I. INTRODUCTION
The productive rural infrastructure development project in the central highlands is funded by ADB. Ministry of Agriculture and Rural Development (MARD) is the project investor. This project will be implemented in the 5 provinces (Lam Dong, Dak Nong, Dak Lak, Gia Lai and Kon Tum) of the Central Highlands.
The long-term purpose of the project is to contribute to hungry alleviation and poverty reduction programs of the Government through sustainable development of the society, ecology and environment at community level by developing infrastructures for production, improving socio-economic conditions and living standards of people in the area. The short-term objectives of the project are (i) to rehabilitate and upgrade deteriorated or damaged irrigation system and rural roads; (ii) to strengthen management capacity and implementation of ODA projects, infrastructure management at community including province, district and commune levels to gradually improve living standards and conditions of the poor in the project area in the Central Highlands; (iii) to build models, institutional policies on "water saving irrigation technology for strategic and economic valuable plants" and "management and exploitation of irrigation schemes sustainably with the participation of all economic sectors ".
One sub-project of the project is “repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province” that will be implemented in three communes including Nam Dong, Dak Drong and Cư Knia, Cu Jut district, Dak Nong province. This Initial Environmental Examination (IEE) of the subproject is prepared to meet the requirements of environmental safety of ADB and the Government of Vietnam. It includes 11 parts:
(i) Introduction
(ii) Policy frame, legislation and management
(iii) Sub-project description
(iv) Description of existing environment
(v) Environmental impacts screening

II. POLICY FRAME, LEGISLATION AND MANAGEMENT
2.1 ADB policy
ADB safeguard policy statement (SPS) 2009 imposes safeguard requirements for all its funded projects. The SPS 2009 clarifies reason, scope and contents of the environmental assessment. Safeguard policy statement emphasizes on environmental and social sustainability in progress of economic growth and poverty reduction in Asia and the Pacific, therefore the objectives of SPS focus on:
i. areas Avoid adverse impacts of projects on the environment and affected people, where possible;
ii. Minimize/mitigate and/or compensate for adverse impacts on environment and affected people when avoidance is not possible; and
iii. Help borrowers/clients to strengthen their safeguard systems and develop the capacity to manage environmental and social risks.
SPS requires preparing environmental safeguard documents in the process of preparing a project including environmental management plan (EMP). The borrower/client needs to monitor EMP implementation. The monitoring will identify outstanding issues of EMP implementation and propose appropriate mitigation measures. Periodic monitoring report on EMP activities will be submitted to ADB every semi-annual during construction of the project.
Moreover, all subprojects under the loan 3032-VIE need to follow the specific guidance on environmental assessment as stated in the Environmental Assessment Review Framework (EARF) of the project, prepared by the project owner and approved by ADB. The subprojects under loan 3032-VIE only categorized as Category B or C will be included in the list of eligible subprojects for possible funding under the proposed Project. It is anticipated that all eligible subprojects will fall into Category B, whereby some adverse environmental impacts are expected, but of a lesser.
The subproject ““Repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province” is selected based on the project’s EARF that may cause the insignificant environment impacts and ranked as categorized B because: (i) It is not close to any preserved areas; (ii) there are not any households whose houses will be affected due to land acquisition to the subproject implementation;;(iii) it estimates there are about 36 households whose land will be acquired to implement the subproject but not any households will lose more than 10% their land. (iv) some environmental adverse impacts but these impacts will take place within subproject sites but can be controlled by mitigation measures. Thus an IEE needs to be prepared with an enclosed EMP.
2.2 Environment regulations of Vietnam government
The project must also comply with the environmental regulations. The Vietnam legal framework comprises of the following items:
- The Law on Environmental Protection adopted by the National Assembly of the Socialist Republic of Vietnam dated January 01, 2015. The law regulates general environmental protection requirements, policies and resources for protecting the environment;
- The Law on Labor adopted by the National Assembly of the Socialist Republic of Vietnam dated June 18, 2012 that regulates general requirement on safety and occupational health;

