HOD Remarks :- • Applied for renewal of consent to operate

• Application received at SRO- Satara on dtd 29/09/2011 and at HQ on 13/02/2012.

• Previous consent was valid up to 30/11/2011

• Industrial effluent is NIL

• Domestic effluent generation is 20.0 CMD. For which sewage treatment plant

provided

• SRO –Satara reported that industry located an air pollution potential prone industry,

where there is lot of fugitive emissions observed at various stages/place of mfg right

from raw material , storage, loading/unloading & its feeding point to final product

• Industry has provided air pollution control system as an ESP to main exhaust &

Cooler/crusher unit and deducting units with bag filters at various place, however its

operation & maintenance is not satisfactory.

• SRO reported that lot of complaint received from Sarpanch Grampanchyat Golegaon

village, Panchayat Samiti Khandala & SDO Wai about the air pollution problem.

• RO Pune has recommended the case for grant of renewal of consent by imposing the condition given in interim direction.

• The case was discussed in the Consent Appraisal Committee meeting held on

20/03/2012 and the Consent Appraisal Committee has decided to issue SCN for

refusal of consent due to non-compliance of conditions stipulated in consent and

Environmental Clearance specifically regarding provision of secondary emission

control system. Also, the stack emission level highly exceed the norms. SCN issued

on 28/03/2012

• Industry replied the same on 02/04/2012

• We may grant the consent with condition that

1. To provide secondary emission control system within next 1 year with B.G. of Rs. 10 Lakhs

2. To provide adequate APC at all material handling units , junction box, strigent water sprinkling arrangement within next 4 months with B.G. of Rs. 5 Lakhs

3. To provide opacity meters to all the steps & CAAQM within next 4 months with B.G. of Rs. 2 Lakhs

4. To take B.G. of Rs.. 5 lakhs towards achievement of consented standards

• Applied for renewal of consent

• Application received at SRO- Satara on dtd 18/12/2011 and at HQ on 01/03/2012.

• Previous consent was valid up to 30/11/2011

• Industrial effluent is 34 CMD. For which ETP provided

• Domestic effluent generation is 0.76 CMD. For which sewage treatment plant provided

• industrial effluent generated form cooling blow down, D.M. plant regeneration is utilize for hot slag cooling at slag granulation pond.

• RO –Pune reported that industry located an air pollution potential prone industry, & lot of complaint received from Sarpanch Grampanchyat Golegaon village, Panchayat Samiti Khandala & SDO Wai about the air pollution problem.

• RO Pune has recommended the case for grant of renewal with amalgamation subject to submission of Rs. 25000/- towards increase in capital investment & commitments towards provision of air pollution control system at boiler stack

• The case was discussed in the Consent Appraisal Committee meeting held on 20/03/2012 and the Consent Appraisal Committee has decided to issue SCN for refusal of consent due to non-compliance of conditions stipulated in consent and Environmental Clearance specifically regarding provision of secondary emission control system. Also, the stack emission level highly exceed the norms. SCN issued on 28/03/2012

• Industry replied the same on 02/04/2012

• We may grant the consent & amalgamate with main plant consent

• We may place the consent application before CAC for further consideration.

• Previous consent was valid up to 31/03/2012

• Industry is generating 19 CMD effluents for which Industry has provided two no.ETP. up to secondary stage.

• Industry is generating 62.0 CMD of domestic effluent for which Industry has provided STP

• Industrial treated industrial effluent after secondary treatment is mixed with domestic effluent before filtration stage.

• Industry has provided necessary air pollution control system to D.G. Set and LPG fired furnace

• Industry not provided VOC control system to paint booth

• Regional officer of Pune has recommended for refusal of consent

• The case was discussed in the Consent Appraisal Committee meeting held on 20/03/2012 and the Consent Appraisal Committee has decided to issue SCN for refusal of consent for non-disposal of H.W. to CHWTSDF and not providing APC system to paint booth as per consent conditions. SCN issued on 28/03/2012

• Industry replied the same 02/04/2012

• We may grant the consent for period up to 31/03/2017 with condition that 1) Industry shall obtain the Membership of CHWTSDF Ranjangaon within 3 weeks with B.G. of Rs. 1 Lakhs. 2) Industry shall provide APC to paint Booth within next 4 months with B.G. of RS. 5 Lakhs

• We may place the consent application before CAC for further consideration.

