Commencement of the Meeting At the commencement of the meeting, The Right Worshipful the Mayor, Councillor A Givan, welcomed those present to the meeting, including the member of the public seated in the public gallery. He requested that all mobile phones be switched off or put on silent for the duration of the meeting.

The Director of Leisure and Community Wellbeing outlined the evacuation procedures in the case of an emergency. 1. Business of The Right Worshipful the Mayor 1.1 Prayers

The Right Worshipful the Mayor, Councillor A Givan, welcomed to the meeting Pastor Geoffrey Ward, Lisburn Baptist Church. Pastor Ward gave an address and said a prayer, during which he expressed:

• condolences to Mr Les King, employee in Glenmore Activity Centre on the recent death of his mother;

• best wishes to Alderman W J Dillon for his continued recovery from recent ill-health.

The Right Worshipful the Mayor, Councillor A Givan, thanked Pastor Ward for his attendance and he left the meeting (7.08 pm). Councillor S Skillen arrived to the meeting at this point (7.08 pm). 1.2 Mayor’s Engagements The Council noted a number of engagements attended by The Right Worshipful the Mayor and the Deputy Mayor since the last meeting of Council.

2. Apologies

It was agreed to accept apologies for non-attendance at the meeting on behalf of Aldermen W J Dillon MBE, T Morrow and S P Porter, Councillors R T Beckett, R Carlin, D J Craig, M Gregg, S Lee, G McCleave and T Mitchell, the Chief Executive and the Director of Service Transformation. The Right Worshipful the Mayor, Councillor A Givan, gave an update in relation to Alderman W J Dillon’s recent spell of ill-health and wished him well in his continued recovery. He also expressed best wishes for a speedy recovery to the Director of Service Transformation who had taken ill earlier in the evening.

3. Declarations of Interest

There were no declarations of interest expressed at this point in the meeting. During the meeting, the following declaration of interest was expressed:

• Councillor A P Ewing in respect of item 14.2 “Meeting Regarding Antisocial Behaviour” due to his membership of the South Eastern Local Commissioning Group.

4. Council Minutes

It was proposed by Alderman A G Ewart, seconded by the Deputy Mayor, Councillor J McCarthy, and agreed that the minutes of the special meeting of Council held on 24 June, 2019 be confirmed and signed. It was proposed by Alderman J Tinsley, seconded by Alderman M Henderson and agreed that the minutes of the meeting of Council held on 25 June, 2019 be confirmed and signed.

8. Adoption of Minutes of Committees

Planning Committee 17 June 2019

The minutes of the Planning Committee meeting of 17 June, 2019 had been circulated for noting only as these minutes had been agreed at the subsequent meeting of the Planning Committee on 1 July, 2019. It was proposed by Councillor O Gawith, seconded by Councillor A Swan and agreed that their contents be noted.

9. Report from Chief Executive

In the absence of the Chief Executive, his report was presented by the Director of Leisure and Community Wellbeing.

It was agreed that the report and recommendations of the Chief Executive be adopted, subject to any decisions recorded below. Items for Decision 9.1 Moira Speciality Food Fair – 17-18 August, 2019 Members were reminded that the Council had successfully staged the Moira Speciality Food Fair each year in the grounds of Moira Demesne since 2015, with the event last year having attracted an estimated 7,000 visitors. The Fair provided an ideal opportunity to showcase the quality producers and artisan traders in a family-friendly, fun and festival format. The promotion of food and drink was one of the Council’s strategic tourism themes going forward and an event management company had recently been appointed to deliver a series of food and drink events over the course of the year, promoting the quality producers and culinary excellence within the area as part of a single campaign. It was planned that the 2019 Moira Speciality Food Fair be extended to be the catalyst for a wider Moira Food and Drink Festival, generating even more buy-in and support from the local traders and community. As part of this initiative, it was proposed to promote the award winning local drink producers within the Council area and for alcohol to be consumed as part of the event, similar to last year.

9.1 Moira Speciality Food Fair – 17-18 August, 2019 (Contd) The Council bye-laws on all its parks prevented the consumption of alcohol and it was a requirement for the bye-law to be relaxed for the two days of the event if alcohol was to be consumed. The businesses appointed to sell alcohol would extend their drinks licence on a temporary basis to cover this event. It was proposed by Alderman A G Ewart, seconded by Councillor O Gawith and agreed that the consumption of alcohol be permitted at Moira Demesne on 17-18 August, 2019 as part of the planned Moira Speciality Food Fair, which was the same procedure as last year. 9.2 Appointment of Independent Members to PCSPs In order to enable the shortlisting/interviews of potential Independent Members to PCSPs, councils had been requested by the Northern Ireland Policing Board to nominate a Panel comprising of up to 4 political members of the PCSPs (plus 2 reserves to facilitate a replacement, if required). These should be confirmed Members of the PCSP and they would be required to carry out both the shortlisting and interview stage. The Board would provide Appointment Panel training and specific training for Panel Chairs and, therefore, the Chairman of the Panel should also be confirmed as part of this process. It was anticipated that training would take place on a regional basis during late August/early September, with the shortlisting/interviews taking place at each council level during October/November 2019. It was agreed that the following Members (as proposed by Party Nominating Officers) be appointed to the Appointment Panel:

• DUP – Councillor A P Ewing and Councillor A Gowan • APNI – Councillor M Guy • UUP – Councillor A Swan • SDLP (reserve) – Deputy Mayor, Councillor J McCarthy

As the Party Nominating Officer for Sinn Féin was not present at the meeting, it was noted that the Sinn Féin nomination of a reserve Member would be submitted to the Chief Executive in due course. It was proposed by Alderman J Tinsley, seconded by Councillor A Swan and agreed that Councillor A P Ewing be appointed as the Panel Chair. 9.3 Notice of Motion – Diversity A Notice of Motion had been agreed at the June meeting of Council “that this Council acknowledges the positive contribution that diversity brings to our communities and accordingly affirms that all lesbian, gay, bisexual and trans people living, working or visiting our council area should be accepted and valued as equal citizens as part of a safe, welcoming and inclusive society. Council consequently requests that Officers bring back a report on how we can positively fulfil this pledge including via the lighting of the Civic Centre in rainbow colours to coincide with Pride Day each year on the first Saturday of August”.

