Summary of the Enquiry East Midlands Centre for Constructing the Built Environment (EMCBE) was established in 2004. The main objective of the Centre is to improve the social, economic and environmental performance of the East Midlands construction Industry. More details about EMCBE and their services are available at their website: www.emcbe.com. EMCBE is organising an International Seminar on ‘Opportunities for Design in the Built Environment’ on 20 March in Derby. This seminar is designed specifically for UK businesses operating in the built environment sector focussing on five key construction markets namely China, India, Ireland, Qatar and Poland. EMCBE is planning to table the specially commissioned market intelligence report of the five key construction markets mentioned above at the Seminar. With this objective in mind, EMCBE has commissioned an OMIS with the following scope: • A general overview of construction sector (size of the market, structure

India – Construction Sector – Overview

General Background The construction industry in India is worth over USD 51 billion (£28 billion) and accounts for more than 20% of GDP. It is also the largest employer in the country after agriculture, employing approximately 31 million people. (Source: Construction Industry Development Council – CIDC). India is the second most populous country in the world with over 1 billion people and constitutes 16% of the world’s population. There has been significant growth of the urban population over the past decade. For example, there are:

• 6 cities with over 4 million (Delhi, Mumbai, Chennai, Kolkata, Bangalore and Hyderabad);

• 23 metro cities with over 1million; and

• 300 towns with up to 0.1 million The organised real estate business in India is estimated at £ 8.25 billion and is currently ranked 12th in the world, but is growing at a compound annual growth rate (CAGR) of 30%. (Source: India Brand Equity Foundation - www.ibef.org). Consistent high economic growth, a shortage of residential and commercial space, a booming retail industry and strong growth in industrial output have all contributed to record levels of activity and investment in this thriving sector. The decision by the Government to allow 100% FDI in real estate in 2005 has led to significant additional interest and growth, both in the real estate and construction sectors. Major international real estate companies are now looking to India to help drive their business growth. Building Materials Building materials such as steel, glass, aluminium, paints, tiles, electrical products, stand as additional indicators for the growth in the construction sector. Products such as cement and tiles which are directly dependent on the construction sector are witnessing growth of around 13% per year. Other products and commodities e.g. steel, glass, paints and aluminium (ACP and extrusions) are growing at 11%, 12% and 14% respectively. Characteristics of Market The Indian construction sector which remained unorganised until 2004 witnessed major changes lately which have been driven primarily by dynamic policy interventions, free-flowing cross-border capital, entry of large

International players, capital market funds and increasing end-user demands. The industry is also trying to move up the value chain and in order to achieve this, companies are going through a process of consolidation as well as integration. This is evidenced by infrastructure companies moving in to developer space and real estate companies having a diversified portfolio. Many of these companies are also tapping international capital markets for funds and the sector has attracted considerable amount of funds from Private Equity players. As a result, the sector is becoming more mature and increasingly competitive leading to strategic alliances and collaborations. The growing sophistication in the sector and a significant level of activity in the infrastructure space has created new opportunities for UK companies in the area of designs, structural engineering, project management and supply of high-end construction products. To capitalise on these opportunities, the UK construction industry needs to be positioned to take advantage of them in the medium and longer term. Key Methods of Doing Business Market strategy: UK companies keen to compete and win business in India should ideally:

• Evolve a long-term strategy – a sustained market presence is key to success.

• Choose the right customer or partner (e.g. projects in States such as Bihar and Jharkhand need a more cautious approach).

• Keep product pricing firmly in mind. India is a competitive market and price is very often the only issue that is considered when selecting a bid.

But clearly India is not a market for everyone. In many areas India has its own capability and expertise, often at a fraction of the price of international competitors. It is therefore important that UK companies identify the areas in which their product or service can succeed and target these strategically. UKTI offices across India can help make sure your company gets this right first time to avoid costly mistakes (see below). Challenges in the market:

• Price is often the only consideration for many projects, products or services

• A long term approach, including a presence in market, can be vital to success in the Indian market

• Having the right partner, agent or distributor can make or break your plans.

• The bureaucracy of government can be a challenge

• Payment terms, particularly in States like Bihar and Jharkhand need to be agreed carefully to avoid delays.

In a diverse market like India, it is important to have the right market strategy. It is often very difficult or costly to retract if wrong decisions are made. This can also have long-term and damaging reputational implications which can harm longer-term prospects. This is particularly true in the construction sector which tends to require overseas companies to have a longer-term presence in the market before business is won. India is clearly undergoing rapid and constant change and the business environment, availability of goods and services and opportunities in the construction sector reflect that change. British companies which have tried (and sometimes failed) to do business with India in the past are amazed at how quickly things have changed, mostly for the better, since they were last here. Private sector opportunities which would have been unthinkable 20 years ago, are now embedded realities.

