III.EXECUTIVE SUMMARY Telecommunication facilities are regulated by Subsection 14-6.2(E) of the city's development code. Telecommunication facilities include antennas used for cell phone networks and other electronic communication purposes, the towers and "tower alternatives" that the antennas are mounted on, and other support facilities.
Telecommunication facilities are also subject to extensive federal regulations, and city rules must be consistent with the federal regulations. Among other important provisions, the federal regulations preclude the Planning Commission from considering possible health effects of radio frequency (RF) emissions from telecommunication facilities that comply with applicable federal radio frequency radiation exposure limits [ 4 7 Code of Federal Regulations 1.301].
The applicant owns the industrial-type building located at 1308 Apache A venue. The property is zoned C-2, but adjoins houses on R-5 lots to the north and west. There are three lattice-type towers on the property: Tower #1 and Tower #2 are mounted on the roof of the building, and Tower #3 is mounted on the ground behind the building. Each of the towers has several telecommunication antennas mounted on it.
The applicant proposes to remove the two roof-mounted towers (Towers #1 and #2), and consolidate all of the antennas on the ground-mounted Tower #3. Tower #3 did not receive a City-issued permit and is subject to this waiver request as part of the required approval process. Tower #3 is also subject to a State Court case and a related Federal Court case concerning compliance with city and federal regulations. The waiver request, if approved, may or may not eliminate the need for these cases to go to trial. The City Attorney's staff will be available at the hearing to address any questions from the Commission.
Should the waiver be approved, the antenna and tower construction will be processed as a construction permit following the administrative review pursuant to § 14-6.2(E)(3) "Administrative approval," in
compliance with federal requirements. The scope of the Commission hearing is limited to the setback waiver. Details of the construction permit, and RF emissions, 1 are beyond the jurisdiction of the

Planning Commission. IV. PERMIT HISTORY On August 6th, 2010 Albert Catanach received a building permit for a roof mounted antenna for Tower #1 for back up City 911 services (Permit Number 10-1257 reference Exhibit C). The permit review identified that the proposal complied with Article 14-6.2(E)(2)(b) "Applicability" which states:
(b) Except as otherwise noted, § 14-6.2 (E) shall not apply to the following: ... (vi) Towers and antennas used exclusively (Or emergency services, including police, fire and operation o[the City water utility;
The 2010 permit included the following items provided by the applicant which included confirmation from the City of Santa Fe ITT Director for police and fire operations (reference Exhibit C);

The city is under contract with CNSP for wireless service which also includes Public Safety support. The applicant has not identified if antennas located on existing towers provide radio service for City Public Safety Support. However, any frequency providing Public Safety service at 1308 Apache A venue may not qualify for exempt status per 14-6.2(E)(2) "Applicability" because the tower is not exclusive to Public Safety as required pursuant to code. The applicant has placed multiple antennas and mini towers on the roof of 1308 Apache A venue. While antennas on a tower are permitted under the Federal Communication Commission Telecommunications Act of 1996 and Section 6409(a) of the Middle Class Tax Relief and Job Creation Act of 2012 ("6409''), building permits are required to ensure construction methods comply with the City's construction code.
To date, the city has found no record that the owner obtained permits for the placement of telecommunication equipment, except for Tower #1 and one antenna on that tower, which were allowed under building permit 10-1257. Mr. Catanach has orally informed City staff that he did receive a City issued building permit for Tower #2. Additionally, Tower #3, which is the subject of this request, was initiated without city permits and was completed after a City Stop Work Order (i.e. Red Tag) was issued.
In March 2015, the applicant requested a building permit to erect Tower #3. In March 2015, City staff informed the applicant he needed to obtain a waiver for Tower #3. On December 10, 2015 a preapplication meeting was initiated by the applicant to discuss the process to construct an 80-foot tower

