INTRODUCTION The Center for Security Policy is pleased to release its twelfth National Security Scorecard since its first in 1994. As with previous iterations, it is designed to illuminate the voting record of members of the United States Senate and House of Representatives on important defense and foreign policy issues. Toward that end, this edition of the National Security Scorecard conforms to the approach taken in previous versions. We have selected Congressional votes on the basis of their significance to the vital security policy interests of the United States. We have, moreover, selected votes that offer real insights into the attitude of the legislators casting them concerning critical national security issues of the day. Such considerations prompt us generally to exclude near-unanimous votes, non-controversial or hortatory resolutions, or votes on final passage of each chambers’ annual defense spending bills or their conference reports. It is important to note that while the scorecard is a critical tool for analyzing a legislator’s national security record, it is not the only measure of that record. By definition, scorecards look only at issues that were brought to a vote they do not capture statements or other forms of discussion and debate, on and off Capitol Hill, that also contribute to the totality of a legislator’s views. In producing this year’s National Security Scorecard, the Center for Security Policy hopes to assist the American people in understanding the performance of their elected officials with respect to vital national security issuesand to encourage greater accountability on the part of Senators and Members of Congress for their votes in this portfolio. INTRODUCTION

The Center for Security Policy is pleased to release its twelfth National Security Scorecard since its first in 1994. As with

previous iterations, it is designed to illuminate the voting record of members of the United States Senate and House of

Representatives on important defense and foreign policy issues.

Toward that end, this edition of the National Security Scorecard conforms to the approach taken in previous versions.

We have selected Congressional votes on the basis of their significance to the vital security policy interests of the United

States. We have, moreover, selected votes that offer real insights into the attitude of the legislators casting them

concerning critical national security issues of the day.

Such considerations prompt us generally to exclude near-unanimous votes, non-controversial or hortatory resolutions,

or votes on final passage of each chambers’ annual defense spending bills or their conference reports.

It is important to note that while the scorecard is a critical tool for analyzing a legislator’s national security record, it is

not the only measure of that record. By definition, scorecards look only at issues that were brought to a vote – they do

not capture statements or other forms of discussion and debate, on and off Capitol Hill, that also contribute to the

totality of a legislator’s views.

In producing this year’s National Security Scorecard, the Center for Security Policy hopes to assist the American people

in understanding the performance of their elected officials with respect to vital national security issues—and to

encourage greater accountability on the part of Senators and Members of Congress for their votes in this portfolio.

Scores are bases upon the legislator's aggregate record on these important votes. If, for example, a Senator was absent

for two of the examined votes, but cast his or her remaining votes in a pro-national security way, he or she would

receive a total score of 100%. The same applies for votes taken before a Senator assumed office in mid-term; votes for

the session from before he or she started serving do not count towards the total votes cast.

House Vote Descriptions, 2015

1. Approve the Keystone XL pipeline. The vote was on whether to authorize the construction of the Keystone XL

pipeline. Pro-national security vote: YES; Passed 270-152, 10 not voting (Roll Call Vote #75, Feb. 11, 2015)

2. Maintain restrictions on transfer of detainees out of Guantanamo Bay. The Walorski amendment (R-IN) to the

FY 2016 National Defense Authorization Act (NDAA) prohibited funding for the transfer of Gitmo detainees into

the United States, as well as funding for construction or modification of any domestic facility for that purpose.

