REQUEST FOR PROPOSAL

MODULARS FOR THE KENNEDY SCHOOL

The Brockton Public Schools requests SEALED PROPOSALS from qualified contractors for the design,

prefabrication, site assembly/installation, all services required to complete and deliver the modular

classroom units, as specified herein, ready for use and occupancy, and all removal costs at the conclusion

of the lease. The proposal shall also include the design and construction of connectors and

connectors/entrances from existing entrances to the modular units. All connectors and modular

classroom units shall meet all state and local building codes. Proposal will be received at the Office of

Financial Services, Brockton Public Schools, Crosby Administration Building, 43 Crescent Street,

Brockton, MA 02301 until 10:00 A.M. E.S.T. Wednesday, March 5, 2014. Proposals will be received

only and not publicly opened and read. Submissions must be made in a sealed envelope, clearly

labeled as: “ REQUEST FOR PROPOSAL FOR MODULARS FOR THE KENNEDY SCHOOL”.

The City of Brockton assumes no liability for proposals mistakenly opened due to improperly labeled

envelopes and return same to the offeror without notice.

Specifications and all other bid documents may be obtained after 1:00 P.M., Wednesday, February 19,

2014 on our website. The hyperlink is http://www.brocktonpublicschools.com/page.cfm?p=64.

Wages are subject to minimum wage rates as per M.G.L., Chapter 149, Section 26 to 27D inclusive.

All bidding procedures shall be in strict accordance with M.G.L., Chapter 149, Section 44E(4).

The Contractor must posses and submit with his/her proposal a DCPO Certificate of Eligibility in

Modular Construction and a Contractor Update Statement.

The successful offeror is required to furnish a five percent (5%) Proposal Deposit, and a one hundred

percent (100%) Performance and Payment Bond upon award of the contract for this proposal.

The Brockton School Committee reserves the right to reject any and all proposals, in whole or in part, to

make awards in a manner deemed in the best interest of the City as provided under Massachusetts

1. Sealed proposal for REQUEST FOR PROPOSAL FOR MODULARS FOR THE KENNEDY

SCHOOL, will be received by Aldo E. Petronio, Executive Director of Financial Services, Crosby

Administration Building, 43 Crescent Street, Brockton, MA 02301, until Wednesday, March 5,

2014, at 10:00 A.M. E.S.T.

All procedures regarding the submission of proposals shall be in strict accordance with

Massachusetts General Law Chapter 149, Section 44E(4). Proposals in excess of $25,000.00 are

subject to public bidding procedures relating to Chapter 149, Section 44E(4) and must be

accompanied by DCPO Certification and an Update Statement.

5. All proposals/bids must be submitted in a sealed envelope, bearing on the outside the name of

the bidder/offeror, his address, and the name of the bid/proposal.

6. The City of Brockton/School Committee reserve the right to reject any or all proposals or

to waive any irregularities or defects in any proposal should it deem it in the best interest of

the City of Brockton to do so. Any proposal received will be binding for ninety (90) days

beyond the DATE and RECEIPT.

7. Any or all questions relative to these specifications shall be submitted in writing to the

awarding authority at least seven (7) days before the DATE of PROPOSAL RECEIPT, and

written answers shall be sent to all offerors as an addendum.

INSTRUCTIONS TO OFFERORS

A. PROPOSAL REQUIREMENTS

1. Sealed proposals for MODULARS FOR THE KENNEDY SCHOOL

will received at the time, date and place as stated in the 'Advertisement/ Request for

Proposals" and in accordance with proposal documents.

2. The general proposal form, completed and signed in longhand by the offeror must be

accompanied by a proposal deposit equal to five (5%) percent of the amount of the base

proposal. The proposal deposit may be in the form of certified check, bank treasurer's or

cashier‟s check, or a bid bond from a licensed surety company and must be placed in an

envelope, sealed, and labeled “MODULARS FOR THE KENNEDY SCHOOL -

PROPOSAL DEPOSIT" and delivered to the Awarding Authority, the Brockton School

Department, as stated in the "Request for Proposal".

3. All proposal deposits shall be returned within five (5) days, (Saturdays, Sundays, and

holidays excluded) after the award of the contract by the Brockton School Committee. If

an offeror fails to perform his/her agreement to execute a Contract and furnish a payment

bond as stated in his/her proposal, his/her proposal deposit shall become the property of

the City of Brockton; provided that the amount of the deposit which becomes the property

of the Awarding Authority shall not, in any event, exceed the difference between his/her

proposal price and the proposal price of the next lowest, responsible and eligible offeror;

and provided further that in case of death, disability, bona fide clerical or mechanical error

of a substantial nature, or other unforeseen circumstances affecting the offeror, his/her

proposal deposit shall be returned to him/her.

4. No claims for immunity or exceptions predicated upon misunderstanding or failure to

correctly interpret the above paragraph will be allowed.

5. The Specifications and Proposal Documents will be available as stipulated in the "Request

for Proposals".

B. OFFEROR'S REPRESENTATION

1. Each offeror by presenting a proposal represents that:

a. The offeror has read and understands the proposal documents and

the proposal is made in accordance therewith.

b. The offeror has visited each site and is familiar with the conditioned under

which the work has to be performed.

2. Failure to examine the Proposal documents and the sites will not relieve any offeror

from any obligation under the proposal as submitted.

C. REQUEST FOR INTERPRETATION

1. All offerors will promptly notify the Awarding Authority of any ambiguity, inconsistency, or

error that they may discover upon examination of the Proposal Documents, the sites, and/or

local conditions.

2. Offerors requiring clarification or interpretation of the Proposal Documents should make a

written request to the Awarding Authority through the Facilities Office, Crosby

Administration Budding, 43 Crescent Street, Brockton, MA 02301. The latter office will

answer such requests if received before seven (7) calendar days prior to the date for the

receipt of proposals.

3. Interpretation, correction, or change(s) in the Proposal Documents will be made by an

addendum, which will become part of the Proposal Documents. Neither the Awarding

Authority nor its representative(s) will be held accountable for any oral instructions.

4. An addendum will be named or faxed by the Awarding Authority to every individual,

firm or company on record as having taken or received a set of the original Proposal

Documents.

5. Copies of the Addendum will be made available for inspection at the location(s) listed

in the Advertisement as to where Proposal Documents are on file.

