernment. The family pensioner in such cases would be required to qive adeclaration regarding her income from other sources to the pension disbursingauthority every six months.
COMMUTATION OF PENSION
').1 A Government servant shall continue to be entitled to commute for a lurnpsumpayment up to 40% of his pension.
9.2 The existing Table of Commutation Value for Pension Annexed to the CCS(Commutation of Pension) Rules, 1981 shall be substituted by a new Table at Annex. Iof this O.M.
9.3 The revised Table of Commutation Value for Pension will be used for all commutationsof pension which become absolute after the date of issue of this O.M. In the case ofthose pensioners, in whose case' commutation of pension became absolute on or after1.1.2006 but before the issue of this OM, the pre-revised Table of Commutation Valuefor Pension will be USedfor payment of commutation of pension based 011 pre-revisedpay/pension. Such pensioners shall have an option to 'commute tile .arnount ofpension that has become additionally commutable on account of retrospective revisionof pay/pension on implementation of the recommendations of the Sixth Central PayCommission. On exercising such an option by the pensioner, the .revised Table ofCommutation Value for Pension will be used for the commutation of the additionalamount of pension that has become commutable on account of retrospective revisionof pay/pension. In all cases where tile date of rettrernent/cornrnutation of pension is011 or after the date of issue of thls OM, the revised Table of Commutation Value forPension will be used for commutation of entire pension.
9.4 Provisions of CCS (Commutation of Pension) Rules, 1981 shall stand modified inaccordance with para 9.2 and 9.3 above.

E;X GRATIA LUMPSUM COMPENSATION
11. In terms of Department of Pension f,- PW O.M.No.45/S5/97-P&PW(C) dated 11.9.199S,an ex gratia lump sum compensation is available to the families of CentralGovernment Civilian employees, who die in the performance of their bone fide officialduties under various circumstances. The amount of this ex-gratia lump slimcompensation shalt be revised as under:
(a) Death occurring due to acckJents in the course Rs. 10.00 lakhof performance of duties
(b) Death occurring in the course of performance Rs. 10.00 lakhof duties attributable to acts of violence byterrorists, anti-social elements, etc.
(c) Death occurring (a) enemy action in Rs. 15.00 laokhInternational war or border skirmishes and (b)action against militants, terrorists, extremistsetc.
(e1) Death occurring while on duty in the specified Rs. 15.00 lakhhigh altitude, inaccessible border posts, etc onaccount of natural disasters, extreme weatherconditions.
The Department of Pension & PW O.M.No.45/55/97-P&PW(C) dated 11.9.1998 shallstand modified to this extent.
12 For the purpose of computing average emoluments in the case of Governmentservants who have opted for fixation of pay in the revised Pay Structure and retirewithin 10 manths from the date of coming over to the revised Pay Structure, basic payfar 10 months period preceding retirement shall be calculated by ta,king inta accountpay as follows:
(i) For the period during which pay is drawn in revised Pay Structure- Pay drawnin the prescribed pay band plus the applicable grade pay
(ii) For the remaining period during which pay is drawn in pre-revised scale ofpay-Basic pay plus dearness pay and actual D.A. appropriate to the basic payat the rates in force on 1.1.2006 drawn during tile relevant perrod.
SPECIAL PROVISION FOR THOSE WHO RETAIN THE PRE-REVISED SCALE OF PAY.

(v) Family pension shall be allowed in accordance with orders applicable prior to the Issueof these orders and shall be calculated with reference to basic pay in the pre-revisedscale. To the family pension so calculated dearness relief upto average AICPI ')36(Base year 1982= 100) at .the rate contained in this Department's Office r-temorandumNo. 42/2/2006-P&PW(G) dated S.4.2006 shall be added. The amount so arrived at willbe regarded as the tarnifv pension for regulating payment of dearness relief heyonciaverage AICPI 536.
14. Formal amendments to CCS (Pension) Rules, 1972, CCS (Extraordinary) Pension Rules,1939 and CCS (Commutation of Pension) Rules, 1981 in terms of the decisionscontained in this order will issue in clue course. Provisions of the CCS (Pension) Rules1972, CCS (Extraordinary) Pension Rules, 1939, and CCS(Comrnutation of PenSIOn)Rules, 1981 which are not specifically modified by these orders, will rernain unaffected.
15. The pension/family pension in terms of these orders will qualify for dearness reliefbeyond average AICPI 536 under the revised pattern being i1ltroduced on therecommendations of the Sixth Central Pay Commission.
16. These orders issue with approval of the Ministry of finance Department of Expenditurevide their U.O. No4871/SE/2008 dated 2.9.2008.
17. In their application to the employees of the Indian Audit anel Accounts Department, theseorders issue in consultation with Comptroller and Auditor General of India.
18. Ministry of Agriculture etc. are requested to bring the contents of these orders to thenotice of Controllerof Accounts/Pay and Accounts Officers and Attached and SubordinateOffices under them on a top priority basis,

