A. Call the Meeting to Order - Stephanie Haan-Amato. The J. Paul Taylor Academy Governance Council met in open session on August 21, 2019. The meeting was called to order at 6:36 PM to conduct a Regular Meeting

1. Roll Call - Roll was called by Jerry Wallace: Governance Council members Stephanie Haan-Amato, Jerry Wallace, Robyn Rehbein, Tomasa Shanbhag, and Barbara Chamberlin were present. A quorum was confirmed. Christy Takacs, Executive Director, Sharon Myers, Assistant Executive Director, and Vicki Chavez, Finance Manger were present. Members of the public present included Rebecca Berkson and Erna Bennett (Finance Committee Member). Sherry Booth entered at 6:49 PM.

B. Conflict of Interest - Chair, Stephanie Haan-Amato, called for any conflict of interest. No conflict of interest was stated by those in attendance.

C. Reading of Mission Statement - Robyn Rehbein - read the Mission Statement: J. Paul Taylor Academy, in alliance with families at the school and community, will offer a rigorous, well-rounded Spanish acquisition, project based instructional program in a smaller school to promote excellence for the diverse students of the Las Cruces area.

D. Approval of Agenda - Robyn Rehbein moved to approve the agenda for the August 21, 2019, Regular Meeting Agenda. Jerry Wallace seconded the motion. The August 21, 2019 Regular Meeting Agenda was approved unanimously with affirmative votes from Stephanie Haan-Amato, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

E. Approval of July 17, 2019 Regular Meeting Minutes - Robyn Rehbein moved to approve the July 17, 2019 Regular Meeting Minutes. Tomasa Shanbhag seconded the motion. The July 17, 2019 Regular Meeting Minutes were approved unanimously with affirmative votes from Stephanie Haan-Amato, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

II. Public Input

A. Status of New Development Committee - Rebecca Berkson 1. Public Input - Chair, Stephanie Haan-Amato, called for any public input. There was

public input from Rebecca Berkson. Mrs. Berkson discussed the status of the dissolvement of the JPTA Foundation and the update on the GC Development Committee which met on August 12, 2019. Mrs. Berkson discussed that the Foundation decided to dissolve due to the administrative costs to running a non-profit. Mrs. Berkson discussed preparation of the upcoming audit and that the Foundation would supply a check to JPTA to be used for unrestricted funds as determined by the Development Committee. The Foundation will close their checking account by August 31, 2019. Mrs. Berkson discussed a need for a structure for teachers to request funds through ED and then Development Committee. Robyn Rehbein expressed gratitude for all the work that the current and previous JPTA Foundation members have contributed to JPTA. There was no other public input

III. Finance

A. Approve June Finance Committee Report - Stephanie Haan-Amato informed the board that the Finance Committee had met on August 21, 2019. Erna Bennett had created the finance report which noted that everything was in good order, bank statements tied in with everything, and nothing unusual was reported. The Finance Committee reviewed several checks and discussed budget requests. Finance Committee also reviewed disposal of property. A motion to approve the June Finance Committee Report was made by Jerry Wallace. Robyn Rehbein seconded the motion. The motion to approve the June Finance Committee Report was approved unanimously with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

B. BAR 535-000-1920-0002-IB - Vickie Chavez discussed BAR 535-000-1920-0002-IB (instructional materials) with the board. A motion to approve BAR 535-000-1920-0002-IB was made by Jerry Wallace. Robyn Rehbein seconded the motion. BAR 535-000-1920-0002-IB was approved unanimously with affirmative votes via roll call from Stephanie Haan-Amato, Robyn Rehbein, Sherry Booth, Tomasa Shanbhag, and Jerry Wallace

C. Approve MOU Agreement for SWEC - Stephanie Haan-Amato updated the board about the MOU for services with SWEC for business management. A motion to approve the Business agreement for SWEC for the current fiscal year was made by Robyn Rehbein. Tomasa Shanbhag seconded the motion. The motion to approve the MOU Agreement for SWEC was passed unanimously, with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

D. Update on Change to Authorized Check Signatures and Electronic Signatures - Vicki Chavez discussed the process for how checks signatures work. Explained the process of all check invoices and verification process. Recommended that JPTA move to electronic signatures for safety reasons. Mrs. Chavez reported that the Finance Committee analyzed the policy and confirmed that it was in line with the required policies. Check audits will still occur every finance committee.

