The Juvenile Justice (Care and Protection of Children) Act, 2015 Passed

The Juvenile Justice Act, which allows children aged 16 to 18 years and in conflict with law to be tried as

adults in cases of heinous offences, finally comes into force on January 15, 2016.

The Act, was passed by the Rajya Sabha in the winter session of parliament, received President Pranab

Mukherjee’s assent on December 31, 2015.

The Ministry of Women and Child Development has passed orders stating that the Juvenile Justice (Care

and Protection of Children) Act 2015 will be enforceable from January 15, 2016.

Under the Juvenile Justice Act 2015

Juveniles between 16 and 18 years of age, who are found guilty of committing heinous offences

through a preliminary inquiry by the Juvenile Justice Board, will be sent to a children’s Court that

can pronounce the child guilty.

Such Juveniles can be detained in a place of safety until they reach the age of 21.

If still not found to have been reformed by 21, they can be sent to jails housing adults.

It specifies imprisonment up to seven years and fine up to Rs. 1 lakh for giving a child any

intoxicating liquor, narcotic, drug, tobacco and psychotropic substances.

Odd-Even scheme Launched

The ambitious odd-even scheme, set to roll out from January 1, will have out of its ambit CNG-certified

vehicles, two wheelers, cars being driven by women drivers and those carrying the differently abled,

Chief Minister Arvind Kejriwal said. Violators would attract a penalty of Rs 2,000, he said. The car

rationing scheme would be applicable from 8 AM to 8 PM on all days except Sunday and on cars with

NCR and other states’ registration number plates, Kejriwal said. Cars being driven by a woman alone or

even while being accompanied by children up to the age of 12 would be exempted while cases of

medical emergencies would be treated on “basis of trust”, the CM said.

Urban development minister M Venkaiah Naidu announced the first list of 20 cities to be developed as

Smart Cities, with Bhubaneswar topping the list and Pune and Jaipur coming in second and third

respectively.

The others on the list include Surat, Kochi and Ahmedabad.

These cities will be developed to have basic infrastructure through assured water and power supply,

sanitation and solid waste management, efficient urban mobility and public transport, IT connectivity, e-

governance and citizen participation.

These are the 20 cities named in the first list

Bhubaneswar, Pune, Jaipur, Surat, Kochi, Ahmedabad, Jabalpur, Visakhapatnam, Solapur,

Davanagere, Indore, New Delhi, Coimbatore, Kakinada, Belgaum, Udaipur, Guwahati, Chennai,

Ludhiana, Bhopal

The government plans to build these smart cities by 2022 to help accommodate its swelling urban

population, which is set to rise by more than 400 million people to 814 million by 2050.

The Centre and states will equally split the overall cost of the project estimated at Rs 96,000 crore. The

central government will provide on an average Rs. 100 crore per chosen city per year. The project cost of

each smart city will vary depending upon the level of ambition, model, capacity to execute and repay.

Insurance Industry of India consists of 52 insurance companies of which 24 are life insurance business

and 28 are non – life insurance companies. (As per August , 2015 update)

Among the life insurers, Life Insurance Corporation (LIC) is the sole public sector company. Apart from

The oldest existing insurance company in India is National Insurance Company, which was founded in

1906 and is still in business. The Government of India issued an Ordinance on 19 January 1956

nationalized the Life Insurance sector and Life Insurance Corporation (LIC) came into existence in the

same year. But LIC starts its operations from 1 September, 1956.

