3:02 (a) Supervisory ~nel, Relief Prodoction Supervisor while repladng Produc.W1 Shift Supervisors, whidl includes contractors, whose employees are c:onsmed to be employees under this Agreement shall not perform m which would nonmally be a functiorl of an employee in the job classifications covered by this Agreement except when instnK:ting employees and In cases of emergency whk:h involve physical danger to employees or danger to property. The Company further agrees that the Relief Production Supervisor will not be allowed to administer disciplinary action as per Article 8:11.

3:02 (b) The Company will not contract out repair and maintenance m which is nonmally performed by the maintenance em~, for which the mill is equipped, fer which crews are available and which employees are capable of performing. The Company agrees to pay the defined Union dues for all contractors who perform work nonmally perfonmed by members of the bargaining unit as well as capital work projects on this site. Any contractors employing the following trades; millwrights, medlanics, electricians, carpentars and/or welders will be included in this payment of Union dues.

3:03 It is agreed that Company operations shall not be Interrupted as the result of any jurisdictional dispute that may arise between the Union and any other Unoo affiliated with the C.L.C. Questions of jurisdiction shall conform to the regulations covering such matters as fixed by the C.L.C. and the Company will not be asked to act Up:lll any matter of jurisdi:OOn between organizations of the C.L.C.

ARTICLE IV· RATES AND CLASSIFICATIONS

4:01 The Wage Sdledule is attadled hereto and fcrms a part of this Agreement.

4:02 If, during the life of this Agreement, a significant dlange in the job content OCOJrs in any job classification listed In the attached Wage Schedule, the rate thereto shall be iKijusted by negotiations between the parties. Up:lll failure to readl agreement the matter may be referred to Stage III of the Grievance Pnxedure.

4:03 For job dasslfk:ations not listed in the attadled Wage Sdledule, the Company shall set a temporary wage rate. Where the Company has JJior knowledge of the necessity fer establishing a new job classification, the Company will notify the Union, In writing, at least two (2) weeks in iKivance, and If the Union requests, the Company will discuss the a~icable rates and conditions prior to the commencerre1t of the new job. Where drrumstances require immediate and unforeseen establishment of a new job dassification, the Company will notify the Union, in writing, immediately.

Any such rates will be based on comparison with the prevailing rate for similar and/or related OCOJpations in the attadled Wage Schedule.

AR'nCLE V - UNION MEMBERSHIP

5:01 Any employee who is now a member in good standi~ or who bealmes or is reinstated as a member of the Union shall, as a Olnditioo of continued empkyyment, maintain such membership in gcxxl starrling throughout the term of this Agreement. The Union shall be the sole jOOge as to whetfler an employee is a member in good standing and shall notify the Company promptly of any change in the standing of any such employee.

5:02 (a) When hiring new employees, subject to the skill and ability of the applicants to perform the work requi~ of them, the Company wil give preference to Union members.

If Union members do not apply the. Company shaD have the light to empkly non-\Jnioo help.

The Con)pany agrees to advise the Union from time to time of its latxlur requirements.

5:02 {b) New employees shall make application to join the Union when first approadled to do so by a duly autroized Union ollidat. The Company shall upon hiring, advise an new employees to report to the f~~~andal Secretary within ten (10) days of commendng wok. Failure of an employee to comply with the oonditions herein shall be cause for immeclate tennlnation d ~t.

5:03 (a) The Company will deduct from all employees covered by the Latxlur Agreement from monies due them and remit to the Union, initiation fees and/or lveekty membership dues but not fines, .assessments or other levies.

5:03 {b) Deductions so made will be remitted to the Union lveekty, said remittance to be accompanied by itemized lists In alphabetical order, in duplicate, of names with Ouistlan names as payrolled. A ax,1f of the list will be given by the Company to the finandal Seoetary of the Union or his representative. ·

5:03 (c) Yearly Union dues deductions wiD be shown on the T-4 stir4

5:04 · Union representatives shall have the right to visit the operation In connection with Union business. Such representatives shall report to the Peoo1nel Supervisor or Operations Manager on arrival.