E. Disposal of Property – Sharon Myers discussed a list of unusable property to be disposed of and requested the GC board approve the property under $5,000. A motion to approve the process of the disposal of the property (under $5,000) was made by Robyn Rehbein and was seconded by??? The board unanimously approved the disposal of property under $5,000 with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

IV. Membership Committee

A. Status of PED Extension for Position 5 - Stephanie Haan-Amato -

DiscussionEmail 7/19/19:

Your request for extension to fill the vacancy created by Martin Lopez, Jr. has been granted, and the board will have until September 10, 2019 to either fill that position of close it. I will await the documentation on the recent designation and closure of other vacant board seat.

B. Call for Nominations for New Governance Council Treasurer (Position 5) Follow by a vote. – Chair Stephanie Haan-Amato called for nominations. Robyn Rehbein nominated Erna Bennett for Governance Council Treasurer (Position 5). Erna Bennett preferred to not accept the nomination because she will be gone for extended period of time out of the country due to prior obligations. Stephanie Haan-Amato asked for a motion to indefinitely postpone nominations for Position 5. A motion to indefinitely postpone nominations for Position 5 was made by Robyn Rehbein. Jerry Wallace seconded the motion. The motion to postpone Position 5 was passed unanimously, with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace. C. Close Governance Council Position 5 - A motion to approve the closure of the Governance Council Position 5 was made by Jerry Wallace. Robyn Rehbein seconded the motion. The motion to close Governance Council Position 5 was passed unanimously with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

D. Status of Designation of Position 2 (Barbara Chamberlin) PED Notification – Chari Stephanie Haan-Amato informed the board of the Designation of Position 2 (Barbara Chamberlin) PED Notification is complete.

E. Status of closure of Position 8. – Chair Stephanie Haan-Amato discussed the closure of Position 8 and informed that the PED approved the closure.

F. Membership Meeting Minutes - Robyn Rehbein discussed the minutes from the Membership Meeting. Robyn and Jerry Wallace met and helped Barbara Chamberlin through the on-boarding process. Membership Committee also discussed the open meetings act, charter documents, and signed disclosure of conflict of interest forms.

V. Governance

A. Sign Updated Statement of Governing Body to Consult with PED – Chair Stephanie Haan-Amato talked about the board needing to move past this since the need was no longer there to sign an updated statement.

B. Committee Chairs and Representatives – Chair Stephanie Haan-Amato wanted to include updated committee list to the board. Informed that the Finance Committee and Audit Committee no longer had chairs. Talked about potential members for the committees but was still actively searching for parents to be on the committees.

C. New Mexico Activities Association Application – Chair Stephanie Haan-Amato discussed the New Mexico Activities Association Application with the Governance Council. Application is not currently present. A motion to postpone a vote to approve NMAA Application indefinitely was made by Jerry Wallace. Sherry Booth seconded the motion. The board unanimously approved the postponement of a vote to approve the NMAA Application indefinitely with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

VI. Executive Director Support and Evaluation

A. Executive Director Report. - Chris Takacs went over the Executive Director Report. Attrition Report was provided to the GC members for students enrolled end of last year till present date. Updated on what was done at early release. Submitted the next quote for shade structure over the playground and is awaiting approval from the State. Looking for outdoor classroom shaded area in pickup area as the next process. A new grant CTE for science that is STEM related. Informed that Open House occurred and explained the activities at the event. Spanish Language Acquisition progress is being made. An order was placed for updating teacher laptops. A quote to have promethium boards in all classrooms was being reviewed as well.

