CONSENT AGENDA (INFORMATIONAL) – NO NEW ITEMS AT THIS TIME RESOLUTION: RESOLUTION TO DISSOLVE THE SUSTAINABLE LA CROSSE COMMISSION – STEVE O’MALLEY O’Malley briefly went over and explained the reason for the Resolution advising the City plans to re-look at their involvement and may eventually implement a task force. Questions from the committee were answered by O’Malley. Some committee members provided by comments. MOTION by Keil/Scheller to approve the RESOLUTION: Resolution to Dissolve the Sustainable La Crosse Commission. 6 Aye, 0 No, 1 Excused (Hoyer), Motion carried. APPROVE THE EROSION CONTROL & STORMWATER MANAGEMENT PLAN FOR HIDDEN PRAIRIE IN THE TOWN OF HOLLAND – JAKE SCHWEITZER Schweitzer introduced Jeff Moorehouse and Mike Richgels before referring to the overhead while doing a PowerPoint presentation about the Erosion Control and Stormwater Management plan. Schweitzer explained what three conditions needed to be met in order to recommend approval but did advise they did a really good job on the plan. Questions from the committee were answered by Schweitzer and some committee members expressed concern about the number of septic systems and water quality on the prairie. MOTION by Hesse/Hundt to approve the Erosion Control & Stormwater Management Plan for Hidden Prairie in the Town of Holland with the (3) recommendations as outlined by staff. 6 Aye, 0 No, 1 Excused (Hoyer), Motion carried.

APPROVE THE PRELIMINARY PLAT OF HIDDEN PRAIRIE IN THE TOWN OF HOLLAND – BRYAN MEYER Meyer referred to the overhead while going over this agenda item, on occasion referencing information Schweitzer had touched base on while discussing the previous agenda item. The Highway Dept had a request there be no access to County Highway XX upon approval of the plat. Meyer recommended approval. Some committee members provided comments again regarding water quality concerns. Questions from the committee were answered by Meyer and O’Malley. Discussion ensued on whether or not to make the 9 recommendations in the TAC committee letter become actual requirements upon approval of the plat. MOTION by Keil/Cornforth to approve the Preliminary Plat of Hidden Prairie in the Town of Holland with the requirement (in the covenants) to disclose the level of nitrates in the well water of that area to buyers. Additional questions were answered by Meyer and Schweitzer. 6 Aye, 0 No, 1 Excused (Hoyer), Motion carried. RESOLUTION: SWRM MASTER GRANT CONTRACT BETWEEN DATCP & LA CROSSE COUNTY – MATT HANEWALL Hanewall presented this resolution to the Committee. The Soil and Water Resource Management (SWRM) Master Grant Contract between La Crosse County and DATCP (Department of Agriculture, Trade and Consumer Protection) needs to be updated due to Tara Johnson retiring. This Resolution recommends making the Land Conservation Director the County Representative for this grant, rather than the County Board Chair. 62 of 72 Wisconsin counties list the Land Conservation Director as their County Representative for this grant. This change has been approved by Corp Counsel and Monica Kruse. Not only will this change save the County Board Chair time, it will provide consistency with how other grants are administered within the Department of Land Conservation. MOTION by Cornforth/Hesse to approve the RESOLUTION: SWRM Master Grant Contract Between DATCP & La Crosse County. 6 Aye, 0 No, 1 Excused (Hoyer), Motion carried. The procedures for tonight’s meeting were explained to those gathered. This meeting is being recorded. ZONING PETITION NO. 2041 William and Margaret Lamprich, N6163 Eric Ave, Onalaska, WI, 54650, o/b/o WM Land and Rentals, N6163 Eric Ave, Onalaska, WI, 54650, petitions to rezone 3 acres of a 10.84 acre lot from the General Agriculture District to the Commercial District for warehouse storage units. Property described as the west 300-ft of tax parcel 10-1547-2 being part of the NW/NE and the SW/NE of Section 15, T17N, R8W. Property address W8200 County Rd Z. Town of Onalaska. Appearing in Favor: Peter Winnie, 1712 La Fond Ave, La Crosse, WI, 54603. First of all, I’d like to make one small correction; the proposed building is attached, not detached. Years ago, it was put up on the foundation and for whatever reason was never filled. The driveway is quite steep and quite short so it’s a danger coming in and out of the driveway.

CONDITIONAL USE PERMIT NO. 1126 Morgan A Jostad acting o/b/o Jostad Family Farm, LLC, 418 1st Ave E, Holmen, WI, 54636, applies for a Conditional Use Permit on a 195.61 acre Base Farm Tract for two single family residences on Class 1 and 2 soils previously used for cropland on lands zoned Exclusive Agriculture District. Property described as the fractional NE/NW, part of the fractional NW/NW, and part of the SW¼ of the fractional NW¼, all in Section 1, T17N, R7W. Tax parcels 10-40-0, 10-41-0, 10-42-0. The easement shown on the map is a proposed driveway and is a 33’ easement that will be recorded. It was an existing farm road that has been there 80-100 years. The driveway that goes to the east that goes up a hillside and the proposed building site is on a hill which is on cropland that has been in CRP for 35 years and hasn’t been worked in many years due to the difficulty going up and down the hill with farm machinery. 3. Deed restrictions shall be recorded within 30 days of County Board approval over the remainder of the 195.61-acre Base Farm Tract, not deed restricted under Administrative Conditional Use Permits 1076A and 1095A indicating no future residential development is authorized and only agricultural uses are allowed; and

