MEETING OF THE BOARD OF MEDICAL EXAMINERS OF THE STATE OF NORTH CAROLINA Blockade Runner, Wrightsville Beach, North Carolina October 8-10, 1971 The Board of Medical Examiners of the State of North Carolina met at the Blockade Runner, Wrightsville Beach, North Carolina, October 8-10, 1971, for the purpose of interviewing applications for license by endorsement and other business. Friday, October 8th 6:00 P. M. The Board convened for dinner. Drs. H. Lee Large, Jr. , President, Joseph J. Combs, Secretary-Treasurer, Frank Edmondson, Bryant L. Galusha, Joseph W. Hooper, Jr. , Cornelius T. Partrick, Vernon W. Taylor, Jr. , Mrs. Louise J. McNeill, Administrative Secretary, and Mrs. Betty Joe Cooke, were present. RE: Re uirements for Credentials - Dr. Joseph J. Combs moved that the secretary be instructed that he is no longer required to get letter of approval of the medical society and letter from the commanding officer with regard to military personnel applying for license by endorsement. This motion was duly seconded by Dr. Vernon W. Taylor, Jr. and passed. RE: Dr. Thomas D. Hoard, who is in residency training at New Hanover Memorial Hospital, has requested that he be granted license on the basis of Flex examination. He has no state medical license. Dr. Joseph W. Hooperp Jr. stated that he had examined him personally for 31 days. VERDICT: Dr. Cornelius T. Partrick moved that Dr. Thorns s D. Hoard be granted license on the basis of the Flex examination when he completes requirements and makes a personal appearance before the Board. This motion was duly seconded by Dr. Joseph W. Hooper, Jr. and passed unanimously. (See P. 157 these Minutes) RE: Dr. Bennie Brooks Ward - Application for BNDD Number Dr. Ward has applied for all schedules, narcotic and non-narcotic. VERDICT: Dr. Bryant L. Galusha moved that Dr. Bennie Brooks ward be approved for BNDD number, Number 2 non-narcotic, in addition to 3, 4 and 5. This motion was duly seconded by Dr. Frank Edmondson and passed unanimously. Dr. Joseph W. Hooper, Jr. abstained from voting. RE: Biennial Re istration Reinstatement, The licenses to practice medicine of the following physicians were suspended for failure to register as required by the General Statue of North Carolina 90-15. 00 and they have now registered: Dr. Thomas Eugene Breeden Dr. John Burton Nowlin Dr. John Albert Patterson Dr. George McVay Rawlins Dr. Hoyle Edward Stetzer RESOLVED:: T }at the medical licenses of the abobe listed physicians be reinstated. RE: Fire Insurance - The secretary reported to the Board that $5, 000. 00 fire insurance is carried. VERDICT: Dr. Joseph W. Hooper, Jr. moved that the amount of fire insurance be doubled. This motion was seconded and passed. RE: Au ust 1 72 Meetin - Dr. Galusha moved % at the Board hold this meet- ing August 3-6th, 1971, at the Grove Park Inn, Asheville. OF THE STATE OF NORTH CAROLINA

The Board of Medical Examiners of the State of North Carolina met atthe Blockade Runner, Wrightsville Beach, North Carolina, October 8-10, 1971,for the purpose of interviewing applications for license by endorsement andother business.

Friday, October 8th6:00 P. M.

The Board convened for dinner. Drs. H. Lee Large, Jr. , President,Joseph J. Combs, Secretary-Treasurer, Frank Edmondson, Bryant L. Galusha, JosephW. Hooper, Jr. , Cornelius T. Partrick, Vernon W. Taylor, Jr. , Mrs. Louise J.McNeill, Administrative Secretary, and Mrs. Betty Joe Cooke, were present.

RE: Re uirements for Credentials - Dr. Joseph J. Combs moved that thesecretary be instructed that he is no longer required to get letter ofapproval of the medical society and letter from the commanding officer withregard to military personnel applying for license by endorsement. This motionwas duly seconded by Dr. Vernon W. Taylor, Jr. and passed.

RE: Dr. Thomas D. Hoard, who is in residency training at New HanoverMemorial Hospital, has requested that he be granted license on the basis of Flexexamination. He has no state medical license. Dr. Joseph W. Hooperp Jr. statedthat he had examined him personally for 31 days.