The amendment also placed further restrictions on the transfer of Gitmo detainees to Yemen. Pro-national

security vote: YES; Passed 243-180, 9 not voting (Roll Call Vote #230, May 14, 2015)

3. Allow funding for transfer of Guantanamo detainees to the United States. The Smith amendment (D-WA) to

the FY 2016 NDAA would have allowed funding for the construction/modification of domestic facilities to

receive transferred Gitmo detainees for detention, but would not have allowed the release of detainees onto

U.S. soil. The amendment also would have prohibited funding for Gitmo operations beyond Dec. 31, 2017. Pro-

national security vote: NO; Failed 174-249, 9 not voting (Roll Call Vote #231, May 14, 2015)

4. Limit funding for implementation of New START treaty. The Lamborn amendment (R-CO) to the NDAA limited

funding for implementation of the New START arms control treaty with Russia, until the President could certify

that Russia no longer illegally occupies the Ukraine, and is no longer taking actions inconsistent with the

Intermediate Range Nuclear Forces (INF) treaty. Pro-national security vote: YES; Passed 235-182, 15 not voting

(Roll Call Vote #234, May 15, 2015)

5. Allow unilateral dismantling of parts of nuclear deterrent. The Nadler amendment (D-NY) to the NDAA would

have struck language that prevents the unilateral dismantling of nuclear warheads. Pro-national security vote:

NO; Failed 242-178, 12 not voting (Roll Call Vote #237, May 15, 2015)

6. Allow exports to Cuban military/intelligence services. The Farr amendment (C-CA) to the FY 2016 Commerce-

Justice-Science (CJS) Appropriations bill would have struck language prohibiting the facilitation, permitting,

licensing, or promotion of exports to the Cuban military/intelligence services, officers serving in either, or

immediate family members of such individuals. Pro-national security vote: NO; Failed 153-273, 6 not voting

(Roll Call Vote #277, June 3, 2015)

7. Allow use of funds to transfer Guantanamo detainees to country of origin or third country. The Nadler

amendment (D-NY) would have struck the section of the FY Defense Appropriations bill that prohibits the use of

defense appropriations funds to enable the transfer of a Guantanamo detainee to his country of origin or to

another foreign country. Pro-national security vote: NO; Failed 181-251, 1 not voting (Roll Call Vote #338, June

10, 2015)

8. Declaration that President Obama was not in compliance with the Iran Nuclear Agreement Review Act of

2015. H. Res. 411, sponsored by Rep. Pompeo (R-KS), declared that President Obama was not in compliance

with Section 2 of the Iran Nuclear Agreement Review Act of 2015 because the President’s transmittal of the

agreement to Congress did not contain two side deals and therefore did not constitute the agreement as

defined by the Act, and therefore the review period had not started under the terms of the Act. Pro-national

security vote: YES; Passed 245-186, 2 not voting (Roll Call Vote #492, Sept. 10, 2015)

9. Vote to approve Iran nuclear deal. H.R. 3461 voiced congressional approval for the Joint Comprehensive Plan

of Action (JCPOA), the Iran nuclear deal. Pro-national security vote: NO; Failed 269-162, 1 not voting (Roll Call

Vote #493, Sept. 11, 2015)

10. Prohibit the President from lifting sanctions on Iran. H.R. 3460, sponsored by Rep. Roskam (R-IL) prohibited the

President from lifting sanctions on Iran per the JCPOA until January 21, 2017, and prohibited the President from

removing an individual listed in Annex II of the JCPOA from the Department of Treasury’s list of specially

designated nationals prohibited from financial transactions with U.S. citizens. Pro-national security vote: YES;

Passed 247-186 (Roll Call Vote #494, Sept. 11, 2015)

11. Simplify process for extraction of strategic and critical minerals. The National Strategic and Critical Minerals

Production Act of 2015, sponsored by Rep. Amodei (R-NV), requires the Departments of Interior and Agriculture

to more efficiently develop domestic sources of minerals of strategic importance to the national security of the

United States. Pro-national security vote: YES; Passed 254-177, 3 note voting (Roll Call Vote #565, Oct. 22, 2015)

12. Require certification of Syrian and Iraqi refugees before admission to the United States. H.R. 4038, the

American Security Against Foreign Enemies Act of 2015, sponsored by Rep. McCaul (R-TX), requires that a

refugee from Syria or Iraq cannot be admitted to the United States unless the FBI certifies to the Department of

Homeland Security and the Director National Intelligences that the refugee is not a threat to the security of the

