Speaking on behalf of my neighbors We have been told by the applicant and their

representatives that our neighborhood is unattractive and undesirable to buyers.

We disagree because we have: Large lots and yards Affordable homes for Dr. Phillips An easy walk to the grocery stores, pharmacy,

schools, churches, and services A close knit community where we know each

other.

Why do we object? A religious institution does not belong within a

home/neighborhood and is a non-residential use.

The lot does not meet the RCE performance criteria

for lot size per property appraiser.

The application does not meet the requirements of

Section 38-78 (Special Exception Criteria).

This use is incompatible because it represents an

intrusion into a neighborhood.

Why do we object? The proposed facility is not large enough to serve the

congregation.

The Orange County Comprehensive Policy Plan

Neighborhood Element states that neighborhoods will be

protected from incompatible uses.

The Orange County Future Land Use Element states that

Rural Settlements will be protected.

The Orange County Future Land Use Element and

Transportation Element state that services must be available.

There is not enough road capacity OBJECTIVE 3.5 The location and intensity of development

shall coincide with the availability of public services and facilities. This objective shall be achieved by implementing a Concurrency Management System and development regulations by December 1, 1991.

POLICY 3.5.1 Development orders or permits, including those for

institutional uses, will be issued subject to the condition that

facilities and services sufficient to maintain adopted level of service

standards will be available concurrent with the impacts of

development as detailed in Policy 3.5.3.

If you approve the request …

You will undermine the character, value, and integrity of a cohesive, affordable neighborhood that has been here since 1964 – inconsistent with CPP.

The sustainability of our neighborhood within the Rural Settlement depends upon drawing the line.

Do not allow additional inconsistent uses. Do not intrude into our neighborhood. All that will be left is a carcass – ripe for “taking.”

Inconsistent with the Criteria Sec. 38-78. Special exception criteria. Subject to section 38-43 and section

30-43 of this Code, in reviewing any request for a special exception, the following criteria shall be met: The use shall be consistent with the comprehensive policy plan. The use shall be similar and compatible with the surrounding area and shall be

consistent with the pattern of surrounding development. The use shall not act as a detrimental intrusion into a surrounding area. The use shall meet the performance standards of the district in which the use is

permitted. The use shall be similar in noise, vibration, dust, odor, glare, heat producing

and other characteristics that are associated with the majority of uses currently permitted in the zoning district.

Landscape buffer yards shall be in accordance with section 24-5 of the Orange County Code. Buffer yard types shall track the district in which the use is permitted.

In addition to demonstrating compliance with the above criteria, any applicable conditions set forth in section 38-79 shall be met. Furthermore, the board of zoning adjustment ("BZA") shall prescribe a time limit, subject to the approval of the board of county commissioners ("BCC"), within which the action for which the special exception is required shall be begun or completed, or both. Failure to start or complete such action within the time limits shall void the special exception.