within the rear yard of the property. The applicant identified that he wished to remove the equipment from the roof and relocate it on the new tower to address roof maintenance issues.
On March 10, 2016, the applicant conducted an Early Neighborhood Notification Meeting (ENN), presenting the same information as at the pre-application meeting. The applicant further added that approval of Tower #3 would consolidate all the antennas on the roof onto a single tower, having the effect of reducing visual impact while enhancing service to the area (i.e. take down Tower #1 and Tower #2 and place all of the antennas on Tower #3). The history of permits issued for the property was discussed.
V. WAIVER
The current request is for a waiver for Tower #3 pursuant to 14-6.2(E)(8) "Waivers," to reduce the required setback from property lines. The setback requirements are as follows:
(k) Tower Setbacks and Separation Distances Between Towers All towers shall be set back a distance equal to at least one hundred percent o( the height o[the tower fi'om any adjoining lot line, measured (i·om the base of the tower. A tower shall not be sited closer than one thousand (1,000) linear feet to another tower. measuredfrom the base of the towers, unless co-location on the existing tower is not technically feasible or would have a significant adverse visual impact. (Ord. No. 2014-31 § 13)
Under federal requirements, the applicant's request for approval of Tower #3 and relocation of the antennas would be handled by city staff without a public hearing, if the waiver were not required. On January 5, 2017, the Planning Commission heard a similar request form Crown Castle (Case #2016-151, 1326 Rufina Circle Waiver) regarding a setback waiver.

The requested waiver would allow setbacks less than the 80-foot requirement from the North, South and West property lines.
Subsection 14-6.2(E)(8) provides for review of waivers to the city's telecommunication facilities regulations:

(a) The planning commission may grant a waiver of the standards set forth in this section or otherwise within its jurisdiction only if the planning commission finds that the waiver:
(i) is in the best interest of the community as a whole: (ii) will expedite the approval of an antenna or tower;
(iii) will not jeopardize the public health, safety and we(fare, to the extent the city has jurisdiction;
(iv) will either mitigate the adverse visual impacts of antenna and tower prol!foration or limit the needfor construction of new towers or antennas;
(v) will better serve the purposes setforth in Subsection 14-6.2(E)(J) (reference Exhibit A "FCC and Code Citations") and
(vi) ({the proposed site is located in the escarpment or south central highway corridor overlay districts, that the applicant has demonstrated to the satisfaction of the planning commission that it has explored all alternatives to the proposed site and to the proposed design and that location outside those districts is not practicable.
The applicant has generally addressed items (i) through (vi) in Exhibit E "Applicant Submittals". See the November 12, 2016letter from Mr. Towner, Mr. Catanach's engineer. Staff concurs with responses to items (i) through (vii) subject to the conditions listed in Section II "Conditions Of Approval" of this Memorandum.
Articlel4-6.2(E)(8)(b) identifies "-Factors to be considered in granting a waiver":
(i) the design of the proposed telecommunications facilities, with particular reference to design elements that reduce or eliminate adverse visual impact including lighting;
Staff Review: Chapter 14 allows a height limit of 1 00 feet in C-2 (General Commercial) Districts. The 80-foot high lattice tower would provide for the consolidation of antennas.
The uses surrounding the property include both residential and nonresidential. The property does not lie within the BCD, Historic, Escarpment or the Cerrillos Road Highway Corridor Overlay District;
Staff believes that approval of Tower #3 would provide for the consolidation of all antennas from the roof onto a single tower, reducing visual impact while enhancing service to the area. Still, staff believes stealth concealment could be used to eliminate more of the adverse visual impact. The general area does contain tall ponderosa pine trees (Exhibit D). Stafi believes that this type of stealth concealment would blend into the area to further eliminate adverse visual impact onto the adjacent neighborhood.
(ii) the nature of uses on adjacent and nearby properties, including proximity to residentially

zonedproperty, the BCD and historic, escarpment and south central highway corridor overlay districts; Staff Review: Adjacent uses consist of residential to the north and west and nonresidential uses to the east and south. A telecommunication tower use is allowed within the C-2 district though the use of stealth technology is appropriate to reduce the effects of negative visual impact on adjoining residential properties.
(iii) the surrounding topography; Staff Review: The surrounding topography is generally flat.
(iv) the surrounding vegetation;
Staff Review: The surrounding vegetation is somewhat sparse along Apache Street within the C-2 District. However, the adjacent Residential District contains mature vegetation consisting of both conifer and evergreen trees such as Elms, Russian Olive, Pifion and tall Ponderosa Pine Trees.
(v) the availability of existing towers or other structures for co-location or of alternative antenna configurations with less visual impact; Staff Review: Tower #1, which is the existing 39-foot rooftop tower, was permitted with one antenna by the City in 2010, but no other permits were found for the other mini towers and antennas on the roof. The applicant has placed the 80-foot Tower #3 in the rear of the property without city permits and is requesting a waiver to setbacks from the north, south and west property lines. There are no other towers within the area for co-location. Staff believes that an alternative camouflaged tower that blends into the vegetation surrounding the adjacent residential district is more appropriate tor addressing visual impact.
(vi) the proposed ingress and egress; and
Staff Review: The existing tower is located to the rear of the property, behind the CNSP building and closest to the neighborhood. Access to the facility is via an existing driveway directly accessed off of Apache A venue. The driveway provides ingress/egress to the property and the Telecommunication Facility.
(vii) improved telecommunication services to Santa Fe residents and institutions. Staff Review: The telecommunication industry has seen vast changes in technology. The use of wireless and mobile technology in household appliances and entertainment systems is also more

