The particulars of organization, functions and duties FUNCTIONS
The object of carving out of the Punjab Public Work Department is to execute public works
of paramount importance and take up developmental activities in the State pertaining to
construction of roads, bridges, buildings & electrical installations in a professional manner.
To cope with the ever expanding activities it has become essential and imperative to expand
the organizational set up. Briefly the main functions of the Building & Roads Department are
as under:-
1. Construction and Maintenance of Roads out of the State Funds.
2. Construction and Maintenance of National Highways and improvement of Roads of Strategic importance out of funds arranged by Govt. of India, Ministry of Shipping, Road Transport & Highways, New Delhi.
3. Construction and Maintenance of village link roads with allied small Bridges and Culverts out of funds arranged by Punjab Mandi Board and Market Committees.
4. Construction and improvement of Roads and Bridges out of loans arranged from HUDCO, NABARD, BOND Schemes and PIDB funds.
5. Construction and improvement of State Highways, MDRs and ODRs with the funds arranged from centrally sponsored schemes under Central Road Funds (CRF) and Inter State Connectivity & Economic Importance (ISC & EI) Scheme.
6. Construction and Maintenance of Govt. Buildings for multifarious department of Punjab Govt. out of funds administered by the respective departments.
ORGANIZATION Presently the Administrative Department is headed by an officer of an IAS cadre
designated as Secretary to Govt. of Punjab having its independent Secretariat with allied
officers and concomitant staff. In order to carry out the works in field the department is run

by the following five Chief Engineers (Civil) with centrally located Head Quarter at Patiala
and One Chief Engineer (Electrical & Building) with Head Quarter at Chandigarh:-
1. Chief Engineer (I.P.)
He is Incharge of infrastructure projects funded by PIDB; besides incharge of
Gazetted Establishment (except Electrical and Mechanical personnel).
2. Chief Engineer (N.H.) Presently this post is headed by an officer of the rank of Superintending
Engineer(I.P.) in addition to his own duties. He is incharge of National Highways in
the State of Punjab for on- going World Bank Projects, BOT Projects, State National
Highway Projects and Inter State Connectivity & Economic Importance (ISC & EI)
Scheme.
3. Chief Engineer (North)
He is incharge of Plan Roads/Link Roads and all the Government Buildings falling
under the jurisdiction of Patiala-I/Patiala-II/Chandigarh/Pathankot/Hoshiarpur Circles
of PWD B&R; besides he is incharge of Non-Gazetted Establishment (except
Electrical & Mechanical personnel).
4. Chief Engineer (South)
He is incharge of Plan Roads/Link Roads and all the Government Buildings falling
under the jurisdiction of Faridkot / Ferozepur and Bathinda Circles of PWD B&R.
Superintending Engineer, Traffic Engineering Cell and Director Research & Design
also works under him.
5. Chief Engineer (Central)
He is inchage of all Plan Roads / Link Roads and all the Government Buildings of
Ludhiana/Jalandhar-I/Jalandhar-II/Sangrur & Amritsar Circles. Presently this post is
lying vacant and the Chief Engineer (North) holds the charge of this post.

6. Chief Engineer (Electrical & Building) He is incharge of Building works, supervision, execution and maintenance of
Electrical wing in whole of Punjab, Electrical Circle (North) Chandigarh, Elect. Circle
(South) Patiala & Mech. Circle Patiala & incharge of Gazetted & Non-Gazetted
establishment of Electrical & Mech. Wings in Punjab PWD (B&R). Presently this post
is vacant and the Superintending Engineer, Construction Circle, Chandigarh holds the
additional charge of this post.
Besides there is one Administrative Officer from PCS cadre, one Registrar looking
after 14 correspondence branches each headed by the Superintendent and equal
number of drawing branches headed by a Circle Head Draftsman to look after their
day to day work. The Accounts Cell in the Head Office is headed by a representative
of the Finance Department, with the designation of Joint Controller (F&A). The
Executive Engineers/Assistant Engineers look after the works of
Design/Planning/Quality Control/Planning and Procurement Cell etc. in the Head
Office.
The following officers act directly under the control of Administrative Department:-
1. Director Quality Control and Chief Vigilance Officer of the rank of Superintending
Engineer, assisted by two Executive Engineers and few Sub-Divisional Engineers
for ensuring quality control over execution of works in the field properly
according to the PWD/MORT&H Specifications. In addition, the designated officer
is charged with the responsibility of looking into the complaints with regard to
any shortcomings or imperfections in the execution of work.
2. Joint Secretary of the rank of Superintending Engineer is entrusted with the duty
of arranging funds and monitoring the progress of works in general and PMGSY
in particular.
DUTIES
1. Secretary to Govt. of Punjab
He is Secretary of the administrative department to ensure proper, adequate and
efficient administration owing allegiance to the H.E. Governor departmental set up in
hierarchy. In order to perform his duties he is assisted by following set up:-

(i) Chief Engineer – He is to discharge his duties as professional Head of B&R
department and to render professional advice to the Govt. in relating to all
matters on which his advice is desired. He is to monitor the Budget
Estimates, allotment and expenditure on works in progress and to suggest
any appropriation of funds depending upon requirement intimated to him by
the Superintending Engineers working under him. The Chief Engineer is at
liberty to correspond with all heads of departments on all matters in regard
to details of buildings or other works concerning them.
(ii) Superintending Engineer – He is responsible to the Chief Engineer for
administration and general professional control of Public Works, incharge of
officers of the department within his circle. He is to inspect the state of
various works in his circle and to satisfy himself that system of management
prevailing is efficient and economical and that there is no accumulation of
stock in any of the Divisions under his control beyond its requirements. He
will inspect each Division in his circle at least once in a year to examine initial
account and various other registers, mode of preparation of estimates,
contract agreements, contractor account and system of recording plans and
paper and office work in general. Further it is incumbent on the
Superintending Engineer to apprise the Chief Engineer of any serious and
glaring irregularities or other matter of importance noticed during inspection
or on which his orders are required. Besides, he is to keep a rapport with the
Executive Engineers with regard to control over accounts and audit inspection
reports. The S.E. is responsible for the Engineering character of every work
which he approves and submit any report, design, estimate or other
documents to the Chief Engineer, in particular to the suitability of design and
reasonableness of the rates and proper checking of the estimates compared
to the drawings. Besides a Superintending Engineer is required to proceed to
the site in his circle to report any important design or work or any serious
accident or threatened danger to the works.
(iii) Executive Engineer – The Executive Engineer is immediately responsible
for proper maintenance of all works in his charge and for the preparation of
projects, designs and estimates, whether for new works or repairs. It is also

a part of his duty to organise and supervis the execution of works and to see
that those works are suitably and economically carried out with material of
good quality. Immediately on completion of the work the Executive Engineer
is required to close accounts and to prepare completion reports. The
Executive Engineer is a primary Drawing and Disbursing Officer. He is placed
in account with the Treasury by the Accountant General of the State. He is
required to draw money from the Treasury by presenting cheques and pay
bills to meet with his just requirements and not to keep in his chest any
money in excess of his immediate requirements. He is required to render
account of all the transactions of the month to the Accountant General. In
order to enable him to discharge his responsibilities he is provided with a
Divisional Accounts Officer owing his three fold duties, as compiler of the
accounts, as primary auditor to exercise certain checks over sanctions and to
act as financial assistant to the Executive Engineer. The Executive Engineer is
required to apprise the Superintending Engineer in the event of probability of
excess over the estimates and to seek for order of Superintending Engineer
on important matters. The Executive Engineer is further expected to inspect
each of the Sub-Divisions annually and to suggest measures for improvement
in accounts. He is to suggest measures for protection of buildings and works
and to prevent encroachments on Government lands in his charge. The
Executive Engineer in addition to his other duties is also Ex-officio
Professional Advisor of all departments of the administration within the limits
of his charge.
(iv) Sub-Divisional Engineer – He is responsible to the Executive Engineer for
management and execution of works within his Sub-Division and is Executive
Engineer’s assistant, charged with getting the work executed in accordance
with sanctioned estimates, specifications and drawings. In case of original
works, the SDE is to check in variably himself all the Nishans and to see that
those are correctly given. He is to check the foundation of all the important
Bridges and Buildings and under ground works. He is required to ensure that
the measurements of the works done or recorded in the measurement books
promptly and to remain in constant and close touch with day to day work of

the Junior Engineers. His detailed duties are codified in Para 5.5 of the B&R
Manual of Orders.
(v) Junior Engineer – In the B&R department, it is the smallest working unit
known as “Section” incharge of a Junior Engineer whose principle functions
and duties are to prepare petty requisitions and plans and estimates for
Special Repairs and additions and alterations, to supervise actual execution of
Buildings and Roads works and repairs in his section, to take measurements
of the works and to assist the Sub-Divisional Engineer in measurements or
check measurements. He is also required to keep a vigilant control over
expenditure and report progress of works to the Sub-Divisional Engineer. His
detailed duties are codified in Para 5.6 of B&R Manual of Orders.
Note:- The duties of the other Ministerial Staff are codified in Chapter-5 of the B&R Manual of Orders.