D. TAXES/EXEMPTION

The Awarding Authority is exempt from payment of the Massachusetts Sales Tax. The City of

Brockton/ Brockton School Department, under M.G.L. ch. 64H, Section 6 (d) and (e) has been

issued a Certificate of Exemption number 046-001-382 by the Massachusetts Department of

Revenue.

E WITHDRAWAL OF PROPOSAL

No offeror shall withdraw his/her proposal for a period of ninety (90) days, Saturdays, Sundays

and legal holidays excluded, after the date set for the receipt of the proposal.

F. SUB-CONTRACTS

Work shall be performed by the General Contractor without recourse to sub--contracts whenever

possible.

G. PERFORMANCE AND PAYMENT BONDS

Proposals for which the contracted/lease price is equal to, or, in excess of $25,000.00 are subject

to all bonding requirements of Massachusetts General Law chapter 149, and, as such, require both

a performance bond and a payment bond equal to one hundred percent (100%) of the total project

cost and issued by a company authorized to do business under the laws of the Commonwealth,

and, satisfactory to the Awarding Authority.

H. CONSTRUCTION TIME SCHEDULE

The Contractor will start the preparatory work under this Contract on written notice form, and, on

the date set by the Awarding Authority. The entire project will be completed by August 8, 2014. It

is the intent of the Awarding Authority that the project shall be completed prior to the start of the

2014-2015 school year on September 1, 2014. The Contractor must be able to assure the

Awarding Authority that this completion date shall be achieved. Liquidation Damages in the

amount of $l,000.00 per day will be assessed if the site, identified in the specifications herein, is

not complete by the above date.

L. SITE VISITS

All offerors are required to inspect the site, as fisted herein, that refurbished modular classrooms

are anticipated for installation. Site visit shall occur between the hours of 8:00 A.M. and 3:00

P.M. on regular school days and must be coordinated in advance with the Facilities Department.

Offerors are requested to contact Mr. Kenneth M. Thompson at (508) 580 - 7503 prior to their

visit.

J. BUILDING AND OTHER PERMITS

The successful offeror shall be required to obtain any necessary permit(s) or license(s) prior to

performing any work at each site. The City of Brockton will not waive any relevant municipal

fees.

The successful offeror is responsible for the filing of any other permits, fees, inspections, etc., as

may be required by State and local authorities.

K. AFFIRMATIVE ACTION PLAN

The offeror‟s attention is drawn to the following procedures and goals to be achieved on contracts

with the City of Brockton.

a. It is the intent of the city of Brockton to target ten (10) percent of all contract work to

Minority Business Enterprises (MBE) and five (5) percent to Women Business Enterprises

(WBE). To achieve these goals, emphasis will be made to attract contracting firms, in these

categories, to bid School Department projects. Whenever possible, every effort will be made

to award contracts to Minority and Women Business Enterprises.

b. Contractors shall request from the State Office of Minority Business Assistance,

(SOMBA), 100 Cambridge Street, 13th Floor, Boston, MA 02202, their list of certified firms

when soliciting sub-contractors. Award of contracts will be only made to offerors who have

identified MBE and WBE sub-contractors to be used on projects or can provide sufficient

information that the offeror did solicit from MBE and WBE but was unsuccessful.

c. Contractors shall request from the State Office of Minority Business Assistance,

(SOMBA), a list of certified firms supplying material, equipment, and other non-

professional services for School Department contracts (and leases). The target goals of ten

percent (10%) for MBE and five percent (5%) for WBE are to be obtained by the Contractor

when purchasing materials are hiring equipment.

d. For projects in excess of $50,000.00, all NON-Minority/Women Business Enterprises

shall submit an Affirmative Action Plan.

e. Offerors requiring assistance in the preparation of the Affirmative Action Plan should

contact the Affirmative Action Officer for the City of Brockton or Mrs. Elisa Martineu,

Affirmative Action Officer for the Brockton Public Schools, (508) 580 -7535.

7. The proposal must be accompanied by a proposal deposit in the form of a bid bond, a

certified check, a treasurer‟s or cashier‟s check issued by a responsible bank or trust

company, payable to the City of Brockton/Brockton Public Schools. The bond shall be

with a surety company licensed to do business in the Commonwealth and satisfactory to

the Awarding Authority, and conditioned upon the faithful performance by the principal of

the agreements contained in the proposal. The amount of such deposit shall be 5% of the

amount of the base proposal.

Certificate of Insurance

(Service Contracts Only*)

As successful proposer on this Contract, you must supply the City of Brockton with a properly endorsed

CERTIFICATE OF INSURANCE. Both the City of Brockton and the Vendor shall be named as co-

insured/additional insured and the City shall be named as certificate holder, and certificates of insurance shall be

furnished to both parties. Reporting of accidents and claims shall be done by the Vendor. This Certificate MUST

accompany the Contract. Unless otherwise provided for by the Contract, Vendor shall meet the following

insurance requirements:

WORKERS’ COMPENSATION: The Vendor, before commencing performance of the work required to be done

under the Contract, shall provide for the payment of compensation, provided by the General Laws (ter. Ed.)

Chapter 152 as amended to all persons to be employed by him/her in connection with said performance and shall

continue in full force throughout the period of this Contract.

PUBLIC LIABILITY: Within fifteen (15) days after the award of this Contract the Vendor shall, at his own

expense, procure and maintain insurance for Public Liability in the minimum amount of $500,000/$1,000,000 and

Property Damage Liability in the minimum amount of $50,000/$100,000.

The policies shall contain a provision worded as follows: “The Insurance Company waives any right to subrogation

against the City of Brockton which may arise by reason on any payments under this policy.”

The policy/policies must contain on the face a notation that it/they cannot be cancelled without at least thirty (30)

days notice in writing to the City as owner.

Furthermore, the certificates of all policies shall provide for notice of cancellation of the Contracting officer and

the certificates shall indicate that the above provisions have been included.

Indemnification and Release The Vendor shall indemnify and hold the City of Brockton harmless from any and all acts & omissions arising out

of this contract by the Vendor, its agents, employees or representatives. Furthermore the term Vendor shall include

Further, the Vendor shall indemnify and hold harmless the City of Brockton against any/all suits, claims, actions,

costs or damages to which the City may be subject to by reason of damages to the property or person of anyone,

This agreement made this ___________ day of _________ in the year 2014 and by and between

hereinafter called the 'Contractor" and the City of Brockton/School Committee, hereinafter called the

"Awarding Authority" witnesseth that the Contractor and the Awarding Authority for the consideration

stated herein agree as follows:

Article 1. STATEMENT OF WORK

The Contractor shall furnish all labor, materials, equipment and insurance, and perform all work required

for entitled " MODULARS FOR THE KENNEDY SCHOOL " in strict accordance with the general

conditions, specifications, and, if applicable, addenda. Said specifications, general conditions and

addenda, are incorporated herein by reference, and, are made a part hereof, provided, however, since this

is a governmental agency contract, that terms of any of these documents inconsistent with applicable law

shall have no effect.