HOD Remarks :- • Applied for renewal of consent

• Application received at SRO- Pune on dtd 10/02/2012 and at HQ on 03/03/2012

• Previous consent was valid up to 28/02/2012

• Industrial effluent increased from 1 CMD to 10 CMD which is due to washing of stocked car

• Domestic effluents increased from 70 CMD to 100 CMD which is due to increased in staff/workers

• JVS analysis result of Moef approved lab on dated 31/03/2011 is under prescribed limit

• Industry has not provided APC to paint booth

• RO Pune has recommended the case for grant of renewal of consent for period up to 28/02/2015 by extending personal hearing about above non compliances.

• The case was discussed in Consent Appraisal Committee held on 20/03/2012 & decided to issue SCN for refusal of consent as industry has not provided air pollution control system to the paint booth and H.W. quantities in Form -IV are not commensurate with the production quantities. SCN Issued on 28/03/2012.

• Industry replied the same on 02/04/2012

• We may grant the consent up to 28/02/2015 with condition that Unit shall provide adequate APC system to control VOC within next 4 months with B.G. of 5 Lakhs.

• We may place the consent application before CAC for further consideration.

HOD Remarks :-

• Applied for renewal of consent

• Application received at SRO- Pune on dtd 22/10/2011 and at HQ on 06/03/2012.

• Previous consent was valid up to 30/11/2011

• Generation of industrial effluent is 8 CMD. Industry has provided 30 CMD capacity ETP.

• Generation of industrial effluent is 28 CMD for which industry has provided 50 CMD STP

• JVS result of submitted on dated 31/05/2011 & 09/03/2011. In which shows that parameter BOD, COD & sulphate level is exceeding the prescribed limit.

• Industry has provided dust collector system to shot blasting machine

• RO Pune has reported that industry has installed over designed ETP & STP & not in operation as per recent visit report & need to be revamping.

• RO Pune recommended the case for grant of renewal of consent by extending personal hearing above mentioned non compliance.

•  The case was discussed in the Consent Appraisal Committee meeting held on 20/03/2012 and the Consent Appraisal Committee has decided to issue SCN for refusal of consent for over-designing of ETP/STP and non-operating the same and having inadequate land for disposal of treated effluent. SCN issued on 28/03/2012

• Industry replied the same on 02/04/2012

TPD and Iron Ore Benefication Plant. Both plant are located in same factory premises.

3. Regional Officer, Nagpur vide letter dated 24.01.2012 has recommended forfeiture of

bank guarantee of Rs.5 Lakhs due to following non-compliances;

i) Analysis results of stack monitoring are exceeding the standards.

ii) Industry has not provided secondary emission control system. During the visit of

Board officials, gaseous emission from the secondary process was emitted into

the environment from the shed of the factory.

4. I/c. SRO, Nagpur-II reported that Board official visited to the industry and observed

that they have erected two kilns and these kilns are ready for commissioning. Industry

proposed to use producer gas as a fuel in the kiln and they have provided falsifier for

the same. Bag filter followed by chimney is provided for air pollution control system.

5. Capital Investment of reduced briquette sponge iron plant of 200TPD is Rs.45 Crore.

Total capital invest of the industry is Rs.162.59 Crore. Industry has submitted consent

fee of Rs.70,000/-. However, additional consent fee of Rs.5,000/- required to be

submitted by industry for the consent period up to 31.01.2013 as per the revised

consent fee circular dated 25.08.2011.

6. Discussed in CAC dated 02.03.2012 and it was decided to issue SCN for refusal of

consent for non-compliance of consent conditions. Accordingly the Show Cause

Notice was issued vide letter No. BO/ MPCB/JD(APC)/NG-6113-11/SCN/TB-1/B-1602

dated 14.03.2012.

7. Industry submitted the reply of show cause notice stating that;

i) Work of installation of Secondary Emission Control System of existing SMS unit is in final stage of completion and will be completed before 05.04.2012.

ii) Ordered the CAAQMS and online Stack monitoring system will be installed within 4 months

balance water is discharged into nearby nalla after treatment in sedimentation tank.

ETP is provided for workshop effluent.

