IED 2010/75/EU LCPs under IED - New Aspects

• Revised scope Annex I activities

o Combustion of fuels in installations with a total rated

thermal input of 50 MW or more

• Revised scope Annex II substances (from Annex III to

Directive 2008/1/EC)

o Air discharges include fine particulate matter (PM2.5) in

addition to dust




• With regard to LCPs → stricter ELVs with transitional and flexibility

measures

• Higher deshulphurisation rates introduced, where applicable

• NOx ELV for Gas engines

• Pending ELVs

o Diesel engines

o Recovery boilers in pulp mills

o LCPs in refineries firing distillation and conversion residues

o LCPs firing gases other than natural gas

o LCPs in chemical installations using liquid production residues as

fuel




• Transitional and Flexibility measures:

o Small isolated systems, except for post-1987 permitted LCPs

≥ 500 MW – exempted from compliance with ELVs untill 2020

o District heating plants if pre-2002 permitted, ≤ 200 MW and

50% steam or hot water delivered to the public - exempted

from compliance with ELVs until 2022

However: Permit conditions based on IPPC/LCP Directives must be

complied with during these periods.




• Aggregation rules:

o For the purpose of calculating the total rated thermal

input of a combination of combustion plants units with a

rated thermal input below 15 MW shall not be considered



IED 2010/75/EU LCPs under IED - New Aspects - INVENTORY

• LCP Direcitve 2001/80/EC: Annex VIII/B

o Member States shall establish an inventory of SO2, NOx and

dust emissions FROM ALL COMBUSTION PLANTS with a

rated thermal input of 50 MW or more.

• IED: Article 72

o FOR ALL COMBUSTION PLANTS covered by Chapter III of

this Directive, Member States shall establish an annual

inventory of SO2, NOx and dust emissions......…….the type

of combustion plant: BOILER, GAS TURBINE, GAS

ENGINE, DIESEL ENGINE, OTHER (SPECIFYING THE

TYPE);



IED 2010/75/EU - Timetable

• 6 January 2011- entry into force of the IED

• 6 January 2013 – full transposition by the Member States; the IED

applies to all new installations

• 6 January 2014 - applies to existing installations previously subject

to IPPC, WID, SED and TiO2 Directives (repealed Directives)

• 6 July 2015 - applies to existing installations operating newly

prescribed activities (specified waste recovery activities, wood

preservation, and other)

• 1 January 2016 - Existing LCPs must meet IED requirements (LCP

Directive repealed)

• 30 June 2020 – end of LCP Transitional National Plan provisions

(previous NERP)

• 31 December 2023 – end of limited lifetime derogation provisions

for LCP (opt out LCPs)

• BREF documents → new legal status:

o BAT - undergo Commitology Procedure (Committee

Procedure)

o BAT conclusions - Commission Implementing Decision (BAT

as stand alone document)

o Emission limit values and other conditions in Integrated Permits → based od BAT conclusions (BATAELs – BAT

Associated Emission Levels)

IED 2010/75/EU LCP BREF document

• First BREF document for Large Combustion Plants –

2006

• Revision on-going under IED prescribed procedure

(2011 - ?)

• First draft available – June 2013



IED 2010/75/EU LCP BREF revision - scope

• Covers also LCPs for which ELVs set in Annex V (IED) are not applicable or may be reviewed:

o Gas turbines and gas engines used on offshore platform

o Co-incineration plants using solid or liquid waste

o Diesel engines

o Combustion plants firing gases other than natural gas

o Combustion plants in chemical installations using liquid production residues as non-commercial fuel for own consumption



Approval of new Refineries BREF



IED 2010/75/EU BREF for the Refining of Mineral Oil and Gas

• Best Available Techniques (BAT) adopted in October 2014 → new BREF for Refiniries published on Joint Research Center website

• BAT conclusions for the combustion units – organised better, user friendly

• Organised around primary and secondary measures for the reduction of NOx, SO2 and dust emissions



Medium Combustion Plants



Proposal for a Directive on the Limitation of

Emissions of Certain Pollutants into the Air from

Medium Combustion Plants COM(2013) 919 final

• IED unsuccessful proposals:

o Lowering threshold for combustion plants from 50MW to 20MW

o Limits on CO2 emissions from LCPs

• However:

o 18 December 2013 – European Published a proposal for a

Directive on Medium Combustion Plants

o Rathed Thermal input – between 1 and 50 MW

o Part of the review of EU Thematic Strategy on Air Pollution