9.3 Notice of Motion – Diversity (Contd) Members were advised that a report on this issue would not be completed in time to coincide with Pride Day this year, which would take place on 3 August. The Notice of Motion stated that the lighting of the building in rainbow colours be included as part of the report, which was not possible given that the technical capacity of the current mood lighting system, installed in October 2018, had the capacity for single colour only. In his report, the Chief Executive recommended that a report on this issue be brought back to the Corporate Services Committee, to include a review of the mood lighting system from the agreed single colour only and the financial costs involved in upgrading the facility to include the ability for multiple colour display. The Director of Leisure and Community Wellbeing advised that it had now been established that the current mood lighting system was capable of showing the colours of the rainbow on a constant loop effect and it was his understanding that this would be consistent with the Notice of Motion. Councillor A McIntyre thanked Officers for the work carried out thus far in relation to this matter. As the proposer of the Notice of Motion, he stated that he was happy (as was the seconder) to proceed on the basis of colour rotation, as outlined by the Director, and for the report to the Corporate Services Committee not to include information on upgrading the current facility to include the ability for multiple colour display. 9.4 Lough Moss Leisure Centre Sewer Repair Members were advised that NI Water Ltd was seeking to enter into a Licence Agreement in order to carry out repair to the sewer at Lough Moss Leisure Centre, Carryduff. The draft licence and the route to be taken by NI Water Ltd had been approved by the Head of Estates Services and works would be monitored by one of his Officers to ensure the said land was reinstated to the satisfaction of the Council. It was proposed by Councillor N Anderson, seconded by Alderman M Henderson and agreed that the Council enter into the Licence Agreement with NI Water Ltd as outlined above. 9.5 Delegated Authority – Annual Financial Statements 2018/19 Members were advised that a representative of the Northern Ireland Audit Office was due to attend a special meeting of the Governance and Audit Committee on 26 September, 2019 to consider the Council’s financial statements for 2018/19. As this meeting fell after September’s full Council meeting, it was proposed by Alderman J Baird, seconded by Councillor J Gallen and agreed that delegated authority be granted to the Governance and Audit Committee, at its special meeting on 26 September, to approve the Council’s financial statements for 2018/19.

12.1 Cross-Party Brexit Working Group Councillor S Eastwood

A copy of the following Notice of Motion in the name of Councillor S Eastwood had been circulated to Members with the notice convening the meeting:

“That this Council resolves to establish a cross-party Brexit

working group in order to support local planning and contingencies in relation to the council’s responsibilities arising from all Brexit scenarios including no deal”.

The Notice of Motion was proposed by Councillor S Eastwood and seconded by Councillor D Honeyford. On a vote being taken, it was agreed that the Notice of Motion would not be debated at the Council meeting, but would be referred to the relevant Committee for consideration, the voting being 9 votes in favour and 21 votes against. Clarification having been sought in relation to which Committee this Notice of Motion would be referred to, the Director of Leisure and Community Wellbeing advised that it would be referred to either the Development Committee or the Governance and Audit Committee as both had previously considered Brexit-related matters. The Director agreed to liaise with the Chief Executive in relation to which of those Committees was most appropriate to refer the Notice of Motion to and this would be agreed in consultation with The Right Worshipful the Mayor. Alderman A Grehan requested that the Chief Executive provide Members with information on work that had been carried out by the Council in relation to Brexit.

Any Other Business 14.1 Performance Reports Alderman J Tinsley Alderman J Tinsley referred to item 7.7 “Performance Reports” in the minutes of the Leisure and Community Development Committee meeting held on 4 June, 2019. The minutes of that item referred to the noting of performance reports relating to absence figures and budget reports for quarter 4 of 2019. Alderman Tinsley advised that a performance summary for the Leisure and Community Wellbeing Department had also been provided and noted at that meeting. It was proposed by Alderman J Tinsley, seconded by Alderman M Henderson and agreed that this be recorded in the minutes of tonight’s meeting. 14.2 Death of Colonel Robin Charley Alderman S Martin Alderman S Martin referred to the recent death of Colonel Robin Charley MBE, Chairman of the Somme Heritage Centre, whose family had many years’ association with this Council area. Alderman Martin, on behalf of his Party and the Council, expressed his condolences to the wider Charley family on Colonel Charley’s sad passing. 14.3 Meeting Regarding Antisocial Behaviour Alderman S Martin Alderman S Martin referred to a meeting that had taken place between Members of the Lisburn North and Lisburn South District Electoral Areas and representatives of the PSNI regarding antisocial behaviour. He placed on record his thanks to the local PSNI representatives for having made themselves available and speaking so frankly about the problems persisting across the city in terms of antisocial behaviour, particularly as they related to drug use. Alderman Martin referred to a serious incident that had occurred recently at new social housing apartments at Graham Gardens, Lisburn, which could have resulted in yet another innocent member of the community being seriously hurt. At the meeting with the PSNI, it had been determined that this Council would take a proactive approach to the issue of drug use, drug abuse and its increase in Lisburn/Castlereagh. Alderman Martin proposed that the Council write to the Chief Executive of the South Eastern Health and Social Care Trust to ascertain what it was currently doing in this Council area to address the issue of drugs. This proposal was seconded by Councillor O Gawith and agreed. Alderman Martin stated that he would work with the Chairman of the PCSP, Councillor A P Ewing, in relation to how such a letter could be framed. Further to Alderman Martin’s comments regarding the social housing in Graham Gardens, Councillor Jenny Palmer stated that when she had received a tour of the new apartments, she had been advised by a representative of Clanmil Housing Association that the apartments would be allocated to families and would not be offered to individuals. She referred to the role of Base2 in offering advice to the Northern Ireland Housing Executive (NIHE) and the PSNI in terms of why someone should be rehoused in an area over antisocial behaviour. Given the introduction of the General Data Protection Regulation (GDPR) and the major

