Status/Council Direction: Revise Section 6 of the ILA to provide more
clarity about the purpose of the various deadlines for action within that
section.
Directed Revisions/Added Information to date: A revised ILA is
presented in the Council agenda packet. Only Section 6 has been
revised.
Recommended Action: Adopt Resolution R-10-765 authorizing the
City Manager to sign the ILA, if the ILA is also adopted by the King
County Council, unchanged.

CITY OF MAPLE VALLEY, WASHINGTON
RESOLUTION NO. R-10-765
A RESOLUTION OF THE CITY OF MAPLE VALLEY, WASHINGTON,
AUTHORIZING THE CITY MANAGER TO SIGN THE INTERLOCAL
AGREEMENT BETWEEN KING COUNTY AND THE CITY OF MAPLEVALLEY ADOPTING THE JOINT PLAN FOR SUMMIT PLACE.
WHEREAS, King County, Washington, as owner of a 156.5 acre parcel in Maple
Valley, known alternatively as Summit Place, and the Donut Hole, has entered into a
purchasing agreement with a developer, Summit Place 156, LLC, with the intent ofdeveloping the area into mixed use residential, commercial and office development; and
WHEREAS, the City of Maple Valley entered into a Memorandum of Agreement(MOA) with King County and Summit Place 156, LLC on October 2, 2008, subsequently
amended on February 23, 2010, to work cooperatively toward several goals including
adoption of an interlocal agreement for joint planning and to achieve annexation of theSummit Place property to Maple Valley prior to the vesting of a development application
by Summit Place 156, LLC; and
WHEREAS, the purpose statement of the MOA provides: To obtain assurances fromthe County and the Developer that they will negotiate with the City in good-faith with the
goal of achieving annexation of the Property to the City before the Developer submits an
application for development of the Property.; and
WHEREAS, the Maple Valley City Council held a public hearing on June 22, 2009 andby Resolution R-09-688, authorized the City Manager to execute an interlocal agreement
to adopt the Joint Plan for Summit Place, upon adoption of the same by the King County
Council, unchanged; and
WHEREAS, City staff have worked with King County staff to renegotiate the terms of
an interlocal agreement to adopt the Joint Plan which takes into account the passage oftime since June 29, 2009 and events that have occurred such as an amendment to the
MOA, and an amendment to the Purchase and Sale Agreement between King County and
Summit Place 156 LLC for the purchase of the Summit Place property; and
WHEREAS, the City of Maple Valley realizes that the successful development of
Summit Place will significantly impact the Maple Valley community, including demands
on the communitys social and physical infrastructure and continues to believe that jointplanning and cooperation with King County and Summit Place 156, LLC is necessary in
order to address the impacts of such development; and
WHEREAS, the City of Maple Valley desires to implement its mission statement to be a
well-planned community; and

WHEREAS, the City of Maple Valley understands that successful large-scale economicdevelopment projects requires both listening and dialogue involving all parties to the
MOA;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF MAPLE
VALLEY, WASHINGTON, DO RESOLVE AS FOLLOWS:
The City Manager is authorized to execute the Interlocal Agreement Between King
County and the City of Maple Valley Adopting the Joint Plan for Summit Place, if the
same is adopted by the King County Council, unchanged.