Article 2. TIME OF COMPLETION AND PENALTIES

The project is to be completed by August 8, 2014. It is the intent of the Owner that all project work be

completed prior to the commencement of the 2014- 2015 school year. The Contractor must be able to

assure the Owner that all refurbished modular classroom units be furnished, installed, completed and

ready for occupancy on September 1, 2014. Failure to comply with this requirement will result in the

Contractor being liable for the payment to the City of Brockton of a penalty fine in the amount of $1,000.

that construction of any one (1) or more of the modular classroom units, as identified in the specifications

herein, is not complete.

Article 3. THE CONTRACT SUM

Article 5. THE CONTRACT DOCUMENTS

The General Conditions, Supplementary Conditions, General Requirements, General Specifications,

Drawings, and Addenda (if applicable), together with this agreement, form the Contract as if hereto

attached or herein repeated.

Article 6. PAYMENTS TO SUBCONTRACTORS

Within ten (10) days after the general contractor receives payment on account of a periodic estimate of

the value of the work done, he shall pay to each subcontractor the sum contained therein, for the value of

said subcontractor's work, less any amount retained therefrom by the Awarding Authority under the terms

of the general contract or in consequence of any legal proceedings of statutory liens, and less an amount

due the general contractor under the subcontract. Not later than the sixty-fifth (65th) day after each

subcontractor fully completes his/her portion of the work, in accordance with the plans and specifications,

the entire balance due under the subcontract shall be due the subcontractor and shall be paid to the

general contractor by the Awarding Authority for the account of the subcontractor and in partial payment

of the amount due under the general contract, provided however, that the Awarding Authority may

withhold from such partial payment all amounts retained by the Awarding Authority pending its

determination that said portion of the work is satisfactory or in consequence of any legal proceedings or

statutory liens. The general contractor shall forthwith pay to the subcontractor the full amount received as

aforesaid from the Awarding Authority for the account of such subcontractor less any amount due the

general contractor under the subcontract; and the Awarding Authority may take such steps as it may deem

necessary to arrange that such amounts are paid by the general contractor to the subcontractor forthwith.

If, within ten (10) days after the aforementioned sixty-fifth (65th) day, the subcontractor has not received

from the general contractor the entire balance due on the subcontract less the aforesaid amounts, the

subcontractor shall give the Awarding Authority and the general contractor written notice of such failure

to receive payment and of the amount so payable, but not paid, by the general contractor. Thereupon, the

Awarding Authority shall make, out of sums payable to the general contractor of the entire balance due

on the subcontract less the aforesaid amounts, such direct payments by the Awarding Authority to any

subcontractor and any payment to a general contractor for the account of a subcontractor as herein before

provided, shall discharge the obligation of the Awarding Authority to the general contractor to the extent

of such payment. (1956 Acts - Chapter 677.)

Article 7. PAYMENTS TO CONTRACTORS

Within twenty-four (24) days after receipts from the contractor, at the place designated by the Awarding

Authority, if such place is so designated, of a periodic estimate requesting payment of the amount due for

the preceding month, the Awarding Authority will make a periodic payment to the contractor for the work

performed during the preceding month and for the materials not incorporated in the work but delivered

and suitably stored at the site, or at some location agreed upon in writing, to which the contractor has title

or to which a subcontractor has title and has authorized the contractor to transfer title to the Awarding

Authority, less:

1. A retention of 5% based on its estimate of the fair value of its claims against the contractor, and

less;

2. A retention for direct payments to subcontractors based on demands for same in accordance with the

provisions of Section 39F, or based on the record of payments by the contractor to the subcontractors

under this contract if such record of payment indicates that the contractor has not paid subcontractors

as provided in Section 39F.

Article 8. PERFORMANCE AND PAYMENT BONDS

All projects for which the contracted price is equal to, or, in excess of $25,000.00 are subject to all

bonding requirements of Massachusetts General Law c I 49, and, as such, require both a performance

bond and a payment bond, both equal to one hundred percent (100%) of the total project cost and issued

by a company authorized to do business under the laws of the Commonwealth, and, satisfactory to the

Awarding Authority.

Article 9. LIABILITY INSURANCE

As stated in the General Conditions, the General Contractor shall furnish evidence of adequate insurance

coverage to all persons to be employed during the work (Worker's Compensation) and for the property

covered by these specifications and shall continue such insurance in full force and effect for the duration

of the work. The Contractor shall sign the accompanying Release and Certification of Insurance as

mandated by the City of Brockton Law Department.

Article 10. NON-DISCRIMINATION IN EMPLOYMENTANDAFFIRMATIVE ACTI0N

The Contractor shall not discriminate against any qualified employee or applicant for employment

because of race, color, national origin, ancestry, age, sex, religion, physical or mental handicap. The

Contractor agrees to comply with all applicable Federal and State statutes, rules and regulations

prohibiting discrimination in employment, and, to comply with all applicable Brockton School

Department policies and procedures relating to the same.

Article 11. CERTIFICATION OF PAYMENT OF STATE TAXES

In accordance with the General Laws of the Commonwealth of Massachusetts, Chapter 62C., section

49A, the Contractor shall sign the accompanying Certificate of Payment verifying the payment of all

State taxes as required by law.

The obligation of the City of Brockton hereunder shall be subject to appropriation in accordance with

Massachusetts General Laws, Chapter 44, Section 3 1.

Article l3. REQUESTS FOR PAYAMENTS

The Contractor she submit to the Owner AIA Document G702, Application and Certificate for Payment,

indicating the areas of work and percentages completed for which payment is being requested. Each

application for payment will contain a 5% retainage calculated on the total payment amount requested.

The 5% retainage will be due the Contractor upon final acceptance of the project by the Owner.

Article 14. ADDITIONAL REQUIREMENTS

The undersigned certifies under penalties of perjury, that this proposal is, in all respects, bona fide, fair,

and made without collusion or fraud with any neutral person, joint venture, partnership, corporation, or

other business or legal entity.