14.3 Meeting Regarding Antisocial Behaviour (Contd) Alderman S Martin issue of confidentiality, Councillor Palmer proposed that the Council write to the NIHE asking if Base2 was appropriate to be one of its contacts and how it would like to address this matter in the future. Alderman J Tinsley seconded this proposal and also asked that it include the organising of an urgent meeting, within the next month, with the Heads of all the social housing providers to raise this serious issue. Councillor Jenny Palmer was happy for this to be included in her proposal and it was agreed. Councillor A P Ewing, Chairman of the PCSP, thanked all Members who had attended the very useful meeting with the PSNI. He stated that he was disappointed with the incidents that had occurred at the apartments and he looked forward to working with his colleagues to address the issues. Councillor Ewing stated that he would be willing to organise any meetings going forward through the PCSP to get all statutory agencies together and deal with this matter. Alderman A Grehan referred to the Council’s Housing Liaison Forum, which was cross-party and met with all housing associations and the NIHE. She asked that a meeting of this Forum be convened urgently in light of incidents that had taken place. Alderman A Grehan stated that a NIHE consultation document that would deal with intimidation points was currently in Stormont, but there was no-one to sign it off. She proposed that the Council write to the Permanent Secretary expressing the Council’s concerns about intimidation points, how the system was not working and asking if this matter could be followed up. This proposal was seconded by Councillor Jenny Palmer and agreed. 14.4 Mr Boris Johnson, Prime Minister Councillor A Gowan It was proposed by Councillor A Gowan and seconded by Alderman A G Ewart that a letter be sent to Mr Boris Johnson wishing him well in his appointment to the position of Prime Minister and inviting him to visit Lisburn & Castlereagh City Council. On a vote being taken, the proposal was “carried”, the voting being 19 votes in favour and 9 votes against. 14.5 Twelfth Celebrations in Glenavy Village Councillor D Honeyford Councillor D Honeyford stated how proud he was of Glenavy village before, during and after the Twelfth. Glenavy had welcomed the Orange District and South Antrim District to the village and many people had commented on what a good day it had been. He congratulated the Orange Order on the efficient and sensitive way it had planned and executed the event. However, there was a lot of work still to be done to unite the community in the Lisburn and Castlereagh area and broader. He referred to a hate crime incident involving the home of one of the Ballymurphy families. Councillor Honeyford thanked Alderman J Tinsley for the way in which that incident, which had the potential to destroy a successful day, had been handled and dealt with very well. 14.5 Twelfth Celebrations in Glenavy Village (Contd) Councillor D Honeyford shown by residents and Glenavy District was an example for this City and the wider area. Unfortunately, in the last few days, there had been another hate crime incident involving a paint attack on a Protestant Hall in the village. As an APNI Member for the area and as an Officer within the GAA, Councillor Honeyford expressed his disgust and gave a reassurance that such behaviour was not the will of the vast majority of people in the area. A number of people from the GAA community had approached Councillor Honeyford and he stated that he would be willing to get a group together to help clean up the building. Alderman J Tinsley thanked Councillor Honeyford for his comments, which were appreciated. Councillor Honeyford stated that he had been involved in the Key Institution Programme, which involved the Loyalist Bands Forum, Orange Order and GAA working together and Glenavy had benefited from that. As Peace 4 was due to end, Councillor Honeyford asked that the Council consider other ways of allowing that Programme to continue when Peace 4 funding ceased. Councillor Jenny Palmer welcomed Councillor Honeyford’s remarks and stated her hope that the good work would continue under Peace Plus. 14.6 Harmony Inn, Newtownbreda Councillor N Anderson Councillor N Anderson advised that Harmony Inn, Newtownbreda, had been officially named as the best Chinese restaurant in the whole of Ireland and asked that a letter of congratulations be sent to that establishment. 14.7 75th Anniversary of VE Day Councillor N Anderson Given the forthcoming 75th anniversary of VE Day, Councillor N Anderson asked that the Council investigate how many WW2 veterans within the Council area were still alive as it would be appropriate to honour them in some way. The Director of Leisure and Community Wellbeing advised that there had been discussion at the June meeting of the Leisure and Community Development Committee regarding VE Day commemorations and it had been agreed that a further report be presented to that Committee regarding detailed arrangements. The Director confirmed that he would take account of Councillor Anderson’s suggestion and consider how that could be built into arrangements. 14.8 Thanks for Well Wishes Councillor J Gallen Councillor J Gallen expressed his thanks to The Right Worshipful the Mayor, his Elected Member colleagues, the Chief Executive and Council staff for their well wishes during his recent spell of ill-health.

14.9 Children’s Funeral Fund Councillor H Legge Councillor H Legge stated that she had been proud to have proposed a Notice of Motion previously regarding the implementation of the Children’s Funeral Fund. This had now been implemented today in England. Carolyn Harris MP had been instrumental in having this implemented in England, Scotland and Wales and Northern Ireland was the only area of the United Kingdom which was slightly lagging behind. Carolyn Harris had written to the Chief Executive of Armagh City, Banbridge and Craigavon Borough Council, which was the council that had initiated this in Northern Ireland, stating that she understood the difficulties in securing a National fund in the absence of an Assembly at Stormont but that she was contacting the Permanent Secretary in the Department for Communities and the Secretary of State to petition for Northern Ireland to be brought in line with the rest of the UK. She asked in her letter if Armagh City, Banbridge and Craigavon Borough Council would consider doing the same. It was proposed by Councillor H Legge, seconded by Councillor Jenny Palmer and agreed that, if and when such a letter was received by this Council, it would be supported.

The Committee considered an application for an entertainment licence that had been received from the proprietor of Lets Go Hydro for an annual licence for the Grandstand Marquee holding a maximum occupancy of 400 and it was noted that a number of objections to the application had been received. The Head of Environmental Health provided the Committee with an overview of the key issues relating to the application including the number and nature of objections received, responses from statutory consultees and internal regulators; and available options for the Council to consider. The Committee was provided with copy of the following documents: entertainment licence conditions; written representations from nine objectors and the appeal procedure.