Opportunities for UK firms in the construction sector

Housing: Nearly 75-80% of all real estate development taking place in India is in the housing sector. The rising income levels in the country have led to a huge unmet demand for dwelling units. According to Housing and Urban Development Corporation (HUDCO), the shortage in dwelling units as of 2002 was close to 30 million. This has given rise to major township developments in metropolitan areas which is also spilling into tier – II cities. With 40% of India expected to be living in urban areas by 2010, there is an estimated requirement of 3000 townships by 2030. Development of large townships open new avenues of partnership between Indian and overseas companies. Besides dwelling units, the housing segment is also witnessing emergence of luxury/leisure homes, resort houses such as golf homes etc. across the country. The high-end housing accounts for 15% of the total housing market. Many of the developers in such higher segment of the market have tied up with overseas architects and designers such as Arcop architects, Jurong, Pacific course design Australia, Greg Norman and Callison Inc. Opportunities: Design, landscaping and interiors. Commercial Infrastructure Commercial infrastructure covers IT and ITES buildings, industrial townships like Special Economic Zones (SEZs), retail malls, entertainment infrastructure like multiplexes, hotels and hospitals which accounts for 15% of the construction activity in India. IT & ITES: The single most important trigger in the demand for office space is the phenomenal growth in the IT and ITES sector which has been growing at an average of 25% annually for the last few years. Nearly 70% of the demand for office space is from the IT sector. The supply of office space is estimated to be around 45-50 million sq.ft at present. With the growth in the economy, India needs additional office space of nearly 350 million sq.ft. in the next 5 years. Retail Space: The retail boom in India is of recent origin and is on an ascending path. The retail industry in India is estimated to grow from its present size of a little over £150 billion to nearly £275 billion by 2011. Although, organised retail accounts for less than 4% of the total retail market at present, it is expected to touch around 20% by 2011. Major Indian corporates like Bharti, Reliance, Aditya Birla group, RPG and Indiabulls are entering the sector. From 137 operational malls covering 28 million sq.ft today, the country is expected to have 525 malls covering 140 million sq.ft by 2011 (source: ICICI Home search). like JHP, Astound and Fitch are working in the Indian retail space. On the development side, Indian companies like DLF, Vipul and Ansals are tying up with international construction companies for project management to ensure timely completion and delivery of projects. A development closely linked to malls is that of multiplexes. Often, malls and multiplexes co-exist in the same venue. As of 2006, India had 130 multiplexes which accounted only for 4-5% of the total screen. However, with nearly 10% of the urban incomes being spent on entertainment, this segment is set to grow rapidly. According to a study by Federation of Indian Chamber of Commerce and Industry (FICCI) and PWC, the Indian media and entertainment industry is expected to grow at a CAGR of 19% to touch close to £ 10 billion (source: India construction report). Indian companies like PVR Cinemas, Essel Group, Adlabs and Inox are major players in the segment. Another area of opportunities for UK companies is the Indian Hotel Industry. The revenues of the Hotel and Restaurant industry at £7 billion during 2006-07 had registered a growth of around 21% over the previous year. The industry is expected to grow even faster in the coming years with 70,000-80,000 rooms getting added in the next two years. At present, there are 110,000 hotel rooms and the industry is estimated to require an additional 150,000 rooms. Opening up of the aviation industry, Government’s decision to upgrade a number of smaller airports in the country and the forthcoming Commonwealth games have all added further impetus to the growth in this segment. Big hotel chains like JW Marriott, Hilton, Accor and Hampshire are a few names that are tying up with local partners to enter the market. Opportunity: design, interiors, facility planning and maintenance and project management Special Economic Zones (SEZs): Government of India announced the SEZ policy in the year 2000 and enacted the SEZ act in the year 2005. Since then, 395 SEZs have been notified and 154 have been approved. These are specially designated duty free zones and are deemed to be foreign territories for the purpose of trade. The minimum prescribed area for a multi product SEZ is 1000 hectares which are expected to provide world class infrastructure for the tenants. A number of overseas companies like Nokia, Flextronics, Motorola, Samsung and Adidas have shown interest in single product SEZs. The Nokia SEZ is already functional and the Adidas-Apache SEZ is nearing completion. These are large integrated industrial complexes which provide huge opportunities for UK expertise in the areas of master planning, design and facilities management. Major Infrastructure: India’s infrastructure has seen major developments in the last few years to keep pace with a fast growing economy. The country requires a total investment of around £ 185 billion in infrastructure in the next five years. Projects like roads and airports also offer opportunities for consultants and project management companies from UK. At present the annual expenditure on road construction is about £ 2 billion. With an additional road length requirement of 67,000 kms by 2015, the expected investments in roads is over £ 27 billion. Likewise, airports require a total investment of £5 billion both for modernisation and development of new airports. Two airports at Delhi and Mumbai have been privatised and two more airports at Chennai and Kolkata are due for privatisation. In addition, Government has taken a decision to upgrade as many as 28 regional airports. Opportunity: design, structural engineering, project management Green building and sustainable construction: The green building movement in India started with the setting up of the Indian Green building council in 2001. India follows two rating systems for green certification. The first one is the LEED rating system being implemented by the Green building council and the second one is an indigenously developed rating system called GRIHA being administered by TERI. The first LEED certificate was given to CII Sohrabji Godrej Green Building Centre in Hyderabad in 2004. Since then the concept has gained momentum. As of 2007, nearly 70 projects with a total area of 32 million sq.ft were registered for green certification (Source: JonesLang Lasalle Meghraj). Nearly 50% of the green buildings today are in the IT & ITES sector. However, the movement is spreading to residential, healthcare, hospitality and even some infrastructure projects. Opportunity: certification systems, intelligent design, interiors and facility management Urban regeneration: The growth in the urban population and acute short supply of land in urban India have given rise to a rising number of urban regeneration projects. Nearly 500 acres of textile mill lands in Mumbai are with real estate companies for multi-use development of these lands. In addition, palaces in Rajasthan, Gujarat, Madhaya Pradesh, historical sites in Kolkata and resettlement of slum clusters across India offer ample opportunities for urban regeneration in the country. Kamala Mills compound conversion in to office space (Mumbai), Phoenix Mills in to a shopping mall (Mumbai), ITC hotel in