SECTION - II
The powers and duties of officers and employees of the PWD
The duties of the various officers & employees of PWD (B&R) Department are as under:- Chief Engineer.
The duties of the Chief Engineer are given in the paragraphs 1.43 to 1.48 of
PWD Code and are as under:-
1.43 The Chief Engineer is the administrative and professional head of the Branch
of the Department in his charge, and is responsible for the efficient working
of his branch. He is also the responsible professional adviser of Government
in all matters relating to his charge or on which his advice may be desired.
He is required to bring clearly, and faithfully before Government all subjects
reserved for its decision or for that of the Central Government.
1.44 It is duty of the Chief Engineer to arrange removals, transfers and postings of
Superintending Engineers and Divisional Officers and transfers of other
gazetted officers from one Circle (or Division in the case of the Electricity
Branch) to another.
In the Electricity Branch it is also the duty of the Chief Engineer to arrange
removals, transfers and postings of other establishment within the Branch
except the Divisional Accountants.
The Chief Engineer, Electricity Branch, is also authorized to make inter-
divisional transfers of posts of clerks, Line Superintendents, Overseeers
within the Branch in emergent cases and as a temporary measure, provided
that –
(a) temporary posts created for a brief period for a special purpose are not transferred;
(b) in the event of the abolition of a Division or a Sub-Division the effect on the strength of the other non-gazetted establishment in the Branch shall be reported to government with such observations as the Chief Engineer may consider necessary; and
(c) when a post has been specifically refused in any particular unit a corresponding post is not created in that unit by transfer from elsewhere.
Section - II
( 8 )
The Chief Engineer Electricity Branch, is also responsible to fix headquarters
of subordinates not in Sub-Divisional charge and of the Traveling Audit
parties employed to audit locally the revenue accounts of the various Sub-
Divisions in the Branch.
1.45 The Chief Engineer will exercise a concurrent control with the Audit Officer
over the duties of the officers of the department in connection with the
maintenance of the accounts and will give all legitimate support to the Audit
Officer in enforcing strict attention to the regulations concerning the
disbursement of money, the custody of stores and the submission of
accounts. He has no authority over the audit officer in regard to audit
matters, but has a claim on him for assistance and advice in matters relating
to accounts and finance. At the same time the Chief Engineer should arrange
that the Audit Officer is kept fully cognizant of all proceedings and proposals
to enable the latter to fulfill his functions.
1.46 The Chief Engineer will prepare annually the portion of the budget estimates
relating to the works under his control and as soon as possible after the close
of each year, a report of the progress made during that period on the public
works under his charge, giving a brief but clear account of the operations of
the department.
1.47 It is the duty of the Chief Engineer to see that the budget allotments of the
year are fully expended in so far as is consistent with general economy and
the prevention of large expenditure in the last months of the year for the sole
purpose of avoiding lapses. He will ensure that any money which is not likely
to be needed during the year is promptly surrendered so as to allow of its
appropriation, for other purposes by the proper authority.
1.48 A Chief Engineer may correspond direct with the heads of departments on all
matters relating to details of buildings or works appertaining to those
departments. A statement of the financial and miscellaneous powers of the
Chief Engineer is given in paragraphs 5.30 and 5.31.
Section - II
( 9 )
Superintending Engineer.
The duties of the Superintending Engineer are given in the paragraphs 1.49 to 1.57 of
PWD Code and are as under:-
1.49 The administrative unit of the department in the Circle, in charge of a
Superintending Engineer who is responsible to the Chief Engineer for the
administration and general professional control of public works in charge of
officers of the department within his Circle.
1.50 It is the duty of the Superintending Engineer to inspect the state of the
various works within his Circle, and to satisfy himself that the system of
management prevailing is efficient and economical that the different articles
in stock are duly verified according to the rules laid down, and that there is
no accumulation of stock in any division beyond its requirements. He is also
responsible that no delay is allowed to occur in the submission of Completion
Reports (or completion statements) where necessary. (see paragraph 2.122).
1.51 The Superintending Engineer is required to ascertain and report on the
efficiency of the subordinate office and petty establishments, and to see that
the staff employed in each Division is actually necessary and adequate for its
management. He will also examine the condition of surveying and
mathematical instruments at the headquarters of Divisions. He will inspect
each Divisional Office in his Circle at least once a year to examine initial
accounts, accounts of stock, tools and plant and stock manufacture, registers
of work and other divisional books, mode of preparation of estimates,
contract agreements, contractors accounts, system of recording plans and
papers, and office work generally.
In the Buildings and Roads Branch, the Superintending Engineer should
submit invariably a report to the Chief Engineer intimating whether the
inspection discloses any serious irregularities or other matters of importance,
which the Superintending Engineer considers should be brought to the notice
of the Chief Engineer, or on which orders are required.
Section - II
( 10 )
In the Electricity Branch, inspection of the Divisional Offices is made annually
by the Chief Engineer who also deals with his Inspection Reports finally.
1.52. Although the Audit Officer is required to make inspections of the account
offices of disbursing officers, this does not relieve the Superintending
Engineer from responsibility for the maintenance of the authorized system of
accounts throughout his Circle. The Audit Officer and the Superintending
Engineer should assist each other in rendering the management of the
accounts of the department as perfect as possible. The Superintending
Engineer should also examine the books of Divisional Officers and their
subordinates, and see that matters relating to the primary accounts are
attended to personally by the Divisional and Sub Divisional Officers and that
the accounts fairly represent the progress of each work. It will also be his
duty to examine the registers of works, so as to keep a vigilant watch over
the rates of work and when he considers it neecssa4ry, he may require a
Divisional Officer to report to him monthly or at longer intervals on a Works
Slip, P.W.A. Form No. 39, the total expenditure to date under each sub-head
of a work compared with the sanctioned estimate. It will thus be seen that it
rests with the Superintending Engineer to investigate excesses over sub-
heads with a view to deciding whether or not a revised estimate will be
required for the work. When a revised estimate is required it will also devolve
on the Superintending Engineer to see that it is submitted in due time to the
sanctioning authority. (See paragraphs 1.70 and 2.117)
1.53. (1) Superintending Engineers are empowerd to transfer and post all members
of establishment within their Circles except Divisional Officers and
Accountants. They may arrange among themselves for transfers of non-
gazetted establishment not borne on Circle cadres their respective Circle
between and when the arrangements are complete, they will recommend to
the Chief Engineers the proposed transfer of such establishment from their
Circles, as also those of gazetted officers.
Section - II
( 11 )
(2) They may fix the headquarters of Overseers and Subordinates not in Sub-
Divisional charge.
(3) They should see that the Circle and Divisional scales of office and petty
establishments are not exceeded without proper authority.
1.54 (1) Superintending Engineers are responsible for the engineering character of
every work which they approve and, in submitting any report, design,
estimate, or other document to the Chief Engineer will invariably state their
own opinion and recommendations on the subject, in particular as to the
suitability of the designs and the reasonableness of the rates. They should
also have estimates checked and compared with the drawings.
(2) Superintending Engineers may be required to exercise, in addition to their
ordinary duties, supervision over Local Fund expenditure in communication
with the Civil Officers.
1.55 Besides regular tours of inspection, it is the duty of Superintending Engineers
to proceed o any place in their Circles to report on any important design or
work, or any serious accident or threatened danger connected with the works
within their charge.
1.56 The supervision and control of the assessment of revenue from irrigation and
navigation works within his Circle will rest with the Superintending Engineer.
1.57 A Superintending Engineer is authorized to correspond direct with any of the
local authorities, civil or military within his Circle. He will address General
Officers Commanding Divisions or Brigades through their Staff Officers and all
other officers direct.
Divisional Officer / Executive Engineer.
The duties of the Divisional Officer / Executive Engineer are given in the paragraphs
1.59 to 1.77 of PWD Code and are as under:-
1.58 The Executive unit of the Department is the Division, in charge of a Divisional
Officers who is usually an Executive Engineer, an is responsible to the

Superintending Engineer for the execution and management of all works
within his Division.
1.59 A Divisional Officer can receive positive orders only from his own
departmental superiors the head of the Administration, or other Civil Officers
duly authorized.
1.60 Divisional Officers are responsible that proper measures are taken to
preserve all the buildings and works in their Divisions, and to prevent
encroachment on Government lands in their charge. They should keep
accurate plans of all Government lands, take care that their subordinates
make themselves acquainted with the boundaries and see that they are
maintained.
1.61 Every Divisional Officer is required to report immediately by telegram direct
to the Chief Engineer and also to the Superintending Engineer any serious
accident or unusual occurrence resulting in a serious injury to, or death of,
any person or damage to any work or crop connected with his Division. The
telegram should be confirmed by letter stating the action taken by the
Divisional Officer (See also paragraphs 2.101)
1.62 Divisional Officers may transfer establishment other than Sub Divisional
Officers, Deputy Collectors and Accountants. Within their respective Divisions
without reference to higher authority. Such transfers will be reported in the
ordinary course to the Superintending Engineer.
1.63 Divisional Officers are immediately responsible for the proper maintenance of
all work in their charge and for the preparation of projects and of designs
and estimates, whether for new works or repairs. It is also part of their
duties to organize and supervise the execution of works and to see that they
are suitably and economically carried out with materials of good quality.
1.64 Divisional Officers are strictly prohibited from commencing the construction
of any work or expending public funds without the sanction of competent

authority; also from making of permitting any material deviations from any
sanctioned design in the course of execution without specific authority, or in
case of emergency, when the change should be forthwith reported to the
Superintending Engineer.
1.65 Immediately a work is finished, it is the duty of the Divisional Officer to close
the accounts and to prepare the completion report if required by the rules in
paragraphs 2.122.
1.66 Divisional Officers will take the necessary steps for obtaining cash for the
works under their control, and will keep their accounts and submit them
punctually to the audit office under the rules for the time being in force. In
their arrangements for account keeping they will exercise a thorough and
efficient control and check over their Divisional Accountants. They will also,
before submitting the monthly accounts, carefully examine the books, returns
and papers from which the same are compiled.
1.67 The Divisional Officer is responsible for the correctness, in all respects, of the
original records of cash and stores, receipts and expenditure and for seeing
that complete vouchers are obtained. The Divisional Accountant is
responsible to the Divisional Officer for the correct compilation of the
accounts of the Division from the data supplied to him.
The Divisional Officer is responsible that his accounts are regularly posted
from day to day and that the Accountant carries out his duties regularly and
punctually. The relative position of a Divisional Accountant to the Divisional
Officer in respect of accounts is analogous to that of a Sub Divisional Officer
to a Divisional Officer in respect of works, and the responsibilities of the
latter for the work of the Divisional Accountant are similar to those which
attach to him in respect of the execution of works in the charge of other
subordinates.
Section - II
( 14 )
1.69. Relates to PWD (Irrigation) Branch.
1.70. The Divisional Officer is held primarily responsible for affording information of
the probability of excess over the estimated cost of work, and is expected not
to allow any delay to occur in reporting any such probability to the
Superintending Engineer. Immediately it becomes apparent that, whether
from excess of certain rates or from departure from a design or any other
cause, the estimated cost of a work is likely to be exceeded, the Divisional
Officer is bound to report the fact forthwith to the Superintending Engineer,
describing the nature and cause of the probable excess and asking for
orders. This report should be made on the works Slip P.W.A. Form No. 39.
The Divisional Officers must also submit the Works Slip, with such
explanation as will enable the Superintending Engineer to pas orders on the
case, on the occurrence, or the probability of the occurrence, of any
irregularity in the rate or cost of a sub-head. All important liabilities not
brought to account should also be noted on the Works Slips.
It will not be necessary for the Divisional Officer to submit the Works Slip in
cases in which he can finally pass excesses over estimates under Serial No.
27 of paragraph 20.15 B.F.P..
1.71 The Divisional Officer is responsible that the surveying and mathematical
instruments in his Division are properly cared for, and will report on their
condition to the Superintending Engineer at the end of each working season.
Any injury to the instruments due to neglect or carelessness should be made
good at the expense of the officer or subordinates responsible for the
damage.
1.72 It will be the duty of the Divisional Officer to furnish Treasury and Sub-
Treasury Officers, after due inspection, with the certificate prescribed in
Article 9 of the Resource Manual as to the security of strong rooms used or
proposed to be used for the storage of coin.

