Preface

Dear Ladies and Gentlemen, Dear Colleagues and Friends,

I am happy to present you with our second newsletter this year, in a new format, and inform you of the latest developments at IACA.

This issue features stories on IACA’s Assembly of Parties, the meetings of four of the organization’s organs, a high-level panel at the UN in New York, and two notable anti-corruption conferences held in the chambers

of IACA’s Palais Kaunitz-Wittgenstein.

You can also read about the impressions from Module VI of our Master in Anti-Corruption Studies in Kuala Lumpur, our Power of the Pen regional roundtable, and the Legal Incentives for Corporate Integrity Training.

Detailed information on the abundance of trainings we have scheduled over the next months is available in our IACA Programmes & Trainings Update and on our website. Assembly of Parties in Baku: 19 - 21 November

After Vienna in 2012 and Bangkok in 2013, IACA’s Assembly of Parties will take place in Baku this year, from 19 to 21 November. This follows a decision of the Bureau of the Assembly, which met in Bangkok in mid-May, generally accepting Azerbaijan’s generous offer to host this landmark event.

It is expected that the third session of the Assembly of Parties will focus on IACA’s budget and state ownership. Ways of meeting the requirements of the general budget, unanimously adopted by the constituency last year, on which the effective implementation of the Work Programme 2014 – 2016 is contingent, may be an important agenda item.

As in previous years, the Assembly will feature a high-level segment where ministerial representation is encouraged. Interested organizations will also have the opportunity to host side events alongside the three-day deliberations. More information will be circulated as the event draws closer. States wishing to be Parties in time for the third session of the Assembly of Parties and thus enjoy voting rights are called to deposit their respective instruments of ratification/accession at least 60 days prior to the event, i.e. not later than 19 September 2014.

Growing Number of Parties

With Malawi’s accession to the Agreement for the Establishment of IACA as an International Organization on 3 June, the number of Parties rose to 55. As the number of States Parties increases, IACA’s responsibility towards the populace it encompasses also grows.

Malawi is the fourth state from the African Regional Group to become Party to IACA’s founding treaty. Sixteen of the organization’s original Signatories are yet to ratify the agreement, while a number of other states have expressed interest in acceding to it in the near future.

High-Level Event on the Post-2015 Development Agenda

The UN General Assembly held a high-level event on the Contributions of Human Rights and the Rule of Law in the Post-2015 Development Agenda in New York on 9 and 10 June.

Upon invitation by the President of the General Assembly, IACA’s Dean, Martin Kreutner, took part as a panellist in the first multi-stakeholder discussion on exploring the contributions of human rights and the rule of law in supporting national and international efforts towards poverty eradication and sustainable development.

“It is impossible to look at corruption through any lens and miss the intrinsic link to human rights and development. All Sustainable Development Goals at stake run the risk of being severely undermined by corruption. On the other hand, good governance including a strong anti-corruption commitment can be a most essential anchor and lighthouse of national and international efforts towards poverty eradication and sustainable development”, he stated.

In response to financial constraints in times of a global financial crisis, he called for alternative ways of funding strategies, e.g., by promoting the let crime pay principle: “Member States may give special consideration to contributing a percentage of the money or a corresponding value of proceeds of crime or property confiscated to this cause. We are aware of the limitations,

but if only a single-digit percentage of these criminal proceeds could eventually be dedicated and facilitated accordingly, anti-corruption and development programmes with, e.g., the UN and IACA would be well-funded for decades and poverty eradication soon a worry of the past.”

He was joined by the Jan Eliasson, Deputy Secretary-General of the UN, the Honourable Asha-Rose Migiro, Tanzanian Minister of Justice and Constitutional Affairs, Chirstoph Strässer, German Commissioner for Human Rights Policy and Development Aid, and Nicholas Lusiani, Director of Human Rights in Development at the Center for Economic and Social Affairs. Irene Khan, Director-General of the International Development Law Organization, moderated the panel.

Meetings of the Board of Governors, Advisory Boards, and the Dean

During the first days of June, IACA’s Board of Governors, the International Senior Advisory Board (ISAB), the International Academic Advisory Board (IAAB), and the Dean came together for a collective meeting in Laxenburg.

Together, they discussed means of fundraising for IACA’s general budget, unanimously adopted by the constituency, and therefore allowing the organization to effectively fulfill its mandate.

The associated implementation of the Work Programme 2014 – 2016 and preparations for the third session of the Assembly of Parties were also topics of discussion.

The ISAB and IAAB also met individually to work on issues under their spheres of competence. Officers were also elected; Michael Hershman (United States) as the Chairperson and Huguette Labelle (Canada) as the Vice Chairperson of the ISAB, and Hans-Heiner Kühne (Germany) as Chairperson and Daniel Li Ming-chak (People’s Republic of China) as Vice Chairperson of the IAAB.