(Councillor S Skillen arrived at 6.37 pm)

The Chairman advised that there were no objectors present at the meeting but pointed Members to the letters of objection that had been previously circulated with the report. The Committee received Ms Sinead Eastwood, Marketing Manager for Let’s Go Hydro. Ms Eastwood offered an apology on behalf of the applicant who had been unable to attend the meeting in person due to the fact that an international championship event was being held at the facility. Ms Eastwood spoke in support of the application for an entertainments licence highlighting issues relating to public safety, management of operations and impact on the local amenity. With regard to events involving fireworks, she advised that these would be limited in number and local residents and anyone wishing to be informed would receive advance notification, where possible.

The Chairman then invited questions from Members and Ms Eastwood provided clarification on a range of issues including public safety, impact on the local amenity, noise levels, site security and car parking facilities. The Chairman thanked Ms Eastwood for her presentation and she left the meeting at 7.05 pm In Committee It was then proposed by Alderman J Tinsley, seconded by Councillor S Skillen and agreed that further discussion be considered “in committee”, in the absence of members of the press and public. The Chairman advised that the discussion would be dealt with in committee for the following reason: Confidential due to information in relation to which a claim for legal professional privilege could be maintained in legal proceedings.

Alderman J Tinsley raised a query regarding outstanding planning applications at the wider site. (At this stage the Deputy Mayor, Councillor J McCarthy, Councillor M Gregg and Councillor A Swan declared an interest on the basis that they were members of the Council’s Planning Committee and they left the meeting at 7.10 pm) The Head of Planning and Capital Development provided clarification regarding planning applications relating to the facility including those that were still outstanding. (The Deputy Mayor, Councillor J McCarthy, Councillor M Gregg and Councillor A Swan returned to the meeting at 7.14 pm) The Director of Environmental Services and the Head of Environmental Health responded to Members’ queries regarding provision of insurance documentation, licence conditions and the licence operating times. Resumption of Normal Business It was agreed to come out of committee and normal business was resumed. The Chairman summed up the discussions that had taken place and outlined recommendations for the issue of the entertainments licence. month licence period, a special condition would also be placed on the licence in addition to the model conditions as indicated above, namely that the premises must inform the Council of any upcoming public entertainment events 14 days in advance

• At the expiration of the 6 month provisional licence period, the applicant might make a renewal application for an appropriate licence to be issued for a period of up to 1 year’s duration. This application would be subject to the full application process including consultations.

3.1 Pictorial History of the Development of the New Ice Bowl and the Wider Site Regeneration The Director set out in his report, background information and key issues in relation to the above matter. It was proposed by Councillor G McCleave, seconded by Councillor J Laverty and agreed to recommend that approval be given to the capturing of a pictorial history of the regeneration of the Dundonald Leisure Park, including time-lapse photography of the construction of the new Ice Bowl facility, following an investment decision, as outlined in the Director’s report. 3.2 Dundonald International Ice Bowl Construction Procurement Strategy Options The Director set out in his report, background information and key issues in relation to the above matter and Members were provided with a copy of a Procurement Options paper and a Procurement Strategy Workshop presentation. It was proposed by Councillor H Legge, seconded by Councillor G McCleave and agreed to recommend that (a) the weightings provided be agreed as appropriate; and (b) approval be given to taking forward a traditional design and then build option so as to ensure quality and cost management were maintained. 3.3 Appointment of SIB Support in Developing Outline Business Cases for Key Sports Development Projects and Cemetery Provision within the Capital Programme The Director set out in his report, background information and key issues in relation to the above matter. It was proposed by Councillor J Gallen, seconded by The Right Worshipful the Mayor, Councillor A Givan, and agreed to recommend that approval be given to appoint, through two separate commissions using the SIB Collaborative Agreement, consultancy support to: (a) deliver the four outline business cases for each of the 3G/4G pitches included within the pitches strategy and provided for within the capital programme; and (b) carry out an economic assessment on the various options in order to progress cemetery provision, subject to this approach being approved by

4.1 Progress of Design and Public Consultation for Dundonald International Ice Bowl The Director of Service Transformation set out in his report, background information and key issues in relation to the above matter and Members were provided with a copy of a draft of the outline business case, global cost plan, outline programme, summary issues log, project heath check and risk register. The Director pointed out that there was now a more up-to-date outline business case than the one provided to Members and agreed that this version would be uploaded to SharePoint for Members’ information. The Director also pointed out that this new version included an analysis of 8 options. The additional options were in relation to the refurbishment of the existing facility; however, the new build facility, inclusive of the medical centre, remained the most economically advantageous. It was proposed by Councillor J Laverty, seconded by Alderman S Martin and agreed to recommend that completion of stage 2 design be noted and that the project be progressed through to stage 3 design, as outlined below: (a) the planning application process and public consultation on the design be commenced; (b) the design team be instructed to move the project through to stage 3 design; (c) a 3 phased approach to the development of the Dundonald Leisure Park site be adopted through: (i) letting an enabling works contract for utilities and a first phase car park with associated works; (ii) progressing the build of the new Ice Bowl, demolition of the existing Ice Bowl and associated works to make the building functional; and (iii) a wider site landscaping and environmental improvement scheme being taken forward as a separate project within the capital programme, subject to affordability limits and Member consideration across the wider investment programme; and (d) releasing, on a temporary basis, the hotel site in the Dundonald Leisure Park under licence for any future contractors. Members further noted the progress with the outline business case, which the Director advised should be read in conjunction with the operating model discussions.

