Mayor Mescher opened the public hearing on the Willis/Welter re-zoning of Lots 81 through 85 and Lot 96 from R-1 to C-2 at 6:00 p.m. Providence Valente – 673 Lilac Lane - lives directly behind the property, when they bought their lot, they knew that the property across the street was residential so she was ok with purchasing the property. She isn’t against growth in the community, she is in favor of it. Out of respect for the families she understands why they want to do what they want to do, but as a property owner she has to look out on her behalf also. One of her main concerns is how it will affect Lilac Lane, when you enter Deerwood Street from Peosta Street this is a very narrow road and if there are two cars at the intersection there is always an issue; if there is a business located on the property how is traffic going to flow? The buildings are pretty close to the road, she isn’t sure how this works with the setbacks; she also has concerns about fencing and what that is going to look like aesthetically. What about chemical use, as people that like to be outdoors what are they going to be smelling? Will there be noise coming from the commercial property, this is a quiet street, they love living there. The property is large will it be a catch all for things a business might accumulate? Providence read up on the code and she knows that Peosta has a junk ordinance, she isn’t sure how it’s enforced, as a neighbor she doesn’t want to be calling City Hall to complain about the business on a regular basis. This will create a substantial hardship for her property and the value of it when she goes to sell her home. What justifies changing the zoning from residential to commercial. To the Council if they do rezone please pay close attention to the property and how are they going to improve the property, it is on the main road it needs to look nice. Providence thanked the Council for their consideration of her comments. Mayor Mescher asked about the junk cars that are on the property currently, Mark Willis said that everything that is setting there will be gone once they own the property. Jeff Willis said the little shed will also be removed and the shed that is off of Deerwood Street will be re-sided. The Mayor also said that the City doesn’t allow trailers to be parked on grass, nothing has been approved yet and there are already five trailers parked on the property. Per Jeff Willis one trailer and one camper will be leaving for sure; the Mayor said personally he doesn’t think this is the right spot for the business. John Kraft addressed the area to the south of the building on Lilac Lane, Jeff said that the fenced in area will have their metal dumpster and if a car is delivered overnight it will be parked behind the fence. John asked how often the metal dumpster is disposed of; Jeff said they empty it themselves so whenever it gets full they get rid of it. John also asked about a third side to the privacy fence so nothing is visible from Peosta Street. Kathy Orr asked about paint fumes, Jeff said they have a $40,000 paint booth and he doesn’t know that you would ever smell any fumes, they haven’t had any complaints from their current neighbors living in the condos Greg Rausch owns. What product will be used for the fencing? Jeff said it will either be a chain link fence with vinyl slats or one with fabric that goes through it. Kathy also asked about noise, Jeff said noise is minimal. John asked about hours of operation, Jeff said 8-5 Monday through Friday and some Saturdays depending on how busy they get. John Valente asked about banging on cars, Jeff and Mark said you shouldn’t hear much outside the building. The Mayor asked what the timeline for the hard surfacing is; Jeff said once they figure out where their office will be located, they can’t pave until the office is up. Front set back is 20’; Karen Lyons said she doesn’t know that the existing buildings meet the setbacks from the street; she said the small garage probably won’t meet the 20’ setback. The Mayor said he stepped it off today from the center of the road to the garage is approximately 29 feet; the big building is only 24 feet off the street; from the edge of the asphalt to the building; it doesn’t meet setback. Karen said the property hasn’t been used for a business for some time and when the business closed it reverted back to residential; if the property the house sets on stays residential they are creating an island. Karen is concerned about all of the residential property around them. Jeff asked how a 60 x 96 building is built on residential property, the Mayor said this was done before the Zoning Ordinance was adopted. Karen said if it would have stayed in business all this time it would not be an issue. John Kraft asked what the building is used for now, Jeff said storage for cars. Karen explained that the restricted residence district is no longer in effect; now there is a zoning ordinance. John Valente – 673 Lilac Lane - said his main concern is the property value on their home, is he going to be able to sell his home? Karen Lyons said this is what she is addressing on the residential; Shirley Welter wants to keep her house residential as well. He is concerned about living by the business running as an auto body shop; hates to see this building with this type of zoning. Providence Valente asked if this would be considered spot zoning? Jeff Willis said that the bar is commercial; Karen said they have been open through the zoning changes. Jeff said that the property they are on now is kept up and they will be moving to twice the size building so most of the stuff that has a possibility of being outside can be inside. Gerry Hess asked about parking surface; Jeff Willis said up front will probably be blacktop, this would be at the intersection of Sundown and Deerwood Streets. Jeff said this is their way of getting the property cleaned up, they will take care of their property. Gerry asked about the condition of the existing garage on Deerwood Street, Jeff said it is slate siding, but the structure looks pretty good it has a new roof, it is in their plans to make it look better. There are just two people working in the shop, may add 1 or 2 part timers in the future. They may put up a different building in the future if they are able to get the zoning but it could be five years down the road. John Kraft asked if there is a backlog of vehicles, where will they be stored? Jeff said the majority could be stored in the back storage (northeast door of the building) they aren’t taking the whole building for their work area. John asked other than the cars for sale and their cars there won’t be any other cars parked on the lot? Jeff said unless a customer was picking up a car after hours it would usually stay in the building. Gerry asked about trailer parking, Jeff said they will probably keep them where they are currently, it’s tough to keep a trailer in storage since they take up so much room and they are using them on a regular basis. John Valente said at the end of the day, they are going to have to look at the car lot, fences, blacktop or gravel it will still be a business that they have to look at every day.