Power of the Pen: Africa Speaks

After a successful three-day Power of the Pen for the Middle East and North Africa (MENA) in 2012, IACA took the regional roundtable series to Accra, Ghana this year.

From 19 to 21 May, 18 journalists from Sub-Saharan Africa came together to explore the ethics, roles, and responsibilities of today’s journalism.

Anas Aremeyaw Anas, Ghanaian journalist acclaimed for his investigative works on human rights and corruption, Paul Radu, Executive Director of the Organized Crime and Corruption Reporting project, Samuel de Jaegere from UNODC, and journalist/scholar Kadija Sharife, were among the speakers.

International expert Suzanne Hayden guided the discussions on behalf of IACA and worked with the participants to extract lessons learned from Africa and beyond.

The Power of the Pen is co-sponsored by the US Department of State. It is planned that the roundtable series will continue into the future, catering to other parts of the world.

Master Programme: Impressions from Kuala Lumpur

Our Master in Anti-Corruption Studies (MACS) students returned full of impressions from Kuala Lumpur last month, where Module VI on enforcement took place.

With the intention to expose students to the practitioner as well as the policy and academic aspects of investigation, IACA agreed with its partner institution, the Malaysian Anti-Corruption Commission (MACC), for them to host the module and provide a substantial input into the delivery of the courses.

Besides IACA trainers, topics were covered by, e.g., the former Hong Kong Director of Public Prosecutions, the former Head of Investigations from the Independent Commission against Corruption (ICAC), the Head of the MACC, the UNODC/World Bank AML/CFT Advisor, and a number of regional experts.

The students have one more module to go before the submission and defense of their Master Theses and graduation at the end of the year. The next intake of the MACS will start in October 2014.

At IACA: Anti-Corruption Measures and the Protection of EU Financial Interests

On 15 May, representatives from European institutions, international organizations, national governments, and academia gathered at IACA for a conference on “New Challenges for Anti-Corruption Measures and the Protection of EU Financial Interests”.

This conference was organized by the Austrian Association for European Criminal Law and IACA, co-financed by the European Commission under the Hercule II Programme.

At IACA: Emerging Trends from Two Years of GRECO Round IV Evaluations

“I am reminded that someone once said that corruption is like a ball of snow. Once it starts rolling it becomes bigger and bigger until at some point it becomes unstoppable. But I disagree. Yes, corruption is likely to have increased in many European countries, but the means available to society for detecting it have also been bolstered. That is why, looking ahead, I am cautiously optimistic”. These were the words of the Council of Europe’s Deputy Secretary General, Gabriella Battani Dragoni, which set the pace for thematic sessions on emerging trends from GRECO’s Fourth Round Evaluations.

This conference took place on 10 and 11 April at IACA, jointly organized by GRECO, the Austrian Federal Ministry of Justice, and IACA.

Seventy representatives from GRECO Member States came together to take stock of national experiences and main findings in light of the Fourth Evaluation Round which focuses on assessing parliamentarians, judges, and prosecutors.

They reviewed policies, exchanged information and good practices, and identified future steps for strengthening institutional capacities. The Principality of Monaco provided substantial financial support for this conference.

Legal Incentives for Corporate Integrity Training

From 24 to 26 March, twenty-five seasoned professionals, from around the world, mainly from the private sector, participated in IACA’s Legal Incentives in Corporate Integrity Training, delivered in cooperation with UNODC.

The course examined how public sector action can serve to strengthen corporate integrity and prevent private sector corruption, through legal incentives, sanctions, and other integrity instruments.

Sandra Orihuela, one of the participants, listed cultural perceptions of corruption, the value of providing interpretative guidance tailored to each location, the effect of collective action, and the impact of rewarding good practices, as some of the takeaway lessons from the course. “Most satisfying

for me, I left IACA knowing that corruption is being actively opposed in each of the 25 countries represented at the training. My work is part of something much bigger -- and growing.“

The next Legal Incentives for Corporate Integrity Training will take place in spring 2015.

IACA Welcomes New Staff Members

Jong-Sam Yang (Republic of Korea) and Godwin Oche (Nigeria) joined the IACA team in May and June, respectively, as Senior Experts.

Their main responsibility is to contribute to the development of course content, case studies, and international best practices for IACA’s programmes and activities.

Mr. Yang is a seconded staff member from the Anti-Corruption and Civil Rights Commission of the Republic of Korea, where he held leading positions for more than ten years, charged with topics such as whistleblower protection, integrity assessments, and anti-corruption policies.

Mr. Oche is a seconded staff member from the Independent Corrupt Practices and Other Related Offences Commission of Nigeria, and has extensive corruption prevention, organizational assessment, and lecturing experience.

IACA also continues to attract qualified graduate students for internships, interested in applying their knowledge and gaining hands-on experience in an international environment. Richard Bärnthaler (Austria) and Alison Sheets (United States) are the latest such valuable assets to our team.