ARnCL£ VI· VACAnONS WITM PAY

6:01 (a) Vacatioo pay shall be pakJ to each employee by d1eQue to be issued at the lime of tffininatioo or when the vacatioo is taken. V~tioo pay shaH be paid to ead1 employee by separate d1eque.

6:1M (b} Vacatioo pay credits shaD be paid to ead1 employee on the ~lowing basis:

( 1} Fwr pertent ( 4%} of gross earnings for employees who have voted less than four ( 4} years in one period d employment with the Company.

(2} Six pertent (6%} of gross eamirqs for employees who have voted more than four (4) years, but less than ten (10} years in one period of employment with the Company.

(3) Eight percent (8%} of gross earnings for employees who have voted more than ten (10) years, but less than eighteen {lB) years In one period of empklymenl

(4) Ten percmt (10%) d gross earnings for employees who have voted more than eighteen {18} years but less than twenty-five (25) years in any one period d ernpklyment

(5} Twelve percmt (12%} rJ gross earnings for employees who have voted more than twenty-five (25) years.

(6) In the case of employees whose period of empklyme!lt dai!S back to June 1, 1963, their years of service shaD be cakulall!l as from June 1st, 1963. In the cased employees whose period rJ employment starll!l after June 1st, 1963, years d service shall be caladated from dati! of hiring. (7) Employees wiU be paid one nonnal weeks earnings at their regular rate d pay for ead1 week of vacafun i:r 2% rJ gross earnings in the previous calendar years, whrnever is greater. Employees must have voted at least 750 hoors during each calendar year. lime off due to CXllllpensable accidents shall be considered as lime worked.

6:03 An emplovee wiYl has been continually emp~ for one year shall take vacation time off at a time which is satisfactav to the emplovee and the Company. Each two pera!l1t (2%) of vacatm pay credit shall entille an emplovee toone (1) week of time off eadl year.

6:04 Vaartion sdledules will ~ rompleted by March 15th and vacations wiD ~ confirmed and ~ by April 15th of eadl year.

6:05 Vacation requests made after March 15th wiD ~ confirmed as soon as JXJ$ible but in r¥J case later than one rr¥Jnth after the request.

6:06 All employee$ will ~ insiiiJcted on August 15 to sdledule any ootstandlng vacations iit a time satisfaciDry to him and his Sllpervisor. Employees wiYl have not sdleduled their ootstanding vacation by September 15 wiD have it assigned by the Company.

6.07 NEW When economically feasible a plant vacation shutdown of one week wiD be scheduled eadl year at Christmas. The Company will advise the Union on Mardl14 of eadl year of the proposed vacation shutdown, where applicable.

ARTICLE VII· HOUDAYS WITH PAY

When any of the alxlve holidays fall on Saturday, it shall be observed on the preceding Friday, and if the holiday falls on Sunday, it wiD be observed 011 the following Monday.

Canada Day and RemembraOO! Day may ~ observed on Friday or Monday with mutual agreement betweel1 parties.

Remembraoce Day (Novem~ 11th) holiday will be observed during Olrislmas and New Year's pe!I!XI. The shutdown day will be mutually agreed r¥Jiater than Septem~ 1st eadl year. If agreement of the date is oot reached by Sep~ 1st, the holiday wiD ~ observed on Novem~ 11th.

7:02 (b) Hourly paid employees will receive eight (8) times their hourly rate.

7:02 (c) If an empoyee wro qualifies under ArtiCle xn is re:alled and I'IOits anytime during t!1e fourteen {14) calendar day period immediately following the tdiday(S)1 he shall receive tdiday pay let t11e preceding holiday(s}.

7:03 An employee wro is requested tn work on any of t11e tdidays in 5ectioo 7:01 shall oo paid for all time worXed at orie and one-ha~ times his regular rate up tD eight {8} hours WOii<ed1 and double time aftl!r eight (8) hours.