The undersigned further certifies under penalty of perjury that the said undersigned is not presently

I. CONDITION OF BIDDING

A. PROPOSAL DEPOSIT: Each offeror must deposit with his/her proposal security in the

amount of five percent (5%) of the base bid, either in the form of cash, a certified check or

cashier‟s check issued by a responsible bank or trust company, or bid bond, payable to the

City of Brockton.

B. PERFORMANCE AND PAYMENT BOND(S): The successful offeror shall furnish either

a Performance and Payment Bond both equal to one hundred percent (100%) of the contract

value subject to regulations related to Massachusetts General Law chapter 149. AU bonds

must be drawn from a surety company authorized to transact business in the Common-

wealth of Massachusetts and satisfactory to the awarding authority. The premiums

for the bond(s) are to be paid by the successful offeror and are to be included in the contract

price.

II. GENERAL WORK DESCRIPTION

A. EXANIINATION OF SITE: The facility will be available for inspection Monday

through Friday from 8:00 A.M. to 3:00 P.M., in order that each offeror may have the

opportunity to become fully acquainted with the circumstances and conditions relating to

the respective project at the site, so that he/she may fully understand the facility, difficulties

and restrictions attending the execution of the work under these specifications. The failure

or omission of any offeror to receive or examine any form, instrument or document, or, to

visit the identified facilities and be acquainted with the conditions there existing shall in no

way relieve the offeror from any obligation with respect to his/her proposal. By submitting

a proposal, the offeror agrees and warrants that he/she has attempted to or actually

examined the facility and specifications, and where the specifications in any of the work a

given result to be produced, that the specifications are adequate and the required result can

be produced under these specifications. No claim for any extra or alleged damage due to

delay will be allowed because of alleged impossibilities in the production of results

specified or because of inadequate or improper specifications and whenever a result is

required, the successful offeror shall furnish any and all extras and make changes needed to

produce, to the satisfaction of the Awarding Authority the required result.

B. MATERIALS AND WORKMANSHIP: Unless otherwise specifically provided for in all

specifications, all services, workmanship, equipment, materials and articles incorporated in

the work covered by these specifications are to be of the best grade of their respective kinds

for the purpose. Where equipment, materials or articles are referred to in the specifications

as "equal" to any particular standard, the Awarding Authority or those delegated by them

shall decide the question of equality.

C. WAGES: The wages paid to labor on this work shall not be less than the minimum wage

rates established by the Commission of Labor and Industries of the Commonwealth of

Massachusetts.

D. PERMITS AND NOTIFICATIONS: The Contractor shall obtain and pay for all required

licenses and permits for the work herein provided in these specifications. The Contractor is

also responsible for the timely filing of all necessary notifications of asbestos abatement

work with the appropriate Federal, State and Local Authorities.

E. MATERLAL REFERENCES: Specific references in the specifications to any article,

device, product materials, fixtures, form or type of construction or installation, etc., by

name, make or catalog number shall be interpreted as establishing a standard of equality and

shall not be construed as limiting competition, and the Contractor, in such cases may at

his/her option use any article, device, product, materials, fixtures, form or type of

construction or installation which in the judgment of the Awarding Authority or those

delegated by them is equal to that named.

F. APPROVALS: All notices, demands, requests, instructions, approvals and claims must be

submitted in writing.

G. PAYMENT TO CONTRACTORS: Payments are to be made in accordance with the `

provisions of Chapter 627, paragraph I of the Acts of 1961 which provisions are contained

in the proposed Contract Form which is hereby made a part of these specifications.

H. INSURANCE REQUIREMENTS:

1. Before commencing performance of any work on the project covered by these

specifications, the contractor shall furnish evidence of insurance coverage for the

payment of Worker‟s Compensation and the furnishing of other benefits under

Chapter 152 of the General Laws (the Worker's Compensation Law) to all person

to be employed during the work covered by these specifications and shall continue

such insurance in full force and effect during the term of this project. Failure to

provide and continue in force such insurance and aforesaid benefits shall be

deemed a material breech of any contract covering the project and shall operate as

an immediate termination thereof at the election of the Awarding Authority. Said

insurance shall be written with such company as may be acceptable to the

Awarding Authority and the policy shall be submitted to the Awarding Authority

for examination if it so desires. Satisfactory certificates of insurance of said

insurance shall be filed with the Awarding Authority prior to the commencement

of any work by the contractor on this project.

2. The Contractor shall carry general liability insurance in connection with all

operations included in these specifications. The amounts of insurance coverage

shall be:

3. The Contractor shall effect and maintain insurance against all risks of physical loss

upon all work in place and all materials stored at any work site, whether or not

covered by payments made by the Awarding Authority. This insurance shall be in

an amount equal to the full replacement cost thereof at all times and shall be for the

benefit of the Awarding Authority and the Contractor as their interest may

respectively appear. This insurance shall be placed with such company or

companies as may be acceptable to the Awarding Authority.

4. In the event that the form of any policy or certificates of insurance required

under this contract or the amount thereof, if not especially specified herein, or the

companies writing the same are not satisfactory to the Awarding Authority, the

Contractor will secure other policies or certificates in form and amount and with

companies satisfactory to the Awarding Authority. The Contractor shall not cause

any policies to be canceled or permit them to lapse, and all insurance policies shall

include a clause t the effect that the policy shall not be canceled or changed until

fifteen days after the Awarding Authority, as herein defined, has received written

notice thereof as evidenced by return receipt of registered letter. All certificates of

insurance shall contain true transcripts from the policy, authenticated by the proper

officer of the insurer, evidencing particularly that the Awarding Authority is

included as one of those insured, the extent of the insurance, the location and

operations to which the insurance applies, the expiration date and the

abovementioned notice of cancellation clause.

I. PATENT INFRINGEMENTS: The Contractor shall hold and save the Awarding Authority,

its officers, and employees, harmless from liability of any nature or kind, including costs,

and expenses for or on account of any, patented or unpatented invention, process, article, or

appliance manufactured or used in the performance of the work covered by than

specifications, including its use by the Awarding Authority.

J. LAWS AND ORDINANCES:

1. All work to be performed under this specification shall be in accordance with all

applicable laws, State or Federal, and all applicable ordinances, codes, rules and

regulations of the Awarding Authority or any public board or officer having

jurisdiction, regulation or control over any work to be done hereunder.

2. The building code of the City of Brockton shall be the minimum required for all

work, but the specifications shall govern where ever the specification requirements

are in excess of, greater than, or more stringent than code requirements and are

permitted under the code.