(source: Statistical Yearbook of Dak Nong province, 2013)
Natural disasters: A report by Dak Nong – Department of Agricultural and Rural Development (DARD) said that there are typically natural disasters in Dak Nong in recent years (i) sweeping floods; (ii) landslides; (iii) Floods; and (iv) droughts
- Sweeping floods took place in Dak Nong in recent years. In which one on September 14,15 and 16, 2012 in Dak Glong and Tuy Duc districts. It swept away 14 bridges and three persons. According to local people, this is a fiercest sweeping flood in 10 recent years through the province. Another one on October 07, 2013 in Quang Tan commune, Tan Duc district, it swept away temporary bridges, trees and farms and two persons died.
- Land slide often has taken place in the southern districts as Dak Song, Dak Dlong, Dak R Lap, Tuy Duc and Gia Nghia town. From 1992 to present, this phenomenon has happened with different extents and has risks, but not clarified reasons. In recent years land slices often takes place (i) in constructing the national highway No14 due to too high slope talus development; (ii) Gia Nghia-Quang Khe road; (iii) and bauxite mining areas etc..
- Flood phenomenon often takes place in the northern districts including Krong No and Cu Jut where have rather flat terrains. Like other provinces in the central highland, rivers and streams in Dak Nong do not have dykes so when it rains a long time, water from rivers, streams will flow to lower areas. Some typical floods in

Dak Nong was (i) on October 10, 2006, a flood in Dak Nong river has sunk hundred houses as heavy rain in days in upstream areas. As a result water level has risen up 2-5m and caused the flood. (ii) On September 10-28, 2012, a flood caused flooding for produce farms at Dak R’moan, Gia Nghia. (iii) on December 29-30, 2013, water on rivers and streams of Dak Nong reached peaks and had risks to happen sweeping floods in areas in Ea Krong river, Cu Jut district but luckily it did not happen.
- Drought, climate in Dak Nong has two clear seasons, rainy season is from May to October and dry season from November to April. Since deforestation for agriculture takes place commonly while rainy volume is reduced, rainy season finished sooner so surface and ground water has reduced significantly.
In Spring -Winter Crop of 2004-2005 , Dak Nong Province is damaged heavily by drought, ten thousands crop plants are dried & complete loss, mostly coffee with approximately 30,000 ha, about 3,000 ha of pepper, 2,000 ha of wet rice are damaged with value of approximately 2,000 billion VND ( Source : Study on Drought assessment of Dak Nong – Phan Thi Thanh Hang – Institute of Vietnam Geography & Science –Technology)
Topography and soil
- The subproject area is dominated by tectonics of plateaus; the terrain is relatively complex, only irrigated areas of the reservoirs are relatively flat. The topography is lower from West to East, from South to North; the average elevation is about 330m. The topography is with alternate valleys, rivers and streams.
- Sub-project is located on an area with 4 main categories of soil as follows: Yellow land on clay, black soil on basalt and Jail, red-brown soil on basalt and converged sloping valleys.
Surface water resource - The entire system of rivulets and streams in the subproject area is in basin of Serepok River flowing from South to North through the boundaries of two provinces of Dak Nong and Dak Lak and flows into the Kingdom of Cambodia.
- In the subproject, there are 03 reservoirs: Cu Pu reservoir, Dak Dier reservoir and Dak D’Rong reservoir.
- There are some streams flowing through communes such as: Ea Gang, 1,5km from Cu Pu reservoir, stream flowing Nam Dong and Tam Thang communes; Dak Dier stream at the southwest of Dak Dier reservoir; Dak D’Rong stream at the Southwest of Dak D’Rong reservoir. Around the reservoirs, there are also a lot of swallow brooks.
The above water resources are for domestic usage and agricultural activities of the local people.
Underground water Groundwater in subproject area is without pressure and located at the depth of 5 m - 30 m. Local people exploit it for domestic purposes.
Water quality
The 6 samples of surface water had been collected and analyzed with 10 parameters in 3 areas of subproject. The results of analyses have been compared with National technical standard for surface water quality QCVN 08:2009/BTNMT proves that almost

V. ENVIRONMENTAL IMPACT SCREENING
5.1 Positive impacts
Constructing the subproject "Repairing, upgrading Cu Jut irrigation works system, Cu Jut district, Dak Nong province" will bring positive impacts on environment and society as follows:
- It will ensure water to irrigate initiatively for 532 hectares of wet paddy, 285ha of coffee, pepper and 216 hectares of maize, 400 hectares of cotton and crops.
- It links the traffic from residential areas with production areas and works so that transporting materials and fertilizers for production as well as agricultural products will be more convenient. It creates favorable conditions for mechanizing agricultural production, bringing scientific advances into production, intensive cultivation to increase crop yields. The sub-project also reduces cultivation and labor costs and improves income of local peoples in the subproject area.
- It contributes to early completion of criteria No.2 - on transport, criteria No.3 - on irrigation, criteria No.10 - on incomes, criteria No.11 - on poverty rate of the new rural criteria in construction plan of new rural areas, which have been approved and are deployed at the locality.
5.2 Negative impacts