4.2 Dundonald International Ice Bowl Redevelopment: Update in Regard to Consideration of Operating Model Options Alderman A G Ewart left, and returned to, the meeting during consideration of this item of business (6.52 pm ad 6.57 pm respectively), as did the Project Manager (6.54 pm and 6.56 pm respectively) and Alderman S Martin (6.59 pm and 7.01 pm respectively). The Director of Leisure and Community Wellbeing set out in his report, background information and key issues in relation to the above matter. With the use of visual aid equipment, the Head of Service (Sports Services) made a presentation regarding the impact and success of the Vitality Household Membership Scheme. It was noted that the scale of this impact was being factored into the final draft report by MAX Associates Consultants on the operating model options. As the issue of the operating model for departmental services fell within the remit of the Leisure and Community Development Committee, it was proposed by The Right Worshipful the Mayor, Councillor A Givan, seconded by Councillor S Hughes and agreed to recommend that the MAX Associates report be first considered by that Committee, with its views being factored into consideration of the overall outline business case by the Capital Projects Committee, prior to an investment decision being recommended to Council. Resumption of Normal Business It was proposed by Alderman S Martin, seconded by Alderman A G Ewart, and agreed to come out of committee and normal business was resumed.

Conclusion of the Meeting At the conclusion of the meeting, the Director of Service Transformation advised that, whilst the next meeting of the Committee was scheduled to take place on 10 September, 2019, there was a need to keep that date flexible as it may be necessary to hold it later in the month to allow sign-off on the final Outline Business Case. Councillor J Palmer updated the Committee on Alderman Dillon’s progress and indicated that he was hoping to be discharged from hospital quite soon.

2. Declarations of Interest

The Chairman sought Declarations of Interest from Members and reminded them to complete the supporting forms which had been left at each desk. During the course of the meeting, the following Declaration of Interest was received:

• Alderman D Drysdale declared an interest in Item 4.2.3

“LA05/2019/0643/PAN - For Industry and Commerce as zoned in the Belfast Metropolitan Area Plan 2015, Approved for Use Classes B1(b) call centre, B1(c) research and development, B2 Light Industrial, B3 general industrial and B4 storage and distribution. Main entrance from Carrowreagh Road”, on the basis that he was Chairman of a competing business park.

Alderman Drysdale was advised by the Head of Planning and Capital Development in consultation with the Legal Advisor that, as this item was for noting only and the Committee would not be taking a decision on it at this stage, it was not necessary for him to leave the meeting.

3. Minutes of the meeting of the Committee held on Monday 17 June 2019.

It was proposed by the Deputy Mayor, Councillor J McCarthy, seconded by Councillor M Gregg, and agreed that the Minutes of the Committee Meeting held on Monday 17 June 2019 as circulated be confirmed and signed.

4. Report of the Head of Planning and Capital Development

4.1 Schedule of Applications: The Chairman reminded Members that they needed to be present for the entire determination of an application. If absent for any part of the discussion they would render themselves unable to vote on the application. The Legal Adviser highlighted paragraphs 46 - 48 of the Protocol for the Operation of the Lisburn & Castlereagh City Council Planning Committee which, he advised, needed to be borne in mind when determinations were being made. The Chairman advised that there were a number of speakers in attendance making representation on some of the applications and therefore the Schedule of Applications would be taken out of order to enable these applications to be taken first. The Chairman also advised that representatives of the Department for Infrastructure, Roads Service, were present at the meeting to assist with consideration of applications that had road safety or traffic management issues.

(1) LA05/2015/0466/F – Demolition of residential premises and the erection of 26 nr semi-detached dwellings and 1 nr detached dwelling (27 nr dwellings in total) site access works, development roads, associated siteworks and landscaping at 54 Saintfield Road, Lisburn and lands to the south and west of 54 Saintfield Road, Lisburn

(The Head of Planning and Capital Development left the meeting at 12.49 prior to consideration of this item.) The Principal Planning Officer (RH) presented this application as outlined in the circulated report. The Committee received Mr Keith Trimble who wished to speak in opposition to the application, highlighting the following:

• Mr Trimble indicated that he was speaking on behalf of local residents who

had no objection in principle to housing development on the site but were concerned regarding road safety and management issues

• He stated that there were so many aspect of the design that did not meet road safety requirements

• He indicated that the only suggestion by the designers to deal with road safety issues had been the provision of a yellow box and this would have failed to address the problems

• He referred to traffic problems in Plantation Road and neighbouring roads.

There being no questions for Mr Trimble, the Chair then invited questions for the Planning Officers. In response to Members’ questions, the Principal Planning Officer provided further information regarding proposed measures to mitigate against noise nuisance. Comment provided included detail on the provision of acoustic fencing and additional planting along the motorway boundary and installation of acoustic glazing in properties backing on to that boundary.

Mr Lionel Walsh from the Department for Infrastructure, provided additional information regarding road safety and traffic management issues arising from the proximity of the development to the Saintfield Road roundabout and Plantation Road junction. The Committee, having considered the information provided within the Report of the Principal Planning Officer and by those making representations, agreed by a majority of 6:0 with 0 abstentions to refuse the application as outlined in the Officer’s report. (The Head of Planning and Capital Development returned to the meeting at 1.12 pm and Mr Lionel Walsh, Department for Infrastructure, left the meeting at 1.14 pm

(5) LA05/2017/0909/F – Residential development to include 1 no. replacement

The Principal Planning Officer (RH) presented this application as outlined within the circulated report. The Committee received Mr Keith Trimble who wished to speak in opposition to the application highlighting the following:

• Mr Trimble stated that he was a resident in the Mount Royal development off

Plantation Road and was speaking on behalf of residents • He said there were no issues with the housing itself but a number of

objections had been raised regarding parking, road safety and access issues. • He said that planning policy indicated that unsatisfactory piecemeal

development would not be permitted • He expressed concerns about a house with a particularly large garden to the

north of the site and about the provision of a 6 metre wide road with footpaths, indicating that these features could facilitate further intensive housing development on an adjoining site

• He stated that, while the proposed site was not right on the Saintfield Road roundabout, even a small increase in traffic using that roundabout would exacerbate current traffic congestion.

• Both BMAP and Lisburn Area Plan had indicated that new housing development should not have vehicular access via Plantation Road.

In response to Members’ questions, Mr Trimble provided further clarification regarding BMAP and LAP guidelines. With regard to the issue of piecemeal development, he accepted that the development was a relatively small one but referred to the cumulative and adverse impact of ongoing housing development on residential amenity and road safety. He also provided clarification regarding bus and pedestrian access to the site from Hillhall Road.

