The function was inaugu- rated amid lockdown due to covid- 19 strict restrictions and guidelines, maintaining social distance, with the lighting of traditional lamp before the photo images of the Martyrs S/Shri Sushil Kumar Bhat, Ravinder Kabu and Ashok Raina who were selectively killed by the Islamic terrorists while they were going to Gool to join their duties in 1997. The two other martyrs who were brutally killed near Sarthal- Kishtwar and Doda in- cluded S/Shri Kanya Lal Duda and Shiban Lal Garib. Floral Tributes were offered to the martyrs on the occa- sion while, besides a large number of community members, the families of the martyrs also attended the function. Rich tributes were also paid to Ajay Pandita Bharti who was martyred das- tardly in Anantnag district recently in Anantnag dis- trict by the Islamic terror- ists. Ashwani Kumar Chrun- goo in his address said that the crusade against Hindu- Sikh communities in Jammu and Kashmir con- tinues for the last three decades. The killing of Ajay Pandta shows that the process of ethnic cleansing and genocide unleashed three decades ago still exist there and there is no let up or much difference on the ground for the minorities in the valley. Virender Raina termed the killings of Gool and the martyrdom of Ajay Pandita as murder of knowledge and democracy to drag Kashmir to dark age and es- tablish an Islamic state. The acts of these enemies of hu- manity and civilization who commit such crimes against humanity show that the perpetrators of terrorism neither like education nor democracy nor peace in the society. Making scathing attack on the administration, Ka- mal Bagati termed it a com- plete intelligence failure and a security lapse and urged upon the govt to pro- vide foolproof security to the minority political ac- tivists on individual basis and to the PM package em- ployees on collective basis as they are always soft tar- gets. The online system is launched by Hon’ble Mayor, Sh. Chan- der Mohan Gupta & Hon’ble Deputy Mayor, Smt. Purnima Sharma in the presence of Ms. Avny Lavasa, Commissioner, Jammu Municipal Corpo- ration. In view of the COVID-19 pandemic situa- tion this system is intro- duced to avoid enormous gathering of general public and to promote contactless efficient public service de- livery system. This initiative is being taken to promote Digital India and E—Gover- nance initiative of Govt. of India. This is 1st such type of Government public ser- vice delivery initiative in the UT of Jammu and Kashmir. Only very few States/UT's are providing such type of Government services at doorstep. It will provide great relief to the general public and also eliminate the requirement to reach JMC office for such services. This is in-house technology developed by the Informa- tion Technology depart- ment of Jammu Municipal Corporation. The requisite Fee is Rs 40 per birth/death certificate and Postal and Conveyance Charges Extra as per the be- low mentioned rates : Within JMC Limits - Rs 50, Outside JMC Limits but within district - Rs 100, Outside District/Division but within JK UT- Rs 150, Outside JK UT - Rs. 200. For building permission cases the fee is as per the ap- proved plan and the Postal and Conveyance Charges are Rs 150 within JK UT and Rs 250 outside JK UT. In this system, SMS, E- mail & online payment gateway integration has been done and all the pay- ments shall be received on- line through secure mecha- nism directly into the JMC bank account. The online receipt and the payment successful acknowledge- ment shall be provided to the applicant online. For Doorstep Birth/Death Certificate and Building permission, public has to visit www.jmc- jammu.org then has to use Menu Option “E-Gover- nance > Doorstep Gover- nance > Apply online for birth/death certificate” and “E-Governance > On- line Building Permission > Register for building per- mission” respectively. In case of Birth/Death, applicant shall be commu- nicated through e-mail : [email protected] for available record verifica- tion. Self attested docu- ments shall be asked from the applicant in case of al- teration/corrections are re- quired in the available record. Then documents verification and alter- ation/modifications of the available record done by JMC and an online pay- ment fee link sent to the reg- istered e-mail & mobile number of the applicant. On successful online fee pay- ment, confirmation sent by JMC to the applicant and fi- nally Birth/Death Certifi- cate shall be dispatched through speed post to the applicant's registered ad- dress. In case of building per- mission cases after the ap- proval of building permis- sion cases by BOCA, an online payment fee link shall be sent to the regis- tered email & mobile num- ber of the applicant. On suc- cessful online fee payment, confirmation sent by JMC to the applicant and finally building