7:04 An emrtt;ee on regular vacation during a week in which a statutory tdiday falls, shall have t!1e option of having a day off with pay at a time mutually convenieflt tn the employee and his supervisor within the following 180 days or having the tdiday pay acXled tD his regular vacation pay. If t!1e employee ele::ts not tD defer his tdiday paymen~ he must advise Management not later than ten (10) days prior tD t!1e commencement of his vacation pemj.

ARTJCLE vm · ADJUSTMEIIIT OF GRIEVANCES

B:Ol It is the mutual desire of the parties hereto that complaints t:J an emp!oyee be adjUS1ed as quiddy as possible. It Is generally understtxxJ that an emp!oyee has no grievana! until he has given his shift supervisor an OAXJ!unlty to adjust his C()lllJilint PrU to redOOng a complaint to a grievance as per Article 8:03 the employee may request his S1lop Sleward to be ~t at any further dlscussion with his shift supervisor.

8:02 (a) The Company shall n!WJnize the Grievance Comlllittee which shaH alll9st of the Presiden~ two executNe offlcers and at the discretion of the Grievance CommittEe the Sleward involved.

It is understood that the Stewards and other Union officers shall not be abse1t from their regular duties in order to deal with a grievance wittoot obtlining ptr authorizatx:ln from their shift supervisor. This permission will not be unreasooably withhek:l.

8:02 (b) It is agrt'!e:lltlat there shall be no discriminaHoo exertised in any manner towards the Sll!wards or Union Grievance Committee members or otller Union members.

Any grievances submittm to the shift supervisor 1n aa:ordance wilh this procedure shall be in writing and wW be disp)Sed of by the shift supervisor in writing. 10:09 As per the attached Letter of U~~ing re Coveralls, the Company agrees to the addition of one (1) pair of coveralls making available five (5) pair of coveralls to all tradesmen.

10:10 The Company wiD ensure tt,Jat adequate temperatures are provided in lunch ~ washrooms.

10:11 The Company provides first aid arrangements as required by Provlndallaws.

10:12 Effective the first date of the oontract renewal the Company will oontribute by monthly cheque to the Financial. Slo'etary of the local union $0.03 per hour per employee for all oompensated hours for the pu~ of provi\fing paid education leave.

Said paid leave will be for the purpose of up-grading the employee's skill in all aspects of health and safety a~ trade union education.

Employees on paid education leave of absence will oontinue to acrue seniority a~ benetit5 during such leave.

ARTICLE XI • HOURS OF WORK

11:01 (a) The week for operatiions shall be six (6) days per week Monday to Saturday indusive. The work week for day or shift workers shall be forty (40) hours, eight (8) hours per day, Monday to Friday inclusive, or Tuesday to Saturday inclusive.

11:02 On other two-shift operations, the first shift shall consist of eight (B) cmsecutive hours, meal time excepted, and shall commence at 7:00a.m. or after. The seoond shift shall cmsist of eight (8) cmsecutive hours, meal time excepted, and shall commence prior ID 7:00 p.m. and shall cany a shift differential of the seoond shift.

12:01 The Company reo:Jgnizes the principle of seniority. Seniority will govern, subject to rea&Jnable consideration of skill, elfk:iency aoo ability, in ~ llansfers, layotfs, aoo recalls after layoffs.

As of September 1, 2000, tfle seniority ranking of empklvees is as set in !:dledule 'C' attached.

12:02 Employment of any new employees shall be COOiidered as rxdlationary until he has completed tflirty (30) days of work in one period of employment. U!XlO complelioo of tflis rxdlationary period he shall be dassed as a qualified employee witfl seniority ranking dating bad< to his date of hire. 12:03 In the case of layoff due to a shortage of work the Company will notifY the men inteOOed to be laid off at least two (2) work days in advance, unless the shortage of work is beyoOO the Company's cootrol. The Union Grievance Committee wiU receive a list rJ the men affected, prior to the interxled layoff.

An employee who quits of his own accord or is discharged aoo not renstated, or fails to re;xrt to work f'dlowing recall as provided in Section 12:04 shaH automatically lose all seniority. An employee who fails to return from leave-of-absence on the date specified. shall lose his seniority unless his return to work on lime Is ~ by drtUmstances beyoOO his cootrol. An employee hired on directly as a ltensed tradesperson will not be permitted ttl apply/bid outside his dassllication for a periOO of one year. In a lay off Sib.Jation, laid off tradespeople wlll exercise miD seniority.