VII. Policy Committee

A. Training and Experience Policy, Employee Policy Manual pp. 31-32 - Christy Takacs went over the Training and Experience Policy. Ms. Takacs discussed changes that were made for time frame for experience qualifications which did have to go through Collective Bargaining Team and they verbally approved the change. Ms. Takacs will be putting an MOU in place, because they are not amending CBA right now and the change will be made in the spring.

B. Administering Medications to Students Policy – Chair Stephanie Haan-Amato discussed with the GC members review of the policy for administering medications to students. Updated the policy with new PED Code through two bills involving medical Page 6 of 61 9/7/2019 7:01:41 PM

cannabis and revised to update language to make everything current. Barbara Chamberlin questioned Section B for not having more precise policy for a staff member taking away medications from a student and recommended and addition to include language to make policy clearer after confiscation.

VIII. Committee Check-Ins and Updates

A. Facilities and Safety Committee - Robyn Rehbein stated that the Facilities and Safety Committee met on August 13, 2019 and discussed the capital outlay playground project.

B. Development Committee – Chair Stephanie Haan-Amato informed that the Development committee had been discussed earlier in the meeting.

C. Parent Advisory Committee – Chair Stephanie Haan-Amato stated that the Parent Advisory Committee had met last Wednesday, August 14, 2019 and had a great meeting. A book fair will be in the Library from September 6, 2019, through September 12, 2019. Also was excited to do the Fall Carnival. Informed that the next meeting would occur on September 11, 2019.

D. Gifted Advisory Committee - Barbara Chamberlin informed that the Gifted Advisory Committee had not met.

E. Academic Oversight Committee - Jerry Wallace and Barbara Chamberlin informed that the Academic Oversight Committee had not met.

IX. Other Business - Stephanie Haan-Amato

A. Open Discussion - There were no items for open discussion from those in attendance.

X. Closed Session

Roll Call Vote to move into closed session for the following reason: to discuss Limited Personnel Issues, closed Pursuant to Section 10-14.1.H(2), NMSA 1978

A motion to indefinitely postpone the Closed Session item was made by Robyn Rehbein. Stephanie Haan-Amato seconded the motion. The motion to indefinitely suspend the Closed Session item passed with affirmative votes from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace.

A. Adjourn - Robyn Rehbein moved to adjourn the August 21, 2019 Regular Meeting. Jerry Wallace seconded the motion. The motion to adjourn the August 21, 2019 Regular Meeting was passed unanimously with affirmative votes by roll call from Stephanie Haan-Amato, Sherry Booth, Robyn Rehbein, Tomasa Shanbhag, and Jerry Wallace. The August 21, 2019 Regular Meeting was adjourned at 8:38 pm.

In attendance: Christy Takacs, Sherry Booth, and Stephanie Haan-Amato

Updates 1. The committee discussed the policy webpage layout and how it is linked to the JPTA

homepage.2. Stephanie reported that the Administering Medications to Students Policy was introduced

at the August 21, 2019 GC meeting. A suggestion to improve the clarity of a section was made by Barbara Chamberlin, and it was incorporated. The policy was then posted on the Policy webpage for public review.

3. Stephanie also reported that the Training and Experience portion of the Employee Policy Manual was presented at the August 21, 2019 GC meeting. No changes were suggested, and it was posted to the Policy webpage for public review. The CBA Team created an MOU to reflect the proposed change regarding the amount of experience required to receive a step increase on the salary schedule. The MOU will bring the CBA into alignment with the proposed change. The MOU will be signed by the CBA Team if the GC approves the policy change at the September 11 GC meeting.

Proposed Policy Review CalendarThe committee discussed the proposed draft of the policy review calendar for the year. The committee felt that it was appropriate to plan to edit seven policies, which we feel will leave time to add more policies as needed because of anticipated regulation changes this year.

Anti-discrimination and Harassment Policy, Stephanie Haan-AmatoStephanie discussed proposed updates to the policy. She said that the changes were mainly just cleaning up the language and making it more consistent. The committee suggested introducing the policy to the GC at the September 11 meeting.