common place. Wireless and Mobile technology has also enhanced communications for life saving technology within both the public safety and medical fields.
As the telecommunication industry continues to advance itself, new technology often meets with stagnant legislation that fails to keep up with the industry changes and demands. These demands include:
• Global Positioning Systems (GPS) for use in mapping and direction;
• Voice and video communication;
• Email and text data;
• Entertainment i.e. social media, gaming, movie streaming;
• Cloud based application i.e. IOS Siri, Google Now and Microsoft Cortana; and
• The internet of things (loT) i.e. smart devices such as watches, thermostats, and home and business security surveillance monitors etc.
The list of uses is extensive and continuously increasing. As the population of these teclmologies increases, the demand on the Telecommunication Industry is to provide more bandwidth with faster and reliable mobile service. The additional antennas within the area will improve telecommunication services to residents by adding capacity, along with improving the overall service within the area of the City.

Acceleration of Broadband Deployment by Improving Wireless Facilities Siting Policies
AGENCY: Federal Communications Commission.
ACTION: Final rule.
SUMMARY: In this document, the Federal Communications Commission (Commission) adopts rules to update and tailor the manner in which it evaluates the impact of proposed deployments of wireless infrastructure on the environment and historic properties. The Commission also adopts rules to clarify and implement statutory requirements applicable to State and local governments in their review of wireless infrastructure siting applications, and it adopts an exemption from its environmental public notification process for towers that are in place for only shmt periods oftime. Taken together, these steps will reduce the cost and delays associated with facility siting and construction, and thereby facilitate the delivery of more wireless capacity in more locations to consumers throughout the United States.
DATES: Effective February 9, 2015, except for§ 1.40001, which shall be effective AprilS, 2015; however,§§ 1.4000l(c)(3)(i), 1.40001(c)(3)(iii), 1.140001 (c)(4), and 17.4(c)(l)(vii), which have new information collection requirements, will not be effective until approved by the Office of Management and Budget (OMB). The Commission will publish a document in the Federal Register announcing OMB approval and the relevant effective date.
e. Substantial Change and Other Conditions and Limitations
87. After careful review of the record, the Commission adopts an objective standard for determining when a proposed modification will "substantially change the physical dimensions" of an existing tower or base station. The Commission provides that a modification substantially changes the physical dimensions of a tower or base station if it meets any of the following criteria: (1) for towers outside of public rights-of-way, it increases the height of the tower by more than 1 0%, or by the height of one additional antenna array with separation from the nearest existing antenna not to exceed twenty feet, whichever is greater; for those towers in the rights-of-way and for all base stations, it increases the height of the tower or base station by more than 10% or 1 0 feet, whichever is greater; (2) for towers outside of public rights-of-way, it protrudes from the edge of the tower more than twenty feet, or more than the width of the tower structure at the level of the appurtenance, whichever is greater; for those towers in the rights-of-way and for all base stations, it protrudes from the edge of the structure more than six feet; (3) it involves installation of more than the standard number of new equipment cabinets for the technology involved, but not to exceed four cabinets; (4) it entails any excavation or deployment outside the current site of the tower or base station; (5) it would defeat the existing concealment elements of the tower or base station; or (6) it does not comply with conditions associated with the prior approval of construction or modification of the tower or base station unless the non-compliance is due to an increase in height, increase in width, addition of cabinets, or new excavation that does not exceed the corresponding "substantial change" thresholds identified above. The Commission further provides that the changes in height resulting from a modification should be measured from the original support structure in cases