QualifYing PeriOO • An insured employee shaH be eligible to receive an amount cl Long Term Disability Plan Benefit after Hftottwo weeks of benefit entitlement for the same disability under tihe Weekly lndemnity Plan. Benefit payment shall not a:mmence during a strike until tre termination of the slrike.

4. Definition of Disability • •Disability" shall mean an insured employee who has received filly-two (52) weeks of benefits for the same disability under the Weekly Indemnity Plan and is thereafter unable because of disease or injury to wm at any available oa:upation in tre Company for which he is reasonably fitted by education, l!aining or experience.

5. Amount of Benefit

Effective September 1, 2001, the Rat Benefit Pension Plan is increased from $32.00 per year of pensionable seMc:e to $38.00 per year of pWionable service for employees who are accruing service in the Rat Benefit Pension Plan after September 1, 2001.

It is understood that this increase of $6.00 per year of pensionable service will not apply to retirees covered under the Letter of Understanding Re: Special Downsizing Retirement Window. It wiD also not apply to employees who Wl11 receive a severanc:e payment under the Letter of Understanding Re: Severanc:e Pay.

To offset the cost of the pension formula increase for past service and for current service, the COmpany and the Union agree to reduce the Hourly Wage Rate increases granted under the term of this Agreement by 3.95%, during a period of three (3) years and six (6) months.

A temporary adjustment to the Hourly Wage Rate of all positions will subsequently be made to reflect this hourly wage increase reduction effective September 1, 2001. A special rate adjustment will be made effective Marth 2DD5, to increase individual rates to 99.5% of their original projected level, taking into account the permanent cost of D.SO% for current service cost Increase.

ARTICLE XVI · BEREAVEMENT PAY

16:01 Whm death occurs to an employee's spouse ()( children, the employee will be granted leave to attend the funeral and shall be paid fa eight (8) hours at his regular straight time rete f()( time lost up to a maximum of five (5) days in the eight (8) day period beginning with the day of death. When death occurs to an employee's father, mother, father-i!Haw, mother-in-law, son-in-law, daughter-in-law, bl'other-in-law, sister-in-law, bl'other, sister, grandparents, the employee wiH be granted leave to attend the funeral and shall be paid fa eight (8) hours at his regular straight time rate fa time lost up to a maximum of three (3) days in the eight (8) day period beginning with the day of death. The intent of this clause is to allow the employee to attend the funeral without loss of earnings. Pay will·be granted fa the regular scheduled I'IOit days lost during the period. Any claim f()( bereaveml!lt pay must be submitted by the employee in writing along with ~of bereaveml!lt in the empbyee's immediate family. If the employee does not attend the funeral, he shall receive one (1) days compaSSionate leave

1. The IJOQram w!U be based oo lhe Ontario Government's ApJrentialship and Tradesmen's Qualification Ad.

2. Applicants must have a minimum of grade 10 edoo;tion ll' ~uivalent as required for a certified jl'Ogram. They will be required to submit to a series of aptitude tests ID determine their suitability for lhe apprenticeship IJOQram. When mCJ'e lflan lhe required number of applicants pass lhe aptitude tests lhe senix employee(s) shall be awan:led lhe apprentialship.

3. The tests will be administered by lhe Director of Human Resources, Wood PrOOucts and the results wiU be kept in strtt confidence. When an employee is in~ lflat he has failed lhe aptitude tests he shcill be glverl, ~ request, lhe results of lhe testing indicating tests passed and failed. ·

4. Once a person has been successfully tested for a parttular lrade he does not have ID be tested again. If he ,is not selected u~ his first application he may apply again in lhe future. If he applies for a different lrade which requires additional tests he will have to take lhe additional test.

5. The formal trclining program will be comj)ete:l and the certificates of qualification, both Government and Company, wiU be issued.

