Clerk of the Supreme Court of IllinoisThe Clerk of the Supreme Court is an officer appointed by theCourt (Ill. Const. 1970, Art. VI, §18 (a)), reports to the Court, andserves at the Court’s pleasure. This senior level position is theCourt’s principal case processing and records manager who oper-ates the Clerk’s main office in Springfield and a satellite office inChicago through a staff of 14 deputies which the Clerk recruits, se-lects, trains, and supervises, and by planning, developing, and im-plementing policies and procedures necessary to execute theresponsibilities of the office.As case manager, the Clerk oversees and evaluates the functioningof four distinct automated dockets, and all associated processes, toensure compliance with Supreme Court Rules and effective track-ing and scheduling of cases from initiation to issuance of mandatesand final orders. Relatedly, the Clerk interprets and applies rele-vant rules and compiles, analyzes, and reports statistics on theCourt’s case load. As records manager, the Clerk is responsible forthe Court’s active and closed files and permanent records, datingto 1818. The Clerk maintains the roll of attorneys, which includesthe licensing process; registers and renews professional servicecorporations and associations, and limited liability companies andpartnerships engaged in the practice of law; files judicial financialdisclosure statements required of state court judges.The Clerk routinely writes reports for the Court on legal and ad-ministrative subjects, including a body of memoranda on attorneydiscipline cases ready for disposition each term of Court; and initi-ates or undertakes projects as directed. The Clerk fosters criticalworking relationships with offices of the judicial branch, SupremeCourt agencies, and state and county departments.The foregoing description of responsibilities is not exhaustive, andit is expected that the incumbent possesses the analytical, organi-zational, communication, and legal skills necessary to execute re-sponsibilities at the highest level of competency.Education and Experience� Juris Doctor degree from ABA approved law school and licenseto practice law in Illinois or other state or territory of the UnitedStates or District of Columbia.� A minimum of 8 years of progressively responsible administra-tive experience in public or private sector which provided a thor-ough understanding of the functioning of an organization and ageneral understanding of court operations, including a minimum of5 years of progressively responsible, substantial, and successful ex-perience in a management or supervisory role. Howdy, PartnerTiffany Farber is a solo practitioner who has been practicing law since 2008. As someonewho has been through transition in her career, she understands the challenges legalprofessionals in this situation face.

So, you’ve made the decision to start your own law practice. Congratulations, step one iscomplete! Chances are your head is spinning from thinking about the things you need to doto get started. Starting a practice can be overwhelming at first, especially if you plan to havea full-time practice.

When you are feeling overwhelmed, organization is usually the key to decreasing your stress.The first step I take when I need to get organized is to make a list of things to consider. Thenext couple of blog posts will cover the things that I think you should consider when makingyour list. Your challenge is to simply think about my suggestions. If you like them, add themto your list and flesh them out according to what is right for you. This week, I ask you toconsider whether or not you want to be a solo or work with a partner.

This question requires some serious soul searching. If you are thinking about partnering, thefirst question to ask yourself is who your partner will be.

Remember how frustrating it was when you argued with your college roommate about whowould clean the bathroom? I imagine that it’s much worse when you are arguing with yourbusiness partner about how much money you are owed or how the office files should be kept.You need to think really hard about your personality type and how that will or will not meshwith a person that you may have in mind. The last thing that you want when you are juststarting out is to walk into a land mine.

You will also want to ask yourself whether your partner will be someone who has neverstarted a law practice. It can be a plus to have someone learning along side of you, whichcan make you feel less alone. But, if you partner with someone who has never started apractice, it may take some time for both of you to learn the ropes. In the alternative, yourpartner can be someone who has experience running a practice. This may be a good ideabecause you can learn a lot from that person, but they may also require a bigger piece of thepie when you bring in fees.

