Locality Plan
The site has frontage to Mary Street, Royston Street, and Eckel Court. Vehicular access willbe Royston Street and Eckel Court. The site proposes to include a on-street car parking onEckel Court, car parking reconfiguration, footpaths, and drainage to the existing stormwaterdrainage system.
COMMENTSThe application is code assessable and the plans have been checked and are in compliancewith the codes and standard drawings of Council's developmentmanual, except wherereferenced in the outlined conditions.
DELEGATION OF AUTHORITYThe Chief Executive Officer has the power to act as the "Assessment Manager" in respect ofdecisions required to be made by Council for all DevelopmentApplications received by Councilunder Chapter 6 of the SustainablePlanning Act 2009.
RECOMMENDEDDECISIONThat Council approve the Development Application for Operational Works associated withearthworks, roadworks, and stormwater drainage for shopping centre on land described asLot 9 on SP178872 and situated at 42 Mary Street, Kilcoy subject to the conditions containedin the Schedules and Attachments.

CONDITIONS OF APPROVALSCHEDULE 1
GENERAL CONDITIONS
1. Carry out the development in accordance with the material contained in thedevelopmentapplication, supporting documentation,Somerset Regional CouncilDesign Standards, and the approved plan(s), except where amended by theseconditions of approval.
2. This approval extends to engineering works including earthworks, sediment anderosion control, roadworks, stormwater drainage and other works as detailed onapproveddrawings and is conditional upon:
2.1 The Applicant is responsible to obtain written consent of the propertyowner/s affected by any works of this approval or where infrastructure is tobe constructedon private property not under the ownership of the applicant(including sewerage, water and stormwater). Proof of owner/s consent isto be provided prior to the relevant pre-start meeting to commenceconstruction works.
2.2 Provide secure bicycle parking for a minimum of four (4) bicycles in
accordancewith AS2890 on Lot 11 on SP188011 and Lot 9 on SP1788722.3 Subsoil drainage as per Council Standard Drawing SRC-ROAD-020and
021 is to be included for parking areas along Eckel Court.2.4 Car Parking sizes / line marking along Eckel Court to be in general
accordancewith AS2890.2.4.4 figure 2.52.5 The Applicant is responsible for obtaining all necessary approvals and
permits required from any external agencies in satisfying the conditions ofapproval. The cost of obtaining these approvals and permits are at theApplicant'sexpense.
3. Certification must be given to Council by a Registered Professional Engineer in
Queensland(RPEQ) that the works have been undertaken in accordancewith theapproved plans and specificationsand to Council's requirements.
4. A legible copy of the Approved Drawings and Conditions of approval is to be
available on site at all times during construction.
5. This approval does not extend to the following;5.1 Provision of electrical networks, or street lighting5.2 Telecommunicationsfacilities5.3 Water Supply and Sewerage infrastructure5.4 Landscaping
6. Prior to works commencing, it is required that a pre-start meeting be attended byCouncil's officers, the supervisingengineerand the Contractor. At that meeting, it
will be necessary for the supervisingengineerto provide Councilwith the following:
6.1 A works program6.2 Inspection and test plan6.3 Public liability certificate of currency (projectspecific)6.4 WorkplaceHealth and Safety plan6.5 Traffic Management Plan
7. Compulsory inspections and meetings shall be undertaken by Council, with a
minimum of two clear working days notice required to be given to Council for aninspection of sections of the work at the following stages:
7.1 Pre-start meeting with Council, Contractor, and supervising engineer.7.2 Of the finished pavement surface prior to concrete surfacing.7.3 At the point of completion of all works.7.4 Other inspections as deemed necessary by Council.
8. Works covered prior to inspection, where inspections are required, shall beuncovered at the contractor's expense to allow inspection by Council at Council'ssole discretion.
9. Reinspection/Retestfees based on the fees and charges current at the time mustbe paid to Council, if applicable.
10. Where the progression of work leads to substantiatedcomplaints, the Applicantshall immediately rectify works and undertakeany directions from Council Officersto rectify any works.
11. From time to time, Council and/or their representatives may enter the work site to
which this approval relates and undertake any testing or analysis of any part of theconstruction, and Council is not liable for the rectification or any compensationforany damage caused in the testing or analysis process. Should work be found to be
not constructed to specification or of poor quality, any reasonable instruction givenby Council Officers shall be considered to be a condition of approval andundertaken by the principal contractor.
12. Where complete or incomplete works under this approval adversely affectadjoiningproperties, Council land, roads or other infrastructure, the Council may require bynotice, works to be completed. Where Council deems it necessary to undertakeworks for the safety or health of the communityor protection of infrastructure, costsassociated with such works shall be recoverable from the applicant.
13. Any damage which is incurred to services, signs, footpaths, roadways, kerb andchannel, or other work abutting the subject land as a result of the proposeddevelopment shall be repaired immediatelyshould hazards exist for pedestrian orvehicular safety. Otherwise, all damage shall be repaired immediately uponcompletion of works associated with the developmentat the Applicants expense.
14. Unless otherwise approved in writing by the Manager Planning and Development,hours of constructionshall be:
Monday to Saturday - 6.30 a.m. to 6.30 p.m. - Noise permittedSunday and Public Holidays - No audible noise permitted
Work or business which causes audible noise shall not be conducted from or onthe site outside the above hours.