lower Parel, Mumbai, Dharavi slum resettlement (Mumbai) and Bata Nagar (Kolkata) are a few examples of urban regeneration projects. Urban regeneration has caught the imagination of even government departments who are now thinking of putting large tracks of land in their possession to commercial use. The examples are defence land (cantonment), land with railways and postal department. The postal department has recently formed a Special Purpose Vehicle (SPV) called Postal Department Corporation for this purpose. Opportunity: concept planning, design and project management.

Political Climate India is the largest democracy in the world. It is a sovereign democratic republic and has a parliamentary system of government with a federal structure. The central government in New Delhi has exclusive jurisdiction over all matters of national interest such as defence, communication, banking and finance, international trade and foreign affairs. The state governments have primary responsibility for matters such as law and order, education, health and agriculture. Political climate is stable, although the current ruling government is a coalition of several political parties, which came together to form the National Democratic Alliance. Typically, the term of an elected Government is for five years and the country has a well established tradition of elected Governments coming to power. Even though different political parties have been in power at the Centre, there has been a reasonable amount of continuity and certainty on the policy aspects particularly relating to economic reforms. Business Visa

Business visa is valid for six month or one/more years with multiple entries. However, the period of stay in India (for each visit) under this category is limited to six months only. A letter from the sponsoring organization indicating nature of applicant's business, probable duration of stay, validity of visa, places and organizations to be visited and also a guarantee to meet maintenance expenses etc. should accompany the application. Business visa valid for ten years with multiple entries is available to foreign businessmen who have set up or intend to set up joint ventures in India.

Residential Permit All foreign nationals are required to register with the local immigration authorities called the Foreign Regional Registration Office (FRRO) within 14 days from their date of arrival, if their visas are valid for longer than six months. A foreign national holding a visa valid for six months or less who wants to stay in India beyond the period of validity must register within 14 days after 180 days from the time of arrival in India subject to holding a visa for the extended period. To register with the local registration office, certain prescribed documents must be presented. The original passport and visa are also required at the time of filing the application with FRRO. Registration is valid for the term of the visa and many be extended on application. Failure to register may result in the Immigration authority’s refusal to allow the foreign national to leave the country.

Employment Visa

For employment visa, an appointment letter, contract letter, applicant's resume and proof that the organization is registered in India are required. Duration of visa would depend on the period of the contract.

Entry visas are issued to accompanying family members of individuals visiting India on business or for employment. Spouses or dependants of

working expatriates must obtain separate work permits to be employed in India. Family members intending to reside with the working expatriates must register separately at the local registration office.