( 15 )
1.73 The Divisional Officer will be required to inspect at least once a year and to
report on and suggest measures for the protection of any public monument
or building of architectural or historical interest, whether public or private
property other than those protected by the Central Government, which
appears likely to fall into decay, and he will be held responsible for any
neglect or destruction which he has failed to report. In the case of private
property it will be for the Provincial Government to decide what steps, if any,
are to be taken to obviate further neglect or destruction.
1.74 The Divisional Officer, in addition to his other duties, will consider himself to
be the ex-officio Professional advisor of all departments of the Administration
within the limits of his charge. He will transact business of this sort with the
chief military of civil authorities within his Division, but it is incumbent on him
to see that no undue formalities or comparatively unessential projects are
allowed to interfere with the performance of those duties which are
necessary or urgent.
1.75 Divisional Officers may, where the services of any officer of the Military
Engineer Services are not available, be called upon by General Officers
Commanding Divisions or Brigades to be members of committees appointed
to select sites and determine general boundaries of cantonments.
1.76 At stations where there are no Ordnance or Military Works workshops,
repairs to ambulance wagons and tongas will be carried out by the Public
Works Department.
1.77 Divisional Officers will address Commanding Divisions, Brigades of Stations
through their Staff Officers.
Sub Divisional Officer The duties of the Sub Divisional Officer are given in the paragraphs 1.78 to 1.79 of PWD
Code and are as under:-

1.78 The Division is divided into Sub Division in charge of Sub Divisional Officers
who may be Executive Engineers, Assistant Executive Engineers, Assistant
Engineers or where no such officers are available, Engineer Subordinates or
Zilladars; they are responsible to the Divisional Officer for the management
and execution of works within their Sub Divisions and are his assistants.
No Sub-Division can be constituted in the first instance without the sanction
of Government.
1.79 In future Executive Sub Division of the kind referred to in the latter part of
the first works Account Code should not be instituted except under the orders
of the Superintending Engineer who should in each case record the reasons
for his action in writing, forwarding a copy to the Chief Engineer, for
information.
Sectional Officer The smallest working unit in the B&R Branch is known as ‘Section’ in the charge of a
Sectional Officer whose principal functions are as under:-
• To prepare petty requisitions and plans and estimates for special repairs and
additions and alterations.
• To give Nishans for works to be done in his section.
• To carry out survey and leveling work when required to do so.
• To supervise the actual execution of building and road works and repairs in his
section done through the contractors or by daily labour and to see that they are
executed in accordance with the plans and specifications approved by the
competent authority for the said work with sound materials. He shall maintain
the Register of progress and instructions on all major works and present them to
all inspecting officers on their visits for recording their orders, if any.
• To make arrangements for adequate strength of labour at economical rates
within the sanctioned rates when a work is required to be done departmentally.
• To maintain accounts of all the stock and T&P in his charge, their receipts and
issues and to maintain register of materials at site.
Section - II

• To take measurements of works and to assist the Sub-Divisional Officer or
Executive Engineer in measurements or check-measurement of works.
• To record, in time, the measurements of small works below foundations. In case
of large works, to get the work measured up, in time, from the Sub-Divisional
Officer, before such works get covered over.
• To prepare running bills of all works and final bills of such works as cost less
than one lakh of rupees and to submit them to the S.D.O.
• To put up measurement books regularly to his Sub-Divisional Officer for order of
payment at least twice a month.
• To supervise labour employed on daily wages and to submit labour reports daily
to the S.D.O. and to supervise the regular gangs and to check their attendance
on his visits to roads under his charge.
• To prepare, maintain and submit in time all rolls of work-charged establishment
and to make payments to work-charged establishment and permanent gangs on
behalf of and under the instructions of the Sub-Divisional Officer when required
to do so.
• To keep a vigilant control over expenditure and report progress of work to his
S.D.O. either daily or periodically as may be ordered.
• To report to the S.D.O. immediately occurrence of any serious accidents etc. in
his section and to ensure that no damage takes place to the Government
property in his charge.
• To check the Visitors register of all rest houses in his charge at least once a
month and to receive collections of rents etc. from Chowkidars of rest-houses for
depositing them in the Sub Divisional Office.
• To keep Government land property free from encroachments and to promptly
bring to the notice of his Sub Divisional Officer in writing when any
encroachment temporary or permanent is threatened or actually takes place.
• To check (count, weigh or measure, as the case may be) each half year, all the
stores in his charge and to prepare half yearly distribution list for stock and
yearly for T&P showing the closing balances and to certify distinctly that he has
checked the stores, recording the result of such a check.
Section - II

• To check, measure all the roadside materials at least once in six months and
record his check in the measurement books.
• To submit survey report for all unserviceable stock and T&P.
• When holding an imprest, the S.O. is responsible for the exercise of proper care
in the custody of cash and in case of loss the onus of proof that proper care was
exercised will be on him.
• To carry out annual inspections of buildings and report the result to S.D.O. for
entry in the Register of Buildings as laid down in paragraphs 9.4 of this Manual.
He shall in addition, be answerable for the general condition of all buildings and
roads under his charge and for bringing to notice structural weaknesses, if any.
The Sectional Officers, instead of keeping a separate Diary showing their visits to
various works in their charge, should show all their journeys within or beyond
five miles areas of their headquarters in their monthly T.A. Bills.
Note: The duties of the other Ministerial Staff are codified in Chapter-5 of the PWD (B&R) Manual of Orders.

3.1 Public Works Minister The Public Works Minister is the member of Council of Minister and over all incharge of the Public Works Department (B&R). He take decision in all matters as per powers vested in him. Being a member of the Cabinet which is collectively responsible to the legislature. Chief Engineer The Chief Engineer is the administrative and professional head of the Branch of the Department in his charge and is responsible for the efficient working of his branch. He is also the responsible professional adviser of Government in all matters relating to his charge or on which his advice may be desired. He is required to bring clearly and faithfully before Government all subjects reserved for its decision or for that of the Central Government. The Chief Engineer will exercise a concurrent control with the Audit Officer over the duties of the officers of the department in connection with the maintenance of the accounts and will give all legitimate support to the Audit Officer in enforcing strict attention to the regulations concerning the disbursement of money, the custody of stores and the submission of accounts. He has no authority over the Audit Officer in regard to audit matters but has a claim on him for assistance and advice in matters relating to accounts and finance. At the same time the Chief Engineer should arrange

that the Audit Officer is kept fully cognizant of all proceedings and proposals to enable the latter to fulfil his functions. The Chief Engineer will prepare annually the portion of the budget estimates relating to the works under his control and as soon as possible after the close of each year, a report of the progress made during that period on the public works under his charge, giving a brief but clear account of the operations of the department. It is the duty of the Chief Engineer to see that the budget allotments of the year are fully expended in so far as is consistent with general economy and the prevention of large expenditure in the last months of the year for the sole purpose of avoiding lapses. He will ensure that any money which is not likely to be needed during the year is promptly surrendered so as to allow of its appropriation, for other purposes by the proper authority. A Chief Engineer may correspond direct with the heads of departments on all matters relating to details of building or works appertaining to those departments. 3.4 Superintending Engineers The administrative unit of the department in the Circle, in charge of a Superintending Engineer who is responsible to the Chief Engineer for the administration and general professional control of public works in charge of officers of the department within his Circle.
It is the duty of the Superintending Engineer to inspect the state of the various works within his Circle, and to satisfy himself that the system of management prevailing is efficient and economical that the different articles in stock are duly verified according to the rules laid down and that there is no accumulation of stock in any division beyond its requirements. He is also responsible that no delay is allowed to occur in the submission of Completion Reports. The Superintending Engineer is required to ascertain and report on the efficiency of the subordinate office and petty establishments and to see that the staff employed in each Division is actually necessary and adequate for its management. He will also examine the condition of surveying and mathematical instruments at the headquarters of Divisions. He will inspect each Divisional Office in his Circle at least once in a year to examine initial accounts, accounts of stock, tools and plant and stock manufacture, registers of work and other divisional books, mode of preparation of estimates, contract agreements, contractor accounts, system of recording plans and papers and office work generally. The Superintending Engineer should submit invariably a report to the Chief Engineer intimating whether the inspection discloses any serious irregularities or other matters of importance, which the Superintending Engineer considers should be brought to the notice of the Chief Engineer or on which orders are required. 3.5 Executive Engineer The Executive unit of the Department is the Division in charge of a Divisional Officers who is usually an Executive Engineer, and is responsible to the Superintending Engineer for the execution and management of all works within his Division. The number of Divisions, permanent or temporary, is fixed by the Punjab Government for each Branch of the Department according to its requirements. Executive Engineer are responsible that proper measures are taken to preserve all the buildings and works in their Divisions, and to prevent encroachment on

Government lands in their charge. They should keep accurate plans of all Government lands, take care that their subordinates make themselves acquainted with the boundaries and see that they are maintained. Executive Engineers are immediately responsible for the proper maintenance of all work in their charge and for the preparation of projects and of designs and estimates, whether for new works or repairs. It is also part of their duties to organise and supervise the execution of works and to see that they are suitably and economically carried out with materials of good quality. Executive Engineers are strictly prohibited from commencing the construction of any work or expending public funds without the sanction of competent authority; also from making or permitting any material deviations from any sanctioned design in the course of execution without specific authority, or in case of emergency, when the change should be forthwith reported to the Superintending Engineer. Immediately a work is finished, it is the duty of the Divisional Officer to close the accounts and to prepare the completion report if required by the rules in paragraph 2.122. Executive Engineer will take the necessary steps for obtaining cash for the works under their control, and will keep their accounts and submit them punctually to the audit office under the rules for the time being in force. In their arrangements for account keeping they will exercise a thorough and efficient control and check over their Divisional Accountants. They will also, before submitting the monthly accounts, carefully examine the books, returns and papers from which the same are compiled. The Executive Engineer is responsible for the correctness, in all respects, of the original records of cash and stores, receipts and expenditure and for seeing that complete vouchers are obtained. The Divisional Accountant is responsible to the Divisional Officer for the correct compilation of the accounts of the Division from the data supplied to him. The Divisional Officer is responsible that his accounts are regularly posted from day to day and that the Accountant carries out his duties regularly and punctually. The relative position of a Divisional Accountant to the Divisional Officer in respect of accounts is analogous to that of a Sub-Divisional Engineer to a Executive Engineer in respect of works and the responsibilities of the latter for the work of the Divisional Accountant are similar to those which attach to him in respect of the execution or works in the charge of other subordinates.
The Executive Engineer is held primarily responsible for affording information of the probability of excess over the estimated cost of work and is expected not to allow any delay to occur in reporting any such probability to the Superintending Engineer. Immediately itn becomes apparent that, whether from excess of certain rates of from departure from a design or any other cause, the estimated cost of a work is likely to be exceeded, the Executive Engineer is bound to report the fact forthwith to the Superintending Engineer, describing the nature and cause of the probable excess and asking for orders. It will be the duty of the Executive Engineer to furnish Treasury and Sub-Treasury Officers, after due inspection, with the certificate prescribed in Article 9 of the Resource Manual as to the security of strong rooms used or proposed to be used for the storage of coin.