K. PROVISION OF LAW DEEMED INSERTED:

1. Every provision required by law to be inserted herein, and especially those required

by Chapter 149 of the General Laws, as amended, shall be incorporated herein by

reference, to the extent that such is not already included herein as if it were set forth

herein in its entirety. These documents shall be read and enforced as though such

provisions were included herein and, if through mistake or otherwise such provision

is not so inserted or is incorrectly inserted, then, upon the application of either party,

these documents shall be amended to meet the requirements of the law.

2. In the event of any conflict between the provisions of these documents and the

provisions required to be inserted herein, such latter provisions shall control.

L. INVALID CLAUSES:

1. If any provision of this specification shall be such as to render it invalid or illegal,

then if it shall not appear to have been made by the parties, it shall not be deemed to

form part thereof, but the balance of the specifications shall remain in force and

effect.

2. The titles, headings and notes contained in the specifications are solely to facilitate

reference to various portions of the specifications and in no way affect, limit or cast

fight upon the interpretation of the portion to which they refer.

M. INDEMNITY: The Contractor agrees to indemnify and save the Awarding Authority

harmless from and against any and all costs, loss, expense, liability, damages, or claims for

damage, including costs of defending any action on account of any injury or damage to

buildings, improvements or property of the City or any person, firm, corporation or

association and on account of any injury (including death) to any person or persons arising

or resulting from the work provided for or performed under the contract documents or

from any act, omission or negligence of the Contractor. The foregoing provisions shall not

be deemed to be released, waived, or modified in any respect by reason of any

reason of any insurance provided by the Contractor under the contract. The Contractor

shall furnish insurance to the Awarding Authority for the performance of the provisions of

this paragraph.

N. HOURS OF WORK: No laborer, worker, mechanic, foreman, or inspector working within

the Commonwealth, in the employ of the Contractor, subcontractor or other person doing

or contracting to do the whole or a part of the work contemplated by the contract, shall be

required or permitted to work more than eight (8) hours in any one (1) day, except in cases

of emergency, the Awarding Authority, being subject to section 31 of Chapter 149 of the

General Laws.

O. QUALIFICATIONS FOR EMPLOYMENT: In the employment of mechanics, teamsters,

chauffeurs, and laborers, preference shall first be given to citizens of the Commonwealth

who have been residents for at least six (6) months at the commencement for their

employment who are male veterans as defined in Clause 43 of Section 7 of Chapter 4 of

the General Laws, and who are qualified to perform the work to which the employment

relates; and secondly, to citizens of the Commonwealth for at least six (6) months at the

commencement of their employment, and if they cannot be found in sufficient numbers,

then to citizens of the United States.

P. FREEDOM OF EMPLOYMENT TO LODGE, BOARD AND TRADE: Every employee

in the work to be performed under this contract shall be allowed to lodge, board and trade

where and with whom he elects and no person or his agents or employees shall directly or

indirectly require as a condition of employment in said work, that an employee she lodge,

board or trade at a particular place or with a particular person.

GENERAL REQUIREMENTS

A. IN GENERAL:

1. The General Conditions form a part of the contract and shall govern the work.

2. The Contractor shall keep fully informed of the conditions relating to construction

and labor under which the work must be performed and shall employ in carrying

out the work such methods and means as will cause the least possible interruption

or interference with the proper and speedy completion of the work under this

contract.

B. CONTRACT INCLUDES:

1. This Contractor shall furnish all materials and do all work (except as specifically

noted to the contrary) according to these specifications and any additional plans

and instructions furnished by the Awarding Authority, the work to include

everything shown on plans, sketches, specifications and everything properly

incidental thereto, subject to the provisions herein.

2. All work and materials shall be of the best quality and workmanship and to the

satisfaction of the Owner. The work shall be in strict accordance with the

drawings, specifications and samples and the Contractor shall cooperate with the

Owner so that no error or discrepancy in the plans and specifications shall cause

defective materials or workmanship to be used.

C. ORDER OF AND COMPLETION OF WORK: Upon the award of the contract, the

Contractor shall commence work immediately, carry it on with all reasonable and proper

activity and dispatch, give all notices, take out all permits and pay all charges, fees and

rates therefor and bring the work to entire completion within the period of time specified

in the contract.

D. PROTECTION – IN GENERAL:

1. The Contractor is to cover and protect his work and materials from all damage

during the process of the work and deliver the whole in a clean perfect condition.

2. The Contractor shall protect everything on the premises from injury by dropping of

materials, water, wind, fire, theft, accident, interference or other cause. All

activities at the site must be coordinated through the Facilities Office, 43 Crescent

Street, Brockton, MA 02301, or, a designated representative of this office.

3. The Contractor shall take charge of and be liable for any loss of or injury to

materials for use on the work. Notify the Awarding Authority as soon as materials

are delivered and provide assistance for the Awarding Authority or authorized

representative to examine same.

E. CONSTRUCTION RISKS: The contractor will understand that the materials, work in

place, and equipment are entirely at his risk, including loss be theft, or, fire during the

project period, and, that he will be held responsible and liable for its safety.

F. SANITARY ACCOMMODATIONS: The Contractor shall make arrangements with the

Senior Building Custodian at the school site for use of a designated toilet.

G. VISITATION TO SITE: All offerors shall visit the site to familiarize themselves with

existing conditions before submitting a proposal. Arrangements for site visits will be

made through the Facilities Department, 43 Crescent Street, Brockton, MA 02301, (508)

580-7503. Visits may occur between 8:00 A.M. AND 3:00 P.M. on regular school days,

Monday through Friday, excluding legal holidays.

H. DISPOSAL OF WASTE MATERIAL: The Contractor shall be responsible for the

removal of all waste materials from the site. Under no circumstances shall the school‟s

dumpsters be used by the Contractor for disposal of any type of material.

I. BUILDING SECURITY: The Awarding Authority provides electronic security of the

building from 11:00 P.M. to 7:00 A.M.; however, it shall be the responsibility of the

successful Contractor to secure all exit doors in the area where work is to be performed

and to ensure against unauthorized access to the work area throughout the course of the

project.

J. ACCESS TO BUILDINGS: The building will only be opened during regular working

hours unless approved and coordinated through the Facilities Department.

K. COORDINATION OF THE WORK:

1. Schedule of delivery of materials shall be such that removal of existing materials

and installation of new materials shall proceed in one (1) continuous operation.