Description: Unexploded ordnance detection along the constructed road & canals may be risky for detectors and local people. However, the Cu Pu, Dak Dier and D'Rong reservoir had been constructed since 2001 therefore; detecting unexploded ordnance had been done. While the upgraded roads are in the existing ones which small adjustment, and the new constructed canals are located in the fields, which have cultivated so long, therefore the possibility of finding unexploded ordnance is very low. though the possibility of finding unexploded ordnance is low, its consequences, if explosion occur, causing to detectors and local people are high, which could be death or losing body parts. This activity needs to be managed carefully by authorized people.
Objects : Detectors and local peoples living closed to UXO points.

HHs due to site clearance (land acquisition)
taken place in existing foundation and alignment, however, sub-project components still require the land acquisition. However, the area of land need to be acquired is not much and 0.88 ha of losing land in Cu Pu reservoir (as rising dam crest) is under management of Irrigation Unit of Cu Pu and no need compensation. The acquired lands are in management areas of reservoirs, canals and roads as well as in productive areas, therefore, almost acquired lands are agricultural land, except material storages and 03 camps will be located in vacant land.
The acquisition of agricultural land will affect 36 HHs of 180 peoples, in which 10 of them are minorities. However, as described above, because the scattered of sub-project activities, the acquired land of each household is limited with small amount for permanently acquisition, while temporary acquired land will be returned after completion. Even though, the acquired of productive lands, though not much, of local people could slightly burden on their economic situation. Therefore, compensation plan need to be prepared and implemented.
In addition, this impacts has been informed to local people through public consultation, and all affected households have agreed to development of sub-project as well as voluntarily donate their land.
Objects : Affected peoples to be land acquired in Nam Dong, Cu Knia and Dak Drong Communes.
Affected level: Thus, social impact due to land acquisitions is minor due to these affected HHs will get beneficiary from upgraded road that it creates favorable condition for travelling from resident area to the agricultural production area & surrounding areas. However, compensation program still need to be implemented to reduce economic burdens for affected
households.
Location: 36 households along the upgraded roads and canals.
Time: Both permanent and temporary during preparation and construction phases.

Canal design is inappropriate with use and does not consider climate change
Yes
Minor
Negative
Permanent
Description: Inappropriate technical consideration during design of dam and canals can be listed as (i) inappropriate consideration on risk of landslide and soil erosion (ii) it can become a dyke that blocks water flow and cause local flooding in rainy seasons. (iii) Climate change/flooding issue has not been taken account into their design. According to “Report on Climate Change Scenarios of Vietnam, MONRE-2011”, With medium emission scenarios (B2): By the end of the century, annual rainfall would increase by about 2 to 7% in most of the regions. In Highland Region, including Dak Nong, where to be affected at least in competition with other areas in Vietnam, forecast is an increase about 0.9 - 3% (0.9% for Dak Nong) compared to 1980 – 1990 period.. In general, the dry season rainfall would decrease while rainy season rainfall would increase. However, with medium emission scenarios (B2): by the end of the century, maximum one day rainfall in the North Region would increase by about 50% compared to 1980 - 1990 period, about 20% in the Central North Region. Otherwise, maximum one day rainfall would decrease in the Central South & High Land, the South Regions about 10% to 30 % (10% in High Land Region). However, it may occurs extraordinary one day rainfall, which 2 times bigger than compared to current record in different regions
In dry season, rainfall decrease 10-14 % for High Land Region. The increase of temperature in accompanying with less rainfall in dry season could result in drought or less water availability, while the high concentration of rainfall as well as increase magnitude of extreme rainfall