permission shall be dispatched through speed post to the applicant's regis- tered address. JMC starts home delivery of birth, death certificates, building permission HIMALAYAN MAIL NEWS KATHUA, JUNE 15 To help them to overcome financial hardships during Covid-19 pandemic, the Labour department has dis- bursed Rs 1,00,52,000( Rs one Crore fifty two thou- sand) among the district Kathua workers registered with the Jammu & Kashmir Building & Other Construc- tion Workers Welfare Board (JKBOCWWB). As per the Department, the amount was paid to the workers in three install- ments @Rs 1000/- each in the month of March, April and May-2020. The relief was transferred to the account of workers through DBT mode, to help them survive the financial hardships in absence of work due to Covid -19 Lock- down. The department also reached out to Inter State Migrant Labourers stuck up in the district due to the lockdown. The Labour Department Kathua took immediate measures to mitigate the suffering of these migrant workers, which were pre- sent in the district in large numbers to meet the labour needs of industrial units as well as other skilled trades. Initiatives such as provid- ing food and shelter to the stranded migrant labour- ers, establishing of Helpline Numbers to receive their calls were taken so that their grievances are redressed on time. Labourers ap- proached the department seeking ration and with the desire to return to their hometown. Accordingly the grievances regarding ra- tion were redressed by pro- viding them food grain in coordination with the Dis- trict Administration. A detailed survey was conducted by the Labour Department to enumerate the Inter State Migrant Labourers stranded in var- ious parts of the district. In the process, 12051 in- ter-state migrant workers (including brick kiln and in- dustrial workers) were regis- tered. Their consent was ob- tained about whether they wish to stay here or want to return to their native places. The Labour Department also distributed 5000 Masks among the migrant workers in District Kathua. On the directions of Supreme court, District Employment and Counsel- ing Centre, Kathua coun- seled 1250 interstate mi- grant labourers/workers in district Kathua about the preventive measures and SOPs for protection against the Covid infection. The de- partment also counseled the labours which have come from other districts like Jammu and Samba on foot to go to their home state and stuck at Lakhan- pur. Facilitating the migrant workers willing to go back to their home states, a helpdesk was established in the district office of Labour Department, to carry out their registrations. The data collected was digitized in the prescribed format and area wise list of the workers was also compiled. After receiving directions from the Labour Commis- sioner’s office for move- ment of interstate migrant workers from district Kathua to railway station Katra as per the train sched- ule, the interstate migrant workers were screened by the medical team before their departure to railway station Katra. On the day of departure, boarding points were se- lected as per the conve- nience of the interstate mi- grant workers/labourers. Refreshment and water was also provided to them be- fore departure. Buses were deployed by JKSRTC. Thereafter, the inter-state migrant labourers were dis- patched from their respec- tive boarding points to rail- way station Katra. During the whole process, norms of social distancing were strictly followed and no fare was charged from any inter- state migrant labourer. As per latest data received from Labour Department Kathua, a total of 2889 mi- grant workers, including 2188 hailing from Chhatis- garh, 341 from Bihar, 249 from Madhya Pardesh, 86 from Uttar Pardesh, 05 from Orrisa, 17 from Jhark- hand, 01 from Uttrakhand and 12 from Rajasthan were ferried to Katra Railway Station for onward journey to their native states through trains. Labour Department disburses Rs 1.052 cr Covid-19 relief among registered workers KATRA, JUNE 15 : Mr. Ramesh Kumar, Chief Executive Officer, Shri Mata Vaishno Devi Shrine Board took a holistic review of the functioning of the Shri Mata Vaishno Devi College of Nursing (SMVDCoN) and Shri Mata Vaishno Devi Gurukul at a meeting held at Katra today. Among those who participated in the meeting included Mr. Hem Kant Prasher, Chief Accounts Officer of the Shrine Board; Dr. Sunil Sharma, Dy. CEO of the Shrine Board and Adminis- trator of SMVDCoN and SMVD Gu- rukul; Dr. Shailla Cannie, Principal of the SMVD College of Nursing and Dr. Dhananjay Mishra, Principal of the SMVD Gurukul. He asked the Principal of the Gurukul that, besides the online mode, if need be, the study material should be despatched to the students at their residences also. Underscoring the need for optimally enhancing the prospects of suitable