Q: “If I sell my home, what happens if settlement is delayed through no fault of my own?” - Jo Veldmeyer.
A: You have a number of options open to you for example you might agree to grant an extension of time and you may impose conditions upon the grant of the extension such as payment of de-fault interest or to cover any of your additional costs. You can also terminate the contract provided that you your self are ready willing and able to settle. To terminate you must first tender or turn up at settlement and prove that everything is in place from your side of things to settle. Once you have terminated you can sue the defaulting purchaser for damages. As there are a number of things to organise to get a matter to settle it is not uncommon for small extensions to be granted.