United States. Pro-national security vote (despite concerns that the certification requirement was not sufficient

to protect national security): YES; Passed 289-137, 8 not voting (Roll Call Vote #643, Nov. 19, 2015)

House Vote Descriptions, 2016

13. Narrow scope of Afghanistan mission. The Ellison amendment (D-MN) would have struck language from the FY

2017 NDAA expressing a sense of Congress that the president should provide the U.S. Commander in

Afghanistan the authority to unilaterally strike the Taliban and Haqaani Network, and should have more

resources to strike ISIS in Afghanistan. Pro-national security vote: NO; Failed 131-292, 1 present, 9 not voting

(Roll Call Vote #212, May 18, 2016)

14. Prohibit funds for housing illegal aliens at military bases. The Fleming amendment (R-LA) to the FY 2017

Military Construction Appropriations bill prevented military construction funds from being used to construct or

modify a facility on a military installation to create housing for unaccompanied illegal alien children. Pro-

national security vote: YES; Passed 219-202, 12 not voting (Roll Call Vote #222, May 19, 2016)

15. Prohibit funding to implement Department of Defense directive on climate change. The Buck amendment (R-

CO) prohibited defense appropriations funds from being used for the purpose of implementing DoD Directive

4715.21, which has the effect of prioritizing climate change over national security. Pro-national security vote:

YES; Passed 216-205, 13 not voting (Roll Call Vote #314, June 16, 2016)

16. Prohibit funding for surveying, assessing, or reviewing potential U.S. sites for Guantanamo detainees. The

Lamborn amendment (R-CO) prohibited defense appropriations funds from being used for the purpose of

surveying, assessing or otherwise reviewing sites within the United States that are being considered for

detaining Guantanamo detainees. Pro-national security vote: YES; Passed 245-175, 14 not voting (Roll Call Vote

#319, June 16, 2016)

17. Prohibit funds for Department of Defense climate change / green energy requirements. The McClintock

amendment (R-CA) prohibited the Department of Defense from using defense appropriations funding to carry

out parts of several Obama executive orders pertaining to green energy and DoD participation in climate change

planning. Pro-national security vote: YES; Passed 221-197, 16 not voting (Roll Call Vote #322, June 16, 2016)

18. Prohibit the federal government from purchasing heavy water from Iran. The No Heavy Water From Iran Act,

sponsored by Rep. Pompeo (R-KS), prohibits federal funds from being used by any federal department or agency

to purchase, or issue a license to purchase, heavy water – a material that plays a key role in the development of

nuclear weapons – from Iran. Pro-national security vote: YES; Passed 249-176, 8 not voting (Roll Call Vote #441,

July 13, 2016)

19. Impose sanctions on Iran. The Iran Accountability Act, sponsored by Rep. McCarthy (R-CA), imposes various

mandatory sanctions on Iran, including with respect to the Iranian Revolutionary Guard Corps (IRGC) and Iran’s

ballistic missile program, among others. Pro-national security vote: YES; Passed 246-179, 8 not voting (Roll Call

Vote #467, July 14, 2016)

1. Climate Change Agreements Require Senate Ratification. The Blunt amendment (R-Missouri) expressed the

sense of the Senate that, among other things, any bilateral or international agreement involving greenhouse gas

emissions requires advice and consent of the Senate. Pro-national security vote: YES; Rejected 46-51, 3 not

voting (required 3/5 majority vote for passage) (Vote #20, Jan. 22, 2015)

2. Override Obama Veto of Keystone XL Pipeline. President Obama vetoed S. 1, a bill to approve construction of

the Keystone XL Pipeline, on Feb. 25, 2015. A vote was taken in the Senate to override that veto, which would

have required a two-thirds vote in favor of override. Pro-national security vote: YES; Veto sustained 62-37, 1 not

3. Substantially Increase Defense Spending. The Rubio amendment (R-Florida) would have increased defense