where the deployments are or will be separated horizontally, such as on buildings' rooftops; in other circumstances, changes in height should be measured from the dimensions of the tower or base station inclusive of originally approved appurtenances and any modifications that were approved prior to the passage of the Spectrum Act. Beyond these standards for what constitutes a substantial change in the physical dimensions of a tower or base station, the Commission further provides that for applications covered by section 6409(a), States and localities may continue to enforce and condition approval on compliance with generally applicable building, structural, electrical, and safety codes and with other laws codifying objective standards reasonably related to health and safety.
(E) Telecommunication Facilities
(1) Purpose
The purposes of this section are to:
(a) comply with applicable state and federal laws and regulations regarding the provision of telecommunications services;
(b) consistent with the federal Telecommunications Act of 1996, establish regulations that do not discriminate among telecommunications providers;
(c) promote regulatory certainty;
(d) minimize adverse land use impacts of towers and antennas by:
(i) encouraging the location of towers in nonresidential districts in order to preserve the character of Santa Fe neighborhoods;
(ii) requiring co-location of antennas, minimizing new tower sites, and encouraging the use of minimally visually intrusive technology to the maximum extent technically feasible; and
(iii) requiring careful design, siting, landscape screening and innovative camouflaging techniques, including tower alternatives, consistent with applicable state and federal requirements, including FAA requirements; and
(e) enhance the ability of telecommunications providers to provide telecommunication services to the community quickly, effectively and efficiently.
(2) Applicability
(a) This section applies to all towers and antennas located within the city's jurisdiction, whether upon private or public lands, except as provided in Subsection 14-6.2(E)(2)(b).
(b) except as otherwise noted, this subsection shall not apply to the following:
(i) towers and antennas located within the city's public rights of way for which a franchise agreement is required pursuant to Article 27-2 SFCC 1987;
(ii) towers and antennas located on state or federal land, except to the extent the city has jurisdiction over the same by law or by contract;
(iii) towers under seventy (70) feet in height used for receive-only antennas that are owned and operated by a federally licensed amateur radio station operator or otherwise used exclusively for receive-only antennas;
(iv) towers or antennas existing prior to March 25, 1998 or for which a construction permit had been issued prior to March 25, 1998, but only to the extent of permits issued prior to June 1 I, 2011;
(v) towers or antennas constructed or installed on city-owned property pursuant to a lease with the city approved by the governing body prior to June 11, 2011, but only to the extent of permits issued prior to June 11, 2011;
(vi) towers and antennas used exclusively for emergency services, including police and fire, and operation of the city water utility;
(vii) antennas and other over-the-air receiving devices for the reception of video images that do not exceed one meter in diagonal length or diameter or are designed to receive television broadcast signals only; provided that any such antenna located in a historic district or on residentially zoned property shall, to the maximum extent technically feasible without requiring new or additional construction, be screened from the view of adjacent properties and public rights of way unless the screening would create a greater visual impact than the unscreened antenna. Screening may include existing parapets, walls or similar architectural elements if they are painted and texturized to integrate with the architecture of the building or other structure or landscaping;
(viii) maintenance, repair and replacement of existing telecommunications facilities to the extent that there is no significant adverse visual impact and maintenance or improvements to existing infi·astructure such as painting over graffiti on walls or renewing landscaping; or
(ix) the modification of existing telecommunications facilities to the extent that there is no significant adverse visual impact.
(c) Notwithstanding the applicability of this section, all telecommunications facilities are subject to the requirements of Chapter 7 SFCC 1987.