VERDICT: Dr. Cornelius T. Partrick moved that Dr. Thorns s D. Hoard be grantedlicense on the basis of the Flex examination when he completes requirements andmakes a personal appearance before the Board. This motion was duly seconded byDr. Joseph W. Hooper, Jr. and passed unanimously. (See P. 157 these Minutes)

RE: Dr. Bennie Brooks Ward - Application for BNDD Number — Dr. Ward hasapplied for all schedules, narcotic and non-narcotic.

VERDICT: Dr. Bryant L. Galusha moved that Dr. Bennie Brooks ward be approvedfor BNDD number, Number 2 non-narcotic, in addition to 3, 4 and 5. This motionwas duly seconded by Dr. Frank Edmondson and passed unanimously. Dr. Joseph W.Hooper, Jr. abstained from voting.

RE: Biennial Re istration —Reinstatement, — The licenses to practice medicineof the following physicians were suspended for failure to register as required bythe General Statue of North Carolina 90-15.00 and they have now registered:

RE: Fire Insurance - The secretary reported to the Board that $5,000.00fire insurance is carried.

VERDICT: Dr. Joseph W. Hooper, Jr. moved that the amount of fire insurancebe doubled. This motion was seconded and passed.

RE: Au ust 1 72 Meetin - Dr. Galusha moved % at the Board hold this meet-ing August 3-6th, 1971, at the Grove Park Inn, Asheville. Dr. Edmonton secondedthe same and it was passed unanimously.

RE: Forei M dical Graduates - Flex Examination - Dr. Joseph W. Hooper,Jr. moved that graduates of foreign medical schools applying forlicense byexamination be required to take the examination in Raleigh under the supervisionof the Board of Medical Examiners. This motion was duly seconded by Dr. V. W.

Taylor, Jr. and passed unanimously.

HE: Conversion to Full License - The following physicians are applyingfor conversion from limited 4 full licanse:

Dr. Douglas Edward MooresideDr. David Rafat - Naturalized

Name changed by court order to "Raft"

VERDICT: Dr. Joseph W. Hooper, Jr. moved that the licenses of the abovephysicians be converted to full license and that Dr. David Rafat's name be changedto "Raft" as per court order. This motion was duly seconded and passed unanimously.

The meeting was adjourned.

VERDICT: Dr. Watson Caufield Arnold, Jr. was approved for license by endorse-ment of credentials, if and when his credentials are completed satisfactory to thesecretary.

HE: Dr. Oswald Berrios is a native of Puerto Rico and a graduate of theUniversity of Maryland in 1952. He was licensed in Maryland by examination and inPennsylvania, Louisiana and Puerto Rico.

Dr. Large: We would like to have a letter from someone who has known you inBaltimore.

Have you had azar difficulty with a medical examining board?I started practicing in Baltimore instead of going to Puerto Rico. At thattime I practiced in private practice. In 1961 some of the doctors perhapsfelt that I was infringing their area being from outside and charges werebrought asfar as an error made in interpreration of an x-ray. A lady gothurt, slammed the door and she was unable to extend the army. At thattime I had a group, seven to eight persons, surgeon, internist, obstetrician-gynecologist, dentist. I took the x-ray in the position it was. She could

not extend it. In thi. s position it usually shows head of the radius —- -.At that time it did look like there was a fissure fracture, together withclinical evidence, swelling. I did interpret it as a fracture. About19 days after they had taken another x-ray in another office with ex-tended arm. At that time they felt there was no fracture. For that reasonthey felt I had tried to state there was a fracture when there was nofracture. Following that the orthopedist said fissure fractures not unusualto occur and that position being extended is the only way it can show. Asa result the Board of Medical Examiners felt even with that my licenseshould be revoked. This decision was stayed after proper hearing. Evenif I had made a mistake it was not so big a case for that severe punish-ment. 'Ihe ver dict was put aside. Thus I have never been without a licenseand have practiced since 1952. Since then I have had all my reciprocitiesfollowing this incident. Louisiana, Puerto Rico and Pennsylvania gave me

reciprocity and I was certified by the American College last year.

