• Suppose you are live streaming a public event in connection with your product or service– What is going on in the background? Live music,
audio/video broadcast, trademarks?– Who is appearing in the video? Have they
consented to appear?– What about getting releases? And how?

Some possibilities
• First Amendment-based right to photograph and record in public– Essential for newsgathering, democracy
• Individual rights to protect property, reputation, right of publicity– In areas with “reasonable expectation of privacy”
• Privacy-based right of “practical obscurity”– protecting data, online information, “right to be
forgotten”