Consequent upon the acceptance of the Report of the Sixth Central PayCommission by the Government, the President is pleased to decide the followingregarding Deputation (Duty) Allowance:-
(a) Deputation (Duty) Allowance will continued to be paid in case of
appointments made in public interest outside the normal field ofdeployment
(b) In case of deputation within the same station the allowance will be paidat the rate of 5%of basic pay subject to a maxirnum of Rs.2000 p.m; and
(c) In other cases, Deputation (Duty) Allowance will be payable at the rate of10% of basic pay subject to a maximum of Rs.4000 p.m.
'Basic pay' in the revised pay structure means the pay dawn in the prescribed payband plus the applicable grade pay but does not include any other type of pay likespecial pay, etc.
2. Insofar as persons serving in the Indian Audit & Accounts Department areconcerned, these orders issue after consultation with the Comptroller & Auditor
General of India.
3. These orders shall take effect from lSI September, 2008.

Consequent upon the decision taken by the Government on therecommendations made by the Sixth Central Pay Commission forproviding extra benefits to women employees with disabilities especiallywhen they have young children and children with disability, the Presidentis pleased to issue the following instructions:-
(i) Women with disabilities shall be paid Rs.IOOO/-per month asSpecial Allowance for Child care. The allowance shall bepayable from the time of the child's birth till the child is twoyears old.
(ii) It shall be payable for a maximum of two children.(iii) Disability means a person having a minimum Disability of
40~/o as elaborated in Ministry of Welfare's NotificationNo.16-18/97-NI.I dated 1.6.2001. (Annexure)
(iv) The above limit would be automatically raised by 25% everytime the Dearness Allowance on the revised pay structure goesup by 50%.
2.. Reimbursement of Education Allowance for disabled children ofGovernment employees shall be payable at double the normal ratesprescribed. The annual ceiling fixed for reimbursement of ChildrenEducation Allowance for disabled children of Government Employees isRs. 24000. The rest of the conditions will be the same as stipulated videOM No.l2011/03/2008-Estt. (Allowance) dated 2nd September, 2008 onthe subject.

No. 16-18/97-NI.I In order to review the guidelines forevaluation of various disabilities and procedure for certification asgiven in the Ministry of Welfare's O.M.No.4-2/83-HW.III, dated the6th August, 1986 and to recommend appropriatemodifications/ alterations keeping in view the Persons withDisabilities (Equal Opportunities, Protection of Rights and FullParticipation) Act, 1995, Govemment of India in Ministry of SocialJustice and Empowerment, vide Order No. 16-18/97-Nl.I, datcd28.8.98, set up four committees under the Chairmanship ofDirector General of Health Services-one each in the area of mentalretardation, Locomotor/Orthopaedic disability, Visual disabilityand Speech & Hearing disability. Subsequently, anotherCommittee was also constituted on 21.7.1999 for evaluation,assessment of multiple disabilities and categorization and extent ofdisability and procedure for certification.
2. After having considered the reports of these committees theundersigned is directed to convey the approval of the President tonotify the guidelines for evaluation of following disabilities andprocedure for certification:-

The minimum degree of disability should be 40l% in order to beeligible for any concessions/benefits.
4. According to the Persons with Disabilities (Equal Opportunities,Protection oCRights and Full Participation) Rules, 1996 notified bythe Central Government in exercise of the powers conferred by sub-section (1) and (2) of section 73 of the Persons with Disabilities(Equal Opportunities, Protection of Rights and Full Participation)Act, 1995 (1of 1996), authorities to give disability Certificate willbe a Medical Board duly constituted by the Central and the StateGovernment. The State govemment may constitute a Medical Boardconsisting of at least three members out of which at leasi one shallbe a specialist in the particular field for assessing locomotor jVisualincluding low vision/hearing and speech disability, rnentalretardation and leprosy cured, as the case may be.
S. Specified test as indicated in Annexure * should be conductedby the medical board and recorded before a certificate is given.
6. The certificate would be valid for a period of five years for thosewhose disability is temporary and are below the age 18 years. Forthose who acquire permanent disability, the validity can be shownas 'Permanent'.
7. The State Govts.jUT Adrnn. may constitute the medical boardsindicated in para 4 above immediately, if not done so far.
8. The Director General of Health Services, Ministry of Health andFamily Welfare will be the final authority, should there arise anycontroversy / doubt regarding the interpretation of the'definitions/ classificationsj evaJuations tests etc.