Dr. Large: There were other charges, do you remember what they were?A. The others in general were I did not take good care, proper care of some

of the patients. There again all the patients came in and saif if therewas anybody did care it was I. '%ere was a third case. I have alwaysfelt patients —- -; I was having office hours, somebody was there 24hours, either I or my assistant. I used to get a lot of traumatic cases.

You were charged with charging too much.This patient came in, no insurance, called me, who treated the same. Onthe way out said she did try to pay some money toward the bill eventhough I understated the amount. A week or two after she brings the paperin for some kind of insurance. Then I said I charged the same as if noinsurance. My secretary filled the paper and sent them out. Then she saidthere was a difference in what she would have paid and the insurance. Itwas interpreted because she had insurance I ordered to increase the billproportinately. It was not true. You have to treat patients just thesame as they have the money. If they have insurance they should pay theusual fee as anyone else.

A complaint was lodged by the Child Accident Plan for charges to children.It was a matter, I felt you shauld charge —- -; There are some things atthat time, laceration, many of them yuu have to depend on the degree ofseverity, time you spend with the patient. They feel regardless of thetime spent, it is a small time, charge low1y. It was based more on whatthe patient had.

A. No sir, I had a year of interneship and one year of Internal Medicine.After that I went to practice.

Dr. Galusha: Anesthesia?A. I took 6 months first in Radiology, then I took 3 years Anesthesiology

training under Dr. Adriani. I taught at Tulane my third year, thenLouisiana State fourth year medical. school training at Tulane. Then Iwent to Pittsburgh at the University School of Medicine. There are 5hospitals there. I was stationed at the Eye and Ear Hospital, consultantat Presbyterian Hospital with Dr. Peter Safar. From there I went chief ofAnesthesiology to Franklin Hospital, two hours from Pittsburgh where Istarted Inhalation Therapy and Pulmonary Function Lab.I am planning to go to Forsyth Memorial -ospital in Inhalation Therapyand Pulmonary Function.

Dr. Combs: What position have they offered you?A. Assistant Chief of Anesthesiology and director of Pulmonary Function and

Inhalation Service.

Dr. Galusha: Do these men know you well".A. He has known me, Dr. Safar. I did not work so much with him.

You are leaving there because you have a better opportunity'?I am leaving because of the cold weather, snow almost every day, secondI want to do more Inhalation Therapy per se.

Dr. Large: On your original application there is the question of statement inwhich you say " I have never been charged with violation of any Federal,State or Local Statute except as follows: None"I di$ not write that. 'this was made by the Board of Medical Examines.I/told by. them because there had been no charge proved in the past legally.I have never had a license revoked. This is what I was told.

VERDICT: Dr. Cornelius T. Partrick moved that the Board withhold and notgrant license at this time, but pursue further inquiry: 1. By asking the MarylandBoard of Medical Examiners whether in fact they did fill out the answers and2. That he furnish letters from Drs. Safar and Adriani, to send letters of re-commendation. This motion was duly seconded by Dr. Bryant L. Galusha and passed.

Dr. Large: The Board wants to get this absolutely clear with respect to line 4.Did you fill in this word, type this word'?

Dr. Galusha: ke you working at Forsyth?A. No sir, they told me not to work until they heard from you. I have been

going around. The service has been behind because they could not geta respiratory director.

Dr. Combs: How long have you been in Winston-Salem?A. A week, I have not done any medicine, just working at the service.

Is it possible for this Board to allow me just Inhalation Therapy as muchas they need it there and the time it takes. Could I be allowed pendingthat you receive this information you want, not in Anesthesiology butInhalation Service? We are trying to bring it up to standard of theUniversity of —- - . CouM I be allowed until your next meeting?

Dr. La rge: Anything you do in the way of prescribing, treating or diagnosingpatients is within the framework of the Medical Practice Act and by de-the practice of medicine. If you worked in Inhalation Therapy, if youare not going to practice medicine, it would have to be limited toInhalation Therapy technician. You could not exercise any judgment.

Dr. Gelusha: 'Ihere is nothing to prevent you from being a technician in Anesthesiology,but this is under the direct direction of a physician.You are cognizant what a lay - - -can do. Their duties are broad. In mosthospitals the chiefs of Inhalation Therapy are not doctors.

A. That is right. Then I can do that?

Dr. Galusha: The Board does not have any authority over that.

Dr. Large: That is right, our authority is with doctors and - - -and practice,you have broken laws feloniously.