4. This permit and deed restrictions can be lifted or amended by the La Crosse County Board of Supervisors only.

CONDITIONAL USE PERMIT NO. 1127 Terry Dickman, W3152 State Rd 33, La Crosse, WI, 54601, o/b/o Donald D and Elaine A Bina, N1904 Bina Rd, Coon Valley, WI, 54623, applies for a Conditional Use Permit on a 154.94 acre Base Farm Tract for a single family residence on lands previously used for cropland and zoned Exclusive Agriculture District. Property described as part of the SE/NW and SW/NE in Section 8, T15N, R5W. Tax parcels, 12-174-0 and 12-180-0. Town of Washington. Appearing in Favor: Terry Dickman, W3152 State Rd 33, La Crosse, WI, 54601. My family and I are looking to build a new single-family home with an additional shed. 3. Thirty-five acres where the existing residence on the Base Farm Tract shall be deed restricted to allow no future residential development and only one single family residence is authorized; and

4. These conditions can be lifted or amended by the La Crosse County Board of Supervisors only. They do that at no fee at the Committee level, but since the lot split had already occurred, that’s when the ordinance requires that a variance be applied for. CALL TO ORDER Howard Raymer, Chair, called the meeting to order at 6:00 p.m. Let the record show that this meeting is called in full compliance with the requirements of the Wisconsin Open Meetings Law. APPEAL NO. 2020-03 Mark Etrheim of Mastercraft Homes, 2300 Oak St, La Crosse, WI, 54603, acting o/b/o Shelley L Lynne, 5896 Audra Falls Ave, Las Vegas, NV, 89131, permit denied to construct a 4,276 sq. ft. detached accessory building 27.28-ft in height that will exceed the area and height limits for such buildings on a 9.5 acre lot. Property described as part of the NW/NW of Section 8 and part of the NE/NE of Section 7, all in T18N, R7W. Tax parcel 8-118-6. Property address W6863 Heram Rd. Town of Holland. Appearing in Favor: Shelley L Lynne, W6863 Heram Rd, Holmen, WI, 54636. Shelley stated she bought the property two years ago and wrote the offer to purchase ten acres. She stated the seller dropped the acreage to nine acres. She said she purchased a half acre from a neighbor, but the other neighbor was not willing to sell the half acre needed to get her back to ten acres. Shelley said she wanted to put a building up that was big enough to keep an antique car, boat, and other items in. Question Raymer: Was the property surveyed when you bought it? Answer Lynne: We had it surveyed when we bought it. Question Eilertson: You said you had someone come survey it, what did the survey say? Answer Lynne: 9.5 acres. After I bought the half acre. Question Eilertson: If this is approved, what is your time frame to get it built? Answer Lynne: Within the year. Appearing in Opposition: None Correspondence: 1.) The Town Board voted unanimously to approve variance request 2020-03. Discussion: The Board discussed that they saw no issue with the appeal. MOTION by Eilertson/Warzynski to Approve the appeal to construct a 4,276 sq. ft. detached accessory building 27.28-ft in height that will exceed the area and height limits for such buildings on a 9.5 acre lot with the condition that construction be completed within 12 months of the approval of this appeal. 3 Aye, 0 No Motion carried

APPEAL NO. 2020-14 Charles J and Megan M McConkey, W2820 M Knudson Rd, Mindoro, WI, 54644-9207, permit denied to construct a 45-ft x 70-ft detached shed that will partially lie within the right of way of M Knudson Rd and within the required setback of 60-ft from the centerline of a Class 1 Highway. Property described as part of the fractional NW/NW of Section 1, T17N, R6W. Tax parcel 7-402-0. Property address W2820 M Knudson Rd. Town of Hamilton. Appearing in Favor: Charles J McConkey, W2820 M Knudson Rd, Mindoro, WI, 54644-9207. Charles stated that the subject residence is on a dead end road in the Town of Hamilton. He said it is 108 acres and very steep. He said he obtained a permit to build a new house and tear down the old one, in the only flat spot without a drainage issue. He indicated the proposed building would be a little further from residence that was there before. He said he talked to Dale in zoning and met with the Town on site to make sure he could do what he wanted. Charles said he cut the building size back to fit it on the site a little better too. Question Eilertson: If you had to comply with the setback, you would have to cut into the hill? Answer McConkey: Yes, and it is extremely steep with very shallow bedrock. Question Eilertson: If this is approved, what is your time frame to get this done? Answer McConkey: Fairly soon. 12 months for sure. Its going to be a slab with a pole shed mounted on it. Appearing in Favor: Blaine Lee, N6304 Bergum Coulee Rd, West Salem, WI, 54669. Blaine stated this is a unique spot with all the springs present on the site. He said the Town’s main concern was if there would be enough room for road maintenance and he felt the proposed location was the best spot to put a building. Blaine said there was enough room for plows and emergency vehicles to turn around. Appearing in Favor: Steven Knudson, W2904 M Knudson Rd, Mindoro, WI, 546694. Steve stated the proposed located is the most user friendly location for the school bus and snow plow to get around. Question Raymer: Blaine this is in the Town Road right of way, not just the setback, does the Town have any liability with this? Answer Lee: Shouldn’t be an issue, no. E-mail from Town of Hamilton Clerk Sara Schultz, dated and received Monday April 27, 2020, in regards to Town of Hamilton Town Board meeting held April 21, 2020. The Town Board voted unanimously to approve variance request 2020-14. 2.) E-mail from Terry G Craig, dated and received Monday May 18, 2020. E-mail stated he was opposed to the variance appeal. Discussion: The Board discussed that they saw no issue with the appeal.
