INSTRUCTIONS

P.REPARATION OF DISTRIBUTION SIrnET AND ORDER IN CoUNCIL

1. Requests for ordinary copies NOT to exceed twelve coples for an individual office. Anything above this amount must be handled within the Department concerned. No additional copies will be supplied....2fter the initial distribution; if extra copies are requiroo, Departments :MUST make their own from copies originally provided.

2. Complete addresses to he given in the distribution sheet for_ordinary and certified copies, i.e., name, street address, zone number, location. (See sample below.)

3. Gazette reference to be completed-an "X" to be made in the appropriate square.

4. Distribution sheet to be signed by Departmental official concerned.

5. One copy ooIy of the distribution sheet to accompany Order in Council.

6. Distribution sheet to be stapled to the back of the Order in Council, NOT on the front. The front of the Order must be left clear with the exception onIy of any explanatory memorandum or note.

7. Distribution of copies will be made onIy in accordance with the requirements set forth in the distribution sheet. Departments must co-.-ordioate arrangements one with the other to ensure complete coverage.

8. It is unnecessary to make provision in an Order in Council for the distribution of certified copies. The requirements for certified copies should he included on the distribution sheet.

9. Orders in Council exceeding single page must be properly assembled in the following order: First page (original), second page (original), etc., etc. (original), with ditto sheets in same order, i.e., originals together, dittos together.

10. If an Order- is to be numbered in a particular sequence, please attach a note to this efI~t.

11. The numerals of they ear to be typed in the Order in Council when it is prepared, e.g. dated this day of , A.D. 19§.

12. It is important that the protective sheet be reinserted after the Order is typed.

13. Refer to Regufations Act and regulations thereunder when preparing orders requiring regulations. Rules should be strictly followed.

14. In the preparation of Orders in Council requiring more than one page, the last page must contain at least three lines of the body of the Order in Council.

As requested in your recent telephone call I have checked our file on the reserve of Lot 1729, Range 3, Coast District, at Hartint s Cove, Bella Bella.

Apparently I 1-las to get a second consent letter from the o\omers of Lot 1105 because of an additional 50-foot strip to be added to Lot 1729. The owners delayed giving this consent until we could fjno. out for them the true ownership of the footbridge leading to their island (Lot 1105). It was claimed" by some reo,ple that this bridge belonged to the B.C. Department of High1-lays but they never confirmed this. \

l It was on our inability to establish o1-mership of the\ bridge that the entire business bogged down. If it is no,v necessary to obtain the consent letter we shall have to start again at the beginning, ,dth a Cerqficate of Encumbranoes and a ne,1 approach to the present owners of Lot 1105. Will you please advise whether you feel this is the course to be taken.

Monuments shoulO be set, when possible on the produotion shorewards of straight line boundaries intersecting high water mark. It would appear that about 5 oornerswill need referencing.

Dear Sir:

This is fUrther to my letter of May 2nd and to recent conversa­tions between Mr. Rutherford and Mr. Grimble regarding a proposed small-boat harbour near the Bella Bella Indian village.

The plan sent with my previous letter indicated the existence of certain improvements (private floats, etc.) within the area requested as a reserve to this Depa~tment. These improvements are either owned, or controlled, by Mr. Martin and will all be removed when this Department develops the small-boat harbour.

It is our intention to have the survey made, when authorized, so that the area shown in green on the plan will be excluded and will therefore remain available for lease by Mr. Martin. Should any objections be raised hy other squatters in the area involved, such objections will be accepted as being the responsi­hUity of this Department.

The matter of this reserve was discussed with

the Superintendent of Lands with respect to the apparent

illegal occupation of a portion of the foreshore and other

existing improvements. The Superintendent advised that

Mr. Grimble (Department of Public Works, Canada) could

be advised to the effect that this Department would proceed

with the establishment of the reserve, subject to survey,

without an inspection of the area if the Department of

Public Works, Canada would take the responsibility of

dealing with the owners of the existing improvements. . {J" t'/'~'1d

Mr. Grimble was so advisediand stated that the

majority of the existing improvements were either owned

or controlled by the Martins who were only too pleased

to co-operate with the Department of Public Works, Canada

as the construction of the small boat harbour would be of

considerable advantage to ~. Martin. Mr. Grimble further

advised that it was the intention of Mr. Martin to legalize

his occupation after the area required by the Department of

Public Works, Canada has been surveyed.

Mr. Grimble will forward a letter to this effect

by todays mail.

This Department proposes to construct~ small-boat harbo~ near the Bella Bella Indian village/as indicated on the enclosed plans, and for which we wil.l require a foreshore reserve as outlined in red.

Certificate of Encumbrances for Lot 1105 is enclosed, along with letters of consent from Mr. Martin and the Shell Oil Co. being upland owners of Lot 1105. The . remainder of the. adjacent upland property is Indian Reserve land but we have not yet requested their consent.

Would you please advise whether there will be any further re­quirements, other than written consent from the Indian COmmissioner, before the necessary survey could be authorized in connection with acquisition of this reserve.