could lead to extreme hazards such as flooding, landslide.
The in appropriation of design without considering CC impacts in reservoir and canal designs could result in significant impacts such as lacking and/or without water for irrigation during dry season, which is less rainfall in future, then reduce productivity. In addition, the higher precipitation and extreme rainfall could cause to flood and/even emergency of reservoir (this impact has been analyzed in operational phase).
However, the aim of sub-project is increase water availability for irrigation during dry season and concrete dam for ensuring safety during operation, especially during rainy season as improving existing works of dam and canals. In addition, the design of sub-project has carefully considered hydro-meteorological data series including during past years & extreme events and future trends of climate change as reducing potential impacts.
Objects
 Crops of local peoples are irrigated by subproject canals
 Local peoples in downstream of 3 Reservoris : Cu Pu, Dak Dier & Dak Drong
Affected level: Sub-project improve situations of existing reservoir and canals with consideration of climate condition, therefore, this impact is insignificant.
Location: All upgraded canals & Cu Pu reservoir.
Time: Permanent.
II. Construction phase
Landslide, soil erosion or sedimentation
Yes Minor Negative Temporary
Description: The construction activities, especially excavating, filling/ embankment work and storing materials, taken place in reservoirs of Cu Pu, Dak Drier & Dak DRONG as well as in upgraded roads and canals will create debris and/or cause materials falling into surface water sources. If they are not collected, it could cause to increasing sedimentation in the canal bed, blocking water flow from main canal into the branches due to debris, solid waste not collected properly; sedimentation may affect the rice fields of the local peoples in Nam Dong, Dak Drong and Dak Dier communes. However, as described in material sources, the excavated soil will be used for upgrading of management/ production/ interior field road along the canal system. In addition, the amount of excavation and embankment at each construction place is quite limited and scattered of construction activities and mainly implemented during dry season, therefore the magnitude of impact is small and duration of impact is short.

Polluted surface water
Yes Moderate Negative Temporary
Description: surface water on Cu Pu, Dak Dier, Dak Drong reservoirs, Ea Gang, Dak Dier, Dak Drong streams and other small streams surrounding the subproject area could be polluted due to construction activities. Those are (i) domestic wastewater from 03 worker camps; (ii) grease from construction machine maintenance and (iii) runoff water passing through from constructional areas/activities during rainy days as well as (iv) discarded soil and/or sludge from excavation, embankment in Cu Pu reservoir, and upgraded canals and roads as well as materials storage. If such pollutants falling/flowing into water bodies could result in water pollution, which reduces water quality for irrigation, domestic use (which is quite limit currently) as well as impact on aquatic-ecology in sub-project area;
However, because of the limitation (100 workers) and scattering of workers (03 camps) and construction machines, the generations of domestic wastewater (approximate 10 m
3/day but in 03 communes) and the
grease are limited, as well as the amount of constructing materials into water bodies during rainy days is also small. In addition, the construction of Cu Pu reservoir and its works mostly conducted during dry season with withdrawing all water in Cu Pu reservoir, therefore, the extent of impact is small and controlled in according to previous impact of increasing sedimentation into water bodies;
Objects:
 Water in Cu Pu , Dak Dier, Dak Drong reservoirs,
 Ea Gang, Dak Dier, Dak Drong streams
Affected level: Because the significant role of surface water bodies, this impact is considered as moderate, an appropriate mitigations need to be implemented;
Location: Cu Pu, Dak Dier, Dak Drong reservoirs and their irrigation canals are the main potential locations of this impact, however, nearby water surface bodies such as, Ea Gang, Dak Dier, Dak Drong streams and other small streams need to be concerned also..

Objects
 Resident areas closed to 3 reservoirs : Cu Pu, Dak Drier, Dak DRong
 Resident areas along the material transportation roads & upgraded roads.
Affected level: The impact is insignificant because extent of the road construction component is small so only few equipment’s will be mobilized to the site, the irrigation component is far from residential area (400m);
Location: Residential areas in Cu Kniwa, Nam Dong and Dak D’Rong communes and travellers.
Time: temporary during the construction phase
Air pollution Yes Minor Negative Temporary
Description: The construction activities will generate dust, air pollution, particularly in dry/sunny days. Dust could also be generated from excavation activities and operation of trucks on the inter-commune roads, or mobilizing mixing concrete, which need to be managed to reduce impacts on local people. Other air pollutant such as NOx, SO2X will be minor since the number of construction equipment mobilized on the site will be small. However, the construction is scattered and the extent of construction activities per place is limited, therefore, the transportation vehicles and operation of construction machines are also limited. In addition, according to site visit, the construction of irrigation canals is distance, at least 400 m from residential areas. And the number of people travelling on roads is quite small;