Detailed Project Description
CNSP Inc. (hereinafter "CNSP") is a locally owned and operated telecommunications company that provides high-speed DSL and wireless internet broadband services to New Mexico consumers. Its President and primary share~holder is Albert Catanach. The company operates from its business location at 1308 Apache Avenue ("1308 Apache"). CNSP does business under the trade name NMSurf and maintains a website advertisement at NMSurf.com.
CNSP currently maintains two .(2) towers on the roof of its building at 1308 Apache. The height to ground of the tallest tower is 80 feet. CNSP desires to remove these 2 towers and construct one ( 1) replacement tower in the rear of the building. The replacement tower would also be 80 feet in height. CNSP has a number of good reasons for desiring the proposed relocated tower and removal of the existing 2 towers.
The 2 towers currently on the roof of the building utilize guy wires to secure them and are approximately 20 feet apart. The proposed replacement tower would be securely installed in the ground within a concrete foundation and would be non-guyed. The move would be a significant improvement to the visual aesthetics of the neighborhood and Apache Avenue in particular.
Safety is another reason for CNSP's relocation request. Vandals have climbed onto the roof of CNSP's building in the past. towers are accessible and can be climbed. Tower guards cannot be placed on the roof. With a tower on the ground in the rear of the building tower guards can be installed behind fencing and a locked gate. Also, a tower installed from a foundation on the grownd would be more sl'oble.
CNSP wishes to utilize the services of Advanced Tower Systems ("ATS") for the construction of the new tower. ATS has completed many similar projects around the State of New Mexico and is chosen for its proven track record of quality and success.
The site of the proposed replacement tower will be excavated so that the tower can be securely installed within a concrete foundation. Again, the visual impact will be an improvement over the existing towers on the roof of the building. There will no longer be guy-wires, there will only be 1 tower instead of the 2 that ore visible now, and the location the replacement tower (in the rear the farther away from Apache Avenue) will be obtrusive. When construction is completed, there will be no disruption or change the natural land form
of 1308 Apache. There will be no additional generators, noise~making uipment, lighting or illumination at the site.
The proposed replacement tower will not jeopardize the public health, safety or welfare. An experienced contractor will be utilized for installation and the replacement tower will be safer than the existing two (2} towers. The replacement tower would be built to the specifications of an engineer's approval. The replacement tower wit! also be on improvement visually over the existing towers and will mitigare the ddverse visual impacts of the existing towers. Also again, CNSP is a locally-owned and operated company. Its success will benefit and be in the best interest of the broader Santa Fe and New Mexico communities. One of CNSP's goals is to provide broadband and internet services to the general public at less expense than its competitors. Its main competitors are very large companies (Century Unk, Comcost, AT&T etc) who have near monopolies on these services and charge high rates. CNSP seeks to become more competitive so that it can charge lower rates.
If CNSP 's application is approved, the replacement tower will be setback 16.80 feet from the nearest property boundary !otline (the west), 31.30 feet from the north lotline, approximately 53 from the south lotline, and over 80 feet from the east lotline. CNSP's building and parking area will be between the replacement tower and Apache Avenue (the east lotline).
The size and configuration of the lot and existing building at 1308 Apache do not allow for any other less intrusive means or alternative to CNSP's proposal that will achieve the aesthetic and safety benefits sought by the proposal.
a} EFFECT ON CHARACTER AND APPEARANCE OF THE SURROUNDING NEIGHBORHOODS
CurTently there ore 2 towers on the roof of the building at 1308 Apache. The tallest tower reaches 80 feet from ihe ground. The proposal is to remove these 2 towers and replace them with 1 tower located in the rear the building, farther to the wesi. The new tower will also be 80 feet high. There should be no effect on the character of the surrounding neighborhood but the appearance will be an improvement.
b) EFFECT ON PROTECTION OF THE PHYSICAL ENVIRONMENT
There will be no additional effect on the physical environment. The proposed replacement tower will be installed in a secure concrete foundation, will be fenced behind a locked gate and will have tower guards for added safety. It will be more stable since it will be installed in a concrete foundation on the ground.
c) IMPACTS ON ANY PREHISTORIC, HISTORIC, ARCHAEOLOGICAL OR CULTURAL SITES OR STRUCTURES INCLUDING ACEQUIAS AND THE HISTORIC DOWNTOWN
The proposed replacement tower will have no impact on any prehistoric, historic, archaeological or cultural sites or structures.
d) RELATIONSHIP TO EXISTING DENSITY AND LAND USE WITHIN THE SURROUNDING AREA AND WITH LAND USES AND DENSITIES PROPOSED BY THE CITY GENERAL PLAN
The property is zoned C-1. The proposed use is a permissible use in the C-1 zone. There will be no change to the current land use. Density will be less because 2 towers will be removed to be replaced with only l tower.
The proposed replacement tower will be on private property, not in any private or public easements or rights-of-way and will have no effect on parking, traffic patterns, congestion, pedestrians or access to services by the disabled, children, !ow-income and elderly.
f) IMPACTS ON THE ECONOMIC BASE OF SANTA FE
The project supports economic development. NMSurf's success will improve living slandards of neighborhoods and businesses. NMSurf seeks to provide lower costs of high-speed broadband access to the internet.