If you are going to partner up, you need to decide if the arrangement will be a formalpartnership or other type of arrangement. There are obvious risks involved in a formalpartnership, and there is paperwork that needs to be done. I don’t profess to be an expert inpartnership formation and everything that goes along with it, but there are certainly people outthere who are experts. I would recommend asking someone who has already formed apartnership about their arrangement, and how they came to it.

There are other options that don’t involve partnership in the traditional sense. You can simplyshare office space with another attorney. This can be a good way to network and getreferrals, but that other attorney may also choose to have nothing officially to do with yourfirm and focus on his or her own practice. You may also decide to co-counsel with anotherattorney and split fees. This can be a good arrangement, but you will need to negotiate withthe other attorney and clear this arrangement with the client.

The decision to have a partner can have a great impact on the trajectory of your practice. Itwill dictate what sorts of clients you have, where your office will be and how the administrativeaspects of the practice will be run. Having a partner can be the best decision you will evermake, or it can be a disaster. You should really think it through before you make your finaldecision.

IS COMPASSION ONYOUR RESUME?

It was brought home to merather forcefully this weekhow important a paralegalcan be in a client’ís life. Ourbusiness is the law and itsapplications yet it can beoverlooked that the law isapplied to living, breathingpeople.

I received a call from aclient. The client is no longerworking due to problems withemployment, is under finan-cial stress, has recently movedand is considering divorceand is facing surgery.Because of all these factors Iwas one of the few persons tospeak with the client over aperiod of days. What theclient needed more than pro-cedural information, contactwith counsel or other infor-mation was just someone tolisten who had some knowl-edge of his problems. Theconversation did not last longbut by the time we concludedour conversation the tone wasdefinitely more upbeat thanwhen it began. Those fewminutes of my time were partof my work day. For theclient it was more. The com-ments I made reflected con-cern and injected some com-mon sense to thoughts thathad been dwelled upon atlength by the client.

Will I bill the client forthat time, probably not. I willrecord it but more likely thannot the client will not see thetime spent as a charge. This isthe part of the paralegal posi-tion not usually listed onresumes. Good listener, car-ing.

In paralegal classes we aretold we may be primary con-tact with clients and we mayas a part of our duties inter-view witnesses to solicit infor-mation. We learn how toidentify ourselves, what basicinformation to gather and theformat in which we may pre-pare it. We learn how toresearch the issues of thematter. What we are nottaught is that speaking with aclient may involve a box ofkleenex and many breaks. Orspeaking with a witness maymean chatting to make thewitness comfortable with whoyou are regardless of the mat-ters you will be discussing.Does this mean every witnessor client you speak withshould be aware of your lifehistory? No. It means youmust use your judgment whenyou speak with people. As aparalegal who must contactwitnesses in employment liti-gation matters I am awarethat many potential trial wit-

nesses are concerned aboutpotential repercussions in theworkplace. The law says theemployer cannot retaliatewhen an employee is subpoe-naed to testify. But this is reallife and the trial witnessesconcerns are not imaginary.Simply to say that I am awareof those concerns and relatethat to the witness can make adifference.

Paralegals involved in con-

tacting and interviewing wit-nesses should learn care andcompassion. Approachingpotential witnesses as well asspeaking with clients can betricky. In many instances weare asking for details of theirlives that are intensely pri-vate, perhaps not fullyrevealed to anyone before.How we as paralegalsapproach these people canmean the difference in

obtaining important and use-ful information or alienatingthem. How we receive theinformation can mean a greatdeal to the individual. Thatwe not judge a person by theinformation received fromthem is in many instances veryimportant to the person.Probably the most importantthing to remember is to cometo each person with an openmind. Be genuinely interest-

ed and really listen.Remember the old adageғlisten with both earsӔ.DonՒt be working on yourgrocery list, thinking aboutwhat you need to do whenyou get home or what you aregoing to have for lunch.Listen, take notes, make com-ments that show you haveheard what is being said andengage with the other per-son.\

While you may not putcompassion in capital letterson your resume it is an impor-tant skill for many paralegals.