Bullying Policy, Christy Takacs and Stephanie Haan-AmatoThe committee reviewed a memo that Ms. Takacs received from Dean Hopper of NMPED that provided guidelines for required policy updates resulting from the new Safe Schools for All Students Act. The committee felt that many of the required updates are already included in JPTA’s Bullying Policy. Stephanie agreed to review the required updates and ensure that they are all incorporated into our Bullying Policy. The committee would like to introduce proposed policy changes to the GC at the October 16 meeting.

Next Steps1. The committee agreed to begin edits to the policies that will be introduced at the October

GC meeting and send drafts to committee members by October 1.2. The committee will set a next meeting date after having a chance to take a more in depth

look at the policies being revised.

POLICY: ADMINISTERING MEDICATIONS TO STUDENTS

I. PURPOSE

To set forth the policy for administering medicications to J. Paul Taylor Academy students.

I. GENERAL PRACTICES

A. The guardian and student will be informed that: 1. Whenever possible, to increase student safety, it is recommended that

medication be administered to students at home.

2. When taking medication at school, it will be the student’s responsibility to report to the school health personnel for his/her medication at the time that it is to be administered.

3. Unused medication will be properly destroyed at the end of the school year unless picked up by the guardian.

4. Medication will not be sent home with students.

5. Guardians are encouraged to request from their pharmacy an additional, appropriately labeled medication container (one for home, one for school).

B. School employees or agents may confiscate a student’s medication if the student’s

self-administration of the medication exceeds the student’s prescribed dosage, if the student endangers others with his/her medication or there is no physician or guardian order filed at the school allowing the student to self-administer medication. Confiscated medication shall be deposited with school health personnel, the school nurse, or the Executive Director for safekeeping

C. Prescription and Over-the Counter (OTC) Medications: Kindergarten – 5th grade

1. A guardian may visit the school to dispense the medication to the student. Otherwise, all medication shall be deposited with school health personnel, the school nurse, or the Executive Director for safekeeping.

a. A permission form completed by the guardian is required and is valid only for the current school year.

b. A dated written order from the student’s health care practitioner is required. The order must include the name of the student, name of medication, dosage, route of administration and time of administration. The health care provider’s order shall be valid only for the current school year. i. Prescription medication (including samples from physicians) shall be

labeled by the physician or by a licensed pharmacist to include the student's name, name of prescribing physician, name of medication, dosage and time of administration.

ii. Non-prescription medications and over-the-counter medications must be in their original containers and must be accompanied by written guardian permission and a written order from a licensed health care provider. The original packaging of medication should be labeled with the student’s name.

iii. Any changes in time or dosage must be accompanied by written documentation from the health care provider.

iv. Students may carry inhalers with them provided both the guardian and the health care provider have supplied appropriate documentation of the student’s competence to administer the medication. Forms for this documentation

c. An adult must deliver the medication to the school and pick up any

medication that needs to go home with the student.

D. Prescription and Over-the-Counter (OTC) Medications: 6th – 8th grade

Secondary students may carry and administer their own medications under most circumstances, except as outlined in Sections E.3 and K.5 of this policy. Any student requiring supervision must deposit their medication and adhere to the same procedures outlined in section C above.

1. Prescription medication, including samples from Healthcare Practitioners (HCP), must be in their original containers and labeled by the HCP or by a licensed pharmacist to include the student’s name, name of the prescribing HCP, name of medication, dosage and time of administration. To ensure students are not bringing excessive quantities of medication to school that could potentially fall into the hands of others, students are to carry only the dosage necessary to take during school hours for one day at a time. Pharmacists may be asked to label a bottle for school and a bottle for home.

2. Non-prescription over-the-counter medications must be in their original containers. 1. With collaboration among the guardian, school nurse, and healthcare provider, students requiring narcotic-containing medications during schools hours must meet the following criteria: a. Written release from the healthcare provider that the student is able to attend

school while taking the medication.

b. Written medication order from a recognized healthcare provider with student’s name, name of medication, dosage and time of administration.