Scope of Work
Advanced Tower Services, Inc. (Contractor) agrees to furnish necessary labor, materials, supplies, equipment and tools to perform and complete in a professional manner, the services described in the proposal
Payment
100% upon completion of scope of work unless credit arrangements have been made, or work duration is longer than one (l) month. Then the Contractor will submit invoices monthly, or as otherwise agreed, for completed p01tions of services or additional work authorized pursuant to paragraph 5 herein. Client agrees to pay the invoiced amount within 20 days from the date of invoice. Any payment not received by Contractor within 30 days shall be considered to be delinquent and the amounts due contractor shall accrue a late charge of 1.5% per month for each month from date of invoice. In the event any payment due contractor under the terms of this agreement is delinquent, Contractor may suspend all services tmtil all delinquent payments have been received.
Standard of Care
a. While performing services under this agreement, Contractor shall exercise the degree of skill ordinarily exercised where performing the kind of services in the Scope of Work. b. Contractor assumes no responsibility for errors in public data utilized, statements from sources outside of Contractor, or developments resulting from situations outside the control ofthe Contractor.
c. The standard of care set forth herein is the sole and exclusive standard of care that wit! be applied to measure Contractor's performance of the services or the creation ofit's work product.
There are no other representations or warranties made by Contractor.
Time for Performance
The wo11~ wHt :be· completed within the calendar days as described in the scope of work, or as expeditiously as possible.
If the Contractor is delayed at any time ir1 the progress ofthe work by any act or omission of the Client, or by it's officers, directors, employees, agents and assigns (Representatives), or by any separate contractor employed by the Client, or by changes ordered in the work, or by labor dispute, fire, unusual delay in transpOJtation, adverse weather conditions, unavoidable casualties, or any causes beyond tl1e Contractor's control, or by delay authorized by the owner pending arbitration, t~en the contract time shall be extended by agreement for such reasonable time as required.

Additionaf Work
The Client, without invalidating the agreement, may order changes in the work within the general scope of the agreement consisting of additions, deletions or revisions of the scope, cost of services and time being adjusted accordingly. All changes in he work shall be authorized in writing. The cost or credit to the Client resulting from a change in the work shall be determined by one or more of the following; ( 1) by mutual agreement of either a fixed fee and/or unit price to be multiplied by the units worked in determining the total sum; (2) hourly rate per man hour multiplied by the man hours expended; or (3) by other mutually agreeable cost methods. If the outcome of the completed work indicates that additional or different work is required; the Contractor will notifY the Client and will use his best professional judgment in assisting the Client in deciding how to proceed. The cost of services will be equitably adjusted by written change order or supplemental agreement between both parties.
Access, Approvals and Permits
Client shall arrange for access and make all provisions for Contractor to enter public and private property as required for Contractor to perfonn the specified services. Client shall fumish approvals and permits from all governmental authorities having jurisdiction over the Project and such approval and consent from others as may be necessary, unless otherwise stated in the proposal as the responsibility of the Contractor.
Client Provided Information
Work will not commence until the Contractor has received duly executed copy of this contract. The Client shaH direct it's officers, directors, employees, subcontractors and agents to render reasonable assistance and to provide (promptly upon request) all necessary or appropriate data to the Contractor in connection with it's performance under this agreement. Any data furnished shall be finnished at the Client's expense, and the
· Contractor shall be entitled to rely upon it's accuracy and completeness. The Client shall locate for the Contractor, and shall assume responsibility for the accuracy of his representations, as to the locations of all underground utilities, tanks, structures or other installations, unless the express responsibility ofthe Contractor as stated in the Scope of Work.
Safety
In an emergency affecting the safety of persons or prope1ty, the Contractor shall act, at his discretion, to prevent threatened damage, injury or loss. Any additional compensation an/or extension of time claimed by the Contractor, on account of emergency work shall be determined as set forth under the Additional Work section.

Hazardous Substances
If any hazardous, toxic or dangerous substances as defined by federal, state or local laws, statutes, regulations, ordinances, rules or orders (Hazardous Substances) are encountered at the site, and if these Hazardous Substances require handling, transportation or disposal, Contractor will assist in advising client of his options.
Restoration
The Client understands that in the nonnal course of work, some minor damage to property may occur including damage to landscaping, sprinkler systems and building finishes. While the Contractor will act to minimize damage, the Client understands that tlw cost of restoration is not included in this agreement unless expressly stated in the scope of work.

