Landlords Legal Expenses and Rent Guarantee Insurance Policy Summary

Some important facts about your Landlords Legal Expenses and Rent Guarantee insurance policy aresummarised below. This summary does not describe all the terms and conditions of your policy, so pleasetake time to read the policy document to make sure you understand the cover it provides.

The insurance cover summarised in this document is provided by AmTrust Europe Limited, andadministered on their behalf by Arc Legal Assistance Ltd (We/Us/Our).

Your Landlords Legal Expenses and Rent Guarantee insurance cover is valid for the period specified inthe insurance schedule and applies to the tenancy agreement with the tenant in the property specified inthe insurance schedule.

Significant features and benefits

Advisers’ costs of up to £50,000 per claimare covered.

Advisers’ Costs to:Pursue eviction proceedings against atenant or guarantor to recover possessionof the insured property where the tenantfails to perform his obligations set out inthe tenancy agreement relating to therightful occupation of the insured property.

Significant exclusions or limitations

This insurance covers the legal costs incurred byArc Legal’s panel solicitors. You are not coveredfor any other legal representative’s costs unlesscourt proceedings are started or a conflict ofinterest arises.

It is a key condition of this insurance that theremust be prospects of success in taking legalaction before a claim for legal costs will beaccepted.

For full details of policy exclusions please refer tothe policy wording.

In summary there is no cover for:

n Claims arising from disputes between you andyour agent or mortgage lender

n Appeals without our prior written consentn Advisers’ costs incurred in avoidablecorrespondence.

The tenant must have passed a tenant referenceas defined in the policy wording and all conditionsof that reference must have been complied with.

You must have entered into an Assured ShortholdTenancy, Company Let or a written common lawresidential tenancy agreement with the tenant.

The tenancy agreement must be for a fixed termof no more than 12 months or if longer, mustcontain a break clause allowing both parties toterminate the tenancy after the first 12 months.

Legal costs to pursue:Actions for nuisance or trespass relatingto the insured property.

Legal costs to defend:Criminal actions brought against yourelating directly or solely from yourownership of the insured property.

Rent arrears owed by the tenant under thetenancy agreement and where appropriate,you are pursuing proceedings under thisinsurance to evict the tenant from theinsured property.

There is no cover for disputes with any personsother than the tenant(s) or guarantor named in thetenancy agreement.

There is no cover for claims:-n where the tenancy agreement commencesmore than 31 days after the tenant reference.

n arising from or connected to your performanceof your obligations under the tenancyagreement.

n arising from dilapidations unless the missing ordamaged items were contained within adilapidations inventory.

n falling within the jurisdiction of the RentAssessment Committee, the Lands Tribunal orthe Leasehold Valuation Tribunal.

n relating to the payment or non payment ofservice charges as defined within the Landlordand Tenant Act 1985 (as amended).

There is no cover for claims arising from a disputerelating to a tenancy agreement or any other leaseor licence to occupy property or land.

There is no cover for legal costs arising fromsomething you have done, knowing it to bewrongful or ignoring that possibility.

There is no cover if any of the significant exclusionsor limitations listed under the ‘Tenant Eviction’section apply.

An amount equal to one month’s rent is notcovered under this insurance. This is the excess.

Rent is only payable:-a) For up to 6 month’s orb) For the dates shown as the term in the tenancyagreement, (if the tenancy has been allowed toroll onto a monthly periodic term, up to expiryof any notice to bring the monthly periodictenancy to an end) whichever is the lesser; and

c) Whilst the tenant (including any unauthorisedoccupant) remains in occupation of the insuredproperty; and

d) Up to the limit of indemnity

A minimum of £250 must be in arrears before anyclaim payments are made.

Rent will be paid in accordance with the above andmonthly in arrears at a rate of 1/30th for eachcontinuous day that it is in arrears.

You will repay to us any claim payments wehave made for rent from the deposit afterdeduction of the cost of dilapidations to theinsured property by the tenant (which must beevidenced by presentation to us of a receipt forrepair/replacement work / items).

Cancellation rights (cooling off period)Within 14 days of receipt of insurance documentation you may cancel this policy if it does not meet yourneeds. Subject to your insurance adviser receiving your written advice of this, they will issue a full return ofpremium, the policy will be regarded as not having been taken up by you and will be cancelled from inception.