2. Technical questions shall be directed to the Awarding Authority and/or authorized

representatives in writing.

3. The Facilities Department for the Brockton Public Schools shall be kept

informed as to when work is to take place.

L. TIME IS OF THE ESSENCE:

1. Any deviation from the established schedule shall be only upon the written

permission of the Awarding Authority as represented by the administrative

Assistant.

2. It is expected that the work at the site will be totally completed and ready for

occupancy at the close of business on August 8, 2014. LIQUIDATION

DAMAGES in the amount of $1,000.00 per day will be assessed to the Contractor

for each day after August 8, 2014 that the site, identified in the specifications,

where construction has not been completed and the units are not ready for

occupancy.

M. ASBESTOS WORK: An AHERA Management Plan for the school included in

this project is available for review from the Facilities Department, Mr. Kenneth M.

Thompson. It is required that this information on the location of asbestos containing

materials for the school be reviewed by prospective offerors as an integral part of their

work site visit.

N. WARRANTY AND SERVICE: In addition to any applicable manufacturer‟s warranty, the

Contractor shall replace, repair, or make good without cost to the Awarding Authority, and

defects or faults, arising within one (1) year after the date of acceptance, of articles

furnished hereunder resulting from the imperfect or defective work done or materials

furnished by the Contractor.

O. TAX EXEMPTION: Purchases made by or for the Awarding Authority are exempt from

federal excise taxes and proposal prices must include any such tax. The School

Department tax exemption certificate number is 046-001-382.

P. Successful proposer is required to comply with Chapter IV, Article 3 and Chapter XIII,

Article 1 of the Revised Ordinances of the City of Brockton as described herein on pages,

47, 48, 49, 50 and 51.

SCOPE OF WORK

The CONTRACTOR‟S responsibilities will include:

Section 1. GENERAL

a. SUMMARY OF WORK

10 modular classroom units of a minimum of 900 sq. feet each with a site built connecting

corridor from existing permanent structure.

Each modular classroom unit, suitably refurbished to „like new‟ condition, to be furnished

and installed with a site built connecting corridor. The successful offeror will supply,

transport, erect and complete the building as described in the specifications.

Design loads for each modular classroom unit will be in accordance with 1990 BOCA

National Building Code. Must meet State and Local Building Codes and be ADA

Compliances. Local conditions may require loads to increase or decrease slightly.

b. COORDINATION

The successful offeror will furnish a single point of contact for this project. The sales

representative will assist with securing appropriate contract documentation. The project

manager will be responsible for all phases of the installation, from contract award to

completion. The Facilities Department for the Brockton Public Schools will be the single

point of contact to channel all information.

c. REGULATORY REQUIREMENTS

The building will be constructed of type 5B construction and in full compliance and

accordance with the American With Disabilities Act (ADA). Third party and approval by

the appropriate agencies, offices and departments in the Commonwealth of Massachusetts

will be furnished and paid for by the CONTRACTOR. All permits are to be obtained by

the successful offeror. All required local fees are to be paid by the CONTRACTOR with

the exception of any that may be waived. All site inspections will be performed by the

appropriate local authorities and by the OWNER.

Each modular classroom unit will meet Massachusetts Building as well as local building

and fire codes.

d. CONTRACTOR RESPONSIBILITIES

Design and fabrication of modular classroom units in accordance with all performance

specifications set forth in Part of this request for proposal, and in accordance and

compliance with all program requirements and applicable building codes;

Design and construction of any connector from existing entrance directly to the modulars,

if required. All connectors shall meet all state and local building codes;

Site design in accordance and compliance with all performance specifications set forth in

this request for proposal, and in accordance and compliance with all program requirements

and applicable building codes;

Delivery of all modular units and construction materials to each respective construction

site;

Obtains all permits required for the transportation of modular classroom units from the

factory to the construction site within the City of Brockton;

Obtains review and approval of all plans by licensed third party inspection agency;

Provides project schedules (and complete construction layouts) for the proposed site;

Obtains all required building permits from the Building Department of the City of

Brockton; Completes installation and assembly of all modular clasroom units in

accordance and compliance with all performance specifications as listed in this request for

proposal and all applicable building codes.

Section 2.

a. SUBSURFACE INVESTIGATION

The successful offeror will provide excavation and footing work associated with this

project to meet the required compaction. Temporary staging and parking areas are to be

provided on site by the OWNER.

b. SITE ENGINEERING

The successful offeror will provide foundation engineering, building stake-out, and as-

built plans for each modular classroom units at the site.

c. EARTHWORK

Excavated material that is suitable for use as backfill or may be stockpiled on the

respective site until required, excess backfill material must be removed from site by

contractor.

d. DRAINAGE

Contractor is responsible for an appropriate dry well for roof storm drainage system.

SUBMISSION REQUIREMENTS

The City of Brockton and the Brockton School Department will review all proposals, and identify any

proposals which do no meet the submission requirements set forth in this section. Such proposals will be

deemed non-responsive, and will be rejected.

All proposals are to be delivered to the Office of Financial Services, Crosby Administration Building, 43

Crescent Street, Brockton, MA 02301, no later than 10:00 A.M. E.S.T. on Wednesday, March 5, 2014.

A contractor for this project will be selected no later than June 1, 2014. LATE PROPOSALS WILL NOT

BE ACCEPTED.

All offerors are required to visit the site before submitting the proposal. Submission of a proposal

constitutes an acknowledgment that the offeror has examined and inspected each site and is familiar with

existing conditions.

Every proposal must be in two (2) parts, submitted in two (2) separate, clearly marked, sealed envelopes:

1) non-price technical proposal, and 2) price proposal.

The following information must appear on each envelope:

OFFEROR‟S NAME

PROJECT NAME

Either-"NON-PRICE TECHNICAL PROPOSAL" or "PRICE

PROPOSAL".

The NON-PRICE TECEMCAL PROPOSAL for every proposal must consist of the following documents,

and any proposal that does not contain all of these documents will be rejected as non-responsive:

1. Current Certificate of Eligibility for Modular Prefab Construction, DCPO Form CQ7.

(DCPO, One Ashburton Place, Boston, MA 02108).

2. Contractor Eligibility Update Statement, DCPO Form CQ3. (DCPO, One Ashburton

Place, Boston, MA 02108)

3. Certification by the State Board of Budding Regulations and Standards, verifying that the

manufacturer of the modular buildings meets the state building code requirements in the

Commonwealth of Massachusetts.

