Prince Edward Island Automobile Insurance Reform Effective
October 1, 2015
As of October 1, 2015 Reform 3 of Bill 46 “An Act to Amend the
Insurance Act (No. 2)” in Prince Edward Island will take effect to
implement Direct Compensation Property Damage coverage for
accidents occuring on or after that date. Policyholder’s will now
be compensated by their own insurer for property damages resulting
from an automobile accident to the degree they are not at fault.
This coverage is mandatory. Facility Association rate pages have
been amended to split Third Party Liability premiums between Bodily
Injury and Property Damage and include premiums for DCPD coverage.
A number of rules have been changed to add references for DCPD
coverage where appropriate and to provide rating instructions as
required. In addition, amended rules in the manual are being
implemented October 1, 2015 including:

requirement to order MVR where collision is not fleet rated • Amend
Policy Change and Cancellation rule to the date request received by
Agent/Broker
rather than Servicing Carrier • Expand flat cancellation

GENERAL Midterm transfer of business and broker of record letter
of authorization
None Midterm Transfer of Business and Broker of Record Letter of
Authorization Broker of Record Letters of Authorization for an
insured to change agent/broker are not accepted. A new application
must be submitted whether the transfer from one agent/broker to
another is to take place midterm or at renewal. Midterm transfer of
a book of business or partial book of business from one
agent/broker to another is not permissible. The transfer will take
place at renewal. It is expected the new agent/broker will review
the risk carefully for remarket before renewing with Facility
Association.

PRIVATE PASSENGER SECTION 100:A The insurer’s rules for
declining to issue, terminating or refusing to renew a contract
are:

months to cover the insurance requirement. Upon expiry the
policy will lapse and will not be renewed. If the vehicle is
registered in this jurisdiction prior to the expiry of the short
term policy, the short term policy will be cancelled pro rata and a
new POL 1 will be issued for a 6 or 12 month term.
100:B Filed underwriting rules

If a current year make/model is not listed but it was listed in
the previous year, use the rate group for the previous year. If it
was not listed in the previous year (new model), contact your
Servicing Carrier. The Servicing Carrier shall provide you with the
Rate Group assigned by the Vehicle Information Centre.

preceding year (It is a new model or there is a gap in model

126 Policy Term

insured requests cancellation of the policy to be effective August

October 10. The Servicing Carrier will cancel the policy effective
12:01 a.m. October 10.

129:E Flat Cancellation Exceptions
1) Any policy returned to the Servicing Carrier complete with
liability cards, prior to the effective date of the policy, may be
cancelled flat. 2) If a cheque received for a new policy or renewal
premium or, for the first installment thereof is not honoured by
the bank, flat cancellation shall be allowed to the Agent/Broker
provided that: a) the cheque was dated and issued on or before the
effective date of the policy period concerned; and b) the cheque
was immediately deposited; and c) in the case of a first
installment, the amount of the cheque was sufficient to cover two
months pro rata premium or if financed under a contract with a
premium finance company the full down payment required under the
terms of the contract; and d) The return of the cheque by the bank
is promptly reported to the Servicing Carrier. A copy of the cheque
front and back must be provided to the Servicing Carrier.

required under the terms of the contract; and d) The return of the
cheque by the financial institution or dishonour of the electronic
payment is promptly reported to the Servicing Carrier. A copy of