5. Analysis results of ambient air quality monitoring carried out between 21.1.2011 to

23.06.2011, shows parameter RSPM & SPM are exceeding the standards hence

mine authority needs to improve the O & M of existing pollution control system.

6. Earlier the case was discussed in CAC dated 2.3.2012 and it was decided to issue SCN for refusal of consent as industry is exceeding AAQM results and thereto non compliance of consent conditions.

7. Accordingly, Board had issued SCN vide letter dated 14.3.2012. 8. Industry has submitted the reply of SCN vide letter dated 3.4.2012.

3. Total Gross Block of Fixed Assets of entire industry has shown in Rs. 9,615,906,810.29 as per CA certificate. Submitted consent fee of Rs 57,69,644/- for three years as per new Consent Fee GR dated 25.8.2011.

4. Since Gross Block investment is increase from Rs 851.16 Crores to 961.59 Crores, additional consent fee of Rs. 2,20,868/- for increase in capital investment of Rs. 110.43 crore shall be submitted by industry.

5. Earlier the case was discussed in CAC meeting held on 2.3.2012 and it was decided to issue show cause notice for refusal of consent as the industry is exceeding the stack and AAQM results to consented norms and thereto non-compliance of Consent Conditions.

6. Accordingly Board has issued Show Cause Notice vide letter dated 14.03.2012.

7. Industry has submitted the reply vide letter dated 22.3.2012 received on 28.03.2012.

In view of above we may renew the Consent up to 31.03.2015 with the condition that the unit shall submit the Bank Guarantee of Rs.50 Lakhs against the achievement of Standards within next 2 years and completion of all the above works within 2 years.

PSF & SDB and the treated effluent is reused for flushing & gardening purpose. SRO

has not submitted the JVS analysis results.

5. The bio-degradable waste generated is treated in organic converter and used as

manure for gardening.

6. SRO reported that applicant have provided oil catchers to kitchen exhaust.

7. Also, reported that C.I. increased from Rs. 122 Crs. to Rs. 203 Crs. and

accordingly, consent fees for consent to establish & 1st operate needs to recover

from applicant. Applicant have not paid adequate consent fees presently.

8. RO-Pune issued SCN to the applicant on 26.12.2011 for not submitting CA-

certificate, not paying fees, details of ETP/STP, Env. Stmt., Cess returns/payment

details, etc.

9. The case was discussed during CAC meeting held on 31.01.2012 and it was decided

to issue SCN for refusal of consent as applicant have not replied to the SCN issued

by RO on 26.12.2011 and not paid the consent fees. SCN was issued on 06.02.2012.

Further it was discussed in CAC meeting held on 02.03.2012 and it was decided to

process the reply received and resubmit the case in next CAC.

10. SRO-Pune-I forwarded the industry reply wherein mentioned that increase in gross

block C.I. is due to the reason that project was not completed. Now, total hotel

building and internal work is completed, hence, investment is raised to Rs. 203 Crs.

and paying differencial consent fees on increased investment. There is no increase in

total area & no. of rooms that were mentioned in consent dtd. 04.01.2011.

11. UV-Plant for treatment of swimming pool is already provided.

12. Consent may be granted upto 31.08.2012 after payment of consent fees as per

4. Applicant have submitted the reply on 17.02.2012 and 02.04.2012 and corrected details

regarding no. of phases, consent obtained, effluent generation & treatment, consent fees are

noted.

5. Obtained Environmental Clearance for Phase-III includes addition of 4 floors over building

no. (2), building no. (3) and hotel building no. (4).

6. As per EC, C.I. of phase-III is Rs. 553.80 Crs. and in consent to Establish it is mentioned as

Rs. 533.80 Crs. The same was clarified by applicant during the discussion on 29.03.2012

and informed that total C.I. of phase-III project is Rs. 553.80 Crs., hence, consent fees of Rs.

20,000/- for consent to Establish needs to be obtained.

7. Applicant have informed that part of phase-III of 44 no. of rooms having C.I. Rs. 15.41 Crs.

was taken in operation from 2008 and obtained the consent in phase-II only but C.I. of part

was not covered in consent. Hence, consent fees of Rs. 50,000/- per year from 2008-2011

needs to be obtained.