2. Examples of narcotics include, but are not limited to, Codeine, Oxycodone (Percocet) and Hydrocodone (Vicodin).

3. No student shall keep narcotic-containing medications on his or her person, possession or control at school, and all medications must be kept in a central location within a locked closet or cabinet. Keeping medications at the school is an accommodation to the student, and J Paul Taylor Academy is not responsible for any claims or damage resulting from loss or theft of the medication. Medications shall be kept in an area inaccessible to students.

F. In the event the school nurse or school health personnel are not available to

administer a medication to a student who is too young or incapable of reliable self-administration, the school nurse, in collaboration with the guardian and school administration, shall arrange for an alternative means of administering any required medication that must be taken during school hours.

G. A medication administration record shall be available in the front office. The name of the student, name of the medication, prescription number, time of administration and dosage of medication shall be documented and filed as a permanent record.

H. When a student comes to take his/her medication, the following Six Rights of Medication Administration shall be followed by the school nurse or school health personnel:

1. Correct student; 2. Correct medication; 3. Correct dosage; 4. Correct time; 5. Correct route; 6. Correct documentation.

I. Students With Diabetes

A student who has a medical diagnosis of diabetes and complies with the New Mexico Administrative Code (NMAC 6.12.8.8) to self-assess and carry and self-administer prescribed medication(s) under specified conditions, shall be permitted to do so if, in doing so, he/she does not endanger his/her own person or other persons through misuse of the medication.

A student who has a medical diagnosis of asthma or anaphylaxis associated medical condition and complies with the New Mexico Administrative Code (NMAC 6.12.2.9) to self-assess and carry and self-administer prescribed medication(s) under specified conditions, shall be permitted to do so if, in doing so, he or she does not endanger his or her own person or other persons through misuse of the medication.

K. New Mexico Medical Cannabis Program 1. Qualified students participating in the New Mexico Medical Cannabis Program

(NMMC) and their guardians must comply with this policy. A qualified student means a student who demonstrates evidence to the school that the student is authorized as a qualified patient pursuant to the Lynn and Erin Compassionate Use Act (§ 26-2B-1 et. seq. NMSA 1978) to carry and use medical cannabis.

2. Required evidence consists of a written and signed certification provided by a certifying practitioner, certifying that the qualified student has a debilitating medical condition pursuant to the Lynn and Erin Compassionate Use Act. This written certification also attests that the certifying practitioner believes the potential health benefits of the medical cannabis would likely outweigh the health risks for the qualified student and that the student is able to function safely at school, while under the influence of medical cannabis.

3. In addition, the guardian must provide the following documents to the school in advance: • A copy of the qualified student’s written certification. • A copy of the patient’s New Mexico Department of Health’s (NMDOH) issued

ID card, which includes the name of the guardian. • A written treatment plan that includes:

o Affirmation of qualifying debilitating medical condition; o Recommended dosage allotment; o Recommended frequency of administration; and, o Signature of the guardian and the certifying practitioner.

• A signed Health Insurance Portability and Accountability Act (HIPAA) authorization that permits the school to obtain current information from the NMDOH regarding the enrollment status of the qualified student in the NMDOH’s Medical Cannabis Program. The HIPAA authorization form shall be retained as a medical record.

• A written release of liability that: o Releases the school, school personnel and volunteers, the Governance

Council, and Governance Council members from civil liability for acting in accordance with the provisions of the Lynn and Erin Compassionate Use Act and the NMPED rule for Medical Cannabis in Schools;

o Releases the school, school personnel and volunteers, the Governance Council, and Governance Council members from any liability and reimbursement claims for costs associated with accidental spillage or waste of medical cannabis; and

o Includes an acknowledgement that the qualified student shall not be entitled to use medical cannabis outside the state of New Mexico.

4. Medical cannabis is limited to a non-refrigerated capsule, extract, or concentrate

that is ingested orally and that is not inhaled in particulate form as a vapor or by burning.

