We are furnishing you photocopy of the Supreme Court decision on the KaDisanan nq Manqqaqawa at TAC sa IRRI-Oraanized etc. v s . Secretary of Labor etc., et al., G . R . No. 89331. This was faxed to you yesterday. The

important to note that the decision brings out two significant precedents f o r international organizations similar to ICMC and IRRI, namely:

case lasted three years and four months. It is

1. - The Supreme Court ruling applies not only to ICMC and IRRI as agencies enjoying diplomatic immunities by law or by agreement, affecting other similarly situated international agencies operating in the country;

2. The unan'imous decision was penned by the Chairman of the Second Division, Justice Melencio-Herrera, concurred by three participating justices, a fourth (Justice Paras) being on leave;

3. The constitutional validity of P.D. 1620 is now unassai'lable; and,

4 . Thenceforth, no attempts for certification will be entertained in IRRI or in any other international agency. Parenthetically, I recall Mr. Bertotti's earlier observation that IRRI should not waive its immunity in instances.

With the above observations, t.,e decision cannot be overturned in any other proceeding. Perhaps, as a matter of pride, opposing lawyers may attempt a motion for reconsideration merely to please their clients, but the way the decision is worded, it is close to "mission impossible". You may thus consider the case closed.

May I suggest that Atty. Gloria and Mr. Pascual discuss the implications o f this decision on IHRI. Should you require that I be present as you discuss this with your directors and department heads, please advise.
