2. The Applicant has challenged the transfer order dated
09.08.2021 whereby he is transferred from the post of Circle
Officer, Wadala, Tahasil Office, Dist. Solapur to Circle Officer,
Ghodegaon Circle, Tahsil Office, Barshi, Dist. Solapur.
3. The Applicant contends that he has not completed
normal tenure of six years but transferred mid-term and mid-
tenure. He further contends that he is suffering from 40%
disability of visual impairment in both eyes, and therefore, his
options ought to have been considered preference wise.
4. Learned Counsel for the Applicant however fairly
concedes that the Applicant has been relieved and joined at
Godegaon Circle. This being the position, now the question
of interim relief does not survive.
5. However, O.A. has beetwar-0(pedited since prima-
facie the Applicant is transferred, as if, he is due for general
transfer as seen from the transfer order dated 09.08.2021.

6. Learned P.O. therefore directed to take instructions
and to file reply by next date. In the meantime, issue notice
before admission returnable on 28.10.2021.
7. Tribunal may take the case for final disposal at this
stage and separate notice for final disposal shall not be
issued.
8. Applicant is authorized and directed to serve on
Respondents intimation/notice of date of hearing duly
authenticated by Registry, along with complete paper book of
0.A.. Respondents are put to notice that the case would be
taken up for final disposal at the stage of admission hearing.
9. This intimation/notice is ordered under Rule 11 of the
1988, and the questions such as limitation and alternate
remedy are kept open.
10. The service may be done by Hand delivery, speed
post, courier and acknowledgement be obtained and
produced along with affidavit of compliance in the Registry
within one week. Applicant is directed to file Affidavit of
compliance and notice.
11. In case notice is not collected within three days or
service report on affidavit is not filed 3 days before
returnable date, Original Application shall stand dismissed

2. The Applicant has filed the present O.A. seeking
direction to the Respondents to consider his representation
for transfer in view of Circular dated 11.07.2000 which inter-
alia provides for preference to Government servant who has
worked in tribal area.
3. The Applicant joined as Sub-Inspector, Excise
Department at Palghar in August, 2018 and admittedly has
not completed his normal tenure so as to consider him due
for transfer.
4. Insofar as Circular dated 11.07.2000 is concerned, it
speaks about giving preference to choices given by a
Government servant who have worked in tribal area. Indeed,
as per Para 2 of Circular dated 11.07.2000 where a
Government servant of Group C & D have worked for three
years in tribal area then they should be given posting as per
their choice. It further provides where a Government servant
of Group A & B worked for two years in tribal area, they
should be also given posting as per their options. Thus, it is
quite clear that Circular dated 11.07.2000 has to be
considered when a Government servant is due for transfer
whereas in present case, the Applicant was not at all due for
transfer since has not completed normal tenure in the
present post. Therefore, O.A. itself is premature and not
maintainable.
5. The Applicant is at liberty to make representation be
which would dealt with by the Respondents in accordance to
rules.
6. No order as to costs.

3. When the matter was taken up for consideration of
interim relief and admission, learned Counsel for the
Applicant states that his client is also ready to go to Mahad or
Dhule or in Palghar District. Therefore, interim relief to the
extent of non posting of a Government servant in place of the
Applicant at Nashik was only granted and the matter was
adjourned to explore further development.
4. Today, learned P.O. has tendered the file which
shows that the Civil Services Board as well as the Hon'ble
Chief Minister has approved the modification in the transfer
order posting him at Mahad.
5. Learned P.O. on instructions further submits that the
order to that effect will be issued tomorrow.
6. Thus, now the Applicant is being posted at Mahad as
per his option and grievance stands redressed.
7. In view of above, O.A. is disposed of with no order as
to costs.
8. Interim relief granted by the Tribunal on 16.09.2021
stands vacated.

She submits that proposal for provisional pension from 1.12.2020 to 31.5.2021 has been send to the Treasury and will be deposited in the account shortly. As far as fixation of pay as per 7th Pay Commission is concerned, it cannot be fixed.
3. We have perused the short affidavit dated 28.9.2021 of respondent no.4 and as per chart at page 82, payment is made under 9 (nine) heads.
4. Ld. Advocate for the applicant submits that he wants to approach the Court, which had passed the order dated 5.3.2021 in the above OA for clarification as to what benefits can be paid during pendency of criminal case.
5. Ld. Advocate for the applicant is, directed to show specific provision or rule that pay fixation can be done during pendency of the criminal case and so also commutation benefits.
6. It is expected from the State to continuously pay well in time the provisional pension and the applicant should be required to approach the Tribunal for this purpose.

2. Ld. Advocate for the applicant has filed this MA No.120 of 2021 in above OA No.105 of 2020 for condonation of delay. He submits that respondent no.2 passed the impugned order on 14.12.2017 which was not communicated to the applicant and he came to know the same when respondent no.3 passed the impugned order dated 7.5.2018 based on the order dated 14.12.2017. The applicant has received the order dated 14.12.2017 on 7.5.2018. However, before passing the order dated 7.5.2018 the applicant has approached the Hon'ble High Court by filing W.P. No.1283 of 2018 on 21.12.2017 for pursuing legal action as per law of limitation. Therefore, this period has to be excluded. However, there is still delay of 9 months in filing OA.
3. Ld. PO opposes the MA for condonation of delay.
4. Looking into the facts of the matter, we condone the delay in the interest of justice as the applicant was pursuing legal remedy in the Hon'ble High Court.
5. MA for condonation is allowed.

2. The applicants are seeking directions to the respondents to revise the pension of the applicants countirw 25% of Non Practicing Allowance of basic pay under the 01 Pay Commission w.e.f. 1.1.2006 and counting the 35% Non Practicing Allowance of basic pay under the 6th Pay Commission w.e.f. 7.12.2012 with arrears.
3. The office objections, if any, are to be removed and court-fees to be paid, if not already paid.
4. Issue notice before admission returnable on 23.11.2021. The respondents are directed to file reply.
5. Applicant is authorized and directed to serve on Respondents intimation/notice of date of hearing duly authenticated by Registry, along with complete paper book of O.A. Private service is allowed in view of this present COVID-19 Pandemic situation. Respondents are put to notice that the case would be taken up for final disposal at the stage of admission hearing.
6. This intimation/notice is ordered under Rule 11 of the Maharashtra Administrative Tribunal (Procedure) Rules, 1988, and the questions such as limitation and alternate remedy are kept open.
7. The service may be done by hand delivery/ speed post/courier and acknowledgement be obtained and produced along with affidavit of compliance in the Registry within one week. Applicant is directed to file affidavit of compliance and notice.