15. It is the applicant's responsibility to appoint the principal contractors, completeforms, notify Workplace, Health and Safety, pay fees and carry out any otherWorkplace, Health and Safety legislative requirements, and submit evidence ofcompliance to Council.
16. All wastes to be managed in accordance with the relevant legislation andregulations with regulated waste to be disposed of at a licensed facility by alicensed regulated waste disposal contractor and general solid waste to bedisposed of at Council approved landfill sites with the contractor covering all costsreasonably incurred for the receipt and management of the waste.
EARTHWORKS
17. Earthworks and fill on the subject land shall not lead to ponding of water oractionable nuisance and shall ensure all lots, both internal and adjoining, drainfreely to a lawful point of discharge.
18. Contaminatedmaterial must not be used as fill on the site. Any filling must be
undertaken using inert materials only.
19. Waste material as a result of demolitionworks and excavation works must not be
used as fili where the material includes the following as defined within theEnvironmentalProtection Regulation:
All waste materialabove as defined within the Environmenta/Protection Regulationmust only be disposed at a waste facility approved for the receipt of waste.
20. Where vegetation is removed, the vegetation waste shall be disposed of by:
20.1 Milling.20.2 Chipping and/or mulching20.3 Disposal at an approved waste disposal facility.
No incineration of vegetation or waste will be permitted at the site. Waste otherthan vegetation waste, generated as a result of the operational works shall bedisposed of to an approved disposal facility via an approved waste receptacleand/or collection service.
GENERAL SERVICES
21. All works requiredfor this developmentmust take due regard of any and all existingservices and, if considered necessaryby the relevant authority, such works mustbe altered at the cost of the Applicant.
TRAFFIC CONTROL
22. Temporary signage and traffic control for construction on or near road reservesshall be provided in accordancewith Part 3 (workson roads)of Manual of UniformTraffic Control Devices (MUTCD)- Departmentof Main Roads.
23. Any Road or lane closure must be applied for in writing to Council, and allconditions of that approval complied with during construction of the works.
EROSiON CONTROL
24. Erosion and sedimentation controls shall be implemented, as necessary, and shallbe maintained to Council's satisfactionat all times during the course of the projectand the ensuing defects liability period. Should proposed controls prove to beineffective, Council will require the developerto install additional measures.
25. No construction works may commenceon subjectsites until appropriateSedimentand Erosion Controls have been implemented.
26. All unpavedareas whereearthworkshave been undertakenare to be grass seededto achieve good grass cover.
27. Measuresshall be applied to Council's satisfaction to preventsite vehicles trackingsediment and other pollutants onto adjoining streets during the course of theproject,and to prevent dust nuisance during construction and the ensuring defectsliability period.
28. Stockpiles of topsoil, sand, aggregate, spoil or other material capable of beingmoved by the action of running water shall be stored clear of drainage paths andprevented from entering the road and/ordrainagesystem.
29. Should it be necessary for the road and/or drainage system to be reinstated orcleaned up due to erosion, debris and/or sedimentfrom the site, then such worksshall be at the developer's expense. Such works shall be undertaken immediatelywhere there is a potential hazard to pedestrians and/or passing traffic.
30. The site shall be maintained in a clean orderly state at all times.
COMPLETIONOF WORKS
31. It should be noted that, in approving plans for this project,Council has carried outan audit check of information submitted. Accordingly,Council has placed relianceon the certificate of design that the approved plans are correct and in accordancewith required engineering standards.
ADVICES
1. Biosecurity Queensland should be notified on 13 25 23 of proposeddevelopment(s) occurring in the Fire Ant Restricted Area before earthworkscommence. It should be noted that works involving movements of soil associatedwith earthworks may be subject to movement controls and failure to obtainnecessary approvals from BiosecurityQueenslandis an offence.
It is a legal obligation to report any sighting or suspicion of fire ants within 24 hoursto Biosecurity Queensland on 13 25 23.

2. The Aboriginal Cultural HeritageAct 2003 commenced in Queensland on April 16,2004. The Act is administered by the Department of Environment & ResourceManagement (DERM).
The Aboriginal Cultural Heritage Act 2003 establishes a Duty of Care forIndigenousCultural Heritage. This applies on all land and water, including freeholdland. The Cultural Heritage Duty of Care lies with the person or entity conductingan activity.
Penalty proposing an activity that involves additional surface disturbance beyondthat which has already occurred at the proposed site need to be mindful of theCultural Heritage Duty of Care requirement.
Details on how to fulfil the Cultural Heritage Duty of Care are outlined in the Dutyof Care Guidelines gazetted with the Act.
Council strongly advises that you contact DERM's Cultural Heritage CoordinationUnit to obtain a copy of the Duty of care Guidelines and further information on theresponsibilitiesof proponents under the terms of the Aboriginal Cultural HeritageAct 2003
3. The AustralianGovernment recently declared koala populations in Queensland asa vulnerable species under the Environment Protection and BiodiversityConservation Act 1999 (Cth). Accordingly, where development may facilitate anaction that is likely to have a significantimpact on the koala the applicant is requiredto refer that development proposal to the Federal Environment Minister. Asignificant impact includesthe removal of two or more koala food trees or any otheractivity that may impact on local koalas.