3.6 Sub-Divisional Engineers The Division is divided into Sub-Division in charge of Sub-Divisional Engineers who be Executive Engineers, Assistant Executive Engineer, Assistant Engineers or where no such officers are available, Engineer Subordinates or Ziladars; they are responsible to the Executive Engineer for the management and execution of works within their Sub-Divisions and are his assistants. 3.7 Junior Engineers Junior Engineers are subordinate to Sub-Divisional Engineers. They are responsible to the Sub-Divisional Engineers for the management and execution of works within their sections and are his Assistants.

SECTION - IV
The norms set by it for the discharge of its functions
4.1 The functioning of the Deptt. is guided by the Manual of orders and PWD Code
issued by the Chief Engineer, Punjab, P.W.D. (B&R) Branch and published by the Govt.
of Punjab. The contents of these two books pertains to the procedure rules, duties and
accountability of the officers/officials of the Department.
(a) The other important documents for estimation of project is Common
Schedule of Rates & Data Book of MORT&H which are being revised
regularly on the basis of market trend prevailing at that time; cost of
material and labour.
(b) The documents which governs the specifications for execution of building
work is PWD Specifications, and for Roads & Bridges MORT&H
specifications is issued by the Govt. of India.
(c) For the constn. of Roads under Prime Minister Gram Sarak Yojna,
National Rural Road Dev. Agency also issued the guidelines for the
implementation of the programme in the form of rural road manual and
specifications.
4.2 Quality Assurance
The Deptt. has quality control Cell which is independently carry out the
quality control test on the works under execution throughout the State. Any deficiency
noticed is brought to the notice of Chief Engineer and the Govt. The Quality Control Cell
headed by the Director who is in the rank of Superintending Engineer. 3 Nos. Executive
Engineer 6 Nos. Sub-Divisional Engineers are under the control of the Director. The
Deptt. has well equipped laboratory at Patiala under the charge of Deputy Director,
Quality Control to carry out the tests for road and building material. The Director
Quality Control is the overall incharge of this Laboratory. Laboratory has three Research
Assistants which conduct the tests as per guidelines of the MORT&H Specifications. One
Sub Divisional Engineer. and one Junior Engineer at each District Head Quarter of the
State are also working under the direct control of Director to ensure quality of works
being executed in the Distt.

4.3 Conduct of Traffic Census
The Deptt. has independent Traffic Engineering Cell to conduct the traffic census
on N.H., Plan Road and ODR to assess the growth of traffic and the data is being used
for planning and design of roads. The Traffic Engg. Cell is headed by Superintending
Engineer assisted by 8 Nos. numerators. The 49 count point has already been
established on N.H.
4.4 Construction of Cinema Building
The construction of cinema building by private owners is governed by the Punjab
cinemas (Regulation) Rules, 1952 issued under Section 9 of the Punjab Cinema
(Regulation) Act, 1952. In order that the buildings should conform to the provision of
the said Rules and that there may be no inherent structural defect which may
subsequently constitute a bar against the issue of licence when applied for, the prior
approval of the building plan by the Executive Engineer concerned is necessary.
In the case of unbuilt areas the sitting of the cinema building should be settled in
consultation with the town planning scheme as may eventually be framed in respect of
the said area.

along National Highways. Sir, Ministry had issued guidelines on “System Improvement of Installation of Petrol /
Diesel / Gas-Retail outlets and Service Stations as well as access to Private
Properties along National Highways” through its Circular No. RW/NH-
33023/19/99-DO-III dated 31st August 2000. Improvement in the highway
network show that there is greater need for road safety for its users. Stricter
enforcement is also necessary.
2. Therefore the Ministry has now evolved the norms for access to fuel stations
along the National Highways. This is modification of the earlier circulars /
publication of the Ministry / IRC. These norms cover the most common

situations. Any complex situation would have to be dealt with through traffic
expert for an appropriate solutions.
3. Generally speaking, the fuel stationsshould be a part of the Rest Area Complex,
Rest areas should have various other amenities for users e.g. place for parking,
toilets, restaurant, rest rooms, kiosk for selling sundry items etc. This aspect
should be incorporated while planning for improvement and up gradation of the
National Highway Sections and / or planning for new fuel stations along National
Highways. The rest area complex be planned subject to the commercial viability.
4. In case of service roads having been constructed, the access to the fuel station
shall be from service roads and not from the main carriageway. This respect has
to be kept into consideration while planning for location of new fuel stations.
5. The Norms are enclosed at Appendix-I, which shall be followed for seeking and
granting permission for the access to the new fuel stations. It shall be the
responsibility of the Oil Company / Owner to ensure that the proposed location
and other features of fuel stations are in conformity with these Norms.
Otherwise, the proposal would be rejected.
6. The cases for granting permission for access to new fuel stations, service
stations and rest areas along National Highways shall, henceforth be dealt with
in accordance with the Norms prescribed in Appendix-I to this circular. The main
features of the Norms are listed below.
6.1 For the siting of fuel stations along National Highways, its minimum distance
from an intersection would be:

6.5 The entry to fuel station shall be through deceleration lane of minimum length of
70m and width of 5.5m, the exit through acceleration lane of minimum length of
100m and width of 5.5m.
6.6 The pavement composition of these acceleration / deceleration lanes and service
road (if provided) would comprise Granular Sub Base (GSB) with minimum
thickness of 150mm, three layers of Water Bound Macadam (WBM) of 75mm
thick each, Bituminous Macadam (BM) of 50mm thickness and Semi Dense
Bituminous Concrete (SDBC) of 25mm thickness.
6.7 The access lanes, service road and separator island in the layout would be
accommodated within the available ROW of the highway but fuel pumps would
be located beyond building line. The fuel station office building etc. shall be
located at the safe distance as prescribed by the Fire Department or other
authorities.
6.8 The acceleration, deceleration lane, service roads, drainage system, signs and
marking shall be constructed and maintained by the Oil Company / owner of the
fuel station at his cost and responsibility during the period of licence deed.
6.9 Permission would be granted within 30 days of the receipt of the application on
the field office, if it meets all the requirements of the norms contained in the
circular.
6.10 The Oil Company / owner shall have to enter into an Agreement for the licence
deed with the Government (Ministry of Road Transport and Highways – MORTH),
for the use of NH land. There would be one time fee of Rs. 1 lakh in
consideration of this Agreement. The validity of the Agreement would be for a
period of 15 years.
6.11 The default or non-conformity of these norms for the fuel station, approaches,
drainage, traffic control devices etc. would be identified and determined through
joint inspection by the representatives of the concerned Oil Company and the
field officer incharge of the NH section. If the deficiencies are not rectified within
the specified time frame, the oil company would be asked to de-energize the fuel

station and re-energizing would be done only on complete rectification and on
the authorization by the field officer incharge of the NH section.
7. These norms will be applicable to all new fuel stations from the date of the issue
of this circular. Its content may be brought to the notice of all the concerned
officers of your Department / Organization.

APPENDIX – I

NORMS FOR LOCATION, LAYOUT AND ACCESS TO FUEL STATIONS ALONG NATIONAL HIGHWAYS.
1. These norms have been finalized in substantial modification of IRC: 12-1983,
‘Recommended Practice for Location and Layout of Road Side Motor, Fuel Filling-
cum-Service Stations’ and the Ministry’s Circular No. RW/NH-33023/19/99-DOIII
dated 31.08.2000 on ‘Systems Improvement for Installation of Petrol / Diesel /
Gas Retail outlets and service stations as well as access to private properties
along National Highway’. These norms shall be applicable to all new fuel stations
with effect from the date of issue of this circular.
2. Petrol / Diesel retail outlets and service stations with or without Rest Area
Amenities etc. are hereinafter referred to as Fuel Stations.
3. These norms are applicable to all Fuel Stations with or without other user
facilities of rest areas, along un-divided carriageway and divided carriageway
sections of National Highways in plain, rolling and hilly terrain and passing
through urban stretches. For this purpose hilly or mountain terrain would be,
when the cross slope of the country is more than 25%. The urban stretches
would be, where National Highway passes through a town of population of
20,000 and more (Census 2001 will apply)
4. General Conditions of Siting
4.1 The fuel stations would be located where the highway alignment and profile are
favourable i.e. where the grounds are practically level, there are no sharp curves
(having radius of less than 230m in plains and 60m in hilly terrain) or steep
grades (more than 5%) and where sight distances would be adequate for safe
traffic operations. The location would not interfere with placement and proper

functioning of highways signs, signals, lighting or other devices that affect traffic
operation.
4.2 While considering the proposal for new fuel stations it would be ensured that the
fuel stations on a corridor are well disturbed on both sides of the highways so
that vehicles normally do not have to cut across the traffic to reach them. The
fuel stations would be serving only the traffic moving on the adjustment lane.
For the vehicles traveling in the lanes in opposite direction, separate fuel stations
needs to be planned for which permission would be considered keeping also in
view of its location and distance norms.
4.3 In order to provide safe length for weaving of traffic, fuel station along National
Highways shall be located at the minimum distance from an intersection (gap in
the central median be treated as intersection) as given below. For single
carriageway section, these minimum distances would be applicable for both
sides.
4.3.1 Non-Urban (Rural) Stretches
1 Plain and Rolling Terrain

