CONTRACT RIDER ADDITIONAL TERMS AND CONDITIONS Please read this rider carefully. It is part of the attached contract for Fretless Music LLC (who’s company, contractors, agents, employees, licensees and designees are hereafter referred to as “PRODUCER”) furnishing the services of Kittel & Co. (hereinafter referred to as “ARTIST”). By signing it, you are agreeing to supply ARTIST with production and proper working conditions essential to performance. Any breach of the terms and conditions of this rider is a breach of the contract and may cause ARTIST to refuse to perform without releasing PURCHASER from his obligation to pay PRODUCER. If ARTIST elects to perform notwithstanding a breach of this agreement by PURCHASER, the performance by ARTIST shall not constitute a waiver of any claim PRODUCER may waive for damages or otherwise. A. ADVERTISING AND PROMOTION Al. ARTIST is to receive 100% star billing on all publicity releases and paid advertisement including - without limitations - programs, electronic media, flyers, signage, newspaper advertisements, marquees, tickets, radio spots, TV spots, etc. unless otherwise authorized in writing by PRODUCER. Billing on all advertising and publicity materials must appear as follows: Kittel & Co. (100% Headline Billing) A2. PURCHASER agrees to use only artwork, ad mats, photos and/or promotional materials provided or approved by PRODUCER. Publicity photos, bios and other assets can be downloaded from www.imnworld.com/kittelandco PURCHASER shall supply all publicity and marketing materials to PRODUCER for review and approval prior to PURCHASER’s print deadlines and/or online launches. A3. In the condition that PURCHASER is distributing program notes at the performance described herein, only those provided directly by PRODUCER shall be used. The exact copy of these notes may be translated from English to the local language, but only with written authorization by PRODUCER before the final version is printed. All program notes must be approved by PRODUCER prior to publication of the materials – without exception. A4. PURCHASER agrees not to commit ARTIST to any personal appearances, interviews or other promotional event or appearance without prior written consent from PRODUCER. B. PRODUCTION, INSURANCE AND PAYMENTS B1. PURCHASER shall not allow audience to enter place of performance until technical set-up has been completed. ARTIST shall complete said setup one hour prior to time of performance or at a mutually agreeable time. ARTIST requires a minimum one (1) hour sound check after completion of load in and set up. When a tour manager and/or sound engineer travels with ARTIST, set up must be arranged one hour before sound check with ARTIST. Festival producers are required to comply with this policy unless otherwise agreed in writing with PRODUCER. B2. PURCHASER agrees that there shall be no signs, placards or other advertising materials on or near the stage during the entire performance. ARTIST'S appearance shall not be sponsored by, or in any other way tie-in with, any political candidate, commercial product or business. B3. There shall be no opening act without PRODUCER’s prior written approval.

Please provide 6 bottles of water for stage. Dressing Rooms Please provide a clean, private dressing room secure from audience/staff. If possible, when there are multiple dressing rooms available, the band would prefer to use them. Food Upon arrival/load-in to the venue, please provide coffee, tea, fruit tray, veggie tray, mixed nuts, and 4 sandwiches to be available to the artists continuously until load-out at the end of the evening. For dinner, please provide a hot, healthy meal for four in a dining area near dressing rooms (or in dressing rooms if they’re large enough). Our goal is to have a convenient meal for the artists so that they do not have to leave the venue between sound check and performance. Usually the band would prefer to eat dinner two (2) hours in advance of the performance time; please confirm with the tour manager. Please note the following guidelines:
· No cream-based sauces
· No deep-fried foods or fast food such as Wendy’s or Taco Bell.
· No Pastas (Lasagna, Fettuccini, etc)
Here’s a sample menu suggestion:
Fish, chicken, or lamb, either baked, grilled, or broiled, with salad, steamed vegetables, and a starch (e.g. brown rice / potato)
If the above is not possible, then the presenter may choose an alternative option: a food buyout at $20 per person to be paid to band in cash three hours before scheduled performance time. If possible, please provide menus and phone number for a local quality restaurant that will deliver to the venue.
Lodging When lodging is part of the agreement with the promoter, we ask that you provide single rooms at a quality hotel. Depending on logistics, sometimes we would prefer that you provide two rooms for two nights rather than four rooms for

one night; please inquire as to our preference with the band’s tour manager. The band commonly spends many months of the year in hotel rooms, so clean, comfortable rooms are greatly appreciated. Please provide the artist with the hotel address, phone number and confirmation numbers at your earliest convenience. Note: • All opening acts must be approved by the band/agency in advance. Kittel & Co. travels with their own In-Ear Monitoring System. No wedge monitors are needed on stage. All stage inputs run to a monitor rack positioned upstage center. From there the signals are split to the monitor rack and to the stage channel rack or channel snake. This allows FOH to control each signal while allowing Kittel & Co. to control their own personal monitor mix. Alternatively, FOH can draw from the L&R outputs of the monitor rack and run sound from the rack’s portable mixer. The band tours with an IPAD (with the Xair software) which can be used to mix FOH if your engineer is comfortable going with this approach.
