AB 144 (Naylor, 1985) requi res that the court consi der a blood al cohol
concentration (BAC) of .20~ or more as a special factor to consider in enhancing penalties when sentencing drunk drivers. This interim report (due
six 'months following enactment of AB 144) summarizes the tabulations of sanction severity by BAC level for first DUI, offenders, both prior and
subsequent to the enactment of AB 144 and by the offender's license status at the time of the OUI arrest (valid'y! suspended license). Due to apparent
data discrepancies in the sanction dispositions of second OUI offenders, the
results of the second offender analysis are not included in the interim

AS 144 (Naylor, 1985), enacted on September 30, 1985, requires that the court consider a blood alcohol concentration (BAC) of .20% or more or a refusal to take a chemical test as a special factor to consider in enhancing penalties when sentenci ng OUI offenders 0 Thi s bi 11 also requ~ red the Department of Motor Vehicles to compile statistics on the disposition of cases by reported BAC levels and to produce an interim and final report, at the end of six and
~~ twelve months, respectively, following the enactment of AS 144. The complete bill is shown in Appendix AD
The purpose of thi s interim report is to summari ze the data coll ected to date. Tabulations of sanction severity by BAC level are provided for first offenders prior and subsequent to enactment of AB 144. As requested by the bil1~ the report also tabulates the sanction and BAC distributions by license status (invalid vSo valid). Results·for the second offender analysis were not included in the interim report due to apparent discrepancies in the second offender disposition information contained on the Department I sOUl offender data baseo
Because of the interim nature of the report and the short post-AB 144 fflllowcoup perio"d p no attempt is made to interpret the results or draw conclusions regarding the impact of AS 144 on DUI sanction severity. Formal Iitests of significance ll have not been applied to the data nor has any attempt been made to evaluate variations across county_ These analyses will be made in the final report 0

Reporting of BAC Levels Although the cou~ts are required by law to report BAC levels to OMV "when it (the· information) is readily available to the clerk of the court," (CVC 1804) the data notibly indicate that court reporting of SAC levels is not very complete. Table 1 shows that the percentage of subjects with reported BAC levels in the pre-AB 144 period was 41.5 while it was 40.7 in the post-AB 144 period. Since only 9 to 10% (Sadler, 1985) of all persons arrested for OUI refuse to submit to chemical testing, the majority of the non-reporting represent court procedural problems or the court's decision not to report the information. This low level of reporting limits the validity of these statistics, particularly if reporting were selective (e.g., higher BAC levels mi ght be reported more often than low BAC 1 evel s or vice-versa). The results, therefore, may not be applicable to the entire population of offenders with BAC levels of .20 or more.

Disposition Code Combinations When an offender is convicted of a DUI offense, the court determines the sancti ons to be imposed upon the DUI offender, and these sancti ons are indicated by the disposition codes on the abstract of convictions. Typical patterns of disposition combinations are shown on the attached tables. The code's 1 isted here comprise the sanctions of primary interest, although
~ additional disposition codes are reported on each conviction abstract. For example, most DUI offenders pay a fine, but the code indicating 'fine' is not shown here.. It should be noted that the license suspension disposition
. categori es (D, X or Y) do not represent !ll suspended offenders since DMV suspends the license of offenders in certain cases regardless of the court's recommendation. Specifically, the vehicle code requires that all second offenders in the GJ, J and "all other" sanction categories be suspended by DMV. First offenders who show any codes without probation (G) also must be suspended by DMV $ whereas DMV woul d not suspend those gi ven probati on (G) unless a 0, X or Y is shown. In 1982, a change in the law (CVC.13201.5)
repealed the courtls authority to suspend licenses (D), but some D's continue to appear on driver records.
first DUI Offenders Tabl e 2 shows the frequency counts and percentages of fi rst OUI offenders with valid licenses(l) who received various 'court-ordered sanctions. The upper table represents drivers whose OUI convictions occurred before AB 144 while the lower table displays the corresponding numbers and percentages for drivers whose DUI convictions occurred after the enactment of AB 144. It is evident from Table 2 that 70~ of first OUI offenders from both time periods, where SAC levels were reported, have BAC levels below .20c.t while about 30% have reported SAC 1 evel s above .20%. The 1 argest proporti on of fi rst offenders in both time periods received the sanction of license restriction (90 days) plus program (GSTVQ). However, when comparing the two time periods, th'e percentage of post~~B 144 subjects receiving the restriction plus program sa~ction was lower (44.4%) than those (49%) in the prior time