To invest the funds of the Corporation in such manner as the Corporation may think fit and to

take all such steps as may be necessary or expedient for the protection or realisation of any

investment; including the taking over of and administering any property offered as security for

the investment until a suitable opportunity arises for its disposal;

To acquire, hold and dispose of any property for the purpose of its business;

To transfer the whole or any part of the life insurance business carried on outside India to any

other person or persons, if in the interest of the Corporation it is expedient so to do;

To advance or lend money upon the security of any movable or immovable property or

otherwise;

To borrow or raise any money in such manner and upon such security as the Corporation may

think fit;

To carry on either by itself or through any subsidiary any other business in any case where such

other business was being carried on by a subsidiary of an insurer whose controlled business has

Co-insurance – When insurance companies shares risks between them known as CoInsurance or

Dual Insurance – If a person has taken more than one policies for specific purpose orrisks having

Principal of Utmost Good Faith

Both parties, insurer and insured should enter into contract in good faith

Principle of Insurable Interest

In case of life insurance spouse and dependents have insurable interest in the life of a

person.Corporations also have insurable interests in the life of it’s employees

In case of life or marine insurance, insured must be the owner both at the time of entering

Insured can’t make any profit from the insurance contract. Insurance contract is meant

for coverage of losses only

Indemnity means a guarantee to put the insured in the position as he was before accident

Principle of Contribution

In case the insured took more than one insurance policy for same subject matter, he/she can’t

make profit by making claim for same loss more than once

For example – Raj has a property worth Rs.5,00,000. He took insurance from Company A

worth Rs.3,00,000 and from Company B – Rs.1,00,000.In case of accident, he incurred a loss of

Rs.3,00,000 to the property. Raj can claim Rs. Rs.3,00,000 from A but after that he can’t make profit by

making a claim from Company B. Now Company A can make a claim from Company B to for proportional

loss claim value.

Principle of Subrogation

After the insured gets the claim money, the insurer steps into the shoes of insured. After making

the payment insurance claim, the insurer becomes the owner of subject matter.

For example :- Ram took a insurance policy for his Car. In an accident his car totally damaged. Insurer

paid the full policy value to insured. Now Ram can’t sell the scrap remained after the scrap.

Principle of Loss Minimisation

This principle states that the insured must take all the necessary steps to minimize the losses to

inured assets.

For example – Ram took insurance policy fo his house. In an cylinder blast, his house burnt. He should

have called nearest fire station so that the loss could be minimised.

Principle of Cause Proxima

Word “Cause Proxima” means “Nearest Cause”

An accident may be caused by more than one cause. In case property insured for only

one cause. In such case nearest cause of the accident is found out.

Pure Insurance Products

Term Plans:

Cheapest insurance & Covers only the risk of your dying

You pay premium year on year to the insurance company and if you die, the insurance amount,

called the Sum Assured, is paid out to the nominees. If you survive, you don’t get anything and

lose the yearly premiums you paid.

The premium for such policies will obviously be more as compared to pure term plans.

Insurance-cum-Investment Products

As the name suggests, these are plans that provide insurance and along with it return on investments.

Endowment Plans: Take a term plan and add an offer of some returns on the premiums you pay – that is

an endowment policy for you. If you survive the policy term, you get the sum assured plus the returns

and if you die during the policy tenure, you still get the sum assured plus some returns. To get these

returns along with the life cover, you end up paying more premium.

With-profit endowment plans: These plans share the profits the insurance company makes each year

with the policyholder. So they offer more returns than without-profit endowment plans and are more

expensive as well – that it, for all parameters considered same, the premiums will be higher than

without-profit endowment plans.

Without-profit endowment plans: These plans do not participate in the profits the insurance company

makes each year. Apart from the sum assured, you could possibly get a loyalty bonus, which is a one-

time payout made in appreciation of your sticking to the insurance company.

Whole-life plans: Term plans, endowment plans and money back plans offer insurance cover till a

specified age, generally 70 years. Whole-life plans provide cover throughout your life. Usually, the

policyholder is given an option to pay premiums till a certain age or a specified period (called maturity

age).On reaching the maturity age, the policyholder has the option to continue the cover till death

without paying any premium or encashing the sum assured and bonuses.

Money-back plans: Money-back plans are variants of endowment plans with one difference – the

payout can be staggered through the policy term. Some part of the sum assured is returned to the

policy holder at periodic intervals through the policy tenure. In case of death, the full sum assured is

paid out irrespective of the payouts already made.

