2. (FOUO) Health: Detainee is in good health except for chronic lower back pain. He has noknown drug allergies. Detainee has a history of major depressive disorder with suicidal ideation.He has a nonspecific anxiety disorder. He takes no psychiatric medications. Detainee has notravel requirements.

3. (S//NF) JTF GTMO Assessment:

a. (S) Recommendation: JTF GTMO recommends detainee be Transferred to theControl of Another Country for Continued Detention (TRCD).

b. (S) Summary: Detainee is not assessed as being a member of Al Qaida or the Taliban.Detainee is the former Security Commander for Shinwar District in the Nangahar Province,AF, and was arrested at his compound on26 February 2003 following the discovery by USSpecial Forces of a suspected Improvised Explosive Device (IED) production facility. Thedetainee was arrested with three letters that associated him with senior Taliban officials, to

include Mullah Omar, the Taliban Supreme Leader. The detainee denies any knowledge ofthe letter. According to interpreter support at the Bagram Control Point, there are questionsof the authenticity of a letter written on the letterhead from Mullah Omar. Detainee iscooperative during interrogations, but his veracity may be questioned. Detainee has beendeceptive when questioned about his association with Mulawi Kabir, the former TalibanGovernor of Jalalabad, AF, and the Taliban as well as his knowledge of who was using theIED cache that was found at the time of his arrest. Detainee is assessed as not being amember of the Taliban, but is assessed to be able to answer questions as to the origin andidentity of the individual(s) who possessed the IED cache. The detainee's experience ofbeing a combat commander for 15 years would indicate the detainee may be a medium riskdue his ability to organize and lead men that may possibly participate or directly supportterrorist acts against US and coalition forces in Afghanistan.

4. (S/NF) Detainee Background Summary: Unless otherwise noted, the followingparagraphs are based solely on the detainee's statements.

a. Prior History: Detainee fought against the Soviets during the Soviet Jihad under HajiKhadir. (Analyst Note: Haji Khadir was the former Afghan Vice President that wasassassinated on 6 July 2002 in Kabul, AF.) The detainee served under Khadir as acommander for nearly 15 years. Following the Soviet Jihad, the detainee served as theDeputy of Refugee Affairs in Jalalabad, AF. During the time period when the Talibancontrolled Afghanistan, the detainee was sent by Khadir to fight the Taliban. The detaineewas captured by the Taliban and was held for nearly two months until village elders spoke inhis behalf for his release. Following the detainee's release the Taliban exiled him fromAfghanistan. The detainee fled from Afghanistan with his wives and children to Pakistanliving with a Yusef Haji for five to six years before returning to Afghanistan. Detaineereturned to Afghanistan to fight against the Taliban fighting under Khadir and Khadir's sonHqi Zafu during the fighting in Tora Bora in November of 200 I . (Analyst Note: Haji Zair isthe current Border Chief of the Nangarhar Province, AF.)

b. Training and Activities: Following the fall of the Taliban, Haji I(hadir appointed thedetainee as the Security Commander for Shinwar District in the Nangahar Province, AF, inJune of 2002. Detainee was in charge of 36 soldiers and was primarily concerned with druginterdiction and eradication operations as Commander of Security. The detainee wasinvolved in a raid in early January 2003 that seized 75,000 liters of chemicals used for theprocessing of poppies from a house in Ghani Kheyl, Nangahar Province, AF. The detaineeanswered directlv to Gul Kareem. the Chief of Securitv of Jalalabad, AF.

c. Gapture Informatioflr Detainee was captured on26 February 2003by US SpecialForces (USSF) following the discovery of an Improvised Explosive Device (IED) productionfacility in a compound located adjacent to the detainee's security compound and hissuspected relationship with Mulawi Kabir, the former Taliban Governor of Jalalabad, AF.Detainee was captured with US9AF-000986 (AF-986), a cousin and subordinate commander.Detainee was captured with numerous pieces of incriminating letters in his pocket litter thatassociates him with Taliban officials. The detainee claims to have no knowledge of theletters that he was captured with and that they were planted to frame him. Detainee was heldat the Bagram Control Point till his transfer to JTF GTMO'

d. (S) Transferred to JTF GTMO: 17 Iuly 2003

e. (S/NF) Reasons for Transfer to JTF GTMO: To provide information on thefollowing:

5. (S/NF) Detainee Threat:

a. (S) Assessment: It has been determined that the detainee poses a MEDIUM risk, ashe may possibly to pose athreatto the US, its interests and allies.

b. (S//NF) Reasons for Gontinued Detention:

o Detainee was captured with three letters implicating him with ties to the Taliban:o The first letter, written by the administrator of Ghunikiel, AF, Haji Jabar,identified the detainee as a producer of IEDs. In the letter, Jabar claims that hewarned the detainee about the production of IEDs and he did not heed the warning.(Analyst Note: The wording of this document refers to the detainee as the "Previous

Security Commander" and may have been written following the arrest of thedetainee.)o The second letter was written on the personal letterhead of Mullah MohammedOmar, the Taliban Supreme Leader. The letter informs Mulawi Kabir, the formerTaliban Governor of Jalalabad, AF, of the detainee's wishes to meet with Kabir andMulawi Ahmed Jan, a suspect Anti-Coalition leader with ties to Taliban. (AnalystNote: Interpreters at the Bagram Control Point noted that they could not confirm thatthe signature on the letter is really the signature of Mullah Omar. The interpreters

also noted that letterhead from Mullah Omar always contained a "control number."This particular letter did not contain any type of "control number."o The third letter is addressed to the Nangarhar Intelligence Department and "all

Taliban members" identiffing the detainee and urges all recipients of the letter tooffer as much help to him as possible.

o Detainee was administered a polygraph on 5 May 2003 and was found to be deceptivewhen questioned about his association with Mulawi Kabir and the Taliban and hisknowledge of who was using the IED cache captured during his arrest.o Following the arrest of the detainee approximately 80 tribal elders gathered tocondemn the detainee for his activities tied to the storing and production of IEDs.o During initial interrogations detainee denied having any knowledge of the IED cachecaptured during his arrest. In subsequent intenogations, the detainee finally admitted toknowing about the cache for at least two-to-three months before his capture.o Detainee has been cooperative during interrogations, but due to his deception whenquestioned about his knowledge about the IEDs found at the time of his arrest, hisveracity is questionable.

c. (S) Detainee's Conduct: This detainee has a past history of passive/aggressivebehavior. The detainee has assaulted the guard staff in the past on several occasions andexhibits extreme emotion.

6. (S/NF) Detainee Intelligence Value Assessment:

a. Assessment: JTF GTMO has determined that this detainee is of MEDIUMintelligence value.

o Detainee was the former Security Commander for Shinwar District in the NangaharProvince, AF, and was involved in drug interdiction and eradication operations. Detaineeis assessed to be able to provide information on the narcotics trade in the NangaharProvince to include information on drug production facilities, individuals involved in thenarcotics trade and poppy farming. Detainee was arrested following araid on an IEDproduction facility and should be able to answer questions about the manufacturing ofIEDs, detailed construction of the IEDs recovered, individuals involved in theconstruction of the IEDs, targets that the IEDs were to be used against, individualsinvolved in a plot to use the IEDs, and any AF-986 involvement in the production or useof the recovered IEDs.