No.622(E) dated 29th August, 2008 and to statethat clarifications are being sought regarding the date of next increment, the methodof fixation of pay on promotion after 01.01.2006,use of fitment tables for cases of payfixation under Rule 11 of CCS (RP) Rules, 2008, fixation of pay of governmentservants who were on deputation on 1.1.06 and got promoted in the cadresubsequently while still on deputation, etc.
2. In this connection, the following clarifications are issued:-
Clarification I: The date of next increment
(i) As per Rule 10 of CCS (RP) Rules, 2008 there will be one uniform date ofannual increment, viz. 1st July of every year. Government servantscompleting 6 months and above in the revised pay structure as on 1st ofJuly will be eligible to be granted the increment. Accordingly, allGovernment servants who earned their last increment between 02.01.2005and 01.01.2006would get their next increment on 01.07.2006.
(ii) For those employees whose date of next increment falls on 01.01.2006,theinstructions already provide for granting an increment in the pre-revisedpay scale as on 01.01.2006 and then fixing their pay in the revised payscales. Such Government servants would also get their next increment on01.07.2006.
Clarification 2: The method of fixation of pay on promotion after 01.01.2006
On promotion from one grade to another/ financial upgradation underACP, a Government servant has an option under FR 22(1)(a)(1)to get hispay fixed in the higher post either from the date of Ius promotion, or fromdate of his next increment, viz. 1st July of the year. The pay will be fixed inthe following manner in the revised pay structure:-

a) In case the Gcvernm('nt servant opts to get his pay fixed frorn :lisdate of next increment, then, on the date of promotion, F'3Y in th,'pay band shall continue unchanged. but the grade pay of the higherpost will be granted. Further re-fixation will be done on the datehis next increment i.e. 1st July. (\.1 that day, he will be granted twoincrements; one aruma! increment and the second on account orpromotion. \Vhile computing these two increments, basic poy priorto the date of promotion shall be taken into account. To illustrate, ifthe basic pay pri or to the date of promotion was Rs.lOO, firstincrement would be computed on Rs.I00 and the second on Rs.I0:.
b) In case the Government servant cpts to get his pay fixed in thehigher grade from the date of his promotion, he shall get his firstincrement in the higher gmde on the next 1st July if ),.2 waspromoted between 2nd July and 1st January. However, if he waspromoted between 2nd January and 30th June of a particular year, heshall get his increment 011 1st July of next ye8r.
Clarification 3: Use of fitment tables for cases of pay fixation under Rule 11 ofCCS (RP) Rules, 2008
Rule 11 of CCS (Revised Pay) Rules, 2008 provides for fixation of pay in therevised pay structure subsequent to the 1st day of January, 2006. Vv'henthepay of a Government servant will be fixed as per Rule 11 on a datesubsequent to 01.01.2006, the fitment tables annexed with thisDepartment's 9.lv1. of even number dated 30.08.2008 will be used asprescribed in the relevant provisions contained in para 2 of the O.M. Thepre-revised pay to be reckoned in slfch cases will be the pay of theGovernment servant on the day of such fixation.
Clarification 4: Fixation of pay of government servants who were on deputationand got promoted in the cadre subsequently while still 011
deputation
(i) In case the Government servant was on deputation on 1.1.06 and gotpromoted to a higher post in his cadre after 1.1.06, but was not grantedproforma promotion under the 'Next Below Rule', his pay will get fixedw.e.f. 1.1.06in the grade which he was holding on 1.1;06.
(ii) In case the Government servant had been granted proforma promotionunder the 'Next Below Rule', his pay will be fixed using the provisions ofthe 'Next Below Rule' as explained in (iii) below.