Looking at both the upper (preaAB 144) and lower (Post AS 144) tables, it is evi dent that the 1 argest percentage of these drivers, reagardl ess of BAC level, received the program pllts jail sanction (GQJ). In the post-AB 144
period~ 66% of those with high BAC levels received this sanction as compared to 5203% of those with low SAC levelso In contrast, the pre-AB 144 period showed an opposite trend with lower BAC subjects more often given a jail sanction. As might be expected~ a comparison of Tables 2 and 3 shows that the 11 cense suspens ion recommendati on was more often app 1 i ed to offenders with invalid licenses than to those with valid licenseso There was a correspondi~g redurtion in the use of the license restriction plus program sanction (GSiVQ) for offenders with suspended licenseso

Dispositions by County
Although tables of sanction codes by county are included in Appendix B for first offenders, the small sample size does not permit adequate interpretation of the findings. These tables were included primarily to indicate the structure and scope of the infonnation to be provided in the finai report. The final report will also include county tabulations for second offenders .
Conclusions and Scope of Final Report For the reasons cited, it was not the intent of the interim report to offer conclusions and interpretations. There is some evidence, however, to show that among first offenders high SAC drivers tend to receive enhanced sanctions and that this trend increased following AB 144. Nevertheless, the trends are not very dramatic and require additional data and analysis before conclusions can be drawn. The final report will include about six months of additional data for both pre- and post- AS 144 periods. it will also analyze the trends with; n counti es and will e~j1pl oy fOi"!1lal tests of si gn; fi cance in evaluating the reliab'ility of the relationship and the magnitude of the impact of AS 144 on the sanction patternso

An act to add Section 23206.5 to the Vehicle Code, r ~lating to driving offenses, and declaring the -qrgency thereof, to take effect immediately.

AB 144, Naylor. Driving offenses: blood-alcohol concentration. (1) Under existing law, a person convicted of driving under the
influence of an alcoholic beverage or drugs, 0'( both, with an excessive blood-alcohol concentration, or when addicted, is required to be sentenced, as specifi~ and may be granted probation by the. court. If granted probation, the time of probation is required to be 3 years, and the terms and conditions of probation are required to include at least specified incarceration periods, minimum fines. and, for some 1st and 2nd offenders, specified drivers' license restriction instead of suspension, which minjmum terms vary with the number of convictions of prior offenses occurring within 5 years of the offense.
This bill would require the court to consider a blood-alcohol concentration of 0.20% of, or a refusal to take a chemical test by, a person convicted of any of those offenses as a Special factor which may justify enhancing the penalties, or determining whether probation is granted, and, if granted, in determining the terms and conditions of probation.
(2) The bill would also require the Department of Motor Vehicles to compile and provide an interim report regarding specified statistics to the Legislature on December 31, 1985, or within 6 months after the effective date of the bill, whichever is later, and provide a final report regarding speci£ied statistics to the Legislature on June 30, 1986, or within 12 months after the effective date of the bill, whichever is later. .
(3) The bill would take effect immediately as an urgency statute.
The people of the State of California do enact as follows:
SECI'ION 1. Section 23206.5 is added to the Vehicle Code, to read:
23206.5. In addition to any other provision of this code, if any person is convicted of a violation of Section 23152 or 23153, the court shall consider a concentration of alcohol in the person's blood of 0.20 percent or more, by weight, or the refusal of the person to take a chemical test as a special factor which may justify enhancing the

penalties in sentencing, in determining whether to grant probation, and, if probation is granted, in determining additional or enhanced terms and conditions of probation.
SEC. 2. The Department of Motor Vehicles shall com,pile statistics on the reported disposition of cases in which the reported concentration of alcohol in the blood of a driver is 0.20 percent or more by weight and shall provide the Legislature an interim report on the results of the compilation on December 31, 1985, or within six months after the effective date of this act, whichever is later, and provide the Legislature a final report on the results of the compilation on June 30, 1986, or within 12 months after the effective date of this act, whichever is later.
The reports shall contain, to the extent practicable, a comparison of dispositions during the year prior to the effective date of this act with dispositions after that date, The reports shall also distinguish between dispositions of cases involving:
(a) Bloodaalcohol concentrations below 0.20 :Percent with those above that level.
(b) First: and second offenders, (c) Persons who drive without a valid license and those who drive
with a valid license. This section shall become inoperative 12 months after the effective
date of this act and, as of January 1. 1987, is repealed, unless a later enacted statute, which becomes effective on or before January 1, 1987, deletes or extends !:he dates on which it becomes inoperative and is repealed.
SEC. 3. This act is an urgency statute necessary for the immediate preservation of the public peace, health, or safety within the meaning of Article IV of the Constitution and shall go into immediate effect. The facts constituting the necessity are:
In order for the requirements of this act, which require the court to cansider greater alcohol consumption before driving as a more serious crime, to become effective as soon as possible, and to permit the Department of Motor Vehicles to complete the statistical study required by this act in the time required, it is necessary tilat !:his act take effect: immediately,
