The budget closes the $270 million gap by taking $122 million from one time savings and $182 million from the state's Rainy Day Fund. Legislative leaders said this is a prudent budget that will prevent a government shutdown July 1. Opponents argue that by using one time monies to balance the budget, the state will be in a bigger hole next year. Legislators did not pass any of the revenue proposals submitted by the governor. Proponents argue the Rainy Day Fund is designed to help in an issue such as this. The governor has proposed taking some money from the fund but not in the amount passed Thursday. If there is a veto, it will take two thirds of the House and Senate to override, not the simple majority needed for legislative bills. AGC WINS BIG IN UNANIMOUS SUPREME COURT DECISION ON CLEAN WATER ACT JURISDICTIONAL DETERMINATIONS The U.S. Supreme Court issued a ruling this week that will allow the construction and development industries with a way to respond immediately to overly aggressive assertions by the federal government that the property they want to build contains jurisdictional "Waters of the United States" (WOTUS). A "jurisdictional determination" significantly impacts how land may be used and dramatically raises the cost, and often reduces the feasibility, of constructing critical infrastructure. Associated General Contractors of America submitted a joint "friend of the court" brief in the case, US Army Corps of Engineers v. Hawkes Co., making a strong case for why it is vital for contractors to know with certainty whether their projects contain WOTUS. AGC was the only trade association to advance the commercial construction industry's interest in the outcome of this case and, once again, AGC has succeeded in changing facts on the ground. This decision will have a material impact on the way that the Section 404 permit program actually functions. More details and history is available here. “In granting the stay, the Court described the rule as ‘facially suspect.’ This solidly reaffirms our belief that we have a strong case on the merits and that the courts will ultimately strike down this burdensome regulation,” Attorney General Morrisey said. “We look forward to continuing to challenge this rule’s legality in court and are confident we will prevail.” Attorney General Morrisey has been a national leader in challenging the “Waters of the United States” rule. These efforts have included drafting rulemaking comments opposing the rule, taking a leadership role in litigating against the rule, and seeking the stay from the Sixth Circuit. Thirty-one (31) states and state agencies have challenged the legality of the rule as violating the Clean Water Act, the Administrative Procedure Act and the U.S. Constitution. It also usurps the States’ primary responsibility for the management, protection and care of intrastate waters and lands. That coalition now includes West Virginia, Alabama, Alaska, Arkansas, Colorado, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Michigan, Mississippi, Missouri, Montana, Nebraska, Nevada, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Wisconsin and Wyoming and the North Carolina Department of Environment and Natural Resources, the New Mexico Environmental Engineer, and the New Mexico State Engineer. 2016-2017 BOARD OF DIRECTORS BALLOTS TO BE SENT TO CONTRACTOR MEMBERS Contractor members will receive an official ballot for election of officers and directors of the CAWV for 2016-2017. The month of June has been traditionally designated as National Safety Month. Over the years safety has grown to be a very important part of any successful business. BOONE COUNTY BUSINESS PARK BID RAISES QUESTIONS Gov. Earl Ray Tomblin, in his January State of the State address, proposed building a business park on the 12,000-acre former mine site in Boone County. The first step is to put out for bid a 2.6 mile, four-lane access road to the site which, depending on what route is selected, could cost upwards of $100 million. The WVDOH has advertised a P3 project with RFPs due June 15 and bids from the selected proposers due in October. The successful contractor will be paid $833,000 a month and completion time is four years. If the project is $100 million, the contractor will be financing $60 million over the next six years. Using this example, the project will cost the WVDOH $10 million a year for the next 10 years. The CAWV Board of Directors discussed the project and questioned whether there is enough money in the State Road Fund to pay $100 million for this project since the West Virginia Legislature did not pass S.B. 555, the $315 million highway funding bill, in this year’s legislative session. A number of other questions have been raised related to the project, including plans, permitting and location of the road.