4. A set of detailed plans and specifications for the proposed modular buildings and

connector for the site. Proposals must include all the manufacturer‟s specifications

governing the materials and equipment used in the modular buildings. The plans submitted

with each proposal must provide all drawings necessary to portray to the City of Brockton

and the Brockton School Department all pertinent design details of the modular classroom

units and the passageways connecting them to the existing buildings for the site, including:

a. An installation plan illustrating the proposed accurate location of the modular

classroom unit site with appropriate tic dimensions to the existing buildings; and

indication of the locations on the modular unit at which utility service connections

are proposed; locations of existing utility services to which the proposed modular

classrooms units can be connected.

b. Mounting plans and details.

c. Architectural type floor plans.

d. Factory plans and details of passageway elements and entrance ramps.

e. Factory plans and details of manufacture of structural elements including

floors, walls, and roofs.

f. Factory plans and details of service appurtenances including electrical, plumbing,

HVAC, fire protection, and communications systems. Such details must include all

fight fixtures, outlets, switches, controls, smoke detectors, and location and

capacity/rating of all equipment, fixtures, and appliances.

g. Factory details of windows and doors.

h. Factory finish details for wall finishes, floor finishes, exterior skin finish, and trim.

5. A set of detailed plans and specifications for the proposed connector.

6. A project schedule.

7. The complete terms of all warranties provided by the manufacturer or by the offeror

relative to the design, manufacture, and installation of the modular buildings, including

both general warranties, and special warranties associated with particular components

and equipment.

8. Certification of financial interest disclosure and of non-collusion, signed and submitted on

Forms I and 2 appended to this request for proposal.

9. Certification that the offeror can furnish labor that m work in concert with other elements

of labor employed at the installation site, signed and submitted on Form 3 appended to this

request for proposal.

10. Certification of compliance with the registration requirements for foreign corporations,

under General Laws chapter 30, section 39L, signed and submitted on Form 4 appended to

this request for proposal.

11. Certification of compliance with the tax laws of the Commonwealth of Massachusetts as

required by General Laws chapter 62C, section 49A, signed and submitted on Form 5 of

this request for proposal.

12. Certification that the proposed modular classroom units will be (1) manufactured within

Massachusetts; or (2) manufactured outside Massachusetts but within the United States; or

(3) manufactured outside of the United States, signed and submitted on Form 6 appended

to these request for proposal.

13. Certification that the proposed modular classroom unit plans comply with all local

and state building codes; that the offeror will if accepted for a contract award, obtain

approval of the plans for the site by a licensed third party inspection agency within 30

days of the notice of award; and that the offeror Will make any revision required to obtain

such approval without increasing the proposal price, signed and submitted on Form 7

appended to this request for approval.

14. Letter of transmittal, signed by an individual authorized to bind the offeror contractually,

certifying that the offeror will, if accepted for a contract award, execute a contract in

accordance with the terms of this proposal within three (3) working days of the notice of

award, and will furnish to the City of Brockton and the Brockton School Department a

payment bond and a performance bond, each in the sum of the contract price, as required

by General Laws chapter 149, section 44E, signed and submitted on Form 8 appended to

this request for proposal.

15. Certification that the offeror, if awarded a contract, will guarantee completion of all

work required by Friday, August 8, 2014, signed and submitted on Form 9 appended to

this request for proposal.

16. Proposals shall be based on the Minimum Wage Schedule, as determined by the

Commission of Labor and Industries pursuant to the provisions of Chapter 149,

Section 26 to 27D inclusive, of the General Laws, as amended. Certification regarding

payment of prevailing wages, signed and submitted on Form 10 appended to this request

for proposal.

The PRICE PROPOSAL for every proposal must consist of the following documents and any proposal

that does not contain all of these documents will be rejected as non-responsive. Prices are to be based on

the annual cost per site for a five-year lease agreement.

1 . A firm, fixed, annual lease cost for the site, which includes the furnishing of all

materials, services, labor, performance and payment bonds, insurance, and other costs

incurred in the performance of the contract, signed by an individual authorized to bind the

offeror contractually, and submitted on Form 11 appended to this request for proposal. (To

be submitted in a separate envelope).

2. Each proposal must be accompanied by a proposal deposit in the form of a bid bond, cash

or certified check, issued by a responsible bank or trust company, payable to the City of

Brockton in the amount of at least five (5%) percent of the total contract price. The

proposal deposit will be retained from the three (3) lowest qualified offerors until a

contract is executed. Offerors, other than the three (3) lowest, will have their respective

deposits returned within five (5) days, Saturdays, Sundays and legal holidays excluded,

after the award of the contract.

EVALUATION CRITERIA

Proposals that meet all of the submission requirements of this request for proposal will be evaluated and

rated solely on the basis of the evaluation criteria contained herein. In evaluating each proposal, the

evaluation committee shall assign a rating of HIGHLY ADVANTAGEOUS, ADVANTAGEOUS, NOT

ADVANTAGEOUS, or UNACCEPTABLE for each of the criteria. A rating of ADVANTAGEOUS shall

be given when a proposal meets the standards set forth in the evaluation criteria. A rating of

UNACCEPTABLE shall be assigned to a proposal which does not meet the evaluation standards and

which cannot be accepted without revisions in the proposal. The evaluation committee may identify any

revisions necessary to change a rating on criterion from UNACCEPTABLE to ADVANTAGEOUS and

shall specify such changes in writing. The award of a contract to any offeror whose proposal was rated

UNACCEPTABLE with respect to one or more criteria will be conditioned on the negotiation of the

revisions recommended by the evaluation committee at no increase in the proposed price. A rating of

NOT ADVANTAGEOUS or HIGHLY ADVANTAGEOUS will be assigned only on criteria, which this

request for proposal specifically notes may receive those ratings. A proposal will not be rated higher than

ADVANTAGEOUS for offering features in addition to those requested in this request for proposal or for

exceeding the standards specified in the evaluation criteria. The evaluation committee shall determine a

composite rating of HIGHLY ADVANTAGEOUS, ADVANTAGEOUS, NOT ADVANTAGEOUS, or

UNACCEPTABLE for each proposal. After a composite rating has been determined for each proposal on

the basis of the evaluation criteria in this section, the chief procurement officer of the Brockton Public

Schools shall, then and only then, open and review the price proposals and determine the most

advantageous proposal, taking into consideration the ratings on all evaluation criteria and the price. If the

procurement officer selects a proposal that is not the least expensive, he/she shall explain in writing the

added benefits of the proposal that justify the higher fee proposed by the offeror.