4.4 The minimum distance between two fuel stations along the National
Highway would be as given below:-

4.4.3 If two or more fuel stations are to be sited in close proximity for some reasons
these would be grouped together to have a common access through a service
road of 7.0m width and connected to the highway through acceleration,
deceleration lanes. From these considerations, the permission for the new fuel
stations would be considered only if it is either in proximity to the existing one so
that the common access can be provided or the new one located at the distance
of more than 1000m.
4.4.4 For installation of new fuel station within the 1000m distance of existing fuel
station in plain / rolling terrain and 300m in hilly / mountains terrain and urban
stretch, new road, deceleration and acceleration lanes, drainage and traffic
control devices. In case of hilly / mountainous terrain, common service roads at

all the such location may not be possible as per the site conditions and therefore
common access through service roads would not be a pre-condition.
4.5 The fuel station would not be located within the distance of 1000m from any
barrier including that of toll plaza. No check barrier / toll plaza should be located
within 1000m of a fuel station.
5. Plot size for fuel station.
5.1 The size and shape of the plot for the fuel station would need to be such that it
suitable accommodates fuel pumps, offices, stores, compressor room, air pump
and kiosks without causing any hindrance to the movement of vehicles of
expected maximum dimensions, within fuel stations and in the access area.
Sufficient space would need to be available to accommodate the number of fuel
pumps to cater to the expected number of vehicles in peak time at this location
so that the vehicles do not spill on to the access area. The air pump and kiosks
for pollution control measurements be installed at some distance from the fuel
pumps so that the vehicles requiring these services do not cause hindrance to
the free movement of vehicles entering or existing for refueling.
5.2 From these considerations, the minimum size of the plot for fuel station along
National Highways shall be as follows:-
(i) On undivided carriageway in plain and rolling terrain 35m x 35m
(ii) On divided carriageway in plain / rolling terrain 35m (frontage) x 45m
(iii) In hilly and mountainous terrain 20m x 20m
(iv) In urban stretches 20m x 20m
5.3 For fuel station being part of the rest area complex, the area required for other
facilities such as parking, restaurant, rest rooms, toilets and shops etc. would be
extra but there would be a single access.
Access Layout Access for New Fuel Stations along Un-divided Carriageway Sections
6.1.1 The access to the fuel stations along un-divided carriageway sections of National
Highway shall be through deceleration and acceleration lanes.
6.1.2 The deceleration lane would take off from the edge of the paved shoulder and
taken up to the edge of the Right of Way (ROW) of National Highway, beyond
which the boundary of fuel station shall start. Its minimum length would be 70m

measured along the traveled direction of highway. Its width would be minimum
5.5m. The shoulder of 2.25m would be provided for this deceleration lane.
6.1.3 The acceleration lane would take off from the edge of the fuel station on exit
side having minimum length of 100m with parallel type layout. Its starting
stretch of 70m length would be with a curvature of minimum radius of 650m and
the remaining 30m length would be tapered so as to facilitate vehicles coming
out of fuel station, merging with fast moving through traffic on main
carriageway, in a safe and efficient manner.
6.1.4 A separator island would be provided in front of the fuel station so that no right
turning take place. The length of this separator island would be determined on
the basis of the intersecting points of the edge line of the separator island with
the line drawn along the edge of chevron markings as indicated in Figures 1 and
2 of these norms. Its shape for isolated fuel station would be as shown in Figure
1, and that for the cluster of fuel stations with common service roads, as shown
in Figure 2. It would have minimum width of 3m. The width of approaches
connecting deceleration and acceleration lanes, along the separator island should
be 5.5m.
6.1.5 There would be buffer strip from the edge of the ROW and would extend
minimum 3m inside the fuel station plot. Its minimum length would be 12m. No
structure or hoarding except the approved standard identification sign on pole
would be permitted, which may be provided outside the ROW. The buffer strip as
well as the separator island would be provided with kerb of minimum 275mm
height to prevent vehicles from crossing it or using it for parking purpose.
The buffer strip in the approach zone should be suitable shaped to cover
extra area in the approach zone after provision of acceleration, deceleration lane
and connecting approaches and should be properly turfed for aesthetic
landscaping.
6.1.6 The radius for turning curve would be 13m and that for non-turning curve be
from 1.5 to 3m so as to check over speeding while entering or existing the fuel
station.
6.1.7 The pavement of the access roads including deceleration, acceleration lanes and
connecting approaches would have sufficient designed strength for the expected

traffic. It would have minimum pavement composition of 150mm thick Granular
Sub Base (GSB) overlaid by three layers of Water Bound Macadam (WBM), each
of 75mm thickness topped by 50mm thick Bituminous Macadam (BM) and 25mm
thick Semi Dense Bituminous Carpet.
6.1.8 A typical access layout for the new fuel station with relevant details for
deceleration and acceleration lanes, connecting approaches, separator island,
buffer strip, drainage, signs and marking on un-divided carriageway section of
National Highway would be as shown in Fig. 1 of these norms.
6.1.9 The typical access layout for cluster of fuel stations, with details for deceleration
lane, service road and acceleration lane etc. would be as shown in Fig. 2 of these
Norms.
6.2 Access for New Fuel Stations on Divided Carriageway Sections.
6.2.1 The access to the fuel station on divided carriageway sections of National
Highways shall be through deceleration and acceleration lanes.
6.2.2 The deceleration lane would take off from the edge of the paved shoulder and
taken upto the edge of ROW, where from the boundary of fuel station would
start. Its length would be 70m measured along the travel direction on the
highway. The acceleration lane would be of 100m length. Its starting stretch of
70m length would be with a curvature of minimum radius of 650m and the
remaining 30m tapered so as to facilitate vehicles coming out of fuel stations,
merging with fast moving through traffic on main carriageway in a safe manner.
The width of deceleration and acceleration lane shall be 5.5m with shoulders of
2.25m.
6.2.3 A separator island would be provided in front of the fuel station. The length of
this separator island would be determined on the basis of the intersecting points
of the edge line of the separator island with the line drawn along the edge of
chevron markings as indicated in Figs. 3 and 4. Its shape for isolated fuel station
would be shown as Figs. 3 and that for the cluster of fuel stations with common
service roads, as shown in Fig. 4. It would have minimum width of 3 m. The
width approaches connecting deceleration and acceleration lanes along separator
island should be 5.5m.

minimum 3m inside the fuel station plot. Its minimum length would be 12m. No

traffic. It would have minimum pavement composition of 150mm thick GSB
overlaid by three layers of WBM, each of 75mm thickness, topped by 50mm thick
BM and 25mm thick SDBC.
6.2.7 The typical access layout for the new fuel station with relevant details for
deceleration / acceleration lanes connecting approaches, separator island buffer
strip, drainage, signs and marking on divided carriageway sections of National
Highway would be as shown in Fig. 3 of these norms.
6.2.8 The access for cluster of Fuel Stations situated in close proximity shall be
through deceleration lane, service road and acceleration lane as shown in Fig. 4
of these norms.
6.3 The typical layout for fuel station and signs and marking along National
Highways in hilly / mountains terrains and in urban stretches is given
in Fig. 5.
7. Drainage
There shall be adequate drainage system of the access to the fuel station and
inside its area so as to ensure that surface water does not flow over the highway
or any water logging takes place. For this purpose, the fuel station and access

area would be at least 150mm below the level at the edge of the highway. The
surface water from fuel station and access road would need to be collected in a
suitable underground drainage system and led away to a natural course through
culvert. Preferable slab culvert with iron granting of adequate strength may be
constructed in the approaches so that surface water is drained through the holes
in the grating. If pipe culvert is used, then it would be ensured that the inner
diameter of the pipe is not less than 1m for proper cleaning and necessary
shallow drains are constructed along the access road and at the edge of the fuel
station so that the surface water is led to the open drain. The drainage
arrangement would be either by the method mentioned above or as per the
satisfaction of the Highway Authorities / Ministry.
8. Enforcement of Right of Way and Building Line
The widths of Right of Way (ROW) has been prescribed as 40m to 60m, whereas
that for building lines as 80m in plain and rolling terrain, in IRC:73-1980,
‘Geometric Design Standards for Rural (Non-Urban) Highways. In hilly /
mountains terrain and urban stretches, the width of building line has been
prescribed as 70m. While planning the layout for various facilities inside the fuel
stations, it has to be ensured that fuel pumps are located beyond the building
lines and fuel station office building etc. at a safe distance as prescribed by Fire
Department or other authorities. The buffer strip would extend minimum 3m
inside the Fuel Station plot, beyond ROW
9. System for Signs and Markings
9.1 An adequate system for signs and marking would be provided at the locations of
fuel stations for the guidance of the highway users. The pavement markings
would be in form of chevron at entry and exit locations, give way for the exit
from the fuel station. Informatory sign for fuel station would be provided at 1Km
ahead, 500m ahead and at the entry point.
9.2 On undivided carriageway, additional signs for the regulation of entry and exit of
the vehicular traffic should be provided on the separator island. Also an
informatory sign should be installed showing the distance of the nearest Fuel
Station located in the direction of travel in order to avoid any need for right
turnings for accessing the Fuel Station located on the opposite side. The sign

should be installed at the location of about 200m ahead of the opposite side fuel
station.
9.3 The pavement markings would conform to IRC:35-1997, ‘Code of Practice for
Road Markings’ and Road signs to IRC:67-2001, ‘Code of Practice for Road Signs’
and IRC:SP:55-2001, ‘Guidelines on Safety in Road construction Zones’.
9.4 These should be as per Sections 801 and 803 of Ministry’s Specifications for
Road and Bridge Works, 2001 as updated from time to time.
9.5 The system for signs and markings with their type and locations would be as
shown in Figures 1,2,3 and 4 for the chosen access layout.
10. Implementation Procedure
10.1 Ministry of Petroleum and Natural Gas / Oil Companies while entering any
application for the installation of Fuel Station, would supply a copy of these
norms to the applicant so that he may assess his position to fulfill the
requirements of these norms. Ministry of Petroleum and Natural Gas / Oil
Companies would ensures that the plot identified by the applicant conforms to
the requirement of these norms in terms of its location, access layout and signs
and markings. It shall also be the responsibility of the applicant / owner of Fuel
Station to provide the prescribed layout for access as given in Figs. 1/2/3/4/5, as
the case may be while preparing the layout.
10.2 For the Fuel Stations along the National Highways vested with NHAI, the field
units of NHAI would examine the drawings and documents to ensure that the
location and layout conform to these norms. Thereafter these would be
forwarded to the Headquarters of NHAI who in turn would forward the case to
concerned Chief Engineer of the Ministry with definite recommendations and the
documents as per Annexure I and the checklist at Annexure II of the circular.
10.3 For Fuel Stations along the National Highways other that those with the NHAI,
the concerned Executive Engineer of State PWD / BRO would examine the
drawings and documents as listed in Annex I and the Checklist at Annex II of this
Circular would be forwarded, through Chief Engineer of the State PWD/BRO, to
the Regional Officer (RO) of Ministry of Road Transport and Highways. The RO
after ensuring the fulfillment of the requirements of this circular and norms
would then forward the proposal along with prescribed documents and checklist,