A. In Anesthesia, when we used to have nurse anesthetists, they would - --under the chief of service.

Are you a nurse".What I am trying to bring out is this - - - -. I did not expect this.I have three kinds, one in college, to be two months without doing anythingis very traumatic.

Dr. Partrick: Would it help you if we were to write the chief of the respectiveservices in which you expect to work and explain the situation, that youdo not have a license and with that limitation they could employ yourtalents as a technician? Would that help?That would be very nice to make it official.

Q. Other than prWice of medicine, this Board has no power of regulation.That would help.

Dr. Large: In anesthesia I think you would find it hard not to overstep your bounds.

October 9thM Dr. William Alton Moo , Broughton Hospital, Morganton, North Carolina-

(See previous Minutes Dr. Moody appeared and advised that he is now working atBroughton Hospital and involved with the Mental Health Clinics of five counties;that his condition is satisfactory and that he is not taking any medication. He saidthat he had told the superintendent he would stay there for a year, but was not surehe would want to stay in institutional work. Dr. Moody was advised that the Boardwas pleased with his progress and that it was hoped he would not entertain the ideaof going back into private practice too soon.

The Board directed that Dr. Moody be seen in March, 1972.

RE: Dr . Jose h Claude Fes erman, Stanley, North Carolina- (See previm sMinutes) - Due to illness Dr. Fesperman was unable to appear before the Board inAugust, 1971, as directed and because of this the Board instructed him to abstainfrom practice until his appearance at this time. Dr. Fesperman appeared and statedthat he stayed in the hospital for three weeks with abscesses on his legs. He saidhe had taken some ta lwin by mouth and by injection for pain in his legs before going to

the hospital. He also said that he is on some medication prescribed by hisdoctors, but denied being on any other type of medication. He related that hewas improved and that his doctor had said he could go back to work gradually,begin with an hour in the morning and an hour in the afternoon. A report waspresented from his psychiatrist who stated that Dr. Fesperman was improving andand doing very well.

Dr. Fesperman asked if he could return to work gradually and if he couldsee his physician less often. 'Ihe Board agreed that he could see his psychiatristevery two months and ask that he and Dr. Waggonsr give the Board reports at threemonth intervals. The Board also agreed that he might return to work gradually, butwarned him of the danger that he might not be able to do this. The Board told Dr.Fesperman that it was pleased with his progress. He is to be seen at the January,1972 meeting.

RE: Dr. Thomas 0. Wheless Louisbur, North Carolina - In May, 1971 the Bmdapproved Dr. Wheless for classifications 3, 4 and 5 under the new Narcotic Law. Dr.Wheless then requested to appear to petition for full narcotic privileges. InAugust Dr. Wheless was issued BNDD number with full privileges and was advised bythe secretary to abstain from writing for drugs under 2N until he had. @peared beforethe Board.

Dr. Wheless appeamd. and petitioned the Board to approve him for full nar-cotic tax stamp. He stated that he did a general practice; that he had no oneto cover for him in writing prescriptions for hard narcotics if the same wereneeded; that in that case he referred.

VERDICT: Dr. Joseph J. Combs moved that Dr. Thomas 0. Wheless be grantedthe privilege of applying for full narcotic tax stamp. This motion was dulyseconded by Dr. Bryant L. Galusha and failed to pass.

The president advised Dr. Wheless the action of the Board.

RE: Dr. Robert E. Gardner formerly Hertford, North Carolina — Dr.Gardner, who has been a patient at Cherry Hospital, appeared for a routine interview.He is working at the Crippled Children's Hospital, O'Berry Center, and stated thathe is doing well; that he is getting no therapy. To be seen in March, 1972.

Dr. Frank Edmondson nominated Dr. Cornelius T. Partrick for president forthe coming year. His motion was duly seconded and passed.

Dr. Frank Edmondson moved that the application for approval for an assistantto a physician be adopted with suggested changes. This motion was duly secondedand passed.

Dr. Frank Edmondson reviewed the Duke program and moved that the Duke programbe approved, provided, however, that it shall conform to the uniform and minimumstandard that will be forthcoming by the American Medical Association Council onMedical Education. This motion was duly seconded by Dr. Joseph J. Combs and passed.

