THE YEAR 2017 IN REVIEW

The lllinois Racing Board ("Board"), an independent agency of state government, enforces the lllinois Horse Racing Act of

1975 (230 ILCS 5/) ("Act") and its administrative rules (Title 11 of the Administrative Code), to ensure the safety and integrity of pari-mutuel horse racing in Illinois. The Illinois General Assembly establishes public policy in tht> area of horse racing regulation that is enforced by the Board. The Board licenses racetracks, off-track wagering facilities, advance deposit wagering companies, allocates race dates, and is also responsible for licensing, rulemaking, and supervising the conduct of race meets. The Board also oversees all pari-mutuel activity and ensures the proper allocation and distribution of revenue generated by pari-mutuel wagering.

All persons participating in pari-mutuel racing under the jurisdiction of the Board are required to be licensed. Before a license is issued, every application is reviewed and carefully processed by the Board's licensing department. The Act also requires fingerprinting of each occupation license applicant. The Board may deny an application for licensure of any person whose criminal record is contrary to the public's best interest.

A staff of administrative, regulatory, security, and veterinary professionals, in conjunction with Board approved racing officials, supervised the activities at three racetracks conducting pari-mutuel horse racing. Each race conducted at an lllinois racetrack is observed by three stewards, two employed by the Board, one employed by the organization Licensee (racetrack). The stewards observe the races to ensure that all conduct is in accordance with the Act, rules, and regulations.

The Act requires the Board to file a written annual report with the Governor. The report is required to include the industry's progress toward the following policy objectives established in Section 1.2 of this Act:

1. Support and enhance fllinois 'horse racing industry, which is a significant component within the agribusiness industry. Sections 30 and 31 of the Act promote the breeding, buying and racing of thoroughbred and standardbred horses in Illinois, preserving the agribusiness segment of the Illinois economy. Purse supplements, owners awards, and breeders awards are paid to owners and breeders of winning horses in certain races limited to Illinois conceived and foaled horses. 2. Ensure that fllinois ' horse racing industry remains competitive with neighboring states. Through the rulemaking process established by the Illinois Administrative Procedure Act and supervised by the Joint Committee on Administrative Rules, the Board creates new rules and amends existing rules to be more unifonn, consistent, and competitive with other major racingjurisdictions. In recent years, the Board has concentrated on rules regulating wagering and medication. 3. Stimulate growth within Illinois ' horse racing industry, thereby encouraging new investment and development to produce additional tax revenues and to create additional Jobs. The Board strives to foster an environment that creates jobs and generates important revenue to the State of Illinois by encouraging racetracks to make use of their vacant off-track wagering licenses. 4. Promote the farther growth of tourism. To ensure that adequate funds are devoted to the marketing of horse racing, the Board requires that each applicant for licensure to operate a race meet ( e.g. organization licensee), submit a proposed advertising and promotional budget during the licensing process. 5. Encourage the breeding of thoroughbred and standardbred horses in this State. Pursuant to the Act, breeders awards have been estab1ished to promote the breeding of thoroughbreds, standardbreds, and quarter horses by Illinois residents.

6. Ensure that public confidence and trust in the credibility and integrity of racing operations and the regulatory process is maintained. Public confidence is essential to a vital horse racing industry. The licensing of all persons participating in pari-mutuel racing and the testing of post-race equine samples are necessary components of the Board's regulatory program. Urine and blood samples are obtained post-race from the winner of every race, the horses finishing second and third in stakes races, and from any other horses selected by the stewards based on current and past performance.

The Board is a member of the Association of Racing Commissioners International ("ARC!"), the industry's oldest and most prominent regulatory association. The information contained in the ARCI database allows the Board to monitor the backgrounds of applicants and licensees and to exchange important regulatory and industry information with other jurisdictions.

In 2017, the Illinois handle on all racing was $586,691,745 (257 race programs). In 2016, the handle was $570,507,635 (290 race programs), an increase of 3%. In 2017, the total handle for advance deposit wagering (ADW) on all racing was $190,284,417. ln 2016, the ADW handle was $165,999,800, an increase of almost 15%.

The Board is funded by the revenues generated from the pari-mutue1 handle (including ADW), admission taxes and license fees. The Board receives no funding from the State's general revenue fund.

A total of $33,793,350 was distributed in purses in 2017. Total thoroughbred purses were $25,024,819 (169 race programs) compared to $23,879,736 in 2016 (180 race programs). Arlington Park averaged $209,966 per program (+6%), Hawthorne Race Course averaged $136,810 ( + 19% ), and Fairmount Park averaged $54,557 (+5%). Total standardbred purses were $8,768,531 (88 race programs) compared to $7,934,835 in 2016 (110 race programs). Hawthorne Race Course (Suburban Downs) averaged $97,029 per program (+21%).