(iii) In the revised pay structure, the pay of a goverru11entservant would beregulated in the following manner on grant of proforma promotion to himunder 'Next Below Rule':
(a) In case a Government servant on deputation to a post getspromoted in his cadre to a post in a higher grade, his pay in the payband will be fixed with reference to the pay in the pay band of theemployee immediately junior to him in the cadre of his service.However, the government servant in question would continue todraw the grade pay attached to the deputation post for theremaining duration of the deputation.
(b) In case a Government servant on deputation to a post in PB-4 getspromoted in his cadre to a post in HAG+, his basic pay will befixed with reference to the basic pay of the employee immediatelyjunior to him in the cadre of his service, but the total of pay in thepay band and grade pay of the deputation post will not exceedRs.79,OOO.
(c) In case a Government servant on deputation to a post in PB-4 getspromoted in his cadre to a post in the apex scale, his basic pay willbe fixed with reference to the basic pay of the employeeimmediately junior to him in the cadre of his service, but the totalof pay in the pay band and grade pay of the deputation post willnot exceed Rs.79,OOO.
(d) In case a Government servant on deputation to a post in HAG+gets promoted in his cadre to a post in the apex scale, his basic paywill be fixed with reference to the basic pay of the employeeimmediately junior to him in the cadre of his service.
Clarification 5: Fixation of pay of government servants who go on deputation to alower post
(i) In case a Government servant goes on deputation to a post carrying alower grade pay, his pay in the pay band would continue unchanged, buthe will be granted the grade pay of the lower post for the entire durationof the deputation.
(ii) In case a Government servant in HAG+ scale goes on deputation to alower post in PB-4, his basic pay in the deputation post will be fixed at astage equal to his basic pay in the cadre of his service, but the total of payin the pay band and grade pay of the deputation post will not exceedRs.79,OOO.

(iii) In case a Government servant in the apex scale goes on deputation to alower post in PB-4, his pay in the pay band will be Sj)<C',j at he maximumof PBA (Rs.67000) and he will be granted the grad.e pay attached to thedeputation post, but the total of pay in the pay band and gTi"hi'~ pay of thedeputation post will not exceed 1\:5.79,000.In case deputation is from theapex scale to a post in HAC+, the basic pay will be protected in rfAG+.
Clarification 6: Procedure for placing employees in upgraded scales in case ofmerger of scalesjupgradations recommended by the Sixth CPC.
(i) Where all posts in one or more pre-revised scales are merged with ahigher pre-revised scale and given a common replacement scale/ gradepay, the suitability of the incumbents need not to be assessed forgranting them the higher replacement scale/grade pay and theincumbents will automatically be granted the replacement payscale/ grade pay recommended by the Commission. Their pay wiil befixed in the accordance with the fitment table annexed to thisDepartment's O.M. of even number dated 30.08.200S.
(ii) Similarly, in the case of upgradations recommended by the PayCommission, i.e. where all posts in a particular grade have beengranted a higher replacement pay scale/grade pay, the suitability ofthe incumbents need not ·be assessed for granting them the higherreplacement scale/grade pay. The incumbents will automatically begranted the replacement pay scale/grade pay reconunended by theCommission. Their pay in the pay band will be fixed with reference totheir fitment table corresponding to pre-revised pay scale. However,the grade pay corresponding to the upgraded post will be granted.
Note: CCS (Revised Pay) Rules, 2008 define the term "basic pay" in the revised paystructure as the pay drawn in the prescribed pay band plus the applicablegrade pay but does not include any other type of pay like special pay, etc. Inthe case of Government servants in the pay scales of HAG+ and above, basicpay means the pay in the prescribed scale.

Consequent upon the implementation of the revised pay structureby the Government with effect from 1st January, 2006 on tile basis ofrecommendations of the Sixth Central Pay Commission and in partialmodification of this Ministry's O.M. No.6(39)/98-IC.11 dated 6th July. 1999,the President is pleased to sanction the revised Family PlanningAllowance at double the existing amount of the Family PlanningAllowance, subject to a minimum of RS.2101- per month as indicated inColumn 7 of Annexure to this Office Memorandum.
2. The allowance will be related to the Grade Pay corresponding tothe post against which the employee concerned had initially earned or willearn the Family Planning Allowance. All other terms and conditionsgoverning the grant of Family Planning Allowance shall remainunchanged.
3. These orders will be effective from 1st September, 2008.
4. In so far as persons serving in the Indian Audit and AccountsDepartment are concerned, these orders issue after consultation with theComptroller and Auditor General of India.