7. Some of the regulated trades programs will require modification to erwe that apprentices learn tasks required in the Nairn operation

B. Apprentices must acquire a complete set of trade related tools before 4800 wor1< hours have been acrumulated.

9. There will be a sixty (60) day probationary periOO for aD employees entering the apprenticeship program. During this period, if the employee does not display the necessary aptitude for the particular trade he may be returned to his former jlb witlnJt klss of seniority. The apprentice must be sucr.essful at the in-school apprenticeship program in order to continue In the program. Two successive failures at school will constitute a dissolution of any contract between the Company and employee. Similarly the contrclct will be dismed If the Advisory Committee recommends the withholding of two successive pay increases.

10. The Company agrees to provide apprentices the difference between forty (40) hours at his regular rate and arly Government subsidies available while at the in-school program. All benefits will continue during the period the apprentice Is at school. The Company will ~ seventy-live dollars ($75.00) per week for room and board in addition to the Government compensation. The Company will further supply all books or materials oo klan to the awentice In order to complete the required course.

The Company is prepared to reimburse an employee for mileage In aa:crdance with our dMsional trclvel ~Icy that states mileage is calculated from an employee's home or the mill, whichever is closer.

11. The progress of each apprentice will be recordej and kept on file In the Personnel Department.

13. The program will be supervised by the Trades Training M-li:J:I:y Committee, whidl will consist of two members of Locai31·X, two members of Managernen~ and a Olairman. The Olairrnan's position wiU be filled by the Director of Human Resources, Wood Prcx!octs.

14. It is understocxl that the rate for the second, third or fourth period will not be paid until the apprentice completes the mandatory schooling at the end of each periOO. If the apprentices school results are sucressful, all hours WQI1(ed between the end of a perb:l, the time an apprentice goes to school, will be paid rates retroactive to the start of the period.

15. In a lay off situation, those still on the property due to seniority will continue in or be recalled to the Apprenticeship Program based on progress (acrumulated hours) to date.

ARTICLE XXI· AUTOMATION AND TECHNOLOGICAL CHANGE

The Company proposed this introduction of an Artide aimed at addressing automation and technological change: c

(A) The Company Is concerned about the Impact on employees and conditions of employment resulting from technological change, automation and change or elimination of a process.

(B) A Joint Committee on Automation and/or Technological Olange will be established consisting of six persons, three selected by Management and three selected by the Union. The function of the Joint Committee shall be advisory to Management and it will study the effects on employees, their employment status and their working conditions in the mill, of changes resulting from automation and/or technological change. The Joint Committee, among other things will consider early retirement, retraining, transfers to other jobs, as well as the availability of assistance from the various levels of Government as a means of assisting employees displaced by changes resulting from automation and/or technological change.

(C) Having concern for the impact of such changes which may result in job elimination, the Company undertakesto advise the Union as far in advance as is feasible (not less than ninety (90) days) of such changes which the Company has decided to introduce, which will,result in significant change in the employment status of employees. The Company will indicate, when notification of this technological change is made, which position(s) will be affected.

(D) At such time, the Company will supply the Joint Committee, for its use, such information as may be required.

(E) All persons who are employed with one ( 1) years continuous servic.e who are set back to a lower paid job dlie to job elimination under conditions set forth above, his rate shall be maintained for a period of six (6) months from date of set back. For an additional period of six (6) months, an adjusted rate will be established

midway between his previous rate at time of set back and the rate of his new job for each work week, which depends upon the operating schedule. At the end of one (1) year, the rate of the job to which he is assigned will apPI'f ..

A sign up sheet will be posted in the Security Office ead1 Mooday at noon. Em~ wishing to be considered for any weekend overtime must sign this list Employees may indiCate whether they wish to be consMJere:l only fur opplrt.unities in their department and/or plant·wide. They may also indiCate their desire to be sd:leduled fur 8 or 12 hour shifts.

The list will be taken down each Thursday at 7:00A.M.

Those employees shown on this list will have their accumulated overtime hours added beside their name. The overtime hours to be used for eadi emJt!yee wUI be those in the Company's payroll system as of noon on Thursday.