Soil pollution Yes Minor negative temporary
Description: Soil quality in the subproject area could be affected by (i) domestic wastewater from 03 worker camps; (ii) grease from construction machine maintenance and (iii) domestic and construction waste (solid waste). Soil could be also impacted due to scattering material and death concrete from construction site. If those wastes are not collected and treated in proper manners, it could contaminate soil, especially wastewater with high contaminants and grease as hazardous substances. Local flooding
Yes Moderate negative temporary/permanent
Description: Constructing concrete canals or roads may block local water flows in rainy seasons and generate local flooding. Sometime, design is inappropriate or contractor will not fully follow the technical specification, which could lead to blocking existing intakes, culverts and/or, material, spoil on the flow. The scattering construction material/waste to streams/river could also lead to block the water flow. This could effect on crops of local people. However, the construction schedule has planned to work mainly in dry season, as well as withdrawing all water in Cu Pu reservoir, therefore, the possibility of flooding by blocking water flow is low. In addition, the historical data has indicated that there is no heavy flooding in sub-project areas and construction activities do not implement on existing intakes, culverts, therefore the existing drainage system is remained;

Impacts on ecology
Yes Moderate negative temporary
Description: The subproject does not go through natural reserves, national parks and ecology with high value in terms of science, which need to protect therefore, it does not affect the ecology. However, during construction, small vegetation covers within the reservoirs of Cu Pu and Dak Drong, and along upgraded roads and the newly constructed canals could be destroyed. However, the affected flora is invaluable. In addition, during construction of canals, soil and rock can slide down the canals and affect aquatic ecological environment. However, the extent of construction is small and fragmented in many places, therefore it will not significant impact on canal aqua-ecology. Furthermore, the construction of Cu Pu & Dak Drong reservoirs required to withdraw all water, this could result in disappearing of aqua-species available in reservoir currently, and take time to recover after completion of construction. However, the site assessment has indicated that the aqua-ecology in Cu Pu and Dak Drong is very poor and this reservoir is almost out of water storage function because of penetration.
Objects:
• Vegetation covers within the reservoir of Cu Pu and Dak Drong as well as upgraded roads and canals
• Aquatic flora & fauna in Cu Pu & Dak Drong reservoirs
Affected level: Because the potential consequences in Cu Pu & Dak Drong reservoirs, this impact is considered as moderate, and aqua-ecology need to be recovered after construction completing;

of sub-project). If this amount is not collected, transported and treated in properly manner, it may cause non-aesthetic or difficulty for cultivation activity later on. (ii) Domestic waste form worker camps is about 0.3 kg/person day (as stated by National Environmental Report 2011, for rural solid waste) * 12 months of construction (continuously) x 30 days x 100 workers equal about 10.95 tons, and (b) Toxic wastes can be oil mops, fuel boxes, chemical boxes. If theses wastes are not collected, treated appropriately, they may pollute soil, water air and un-aesthetic.
The amount of solid waste and hazardous waste generated during this phase is small and scattered depending on allocation of workers, construction machines and vehicles. While the abundant of soil will be (i) dumped in disposal sites and/or (ii) utilized by local people for agricultural and leveling purposes as agreed in public consultation;

Impacts/ damage on infrastructures
Yes Minor negative Temporary
Description: According to the field survey, the current inter-communal roads are asphalt, but they were deteriorated, damaged and difficult for travel; many sections of inter-village roads were concreted according to the criteria of new rural area. The other roads are soil one and also in deteriorating situation.. The roads are narrow from 3 – 5 m, and even lesser for canal bank roads (approximate 2 m); and the road load is less than 5 tons/axis. Moreover, neighbouring roads/bridges connecting to the sub-project road also have small load too. So they may be damaged if the material or waste transport from the construction is not controlled well;
However, the extent of transportation that needs for sub-project is small and scattered in 03 different communes. In addition, there is no electrical, supply water as well as drainage pipe along roads, therefore, no impact on those infrastructures;

These could cause to occupational accidents during working and/or traffic accident for people passing through construction places. In lesser consequences, the workers may get sick because of unsafe living conditions, unsafe food and inappropriate personal protection equipment. However, few workers concentrated in each construction place, as well as low traffic density along constructed road, which results in less people being exposed to this impact. In addition, the construction activities do not require complicated skills, as well as required to follow environment and labor safety requirements, therefore it is low probability of occurring of accidents;