� 5. Students are prohibited from possessing, storing, or administering medical

cannabis to themselves in the absence of a guardian or designated school personnel at the school.

6. J. Paul Taylor Academy will provide documented witness of clean up and destruction of medical cannabis in the event of spillage or waste. The guardian will be notified the same day the spillage or waste occurs.

7. The guardian, school health personnel, and Executive Director will develop a plan

for the storage, possession, and administration of the qualified student’s medical cannabis. �

8. Participation in NMMC by qualified patients or primary caregivers does not relieve

them from criminal prosecution or civil penalty arising out of: a. Operation of a vehicle while under the influence of cannabis; b. Possession or use of cannabis:

i. On school grounds or property, including a school or public vehicle; ii. In the workplace of the qualified patient’s or guardian’s employment;

or iii. At a public park, recreation center, youth center or other public place.

9. J. Paul Taylor Academy is a drug-free zone. Except for those participating in this program, no student shall be permitted to possess any illegal substance on school grounds or school-related functions, or to attend school or school functions, while under the influence of any illegal substance.

10. Any person who makes a fraudulent representation to a school staff member, administrator or law enforcement officer about their participation in a medical use of cannabis program will be subject to discipline, arrest and/or prosecution.

11. The administration of medical cannabis will not disrupt the education environment and not cause medical cannabis exposure to other students. Medical cannabis will be administered in the nurse’s office.

12. The disciplining of any school employee who refuses to administer medical

cannabis to qualified students is prohibited.

L. School-Sponsored Field Trips and Excursions – Medical Administration 1. The guardian shall collaborate in advance of a school-sponsored field trip with the

school nurse or school health personnel to decide which adult attending the field trip will administer the medication.

2. While the student is on the field trip, the medication should be carried in its original container, including a standardized preprinted medication label; or the appropriate dosage of the medication should be enclosed in a separate container and should include a legible copy of the original label or, in printed form, all relevant information about the medication and its administration.

3. The medication, including the label or relevant information, will be provided to trained personnel for administration during the field trip. (See item 1 above). The school nurse or school health personnel will provide a review of the medication and its administration to the trained personnel on an as-needed basis. All trained personnel administering medication must understand what to do in an emergency.

4. The medication will be transported and stored in compliance with any special directions for the medication and will be secured as safely as possible.

5. An appropriate number of doses of a student’s medication should be provided to the school by the guardian in advance of a same-day field trip.

6. It is important that guardians provide adequate doses of a student’s medication to ensure appropriate administration of medication on every day of an extended field trip (overnight, and/or beginning before and/or extending beyond the duty day for school staff).

7. Guardians of students with medical needs are welcome and strongly encouraged to attend field trips with their children.

A school calendar is adopted each year designating the work schedule and all school holidays for exempt employees. Notice of work schedules for non-exempt employees, including required days of service and scheduled holidays, will be distributed each school year. For CBA-covered exempt employees, the full-time workday consists of 7.75 hours, unless negotiated with the Executive Director or through the collective bargaining process, including a duty-free lunch equal to the student lunch period but not fewer than thirty consecutive uninterrupted minutes. This duty-free lunch should fall between 11:00 AM - 1:00 PM. Teachers and other exempt employees may volunteer to give up a duty-free lunch to take on additional duties.

5.4 DUTIES J. Paul Taylor Academy has extra duties that must be performed in order to ensure the proper supervision of students outside of the classroom. Staff members are expected to assume and perform these responsibilities in a professional manner. Extra duties may be assigned by the Executive Director or his/her designee, consistent with New Mexico law. From time to time, J. Paul Taylor Academy might ask you to work beyond your normally scheduled hours. J. Paul Taylor Academy asks that full-time employees perform this work when requested. Attention will be given to any terms outlined to eligible employees through the CBA.

SECTION 6 – WAGE AND SALARY POLICIES 6.1 BASIS FOR DETERMINING PAY Staff salaries are determined by the current salary schedule. Several factors may influence your rate of pay. Some of the items J. Paul Taylor Academy considers are, relevant training and experience (see the Training and Experience Policy below), the nature and scope of your job, what other employers pay their employees for comparable jobs (external equity), what J. Paul Taylor Academy pays their employees in comparable positions (internal equity), and individual as well as J. Paul Taylor Academy’s performance.