Contractor shall perform all work under this agreement as an independent contractor, retaining complete control over it's personnel and operations. Neither Contractor nor it's subcontractors shall be, or construed to be Client's employees or agents, or have any authority to bind Client in any way.
Indemnity
a. Contractor shall indemnify and hold harmless Client, and it's respective officer, directors, employees, subcontractors, agents and assigns (Representatives), from and against any and all liabilities, claims, causes of action, suits, losses, damages, costs and demands, including reasonable attorney's fees, resulting from or arising out of, personal injury, including death or propetty damage, to the extent such injury, death or property damage is caused by the negligence or willful misconduct Contractor or it's Representatives; and provided that such injury, death or property damage is not caused by the sole or contributory negligence of Client or it's representatives; and provided further, that Contractor's liability hereunder shall be limited to and not exceed the insurance limits of liability identified in this proposal or the total cost of services under this agreement, whichever amount is less.
b. Client shall indemnify and hold harmless Contractor, and it's Representatives, fi·om and against any and all liabilities, claims, causes of action, suits, losses, damages, costs and demands, including reasonable attorney's fees, resulting from or arising out of, personal injury, including death or property damage, to the extent such injury, death or property damag~ i$ caused by the negligence or willful misconduct Client or it's Representatives; and provided that such injury, death or property damage is not caused by the sole or contributory negligence of Contractor or it's representatives.
c. The provisions of this paragraph shall survive the completion ofthe work or tennination of the agreement between Contractor and Client.

Dispute Resolution
AU claims, disputes and other matters in question between Contractor and Client arising out of, or relating to, this agreement or breach thereof, shall be decided by arbitration in accordance with the construction industry rules of the American Arbitration Association, unless the parties mutually agree otherwise. The award rendered by the arbitrators shall be final, and judgment may be entered upon it in accordance with applicable law in any court having jurisdiction thereof. Notice of demand for arbitration shall be filed in writing with the other party to the contract agreement within a reaso11able time after the claim, dispute or other matter in question has risen.
Subcontractors
The Contractor reserves the right to subcontract portions of the Scope of Work at his sole discretion.
The Contractor reserves the right to remove and person, finn or corporation (subcontracted to the contractor) from participation in the services being provided to the client.
Termination
If the work is stopped for a period of thirty (30) days under an order of any court or other public authority having jurisdiction, or as a result of an act of government, through no act or fault of the Contractor or it's Representatives, or fthe client has failed to make payment as provided in this agreement for work perfonned, or has otherwise stopped the Contractor's work, then the Contractor may at his option provide three (3) days notice to the Client, terminate this agreement and recover fTom the Client, payment for all work completed, with all costs arising out of such termination.
Entire Agreement
The agreement and any referenced attachments constitute the entire agreement between the Contractor and the Client and supercedes all prior, oral or written representations or agreements. This agreement shalf not,be modified except in writing and signed by both pruties.

Severability
If any of these General Conditions shall be finally determined to be invalid and unenforceable in sole or in part, the remaining provisions hereof shall remain in full force and effect and be binding upon the parties.
Applicable Law and Venue
This Agreement shall be governed by the laws of the state of New Mexico. All actions, disputes, claims or other matters arising :from this agreement shall be decided per the disputes clause in Albuquerque, New Mexico.
Limitations of Liabl/lty
In no event will the Contractor be liable to the Client or anyone else (including third-party beneficiaries), for any consequential, incidental, special or indirect damages, including lost revenue.and profits that result in any way connected with the services provided herein.
The Client agrees that the liability of the Contractor arising out of any kind of legal claim (whether in contract, tort or otherwise) in any way connected with the services provided will not exceed the amount the Client originally paid the Contractor for the service, or the available insurance identified elsewhere in the agreement, whichever amount is less.

Per your request, Hands Engineering, Inc. was employed to perform a site visit to the referenced site. On 15 July 2010, M:r. James Hands visited the site to gather the data necessary for our analysis. The purpose of the site visit was to evaluate the structural condition and capacity of the roof at the above referenced building. Please note that the evaluation was from a visual observation, photos were taken at the site and are enclosed •
. After visiting the site and reviewing the loads of the ballast and the antenna loads, it is my professional opinion that the building and its components will support the 25 GBRM Antenna. Also the antenna has been braced laterally with guy wires.
The conclusions and opinions stated are based on our understanding of the facts and evidence stated in the discussion above. Should additional facts or evidence become available pertaining to this project, I reserve the right to review that information and revise my opinions when appropriate.

