PURSUANT TO REQUIREMENT OF THE UNIFIED DEVELOPMENT ORDINANCE, THE BOARD OF COMMISSIONERS FINDS THAT THE FOLLOWING STANDARDS ARE RELEVANT IN BALANCING THE INTEREST IN PROMOTING THE PUBLIC HEALTH, SAFETY, MORALITY OR GENERAL WELFARE AGAINST THE RIGHT TO THE UNRESTRICTED USE OF PROPERTY AND SHALL GOVERN THE EXERCISE OF THE ZONING POWER.

SPECIAL USE PERMIT APPLICANT'S RESPONSE
STANDARDS GOVERNING THE EXERCISE OF THE ZONING POWER
A. Yes. The proposed Special Use Permit to allow for the sale of pre-owned, quality automobiles is suitable based on the fact that the adjacent property consists of other commercial businesses, including a Discount Tire Store, a Tires Plus, a furniture company, a Sherwin Williams, and several fast food restaurants. The subject tract of land was formerly a Quick Trip gas station.
B. No. the proposed Special Use Permit will not adversely affect the existing use or usability of adjacent or nearby property. As stated above, the subject property was formerly a Quick Trip gas station and is currently surrounded by other commercial businesses.
C. The property to be affected by the proposed Special Use Permit has reasonable economic use as currently zoned. However, the addition of a Pep Boys Auto Sales, which will be selling quality, pre-owned vehicles, will enhance the economic use of the property as it is consistent with the adjacent commercial stores. Additionally, having an Auto Plus Auto Parts will have a greater benefit to the surrounding areas than the property had when it was a Quick Trip gas station.
D. The proposed Special Use Permit will have no impact on the use of existing streets, transportation facilities , utilities, or schools.
E. Yes, the proposed Special Use Permit to allow the sale of quality, pre-owned automobiles is consistent with the policy and intent of the land use plan.
F. There are no existing or changing conditions affecting the use and development of the property on which a Special Use Permit is requested which would support disapproval of the proposed Special Use Permit. Rather, the adjacent commercial stores, including several stores related to the auto industry, will benefit from having a Pep Boys Auto Sales on the property. Moreover, the property is currently a vacant lot, and Pep Boys Auto Sales intends to renovate the space and improve its aesthetics, which will benefit the area.

LETTER OF INTENT FOR SPECIAL USE PERl\1IT APPLICATION OF AUTOPLUS AUTO CARE
Pep Boys Auto Sales ("Pep Boys") submits this letter of intent, along with its Special Use Permit Application, seeking a special use permit for approximately 2.48 acres of currently vacant land located at 4900 Stone Mountain Highway, Lilburn, Georgia 30047 (the "Property"). Pep Boys is seeking the Special Use Permit so that it may sell premium, pre-owned vehicles on the Property.
The Property was formerly a Quick Trip retail and gas station that has since been relocated. If Pep Boys' Special Use Permit is granted, Pep Boys will renovate the Property and improve its overall aesthetics. Pep Boys is a reputable company with over 1,200 service and retail locations. Based on this, Pep Boys will bring experience and expertise in the automotive industry to the Property, which will benefit the surrounding community, including many of the other adjacent commercial stores, many of which are part of the automobile industry.
Granting Pep Boys' Special Use Permit is in keeping with the adjacent areas. Pep Boys looks forward to working with the Gwinnett County Planning Division and the Planning Commission.
