Licensing Sub-Committee – Thursday 8th August 2013
Bulgarian Food Shop Sophia, 42 Queensway, W2 (Lancaster Gate Ward / Bayswater Stress Area) – Granted under delegated powers prior to the hearing. Christopher’s, 18 Wellington Street, WC2 (St James’s Ward / West End Stress Area) - Granted under delegated powers prior to the hearing. The Italian Restaurant, Ground Floor, 16 Irving Street, WC2 (St James’s Ward / West End Stress Area) – Application by the Licensing Authority (Inspectorate Team) for a review of the premises licence. This was sought in order to prevent crime and disorder as the Licensing Authority was of the view that there had been a series of breaches by way of unauthorised sales of alcohol on the premises. The Sub-Committee had concerns that alcohol had been sold whilst the premises were unlicensed from 18 June until 16 July 2013. Having carefully considered the legal position, however, Members considered that the action they could take was limited in respect of the allegation that there had not been a DPS at the premises since 12 February because although, as the Licensee’s Representative agreed, the DPS had wanted to resign in February, the notice that he had signed did not comply with Section 41 of the Licensing Act 2003 which sets out the relevant procedure
when an individual wishes to cease being the DPS. The licensee’s position was that he had not ceased being the DPS. Having reviewed all the evidence the Sub-Committee added the condition that ‘there shall be a personal licence holder on duty on the premises at all times when the premises are authorised to sell alcohol’. Amika, 43 South Molton Street, W1 (West End Ward / not in stress area) - Application by the Licensing Authority for a review of the premises licence. This was sought on the grounds of public safety and the prevention of public nuisance as a result of noise complaints. The Sub-Committee considered that whilst many of the 36 complaints could not be directly attributed to the premises, there was sufficient evidence to attach specific conditions to the licence and amend the hours of operation. Conditions attached included that no alcohol shall be consumed more than 30 minutes after the permitted hour for the supply of alcohol and that all windows and external doors shall be kept closed after 22:00 hours, or at any time when regulated entertainment takes place, except for the access and egress of persons. The existing hours on the licence permitted unrestricted private entertainment and 24 hour a day opening 7 days a week. The Sub-Committee reduced the hours for private entertainment to those permitted for regulated entertainment Monday to Saturday 09:00 to 03:00 and Sunday 12:00 to 23:00 and opening hours Monday to Saturday 09:00 to 03:30 and Sunday 08:00 to 01:00.