Dr. Cornelius T. RE: Dr. Donald R. Baile , Charleston, West Virginia (See previous Minutes)Dr. Bailey appeared before the Boar d of Medical Examiners in June, 1971 applyingfor licence by endorsement of credentials and due to certain information at handthe Board directed further investigation. A t the August, 1971 meeting the Boarddirected that Dr. Bailey be asked to make another appearance before the Board. On

October 1st Dr. Bailey advised the secretary that there had been such delay inreceiving license that he was withdrawing his application and asked for refund offee. The secretary refunded Dr. Bailey, less 10$ as per the policy of the Board.

RE: Dr. V. Clifton Lanier, Welcome, North Carolina - The State Bureau ofInvestigation has: reported that in the course of an investigation with regard toa trial, discrepancies in refills of stimulant drugs for the defendants werefound, which involved Dr. Lanier.

VERDICT: Dr. Cornelius T. Partrick moved that Dr. V. Clifton Lanier beinterviewed at the December, 1971 meeting. This motion was duly seconded andpassed.

RE: Dr. Albert Kodack, Asheville, North Carolina - Dr. Kodack reportedthat his patient who is on narcotics is attempting to provide for care of a schoolage son in order to enter Broughton Hospital for treatment, but this has not todate been accomplished.

VERDICT: This report was received as information. 'lhe Board directed thatreport be requested of Dr. Kodack for the December, 1971 meeting.

RE: Dr. Gra C. Siske, Pleasant Garden, North Carolina —Report of in-vestigation was received from the Bureau of Narcotics in September, 1971 on Dr.Siske. It was stated that his narcotics and DACA drugs were seized in Februa~,1971, at which time Dr. Siske surrendered his narcotic tax stamp and stated thathe planned to retire from medical practice. However, he decided to continuepractice, operating a weight clinic. The report stated that discrepancies werefound in Dr. Siske's records on amphetamines; that, had kept no record on narcoticsdispensed.

VERDICT: Dr . Bryant L. Galusha moved that Dr. Grady Siske be seen at theDecember, 1971 meeting. This motion was duly seconded and passed.

RE: Dr. James S ullock Lambert, Swannanoa, North Carolina — The secretarypresented report dated September 29%, 1971, from the Pharmacy Board that noimproper prescrip tions issued by Dr. Iambert had been found in the area ofSwannona when inspection was made in July, 1971. '%is was received as infornsbion.

HE: Dr. Jack Foster, Eden, North Carolina - The secretary presentedreport of the State Bureau ofInvestigation, which was precipitated by the Chiefof Police of Eden. It was alleged that numerous prescriptions for narcotic drugshad been written by Dr. Foster; that several of the prescriptions had been pickedup by Dr. Foster after writing the prescriptiors in the store and paying for thesame; that in some instances patients had not received the drugs; that somepersons whose names were on the prescriptions had never been treated by Dr. Fos ter;that some of the persons listed on the prescriptions did not exist.

Dr. Foster appeared with his attorney, Mr. Monroe M. Redden of Hen-dersonville. Dr. Foster stated that while practicing in Hendersonville he would,write some prescriptions for his mother and pick up the drugs to take to her.He also stated he had picked up some prescriptions for a terminal cancer patienton whom he was making a house call and to the best of his knowledge everyone forwhom he had written prescriptions had received the drugs.

Dr. Foster's attorney, after conferring with his client, stated that Dr.Foster would withdraw his application for BNDD number and not apply for ScheduleII narcotics. The Board did not resume deliberations on the testimony awaiting the out-come of Dr. Foster's offer not to apply for the privilege of writing for hard nar-cotics.

The Board delegated Dr. Frank Edmondson to discuss the matter cf Dr. Fceterwith the councillor for the State MedicalSociety for further investigation.

RE: Dr. John Bum amer, Newton, North Carolina - (See previous Minutes)The secretary advised that he had requested report from Dr. Bumgarner for this meet-ing but had received no reply from him.

VERDICT: Dr. Cornelius T. Partrick moved that he be requested M appearat the December, 197l meeting. M.s motion was duly seconded and passed.

HE: Finance Committee — The incoming president appointed the followingto the Finance Committee: Dr. H. Lee Large, Chairman, and Drs. Frank Edmondsonand Vernon M. Taylor, Jr.