to the Ministry and approval given by the Project Chief Engineer (dealing with
the State), on the merit of the case.
10.4 A License Deed would be required to the signed between the Oil Company
wanting to install the Fuel Station (Licensee), and Government of India through
their designated officers. The specimen copy of the licence deed is enclosed at
Annex-III.
10.5 The licence deed would be drawn on a non-judicial stamp paper and all expenses
in this regard be borne by the licensee. A one time fee of Rs. 1,00,000/- (Rupees
one lakh only) would be payable by the licensee to the Government in
consideration of this Agreement for the land for which the license is issued. The
license deed is not required to be registered. This fee amount would be paid
through a Demand Draft in favour of the concerned Pay & Accounts Officer of
the Ministry of Road Transport and Highways and would be debitable to the
Major Head 1054 (Revenue Receipt Head).
10.6 The No objection Certificate by the Licensing Authority, through their field units,
would be issued and construction permitted only after the necessary approval
has been given by Ministry license duly signed and delivered.
10.7 The approval for setting up of fuel stations would be given within 30 days from
the date of receipt of the application if it conforms to all the stipulations of the
norms. In case of any query, the date when the resubmitted application is
received would be treated as the date of receipt. All the queries would be raised
at one time only. The construction would commence only on the receipt of the
approval.
10.8 The Licence Deed shall also be signed, within 30 days of the submission of the
application in the field office if it fulfils all the requirements as mentioned above,
between MORTH and Oil Company only, irrespective of the dealership type.
10.9 Oil Companies / owner shall be responsible for the construction and maintenance
of deceleration / acceleration lances, service roads, channelisers, drainage
arrangement, signs and markings in accordance with the approved layout and
specifications conforming to these norms, at his own cost. On completion of the
construction in accordance with checklist and conforming to the approvals, a
Completion Certificate would be issued by the field unit of NHAI/PWD/BRO/ or

any other agency (as the case may be). The concerned Oil Company would be
allowed to energize the fuel station only after the issue of such a certificate.
10.10 The validity of the Licence Deed for the use of National Highway land for access
to fuel station would be for a period of fifteen years after which the same would
be required to be renewed which could be for a similar period. During this
validity period, the owner shall maintain in good condition the deceleration /
acceleration lances, service roads (free from any potholes/patches), drainage
arrangement (clean conditions to allow full discharge of storm water), signs and
markings (existing at identified location with clear required visibility).
10.11 Non conformity or any default in respect of the norms and as indicated in Para 1
to 9, Para 10.9 and Para 10.10 above would make the fuel station liable to be
de-energized. In cases of clustered fuel stations, responsibility for default or non-
conformity to attract such penalty would be determined through a joint
inspection. In such cases, the procedure prescribed in Para 10.12 below would
be adopted.
10.12 In cases of defaults (s) found by Highway Authority, joint inspection by the
representative of the concerned Oil Company and the Field officer incharge of
that NH section would be undertaken to identify each deficiency and time frame
for its rectification which in no case should exceed 60 days from the date of joint
inspection. The failure to rectify the identified deficiencies within the prescribed
time would lead to de-energizing the petrol pump by the concerned Oil
Company. The re-energizing would be done only on complete rectification and on
the authorization by Field Officer, incharge of NH section.

pay necessary fee for the use of the National Highway land whenever the fee
is asked by the Highway Authorities in future.

removal/shifting of the approach roads at its own cost if so required by

LICENSE FOR THE USE OF NATIONAL HIGHWAY LAND

thousand_____________ between the President of India (hereinafter called the
Government which expression shall, unless excluded by or repugnant to the context,
include his successors in Office and assigns) of the one part and (name and address of
Oil Company) hereinafter called “the Licensee”/”the Licensees” (which expression shall,
unless excluded by or repugnant to the context, include the said licensee’s
successor/Licensees successors, heirs, executors, administrators and assigns) of the
other part.
2. WHEREAS THE Licensee has/licensees have applied to the Government for
permission to construct on the Government land an approach road with
necessary provision for drainage, signs and markings to his/their property
abutting on the boundary of ____________________________________ in
Kilometer ____________________ in the _____________________ Taluka of
the _______________________________ District more particularly described in
the Schedule annexed hereto shown in the drawing attached hereto (hereinafter
referred to as “the said premises”).
3. AND WHEREAS THE GOVERNMENT have agreed to grant such permission on the
terms and conditions hereinafter mentioned.
4. Now, this Agreement withnesseth that, in consideration of the terms and
conditions hereinafter contained and on the part of the licensee/licensees to be
observed and perfumed, the Government hereby grants to be licensee/licensees
permission to construct an access/approach road with necessary drainage works,
signs and markings to the said premises as per approved drawings attached
subject to the following terms and conditions, namely:-

( 66 )
i That the licensee/licensees shall within three months from date of receipt of the
permission, but without interfering in anyway with the highway traffic, complete
the construction of the approach and (including deceleration/acceleration lanes)
and shall make provision for drainage, signs and markings at his own cost and to
the full satisfaction of the Executive Engineer/Divisional Engineer in-chare/Project
Director in-charge of the National Highway according to the approved drawings
and specifications. The said approach road shall not be brought into use after its
completion until the Executive Engineer/Divisional Engineer/Project Director,
Government /NHAI gives a completion certificate after satisfying himself that it
has been completed as per the sanctioned drawings and specifications. The Fuel
Station would be energized by the concerned oil company only after completion
certificate has been issued by the Highway Authority.
ii That on the completion of the said work, that part of the approach road, which
lies within the limits of Government road land together with any culvert of drain
therein constructed shall become the absolute property of the Government
subject to the rights of the licensee/licensees to use the same for ingress and
egress.
iii The licensee/licensees shall at his/their own cost keep the said approach road,
and any culvert or drain therein, in proper repair and condition to the satisfaction
of the Executive Engineer/Divisional Engineer, Government/Project Director,
NHAI. The approach roads would be considered in proper conditions when they
are fee from potholes and patches. The culverts and drains would be kept in
clean conditions to allow full discharge of the storm water, signs and markings to
be kept at their respective locations and in clean condition for visibility at all
times
iv That within Six months of a notice duly given to the licensee/licensees in this
behalf, the licensee/licensees shall at his /their own cost remove the said
approach road or any drainage work constructed in connection therewith and
restore the land to its original condition when required to do so by the
Government or by any person duly authrised on its behalf. The
Licensee/licensees shall not be entitled to any compensation on account of such
removal and restoration.

( 67 )
v That the approach road shall not be used for any purpose other than that of
access to and egress from the premises of the licensee/licensees on to the
Government road.
vi That the licensee/licensees shall not, without the prior permission in writing of
the Executive Engineer/Divisional Engineer, (Government)/ Project Director
(NHAI) in any way extend or alter the said approach road or any culvert or
drainage therein.
vii That the licensee/licensees shall at all times permit any duly authorized officer or
servant of the Government /NHAI to inspect the said approach road including
any culvert or drainage therein. He shall keep the said approach road clear and
shall not be entitled to close any right of way over or in respect of the same
against Government, or any member of the public.
viii That the licensee/licensees shall be liable for any loss or damage caused to the
Government by drain obstruction or any other like cause due to the said
approach road or the drainage work.
ix That the permission granted by this license shall not in any way be deemed to
convey to the licensee/licensees any right into or over, or any interest in
Government land other than that herein expressly granted.
x That in case the said approach road is destroyed this license shall determine and
the licensee/licensees shall not be claim any right to construct another approach
road in lieu of that so destroyed.
xi That, during the subsistence of this license, the said approach road including the
road drainage shall be deemed to have been constructed only by the consent
and permission of the Government so that the right of the licensee/licensees to
use the same shall not become absolute and indefeasible by lapse of time.
xii That, if the licensee fails/licensees fail to execute any work which he has /they
have agreed under this agreement to the full satisfaction of the Executive
Engineer/Divisional Engineer, Government/Project Director, NHAI, the work shall
be executed by the Executive Engineer/Divisional Engineer/GM/DGM at the cost
of licensee/licensees; and the expenditure incurred shall be recoverable from the
licensee as an arrear of land revenue without prejudice to any other remedies
which may be open to Government in this behalf.

xiii That the licensee/licensees shall not sell, transfer or otherwise dispose of the
premises without obtaining from the transferee a duly executed agreement with
the Government embodying the terms and conditions herein before.
xiv A one time fee of Rs. 1,00,000/- (Rupees one lakh only) shall be payable to
execute this Agreement for the land for which the license is issued.
xv That if and when parallel service roads are constructed the access to fuel station
shall be from the service road alone as determined by the Executive
Engineer/Divisional Engineer/GM/DGM and no claim / compensation shall be
entertained on the account.
xvi That this Agreement shall remain in force for fifteen years from the date of
execution in the first instance and be terminable by a notice of 6 months and the
permission may or may not be renewed after expiry of the said period.
xvii That the licence hereby granted shall not be transferable.
xviii That the licensee/licensees shall bear the cost of Stamp and attestation of this
Agreement.
5. Situations given below would be treated as violations of the license deed
agreement and the Government would be within its right to ask the concerned
Oil Company to de-energize the Fuel Station.
i Non-maintenance of deceleration lane, acceleration lane service road, drainage
system, channelisers, markings, signs and other traffic control devices in good
operating conditions (as specified in Para 4 (iii), during the period of license deed
and not rectifying the short comings within the specified period as pointed out by
Executive Engineer/ Divisional Engineer/ PD, NHAI, incharge of the National
Highway Section.
ii Non-compliance for revising the layout of access as directed by Executive
Engineer/ Divisional Engineer incharge/ Field Unit (NHAI) of the National
Highway Section in writing within specified period.
6. Not-withstanding anything contained in clause 4, this licence can be cancelled at
any time by the licensor through the Executive / Divisional Engineer for breach of
any of the terms and conditions of license and the licensee/licensees shall not be
entitled to any compensation for loss caused to him/them by such cancellation
nor shall be absolved from any liability already incurred by him/them under this
Section - IV

Agreement. The licensee/licensees shall at his/their own cost remove approach
road lying within the boundary of the Government land and restore the
Government land to its original condition. In the event of licensee/licensees
refusing to do so, the restoration of the Government to its original condition shall
be done by the Executive Engineer/Divisional Engineer, at the cost of
licensee/licensees and the expenditure incurred shall be recoverable from the
licensee/licensees as an arrear without prejudice to any other remedies which
may be fixed by Government in this behalf.
7. This Agreement they be executed in two counterparts, each of which when
executed and delivered shall constitute an original of this Agreement.

fuel stations and rest area along National Highways which has already been circulated
vide this office letter of even number dated 4th November, 2003. As per the revised
guide lines an inspection report of the officer inspecting the site of the proposed fuel
Stations needs to be submitted with the proposal. It is requested to enclose an
inspection report of the inspecting officer (not lower than Executive Engineer) in the
format enclosed here with along with all the new proposals which will be submitted in
future. This may be brought to the notice of all field officers up to the rank of Executive
Engineers.