placements of the passing-out stu- dents of the Nursing College, Mr. Ramesh Kumar asked the Principal to tie-up with various leading healthcare institutions in the country for arrang- ing placements for the students of the college as the first batch of the B. SMVDSB CEO reviews functioning SMVD College of Nursing, Gurukul HIMALAYAN MAIL NEWS JAMMU, JUNE 15 Despite a lot of disruptions, distrac- tions and innumerable challenges posed by the spread of COVID-19 pan- demic and consequent lockdowns, J&K Board of School Education has successfully concluded the evaluation process of Secondary School Exami- nation (Class 10th), Session Annual, Regular, 2020, Summer Zone of Jammu Division with the declaration of its result today. Spread over 541 Ex- amination centres, 53807 candidates appeared in the said examination, out of which 29487 were boys and 24320 were girls. Girls have again outnum- bered boys by scoring a pass percent- age of 72.00 whereas boys stand at 68.%. 3,465 students got A1 grade, 4,999 got A2 grade, 6,033 students got B1 grade, 7,549 got B2 grade, 8,469 got C1, 6,229 stood at C2 grade whereas 723 got D grade. J&KBOSE declares 10th class result JAMMU, JUNE 15 ( JNF): In a significant judgment, Justice Vinod Chatterji Koul today dis- missed petition filed by Nayeem Akhtar Andrabi Ex-Minister of PDP chal- lenging the order of trial Court in defmation case filed by Ex-Chief Minister Omar Abdullah. A complaint under Sec- tion 499 and 500 of the Ranbir Penal Code, 1932 AD, of erstwhile State of J&K (which is pari materia to Section 499 and 500 of the Indian Penal Code) was filed by Public Prosecutor, Srinagar - respondent no.1 herein, against petitioner, before the court of Principal District and Sessions Judge, Srinagar (for short "Trial Court") on the grounds de- tailed therein. The Trial Court, while taking into account the alle- gations made in the com- plaint and the record con- comitant therewith, took cognizance of the complaint and issued process vide or- der dated 29th September 2010, and bailable warrant in the amount of Rs.20,000/- each was is- sued for securing presence of the accused. Nayeem Akhter Andrabi, feeling aggrieved of afore- said complaint and the pro- ceedings initiated thereon by the Trial Court, seeks quashment thereof on the edifice of case set up and grounds taken in petition on hand. Justice Vinod Chatterji Koul after hearing both the sides in length observed that inherent powers can- not naturally be invoked with respect to any matter covered by specific provi- sions of the Code of Crimi- nal Procedure. It is only where the High Court is sat- isfied either that an order passed under the Code would be rendered ineffec- tive or that the process of any court would be abused or that ends ofjustice would not be secured, that the High Court can and must exercise its inherent powers under Section 482 of the Code. This power can be in- voked only in an event when aggrieved party is being un- necessarily harassed. The power under Section 482 Cr.P.C., is not intended to scuttle justice at threshold but to secure justice. High Court further said that needless to say, that when exercising jurisdic- tion under Section 482 of the Code, the High Court would not ordinarily em- bark upon an enquiry whether the evidence in question is reliable or not or whether on reasonable ap- preciation thereof, accusa- tion would not be sustained. That is the function of the trial Judge. The scope of ex- ercise of power under Sec- tion 482 Cr.P.C. and the cat- egories of cases, where the High Court may exercise its power under it relating to cognizable offences to pre- vent abuse of process of any court or otherwise to secure ends of justice were set out in detail in the case of Bha- jan Lal (supra). The powers possessed by the High Court under Section 482 Cr.P.C. are very wide and at the same time the power re- quires great caution in its exercise. The Court must be careful to see that its deci- sion in exercise of this power is based on sound principles. The inherent power should not be exer- cised to stifle a legitimate prosecution. With these observations High Court dismissed the petition with directions that parties to appear before Trial Court on July 20, 2020. Thec ase that a complaint has been moved by Omar Abdullah before the Trial Court under Section 499, 500 RPC/IPC. While giving introduction of Mr Omar Abdullah, the then Chief Minister of erstwhile State of Jammu and Kashmir, it is stated in the complaint that on 25th August 2010, a Press Conference was held by petitioner and respon- dent no.2, at the office of J&K Peoples Democratic Party, No.2, Circuit House, Emporium Lane, Residency Road, Srinagar, which was attended by several other members of the Party, in- cluding legislators of the State Legislature as well as members of public and me- dia persons.