8. Applicant has submitted the DR receipt of Rs. 17.5 Lakhs paid at RO-Mumbai on

01.04.2010.

9. We may call industry representative for clarification of point no. (3), (5), (6) & ETP/STP

3. The consent to Establish was granted on 02.06.2006 for hotel with the condition of

obtaining Env. Clearance, as per EIA Notification, 2006 and the applicant have obtained

Environment Clearance for the same on 23.01.2007.

4. The sewage effluent generated is 189 CMD, which will be treated in their STP and trade

effluent 7.40 CMD will be treated by primary followed by tertiary treatment and further it

is mixed in STP. The treated effluent is reused/recycled for flushing & gardening

purpose. The area available for disposal of treated effluent is 15,224 sq.m. i.e. 3.76

acres.

5. Industry has provided ozonation treatment for swimming pool.

6. The bio-degradable waste generated will be treated by composting.

7. SRO had issued letter to induatry on 18.03.2011 & 20.04.2011 for non-compliances and

RO has issued SCN for operating hotel without consent & without provision of ETP.

Industry has replied the SCN and RO reported that they have provided necessary

pollution control system. Further, RO has called explanation from SRO-Pune-I for

forwarding application to RO after 9 months period.

8. CA-certificate dtd. 05.01.2011 shows that C.I. is Rs. 264.47 Crs. and accordingly paid the fees. However, CA-certificate dtd. 05.01.2010 shows that C.I. is Rs. 387.19 Crs.

9. The case was referred to CAO on 04/01/2012 for guidance on which CA-Certificate is

correct. checking the CA Certificate and he has recommended that now C.I. of industry is

increased compare to the consent to Establish, hence, called previous C.I. details of

industry. Letter issued to the industry on 17.01.2012, reply not yet received.

10. The case was discussed during CAC meeting held on 02.03.2012 and it was decided to

process the reply and resubmit the case in next CAC.

11. Applicant has submitted the reply vide letter dtd. 02.03.2012 & 03.04.2012, wherein

mentioned that they do not have details of C.I. which was given at the time of C to E.

Now, their total project cost increased due to increase in material costing and total C.I. is

Rs. 332.49 Crs. Submitted CA certificate. They are ready to pay necessary difference in

fees.

and obtained the same.

e. Applicant have started construction activity without obtaining consent as previously

they had approved plan for 7,868.06 sq.m. BUA and said does not require

Environmental Clearance. SRO reported that they have completed 21 storey building

of hospital with partly plumbing/ flooring. And SRO recommended to issue SCN for

the same.

f. The effluent generated from the said activity will be sewage – 242 CMD and

proposed to provide STP (capacity-325 CMD) and treated effluent will be reused for

flushing, cooling purpose and remaining treated effluent is disposed off into the

sewer line.

g. The bio-degradable waste generated will be segregated and disposed to MCGM.

And non-biodegradable waste will be send to authorized vendor. They have

proposed to provide vermin-composting pits for biodegradable waste.

h. RO reported that applicant have proposed rain water harvesting.

i. The C.I. of project mentioned in EC is Rs. 100 Crs. and in the application it is

mentioned as Rs. 208 Crs. Applicant have submitted the clarification as earlier

medical equipment cost did not included in C.I. and escalation in project cost is due

to the time lapsed between 2008 and now and paid consent fees accordingly.

j. As this is the construction of Hospital with canteen, category of consent and consent

granting authority needs to be defined. As per CPCB revised product category,

Hospital comes under RED category. There are similar activities in Hospital & Hotel

such as laundry activity, canteen, sewage waste, biodegradable waste. So, we may

consider hospital in Red category and Hotel.

4. The trade effluent generated from the said activity is 132 CMD (Previous consent-

126.5 CMD), which is being treated in primary ETP and then connected to STP. The

domestic effluent is 196 CMD (previous consent- 300 CMD), which is being treated in

the STP and the total treated effluent is reused for flushing, cooling purpose and

remaining treated effluent is disposed off into the sewer line.

5. JVS analysis results dtd. 14.07.2010, 15.10.2011 found within norms.

6. Provided stack of adequate height to DG Set, Boiler.

7. Provided adequate exhaust system at all sections/points The bio-degradable waste

generated is disposed to MCGM.

