General Procedures if there is no conflicting traffic in the horizontal dimension, ATC will issue clearance to deviate from track; or if there is conflicting traffic in the horizontal dimension, ATC will separate aircraft by establishing vertical separation or, if unable to establish vertical separation, ATC shall : advise the pilot unable to issue clearance for requested deviation advise pilot of conflicting traffic request pilot’s intentions SAMPLE PHRASEOLOGY : “Unable (requested deviation), traffic is (call sign, position, altitude, direction), advise intentions.”

Let’s look at these in more detail RVSM Approved - permitted to;
– flight plan in all RVSM airspace– operate in all RVSM airspace
Approved Non RVSM - permitted to– flight plan in all RVSM airspace– operate in all RVSM airspace, subject to controller discretion
Not RVSM Approved - permitted to– flight plan in all non-exclusive RVSM airspace– operate in all non-exclusive RVSM airspace, subject to controller discretion– transit exclusive RVSM airspace on climb/descent

Controller Discretion
Allocation of RVSM flight levels to ‘not RVSM approved’ aircraft is
the controller’s decision - discretion
Despite RVSM making more levels available, each not RVSM
approved aircraft will effectively occupy 3 RVSM levels
Pre-coordination is not required. Will you be creating workload issues
if the next sector/FIR cannot accept
Flight Planning and Permitted Ops
Transit Not RVSM approved aircraft may operate above or below RVSM
airspace as such, they may be cleared to climb to operate above FL 410 or be
cleared to descend to operate below FL290, provided that they – do not climb or descend at less than the normal rate for the
aircraft– do not level off at an intermediate flight level while passing