Unit-linked insurance plans (ULIP): ULIP give you greater control on where your premium can be

invested. Think of them like mutual funds. The annual premium you pay can be invested in various types

of funds that invest in debt and equity in a proportion that suits all types of investors. You can switch

from one fund plan to another freely and you can also monitor the performance of your plan

easily. There are various charges to be aware of in a ULIP and is suitable for those who understand the

stock market well. Of late, ULIPs qualified as the most abused insurance plan.

Investment Products

Pension Plans:

Investment options that let you set up an income stream in your post retirement years by giving

away your savings to an insurance company who invests it on your behalf for a fee.

The returns you get depends on a host of factors like how much you contributed and when is it

that you started, the number of years when you want the money to come to you and at what

age that starts.

When you buy the pension plan contract, if the payment to you (called annuity) starts

immediately it is called an immediate annuity contract. However, if the payout starts after some

years of deferment, it is called a deferred annuity.

Insurance Ombudsman scheme

Introduction:

The Insurance Ombudsman scheme was created by Government of India for individual policyholders to

have their complaints settled out of the courts system in a cost-effective, efficient and impartial way.

There are 17 Insurance Ombudsman in different locations and you can approach the one having

jurisdiction over the location of the insurance company office that you have a complaint against.

Objective : To provide a forum for resolving disputes and complaints from the aggrieved insured public

or their legal heirs against Insurance Companies, the Government of India, in exercise of powers

conferred on it u/s 114(1) of Insurance Act, 1938 framed “Redressal of Public Grievances Rules, 1998”,

which came into force w.e.f. 11th November, 1998.

Features of Insurance Ombudsman:

A representation should be made to the Insurance Company and either an unsatisfactory reply

should have been received or the representation should stand as un-replied for at least 1

month.

The complaint must be lodged within 1 year of the events.

The total relief sought must be within an amount of Rs.20 lakhs.

The subject matter of the complaint should not currently be or have earlier been before a

Court/Consumer Forum.

No fees / charges are required to be paid.

Any aggrieved individual who has taken an Insurance Policy on personal lines (or if deceased,

the legal heir(s) under such policy) can approach Ombudsman.

If the Ombudsman deems it fit in the circumstances of the case, he may award ex-gratia

payment.

Complaints pertaining to repudiation of claims totally or partially, delay in settlement of claims,

any dispute on the legal construction of the policies in so far as such disputes relate to claims,

disputes regarding premiums paid / payable and non-issue of insurance documents.

Insurance on personal lines means a policy taken or given in an individual capacity, e.g. life

insurance, personal accident insurance, mediclaim insurance, insurance of personal property of

the individual such as motor vehicle, household articles, etc.

You can write complaint to the Ombudsman about:

Any partial or total repudiation of claims by an insurer

Any dispute about premium paid or payable in terms of the policy

Any dispute on the legal construction of the policies as far as it relates to claims

Delay in settlement of claims

Non-issue of any insurance document to you after you pay your premium

You can approach the Ombudsman with complaint if:

You have first approached your insurance company with the complaint and they have not

resolved it OR not resolved it to your satisfaction OR not responded to it at all for 30 days.

Your complaint pertains to any policy you have taken in your capacity as an individual and

The value of the claim including expenses claimed is not above Rs 20 lakh.

The settlement process Recommendation:

The Ombudsman will act as counsellor and mediator and

Arrive at a fair recommendation based on the facts of the dispute

If you accept this as a full and final settlement, the Ombudsman will

Inform the company which should comply with the terms in 15 days

Award:

If a settlement by recommendation does not work, the Ombudsman will:

Pass an award within 3 months of receiving the complaint and which will be a speaking award

with the detailed reasoning and Binding on the insurance company but Not binding on the

policyholder

The Ombudsman can also award an ex-gratia payment

Once the Award is passed:

You have to accept the award in writing and the insurance company has to be informed of it

within 30 days and

The Insurance Company has to comply with the award in 15 days after that.