OFFICE MEMORANDUM
Subject: Applicability of CCS (RP) Rules, 2008 to persons re-employed in
Government Service after retirement and whose pay is debitable to Civil
Estimates.
Persons re-employed in Government service after retirement have been
excluded from the purview of the Central Civil Services [Revised Pay) Rules, 2008 vide
Rule 2 (2)(vii) thereof. The question of extension of the benefit of the revised pay rules
to these persons and the procedure to be followed for fixing their pay in the revised
scales has been considered by the Government. The President is pleased to decide that,
in partial modification of the Rule 2 (2)(vii) of the Central Civil Services (Revised Pay)
Rules, 2008, the provisions of these rules shall apply to such persons also who were in
re-employment on I" January, 2006, subject to the orders hereinafter contained. This
decision will cover all Government servants re-employed in Central Civil Departments
other than those employed on contract whether they have retired with or without a
pension and/or gratuity or any other retirement benefits, e.g. contributory fund etc.
from a civil post or from the Armed Forces.
2(1). The initial pay of a re-employed Government servant who elects or is
deemed to have elected to be governed by the revised pay scale from the i" day of
January, 2006 shall be fixed in the following manner namely -
According to the provisions of Rule 7 of the c.C.S. (R.P.) Rules, 2008, if he is-
(i) a Government servant who retired without receiving a pension, gratuity or
any other retirement benefit and
(ii) a retired Government servant who received pension or any other retirement
benefits but which were ignored while fixing pay on re-employment."
L (II). The initial pay of a re-employed Government servant who retired with a
pension or any other retirement benefit and whose pay on re-employment was fixed
with reference to these benefits or ignoring a part thereof, and who elects or is deemed
to have elected to be governed by the revised scales from the 1st day of January, 2006
shall be fixed in accordance with the provisions contained in Rule 7 of t he Central Civil
Services (Revised Pay) Rules, 2008. In addition to the pay so fixed, the re-employed
Government servant would continue to draw the retirement benefits he was permitted
to draw in the pre-revised scales, as modified based on the recommendations of the
Sixth Central Pay Commission, orders in respect of which have been issued separately by.the Department of Pension & Pensioners Welfare. However, an amount equivalent to
the revised pension (excluding the ignorable portion of pension, wherever permissible),
effective from 1.1.2006 or after, shall be deducted from his pay in accordance with the
general policy of the Government on fixation of pay of re-employed pensioners. Annual
increments will be allowed in the manner laid down in Rule 10 of Central Civil Services
(Revised Pay) Rules, 2008, on the entire amount of pay as if pension had not been
deducted.
3. Re-employed persons who become eligible to elect revised scales in
accordance with these orders should exercise their option in the manner laid down in
Rule 6 of the Central Civil Services (Revised Pay) Rules, 2008, within three months of the
date of issue of these orders or in cases where the existing scales of pay of the posts
held by them are revised subsequent to the issue of these orders, within three months
of the date of orders/notification revising the scales.
4. Where a re-employed Government servant elects to draw his pay in the
existing scale and is brought over to revised scale from a date later than the i" day of
January, 2006, his pay from the later date in the revised scale shall be fixed in
accordance with the provisions of Rule 11 of the Central Civil Services (Revised Pay)
Rules, 2008.
5. Further, the existing ceiling of Rs. 26000/- for drawal of pay plus gross
pension on re-employment is enhanced to Rs.80,000/-, the maximum s(llcuy pavable to
the Secretary to the Government of India under Cerur al Civil Services (Revised Pay)
Rules, 2008.
6. The President is also pleased to enhance the ignorable part of pension
from Ks. 1500/- to Rs. 40001- (Rupees four thousand) in the case of Corrunissioned
Service officers and civil officers holding Group 'A' posts who retire before attaining the
age of 55 years. The existing limits of civil and military pensions to be ignored in fixing
the pay of re-employed pensioners will, therefore, cease to be applicable to cases of
such pensioners as are re-employed on or after 1.1.2006. In the case of persons who are
already on re-employment, the pay may be fixed on the basis of these orders with effect
from 1.1.2006, provided they opt to come under these orders. If they so opt, their terms
would be determined afresh as jf they have been re-employed for the first time from
1.1.2006. The option should be exercised in writing within three months from the date
of issue of these orders. The option once exercised is final.
7. In so far as the persons serving in the Indian Audit & Accounts
Department are concerned, these orders are being issued after consultation with the