This letter serves as NMSURF's position regarding our request for a setback waiver for a communication tower at 1308 Apache Ave. in Santa Fe. The property already has a setback waiver in place for two telecommunications towers currently situated on the building's roottop.
This waiver request will provide improved wireless services to the citizens and visitors of the City of Santa Fe. NMSURF's proposal will allow NMSURF to provide enhanced capability and capacity upgrading the services of its subscribers. The proposal will also allow for enhanced E-91 l technology to be installed improving emergency capacities which is in the best interest of the community.
NMSURF's new tower is 80' feet in height which is well under the City's 100' foot restriction. The rooftop towers currently are 77' and 40' in height, making the existing increase in height for the new tower only 3'.
The tower does not connect to a water system, refuse collection or sewer system. The existing and proposed equipment do not emit any odor, dust, gas, noise, smoke, heat, or glare. There is no lighting installed on the rooftop tower and no lighting is included in the proposal for the new tower.
The new tower will have no impact to vehicular or pedestrian patterns. Ingress and egress to the site will continue to be from Apache A venue. Dedicated parking in the front of our building is available for any maintenance.
Adjacent property on Apache Avenue is commercially zoned and a catering company (Peas in Pod) and The Friendship Club are immediately to the South. Remaining adjacent property is residential.
The required Early Neighborhood Notif1cation meeting was held on March 10, 2016 with members of the public.
NMSURF will establish this request meets all the requirements under Section 14-6.2(E)(8 ); Citation: Waivers 14-6.2(E)(8) (a) The planning commission may grant a waiver of the standards set forth in this section or otherwise within its jurisdiction only if the planning commission finds that the waiver: (i) is in the best interest of the community as a whole; (ii) will expedite the approval of an antenna or tower; (iii) will not jeopardize the public health. safety and welfare, to the extent the city has jurisdiction; (iv) will either mitigate the adverse visual impacts of antenna and tower proliferation or limit the need for construction of new towers or antennas; (v) will better serve the purposes set forth in Subsection !4-6.2(E)(l); and (vi) ifthe proposed site is located in the escarpment or south central highway corridor overlay districts, that the applicant has demonstrated to the satisfaction of the planning commission that it has explored all alternatives to the proposed site and to the proposed design and that location outside those districts is not practicable. I. Setback waiver is in the best interest of the community as a whole.
This waiver request is in the best interest of the community as a whole as it will significantly improve the visual aesthetics in the neighborhood. The current two towers on the rooftop and their guy-wires will be taken down upon completion of the collocation of the equipment on the two rooftop towers to the new tower.
This will also provide improved network expansion for the citizens of Santa Fe as some of the equipment on the current towers will be able to be repositioned on the new tower to allow enhanced and expanded coverage for customers. The proposal will also allow for enhanced E-911 technology to be installed improving emergency capacities which is in the best interest of the community.
II. Will expedite the approval of an antenna or tower The setback waiver will expedite the approval of the tower as the tower has
previously been certified by a structural engineer as to its specifications and safety.[ Attachment 1]. The City has reviewed the tower and the setback waiver is the final assurance required for compliance.
III. Will not jeopardize the public health, safety and welfare, to the extent the city has jurisdiction
The setback waiver request will not jeopardize public health, safety and welfare. The base support system (Attachment 2] is structurally superior to the current rooftop towers and provides for a capacity well above its intended use including wind speeds up to llOmph. Public safety then is actually enhanced by the new tower.
IV. Will either mitigate the adverse visual impacts of ante11na and tower proliferation or limit the need for construction of new towers or fmtennas;
The new tower will improve the visual aspects of the surrounding area as the current towers and all guide wires for those towers will be removed upon completion of the collocation of equipment to the new tower. The before and after effects of this transition are attached as a reference point [Attachment 3]. Neighbors on Vitalia St. will have an improved view of the Jemez mountains as the current rooftop towers are more directly in the line of sight and will be removed. The collocation of equipment essentially condenses two towers down to one and prevents the need for additional towers being placed on the rooftop of the building.
V. Will better serve the purposes set forth in Subsection 14-6.2(E)(l); This request is consistent with Subsection 14-6.2(E)( I) particularly with
Subsection 14-6.2(E)( 1)( d)(i) which requires co-location of antennas. As stated above, the equipment on the current two rooftop towers will be co-located to the one new tower to minimize visually intrusive effects to the neighborhood.
This request also furthers the intent of Subsection 14-6.2(E)( 1 )(e) as it will improve the ability to provide telecommunications services to the citizens of Santa Fe.