Based upon the relative accumulated overtime fur ead1 employee any weekend overtime work available will be assigned to those employees listed. This overtime wm be wen falling outside of a dassfficatm sdieduled fur a given week to be performed on the weekend. It is further understood that these overtime lists are for the sde pu!JX)Se of detennining availability of ~mployees for weekend overtime and for provkjing the equalization of such overtime.

Assignments will be based upon each employee's skill, elfidel1cy and atuty to perform the required assignments.

To be eligible, 1. the rmtm(s) will be p:lSted as re: artide 12:07 2. the employee must not be on ltleir regular shift 3. the overtime would have to have been offered first to people within the following groups, provided that they are also not on lf1eir regular shift:

1. tradespeople 2. apprentice tradespeople

Based on anticipated requirements; l!lis group will be limited to a maximum of live (5) people -distribution of overtime welding within this group wUI be based on equalization.

While the employee is performing welding, he/she will be paid at the 3rd vear aporentice rate.

The employee will receive the reasonable on site training necessary to ~orm these duties.

When an aoprentice trade500"S01! is performing welding, they will receive the higher welding rate for unscheduled overtime.

4. The rotation schedule within a partiCular Job Grouping will be Cell!rmined by the employees within that Job Grouping and as agreed with the respective supertisor. As a general principle such rotations shall oo:ur once per quarter shift

5. The Job GroupiiY,js wil !je as presented by the Company. The 'New' Log Preparation Ne.a requires four positiOns per shift. The Company is prepared to recognize the skills and transferability of the incumbents in the furmer Debarker and Ublity Operator dassilications in order that they may assume two of the newly created positions per shift. It has been determined lllat the CDmpany will need a llltal complement of approximately 170 employees (including those for vacatkln replacement, leaves of absence ard scheduled Ill the Labour Pool} on the start up of the exterdro prodoction schedule.

LETTER OF UNDERSTANDING RE:

SPECIAL DOWNSIZING RETIREMENT WINDOW

In order to minimize the effects of downsizing and to ftmlt the number of employees whose JXlSI1;ion wiD be eliminated, a special temporary window of retirement wiD be opened from the date of ratification until August 31•, 2001 during whid1 employees

a) who were actively employed as of October If', 2000 or who have notified the the Company of their return to work prior to May 3, 2001; and

b) who are then age 58; and c) have then reached 20 years of continuous service; and d) who elect to retire on or befure September, 2001

will be eligible for a speciallifetil!ll! monthly supplement pension of $8 per year of · pensionable service in addition to an unreduced basic pension as per the pension plan. Such supplement wiU be govemed by the same rules as for the basic pension except that the pension wiU not be reduced for early retirement

This spedal supplement is introduced for the sole purpose of compensating for the shorter period of pensionable service ~nized by the contributory portion of the pension IJI'O!jl'ilm and in consideration for the downsizing.

Employees retiring under this speCial window will also be eligible for the temporary monthly bridging benefit of $15 per year of pensionable service to a maximum of thirty (30) years. The bridging supplement will apply from date of retirement until age 65.

Such retiring employees may however opt Qllt of the special supplement In order to benefit from a retiring allowance equivalent to the severance payment for eligible laid off employees, as defined in the Letter of Understanding on Severance. In this case, the retiree wiU still be eligible for an unreduced pension and the $15 monthly bridging benefit from date of retirement until age 65.

Those employees on l.T.D. and W.S.I.B. are not eligible for the Early Retirement Window.

BASIC MONTHLY EARNINGS

Your regular monthly earnings on which your benefit wiU be based will exdude OYertime pay, bonuses and otller special compensatiori as at the date you become disabled.

BENEFIT

If you become tnt!lly disabled before you are 65 and yoor disaljlity lasts klnger !han 52 weeks of benefits under the employer's We!i1; Indemnity Plan, you wiB be paid a roonlhly Income whldl is payable at the end of each month of disability as long as you are disabled but not beyond age 65 and in no event for more !han the number of completed months equal to the employee's service. The amount of income for which you are eligible will be redoced as lbllows:
