The Judicial Branch of the State of Iowa is composed of the Supreme Court, the Court ofAppeals, and the Iowa District Court.

Supreme CourtThe Supreme Court is the highest appellate court in the state with jurisdiction to review

the decisions of all inferior courts. In Iowa, all appeals are filed with the Supreme Court. TheSupreme Court retains certain cases to decide itself, and transfers other cases to the Court of Appealsfor a decision. A litigant who is dissatisfied with a Court of Appeals decision may seek furtherreview by the Supreme Court. The Supreme Court is also responsible for licensing and discipliningattorneys, promulgating rules of procedure and practice used throughout the state courts, andoverseeing the operation of the entire state court system.

Court of AppealsThe Court of Appeals is the state’s intermediate appellate court with jurisdiction to hear

appealed cases assigned to the Court of Appeals by the Supreme Court.

Iowa District CourtThe Iowa District Court was established as a unified trial court, effective July 1, 1973, by

the Unified Trial Court Act of 1972, which also abolished all trial courts below the district court suchas justice of the peace courts. The district court has general jurisdiction of all civil, criminal, andjuvenile cases and probate matters in the state. The district court sits in all county seats.

Judicial DistrictsFor judicial administration purposes, the 99 counties are organized into eight judicial districts. Each

judicial district is composed of five to 22 counties with eight to 28 district judges of general jurisdictionassigned to each judicial district. For purposes of nomination and appointment of district judges anddistrict associate judges, five of the eight districts are divided into subdistricts for a total of 14 judicialelection districts as shown on the map below.

Judicial OfficersIn 1962, Iowa voters approved a constitutional reform that replaced the process of selecting

judges by popular vote with a merit selection and retention election process. This reform promotesselection of the best qualified applicants and ensures that Iowa has fair and impartial judges who areaccountable to the public. At the same time, it eliminates the need for judges to raise money frompolitical parties, special interest groups, and others for an election campaign, an activity that maycompromise impartial decision making.The merit selection system involves a nonpartisan commission that reviews the qualifications of

applicants for judicial office. Applicants provide the commission with extensive information abouttheir education, professional career, and qualifications. In addition, the commissionconducts interviews of all candidates. Once the commission screens and interviews applicants, itforwards a slate of nominees to the Governor, who makes the final appointment.Within the district court are six types of judicial officers: district judges, district associate

judges, associate juvenile judges, associate probate judges, senior judges, and magistrates.Statewide, the district courts have 116 district judges, 68 district associate judges, six associate

juvenile judges, one associate probate judge, and 146 part-time judicial magistrates. Retired judgescalled senior judges may also serve temporarily in the district court.

Associate Juvenile JudgesAssociate juvenile judges preside over juvenile cases and adoptions only. They have

authority to issue orders, findings, and decisions in juvenile cases, including cases that involvejuvenile delinquency, children in need of assistance, and termination of parental rights. Associatejuvenile judges serve six-year terms. They are appointed by the district judges of the judicial districtfrom a slate of nominees screened and selected by the county magistrate appointing commissions.

District Associate JudgesDistrict associate judges have the jurisdiction of judicial magistrates plus authority to hear

serious and aggravated misdemeanor cases, civil suits in which the amount in controversy is $10,000or less, and juvenile cases when the judge is sitting as a juvenile judge. District associate judges areappointed by the district judges of the judicial district from a slate of nominees screened and selectedby the county magistrate appointing commissions. Their term is six years.

District JudgesDistrict judges have the authority to hear any type of case within the district court. District

judges typically hear a variety of cases including probate, felony criminal cases, dissolution ofmarriage, adoptions, disputes involving actions of state administrative agencies, juvenile cases, andother matters. Many district judges travel extensively to make sure all of Iowa’s counties have aregular schedule of judicial service. District judges are appointed by the Governor from a slate ofnominees chosen by the judicial election district nominating commission. Their term of office is sixyears.

Chief Judges of the Judicial DistrictsIn each judicial district, a chief judge is appointed by the Supreme Court to a two-year term

to supervise the work of all trial judges and magistrates in the judicial district.

Judicial MagistratesEvery county is assigned at least one judicial magistrate position although the magistrate

may reside in a contiguous county. Magistrates may hear cases in other counties upon order ofthe chief judge of the district. Magistrates serve four-year terms and are appointed by countymagistrate appointing commissions. Magistrates are required to be attorneys and have jurisdictionover simple misdemeanors, including scheduled violations, county and municipal infractions, andsmall claims. Magistrates have authority to issue search warrants, conduct preliminary hearings, andhear certain involuntary hospitalization matters.

The Iowa Supreme Court is composed of seven justices. The justices are appointed bythe Governor to eight-year terms from a list of three nominees selected by the State JudicialNominating Commission. Justices must stand for retention in office at the first general electionheld after serving at least one year, and every eight years thereafter. The justices elect one of theirmembers as chief justice to hold office until the expiration of the member’s term.The Supreme Court is required to hold court at the seat of state government and elsewhere

as the court orders and at the times the court orders. The Supreme Court has general appellatejurisdiction in both civil and criminal cases and its opinions are binding on all other Iowa statecourts. As the constitutional head of the Iowa Judicial Branch, the Supreme Court has the authorityto supervise the trial court and all judicial officers and court employees, to prescribe the procedure inmatters brought before it and the rules for admission of attorneys to the practice of law. It also has thepower to prescribe rules of civil and appellate procedure. Any rules prescribed by the Supreme Courtand reported to the General Assembly become effective unless changed by the General Assembly.Under a 1972 constitutional amendment and the provisions of the Iowa Code, a Commission on

Judicial Qualifications is established to receive, investigate, and evaluate allegations ofjudicial misconduct. The commission can apply to the Supreme Court to retire, discipline, or removea judge or magistrate. The commission has seven members and is independent from the judicialbranch. Four members are appointed by the Governor and are subject to Senate confirmation; threemembers, a district court judge and two lawyers, are appointed by the Chief Justice of the SupremeCourt.Summaries of Supreme Court decisions and the full text of the opinions are available on the

JUSTICES OF THE SUPREME COURTChief Justice Mark S. CadyChief Justice Cady, Fort Dodge, was appointed to the Iowa

Supreme Court October 15, 1998, and became the Chief Justice inJanuary 2011.Chief Justice Cady was born in Rapid City, South Dakota. He

earned both his undergraduate and law degrees from Drake University.After graduating from law school in 1978, he served as a judiciallaw clerk for the Second Judicial District for one year. He was thenappointed as an assistant Webster County attorney and practiced with alaw firm in Fort Dodge. Chief Justice Cady was appointed as a districtassociate judge in 1983 and a district court judge in 1986. In 1994,he was appointed to the Iowa Court of Appeals. He was elected chiefjudge of the Court of Appeals in 1997.Chief Justice Cady is a member of the Order of Coif

(honorary), Iowa Judges Association, and Iowa Academy of TrialLawyers (honorary). He is the Iowa chair of iCivics Inc. He alsoserved as chair of the Supreme Court’s Task Force on the Court’sand Communities’ Response to Domestic Abuse and is a memberof the Drake Law School Board of Counselors. Chief Justice Cadyis the coauthor of Iowa Practice: Lawyer and Judicial Ethics(Thomson-West 2007 – 2015); the coauthor of Preserving the DelicateBalance Between Judicial Accountability and Independence: MeritSelection in the Post-White World, 16 Cornell J.L. and Pub. Justice David S. WigginsJustice Wiggins, West Des Moines, was appointed to the

Supreme Court in 2003.Justice Wiggins, who was born in Chicago, Illinois, earned

his bachelor’s degree from the University of Illinois in Chicago in1973. He graduated with honors and Order of the Coif from DrakeUniversity Law School in 1976. While in law school he served asassociate editor of the law review. Justice Wiggins began his legalcareer as an associate in the West Des Moines law firm of Williams,Hart, Lavorato & Kirtley. He became a partner in the firm in 1979.Prior to joining the court, Justice Wiggins was active in

numerous bar organizations including serving on the Board ofGovernors of the Iowa State Bar Association, and serving as presidentof the Iowa Trial Lawyers Association, senior counsel for the AmericanCollege of Barristers, master emeritus of the C. EdwinMooreAmericanInn of Court, a founding sponsor of the Civil Justice Foundation, andan advocate for the American Board of Trial Advocates. He servedas chairperson of the Judicial Qualifications Commission from 2000until he joined the Supreme Court. He received the MeritoriousAchievement Award from the Iowa Trial Lawyers Association in 1999.Justice Wiggins was born in 1951. He is married and has

three children. His current term expires December 31, 2020.

Justice Daryl L. HechtJustice Hecht, Sloan, was appointed to the Supreme Court in 2006.Raised near Lytton, Iowa, he received his bachelor’s degree

from Morningside College in 1974 and his J.D. degree from theUniversity of South Dakota in 1977. He received his L.L.M. degreefrom the University of Virginia Law School in 2004.Justice Hecht practiced law in Sioux City for 22 years before his

appointment to the Court of Appeals in 1999.Justice Hecht is a past president of the Iowa Trial

Lawyers Association. He served as chairperson for the Iowa SupremeCourt Task Force for Civil Justice Reform. He has served as amember of the Board of Directors of the Boys and Girls Home andFamily Services, the Morningside College Alumni Association, theWoodbury County Judicial Magistrate Nominating Commission, andthe Woodbury County Compensation Commission.Justice Hecht was born in 1952. He is married and has

two daughters. His current term expires December 31, 2016.

Justice Brent R. AppelJustice Appel, Ackworth, was appointed to the Supreme Court

in 2006.A Dubuque native, he received his bachelor’s and master’s

degrees from Stanford University in California in 1973 and his J.D.degree from the University of California, Berkeley, in 1977.Following graduation from law school, Justice Appel served as

a court law clerk for the United States Court of Appeals for theDistrict of Columbia Circuit. In 1979, Justice Appel was appointedIowa First Assistant Attorney General, and in 1983 became IowaDeputy Attorney General. While serving in the Iowa AttorneyGeneral’s office, Justice Appel argued and briefed four cases beforethe United States Supreme Court, including the second “Christianburial” case, Nix v. Williams. From 1987 until 2006, Justice Appelwas engaged in private practice in central Iowa.Justice Appel is a member of the C. Edwin Moore Inn of Court. He

has served on the Supreme Court’s Bar Conduct Committee andis currently a member of the subcommittee on Supreme Court Rulesof Practice and Procedure.Justice Appel was born in 1950. He is married and has five sons

and one daughter. His current term expires December 31, 2016.

Justice Thomas D. WatermanJustice Waterman, Pleasant Valley, was appointed to the

Supreme Court in 2011.Justice Waterman, who was born in Davenport, Iowa, earned

his bachelor of arts degree from Dartmouth College in 1981. Hegraduated Order of the Coif from the University of Iowa College ofLaw in 1984, and served as associate editor of the law review. He wasin private practice at Lane & Waterman LLP in Davenport from 1984until his appointment.Before joining the court, Justice Waterman was active in

numerous organizations including the Jury Instruction Committeeof the Iowa State Bar Association, the American College of TrialLawyers, and the Iowa Academy of Trial Lawyers. He was a memberof the State Judicial Nominating Commission from 1999 – 2005,and was a co-editor of Defense Update, the quarterly publication ofthe Iowa Defense Counsel Association. An avid endurance sportsenthusiast, he has completed seven Ironman triathlons and severalultra-marathons including the Leadville, Colorado, 100-mile trail runand the Grand Canyon “Rim to Rim to Rim.” His volunteer workincluded serving as board chair for the Scott County Family YMCAand Rivermont Collegiate.Justice Waterman was born in 1959. He is married and has

four daughters. His current term expires December 31, 2020.


Justice Edward M. MansfieldJustice Mansfield, Des Moines, was appointed to the Supreme

Court in 2011.Justice Mansfield was born and raised in Massachusetts. He

received his undergraduate degree from Harvard in 1978, and his lawdegree from Yale in 1982. After law school he clerked for the U.S.Court of Appeals, Fifth Circuit.Justice Mansfield worked as an attorney in private practice until

his appointment to the Iowa Court of Appeals in 2009. JusticeMansfield also has been an adjunct professor of law at Drake Universitysince 1997.Justice Mansfield is a member of the Iowa State Bar

Association, having served as Chair of the Trade RegulationSection from 2004 – 2006. He is a member of the Polk County BarAssociation and the Iowa Judges Association. Justice Mansfield alsoserves on the board of directors of Goodwill Industries of CentralIowa, and is a past chairperson of this organization.Justice Mansfield was born in 1957. He is married and has

three children. His current term expires December 31, 2020.

Justice Bruce B. ZagerJustice Zager, Waterloo, was appointed to the Supreme Court

in 2011.He was born and raised in Waterloo, Iowa. He earned his

bachelor’s degree from the University of Iowa in 1975 and his lawdegree from Drake University Law School in 1980.Justice Zager was in private practice in Waterloo from 1981 until

his appointment to the Iowa District Court in 1999.Justice Zager is a member of the Black Hawk County

Bar Association, the Iowa State Bar Association, and the IowaJudges Association and serves on the Iowa Supreme Court PublicOutreach Steering Committee.Justice Zager was born in 1952. He is married and has three