Highlights of IRDAI (Transfer of Equity Shares of Insurance Companies) Regulations, 2015

According to the notification, all investors (where there are one or more investors in an

insurance company) jointly should not hold more than 25 percent of the paid-up equity

share capital of the insurance company.

Further, with reference to the proposals pertaining to the transfer of shares in insurance

companies, the authority said it might ask Indian promoters as well as foreign investors

to have minimum lock-in period for infusion of additional capital as a pre-condition for

approval.

It will also carry out its own ’due diligence’ before approving any deal for transfer of

shares of insurance companies. The applications seeking prior approval of the authority

should be accompanied by a declaration from a proposed shareholder whether the

shares are proposed to be held for his own benefit or as a nominee, whether jointly of

severally, or on behalf of others.

No registration of transfer of shares or issue of equity capital of insurance company

which will result in change in the shareholding should be made if after the transfer the

total paid-up holding of the transferee in the shares of the insurance company is likely

Important Insurance terms

Actuary: A specialist in the mathematics of insurance who calculates rates, reserves, dividends

and other statistics

Annuity: An agreement by an insurer to make periodic payments which continue during the

survival of the annuitant(s) or for a specified period.

Claim: A demand made by the insured, or the insured’s beneficiary, for payment of the benefits

as provided by the policy.

Coverage: It is the range of protection that you are provided under an insurance policy.

Death Benefit: The limit of insurance or the amount of benefit that will be paid in the event of

the death of a covered person.

Deductible: The amount you have to pay out of pocket for expenses before the insurance

company will cover the remaining costs.

Endowment Insurance: Endowment insurance pays the sum assured upon the death of the life

insured during the policy terms or on survival to the end of the policy term.

Exclusive: Things that are not covered under the policy

Indemnity: Restoration to the victim of a loss by payment, repair or replacement.

Insurable Interest: Interest in property such that loss or destruction of the property could cause

a financial loss.

Maturity value: It is the amount the insurance company has to pay you when the policy

matures. This would include the sum assured and the bonuses.

Paid-up value: If you stop paying the premiums, but do not withdraw the money from your

policy, the policy is referred to as paid-up.

Peril: It is the causes of the possible loss or damage.

Policy: Policy is the legal document issued by the insurance company that outlines the general

terms and conditions of the insurance.

Premium: It is the amount you need to pay to the insurance company.

Reinsurance: In effect, insurance that an insurance company buys for its own protection. The

risk of loss is spread so a disproportionately large loss under a single policy doesn’t fall on one

company. Reinsurance enables an insurance company to expand its expanding volume; secure

catastrophe protection against shock losses; and withdraw a specified time period.

Renewal: The automatic re-establishment of in-force status effected by the payment of another

premium.

Rider: It is an optional feature that can be added to a policy. You will have to pay an additional

premium to avail this benefit.

Subrogation: It is the right for an insurer to pursue a third party that caused an insurance loss to

the insured. This is done as a means of recovering the amount of the claim paid to the insured

for the loss.

Sum assured: It is the amount of money an insurance policy guarantees to pay before any

bonuses are added. In other words, sum assured is the guaranteed amount you will receive.

Halfway through the policy, you might want to discontinue it and take whatever money is due to

you.

Surrender value: This is the amount payable at the end of specified duration. These amounts

are fixed and predetermined.

Insurance Settlement: A payment on an insurance claim. That is, when a valid insurance claim is

made, the insurer makes a payment to the policyholder. This is call the insurance settlement.

Lapse: Termination of a policy due to failure to pay the required renewal premium.

Term insurance: It is the most traditional life insurance policy wherein the insured gets death

benefit if any contingency happens within the policy term. The insured is, however, not entitled

to receive any survival benefit if he outlives the policy term.

Underwriting: The process of selection risks for insurance and determining in what amounts and

on what terms the insurance company will accept. Unlike a term insurance cover, if you live, an

amount will be paid to you on maturity of the plan.