The Committee received Mr Richard O’Toole who wished to speak in support of the application, highlighting the following:

• Mr O’Toole stated that the applicant already had consent for a small number

of houses allowing access in the same place on Plantation Road via Plantation Mews.

• There was no adverse road impact as a result of this application; the realignment of access with Princetown Road would improve access and the replacement of an old house would create a better entrance

• The road impact issue had been considered at a previous appeal hearing in connection with this development and the number of houses on the site had been deemed to be acceptable

• When this development has been completed, the developer might apply to develop an adjoining site with access from Hillhall Road and at that stage the issue of cumulative impact on local residential amenity could be considered

Officers then responded to Members’ questions as follows:

• The Legal Adviser stated that each planning application must be considered

on its own merits and possible future development could not be taken into account.

• The Principal Planning Officer provided clarification in relation to separation distances for two sites which the report noted fell below standards set out in Creating Places. Using visuals from the presentation, Members were advised that separation distances had been considered to be acceptable on balance due to the difference in levels, nature and orientation of the houses within the respective sites and that windows in gables were en suite bathrooms with obscured glass.

• Mr Stephen Cash, Department for Infrastructure, provided further clarification on access arrangements and the extent of the footpath provision into the site and how this was connected to Plantation Mews.

The Committee, having considered the information provided within the Report of the Principal Planning Officer and by those making representations, agreed by a majority of 5:1 with 0 abstentions to approve the application as outlined in the Officer’s report and subject to the conditions contained therein. (Alderman D Drysdale arrived at the meeting at 1.51 pm; Mr Stephen Cash, Department for Infrastructure, left the meeting at 1.52 pm)

(2) LA05/2018/1094/F – Erection of two storey dwelling with attached double garage on a farm at 88 Steps Road, Donaghcloney

The Senior Planning Officer (RT) presented this application as outlined within the circulated report. The Committee received Mr Edwin Poots MLA who wished to speak in support of the application, highlighting the following:

• Mr Poots advised that the applicant was getting married next year and

wished to build a family home on his farm • He advised that there was intensive farming on the site with 350 cows and

70,000 chickens • There was a difficulty in that the farm was land locked on 3 sides and a site

was possible on only one side. • There were drainage issues on the site immediately next to the farm where a

drainage pipe on occasion was unable to deal with water from the farm and from streams coming from higher land

• The land started to rise steeply in the only site closer to the farm that was available and any dwelling on that site would be very prominent

• The applicant and his father had replaced a dry storage shed on the farm with a milking parlour and it would be their intention to construct a new storage shed on the land immediately next to the farm

• The proposed site for the new dwelling was only 30 metres away from the farm

• He suggested that a site visit would be useful in clarifying the issues raised

In response to Members’ questions, Mr Poots confirmed that the proposed site for the dwelling was much less visible in the landscape than a site closer to the farm but on rising ground. He also provided clarification on regulations on separation distances between farm buildings and dwellings.

Following consideration of the information provided in the report of the Senior Planning Officer and by those making representation, it was proposed by the Vice-Chair, Councillor O Gawith, seconded by Alderman D Drysdale, and agreed by a majority of 4:3 that determination of this application be deferred for a site visit.

(4) LA05/2017/0868/O – 2 No. dwellings beside 42 Halfpenny Gate Road,

Broomhedge, Moira

The Senior Planning Officer (MCON) presented this application as outlined within the circulated report.

The Committee received Mr Andrew McCready who wished to speak in support of the application, highlighting the following:

• The site was located to the north of the road and formed a gap in a

substantial stretch of road frontage development • The issues were whether the site was an infill opportunity and did it impact

on the distance between countryside and the existing settlement • A gospel hall had recently been constructed at the edge of the existing

settlement and this changed the settlement limit. • The proposed site was located between the gospel hall and the line of built

up frontage and therefore should be considered to meet the criteria for an infill site.

• He referred to examples in Hillhall and Rathvarnet villages where planning permission had been granted for sites outside the settlement limits

In response to queries by Members, Mr McCready confirmed that it was the applicant’s contention that the existence of the gospel hall meant that the site could be considered to meet the criteria for an infill gap. The Committee received Mr Edwin Poots MLA who wished to speak in support of the application, highlighting the following:

• PPS21 sought to prevent scattered or random development within the

countryside • The Planning Officers placed great emphasis on the fact that there was a

separation between Broomhedge and Halfpenny but driving along the road you saw a continuous row of built up frontage.

• Broomhedge was one settlement and was made up of Lower and Upper Broomhedge;

• Sustaining the gap at the proposed site did not do anything in terms of conservation of the countryside

In response to a query by Members, the Senior Planning Officer clarified that PPS21 CTY8 applied to infill gaps in a rural context outside settlement limits; in this instance the built up frontage in Halfpenny was part of an existing settlement and could not be taken into account when considering an infill site. The Head of Planning and Capital Development advised that the gospel hall had been granted planning permission in 2016 on the basis that it was a community facility and that it was located within the countryside.

He further clarified that the gospel hall was the only building with a rural context and explained in two other cases in the Council area how the Planning Appeals Commission had interpreted the planning policy and how this informed the advice in terms of which buildings should be taken into account when assessing these types of application.

The Committee, having considered the information provided within the Report of the Senior Planning Officer and by those making representations, agreed by a majority of 6:1 with 0 abstentions to refuse the application as outlined in the Officer’s report.

(3) LA05/2018/0914/F – Extension to garage (in matching materials) to

accommodate vintage car and forklift at 80 Moneyreagh Road, Moneyreagh

The Senior Planning Officer (RT) presented this application as outlined within the circulated report. The Committee received Mr Ewart Davis and Mr John Spratt who wished to speak in support of the application highlighting the following: • the site lay within a cluster of housing; the site was half an acre and had

mature hedging • There had been no objections from neighbours or from statutory consultees • The site was located 55 metres from the road entrance • Only the front up and over door of the garage could be seen and the

proposed extension extended further back in the site • The house and gardens were well maintained and screened with flowers,

hedging and fencing • The applicant had two jobs and had a works van and his own van; he also

had a fork lift truck and a vintage car • The proposal did not impact on amenity space, parking space or

manoeuvring space within the site • The planners had measured the garage space as being 280 sq. metres but it

was in fact 220 sq. metres • The issue about the scale of the garage space had not been raised

previously by the planners and the applicant had not been given the opportunity to mitigate against this

• The proposal would not affect the amenity of surrounding properties

In response to a Member’s query as to whether a meeting had taken place with planners to discuss the scale of the garage provision, Mr Davies indicated that it

In response to queries by Members, the Senior Planning Officer clarified the amendment to a previous planning approval for a garage and why the location within the site could be distinguished from an earlier refusal of permission.