J. Paul Taylor Academy Training and Experience Policy The Executive Director must receive verification of experience on a verification form by October 1 of the current school year or within 90 days of employment in order to grant credit for experience in the current contract year. Verification of experience received after this date will be granted in the next fiscal year. Responsibility for verification of prior experience rests solely with the employee. For CBA-covered exempt employees, one year's experience will be allowed for each year if approved, verified experience in public or private schools, or 15 credit hours teaching per academic year (including summer session) at the university level. days of experience shall have his or her experience rounded up to the next year when determining the salary on the salary schedule. CBA-covered exempt employees working at a 0.50 or more full-time equivalency (FTE) for an entire school year at J. Paul Taylor Academy shall qualify for a year of experience on the salary schedule. Any non-traditional experience that is aligned to the assigned duties of an employee shall be considered for additional experience at the discretion of the Director who hires that employee. Refer to the T & E Manual of Procedures (Version 2015 or later). Reported experience must be related to an employee’s duties in order to qualify as official years of experience on the salary schedule – those experiences as a professional educator, including administrative and supervisory experience, and as licensed or certified professionals in a clinical or parallel setting. The Executive Director has the final determination on approval of experience. The following considerations will be used in this determination:

• Is the experience related to the current duties of the employee? • Was the employee degreed or certified while gaining the experience?

For employees whose salary schedule includes ranges based on post-secondary education, additional undergraduate credit (post-degree) will be considered when the credit is beneficial to the staff member’s duties or to the school. If such an employee plans to gain additional undergraduate credit and wishes to add this to his/her training, the employee must gain written approval from the Executive Director prior to taking the class and acquiring the credit. 6.2 TIMEKEEPING Non-Exempt Employees: Accurately recording time worked is the responsibility of every non- exempt employee. Time worked is the time actually spent on a job(s) performing assigned duties. J. Paul Taylor Academy does not pay for extended breaks or time spent on personal matters. Any time worked beyond the contracted time must be approved by the Executive Director. Failure to obtain prior approval may result in disciplinary action. Authorized personnel will review time records each week. Any changes to an employee’s time record must be approved by his/her supervisor. Questions regarding the timekeeping system or time cards should be directed to the appropriate person.

Time Sheets – Non-exempt employees will be issued a time sheet. The employee will be given instructions on usage and instructions on what to do should a problem occur. Exempt Employees: Exempt employees are responsible for notifying the Executive Director and front office when deviating from contracted time. In the event a staff member needs to leave the building during school hours, the employee must notify the office of the departure and expected return time. Time away from school must be documented on a “Leave Request Form,” unless instructed otherwise by the Executive Director.

POLICY: ANTI-DISCRIMINATION AND HARASSMENT

I. PURPOSE The purpose of this Policy is to ensure a school environment in which students feel safe and secure. J. Paul Taylor Academy (JPTA) is committed to maintaining an environment conducive to learning in which students are not subjected to an intimidating, hostile, or offensive environment.

II. POSITION A. JPTA prohibits illegal discrimination including harassment against any student on the basis of

race, color, sex, religion, national origin, ancestry, age, physical or mental disability or serious medical condition, sexual orientation, or gender identity (referred to herein as “protected characteristics”), on school premises, at any school-sponsored activities, or during any school-supplied transportation, by any student, employee, volunteer, or any other person who is subject to the control of school authorities.

B. JPTA prohibits retaliation against any person for good faith reporting, or participating in the investigation of an alleged violation of this policy.

C. JPTA prohibits employees or students from knowingly giving false reports or information under this policy.

D. School officials, employees, and volunteers shall not permit or tolerate discrimination or harassment and shall immediately report, intervene, or stop the discrimination or harassment that is threatened, found or reasonably known, or suspected to be occurring.

