13 Sunday June 9, 2019 STATE TIMES NEWS JAMMU: Principal Sessions Judge Jammu V.C Koul on Saturday rejected the bail application of Balwan Kumar, son of late Manga alias Manga Ram, resident of Parth Pargwal (Marh Kulla) Jammu, who was arrested and booked under POCSO Act. According to case, com- plainant Bali Ram lodged report that accused kid- napped his daughter on August 1, 2018, when she was sleeping along with her family inside his residential Kulla and took her to some unknown place. After hearing both the sides, the court observed that in such cases, the exer- cise of discretion vested in the courts cannot be exer- cised in favour of the accused as a matter of course and he cannot be granted bail without their being extraordinary circum- stances in his favour. "The act which is alleged of hav- ing been committed by the accused is a heinous offence having provoked social con- demnation and social dis- gust. Court cannot ignore at this stage the public anger and condemnation that the act of the accused has pro- voked. Admitting the accused to bail at this stage of the case would add to, and aggravate, that anger and condemnation and may cause people lose faith in the administration of criminal justice. Considering the present bail matter on the pedestal of justice and objectivity, this court does not find any merit in it. The accused cannot be granted bail at this stage of the case", the court observed adding that the other reason which persuades this court to reject this bail petition is to prevent the accused from absconding and tampering with the prosecution evi- dence. With these observa- tions, court rejected the bail application. Bail denied to man booked under POCSO Act STATE TIMES NEWS SRINAGAR: Advisor to Governor Khurshid Ahmad Ganai on Saturday held a pub- lic outreach programme at Grievance Cell, Church Lane, Sonawar here. As many as 16 delegations visited the Governor's Grievance Cell and appraised him with various issues and problems faced by them in their respective areas. A number of individuals also called on the Advisor to seek redressal of their problems. Among delegations included villagers of Gujjar Basti, Nandimarg of district Kulgam, Akhal Kangan and Shalteng area. The raised by the delega- tions included road connectivi- ty, irrigation facilities for their agricultural lands and early completion of ongoing projects. Another delegation demanded establishment of Degree College in the Shalimar area of Srinagar. The Sports Federation Mattan demanded the development of sports infrastructure in their area. The delegation consisting of cricket bat manufacturers raised the issues confronting the industry. Another delegation from Beerwah demanded the devel- opment of their area as Hill dis- trict, and providing of different amenities like drinking water, road, educational and health facilities in their area. The deputations from Srigufwara Anantnag raised the issue of compensation in terms of SRO-43, while as the 12th class students from Higher Secondary School Bijbehara sought reconsidera- tion of their cancelled papers for assessment. Contractual lecturers demanded exemption from yearly screening tests for their selection on academic arrangement. The Employee delegation of seasonal teachers also met the Advisor for the continuation of their services and enhancement of their monthly remuneration. Moreover, scores of individu- als also visited the camp with their personal complaints. The Advisor listened to each of them very patiently, and gave specific directions to the relevant agen- cies and assured them of taking their issues with the relevant agencies for their early resolu- tion. STATE TIMES NEWS JAMMU: Former Deputy Chief Minister, Kavinder Gupta said that a comprehen- sive development plan is underway in Gandhi Nagar constituency to meet basic development needs of inhabi- tants with special thrust being laid on construction of lanes, drains, paths, best drainage facilities and toilet complexes to strengthening the Swachh Bharat Mission. Gupta said this while inter- acting with inhabitants of Jeevan Nagar and BJP work- ers, after starting macamadis- ation work of Jeevan Nagar- Darap-Maralian road, which is being executed by PWD at an estimated cost of Rs 2.5 crore. STATE TIMES NEWS SRINAGAR: Chief Secretary, B.V.R Subrahmanyam on Saturday reviewed the arrangements made for the smooth conduct of Shri Amarnath Yatra (SANJY- 2019), commencing from July 1. Director General of Police, J&K, Financial Commissioner, Health & Medical Education, Financial Commissioner to Governor/CEO, SASB, , Principal Secretary Home, Principal Secretary, PD&MD, Principal Secretary, Animal & Sheep Husbandry/Transport, Administrative Secretaries of the Departments of Power Development, Forest, Ecology & Environment, PHE and I&FC, Tourism and Divisional Commissioner, Kashmir and other senior officers attended the meeting. Divisional Commissioner, Jammu, DC Ganderbal and DC Anantnag participated in the meeting through video conferencing. Chief Secretary reviewed in detail the facilities for safe, smooth and secure movement of pilgrims particularly along the Jammu-Srinagar National Highway and Baltal and Chandanwari Yatra tracks up to the Holy Cave. Chief Secretary directed the Divisional Commissioner Kashmir/ Jammu to closely monitor the arrangements being