RESUBMISSION AGENDA CAC Item No. 01

Name of the Industry: M/s. Hindalco Industries Limited (Expansion Project), Sr. No.95/1, 95/2, Village Daheli, Tal: Mouda,

Dist: Nagpur. Applied for Consent to Establish for Expansion.

1. Discussed in CAC dated 24.09.2012 and it was decided to review the assessment of pollution load proforma submitted by Industry thorough IIT, Mumbai regarding Certification on “No increase in pollution load” due to expansion.

2. The communication received from the unit on 29.11.2012 submitted that IIT Mumbai does not validate the pollution load increase and will take much time. The unit has requested for grant of consent to Establish based on commitment given by the industry and ready to undertake / implement any additional condition imposed by MPCB prior to commission of new equipment on the basis of IIT Mumbai at latter stage.

3. The case was again discussed in CAC dated 24.12.2012 and decided to keep the case in abeyance till self assessment report of industry for no increase in pollution load is received.

4. The was again discussed in CAC dated 5.3.2013 and it was decided to keep the case in abeyance and resubmit in next CAC after obtaining opinion from Shri Rakesh Kumar, NEERI regarding no increase in pollution load.

5. The proposal is examined by Dr. Rakesh Kumar, NEERI, Mumbai and informed that it is in line.

In view of above, we may put the modified proposal before CAC for further consideration on the grounds that there will not be any change in production quantity as per earlier granted one and decrease in water consumption.

Name of Industry:- M/s. JSW Jaigad Port Limited, Dhamankhol Bay, A/P:- Jaigad, Tal & Dist:- Ratnagiri The said case was discussed in CAC meeting haeld on 31/1/2012 & 14/2/2012. The

case was approved in CAC meeting of 31/1/2012 and was decided to grant the

consent to establish for Expansion. But the case was again discussed in CAC

meeting of 14/2/2012 as ther is applicability of Moratorium in Ratnagiri district and it

was decided to return the application as Board is unable to consider the case due to

moratorium. Now industry have resubmitted application alongwith the letter of MoEF

& Minutes of 122 Expert Appraisal committee, where in it is stated that this project is

considered as of National importance & is exempted from Moratoruim.

We may place the case before CAC for further discussions.

• Industrial effluent (cooling) is 4.87 for which ETP provided

• Domestic effluent is 50 CMD from which they have provided STP

• Ventury scrubber to core oven section and wind turbo ventilators provided to different section for control of air pollution

• RO Pune has recommended for grant of consent to operate

• The case was discussed in CAC dt. 19/03/2013 and it was decided to keep the case in abeyance and put up in next CAC with clarification regarding increase in Capital investment and details of Bank guarantee. Accordingly, industry has submitted the same.

• We may grant of consent to operate up to 31/01/2016 with operational BG of Rs. 5/- Lakhs

• We may place the consent application before CAC for further consideration.

• Application received at SRO- Satara on dtd 01/11/2011 and at HQ on 03/11/2012

• Existing unit consent was valid up to 30/09/2012 & applied for renewal of consent

• Industry located @ 1.3 KM away from A-II class River NIRA. Not satisfy the RRZ distance criteria.

• Industrial Effluent Generation is Nil (existing 65 CMD) for which effluent treatment plant provided.

• Domestic Effluent Generation is NIL (existing 65 CMD) for which sewage treatment plant provided

• JVS analysis result of ETP dated 24/01/2012, 31/03/2012 and 15/10/2011are under prescribed limit.

• Adequate height of stack provided to DG set & various stack of existing unit & no additional air pollution control system are required as there is no additional fuel requirement.

• RO Pune has recommended the case for grant Consent

• The case has been discussed in the Consent Appraisal Committee meeting held on 31/01/2013 and decided to issue SCN for refusal for the unit running without consent for last 3 years for the product. SRO Satara submitted the reply 04/04/2013

• We may issue plain renewal of consent & refuse the expansion due to RRZ issue

• We may place the consent application before CAC for further consideration.

3. MoEF, GoI vide letter F. No. 21-9/2011-IA.III dtd. 9/11/2011 has accorded Environmental Clearance for development of 1st phase of Hill Station Township on a plot area of 2,000 Hectares at village Mulshi and Velhe Talukas, Dist. Pune, Maharashtra by M/s Lavasa Corporation Ltd.

4. Applications of the Hotels (3 Nos.) were handled by A.S.(Tech.) Section; applications of Hot Mix Plant, RMC Plant and Bamboo Craft Works were handled by J.D. (APC) Section and that of Laundry was handled by R.O.(HQ) Section.

5. These files were routed to Legal wing for opinion about applicability of RRZ Policy / EC and kept pending due to action initiated by MoEF on M/s Lavasa Corpn., Court cases

and absence of guidelines. 6. Upon receipt of written request dtd. 27/12/2012 from Chief Planner, Lavasa Corp. Ltd.

Hon’ble Chairman & Member Secretary has instructed to expedite the disposal of pending applications.

7. Hon’ble Member Secretary discussed the issues of pendency with SLO, AS(T), JD(APC) & RO(HQ) on 28/02/13 and entrusted job of preparing guidelines for quick disposal of the applications with SLO.

8. SLO has prepared guidelines on 14/03/13 and forwarded to Member Secretary through RO(HQ)/JD(APC)/JD(WPC).

9. Hon’ble Member Secretary instructed AS(T) on 2/04/13 to prepare combined agenda of the pending 7 Nos. applications of M/s Lavasa Corporation Ltd., Phase-I Hill station project for placing these cases in the ensuing CAC meeting for taking further decision of grant of Consent to Operate to these units.

10. R.O.(Pune) has forwarded these cases for taking suitable decision as the matter is also pending at CJM, Pune and High Court, Mumbai.

11. It is felt that we may treat M/S Lawasa Corporation Ltd. as a township and the activities which are being operated under separate management can be given separate consent as we issued in the corporation areas, as per the delegation of power. The remaining activities can be covered under Lawasa Corporation and can be issued combine consent for the entire project. The policy decision in this regards may be taken in CAC.

12. As far as responsibility for omission or non compliances in respect of waste management will be jointly and several. Also as per the consent condition no. 12, the proponent is suppose to pay the consent fees every after two year based on the investment made. However they have failed to do so. Hence as per the present fee calculations, the proponent needs to pay the consent fee of Rs. 27,23,500/-.

13. The consent to operate issued earlier to M/s. Lawasa Corporation Ltd. needs to be amended as per the E.C. granted to them. Fresh Consent to Operate may be granted pto 30/04/2014 to parent Company M/s Lavasa Corporation Ltd. for development of the Phase-I of the Hill Station over 2,000 Ha area as per Environmental Clearance granted by MoEF, GoI vide letter F. No. 21-9/2011-IA.III dtd. 9/11/2011 with overriding effects over earlier Consent to Operate granted by the Board dtd. 5/01/2005 after recovering difference of the Consent fees of Rs. 27,23,500/- subject to condition of compliance of the EC conditions and submission of B.G. of Rs. 10.0 Lakhs towards compliance of Consent conditions / 0&M of pollution control facility. Consent to Operate may also be granted for 7 Nos. sub-units / industries in Phase-I of Lavasa upto 30/04/2014 after recovering difference of the Consent fees as per Chart enclosed.