In 1976, the General Assembly established the Court of Appeals as a five-memberintermediate court of appeals. A sixth judge was added in 1983. In 1999, three additional judgeswere added, making the Court of Appeals a nine-member court. The judges are appointed by theGovernor to six-year terms from a list of three nominees selected by the State Judicial NominatingCommission. To be considered for appointment, a person must be an attorney licensed to practice inIowa. The judges must stand for retention in office at the first general election held after serving atleast one year, and every six years thereafter. The judges elect one of their members every two yearsto serve as chief.A party dissatisfied with the final outcome of a case at the trial level may appeal. A party

does not always have the right to appeal. In some cases, for example, those involving a simplemisdemeanor crime or a small claims action, the party must seek permission from the Supreme Courtto file an appeal. Additionally, in limited circumstances, a party may seek an early appeal, or anappeal in advance of final judgment, by obtaining permission from the Supreme Court.The Court of Appeals is an intermediate appellate court. It reviews appeals from trial

court decisions that have been transferred to the Court of Appeals by the Supreme Court.At the appellate level, the court does not conduct trials or hear new evidence, but rather it

determines whether legal errors were committed in the rendering of the lower court’s judgment ororder. The appellate court can affirm — uphold the decision or order of the lower court; reverse —set aside the decision or order; or remand — send the case back to the lower court with instructions,including instructions to hold a new trial. JUDGES OF THE COURT OF APPEALSChief Judge David R. DanilsonChief Judge Danilson, Boone, was appointed to the Court of

Appeals in 2009. He was born in Perry, Iowa, and raised on a farmnorth of Woodward, Iowa. He earned his bachelor’s degree from IowaState University in 1976. He graduated from Creighton Law Schoolin 1979.Judge Danilson was in private practice in Boone beginning in

1980 and during this time served as judicial hospital referee andjudicial magistrate. He was appointed to the district associate bench inthe Second Judicial District in 1987. Judge Danilson was appointed tothe district court bench in 1997 and served two years as the assistantchief district judge of the Second Judicial District.Judge Danilson is a member of the Iowa State Bar Association

and the Iowa Judges Association.Judge Danilson was born in 1954. He is married and has

five children. His current term of office expires December 31, 2016.


Judge Gayle Nelson VogelJudge Vogel, Spirit Lake, was appointed to the Court of Appeals

in 1996. She was born in Rockford, Illinois, and graduated cumlaude from Rockford College in 1971.In 1983, Judge Vogel graduated from Drake University Law

School, Order of the Coif. Following law school, she worked in theprivate practice of law in Knoxville. In 1994, she was awarded theChamber of Commerce Business Woman of the Year Award. JudgeVogel is a member of the Iowa State Bar Association, having servedon the Grievance Commission from 1988 – 1996. As a member of theIowa Judges Association, she served on the juvenile law committeeand was co-chair of the Iowa Court Improvement Project. JudgeVogel was instrumental in developing rules to expedite appeals inchild dependency cases. In 2015, Judge Vogel was appointed to serveon the Judicial Technology Committee.Judge Vogel was born in 1949. Her current term expires

December 31, 2016.

Judge Anuradha VaitheswaranJudge Vaitheswaran was appointed to the Court of Appeals in 1999. She attended high school

in Cedar Rapids, Iowa. Judge Vaitheswaran received her undergraduate degree from GrinnellCollege. She attended the University of Iowa, earning a law degree and master’s in political science.Judge Vaitheswaran was a law clerk to Honorable Charles R. Wolle, Iowa Supreme Court, beforeWolle’s appointment to the federal district court. She worked as an attorney with Legal ServicesCorporation of Iowa and with the Attorney General’s office before her appointment to the appellatecourt.Judge Vaitheswaran is a member of the Polk County and Iowa State Bar Associations, the

Polk County Women Attorneys and Iowa Judges Associations, and the C. Edwin Moore Inn of Court.Judge Vaitheswaran was born in 1959. Her current term expires December 31, 2018.

Judge Amanda PotterfieldJudge Potterfield, Tiffin, was appointed to the Court of Appeals

in 2008. She was born in Jacksonville, Florida, and raised inDaytona Beach, Florida. Judge Potterfield attended Hollins College inRoanoke, Virginia, where she received her bachelor’s degree in 1969.She received her law degree, with honors, from the National LawCenter, George Washington University in 1974.Judge Potterfield worked as a criminal defense attorney for

the Georgia Criminal Justice Council and, later, for Prisoners’Legal Services in NewYork City. Judge Potterfield worked in Thailandtracing families for unaccompanied Kampuchean minors in 1980and in New York as a member of a team of lawyers challenging theemergency evacuation plan for a nuclear power plant near the city.She moved to Iowa in 1982 and worked in the Linn County PublicDefender’s office. She was in private practice from 1989 – 2001 beforebeing appointed to the district court bench.Judge Potterfield was born in 1947. Her current term expires

December 31, 2016.

