Lawyers to give closing arguments in marathon bomber’s caseBOSTON (AP) — It’s the last chance for

prosecutors and lawyers to make a case for life in prison or the death penalty for Bos-ton Marathon bomber Dzhokhar Tsarnaev when they present their closing arguments to the jury.

The jury is expected to begin its deliber-ations late Wednesday after it hears closing arguments and instructions from the judge.

Judge George O’Toole Jr. told jurors be-fore closing arguments that they only have two choices for punishing Tsarnaev: life in prison without the possibility of release or the death penalty.

“The choice between these very serious alternatives is yours and yours alone to make,” the judge said.

During the four-month trial, prosecu-

tors have portrayed Tsarnaev as a callous, unrepentant terrorist who carried out the deadly attack with his radicalized older brother, Tamerlan. They say he deserves the death penalty.

Tsarnaev’s lawyers admitted he partici-pated in the bombings, but told the jury he was “a good kid” who was led down the path to terrorism by Tamerlan, who wanted to punish the U.S. for its actions in Muslim countries. They’ve asked the jury to spare his life.

Three people were killed and more than 260 were injured when two bombs exploded near the marathon’s finish line on April 15, 2013.

Tsarnaev, 21, was convicted by a federal jury last month of all 30 counts against

him, including use of weapon of mass de-struction. The same jury must now decide his punishment.

In their opening statement in the pen-alty phase, Tsarnaev’s lawyers urged the jury to sentence Tsarnaev to life in prison, calling it the most appropriate punishment for someone who was 19 when he commit-ted the crime. They said a life sentence also would help the families of his victims, who wouldn’t be subjected to years of appeals and public attention that would almost cer-tainly result if he is sentenced to death.

The defense showed the jury photos of the federal Supermax prison in Florence, Colorado, where Tsarnaev likely would be sent if he is sentenced to life. There, his lawyers said, he would remain, locked in

his cell 23 hours a day, living an austere, solitary existence until the day he dies, denying him the martyrdom he apparently wanted.

Prosecutors, however, said death is the only appropriate punishment for Tsarnaev. They said he was an equal partner with his brother in planning and carrying out the bombings. He planted his bomb behind a group of children, killing 8-year-old Martin Richard.

“Nothing will explain his cruelty and his indifference,” prosecutor Nadine Pellegrini said.

Jurors must be unanimous in their deci-sion to give Tsarnaev the death penalty. If even a single juror votes against death, Tsarnaev will be sentenced to life in prison.

Police shoot man suspected in 4 hammer attacks in ManhattanNEW YORK (AP) — A man suspected of at-

tacking four people with a hammer this week was shot and wounded by police Wednesday after he pulled a hammer from a bag and lunged at officers who approached him on the street near Penn Station, police said.

Manhattan Chief of Detectives William Aubry said the two officers were responding to an unre-lated assault when they noticed the suspect and started to follow him.

“When he turned around, he violently started swinging,” Aubry said. An officer backed away and fell to the ground.

The other officer fired four times, striking the suspect twice. Police say the man is in critical but stable condition at a hospital.

The shooting took place shortly after 10 a.m. blocks from Madison Square Garden in midtown Manhattan. Traffic was stalled as police investi-gated the shooting. A hammer lay in the middle of the intersection at 37th Street and Eighth Avenue.

Police Commissioner William Bratton said investigators have an abundance of video of the incident. He commended the officers, saying it’s

possible one saved the other’s life.Police said the man is the same person who

attacked four people with a hammer two days earlier.

On Monday night, a 34-year-old woman was struck in a park. A few hours later, a 28-year-old woman in Union Square noticed a man looking at her and he then pulled a hammer out of a bag and bashed her head. Another attack happened about 10 minutes later when a 33-year-old was struck from behind. Officers also discovered that a fourth attack happened earlier Monday in a different part of the city. A 20-year-old man was injured.

Throngs of onlookers gathered as police set up a crime scene.

Anthony O’Grady, 26, said there was a chase and then the suspect turned around.

“And they shot him,” O’Grady said. He said he was in Union Square earlier in the week when one of the hammer attacks occurred.

The investigation is ongoing. The officer who was backing away from the suspect suf-fered head and back injuries after she fell to the ground.

5 found dead in Arizona home in suspected murder-suicide

TUCSON, Ariz. (AP) — Police suspect the shooting deaths of five people discovered in a southern Arizona home are a murder-suicide.

Officers responded to a call from a man who went to the single-story house in Tucson and they found the bodies about 6 p.m. Tuesday, police Sgt. Pete Dugan said.

Details are sparse, but all of the dead had “obvious signs of gunshot trauma,” he told The Associated Press.

Authorities aren’t actively searching for suspects because they suspect a murder-suicide, Dugan said.

“They are trying to figure what took place. Right now, it appears it was a murder-suicide, but it (the investigation) is in its initial stages,” he said.

Police got word of the bloodshed from a man who went to the house to meet someone, “peeked inside and noticed one individual who ap-peared to be deceased with multiple gunshot wounds,” Dugan said.

Investigators did not release any other information, including names or ages.

Police Chief Roberto Villasenor told the Arizona Daily Star that all five appeared to have been shot sometime Tuesday, and it didn’t appear that any of them were young children. He said the bodies were found in different areas of the house.

Villasenor said officers have been called to the home before, but details weren’t immediately available, the Tucson newspaper reported.