8. Applicant have submitted Environmental Statement for period 2009-10 and Cess

paid upto 22.06.2011.

9. SRO has communicated certain discrepancies to the applicant on 11.11.2011

regarding increase in C.I. & other details but they have not replied the same till date.

10. RO/SRO recommended the case for grant of renewal of consent after receipt of audited annual balance sheet and obtaining necessary consent fees.

11. The case was discussed during CAC meeting held on 23.01.2012 and during the

meeting, it was decided to issue SCN for refusal of consent as industry has not

replied to letter issued by the SRO on 11.11.2011. SCN issued on 06.02.2012 and

industry has submitted the reply on 27.02.2012 & 03.04.2012, following points are

noted;

a) Submitted CA certificates from 2007 to till date, however, C.I. mentioned is found

reduced to previous year and they have mentioned that the difference in gross

block C.I. over the years is due to fluctuation of the foreign exchange rate of the

assets purchased under foreign loans. They are ready to pay the requisite

consent fees. Current year C.I. is Rs. 318.34 Crs.

b) C.I. is increased from Rs. 196 Crs. to 318.34 Crs. but there is no

modernization/expansion of the hotel.

135 CMD. Used for gardening and industrial effluent is 4650 CMD. • Unit was closed from Mar -2008. Unit had valid consent upto 30.04.2009 &

industry had applied for renewal of consent for 1 year, but was not granted to industry.

• Previously M/s. Global Board Ltd has investment of Rs.17000 Lakh & had valid consent upto 30.04.2009. But now the Industry has been bought by M/s. Pudumjee Pulp and Paper Mills Ltd., and they have applied for renewal of Rs. 2236 Lacs only.

• AS per the decision of the CAC Dt. 14.02.2012 SCN for revocation/ refusal of earlier consent /closure due to having invalid corroded ETP and no arrangement for the disposal of the treated effluent as CETP is inadequate to handle the load.

• In reply to the SCN issued to the Industry, industry has stated that they have purchased second hand industry hence Capital Investment is decreased. Industrial effluent generation is 4 MLD

6. Industry has stopped its production since Nov. 2010, and Mercury Cell Plant was stopped in 1997 and scrapped there after. The Board had issued directions on 13/11/2007 followed by Interim Directions issued on 18/12/2007 which states that, the industry shall furnish concrete proposal duly prepared by the expert in the field in respect of present storage of mercury having 100 Tons in the landfill and suggesting the remedial measures, which is one of the conditional directions. And also submit the Bank Guarantee of Rs. 200000/- and which was submitted.

7. The industry shall get certified by the competent authority of the Government, such as Industrial Safety & Health Department that there is no storage of any hazardous chemical within the premises.

8. The Mercury waste lying in the landfill site shall be analyzed for its mercury content and then decision in this regard may be taken or an a expert may be nominated to carry out the duties.

5. Coal Production for last three years is enclosed herewith. The Production for the year 2010-11 was 3.058 Million Ton.

6. The Board vide letterMPC/CRO/1366/2010 dated 05/08/2010 has issued interim directions to the mine. But said mine authority is non-complied with respect to these points.

a. Active O.B is about 50 meter away from notified Wardha river. The OB was slide in part and spread up to bank of river.

b. Operation & maintenance of existing air pollution control system, sewage treatment plant is very poor and thus affecting surrounding environment.

8. From the Ambient Air Monitoring Results carried in Jan/March/Oct, 2011 observed that results are exceeding.

9. Mine Lease boundary is adjacent to notified A-II class Wardha river ( 0.2 Km) and within two km from Notified A-II Class Penganga river. RRZ not satisfied for expansion of mine near the notified A-II class river.

10. The mine is not complying to the consent conditions/interim directions. The results are exceeding. Industry not satisfying the RRZ notification, hence we may refuse the consent for expansion unit and issue Show Cause Notice for refusal to the existing unit.

mountains and hilly soils with less porosity & permeability, effluent disposed on

land may get percolated. Accumulated effluent may contaminate rain water during

monsoon and may enter into river/sea by surface runoff endangering life of flora

and funna. Hence, we may amend the consent and impose strict norms to achieve BOD -5

mg/L, similar to that imposed on galvanizing unit.