Judge Richard H. DoyleJudge Doyle, Des Moines, was appointed to the Court of

Appeals in 2008. He was born in Elgin, Illinois, and raised in MountProspect, Illinois. He earned both his undergraduate and law degreesfrom Drake University. After graduating from law school in 1976, heserved as assistant attorney general for the Iowa Department of Justicein the Criminal Appeals Division. He was in private practice in DesMoines from 1977 until his appointment to the bench.Judge Doyle is a member of the Iowa State and Polk

County Bar Associations, Iowa Academy of Trial Lawyers, IowaJudges Association, and the Lincoln Inne.Judge Doyle was born in 1949. He is married and has two

children. His current term of office expires December 31, 2016.

Judge Mary E. TaborJudge Tabor, Des Moines, was appointed to the Court of Appeals

in 2010. She was born in Maquoketa, Iowa, and raised on herfamily’s farm in Jackson County. She earned her bachelor’s degreefrom the University of Iowa in 1985. She graduated from theUniversity of Iowa College of Law in 1991.Judge Tabor worked as a staff attorney in the Office of

General Counsel for the Federal Election Commission in Washington,D.C., from 1991 to 1993. She joined the Iowa Attorney General’soffice in 1993 and served as director of the Criminal Appeals Divisionfrom 1999 to 2010.Judge Tabor is a member of the Iowa State Bar Association and

the Blackstone Inn of Court.Judge Tabor was born in 1963. She is married and has two sons

and one daughter. Her current term of office expires December 31,2018.

Judge Michael R. MullinsJudge Mullins, Washington, was appointed to the Court of

Appeals in June 2011. He received his bachelor’s degree fromSouthwest Baptist University, Bolivar, Missouri, in 1974; his M.S.W.from the University of Iowa in 1976; and he was editor-in-chief ofDrake Law Review and graduated with honors, Order of Coif, fromDrake University Law School in 1982.Judge Mullins spent 19 years in private practice in

Washington, Iowa. He was appointed to the district court bench inDistrict Eight in January 2002. He is a former member of the JudicialTechnology Committee and the Business Advisory Committee forthe Electronic Document Management System (EDMS). He is also afaculty member for new judge orientation and a frequent presenterfor continuing legal education on the topic of sentencing issues.Judge Mullins developed and periodically updates the Iowa CriminalStatutes Summary Chart used by judges and lawyers throughout Iowa.He is a member of the Washington County Bar Association, the IowaJudges Association, the Iowa State Bar Association, and the AmericanBar Association.


Judge Mullins was born in 1952. He is married with twoadult married children and four grandchildren. His current term ofoffice expires December 31, 2018.

Judge Thomas N. BowerJudge Bower, Cedar Falls, was appointed to the Court of

Appeals in January 2012. Judge Bower received his bachelor’sdegree from Illinois State University in 1984 and his law degree fromDrake University in 1987.Judge Bower was appointed to the district associate court bench

in 1993 and the district court bench in 1995. He was appointed chiefjudge of the First District in 2010. Prior to his appointment, he servedas an assistant city attorney for the city of Ames and as an assistantBlack Hawk County Attorney. Judge Bower helped to establish theBlack Hawk County Adult Drug Court program in 2006 and a mentalhealth court program in 2009. Judge Bower is a member of the IowaState Bar Association, Black Hawk County Bar Association, andIowa Judges Association.Judge Bower was born in 1960. He is married and has two sons.

His current term expires December 31, 2020.

Judge Christopher L. McDonaldBorn overseas into a military family, Judge McDonald was raised

in Des Moines. He earned his undergraduate degree from GrandView University in 1997 and his law degree from the Universityof Iowa College of Law in 2001, where he graduated with highestdistinction and received the John F. Murray Award and Order of theCoif recognition.After graduating from law school, Judge McDonald served as a

law clerk to the Honorable David R. Hansen, United States Courtof Appeals for the Eighth Circuit. Judge McDonald then worked inprivate practice in central Iowa for a number of years prior to beingappointed to serve as a Judge of the District Court, Fifth JudicialDistrict of Iowa. In 2013, he was appointed to the Iowa Court ofAppeals.Judge McDonald has supported and served numerous nonprofit

and community organizations in Iowa. He has served on the Boardof Directors of Bravo Greater Des Moines, the Iowa Asian Alliance,and the Iowa Foundation for Microenterprise and CommunityVitality. Judge McDonald is a recipient of the Governor’s VolunteerAward.Judge McDonald is a member of the American, Iowa, and

Polk County Bar Associations. He is also a member of the IowaJudges Association, serving on the Board of Directors. Prior tohis appointment to the bench, Judge McDonald was active in severalprofessional organizations.Judge McDonald was born in 1974. He is married and has three