put in place in Transit Camps along the Yatra route particularly at Kathua, Samba, Jammu, Udhampur, Ramban and in the base camps at Baltal and Chandanwari. He asked Divisional Commissioner, Jammu to work out a plan for holding of Yatries in Transit Camps especially between the Udhampur - Ramban-Banihal stretch in the event of blockade of National Highway due to landslides etc. He stressed on keeping Mughal Road opera- tional for use during the Yatra as an alternate route in the event of blockade of Jammu- Srinagar National Highway. Chief Secretary also reviewed the status of comple- tion of track up-gradation works on Baltal & Chandanwari routes upto Holy Cave, improvements at the access control gates, estab- lishment of camps, shelter sheds, health/medical camps and Emergency Operation Centers (EOCs) at various locations, provision of drinking water supply, lighting, LPG, ration, Medicine and mobile connectivity besides establish- ment of Joint Control Rooms. Timelines were finalized for completion of various works and putting in place all arrangements before June, 25, 2019 for smooth commence- ment of the Yatra. It was informed that Camp Directors, Additional Camp Directors and Deputy Camp Directors drawn from the Civil and Police Administration will be in position by June-25, 2019. Chief Secretary empha- sized that SoP for Camp Directors should be devised to make it mandatory for them to hold a brief morning meeting with all the Officers on a daily basis. "This will result in improved team work and coor- dination to deal with contin- gencies", he said and added that the Camp directors be vested with magisterial powers for their smooth functioning. DGP, J&K informed that for the SANJY-2019, 11 Mountain Rescue Teams (MRTs) of J&K Police besides 4 NDRF Teams supplemented by the rescue teams drawn from SDRF and CRPF etc will be deployed at various locations to deal with various contingencies. Chief Secretary directed that the units of Civil, Police, Medical teams and MRTs etc being deployed at various locations should be kept at one place or in vicinity for quick response and better coordination for management of the Yatra. Arrangements put in place by the Sonmarg and Pahalgam Development Authorities and the Shri Amarnathji Shrine Board (SASB) for disposal of Solid, Liquid Waste as would be generated during the Yatra period were discussed in detail. STATE TIMES NEWS JAMMU: Anti-Corruption Bureau(ACB) Jammu on Saturday booked then Sr. Town Planner, Jammu Municipal Corporation (JMC) and the then Commissioner, JMC for criminal misconduct, abuse and misuse of their official position as public servants while issuing building per- mission in favour of Pardeep Kumar and Kuldeep Kumar, sons of Shanti Prakash with dis- honest intentions. A verification was con- ducted into the allegations that building permission was granted to Pardeep Kumar and Kuldeep Kumar for raising a resi- dential as well as commer- cial structure at Gummat Chowk Jammu, illegally and against laid down pro- cedure of JMC. The former Senior Town Planner rec- ommended case of the applicant to the then Municipal Commissioner Jammu, who approved the building permission with- out referring it to BOCA or UTEIC ignoring objections raised by ACR Jammu and AC Nazool, deliberately and with malafide inten- tions. During verification pro- ceedings, it also came to fore that land in question was basically State land and acquired by Rani Blori temple during the rule of Maharaja but the officers relied upon the notarised lease deed which contained cuttings and unclear land specifications/Khasra number and despite these inherent defects, the per- mission was granted in favour of the beneficiaries, illegally thereby conferring huge pecuniary advantage upon them as the permis- sion in question facilitated them to raise a huge com- mercial structure at the prime location near Gummat Chowk, Jammu. As per the probe, it became evident that former Senior Town Planner and the then Commissioner Municipal Jammu by abuse and misuse of their official positions as public servants with dishonest intentions sanctioned building permission in favour of the beneficiaries which paved way for them to raise huge commercial complex in Jammu city. As the probe, prima facie, disclosed commission of criminal misconduct on the part of the then Senior Town Planner and the then Commissioner JMC vis-a-vis the beneficiaries Pardeep Kumar and Kuldeep Kumar and con- stituted offences under Section 5(1) (d) punish- able under Sections 5 (2) J&K P.C Act, Svt. 2006 read with 120-B RPC, a formal case FIR No. 12/2019 has been regis- tered at Police Station ACB Jammu for investiga- tion. The meeting was attended by IGP CRPF, DIG CRPF, DIsG DKR /JSK Range, SSsP Jammu, Samba, Kathua, Udhampur, Ramban, SSP Railways, SSP Security, SSP PCR, Jammu, SP Telecommunications and representative of SDRF Battalion. During the meeting, detailed discussion were held with regard to CAPF man- power provided by PHQ for Amarnath Yatra and further distribution as per ground requirement in five districts of Jammu province and PCR Jammu for smooth conduct of Yatra. Deployment to meet any contingencies in the other district of Jammu Zone was also finalised. The dis- tricts SSsP were directed to ensure optimum use of the resources available with them for the purpose.