The Committee, having considered the information provided within the Report of the Senior Planning Officer and by those making representations, agreed by a majority of 7:0 with 0 abstentions to refuse the application as outlined in the Officer’s report.

(6) LA05/2018/0254/F – Replacement dwelling and retention and change of use of existing dwelling to crèche at 17a Upper Mealough Road, Carryduff

The Principal Planning Officer (RH) presented this application as outlined within the circulated report. The Committee received Mr Gary Thompson who wished to speak in support of the application, highlighting the following:

• The proposal was for a much needed child care facility in the rural community • The planning system was set up to regulate planning in the public interest • NI Executive had identified a need for several thousand child care places in

Northern Ireland, 2,000 of which were needed in rural areas • A 2010 NI Childcare survey pointed to the need for more child minding

places. • In relation to the proposal for a replacement dwelling, the site was located off

the main road and behind existing outbuildings and mature hedging • The crèche building was ideal for children with opportunities for nature walks

and an equestrian centre in the vicinity • The Rivers Agency flood map did not indicate that the area was a flood area • Existing drainage on the site was more than adequate • The proposal did not involve the removal of any existing buildings so a bat

survey was not relevant • DCAM 13 stated that detached dwellings were more suitable for child

minding facilities which was the case in this instance • The proposal would be an employment opportunity within the countryside • 3 dwellings had been constructed at the end of the lane and there had been

improvements to the road which would satisfy Transport NI requirements In response to Members’ queries, Mr Thompson responded as follows:

• He provided information on the existence of other creches within the locality; • The applicant did not have personal experience of running a crèche but had

plans for the development of the business. • The applicant had provided responses on two occasions to issues raised by

Roads Service. • A pre-application meeting had been requested but had been refused by

planning officers.

• The laneway was wide and included cycling facilities in both directions and was therefore more than adequate for the development

• The applicant’s businesses on the site were an equestrian centre and a farm

In response to a Member’s question, the Head of Planning and Capital Development advised as follows:

• The request for a pre-application meeting had been turned down because the

scale of development proposed did not justify a meeting. Written planning advice was offered instead and a letter issued.

• The PAD request related to the change of use to a crèche and not for the replacement dwelling. This was a different proposal.

• There would have to be demonstrable reasons why a replacement dwelling must be located off-site. That said, if Members were not minded to accept the advice of the officers, normally planning conditions or a legal agreement would be put in place to ensure that a new dwelling was not occupied until the crèche business was fully operational.

The Committee, having considered the information provided within the Report of the Principal Planning Officer and by those making representations, agreed by a majority of 7:0 with 0 abstentions to refuse the application as outlined in the Officer’s report.

(7) LA05/2018/1017/F – Change of use from dwelling to office accommodation

at 34b Plantation Avenue, Lisburn

The Senior Planning Officer (MCON) presented this application as outlined within the circulated report. The Committee received Mr Keith Trimble who wished to speak in opposition to the application, highlighting the following:

• Residents would support the planning recommendation to refuse the

application • The location of an office within a residential area was not necessary or

appropriate • The office was linked to other developments but a portakabin facility at those

development wold be more suitable

In response to Members’ queries, Mr Trimble advised that the office was continuing to operate and had been there for some time. The Committee received Mr Brendan Starkey who wished to speak in support of the application, highlighting the following:

• The building was formerly a dwelling and was converted to a site and sales

office for the Mount Royal development; the office remained to co-ordinate other developments within the area

• The office was no longer used as a sales office; it was used by 3 members of staff and was not visited by members of the public

• Under planning policy, an office in an out of centre location would be acceptable when it was demonstrated that no other suitable site was available

• There were no designated centres in close proximity to the development location

• There was no prospect of the office being relocated to the city centre and instead the developer would place temporary site offices in other developments

• The office caused no harm to the character of the area or residential amenity • The office had no impact on the viability and vitality of the town centre • There were no objections from statutory consultees • The administrative hub was a more sustainable operation than providing new

temporary offices at other sites as allowed under permitted development In response to Members’ questions, Mr Starkey advised as follows:

• The offices were functioning well and, as a matter of practicality and prudence, the applicant did not wish to relocate the office functions to temporary structures on other sites

• The office conversion had been completed several years ago in association with the Mount Royal Gate development which had been completed 12 months ago.

• The building was used originally as sales and administration; sales and marketing had ceased on the site and it now functioned as an administrative hub to coordinate other developments

• Mr Starkey was unable to provide information on the developer’s business address or whether they had other office accommodation

The Committee received Mr Edwin Poots MLA who wished to speak in support of the application, highlighting the following:

• The planning reasons for refusal included impact on the viability and vitality

of the city centre but the office has had no impact on this over the past 5 years and would have no impact in the future. It was not a town centre type of office

• The developer was making a substantial contribution to the economy of the area; there were a considerable number of people whose jobs were supported by this company

• The office was central to the surrounding residential land use and had no impact on the character of the area

• Planners could issue an approval but apply conditions in respect of its continued use

• It made practical sense to continue to use it as an office and it would revert to a dwelling when that use had finished.

In response to Members’ questions and queries, Mr Poots stated that, although the Mount Royal development was completed, there were other developments in the immediate vicinity. In response to a comment that approval could create a precedent, he stated that portakabin provision on other sites would have a more detrimental effect on a building site. In response to a Member’s question, the Senior Planning Officer confirmed that the office had originally been allowed under permitted development while the Mount Royal development was being constructed. The Head of Planning and Capital Development read an extract from the legislation setting out the parameters for permitted development and the actions that should follow when the development was complete. The context was changed and the site was now surrounding by housing. The Committee, having considered the information provided within the Report of the Senior Planning Officer and by those making representations, agreed by a majority of 6:0 with 1 abstention to refuse the application as outlined in the Officer’s report.