III. DEFINITIONS

A. Definitions 1. “Discrimination” is treating someone differently because he or she has a protected

characteristic and such treatment results in denial or granting of a privilege or right that he or she would otherwise receive or not receive but for his or her being an individual with a protected characteristic(s).

2. “Harassment” is verbal or physical conduct that denigrates or shows hostility or aversion toward a student because of a protected characteristic(s) and that:

i. Has the purpose or effect of creating an intimidating, hostile, or offensive school environment; or

ii. Has the purpose or effect of unreasonably interfering with the student’s ability to benefit from any educational program or service provided by JPTA; or

iii. Is so offensive or pervasive as to adversely interfere with a student’s ability to benefit from an educational program, including negatively affecting the educational performance of the student.

IV. REPORTING, INVESTIGATION, AND STANDARDS

A. Reporting Students who feel they have been discriminated against or harassed by a school employee or by another student or students, are strongly encouraged to report the incident.

student should tell his or her guardians about the problem, and ask for the guardians’ help in reporting the prohibited conduct to school personnel.

2. Reporting Discrimination or Harassment by a School Employee: If a student believes he or she has been discriminated against or harassed by a school employee, the student should seek the assistance of his or her guardians in reporting such prohibited conduct to the Executive Director. If the incident involves the Executive Director, report the matter to the Chair of the Governance Council. Any employee who witnesses or is aware of conduct that may violate this policy shall report it to the Executive Director or their immediate supervisor at his or her earliest opportunity. Any employee who receives any report of discrimination against or harassment of a student, whether the report is given by a student, guardian, or another employee, or who himself or herself observes instances of discrimination or harassment must notify his or her immediate supervisor or the Executive Director, regardless of whether the employee receiving the report or observing the instance considers the matter credible or significant.

B. Investigation 1. All reports of violations of this policy shall be promptly investigated by the Executive

Director or his/her designee. 2. The Executive Director shall create a procedure for investigations, which shall include a

provision that the final investigation report sufficiently documents the investigation and the basis for any disciplinary or other action taken as a result of the investigation.

3. The Executive Director shall communicate with the alleged victim and alleged perpetrator(s) and their guardians during the investigation where reasonable and promptly report to each of them as to whether the complaint was substantiated.

4. The Executive Director shall make every effort to complete the investigation process within a maximum of ten (10) school days of receipt of the complaint, except in extenuating circumstances, and then report the findings to the student and guardians to the extent appropriate protecting student confidentiality.

5. If guardians and students are not satisfied with actions taken and wish to appeal the findings and decision of Executive Director, they may request in writing a review of the investigation (“grievance”) by the Governance Council. The Council shall make a determination on a grievance within fifteen (15) school days of the submission of a grievance and may concur with the actions of the Executive Director, or direct further or different action. The Governance Council is the final appeal authority on a grievance.

6. Staff and students are expected to cooperate with an investigation of a complaint of harassment.

7. Where violations of criminal law may have occurred, the Executive Director may report the matter to the appropriate law enforcement agency.

C. Standard: When assessing whether violation of this policy has occurred and the appropriate discipline, the Executive Director or designee shall consider the nature and extent of the conduct, the age of the student(s) involved, the context in which the alleged conduct occurred, and any prior history of conduct prohibited by this policy on the part of the violator.

V. CONFIDENTIALITY The identities of those reporting violations of this policy and those cooperating in the investigation of alleged violations shall be kept confidential to the extent consistent with the requirements of a full and fair investigation, the due process rights of persons charged with violations, and state and federal law.

have failed to discharge a duty imposed by this Policy, shall be subject to sanctions, including, but not limited to, warning or reprimand, suspension, termination, or discharge, subject to applicable procedural requirements and the Collective Bargaining Agreement, if applicable.

B. Any student who is found to have engaged in conduct prohibited by this policy shall be subject to discipline, including, but not limited to, suspension or expulsion, subject to applicable procedural requirements, and to any applicable limitations imposed by state and federal disabilities law.