The Board supplemented organization licensee purse accounts $500,000 in 2017. It was

the intent of the Board to use these funds to promote 11linois horse racing, pursuant to Section 1.2 of the Act, and to allocate the funds to the four purse accounts (Arlington Park, $259,662; Hawthorne Race Course, $82,457; Suburban Downs, $120,406; and Fairmount Park, $37,475) in the most transparent method possible. Also, in an effort to improve Illinois racing, the racetracks committed to shifting purse money from their stakes programs to overnight races.

The Board published a Notice of Funding Opportunity ("NOFO") for its annual $750,000 11linois Racing Charity Grant ("Grant"), pursuant to Illinois' Grant Accountability and Transparency Act. The Board received two applications for this Grant. Pursuant to Section 31.1 of the Illinois Horse Racing Act, the Board approved a Grant for 2018 in the amount of $750,000 to the Racing Industry Charitable Foundation, Inc.,

Public Act 99-891, effective January l , 2017, amended Section 12.2 (Business Enterprise Program) of the Illinois Horse Racing Act

1n 2017, Governor Rauner made two appointments to the Board. Thomas McCauley was appointed in January and Edgar Ramirez in April. Mr. McCauley, a Chkago attorney at Nisen & Elliott, previously served on the Board in 2014 and Mr. Ramirez is the President and CEO of Chicago Commons, a not-for-profit social service organization.

On September 26, 2017, the Board voted unanimously to award 7 1 live thoroughbred programs in 2018 to Arlington Park, 55 programs to Hawthorne Race Course, and 41 programs to Fairmount Park. Suburban Downs was awarded 112 live harness programs.

Pursuant to an Executive Order (2016-03), all agencies under the jurisdiction of the Governor sha11 conduct a comprehensive review of their administrative rules. ln 2017, the Board began this "Cutting the Red Tape Initiative" by amending and repealing rules, according to the guidelines contained in the Executive Order.

The Board issued 237 rulings for violations of the Board's rules and regulations at both thoroughbred and standardbred racetracks.

Laboratory

Over the past year the University of Illinois at Chicago Analytical Forensic Testing Laboratory has conducted one of the most comprehensive equine drug testing programs in the country. The laboratory continues to screen all urines and bloods using solid phase extraction with LC-MS-MS analysis. This method of testing is highly sensitive and allows the laboratory to screen for a wide range of substances. In addition, this switch from ELISA screening has greatly reduced the reporting times for these samples. The laboratory successfully cross-validated a new method to test for total carbon dioxide (tCO2) and published this research in a peer-reviewed journal. The laboratory uses this method to routinely tests for violations of total carbon dioxide levels.

The laboratory continues to assist the track stewards and security personnel in investigating possible doping violations that employ methods designed to circumvent our standard testing procedures. The laboratory also investigates and reports on special items such as syringes, drug vials and other contraband that are collected or seized at the racetracks.

In 2017, the laboratory attained full accreditation from the Racing Medication Testing Consortium. This is in addition to the laboratory's ISO 1 7025 accreditation. The laboratory successfully completed the International Proficiency Testing Program conducted by the Association of Official Racing Chemists with a score of 100%.

LICENSING

The IRB Licensing unit is comprised of three license clerks assigned to thoroughbred, quarter horse, and harness venues. During a licensed racing meet at any of three racetracks and State and County Fairs in the state, a licensing field office of the Board is established at the operating facility. WHATIBPURSERECAPTURE? Purse recapture is a 1995 provision of the law that allows racetracks to recoup losses on live handle brought on by the

authorization of full-card simulcasting of races from other states. Handle on Illinois races as a percentage of total Illinois handle (non-ADW) has dropped from 95% in 1994 to 14% in 2017. The recapture amount is 2% of the decrease of Illinois handle on Lllinois races from 1994. The recapture monies allocated to the racetracks are deducted from the purse accounts. In 1999, legislation was passed that authorized annual appropriations to the Department of Agriculture for reimbursement to purse accounts equal to the recapture amounts. 2017 ADVANCE DEPOSIT WAGERING (ADW) Advance Deposit Wagering officially began in Illinois on October 13th, 2009. Six companies were licensed in 2017 as ADW providers. Illinois patrons place funds into an account and then wager on races using a telephone or internet device such as a computer or smartphone. Each ADW provider must have a contract with an Illinois racetrack and their affiliated Illinois horsemen association. Bet America changed ownership on April 24, 2017 as they were purchased by Twin Spires from lien Games. Arlington remained their affiliated Illinois racetrack. Under lien Games, the handle was 1,287,501 from January 1st through April 23rd.
