Lease Term: July 1, 2004 - June 30, 2024

Renewal Options: Three (3) - 5 Year Options with fixed rent increases in each option.

Utilities: Landlord agrees to deliver the Premises to Tenant with all utilities located in the public right of way, (including but not limited to water, gas, electric, fire hydrants, telephone, storm drains and sanitary sewers) installed and stubbed or delivered to Tenant's lines of construction (as shown on the Site Plan), and available for Tenant's intended use. Tenant shall have forty-five (45) days from final utility installation to inspect and approve the function and use of the utilities. If the utilities do not meet with Tenant's approval, Tenant shall have the right to terminate this Agreement by giving Landlord ten(10) days prior written notice of termination at anytime within the first sixty (60) days after final utility installation. Upon the effective date of such termination, neither party shall have any further obligation to the other underthis Lease except for those continuing obligations set forth in this Lease which specifically survive such termination. Tenant's failure to terminate this Lease within the period of time stated in this Subparagraph shall constitute Tenant's waiver of this condition.

Holdover: If Tenant shall hold over after the expiration of the term of this Lease, or any extension thereof, such tenancy shall be from month-to-month only but otherwise subject to all the other terms, covenants and conditions hereof, provided, however, that the rent shall be an amount equal to one and one-quarter (1 1/4) times the monthly rent for the month immediately preceding the expiration of the term of this Lease or of the extension thereof.

market overviewFontana, CAThe City of Fontana now has over 200,000 residents and continues on a trajectory of rapid growth. One of the major new areas of development in the city lies just to the north of Taco Bell and is dubbed Duncan Canyon. Stemming from the newly constructed Duncan Canyon overpass and interchange on I-15, the new master-planned development area will include new housing in addition to mid-rise office, hospitality, and retail projects. In total, there are more than 9,000 new housing units planned in the northern part of the city.

Taco Bell is located along I-15 in the north part of the City of Fontana.