Revised instructions regarding enlistment of contractors in Punjab PWD
(B&R)
These instructions shall be referred to as appendix 7-C of B&R manual of
instructions and substitute the existing provisions of instructions issued vide
correction slip No. 1 dated 01.09.1973.
1. Applicability:-
Any Indian Individual, Sole Proprietorship Firm, Partnership Firm, Public
Limited Company or a Private Limited Company, Cooperative Labour &
Construction Society is entitled to get enlistment as a contractor in PWD (B&R)
under these instructions provided the eligibility and other conditions are satisfied.
The enlisted contractors have to abide by all the instructions made herein and as
amended from time to time during the currency of their enlistment.
No individual, or a firm having such individual as one of the partners, who
is a dismissed government servant; or removed from the approved list of
contractors, or demoted to lower class; or having business banned/suspended by
any government department in the past; or convicted by a court of law shall be
entitled for enlistment.
No Engineer or any other official employed in Engineering or
Administrative duties in the Engineering Department of the Government or
Punjab State undertaking is allowed to work in the PWD(B&R) Department either
as contractor or as employee of a contractor for a period of three year after his
retirement from Government service unless he has obtained prior permission of
Government of Punjab to do so. Even after enlistment, if either the contractor or
any of his employees is found to be a person who had not

obtained the prior permission of Government of Punjab as aforesaid, the name of
the contractor shall be removed from the list of enlisted contractors.
A contractor is permitted to have enlistment in more than one category
and under more than one enlistment authority but not in more than one class of
the same category in PWD (B&R).
A contractor is not permitted to have enlistment in more than one name.
A partner of a firm or a director of a company enlisted as a contractor
cannot be a partner/director in any other enlisted firm/company.
The enlistment of a contractor in PWD (B&R) shall only entitle him to be
considered for issue of tender papers subject to the conditions laid down in each
individual Notice inviting Tenders. It shall not confer any right on him either to
be necessarily issued the tender papers or for award of work.
2. Enlistment Procedure:-
The intending contractor shall have to submit the application in a
prescribed form (Annexure-I) to the enlistment authority complete with all
documents as per Annexure-II. The Application form shall be available upon
payment of Rs. 200.00 from any Divisional Office of PWD (B&R) in the form of
crossed demand draft drawn in the name of Joint Secretary, Punjab Roads &
Bridges Development Board payable at Chandigarh.
Incomplete applications and applications not accompanied with necessary
documents are liable to be rejected.
If the decision regarding enlistment is not conveyed within six months of
date of receipt of application, for any reason not attributable to the contractor, a
provisional enlistment for one year may be granted
the contractor. Such provisional enlistment may be cancelled without
any notice if the contractor is subsequently found unfit for enlistment in the
Department.
The enlistment authority shall have the right to independently verify the
details furnished by the contractors and to get works done by the contractor
inspected and/or to get such other reports as may be considered necessary

Ordinarily works executed in PWD (B&R) Department need not be inspected. The
inspection teams for inspecting the non PWD (B&R) works of the contractor shall
furnish their report on Quality of construction, workmanship etc. & make specific
recommendations to the enlistment authority. The inspections recommendations
committee will consist of following:-
(a) For Class I Enlistment
• A Committee consisting of One Superintending Engineer and two
Executive Engineers.
(b) For Class II Enlistment
• A Committee consisting of Two Executive Engineers and a Sub
Divisional Engineer.
(c) For Class III Enlistment
• A Committee consisting of One Executive Engineer and Two Sub
Divisional Engineers.
(d) For Class IV Enlistment
• No Committee is required.
If the enlistment authority finds the contractor suitable for enlistment, it
shall issue the enlistment order and otherwise, send a letter of rejection of the
application to the contractor. The decision of the enlistment authority shall be
final and binding on the applicant. Refund to the extent of 50% of the enlistment
fee remitted with the application shall be made to such applicants.
Notwithstanding above procedure, if the applicant contractor for Class-IV
(Civil), Class-IV (Elect.) and Class-IV (Furniture) does not have the required
experience, he shall be enlisted provisional for
one year, after fulfilling the requirement of financial soundness. During which he
shall have to secure work of required magnitude to become eligible for
regularization of the enlistment. On satisfactory completion of the work his
enlistment may be regularized for two years from the date of initial provisional
enlistment depending upon his performance on the work. In case the contractor
is not able to secure any work PWD during the year, his enlistment shall be
cancelled and he shall be debarred from applying afresh for enlistment for two

years. The enlistment fee for provisional enlistment for one year shall be 50% of
the enlistment fee for regular enlistment.
3. Period of enlistment:-
The enlistment shall be valid for a period of two years. The enlistment
can, however, be revalidated in accordance with rules in this regard. Each
revalidation shall be for a period of two years from the date of expiry of the
previous enlistment/revalidation. The enlistment shall be open to review by the
enlistment authority and liable to termination, suspension or any other such
actions at any time if considered necessary by the enlistment authority, after
issue, show cause notice.
4. Enlistment Authority, Categories & Classes
The Enlistment authority, categories and classes along with eligibility
criteria are given in Table-I. Enlistment authority shall be the SE/EE as per
competency in whose jurisdiction the applicant will have his proof of residence.
In case of companies/firms location of Head/Branch office shall be considered for
enlistment. For Chandigarh, Panchkula SE Chandigarh shall be the competent
authority.
5. Jurisdiction and Tendering Limits:-
The contractors enlisted as class-I shall be entitled to tender in State of
Punjab, Delhi and Shimla (for Punjab works only) & others in
respective circles where enlisted for various works being executed by PWD (B&R)
Branch and the tendering limit upto which they shall be eligible to tender shall be
as given in Table-I. The contractor shall be governed by rules provisions and
instructions existing at a particular point of time irrespective of when he was
enlisted.
6. Eligibility Criteria
The contractors shall have to satisfy the minimum eligibility criteria
specified in Table-I, before they can be considered for enlistment.
The criterion for experience shall be the execution and completion of
three or two works, satisfactorily as the case may be, of prescribed nature and

magnitude on agreement basis, during the last five years. The works should
have been executed in the same name & style in which the enlistment is sought.
The financial soundness shall be judged on the basis of the solvency
certificate issued by the Bankers of the contractors on the format prescribed in
Annexure-V. Such certificate shall be issued by a scheduled bank and shall be
submitted, in original, in a Bank sealed cover, addressed to the enlistment
authority.
The criteria for the experience and financial soundness existing on the
date of receipt of application by enlistment authority as indicated for each class
and category Table-I shall be applicable.
7. Enlistment Fee
The intending contractor shall forward the completed applications to the
enlisting authority along with a non-refundable enlistment fee by crossed
Demand Draft drawn in favour of the Joint Secretary, Punjab Roads & Bridges
Development Board payable at Chandigarh. For various categories and classes of
enlistment, the fee is as below. This fee is to be submitted alongwith application
form to the enlisting authority.
(A) Class I Rs. 25,000/-
(B) Class II Rs. 15,000/-
(C) Class III Rs. 10,000/-
(D) Class IV Rs. 5,000/-
The fees for enlistment of Cooperative Labour & Construction Society shall be
50% of the above fees for each category.
In the case of such applicant whose application of enlistment is rejected
by the Enlistment authority, amount to the extent of 50% of the enlistment fee
remitted with the application shall be refunded.
The fees for revalidation of Enlistment shall be the same as per new
enlistment.
Funds collected by way of sale of application form and fees for
Enlistment/Revalidation of Enlistments with Punjab Roads & Bridges
Development Board, shall be utilized for construction, improvement renovation of

existing Offices & Residences & automation of Offices of Punjab PWD (B&R)
Department.
8. Income Tax Clearance
The contractor shall produce a valid Income Tax Clearance Certificate
(ITCC), along with his application for enlistment. After enlistment, he shall have
to apply to the Income Tax Department for issue of ITCC in the month of May
every year and submit the same or an attested copy thereof to the enlistment
authority by the end of June every year. Failure to submit the ITCC in this
manner without any justifiable reason will render the contractor liable to be
removed from the approved list of contractors. In case of partnership firms, the
names of all the partners should be mentioned in the ITCC.
9. Sales Tax Clearance
The contractor shall produce a valid Sales Tax Clearance Certificate along
with his application for enlistment. After enlistment he shall have to apply to the
Sales Tax Department for issue of No Objection/Sales Tax Clearance Certificate
in the month of May every year and submit the same or an attested copy thereof
to the enlistment authority by the end of June every year. Failure to do so
without any justifiable reason will render the contractor liable to be removed
from the approved list of contractors. In case of partnership firms, the names of
all the partners should be mentioned in the certificate.
10. Electrical License
The intending contractors of Electrical category shall have to produce
valid electrical license from the Chief Electrical Inspector of the State of Punjab.
The license shall be kept valid throughout the period of enlistment by getting it
renewed at suitable intervals and submit an attested copy of the same to the
enlistment authority after each renewal.
11. Change in Constitution of Firm
The contractor/firm/LC Society shall not modify the existing
partnership/membership or enter into any fresh partnership without the prior
approval of the enlistment authority. Such proposal, if any, shall be submitted in
advance giving full details of the intended partnership/sole proprietorship along
with the draft partnership deed/affidavit and documents as per Annexure-VI. Any

change in status of the contractor as an Individual or in constitution of the firm
without prior approval of the enlistment authority will render the
contractor/firm/LC Society liable to be removed from the approved list of
contractors.
If a firm is converted in two or more firms by any action of its partners,
the new firm(s) or any separated partner(s) in his (there) individual/joint
capacity shall have to apply for enlistment afresh and shall be governed by the
eligibility criteria given in Table-I.
If the partners are taken in the firm, the eligibility criteria mentioned in
Table-I shall be applicable.
If the number of original partners of a firm reduces to less than half due
to any reason including death of partner(s), the enlistment of the firm shall be
withdrawn and the remaining/surviving partners shall have to seek fresh
enlistment.
12. Change in Address
(a) While applying for enlistment, the contractor should mention
address of his Registered office as well as Head Office, if different. All
documents i.e. ITCC, Sale Tax ClearanceCertificate, Solvency Certificate,
Electrical License etc. should bear one such address, otherwise the same
shall not be accepted.
(b) The contractor shall intimate the change of address, if any in
advance or maximum within one month of such change. Failure to
do so may result in removal of the name of the contractor from
approved list of contractors.
13. Near Relatives Working in PWD (B&R)
Individual Contractors / Partners in a Partnership firm / members of Co-
operative L&C Society whose near relatives are Divisional Accountants or
Engineering Officers between the grades of Chief Engineer and Junior Engineer
(both inclusive) in the Public Works Department (B&R) Department shall not be
allowed to tender for works falling in the jurisdiction of the office responsible for
award and execution of contract where the near relative is working. For this
purpose, a near relative shall mean wife, husband, parents, grand parents,