Each responsive proposal will be assigned a rating for each of the following criteria:

1. The offeror‟s qualifications to perform the work, to be evaluated solely on the basis of

performance on projects undertaken or completed after the most recent renewal of the

contractors DCPO Certificate of Eligibility. Proposals will be assigned a rating for each of

the following criteria in this category:

a. Finished product quality and compliance with construction specifications.

b. Completion of project within budget.

c. Compliance with project schedules.

For each of the criteria in this category, a proposal will be rated ADVANTAGEOUS if the offeror‟s

performance on all projects substantially complies with contract requirements; NOT ADVANTAGEOUS

if the offeror‟s performance on most but not all projects substantially complies with contract

requirements; and UNACCEPTABLE if the offeror‟s performance on most projects does not

substantially comply with contract requirements.

2. Compliance with all applicable building code requirements. Proposals which meet all

building code requirements will be rated ADVANTAGEOUS; proposals which fail to

meet any requirement will be rated UNACCEPTABLE.

3 . Compliance with all performance specifications fisted in this request for proposal.

Proposals which meet all performance specifications will be rated ADVANTAGEOUS;

proposals which fag to meet any performance specification will be rated

UNACCEPTABLE.

4. Compliance with warranty specifications contained in this request for proposal. Proposals

which meet all warranty specifications will be rated ADVANTAGEOUS; proposals which

fail to meet any warranty specification will be rated UNACCEPTABLE.

5 . Compliance with all program requirements. Proposals which meet all program

requirements will be rated ADVANTAGEOUS; proposals which fail to meet any program

requirement will be rated UNACCEPTABLE.

The offeror declares and certifies:

1. The said offeror has carefully examined the instructions to the offeror, schedules,

and specifications, and will, if successful in the proposal, furnish, deliver and install at the

prices and lease costs stated and within the time specified, all the materials, services and

labor required for this proposal.

2. No plead of mistake in an accepted proposal shall be available to the undersigned offeror.

The offeror understands:

1. That all costs proposed are based on a lease of three (3) years with annual lump sum

payments scheduled on the thirty first day of July, of each fiscal year, beginning on

July 1, 2014 for the 2015 fiscal year;

2. That the award of this contract is contingent upon appropriate funding as voted by the

Brockton City Council for the first year and each of the two (2) successive years of the

lease agreement,

3. That the City of Brockton and Brockton School Committee may exercise their right to

terminate the lease agreement within the five year period if fending is not available;

4. That the price proposed for the site reflects the total annual lease cost and includes the

total cost: for the design prefabrication, site assembly, installation, removal fee (restoration

of site to preconstruction state), and all services required to complete, deliver and install

the refurbished modular classroom units, in the quantities and at the identified site, as

described in the specifications herein, for use and occupancy; and for the design and

construction of connectors and connectors/entrances from the existing entrances to the

modular units, including the furnishing of all materials, services, labor; and for the

performance and payment bonds, insurance, and other costs incurred in the performance of

this contract in its entirety;

5. That the installation of gang restrooms and appropriate plumbing for boys and girls is an

option at each of the five (5) sites fisted.

Information about Prevailing Wage Schedules for Awarding Authorities and Contractors

• This wage schedule applies only to the specific project referenced at the top of this page and uniquely identified by the “Wage

Request Number” on all pages of this schedule.

• Awarding authorities must request an updated wage schedule from the Department of Labor Standards (“DLS”) if it has not

opened bids or selected a contractor within 90 days of the date of issuance of the wage schedule.

• The wage schedule shall be incorporated in any advertisement or call for bids for the project as required by M.G.L. c. 149, §

27. Once a contractor has been selected by the awarding authority, the wage schedule shall be made a part of the contract for that

project. The wage schedule must be posted in a conspicuous place at the work site during the life of the project in accordance with

M.G.L. c. 149, § 27. The wages listed on the wage schedule must be paid to employees performing construction work on the

project regardless of whether they are employed by the prime contractor, a filed sub-bidder, or any sub-contractor.

• All apprentices working on the project are required to be registered with the Massachusetts Division of Apprentice Training

(DAT). Apprentices must keep his/her apprentice identification card on his/her person during all work hours on the project. If an

apprentice rate is listed on the prevailing wage schedule for the trade in which an apprentice is registered with the DAT, the

apprentice may be paid the lower apprentice wage rate at the applicable step as provided on the prevailing wage schedule. If an

apprentice rate is not listed on the prevailing wage schedule for the trade in which an apprentice is registered with the

DAT, the apprentice must be paid the journeyworker’s rate for the trade.

• The wage rates will remain in effect for the duration of the project, except in the case of multi-year public construction

projects. For construction projects lasting longer than one year, awarding authorities must request an updated wage schedule.

Awarding authorities are required to request these updates no later than two weeks before the anniversary of the date the contract

was executed by the awarding authority and the general contractor. Contractors are required to obtain the wage schedules from

awarding authorities, and to pay no less than these rates to covered workers. The annual update requirement is not applicable to

27F “rental of equipment” contracts.

• Every contractor or subcontractor which performs construction work on the project is required to submit weekly payroll

reports directly to the awarding authority and keep them on file for three years. Each weekly payroll report must contain: the

employee’s name, address, occupational classification, hours worked, and wages paid. Do not submit weekly payroll reports to

DLS. A sample of a payroll reporting form may be obtained at http://www.mass.gov/dols/pw.

• Contractors with questions about the wage rates or classifications included on the wage schedule have an affirmative

obligation to inquire with DLS at (617) 626-6953.

• Employees not receiving the prevailing wage rate set forth on the wage schedule may report the violation to the Fair Labor

Division of the office of the Attorney General at (617) 727-3465.

• Failure of a contractor or subcontractor to pay the prevailing wage rates listed on the wage schedule to all employees who

perform construction work on the project is a violation of the law and subjects the contractor or subcontractor to civil and criminal

penalties.

Minimum wage rates for apprentices employed on public works projects are listed above as a percentage of the pre-determined hourly wage rate established by the

Commissioner under the provisions of the M.G.L. c. 149, ss. 26-27D. Apprentice ratios are established by the Division of Apprenticeship Training pursuant to M.G.L.

c. 23, ss. 11E-11L.

All apprentices must be registered with the Division of Apprenticeship Training in accordance with M.G.L. c. 23, ss. 11E-11L.

All steps are six months (1000 hours) unless otherwise specified.