(8) LA05/2019/0500/F – Conversion and single storey extension to existing

In response to a comment by Councillor M Gregg that the iPads were not fit for purpose when it came to viewing planning applications, the Head of Planning and Capital Development advised there was an issue with regard to compatibility of Apple technology with the planning portal and the Director of Service Transformation was discussing this with the Council’s IT section. He advised that a report would be brought back to Committee on this matter. 5.2 Emails to Members from Residents – Councillor A Swan

In response to a query by Councillor A Swan, the Head of Planning and Capital Development advised that Members should forward emails received regarding planning applications to the Planning In-box rather than to individual officers. He

Members are reminded that under the terms of the award of Peace IV Grant Funding to the Council from the Special European Union Programmes Body [SEUPB], the Council is required to establish a Local Peace Partnership to oversee delivery of the approved PEACE IV Action Plan under the themes of Children & Young People, Shared Space & Services and Building Positive Relations. The current LCCC Peace IV programme runs until February 2020. The Peace IV Partnership has been operating since September 2016, the existing Partnership Agreement, agreed with the SEUPB, makes provision for 25 members comprising thus: 12 Elected Members nominated by Lisburn & Castlereagh City Council 4 statutory partners – selected from emerging priorities as identified from the consultation

processes 2014 - 2016; 9 social partners – representation will be from the following groups:

(a) Community and Voluntary Sector; (b) Black and Minority Ethnic Community; (c) Children and Young People; (d) Women’s sector; (e) Rural Community; and (f) Church Groups,

Key Issues

Arising from the Local Government Elections held on 2nd May 2019, six of the twelve previously

nominated Elected Members were lost from the Local Peace IV Partnership either because they

didn’t stand or were not re-elected.

The Council is therefore required to consider Elected Member nominations to ensure the Partnership can fulfil its responsibilities until the completion of the Peace IV Programme early next year.

Following discussion at the Party Group Leaders Forum it was agreed to recommend that the Council is requested to continue with the status quo of nomination of 12 Elected Members to the Peace IV Partnership. To ensure representation by all Council parties on the Partnership it is recommended nominations be made on the following basis. DUP – 4 UUP – 3 APNI – 2 SF – 1 SDLP – 1 Green Party – 1

TITLE: Item 2 Northern Ireland – Netherlands Trade and Export Society (NI-NL) Rotterdam Trade and Networking Event: Request for Delegated Authority

Background and Key Issues:

The Northern Ireland - Netherlands Trade and Export Society (NI-NL) was established in 2006

along with Invest NI, Lisburn & Castlereagh City Council and Northern Ireland Trade Consultants

(NITC), it is a forum and platform for businesses active in trade between Northern Ireland and the

Netherlands. Members will be aware that the Council supports NI-NL networking events, local and

regional publicity, NI-NL Biz magazine and the high profile annual trade dinner that is now planned

for January 2020 in Amsterdam.

An NI-NL Trade Networking event is currently being planned for early October 2019 that will include

Lisburn & Castlereagh based exporters together with their Dutch business partners and suppliers

attending a business networking event, dinner and attendance at an international football match in

De Kuip, Rotterdam.

Each business representative will cover their own costs to attend as follows: €165 per delegate for

event, this includes the business networking event, dinner and ticket into match. Flights and

overnight accommodation for each delegate will be in the region of £320 for one night. At present

four local Lisburn Castlereagh businesses have signed up to attend

Members are asked to note the success of Council`s Sports Services Unit in being shortlisted as one of seven finalists in the “Best Service Team of the Year: Sports, Leisure and Cultural Service” category for award at the annual APSE Service Awards, with the winner due to be announced at the Awards Dinner held as part of the above event. Along with the attendance of the Head of Service and two representative staff from within the Unit, Members are asked to approve the nomination of the Chairman of the Leisure & Community Development Committee or their nominee at the event.

Recommendation:

It is recommended that the Council notes the success of the Sports Services Unit in being included in the shortlist of finalists for award in the 2019 APSE Service Awards, and approves the nomination of the Chairman of the Leisure & Community Development Committee or his nominee to attend the APSE Awards Dinner on 12th September 2019.

Correspondence has been received from the Department of Health requesting that the Council supports Organ Donation Week, 2nd – 8th September 2019, by agreeing to light up the Council Offices pink. In consultation with the Council’s Civic Events Officer, it is proposed, that if approved, this light up would take on Monday 2nd September 2019.

Recommendation:

It is recommended that the Council agrees to this request.

PROMOTING ORGAN DONATION IN NORTHERN IRELAND

As you may be aware, the Department launched a policy statement in December 2018 that provides guidance on the Department’s statutory duty to promote organ donation and transplantation. A copy of the policy statement can be found at https://www.health-ni.gov.uk/sites/default/files/consultations/health/organ-donation-policy-statement.pdf

A commitment in the Policy Statement is to establish a Northern Ireland Organ Donation Steering Group to oversee the implementation of the Policy and to recruit an Organ Donation Promotion Manager, who will drive forward the work of the Policy, including working with Local Government to engage with communities – this will include finalising a Code of Practice for Local Councils.

Work is progressing to fill this important post but the successful candidate will not be in place before this year’s Organ Donation Week, which is scheduled to take place between 2-8 September. That being the case, I am contacting you to ask that you consider what can be done in your Council area to promote organ donation and transplantation during this week.

One of the issues we would be particularly interested in is whether you could light up any iconic buildings in pink to mark the week. Belfast City Hall has already been confirmed by one of our stakeholders and we are actively seeking confirmation from other similar buildings. I am sure you can appreciate the impact that having a series of buildings across the country lit up during this week would have.

If any events are organised, I would be interested to hear about them in order that a co-ordinated approach to promoting events can be developed.