children, grand children, brothers, sisters, first uncles, aunty, first cousins and
their corresponding in-laws.
14. Review of Approved List of Contractors
The contractor shall be required to secure works of appropriate
magnitude in PWD (B&R) Department, and other Department of the State during
the revalidation/enlistment period. Contractors shall liable to be black listed for
non-observance of enlistment rules. For this purpose the enlistment authority
shall have the power to periodically review the approved list of contractors.
15. Revalidation of Enlistment
The validity of initial enlistment of the contractor shall be as given in para
3 above. It shall, however, be revalidated on merits, if desired by the contractor.
Only the contractor who has secured at least one work of appropriate magnitude
in PWD (B&R) Department, Punjab Mandi Board, PUDA, Local bodies of Punjab
Government,
Chandigarh Administration during the period of enlistment or last revalidation
period of enlistment as the case may be, shall be considered for revalidation.
Application for Revalidation.
The contractor shall apply for revalidation of his enlistment in the
prescribed form (Annexure-VIII) along with all documents as per Annexure-IX,
so as to reach the enlistment authority at least 2 months before expiry of his
enlistment.
The fees for renewal in a particular category shall be 100% of the fee
required for fresh enlistment of that category.
The revalidation application with all documents shall however be
accepted upto the date of expiry of enlistment with late fee.
In cases where the application is received after date of expiry of
enlistment/revalidation, but within three months of expiry, the application can be
accepted with additional 20% of enlistment fees. Application received, thereafter,
shall not be accepted and contractor should apply for fresh enlistment, as per
instructions.
On receipt of application for revalidation, complete in all respects and
with all necessary documents, provisional extension into three months from the

date of expiry of the enlistment/date of issue of order/whichever is later may be
issued.
16. Performance Reports
The contractor should fill the details of each of the work, of appropriate
magnitude, secured by him during the list revalidation/enlistment period, in the
proforma as given in Annexure-VII.
The list should include all works secured by him during the above
mentioned period. In case, the contractor conceals any information, his
revalidation will be liable to be cancelled.
The contractor should fill up the details in the proforma as given in
‘Annexure-VII’, in duplicate. For each work, separate proforma should be filled.
One copy of all the proformas should be
given to the concerned Executive Engineer of the division, in which the work was
executed and the acknowledgement obtained on the second copy of the
proforma. This 2nd copy should then be submitted to the enlisting authority along
with the application for revalidation.
The Executive Engineer should fill up the proforma and submit to the
Enlistment Authority through his SE, within two weeks of receipt of proforma.
17. Revalidation Procedure
The revalidation shall be done on the basis of review of the performance
of the contractor pertaining to the period of enlistment/revalidation. Cases shall
be categorised and action taken as below:
(i) Category ‘A’ Enlistment of such contractors, who secured work(s) of
appropriate magnitude during the period of enlistment/revalidation shall be
considered for revalidation for a period of five years subject to evaluation of
their performance.
(ii) Category ‘B’ Enlistment of contractors, who secured work(s) of
appropriate magnitude recently, in the final year of their enlistment, because
of which the performance cannot be properly judged, shall be extended for one
year for watching the performance and then revalidated for four years, if
found satisfactory.
Section - IV

(iii) Category ‘C’ A contractor, who could not secure any work during the
enlistment period but submitted three or more tenders (out of which at least 2
tenders should be during, the first four years of enlistment/ revalidation) for
works of appropriate magnitude shall be eligible for extension of enlistment for
one year, provided he was among the three lowest tenders in at least one work,
so as to enable him to try to secure at least one work. After one year, he shall be
regularized in the following manner:-
(a) If he has not been able to secure any work of
appropriate magnitude during the extended one year
his enlistment shall stand cancelled and he shall be
entitled to apply for fresh enlistment only after one
year of expiry of his extended enlistment.
(b) If he has secured at least one work of appropriate
magnitude during the extended one year, he shall be
granted extension of one more year so as to watch his
performance. After this one year, when his
performance report is available, the same shall be
evaluated and if found satisfactory, the enlistment shall
be revalidated for three years.
For the purpose of (iii) above, the contractor should submit certificate in original from
the concerned Executive Engineer in the proforma as given in Annexure-X.
18. Contractor’s Obligations
The contractor should fulfill all his obligations in a manner as specified, failing
which he shall be liable for action as mentioned therein. Some of the obligations are
summarized below.
(a) Prior approval shall be obtained from the enlisting authority before changing
the constitution of the firm/company.
(b) Intimation of change of address should be given in advance or within one
month.
(c) He should obtain valid electrical license for the State.
(d) He should secure at least one work of specified magnitude during the period
of enlistment/revalidation.

(e) He shall abide by these rules.
(f) He should not indulge in unethical practices.
(g) He shall execute the works awarded to him strictly as per the terms and
conditions of the contract and specifications.
19. Disciplinary Actions
The contractor shall have to abide by all the rules/instructions of enlistments and
also by the terms and conditions of the contract and the Notice
Inviting Tenders. He shall have to execute the works satisfactory, on time and with good
quality. The enlisting authority shall have the right to demote a contractor to a lower
class, suspend business with him for any period, debar him or remove his name from
the approved list of contractors after issue of show cause notice. Decision of the
department shall be final and binding on the contractor. The following actions of the
contractor shall in general make him liable to disciplinary actions.
i) Demotion to a lower class: The contractor shall be liable to demotion to a
lower class, by the enlisting authority, if the:
(a) fails to execute a contract or executes it unsatisfactory or is
proved to be responsible for constructional defects; or.
(b) no longer has adequate equipment, technical personnel or
financial resources; or
(c) is litigious by nature; or
(d) violates any important condition of contract or
(e) is responsible for a conduct which may justify his demotion to
a lower class.
ii) Suspension of business:-The enlistment authority may suspend business with
a contract for indefinite period where, pending full enquiry into a allegations the
enlistment authority is prima facie of the view that the contractor is guilty of an offence
in relation to business dealings which, when established would result in his
removal/banning business and it is not considered desirable to entrust new works or
continue business with the contractor.
Removal from the approved list; the name of the contractor may be removed
from the approved list of contractors by the enlisting authority, if he

(a) has, on more than one occasion, failed to execute a contract or has
executed it unsatisfactorily; or
(b) is proved to be responsible for constructional defects in three or more
works or.
(c) has executed two or more works which was found to be substandard
during the course of departmental enquiry against delinquent officials; or
(d) persistently violates any important conditions of the contract or
(e) fails to abide by the conditions of enlistment or
(f) is found to have given false particulars at the time of enlistment; or
(g) has indulged in any type of forgery or falsification of records or
(h) changes constitution of the firm or individual without prior approval of the
enlistment authority or
(i) changes permanent address/business address without intimation to the
enlistment authority or
(j) is declared or is in the process of being declared bankrupt, insolvent,
wound up, dissolved or partitioned or
(k) persistently violates the labour regulations and rules, or
(l) is involved in complaints of serious nature received from other
departments which prima facie appear to be true; or
(m) Default in settlement of tax dues like income tax contract Tax, sales tax,
octroi, duties etc.
20. Revision/Modification of the instructions.
Secretary, Public work (B&R) may modify add. delete and/or
change any of the above instructions and same shall be binding on all enlisted
contractors.

The State Govt. has framed BOT policy to encourage the private participation in road sector. The major provisions of the policy/guidelines are as follows:
1. The Govt. of Punjab has existing Land Acquisition Act, which provides for
speedy acquisition of land. However, if Central Govt. enact a new
ordinance for acquisition of land and if the same is made applicable to the
states, that ordinance shall be adopted for BOT projects. The Govt. may
also acquire land through, negotiation with the land owner.
2. There is immediate need to widen/4-lane certain stretches of State roads,
Construction of Bridges & Rail Over Bridges, Grade separators, Bye
passes, maintenance, improvement, strengthening etc. since it is not
possible to undertake this task within budgetary resources, Govt. has
decided to invite private participation for this task and has also decided to
levy user fee (Toll) on completed projects.
3. In the case of B.O.T. projects, the financial liability of the State Govt.
would be negligible except in cases where continued toll collection is
frustrated by the changes in the policy of the Govt. or under exceptional,
circumstances or the force majeure. In such cases, the Govt. may
consider to compensate the entrepreneurs suitably.
4. In cases where B.O.T. projects attract foreign investment and foreign
investor seek rupee-dollar parity, Govt. may consider to provide for such a
risk in consultation with Central Govt.
5. Government have decided to constitute a high powered committee under
the Chairmanship of Chief Secretary to Govt. of Punjab with Secretary
Finance, Secretary to Revenue, Secretary Planning, Secretary Housing &
Urban Development, Secretary Public Works (B&R), Legal Remembrances
and Chief Engineer PWD (B&R) as member, to select B.O.T. projects, and
to regulate B.O.T. terms and conditions.
The salient features of the Government approved BOT guidelines for
private sector participations in the Highway Sector are:
- Invitation of “Licence Period” competitive bids.
- Government will bear the cost of :

a) Pre-feasibility studies. Detailed feasibility study may also be
conducted on case to case basis.
b) Acquisition of land for the project and assistance in acquisition
of land, if requested, for enroute facility and for real estate
development. Government may take the land through
negotiation with land owner.
c) Relocation of Utilities.
d) Environmental mitigation measures:
- Suitable provision relating to adjustment of toll fee structure for
inflation and exchange rate variations.
- Permitting development of highway facilities along side so as to
provide predetermined revenue sources for the entrepreneurs with tin
the frame work of Rules/Acts.
- Dispute resolution under Indian Arbitration Act, 1996.
- In the event of losses arising out of situation of exceptional
circumstances or force majeure, the Govt. may suitably compensate
the entrepreneurs on the basis of fair and balanced allocation of risks.

specifications. These rates are then approved for estimating and tender purposes
only. However, while allotment, the lowest competitive rates are allotted and
paid.

Civil Circle, Electrical Circle, Public Health, Irrigation Branch, Punjab State

fixed by the Labour Commissioner, Punjab and increase in rates as a result of

The enlistment of contractual agencies shortlisted to carry out the works in

based on capability of the contractual agency. The eligibility parameteres are
decided on contractual agencie’s experience in executing the work and its capital
power.

2) Issuance of No Objection Certificates to Fuel Stations, Service Stations
and rest area applicants:
The Deputy Commissioner of the concerned juridictioin where a petrol pump is
proposed to be set up issues permit to the applicants based on NOC received
from concerned departments including Public Works Department. For any petrol
pump to be installed along National Highways in the State, the Ministry of
Transport, Govt. of India issues the NOC. This NOC is issued by the concerned
Cabinet Minister of Transport, Govt. of India. For other roads like State
Highways, MDRs, ODRs and Link Roads, the NOC is issued by the Department of
Public Works, Punjab. This NOC is issued by the Minister Public Works, Punjab.
The norms to be followed for issuing No Object Certificates to Fuel Stations,
Service Statiosn and rest areas location layout and its access have already been
mentioned in Section IV.
2) Issuance of Safety Certificate to Public buildings like Cinema Halls,
Schools, Colleges, Marriage Palaces etc. The concerned Executive Engineer in whose jurisidiction a public building falls
issues safety certificates to the owners satisfying him self with the various safety
parameters and guidelines issued by the Govt. from time to time.
