a) 7he pravisEons af fhis sectian shall prevail and be given precedence over any requirements of this subpart which arecantrary to this sectivn. However, nothing in this section shall be construed to 6 contrary to the requirements of § 635.4D9( a) of fhis subpart.
b} No Federak- aid highway construction project is to be authorized for advertisement or otherwise authori ed to proceedunless at least one of the following requirements is met:
1} The project either. (i) Includes no permanently incorporated steel or iron materials, or.( ii) if steel or iron ma#erials are tobe used, all manufacturing processes, including application of a coating, far these materials musi occur in the Urtited States. Coating inc] udes all processes which protect ar enhance the alue of the material to which the coating is applied.
2) The State has standard contract provisions thaf require the use of dorrtesfic materials and products, including steel andiran materials, to the same or greater exfent as the provisions set forth in this section.
3) The Siate efecfs to include alternafe bid provisions for foreign and domestic steel and iron materials which comply witf the foliowing requiremenis. Any procedure for obtaining alterrtate bids based on furnishing foreign steel and iran materialswhiah is accepta6le to the i ision Administ ator may be used. The contract provisions must ( i) require all hidders to su6mita bici based vn furnishing domestic steel and iron materiais, and ( ii) clearly state that the contract will be awarded to thebidder who subrr its the lovvest total bid based on furnishing domestic steel and iron materials unless such total bid exceedsthe fowest tatal 6id based on furnishing foreign steel and iron materiais by more than 25 percent.

3) Requests for waivars may be made for specifio projects, or for certain maferials or products in specific g: ographic areas, or far combinations of both, depending on the circumstances,

2) Where the State transpartation department has developed and implemented one or more
of the cdntract clauses inclucEed in paragraph ( a) of this secfiion, such clause or clauses, as
de eloped by the State transporCation department may he included in Federal- aid highwaycontracts in lieu ofthe eorresponding clause or clauses in paragraph ( a) of this section. The
State' s action must e pursuant to a specific State statute requiring differing contractconditians clauses. Such State developed. clause or clat ses, howe er, must be in
confiormance with 23 U. S. C., 23 CFR and other applicable Federal statutes and regulatians as
appropriate and shall be subject to the Di ision Administrator' s appro al as part of the

It is anticipated that rrugratory birds, a protected group of species, may try to nest on bridges, culverts, vegetation, or gravel substrate, at any time of the year. The preferred nesting season formig ratory birds is from Februazy 1S through ciobex 1. V henpxactacable, schedule construction
operaiions outside n fhe preferred nesting season. Oiherwise, avoid nests containing migratoiybirds and perform no work in the nesting areas until ihe young irds have fledged.

nesting can be performed by ane o' the folla ring methods:
1. By February 1 S begin the removal af any existing mud nests and all other rnud placed byswallows for the construction of nests on any ortion of the bridge and culverts. The Engineerwill inspect the bridges and culverts for nest b zilding activity. If swallows begin nest building, scrape ar v,ash down alI nest sites. Perform these acti vities daily unless the Engineer deterrninestlie need to do this work rnore frequently. Remove nests and mud thraugh October 1 ar untilbridge and culvert construction o erai ons are completed.
2. By February 15 place a. nesting deterrent ( which prevents access to he bridge and culvert b swailows) on the en ire b zdge ( except deck anc railing) and culverts.
No e tension of time or compensation payment will be gra t d for a delay or suspensian of worl caused by nesting swallows. Tlus work is subsidiary to the variaus bid iterns.

Collection of retroreflectivity readin s using a mobile retroreflectometer is the preferred methad.
